73-366 APPROVAL OF MINUTES
On motion of Supervisor Gilman, seconded by Supervisor Ladd and
unanimously carried, the minutes of February 27th, 1973 were approved as
mailed with the change to item 73-263, page 81, Change Budget Transfer 8-76,
from $75,500 to $7,500, as set out in transfer.

reductim in the scope of required offsite improvements.

Paradise Local Government Study Committee. The Committee writes to the
Administrative Officer regarding an in-depth feasibility study

Robert A, Rehberg, County Counsel, Shasta County. Mr, Rehberg writes that

County of Tehama. Tehama County writes in regard to relief from responsibility
of support to parent, and would like to know what Butte County

Department of Parks and Recreation. The Department writes to remind County

Kimberly Moore, Paradise. Mrs, Moore writes regarding the litter and garbage

73-368 RETAIN CONDITIONS AS FIRST STATED ON TENTATIVE MAP FOR LARWIN
Letter from Larwin was read. G1ay Castleberry, Director
of Public Works, explained Larwin's request.
Discussed,
Mrs. Franklin Butler, Nimsh~r Road, Magalia, appeared before
the Board, She felt the objections of some of the residents of the area
that were sent to the Board last sunmier are still valid, She explained that
there is no improvement in water conditions on Nimshew Ridge.
Clay Castleberry said that an adequate water supply that
would satisfy the Health Department and the Public Utilities Commission
still had to be verified,
Mrs. Freeman, Magalia, appeared, She stated that the Larwin
map included within its boundaries her frontage and all the frontage of
Unit No. 20
J. Co Buchannon.appeared and stated that the center of the
road is his property and Larwin`s map shows the roads are infringing on his

~ Clyde Bann, Nimshew Ridge Road, appeared and stated that
hQ drives a fire truck for the volunteer fire department, and without
Z,arwisA repairing Ponderosa Way, the fire department cannot serve the
area. .
Clay Castleberry reviewed the requirements stated on
the conditions of the approved tentative parcel map,
Supervisor Madigan said from safety standpoint why should
Larwin be required to do less than what was set forth on the approved
tentative parcel map.
On motion of Supervisor Cameron, seconded by Supervisor
Madigan and unanimously carried the action as first stated on the Larwin
tentative parcel map was retained,
73-3b9 AtTTHORIZE ACTION TO BE TAKEN ON POPULATION ESTIMATES
Ev. Bosworth, Administrative Assistant, spoke concerning
the population figures being used Uy the State of California for various
Butte County Subventions.
Discussed.
On motion of Supervisor Gilman, seconded by -Supervisor
Cameron and unanimously carried, Administration was authorized to assist
the Paradise T,ocal Government Study Committee in accumulating cost figures
on current services being furnished by the Countyo
Ev Bosworth stated that he had talked with the Department of
Finance and they suggested that the County submit a population request.
Ae said the population survey is not automatically made, but the County
must request it.
On motion of Supervisor Cameron, seconded by Supervisar
Gilman and unanimously carried, Administration was authorized to write a
letter to the Department of Finance requesting a population estimate
with the necessary fees from the reserve not to exceed $800.

73-372 AUTHORIZATION GIVEN TO BRING AMBULANCE CONTRACT BEFORE THE $OARD
Ev Bosworth reported on the ambulance meeting and
reviewed the memorandum of the meeting.
Contract was discussed.
On motion of Supervisor Madigan, seconded by Supervisor
Gilman and unanimously carried, County Counsel and Administration were
authorized to bring an ambulance contract•to the Board,

Certain easements that were in the original plan
but never acquired when the Shasta Union Drainage and Assessment
District was formed from district funds were presented fos Board

On motion of Supervisor Madigan, seconded by Supervisor
Gilman and unanimously carried, acquirement of easements in Service
Area No, 25 was authorized,

Clay Castleberry, Director of Public Works, explained the
Ord Ferry Road FAS Project 1523(4)o County-State Agreement ~k31 covering
proposed construction and subsequent maintenance of Ord Ferry Road FAS
Project 1523(4) has been received from California Division of Highways
for approval in order that the project may be advertised, Estimated
cost of project is $309,000, County's share is $35,000 and Federal-
State share $274,000.. Should the 1972 Highway Bill not pass, County
would have to provide an additional amount of $200,000, The agreement
was approved by Counsel and Auditor,
Seven of the eight parcels for right of way for the
Ord Fexry FAS Project 1523(4) have been obtainedo Initiation of con-
demnation for the other parcel was approved by Board at its December 19,
1972 meeting. The complaint in eminent domain, summons and order of
immediate possession for this parcel have been filed, It was nnw•
in order to prepare right of way certification ~k2 which is required by
the State before the low bidder for the project can be awarded the contr~c~o
Clay Castleberry stated that if the 1972 Highway Bi11 does
not pass there would not be sufficient money in the road fund~for the
project and he would have to postpone other proposed projects,

73375 PUBLIC WORKS INFORMATIONAL AND DISCUSSION ITEMS
Clay Castleberry reported on the City of Oroville Dry
Greek ordinance.
Chairman McKillop stated that if the people in the area
are interested in forming a district, the Board will help in its creationR
Mr, Castleberry reported on an arrangement where developers
leave a check with Public Works with a letter authorizing it be spent
in six months, This enables developers to record parcel maps, and
insures that the work will get done.

Mr. Pelliciotti, Oroville, referred to action taken
on population estimates. Ile suggested making an estimate for judicia3,
districts.
Chairman McKillop stated the judicial districts will be
included in the estimate.
73-377 APPEARANCE: NORMAN CALI,OWAY,_F_I__RST_UNIfiED METHODIST CHURCH. OROVILLE
J Norman Calloway, First United Methodist Church, Oroville,
u L~•~ appeared regarding the Head Start Program in Oroville, Mr. Calloway
is the Administrator for Preschool and Head Start in Oroville.
He requested from Revenue Sharing a grant of $5,082 which will maintain
the school until the end of the school year, :.He explained that
funding may become available thm ugh state sources, but if not
he will need a decision from the Board by March 15, 1973.
Supervisor Madigan commented that if action was taken
at this time, it would affect any action taken at State level, He
suggested the matter be held over one week.

Mra Claude Willis, Forest Ranch, appeared to ask about
the County's plans for remodeling the~old Courtrooms,
Mr. Mickelson outlined the plans for remodeling,
Mr. Willis wondered about the safety of the building,
He is in favor of relocating the county buildings because the people
of Oroville are not accomodating to people who come to the County buildingsP

a high density transmission line.
Administration is requested to write letter to the Public Utility
Commission requesting the public hearing be held in Oroville for the trans-
mission lines of P.Go & E.

Mr. Bi11 Tompkins, Paradise, appeared to suggest that the pxess
attend executive sessions of the Board,
73-384 ADOPT RESOLUTION N0. 73-1, AUTHORIZING AND DIRECTING THE FILING OF AN
APPLICATION FOR LOAN UNDER THE DAMS-GRUNSKY ACT FOR PREPARATION OF PROJECT
FEASIBILITY REPORT
Clif Mickelson outlined the proposed resolution. The Lime Saddle
Community Service District has prepared application fora loan of $6,000
under the Davis-Grunsky Act for preparation of a project feasibility report
for domestic water supply, including pumps, treatment plant, storage tanks
and distribution lineso Application has been reviewed by Gounty Counsel and
repayment provisions of such a loan are well within the District's financial
ability to repay, even if the capital costs of the proposed project of the
$300,000 is not granted through Davis-Grunsky Act.
On motion of Supervisor Gilman, seconded by Supervisor Madigan
and unanimously carried, the Board of Supervisors acting as the Board of
Directors of the Lime Saddle Community Service District adopted Resolution
No. 73-1 authorizing and directing the filing of an application for loan
under Davis-Grunsky Act for preparation of project feasibility report and'.

73-386 DISGUSSION: WATER fjUALITY CONTROL BOARD COMMITTEE MEETING RE VARIATIONS
AND GUIDELINES
Howard Toussaint, Health Airector, appeared to report on the com-
mittee meeting held last Friday with the Water Quality Control Board re-
garding variations and guidelines, He said the meeting broke up with the
understanding that there would be another meeting to see if they can reach
an agreement regarding guidelines,
Matter discussed.
Mro Toussaint also reported on the Water Shed Report. He said
the rough draft of the final report has been completed and the final
draft should be done by the end of Marche

At the request of Harold Dawson, Chairman of Ad Hoc Committee
of the Lime Saddle Community Service Area, Public hearing for the
following was continued to April 10, 1973 at 1:30 p.m.:

73-391 GRANT P.G & E. EASEMENT AT BUTTE COUNTY FAIR GROUNDS IN GRIDLEY
Request from Butte County Fair to grant easement to Polio & E,
discussed.
On motion of Supervisor Ladd, seconded by Supervisor Gilman
and unanimously carried, P.G. & E. was granted easement as requested by
the Butte County Fair Board subject to County Counsel's approval and
sanction.
73-392 DISCUSSION: BOARD ESTABLISHMENT OF GOUNTY SERVICE AREAS
Dan Blackstock, County Counsel, discussed the case of Byers Vs,
Board of Supervisors, San Bernardino County9 which questioned the ability
of the Board of Supervisors to set up County service areas. The court
declared the San Bernardino Supervisors' setting up of a cable 'tv service
area illegal. Since that time the legislature has amended the County
Service Act allowing cable tv service districts,

73-393 DISCUSSION: RE HAZEL SHANE
Mro Robinson, Welfare Director, appeared before the Board to
discuss the case of Mrs. Hazel Shane> He reported the actions taken
by the Welfare Department and set out the reasons why her temporary
General Assistance was not extended.

Chairman McKillop stated that the Board has tried to take care
of the problem, but until Mrs. Shale puts herself on the labor market,

73-39k SETTLEMENT OF UNSEGURED TAXES DISCUSSED
Rolland Vandergrift appeared to report on unsecured taxes
regarding a person who is out of business and going through bankruptcyP
Request discussed.
Mr. Vandergrift was asked to present the details of the case
in writing to the Board at a later meeting,
73-395 MENTAL HEALTH STABILIZATION PROGRAM BISCUSSED
Dro Ely presented a letter from the State Fire Marshal approving
the Mental Health facilities for a maximum of six patients. He requested
the Board`s reconsideration .of his proposal,

73-396 RESERVE FUND - COUNTY RECORDER: NO ACTION TAKEN
At the request of the Recorder and Auditor the following was
removed from the agenda and no actinn was taken:
Reserve fund - County Recorder. Recording of BIR tax liens
had a fee increase from $2 to $3 per document. The Recorder s
reserve fund of $150 which is used to pay for the recordings
during the month pending monthly billing to the gove:enment is
now inadequate. She requests authority to increase the reserve
fund by $50 which would give her $200 reserve and $25 change
fund.
73-397 SALARY ORDINANCE AMENDMENT PUT OVER ONE WEEK
Clif Mickelson, Administrative Officex, summarized the changes
in personnel made by the proposed Salary Ordinance amendment.

Ladd and unanimously carried Resolution 73-47, approving application for
grant for law enforcement purposes and authorizing the Chairman of the'Board
of Supervisors to execute on behalf of the County of Suate, was adopted,
the chairman authorized to.sign.:said resolution. and the following items ',

lP Extension of the non-compensated medical leave of absence
for Virginia Davis through Juna 6, 1973.

73-399 AISCUSSION: GENE DILL - WARD BOULEVARD' PARCEL DIVISION
Ken Teach, District Attorney, reported action taken in regard
to Gene Dill, He stated he has discussed the possibility of returning
the Ward Boulevard-lots into acreage with Mr. Dill's attorney,
Matter discussed.
Chairman McKillop commented that it seems the only alternative
Mr. Dill has is to turn the lots into acreage,
Mr. Teach said it his policy that whenever a person has a D&R
and returns the land into acreage, it is fine. But if he doesn't want
to 'return the land to acreage, the District Attorney's Office will
prosecute.

73-401 HOSPITAT MATTERS "'
Chairman McKillop reviewed the Hospital certification meeting in
Sacramento last Thursday.
Supervisor Gilman stated that if a ballot proposal doesn't come
forth, de-certification of the County Hospital will come about on April
30, 1973.
County Counsel explained proposed ballot measures that he felt

would give electoral versatality;.liestated the election pould be held
on May 8 if the Butte Junior College Board election is held at the
same time. If the election is to be held May 8, 1973, the Board will
have to adopt ballot measures next week.
Supervisor Gilman said it is important for the Board to agree
on whit was said at the Certification meeting last Thursday,
Guy Hart, Orovilie, appeared and suggested that the Board ask
Mr. Geduldig, Director of the State Depaxtment of Health Care Services,
to cane to Butte County and explain hospital certification to the County9

County Counsel recommended that the letter of November 6, 1972
from the Calffornia Medical Association be made available for public"regord,

Supervisor Gilman brought up the matter of the hospital generator
and whether to go ahead and get it,
On mation of Supervisor Gilman, seconded by Supervisor Cameron
and unanimously carried, the Board xeseinded action awarding the contract
for generator and pad for the Butte County Hospital.
County Counsel reviewed certification requirements, He said
that according to the Iovember 6, 1972 letter, a•Joint Conference Committed
should be established as part of procedure and part of the Board of
Supervisor's showing of good faith, It would be the function of said
committee to make known the needs of the hospital to the Board of Suger-
visors.
On motion of Supervisor Gilman, seconded by Supervisor Ladd
and unanimously carried, a Joint Conference Committee was established
consisia.ng of the Medical Director, Chief of Staff, the Administrator,
and two Board members who are Chairman McI€illop and Supervisor Madigan,
Certification meeting of last Thursday discussed further.
Administration was requestet~ to prepare a letter indicating the
action taken by the Board to Mr, Geduldig, and also ask him for a resume
of what he feels he said at the meeting of last week,
Jordan Peckham, Chico, appeared and stated that the chief problem
is recruiting a safisfactary medical director. He suggested the Board
offer a twelve month contract which will solve the problem,
Jim Rackerby, Personnel Director, reported that at the present
time there are several candidates being considered for medical director,
Salaries are being negotiated, but the applicants want assurances for
long range operations of the hospital,
Matter discussed.
On motion of Supervisor Ladd, seconded by Supervisor Cameron
and unanimously carried, Personnel was authorized to offer a one year
contract for a medical director at. $37,500 a year.

Supervisor Gilman reported on his nominations for
the Air Pollution Control Hearing Board, They are Harry Hanson,
ret}zed meteorologist and Don Black, retired air pollution officexr
On motion of Supervisor Gilman, seconded by Supervisor
Madigan and unanimously carried, Harry Hanson and Don Black were
appointed to the Air Pollution Control Hearing Board for terms
prescribed by law.

Supervisor Cameron presented his appointments to the,
Charter Study Committee, They are: Phillip Mace, Paradise;
Jenny Hart, Paradise; and Viola O'Neal, Paradise.
Supervisor McKillop also presented his appointments
to the Charter Study Committee ...They are: Leroy Clayton,
Ed Nettleship, and Lee Fickes, Sr,
The balance of appointments to the Charter Study Committee
will be made next week.
