(Bizz) Johnson, Mr, .Tohnson writes that he has contacted officials in Washington regarding elimination of the Post Office in Feather A• Z7/k'a11s and states that he is very much opposed to such elimination, however, Q jurisdiction no longer lies with Congress as far as Post Office is concerned, so Congress is limited in what they can do. COURTNEY BENEDICT AND DOROTHY POND BENEDICT On motion of Supervisor Gilman, seco nded by Supervisor Ladd and unanimously carried, the claim of H. Courtney Benedict and Dorothy Pond Benedict in the amount_of $75,000 was reiected and referred to County Counsel. 73-319 APPROVAL OF REQUEST BY CITY OF CHICO TO DO BUILDING INSPECTION AND COLLECT FEES AND APPR0I~AL OF RIGHT OF WAY AC UISITION. On motion of Supervisor Gilman, seconded by Supervisor Ladd ahd unanimously carried,~authority was`granted_to_~he_City of Chico to do building inspection and collect fees at 1422 N. Cherry Street, Chico; and approved right of way acquisition,,agreement for sale, Pentz Road 43431-69-1, M. Orr Parcel (Parcel 8) 0.409 ac.$176 plus exhhange, Chai"man authorized to sign and authorized Auditor to issue warrant upon demand of County`s excro~ agent. 73-320 DISCUSSION: SALARY INCREASES FOR BULLDING INSPECTOR POSITIONS Clay Castleberry summarized the problem and stated that County Building Inspectors' salaries are about 20% below that of State Building Inspectors'. Jim Glander stated that the County may lose two Building Inspectors to the State by budget time due to this difference in salaries. Supervisor Madigan asked if the Board should consider raising inspection fees. Clay Castleberry replied that the fees are sufficient for a cushion that will help for about one and a half years without raising fees. Matter deferred to next week's agenda. Personnel will submit a report at that time. 73-321 DISCUSSION: OPENING OF NATURAL DRAINS IN HONCUT Clay Castleberry reported on the petition from Honcut residents regarding the opening of natural drains. The Board acknowledged the petition and referred it to Public Works fora reply. 73-322 LEGALITY OF PARCEL DIVISIONS REFERRED TO REAL ESTATE COMNff SSION Clay Castleberry summarized four possible violations of parcel division, and stated that building permits are being issued with notes attached stating that the lots are under investigation. Supervisor Gilman wondered if building permits are being issued and if houses are being built, could the Real Estate Commission decide they are illegal. ban Blackstock recommended that permits not be issued under these circumstances. On motion of Supervisor Madigan, seconded by Supervisor Gilman, and carried, the four parcel divisions were referred to the Real Estate Commission for verification. Noes: Supervisor Ladd, Page 71 February 27,1973 February 27, 1973 = = = - = = - - = = _ - = = = = = = = = - - = - - - = - = - = - = = = ~ ~ - r 73-323 AUTHORIZATION FOR PRINTING OF FOUR-COLOR COUNTY BROCHURES Bob Nicholson, Economic Development Director, reported before the Board on the printing of 50,000 new four-color county brochures. Estimated cost of pictures and printing is $5,500. Nicholson stated that this was not put on the last budget request because he felt the brochures would last, Developers have used several thousand of the brochures. Supervisor Gilman didn't want taxpayers paying for brochures for developers to use, County Corznsel stated that policy was established many years ago that when anyone wants public papers that the-County would recover 50fi a copy. Tt was moved by Supervisor Cameron, seconded by Supervisor Gilman and unanimously carried that authorization would be given for printing of_ 50,000 femur-color county brochures and for a transfer of $5,500 from the reserve to the Development Commission's budget, with the policy stipulation that private concerns desiring additional copies for their own business be charged a cost. At this time Supervisor Madigan stated that he would like Tom Struthers, Purchasing Agent, to report to the Board on the purchasing in the Clerk's Office. RECESSED: 9:55 a.m, RECONVENED: 10:15 a.m. 73-~~l+ ADOPT ORDINANCE N0. 1330, AN ORDINANCE ADDING SECTION 20-30.8 TO THE BUTTE COUNTY CODE Dan Blackstock summarized the Ordinance. On motion by Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, Ordinance No. 1330, an Ordinance adding Section 20- 30.8 to the Butte County Code, was adopted and the Chairman was authorized to sign. 73~ ~S ORDINANCE ADDING ARTICLE TI, CHAPTER 26 TO THE BUTTE COT7NTY CODE DISCUSSED AND REFERRED TO PLANNING This is an ordinance relating to additional reouirements for buildin~* within the Chico urban area. Supervisor Gilman commented that he can-accept the concept but not the' whole idea. He also stated that he would like to hold a public hearing on the proposal. Jim Lawson suggested that a standard urban area should be drawn up. Supervisor Ladd stated that the plan for curbs, gutters and sidewalks is for too large an area. The city should require this when areas are annexed. Discussed. Referred to Planning Commission for study. 73-'~~ ORDINANC:r~ MODIFYING INTERIM ANiI PERMANENT ZON1? C:~1AN~^.E PROCEDURES, AND CLARIFYING USE PERMIT AND VARIANCE PROCEDURES DISCUSSED AND REFERRED TO COUNT'X COUNSEL Page 72 February 27, 1973 -., February 27, 1973 County Counsel stated his recommendations on this ordinance. He stated that the County anticipates la me rezoning, hearings before July i to confiorm with the general plan, The Planning Commission is working on the proposed codification which would create a considerable amount of advertisement. Mr. Blackstock recommended that the advertisement requirement be deleted because massive rezonin~~ would require a large amount of mailing. Discussed. Supervisor Ladd commented that he didn't like some items in the ordinance. He felt that two hearings should not be required in ordinance matters and the. mailing requirement could be deleted in massive zoning matters. Jim Lawson reported that notices on public hearings are adequate but he would like to use a bold format for hearing notices in the newspapers.• Supervisor Madigan said he has heard criticism of legal advertisements because the legal descriptions are difficult for the general public to understand, Supervisor Gilman felt that the legal descriptions are a waste of money because the average person cannot understand them. He suggested a brief description in plain English below the legal description. Supervisor McKillop stated that one of the largest problems the County has had is notification of hearings. Matter deferred to next week and the ordinance referred to County Counsel for redrafting, 73 3~7 REPORT ON FAIR REQUEST TO GRANT EASEMENT ~0 P,G,&E,: HELD OVER ONE WEEK The report on the Fair request to grant easement to P.G. & E. was held over to next week's agenda. ~33.~8 ADOPT RESOLUTION N0, 7,3-x+0 A.FPROVING ASSIGNMENT AND AUTHfl~IZING CHAIRMAN OF THE BOARD OF SUPERVISORS TO EXECUTE ON BEHALF OF THE COUNTY OF BUTTE Clay Castleberry summarized the Resolution. He stated that the State people with whom he has contact say they want Lime Saddle to remain a memorial. On motion of Supervisor Gilman, Seconded by Supervisor Ladd and unanimously carried, Resolution No. 73-40 approving assignment and authorizing Chairman of the Board of Supervisors to execute on behalf of the County of Butte. was approved, and Chairman authorized to sign said resolution. 73-99 APPROVAL OF NINE APPLICATIONS AND_AGREEMENTS UNDER LAND CONSERVATION ACT Mr. Mackessy, Agricultural Commissioner, appeared at this time and presented ten applications and agreements reviewed by the Land Conservation Act Committee. These applicants are: Three B's Ranch, Inc.; Thomas and Janet Vanderford: Henry E. Damon; Ted and Muriel Turner; Soper Wheeler Co.; Deorge T. Peekema, et alr Darrell C. McEnespy; Aiamond International; Stutzman; and Dan Grigsby, Mr. Mackessy reported that the Grigsby application was disapproved by the Land Conservation Committee. The property in question is located N,N-E of Chico and has not been planted. On motion of Supervisor Gilman, seconded by ~3upervisor Ladd and unanimously carried, approval was given to nine applications reviewed by the Page 73 February- 27 19"3 February 27, 1973 Land Conservation Committee. Mr. Dan Grigsby appeared at this time to ask the Board to reconsider his denied application. Mr. Grigsby explained why he has not been able to piant a crop and that he has made an effort to do so. Supervisor Madigan commented that as far as he knew this area has been used for grazing purposes for the last 20 or 30 years. Supervisor Gilman said that without irrigation the land will probably be useless for crops. Chairman. McKillop stated that it was the Board's consensus that Mr. Grigsby reapply next year. 73-~~0 APPEARANCE OF GENE RILL OROVILLE: WARD BOULEVARD LOT SPLIT Mr. Gene Diil of Oroville appeared before the Board to request a policy statement recommending that the lots on Ward Boulevard be put back' into one parcel with exception of one lot that has a house on it. Mr. Diil said that there is a cease and desist order from the Real Estate Commission on the lots. Supervisor Gilman commented that this kind of lot splitting in the County leaves him to beiieve that unless action is taken, it wilt continue. Discussed. It was moved by Supervisor Madigan,. seconded by Supervisor Gilman to have the District Attorney in conjunction with the Real Estate Commission proceed with the case by prosecuting. Ayes: Supervisors Gilman and Madigan. Noes: Supervisors Cameron, Ladd and Chairman McKillop Motion failed. Mr. Dill stated at this time that he has made roads, graded lots and has the option to build on these lots. Discussed, Supervisor Madigan suggested the Butte County Grand Jury be requested to investigate the matter. Mr. Dill was asked to talk to the District Attorney End come up with a solution to present to the Board. 73~1~1 DAN PELLICCIOTTI OROVTLLE: REMODELING OF COURT BUILDING Dan Pellieciotti of Oroville appeared before the Board to commend 0~.~ ~ it for paying off the note for the new court facility building. He recommended that before remodeling ~ the old court building, to have a structural and fire inspection. 73~'~2 APPEARANCE OF C,A. WITHrNGTON: P.G, & E. RIGHT OF WAYS Mr. C.A. Withington appeared before the Board in regard.to s P.G.&E. 500,000 volt line on the eastern end of Oroville and going southward. He requested the Board to Consider a resolution of complaint against P.G. & E. for soliciting right of ways and paying for them before applying to•theLPubliC Utilities Commission. Coffins, eezoning from "A-2" (general) to "C-2" (general commercial) district for property located on the west side of Mangrove Avenue, 200 feet north of Tri-rd Avenue, identified as AP 45-114-41, Chico, was held as advertised. LIME SADDLE COMMUNITY SERVICE AREA. PARADISE Jim, Lawson, Planning Director, summarized thte proposed rezoning ordinance and the action taken by the Planning Commission. County Counsel stated that the people in the area are interested, in additional control over and above what has already been done. Supervisor Gilman commented that the land is steep and when more people get in that area there will be drainage znto the lake. Discussed. He discussed carpeting and removable partitions for the new Porbation Offices and permanent partitions for County Counsel's Offices. Discussed. C1if Mickelson, Administrative Officer, explained the changes in Courtroom A for the new Probation offices. On motinn of Supervisor Ladd, seconded by Supervisor Cameron and unanimously carried, the Purchasing Department was authorized to advertise for bids for remodeling of County Counsel .Offices with bids opening in the Pu//b~~lic Works Office March 19, 1973, at 11:00 a.m. 73-~Sb APPROVAL OF $100,000 LOAN FOR BUTTE COUNTY HOSPITAL Bill Lawrence appeared before the Board to request a $100,000 loan to the Butte County Hospital to meet the March 2, 1973 payroll, He stated that the hospital is still $28,676.39 in the red, Wa1t~Atkins, Hospital Administrator reported that the hospital's billings are about four to six weeks behind. Discussion followed, On motion of Supervisor Ladd, seconded by Supervisor Cameron, and unanimously carried, approval was given fora $140,000 loan to the Butte County Hospital, with $70,000 from the hospital reserve and $30,000 from contingencies. 73-37 BOARD ACCEPTS PROPOSAL OF GENERAL APPRAISAL CO. FOR FIXED ASSETS SURVEY Bill Lawrence read a memorandum from F. H. Seely, 3r., Auditor-Controll~e r, explaining the proposals of General Appraisal and Appraisal Bureau for the Fixed Assets Survey and recommending that the Board accept the proposal of_ General Appraisal Co. The matter was discussed. On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, the Board accepted the negotitated proposal of General Appraisal Co. Supervisor Cameron stated that he has only attended two committee meetings and didn't have all the background in the matter, but with his previous experience he would have to say that he is very "gunshy" when it comes to computers in Butte County. He agreed with Supervisor Madigan to put the matter over one week. Hank Hindry appeared before the Board and wondered if they would like to hear from some of the committee members. County Counsel Said that in the contract it States the equipment is not new, but is comparable or superior to new equipment. James C. Rowan, Paradise, appeared to discuss t_he matter with the Board, He stated that if the County had this equipment, three times the work could be done than what is being done at this time. Orrin B. Stratton of Chico, president of the Butte County Taxpayer's Association appeared before the Board. He. felt that Mr. Rowan has made an adequate study of the needs of the County and he is ready to stand by Mr, Rowan's recommendation. Gene Ro11s, Forest Ranch, member of the 1972 $utte County Grand ,Jury, also a member of study of committee, appeared. He concurred with Mr. Stratton's views, He said he is disappointed bec9use Mr. Rowan was brought in as a consultant and Mr. Madigan declines to take his adviee. The matter was discussed further, Supervisor Cameron questioned whether used equipment would be satifactory. Robert Horvath, branch manager of Control Data's Sacramento 0£fice, appeared to report on the subject, He said it is not unusual to use re Furbished equipment in new leases. The refurbished equipment goes through the exact end of production line tests as new equipment and is issued the same Warranty as new equipment. Dis cussed. County Counsel explained and summarised the contract arrangement with Control Data Corporation. The contract consists of a straight commercial lease with addendum and an agreement. NOES: Supervisor Madigan, 73-~~9 LETTER APPROVED TO CORPS OF ENGINEERS RE BANK PROTECTIVE WORKS ALONG SACRAMENTO RIVER George Stamm, Water Resources Coordinator, appeared at this time and reviewed the proposed bank protective works along the Sacramento River. He discussed the two bank protection sites, He felt the Corps should protect the River Road by putting it back to its original high location. He requested the Board's approval of a letter to the Corps outlining the County's views of the proposed work. Modifications to the PEP grants have been prepared to extend the grants £rom March 15 to April 30, 1973. The request was for an additional $82,180 federal funds for Section 5 and $54,824 for Section 6. Dr. Heindl, Director of the Health Department, re~puests authorization for Lorna Thompson and Mark Duckett to attend a seminar for physically handicapped children and the approximate cost is $58. County Counsel requests authorization for Jim Gri££ith to attend a District Attorney's and County Counsel's Association School LaW Section in Los Angeles. County Counsel is out of money in the out-of-county travel fund and a transfer is needed from the in county daily travel fund to the out-of-county fund. County Counsel recommended a transfer of $700 into the out-of- county fund which raQU1d leave $200 in the regular fund. On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, the following travel requests were approved and transfer of funds made: 1. AND PHILLIPS PETROLEUM CO Tom Struthers, Purchasing Agent, reported the bids for annual gasoline and diesel fuel which opened on February 22, 1973. He stated that the nation is faced with a•.real fuel crisis and the situation is tightening. There were two bids for diesel, with the low bid up 10% from last year, and there was only one bid for gasoline.
