Supervisor Mcltillop said he would attend and report back to the Board. 7~:-259 APPROVE BORROWING OF I'UNDS FP,OM FAMILY PI,ANNIPIG ACCOUNT COM£4UNITY ACTION AGENCY GOVERNING BOARD Don Woodworth, Executive Director of E.O.C., reported that the Regional OEO has authorized borrowing of $39,006 from the Family Planning account to cover approved operating expenses of the Community Action Agency. This borrowing to be repaid as soon as funds due from the treasury are received. Request discussed. Mr. Woodworth said this request to borrow funds was to solve the present cash flow problem, The request has been approved by the Administering Board, He slated that both the American Native Crafts Program and the Thermalito Multi Center program have been approved by the Administering Board, Jim Johanson, Auditor's Office, spoke on the matter of use o£ the Family Planning funds. On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, borrowing of $39,006 from Family Planning account to cover operating expenses of the Community Action Agency was approved, subject to the approval of County Counsel and theCounty Auditor. 74-260 RECORDS TO REFLECT THAT DON 1d00DW0RTH, EXECUTIVE DIRECTOR OF EOC E639HSPIEED idORK ON FEBRUARY 11tH RATHER THAN 15th. On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, the records of the County were changed to reflect that Don Woodworth, Ececutive Director of EOC, commenced work on February 11th, 1974, rather than on February 15th, 1974 as stated at time of his appointment. February 2&, 1974 February 26, 1974 CHAIRMAN MADIGAN WELCOMED THE STUDENTS OF LAS PLUMAS HIGH SCHOOL. 74-261 WAIVE FIP,ST READING OF SALARY ORDINANCE AMENDMENT Oa motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, the Board waived the first reading of the salary ordinance amendment affecting personnel changes in Drug Control, Auditor, Welfare and Mental Health departments. 74-262 APPROVE LEAVE OF ABSENCE: DORIS BYRAM On motion of Supervisor Gil[n~.an, seconded by Supervisor McKillop and unanimously carried, the non-compensated medical leave of absence for Doris Byram for the period February 12 through March 31, 1974. 74-263 AUTHORIZE ADVANCE STEP HIRING SHERIFF'S DEPARTMENT The Sheriff requests authority to fill the Regional Narcotics and Intelligence Coordinator position at the C step. This position is funded under the CCCJ grant. There is sufficient budget to cover advance step hiring. Mr. Rackerby explained the request. Request discussed. On motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, the filling of the Regional Narcotics and Intelligence Coordinator position at Range 23.5, Step C, $493 bi-weekly, was authorized. 74-264 BRUNING MACHINE DECLARED SURPLUS PROPERTX On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, an old Bruning copy machine ~~05974 located in the Assessor's office was declared surplus and the Purchasing Officer was authorized to dispose of said machine, 74-265 BUDGET TRANSFERS APPROVED On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, the following budget transfers were approved; 8-66 Central Services $10 from other transportation and travel to equipment B-68 Data Processing $4,100 to set up in the overtime account from unanticipated revenues which will be received from increased billings from outside users and county departments. B-70 Juvenile Hall $7 from other transportation and travel to Board authorized travel B-69 Welfare $2,500 from office expense to rents and leases equipment B-7l Planning $82 from special departmental expense to equipment B-72 Auditor-Controller $15,000 to establish the appropriation for the Personnel Manpower Planning Grant from Federal Funds, unanticipated revenue 74-266 REPORT ON REMODELING BIBS FOR SAFEWAY BUILDING Bids for remodeling for Safeway building were opened on Friday, February 22, 1974. Tom Struthers, Purchasing Agent, reported on the bids. A recap of the bids received was presented to the Board at this time. Mr. Struthers stated he had received a call from the Architect requesting that he be given another week to review the bids prior to making his report to the Board. His cursory review shows that the alternatives should be given some consideration. Alternatives set out by Mr. Struthers and discussed. Mr. Struthers stated they were not asking for a decision this morning; he requested that this matter be placed an the Board's agenda for Tuesday, Maxch 5th, 1974. February 26, 1974 February 26, 1974 74-267 AUTHO1dIZE FUNDS TO BE USED FROM GENERAL ASSISTANCE FUND FOR BURIAL OF VETERAN ON A LOAN BASIS Dan Blackstock, County Counsel, reported on the matter of the deceased veteran Sabo could not be buried due to lack of funds to pay the Oroville Cemetery District for the burial plot fees in the amount of $346. He said he had discussed the matter with the Cemetery District and they stated that they did not want to give credit for these burial lots; this amount has to be paid before the man can be buried. Mr. Blackstock said the Veterans~Service Officer was attempting to get funding from the Veterans Administration. The mortician is not asking for his payment; he stated that this amount would just cover the cemetery district fees. Mr. Blackstock set out what he has done to attempt to get this veteran buried. Supervisor McIZillop felt the Board should do something now concerning this problem. He feels that the County could use General Assistance funds on a one time action and not to set a precedent. Mr. Blackstock said this could be handled through General Welfare provisions. Situation discussed. On motion of Supervisor McIZillop, seconded by Supervisor Cameron and unanimously carried, the Board authorized $346 to be taken from the General Assistance fund and paid to the Oroville Cemetery District for the burial of this veteran, directed the Auditor to issue the draft today and deliver it to the cemetery district, with the understanding that this not be used to set a precedent, and that Bob O'Brien, Veterans Service Officer, follow through on this matter and return the funds to the County when the funds are received from the Veterans Administration and from the Social Security Department. 74-265 WAIVE FIRST READING OF ORDINANCE AMENDING AND ADDING CERTAIN PROVISIONS OF CHAPTER 20 of the BUTTE COUNTY CODE: DISCUSSED RESOLUTION AMENDING CERTAIN SUBDIVISION AND LANB DIVISION STANDARDS ESTABLISHED BY RESOLUTION 72-62 Dan Blackstock, County Counsel, reported on the Ordinance amending and adding certain provisions of Chapter 20 of the Butte County Code and the Resolution amending certain subdivision and land division standards established by Resolutinn 72•-62. He said a memo had been sent to the Board concerning the use of the set back areas. He felt the memo was self-explanatory. He set out the other modifications. Building standards discussed. The standards call for paving of the roads; the roads do not have to be paved unless it is going into the County's system. He explained hoca this section was modified to avoid any conflict of interpretation after the resolution or ordinance is adopted. Traversable defined. Time spent discussing the matter of traversable xoads. Mr. Blackstock set out other changes to the resolution and ordinance. Matter of findings discussed. RECESS: 1fl:30 RECONVENED: 10:45 Mr. Blackstock said if a motion was made concerning the ordinance, it should be made clear which provision would be used for set back purposes. Alternate one trould allow the use of the set back area unless there would be a health problem and Alternate two would prohibit the use of the setback requirement for use in connection with septic tanks. February 26, 1974 Page 293. February 26, 1974 County Counsel recommended that alternate no, 2 be approved as it is their opinion that this would be more consistent with the present interpretation. This is typed into the draft of the ordinance mailed to the Board members. Supervisor Cameron said that with this modification, it would mean that the setback area could 'net be utilized for secaer lines unless the applicant appears before the Board and obtains a setback variances Supervisor Ladd stated there were a couple of items he Caould like to have cleared up; one concerns the matter of water wells. The standards state that on parcels of less than five acres there would have to be definite proof of water. He said he would hate to see a lot of unnecessary wells drilled. Matter of wells discussed. Supervisor Ladd also questioned the septic tank requirements. Requirements discussed. P4atter of ~•rater ~oells and septic tank requirements discussed. It was the Boards feeling that these items should be left in the ordinance. On motion of Supervisor Gilman, seconded by Supervisor Cameron and una nimously carried, the Board waived the first reading of the ordinance amending and adding certain provisions of Chapter 20 of theButte County Code, as read, and placed the matter back on the agenda for Tuesday, March 5th, 1974, 74-269 APPROVED AMENDMENT TO JOINT POWERS AGREEMENT WITH TID RE COUNTY SERVICE AREA ;~26 Dan Blackstock gave some background on the agreement. It fo3;lows along the same lines of the 1971 agreement. Thermalito will operate and main- tain the sewers, Mr. Spruance of Minasian, Minasian, Minasian and Sgruance appeared to answer questions from the Board. He stated that the agreement in its present form was unanimously approved by the Thermalito Irrigation District Board last Thursday night. Qn motion of Supervisor McKillap, seconded by Supervisor Ladd and unanimously carried, the amendment to the Joint Powers Agreement with the Thermalito Irrigation District regarding County Service Area ~~2b was approved. 74-270 APPEARANCE: GENE MERCER FISH AND GAME COMMISSION RE HUNTING ON LAVE OROVILLE Mr. Gene Mercer appeared before the Board to answer questions about hunting on Lake Oroville. Supervisor Gameron explained his reasons for wanting Mr. Mercer present. The Fish and Game Commission had hunting on Lake Oroville scheduled for their March 8 meeting in San Francisco. Mr. Mercer explained that he had seen it but that he was at a loss to explain why it was on the agenda. He stated he was. personally opposed to any hunting on the lake, as were two other members of the Commission, There was some discussion about the letter Mr. Mercer wrote in his capacity as secretary of the Commission setting forth the proposal, Mr, E.E. H'.~ on, Fish and Game, appeared to apologize to the $oard for the item being placed on the agenda before the Board had time to discuss it. He said it was his intention to discuss this progosal with. them before it was publicly announced and put on the agenda but there was a lack of communication between their office and the main office. Page 294. February 26, 1974 February 26, 1974 Mr, Hudson explained the proposal for hunting around the lake and the .areas that would be off-limits to hunting. The hunting would be allowed from September 15 through January 31, during the regular hunting season, and would be on game animals, not waterfowl. These dates were picked to miss the high boating season on the lake. Mr. Hudson felt that this proposal was safe and reasonable. Discussion about requesting the item be taken off the agenda. Mr. Gerald Fialho, Parks and Recreation, appeared before the Board, Mr. Fialho stated that hunting on Lake Oroville is scheduled for their meeting in May at Fort Bragg. His department is going along with it because they thought that was the wish of the poeple. He explained that this proposal would allow the hunters to know exactly where they were able to hunt. He stated that this matter could not be handled on a statewide level and must be decided in each area. It was moved by Supervisor Cameron, seconded by Supervisor Gilman, and unanimously carried that the Board contact the Fish and Game Commission and the proper officials and request that the item be taken off the agenda on March $, 1974 and referred back to the Board for recommendation. 74-271 APPEARANCE: JAMES W. HANSEN OROVILLE Mr, Hansen appeared before the Board to thank them for a letter they wrote rega'cding miners and mining rights. He also discussed his views about the President of the United States having the right to place fees on the American people, 74-272 APPEARANCE: DR. JAMES LAMBERT Dr. Lambert appeared on behalf of Dr. McLaughlin of the Work Training Center. He presented a letter setting forth the formal proposal about the Worlc Center expansion, which he read to the Board, He stated he was authorized to tell the Board that the Center has obtained promise of 90-day completion from the time the permit is issued and that they have pre- pared a site plan for the land on which the building would set, There was a discussion about when the proposal could be presented to the Board in full; it must first be presented to the Mental Health Advisory Board. Discussion of contracts and funding of the expansion work. No action taken. 74-273 APPEARANCE: AL DAVIS SKYLINE WAY OROVILLE Mr, Davis appeared before the Board to request that something be done about the intersection of Oakvale and Olive Highway. He stated that there have been several near misses involving buses turning onto Oakvale to go to Ophir School, Discussed. This was referred to Clay Castleberry. Mr. Castleberry stated that Olive Highway is a state highway but he thought his department can work with the Division of Highways and solve the problem. He will present a proposal to the Board at a later date. Mr. Davis also requested that a ramp be installed at the lake to enable disabled people to do deep-water fishing. Supervisor McKillop stated that there is a request for a wharf in now, but perhaps the Board can push harder. Mr. Davis also stated that he was opposed to the hunting on Lalce Oroville. Page 295 February 26, 1974 February 26, 1974 74-274 APPEARANCE: JERRY MEYER, THERMALITO EOC ADVISORY' BOARD Mr. Meyer stated that their budget is again stalled. It was his understanding that it would appear on today's agenda, which it did not. He explained the funding of the program. Discussion. The Board requested that Mr. Woodworth appear in the afternoon to answer some of their questions about the matter. 74-275 APPEARANCE: JAMES OVERHOLTZER, PARADISE_~OARD OF REALTORS Mr. Overholtzer was concerned that the boundaries used in the Paradise Irrigation District were going to become the boundaries for paradise if it incorporated. He stated that there has not yet been a vote to decide on incorporation and that the Board shouldn't assume it will incorporate. Discussion. No action taken. RECESS: 12:07 p.m. RECONVENE: I:30 p.m, 74-276 APPROVB PUBLIC WORKS ITEMS: ADOPT ORDINANCES N0. 1432 & 1433 On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the following action was taken: 1. Approved acquisition of backpack carrying case for electronic distance meter, at an approximate cost of case in the amount of $225, from funds budgeted for magnetic locator. 2. Approved final map of E1 Monte Heights Subdivision Addition ~~I {El Monte Avenue, Chico, 13 lots, offers of dedication were accepted and the Chairman Baas authorized to sign the Subdivision Agreement. 3. Waived the second reading of the ordinance establishing speed limits on Ord Ranch Road, adopted Ordinance No. 1432, establishing speed limits on Ord Ranch Road and authorized theChairman to sign, 4. T+7aived second reading of the ordinance amending Chapter 26 of Butte County Code, adopted Ordinance No. 1433 amending Chapter 26 of Butte County Code and authorized the Chairman to sign. 5. Approved request by City of Chico to do building inspection and collect fees at 1205 N. Cedar Street, for property annexed to the City of Chicoo 6. Authorized Public Works to enter into an agreement with Mro Kasza (Karoly Kasza parcel map - AP 54-24-81) to guarantee road construction to County departments. 74-277 APPROVE SB 325 ALLOCATTON INCREASE (SKYWAX AND OTHER PROJECTS) AND APPROVED SB 32S FUNDING PROJECT LIST Clay Castleberry, Director of Public Works, stated that it was reported on November 13, 1973 that additional money would be budgeted under SB 325 for Skyway constructiono He explained the request for SB 325 allocation increase for the Skyway and othe~irojects. He said that during the fiscal year they have had an increase of some $70,000 more than had been budgetede Public Works is requesting at this time that $160,000 be made available for these projects, along with the SB 325 List. He would like to forward to BCAG allocation increase of $160,000 of SB 325 monies for Skyway construction. Request discussed. Supervisor Gilman said he tooit offence that this Board takes action at BCAG meeting prior to action being taken by this Board; he was referring to the approval of the "Your Bus ". Supervisor McKillop said that because of the $160,000 being requested the Board i ~ go6~ngl974 have Page 296 Februar G February 26, 1974 to take a good hard look at the bus project. He said that he sees no way to postpone any further the Skyway Project. Chairman Madigan asked Supervisor Gilman if it would be his desire to take action on the bus prior to taking action on these matters. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the Board approved the SB 325 allocation increase for Skyway and other projects and approved the forwarding to BCAG allocation increase of $160,000 of SS 325 monies for Skyway construction, approved the following SB 325 funding project list and approved the forwarding of it to Transportation Review Committee and BCAG for approval: 1. Skyway Construction - additional allocation 2. Bald Rock Road (Rebudget) Hernandez Ranch to 1 Mile East 3. Oroville Quincy Highway Hart`s MiII Grade to Berry Cre~:k School (Any additional SS325 funds will probably be needed for this project) 4. Quincy Road (Increase allocation) Increase limits of project to include Canyon Highlands to Foothill Boulevard 5. Lassen Avenue (Cohasset Road to Esplanade) (subject to curb, gutter and drainage by property owners) 6. Manzanita Avenue (Chico City limits to East Avenue) 7o Randolph Avenue and Oregon Street (Adjacent to Gridley City limits) 8. Biggs-West Gridley paving overlay 9. He explained the projects proposed. He stated that FA5 monies v.*ere no longer allowed to be used in urban areas. Supervisor Ladd said he would like this matter put off one week. Approval of the FAS project list for planning and design purposes put over one week. 74-278 AUTHORIZE PUBLIC WORKS DIRECTOR TO APPEAR BEFORE THE PUBLIC UTILITIES COMMISSION Mr. Castleberry said he would like to have auttaorization to appear before the State Public Utilities Commission to request two additional railroad crossings. This would be new funding. Request discussed, On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, Mr. Castleberry was authorized to appear before the Public Utilities Commission to request two additional railraad crossings, 74-279 INFORMATION AND DISCUSSION ITEM: SKYWAY PROJECT-COUNTX FRONTAGE AT MEMORIAL HALL Mr, Castleberry explained the Skycray project-county frontage at Memorial Ha11. All the properties within this project will be providing curbs and gutters. Dir, Castleberry recommended that sidewalks be put in at the Paradise Memorial Hall. For a 5' wide sidewalk, he estimated it would Page 297. February 26, 1974 February 26, 1974 cost about $7-8,0000 There would still be access to the parking in the back, This request trill be included in the Memorial Hall budget this year. 74-280 APPROVE REQUEST OF SOCIAL SECURITY ADMINISTRATION FOR USE OF SPACE AT PARADISE VETERANS MEMORIAL BUILDING On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, the Social Security Ldministration was granted approval to use space at the Paradise Veterans Memorial building, as requested. Administrative Officer will send a letter to the Social Security Administration immediately informing them of the Boards approval of their use of this space, 74-281 DISCUSSION: REPORT ON .THE THERMALITO MULTT-PURPOSE CEL`ITER & INDIAN BEADING PROGRAM Don Woodworth, Executive Director of EOC, gave a status report on the Thermalito multi-purpose center and the Indian Beading program. Chairman Madigan said a reconunendation was to be made on the proposal for the Thermalito Center. It was asked if the Board could approve the Thermalito Center and the Indian Beading program at this time. The programs were approved by the Administering Board. Mr. Woodworth said he would get the figures for the budgets for these programs and will report back later in the day. 74-282 HEARING SET ON THE EARL F. AND GLORIA C. BRASt•]ELL REZONE ON SOUTH SIDE OF OROVILLE-BANGOR ROAD OROVILLE A public hearing raas set for Tuesday, March 12th, 1974 at 2:00 p.m. on the Earl F. and Gloria C. Braswell rezone from H=C (highway-commercial) ~. The proposed rezoning was initiated to provide zoning consistent with the agricultural use of the area. Supervisor Ladd felt there ~•~as a lot of land that could not be used for agriculture. There are small parcels that could be used for camping. He explained the application of Paradise Rim Rock Ranch and Cecil M. Johnson, of Fountain Valley. They have requested certain parcels to be excluded from this agreement for future development. On motion of Supervisor McKillop, seconded by Supervisor Ladd and unanimously carried, the Land Conservation Act Agreement between theCounty and Fletcher L., James E., Carl E., Sandra G., Gary L., and Linda I. Brown was approved and the Chairman was authorized to sign, subject to the County being assured that the guardian has the authority to sign the agreement. Mr. Blackstock presented the Frank G. Bennett agreement for Board consideration. He recommended that the Board approve this agreement, subject to that it be under one ownership. They are a number of smaller parcels but they are all under one ownership. Discussed. On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the John Jean, Marie Anna and .Kohn Peter Dagorret Land Conservation Act Agreement with the County was approved and the Chairman was authorized to sign, subject to the property being under one ownership. Mr. Blackstock presented the ,Toe Kelly agreement, for a total of 76 acres located in the Palermo area, Some of the smaller parcels are being converted back to acreage. The land is in permanent pasture. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the Land Conservation Act Agreement between the County and Joe F, and Melbagene Kelley was approved and the Ch airman was authorized to sign. The Committee felt the application should be denied and that if he applies again next year and the property has been planted, it could then be consideredo A letter will be written to Mr. Gargon explaining the denial of the application. 74-296 DISCUSSION: GOVERNOR'S GAS DISTRIBUTION PLAN-COUNTY NOT TO BE DECLARED EMERGENCY Ev Bosworth, assistant administrative sxfficer, and Tom Struthers, Purchasing Agent, explained the telegram received from Governor Reagan relating to the gas shortage crisis. The State has set up an emergency plan for gas distribution. Plan explained. Mr. Struthers stated they had worked all last evening and today on this matter. If the County desires to go into this plan, they should adopt an ordinance setting it into affect and should also adopt a resolution asking the Governor to implement the plan. Situation discussed. He has talked to the gas stations throughout the County. It is felt that the emergency is not serious at this time; the Page 3090 February 26, 1974 February 26~ 1974 County could go into it later if the situation becomes serious. The Governor has requested that all Counties act on the matter at least by Thursday afternoon. On motion of Supervisar Cameron, seconded by Supervisor Gilman and unanimously carried, theAdministrative Officer was requested to transmit a telegram to the State informing them Butte County has decided not to declare the County an emergency at this time but that the opportunity be given them to opt into the program at a later time if the need arises. 74-297 REQUEST TO HAVE PARADISE LIBRARY SITE DTSCUSSION PLACER ON THE AGENDA Supervisor Cameron requested that discussion o£ the Paradise Library be placed on the agenda for Tuesday, March 5, 1974.
