Mr, Casagrande, planning (~ O director, sends notice of federal decentralization of L.E.A.A. program f o2 grant authority. Authority will now reside in the staff at their west coast office. Discussed; no action taken. Yuba County Superintendent of Schools. Sands notice of realignment of school. D ~f,0 ~ trustee districts in Yuba and portions of Butte County. A resolution consolidating special and primary election will be necessary. Referred to County Clerk and County Counsel for preparation of a resolution to be adopte< State Public Utilities Commission. Supervisor Reynolds stated he had a petition from Mr. Peterson concerning the Nord Gianelli Road. All Board members received copies of the petition, Clay Castleberry, Director of Public Works will advise the petitioners that there is a time on the agenda that they can appear and present this matter, tL-. Castleberry will write to these people and tell them to appear before the Board next Tuesday at 11:00 a,m, Wm. Gianelli, Supervisor Madigan stated that he had received a letter from Mr, Gianelli stating that he will be here Monday March 13th at 1:00 to make a tour of the Feather River and Lake Oroville. He will have a time on the agenda for Tuesday, March 14th, at 9:30 a,m, Henry L, Williams, Application for position of Gridley Justice Court Judge, To be placed in the file for interviewing the applicants. Chairman Gilman, Presented about 25 letters regarding opposition to LAFCO action taken last Thursday. Page 412, March 7, 1972 =T====-_=====March 7,=1972 =________---______ SUPERVISOR REYNOLDS NJW PRESENT 72-410 DISCUSSION: APPOINTMENT OF GRIDLEY JUSTICE COURT JUDGE Applications for appointment of Gridley Justice Court Judge discussed. Procedure to be follow~~i set out. Supervisor Reynolds requested that the letter be sent immediately to set up the screening committee. After the interviews are held, then the Board could make the appointment. Mr. Mickelson will write to the .judicial Counsel and inform them that the County has five applicants for this position. Matter discussed; no action taken at this time. 72-411 REPORT: INDUSTRIAL DEVELOPMENT PLANS TN BUTTE COUNTY. Mr. Bernard Richter, Oroville, Chairman of the Industrial Development Commission, reported to the Board concerning progress and plans #or industrial development in Butte County, Mr, Richter explained what has been happening in the way of industrial development in the county. He said the Commission has had 7 years of experience, He said the economy of Butte County is the biggest thing the County Ihas to look at; he said that all the cities in the County have a different personality. He said the Commission feels that the County should work closely with the citiesp Mr. Richter said that a study has been made on the proposed Oroville Industrial Park, He set out the area proposed. The work of the study was donated by Dan Cook & Associates. A master plan has been developed. He explained the industries that have been brought in through their efforts. Geargia Pacific mill is considered the highest cutting mill that Georgia- Pacific has and it has a very large payroll. There is Koppers, Las Plumas Mill and Diamond National Corporation, He said that Western Pacific now has plans for their property to use it as a storing area. Mr. Richter said it was felt that Oroville was the gateway to the Feather River Canyon and it could become a main division point. Mr, Richter explained the purpose of the industrial park. He presented pictures for the Board members to examine. He said the building of Natomas Blvd. was a great asset; they would like the County to work on securing another grant for another access road for the hauling of logs, Mr. Richter requested that at this time he would like to have Robert Nicholson, Economic Development Director, present the finish of this report. Mr. Nicholson said that 1971 was a good year for Butte County, based on the sales tax report. There were 500 more people working in the County than in 1970. Mr, Nicholson gave the background of the work they have been doing to help the County. He reported on their future plans for the County. He said that one of the problems is to try and find a way to get industrial buildings built. He said he felt that this coming year would be a good year for the Countyo He explained the particle Board plant situation. Report discussed; no action taken. CLAIMANT On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the claim of Grace I. Hood in the Sum of Five Thousand ibllars, in permanent loss of ability to work, two w=_eks loss of wages in the amount of $250, together with medical costs to date of approximately $100, with expected future medical costs was rejected and referred to County Counsel. Page 413, March 7, 1972 ~_~___--_-=====March=7~ 1972_______________ 72-413 APPROVE RE-ESTABLISHMENT OF CLIPPER MILLS POLLING PLACE On motion of Supervisor McKillop, seconded by Supervisor Maxon and unanimously carried, the petition to re-establish the Clipper Mills polling place that was consolidated in 1966 into the Forbestown precinct was approved. 72-414 APPROVE BOARD'S APPOINTMENTS TO CHICO AREA ApVISORY COMMITTEE Chairman Gilman requested that the Board take action on the proposed candidates to the Chico Area Advisory Committeeo The following names were suggested: Robert Aisthorpe, Attorney Ray Nystrom, Chico Robert Adams, Chico A11 of these men live in the unincorporated area. Committee discussed, It was stated that this would be an investigative committee to study the best way to bring the City and County ordinances into conformance with one another. Purpose of the committee discussed. On motion of Supervisor Madigan, seconded by Supervisor Gilman and carried, that the following being appointed as the Board of Supervisors' representative on the Chico Area Advisory Committee; Robert Aisthorpe Ray Nystrom Robert Adams AYES: Supervisors Madigan, McKillop, Reynolds and Chairman Gilman NOES: Sugervisor Maxon. 72-415 AUTHORIZE ACQUISITION OF RIGHT OF WAY FOR FUTURE CONSTRUCTION OF BUSCHMANN ROAD FOSTER TO SKYWAY Clay Castleberry, Director of Public Works, explained the proposed acquisition of right of way for future construction of Buschmann Road (Foster to Skyway). He said they were going to try and get some of the right of way donated, Supervisor Maxon felt this prpject was very much needed, Matter of the acquisition of these rights of way discussed. On motion of Supervisor Maxon, seconded by Supervisor Madigan and unanimously carried, Public Works was granted authorization to acquire right of way for future construction of the Buschmann Road (Foster to Skyway). 72-416 AUTHORIZE CANA PINE CREEK BRIDGE BEDECKING On motion of Supervisor Reynolds, seconded by Sugervisor Maxon and unanimously carried, authorization was granted to redeck the Cana Pine Creek Bridge from bridge maintenance fund-at an es:_-:mated cost of $5,000, plus labor. 72-417 ACCEPT DEEDS. Robinson 72-418 HELD OVER ONE WEEK: AWARD OF BID: PARADISE PINES UNITS 1 2 & 3 At the request of'Public Works Director, the awarding of-bids for Paradise Pines Units 1, 2 and 3 was held over one week. 72-419 DENY.REQUEST_f'OR SALE OF SURPLUS PROPERTY: COHASSET ROAD Clay Castleberry, Director of Public Works, explained the request for sale of surplus property on Gohasset Road, Chico, He strongly recommends against the sale of this property. He explained his recommendation; he said they anticipate the widening of the intersection will become necessary in the near future. City of Chico concurs with this recommendation. Matter discussed. On motion of Supervisor Madigan, seconded by Supervisor Maxon and unanimously carried, the request for sale of surplus property on Gohasset Road, Chico was denied. 72-420 ADOPT RESOLUTION 72-46 TO WILDLIFE CONSERVATION BOARD RE LIMITED FISHING ACCESS DEVELOPMENT Mr. Castleberry presented the resolution to Wildlife Conservation Board regarding limited fa.shing access development. He explained the work that was being contemplated. They would propose to do the work on the parking lots this summer and do the concreting of the ramps next fall when the water goes down. On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, Resolution 72-4b to Wildlife Conservation Board re limited fishing access development was adopted and the Chairman was authorized to sign. 72-421 STUDENTS OF LAS PLUMAS GIVEN OPPORTUNITY TO ASK QUESTIONS Chairman Gilman aC this time asked the students of Las Plumas High School if they had any questions of the Board members. Appearing: 1. Mr, Don Thomas. He said he did not have any questions, but he would like to thank the Board for installing the stop sign near Las Plumas High School. 72-422 ADOPT RESOLUTIONS 72-47 & 72-48 APPROVING AGREEMENT REGARDING A FREEWAY ON ROAD 03-BUT-32 BETWEEN CHICO CITY LIMITS ABOUT 0.3 MILE EAST OF ROUTE 99 AND HUM$OLDT ROAD NEAR HOG SPRING & APPROVING AGREEMENT REGARDTNG A FREEWAX ON ROAD 03-BUT-32 BETWEEN HUMBOLDT ROAD NEAR HOG SPRING AND ABOUT 0.1 MILE NORTH OF HUMBOLDT ROAD NEAR LOMO On motion of Supervisor Madigan, seconded by Supervisor McKillop and unanimously carried, the following resolutions were adopted and the Chairman was authorized to sign: Resolution 72-47 Approving Agreement regarding a freeway on Road 03-BUT-32 between Humboldt Road near Hog .Spring and about 0.1 mile north of Humboldt Road near Lomo Resolution 72-48 Approving agreement regarding a freeway on Road 03-BU'. -32 between Chico Gity Limits abaut 0.3 mile east of Route 99 and Humboldt Road near Hog Spring 72-423 PUBLIC WORKS DIRECTOR TO WRITE LETTER TO MR. BERGER LARWIN REPRESENTATIVE Mr. Castleberry requested permission to write a letter to Mr. Berger, a Larwin Construction Co. representative, and thank him for his help on the road situation in Paradise. The Board members felt the letter should be written. 72-424 ADOPT RESOLUTION 72-49 APPROVING A?~NDMENT N0. 4 TO COUNTY-STATE WATER CONTRACT George Stamm, County Water Resources engineer, explained the amendment No. 4 to the County-State Water contract. This amendment has been reviewed by County Counsel and the Auditor. The County contract is not affected by the amendment. Page 415. _______~~~=====March=7s 1972______ __________ On motion of Supervisor Reynolds, seconded by Supervisor Maxon and unanimously carried, Resolution 72-49 approving Amendment No. 4 to County- State water contract-was adopted, amendment was approved and the Chairman was authorized to sign. 72-425 DISCUSSION BY WATER RESOURCES ENGINEER OF VARIOUS WATER MATTERS AFFECTING THE COUNTY George Stamm, Water Resources Engineer for the County, explained Mr. Kimmelshue's request regarding the proposed degrading of the levees along the Sacramento River. The staff of the Reclamation Board has recommended to the State that these levees be degraded, They feel that the private levees would contribute to the high flows down the river. Mr. Stamm set out the areas of the levees. The State heard the recommendations of Mr. Kimmelshue, Mr. Bach and of Butte County, but due to the staff recommendation, the State Board made a compromise ruling. Designated flood plan line set out. The State Board felt that the portion of the levee on this line should be allowed to remain. Mr. Bath's levee is on that line and it will be allowed to remain. A portion of Mr. Kimmelshue's levee will be allowed to remain. The remainder of his levee will have to be degradedo Mr. Nielson's levee will have to be degraded. Report discussed; no action taken. 72-426 OPPOSE THE SACRAMENTO RIVER BEING INCLUDED IN THE WILD & SCENIC RIVER ACT Mr. Stamm reported on the letter received by the Board from the Newhall Land Company requesting that the Sacramento River be placed in the Wild and Scenic River Act. Mr. Stamm explained this law. He said to be eligible, the river must maintain its free flowing characteristic. There must not be any impoundment of the water way. Mr, Stamm feels that this bill should be watched closely, Supervisor Reynolds felt the Board should oppose this request, He said the County would have a situation where there would be water going by and noone could use it. Supervisor Reynolds felt this Board should go on record as opposing this request. On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, this Board went on record as being in opposition to any portion of the Sacramento River being included in the Wild and Scenic River Act. 72-427 DISCUSSION: REMOVAL OF ABANDONED STRUCTURES Mro Stamm reported on another matter that is a danger to people, He said that abandoned structures should be removed at the expense of the owners. There are a great many abandoned structures that should be taken down. The Board asked what constituted an abandoned strutted. Mr. Stamm said that each building would have to be considered individually. He said there would be hearings if requested, Matter discussed; no action taken. 72-428 DISCUSSION: CHANGES ADOPTED BY FEDERAL COMMUNICATIONS COMMISSION TO CABLE TV Mr. Iacopi, area manager of Nor Cal Cablevision, gave a short explanation of the changes adopted by the Federal Communications Commission to cable television rules and how they might affect Butte County. He said this was informational more than anything else. He explained the non-duplication protection rule. The cable television locally would have to blank out the bay area stations if they were duplicating local stations. He explained the matter of news protection. Mr. Iacopi said their company was grandfathered in because of the length of time that they have been operating, He explained the notice of handling 5 additional channels, They are trying to lock themselves in so that they can always deliver 11 channels, He said at the present time, they have the capability of delivering 12 channels, He will send a memo to the County concerning the new rules that affect this county. March 7, 1972 March_71 1972 72-429 APPEARANCE OF CLAUDE WILLIS, FOREST RANCH: WATER PROBLEM Mr. Claude Willis, Forest Ranch area, presented a problem concerning water, He said that Mr. and Mrs. Yorkman moved to the Forest Ranch area and found themselves in a problem because of other people. They purchased a parcel of property; they have spent a lot of money trying to get themselves set up to be comfortbable. They have moved up a mobile home. They are limited to water, They have asked him if he could help them. He said it will take some doing to help them. The County has an ordinance for setbacks from the roads. He was requesting permission to negotiate a way around the setback requirement. He said the site that he would place the well is 37' from the Centex line of the road. The source of the water is in the right-of-way. Time spent discussing the placing of the well within the right-of-way. He was advised to apply for a variance and then have Public Works look at the area. Dan BlacksCocic, County Counsel, told him to go to Planning Department and secure an application for the variance; the Planning Commission has a procedure that they follow on these setback variance requests. Supervisor Madigan and ~Ir. Castleberry will meet with Mr, Willis and view the area. Mr. Willis will make application for the variance. No action taken at this time. 72-430 APPEARANCE OF MRS. KATHERINE BEST PARADISE: PROBLEM .OF BUSCHMANN ROAD R/W Mrs. Katherine Best, Paradise, stated she had hoped she could talk about the acquiring of rights of way for Buschmann Road before action was taken. The Paradise Safety Commission felt that if the County has money to spend for right of ways, there are plenty of other places that it could be spent. Mr. Castleberry explained the area of the right of ways. She said she did not see why the County should acquire rights of way on Buschman Road, She feels that there needs to be planning of roads in the Skyway area, She said she was referring to the upper part of Skyway going to Paradise Pines. Mr. Castleberry said he would go back orith the Highway Patrol and look at the matter of the stop signs in Paradiseo He will review what is best based on the usage of the roads in that area, Matter discussed; no action taken. 72-431 PUBLIC HEARING SET: JAMES DOUGHERTY(PROPOSED REZONING FROM "A-R TO "AR-MH" WEST SIDE OF FOOTHILL BLVD. SOUTH OF ORO BANGOR HWY. A public hearing was set for March 21, 1972 at 1:30 for the James Dougherty-proposed rezoning from "A-R" (agricultural-residential) to "AR-MH" (agricultural residential-mobile home) district, for property located on the west side of Foothill Blvd., approximately 1/2 mile south of Oro Bangor Hwy. identified as AP 36-36-07, Oroville, containing 0,973 acre. 72-432 APPROVE TENTATIVE MAP: PARADISE PINES. UNIT N0. 16 Jim Lawson, Planning Director, presented the tentative subdivision map of Paradise Pines, Unit No. 16, 378 lots, east side of Nimshew Road, west of the Skyway, northwest of Magalia, Owner: Larwin Developments, Inc. Engineer: James G. Gee, the Murray-McCormick Environmental Group. Planning Coczmiission conditions read. Mr. Castleberry explained the situation. As time goes on, they will build up a kitty for a sewage system for the area. The company would design the complete system. Mr. Castleberry stated that with the property that Larwin owns, the area could end up with a master plan for the whole area; a complete sewer design ready to go to bid for about 1,000 lots. This would allow the County to intelligently plan for a sewer system for that area, Larwin Company has agreed to all the conditions set out. Page 417> March 7, 1972 March7, 1972 On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, the tentative map of Paradise Pines, Unit No. 16 was approved subject to the conditions within the Subdivision Committee's report and subject to the alternative suggested by Public Works Director, and to include some reference to the Cook plan being used as a guide line. RECESS: 12:10 RECONVENED: 1:30 - Supervisor Maxon absent. 72-433 PUBLIC HEARING: APPEAL TO BUTTE COUNTY PLANNING COMMISSION'S ACTION GRANTING A USE PERMIT FOR A COMMERCIAL OFF-SITE SIGN ON PROPERTY AT OLIVE & CENTRAL DRIVE._OROVILLE The public hearing on the City of Oroville's appeal to the Butte County Planning Commission's action granting a use permit for a commercial off-site sign on the property identified as AP 34-33-45, intersection of Olive Highway and Central Drive, Oroville, was held as advertised. Jim Lawson, Planning Director, summarized the actions of the Planning Commission. The Planning Commission approved this use permit on a 6-3 vote. Mr. Lawson gave the background in this matter, The City of Oroville has a Sign policy. The sign in question is now at the Foster Freeze Drive-in. The sign is fox the Olive Hill Mobile Home Park. At present, the owner of the sign has a non- conforming use, They feel that they would receive more exposure to the sign if it was moved across the street. Hearing opened to the public at this time. Appearing in opposition: 1. Mayor Robert Winston, Oroville. He stated that the basis for the Gity of Oroville's objection is that it is contrary to the City's regulations, They do not allow off-site signs. The City of Oroville is presently drafting a Master Plan. Mayor Winsbn urged the Board to consider over-ruling the recommendation of the Planning Commission. Appearing in favor: 1. Mr. Lawrence McKeever, operator of Olive Hills Estate Mobile Homes. He explained the reason for the request to place this sign on the property within the County. They are doing everything they can to make a success of the mobile home park. He .said their taxes went up $3,000 last year, He requested that the Board approve his request for the use permit. Hearing closed to the public and confined to the Board, Supervisor McKillop set out his feelings concerning this request. He asked if the sign was disallowed, what would be done about all the other off-site signs in the County. Mr. Lawson explained how the matter would be handled, He said there would be a draft presented in June for a County sign ordinance. Time spent discussing the request. On motion of Supervisor McKillop, seconded by Supervisor Madigan and carried, the Board denied the action recommended by the Planning Commission, and approved the appeal of the City of Oroville for the denial of the use permit. 72-434 PUBLIC HEARING: HUDSON OIL COMPANY, CHICO, USE PERMIT FOR FREE STANDING ADVERTISING SIGN The public hearing on the Hudson Oil Company, Chico, application for a use permit for a free standing advertising sign was held as advertised. Jim Lawson, Planning Director,. summarized the action of the Planning Commission. The Planning Commission recommended denial of the use permit. On motion of Supervisor Reynolds, seconded by Supervisor Madigan and carried, Ordinance No. 1246, an interim ordinance zoning a portion of the County of Butte, an "A-R" (agricultural-residential} District, and establishing regulations for the use of land and the construction of buildings for property located in Paradise, was adopted and the Chairman was authorized to sign. 72-438 ADOPT ORDINANCE 1247, INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY AN "A-R" DISTRICT (FRAZER LOVETT) Jim Griffith, deputy county counsel, reported on the Frazer Lovett request for rezoning in Paradise. At the last meeting they discussed the problem of the meets and bounds description. At that time the question was asked whether the ordinance was valid. regarding the hearing notices. Mr. Griffith reported that Betty Blair, Planning Department, had found a clipping of the hearing. The matter had been noticed in the Chico paper. The passer spelled out the error in the description. Mr. Griffith recommended that this Board hear the appeal of Mr. Lovett as though the area was zoned as an "A-R" District. Mr. Griffith said that as to the matter of the notices, there has been a very serious due-process problem. He explained the problem of the zoning and the notices. He said what he was saying is that there is a defect in the whole thing. Time spent discussing the problem involved, Mr. Griffith said that procedural defect is the error that should be corrected. Due to the absence of Supervisor Maxon, discussion on matters concerning the hospital was put over one week. 72-440 REPORT ON MEETING WITH SENATOR MARLER, ASSEMBLYMAPF 30HNSON & DR. BRIAN REGARDING BUTTE COUNTY MEDZ-CAL CONTRIBUTION ban Blackstock, County Counsel, reported on the meeting with Senator Marler, Assemblyman ,Tohnson and Dr. Brian regarding Butte County Medi-Cal contributiono After the discussion of the problem, it was apparent that the State had picked up the County's contribution based on the County's budget. Mr. Blackstock pointed out to them the problem that the County was having; the County is operating on a Iow reserve. The State will send up two Auditors and they will be here on Thursday. Mr. Seely will put a County auditor with them. Mr. Blackstock explained how the State handled this matter with the other counties. Hopefully this audit will result in facts which the Assemblyman and Senator can take forward. Mr. Blackstock said they do not anticipate any problems with the Administration. The State will know from the audit pretty much what the County's costs have been. Report discussed. Mr, Blackstock said that another thing came up at the meetingo Right when the meeting was breaking up, Dr. Brian mentioned that he had had some discussions w:itl.! Mr, Blackstock said he dial not have anything to add at this time. Mr. Nickelson commented on this item. He said he takes a very dim view of this proposal; he feels that this is an attempt to have these investigators covered under a peace officers retirement plan, Mr. Nickelson explained the peace officers retirement plan. He said he would be wary of the Board declaring these people as peace officers. It was stated that Mr. Rackerby has some in-put on this.. Chairman Gilman said F}e would like to see these people appear before the Board and explain their problems. 72-443 DISCUSSION: GRIDI,EY JUSTICE COURT APPOINTMENT Supervisor Reynolds said he had a letter from County Counsels office concerning the appointment of the Gridley Justice Court Judge appointment, The forms for the candidates will be here Wednesday; a letter will be sent off to start the oral Board examining proceeding. The Board has to give notice that they have so many days to file with the County their applications for this appointment. Tt was felt that a week would be amply time to give them notice. The letter to the Judicial Counsel would have to have the statements of candidacy attached. It was felt that March 10th at 5:00 p.m. should be the time set for the closing date to receive applications. RECESS: 2:55 RECONVENED: 3:15 72-444 PRESENTATION ON DATA PROCESSING E~IPMENT Mr. Hindery offered his presentation and a recommendation concerning the County's data processing equipment. He said he felt this was a very a.mportant matter and he wished that Supervisor Maxon was present to receive the presentation, He said he would like to make one pointo The data processing department has reduced its costs to the tax payerso He said the budget figures were completely false. He said he has the actual costs in his office. He said he realized that taxes were rising but the attack on the data processing department is not the answero This department offers cost savings to the County tax payers. He said the obvious answer is that the machines should not be idle. The County Should allow other users to use the machines. He said the critcism of his department was based on mis-representation. Mr. Hindery reported that the RCA Company has gone out of business. He feels that the County should be protected by looking at other equipment. He said he has made a thorough investigation of the other companies. He said his concern was that costs to the County should not increase. He said in his investigations he had insisted that any conversion must be done by the vendors. He feels that a recommendation must be made to the Board members, He said there were three companies that he could discuss with the Board: Controlled Data Corporation Honeywell Univac (they purchased RCA) He set out the comparison of the three companies. He set out the capabilities of each of the systems, He explained the costs of the 3 systems. He said that each system proposed would require additional wiring, air conditioning and more space. He said he would recommend going to the Controlled Data Corporation system as being the best system> He said he did not feel that it would be in the best interest of the County to continue with the RGA equipment. He requested that the Board relay their decision concerning .this matter to him at the earliest possible time. He said there was a 30 day termination clause in the RCA leased Recommendation of Mr. Hindery discussed, Advantages of the system set out by Mr. Hindery, information could be stored and it could be run at a slack time. Mr. Hindery explained the advantages this new system would be to the County tax collector. He said that the uses of this equipment is unlimited. He said the remote stations in other counties would be paid for by the customers themselves. Supervisor Madigan questioned Mr. Hindery about the system. It was brought out by Mr, Hindery that Controlled Data controls 4% of the data processing market; IBM controls 75% of the market, Mr. Hindery said that IBM is more costly than any of the other systems; most of IBM customers are captive customers, Supervisor Reynolds said he would like this matter placed back on the agenda for March 21st and have ~upervisor'Maxon present to discuss Chi matter with Mr. Hindery, Supervisor Madigan said he felt there should be some written requirements to the vendors. Mr. Hindery will prepare his requirements. The requirements should be in writing for the study of the Board. Nelson, County Clerk,'by Oriel Elkins, Board of Supervisors' Clerk pro tem. 72-460 PUBLIC HEARING: STANDAltb5 FOR LOT SPLIT ORDINANCE AB1301 This meeting was called on a continuation of a Public Hearing on establishing standards pursuant to Chapter 20 of the Butte County Code, GEORGE CRANES, Chairman of the Citizens Committee on Subdivisions for Butte County appeared at the request of the Chairman of the Board to answer recommendations of the Department o£ Public Works for land div}sion standards. The committee's vote and explanations were submitted in written form as well as verbal. CLAY CASTLEBERRY appeared in rebuttal at the request of the Board, telling the public the Department of Public Works is willing to lower the standards from the original proposals if that is what the public and the Board would like. He explained that a traversable road would be a graded dirt road on which a standard automobile could travel but growth in density might make an improved road necessary. Further, the $200 deposit originally required as ~ deposit for drainage improvements was lowered by his department to $100 as a suggestion. Many drains can be kept at the natural drainage for the present time without injury to the neighbors. HOWARD TOUSSATNT appeared to suggest that Item No. 4 on Page 16 be clarified, He recommended the wording be simply: "Where individual wells and septic tanks are to be installed on the same lot, the minimum lot area should be 12,500 square feet." (Omitting everything else in that paragraph.) PUBLIC HEARING opened at 8:14 p.m. with the following appearing; 1. Jack Bryson, 1873 Del Rio Way, Paradise. Favored staying with the recommmendations of the Citizens Committee, He would like to have the $100 deposit drainage expense not be included in the standards, 2. Mrs. John R, Hanford (Priscella), 1773 Honeysuckle Lane, Paradise, appeared on behalf of the League of Women Voters of Butte County, reading a Letter from their president, Mrs. Barbara Seawall, in which approval of the original recommendations was expressed. 4. Quinton Griffith of Chico, representing the "Bird Watchers", Sierra Club. They favor the original standards rather than those "watered down", Their 350 members are strongly in favor of those standards first submitted. He hoped the board would be guided in the ordinance with local interests and support Mr. Castleberry's recommendations. 5. Mr. .Tack Bryson appeared again, asking, "What is a 'Bootleg subdivision'?" Chairman Gilman read the definition from a manual. Mr, Castleberry put a chart on the bulletin board to illustrate how .lot splits can become bootleg subdivisions. 6. Bill Dawson, Fire Marshall from the Paradise Fire District. Page 426. March 7, 1972 Expressed approval of higher standards of AB 1301. Not in favor of dirt roads in wet weather in his area. He is concerned with them when the population increases in these areas. 7. Emmett Ricks of Paradise appeared, asking what the Board is going to do with land within the Butte College area, with zoning. It is zoned as A-3 as an interim, The Planning Commission is going to study land use plan for the area in the near future, Laurence J, Lawson said. He said they have had no request for development in the area but it will be reviewed on March 17th at a study session. 8, Marjorie Cox from Paradise appeared, again asking why the law should not be cancelled, saying it is unconstitutional. She is concerned with AB 1301 and with the burning law. Chairman Gilman enlightened her on the burning law. 9. William A. DeSpain from Durham, asking how things can be mandated by the state, Someone mentioned that gassage of SB 412 would change AB 1301 insofar as standards are concerned, The Public Hearing closed at 9:10 p,m, and the meeting was confined to the Board, Supervisor maxon said he has had no one call him in favor of AB 1301, On the other hand, he has had letters and telephone calls against AB 1301 or at least in favor of only the minimum requirements. Supervisor Madigan stated he has had no telephone calls, either way. Supervisor Reynolds said he cannot support what has transpired with the committee that started in one way and in the course of two months went to nothing, He said, we do need accessable roads with sixty-foot right-of-way that are traversable except in snow season. If the planned traffic gets in excess of the traversable road, supervisor Reynolds thinks it should be changed. Further, he believes there should be a fee for making drainage or storm drainage could be provided when required. In his opinion, we do need standards for the Public Works Department and the Health Depart- ment to work by. Supervisor Gilman questioned our need for some of these suggested standards. There have been land developments that are going to require road improvement, he said. In his opinion, a traversable road is as loose as you can get and still say anything. Supervisor McKillop believes in the sixty-foot road. He thinks the responsibility of the four-way split should not be left with the Public Works Department but should be with the Board; this also refers to off- highway roads. It is his belief that the $200 drainage deposit should stay in the standards. Supervisor McKillop approves the sixty-foot traversable right-of-way (except in snoca season) off the public road and a drainage deposit. He said the off-side road should be the deter- mination of the Board of Supervisors and that it should be agreed on that when applicable it should be the determination of the Board whether the drainage deposit would be $100 or $200. Mr, Chames suggested a fee of no less than $100 without mentioning a maximum. On motion of Supervisor McKillop, seconded by Supervisor Reynolds and carried the wording in Paragraph 4, Page 16, of the proposed resolution establishing standards be changed to read: "Where individual wells and septic tanks are to be installed on the same lot, the minimum lut area should be 12,500 square feet," The Drainage deposit shall be no less than $100; the access roads shall have 60-foot traversable rights-of-way (except in snow season; the parcelling and off-side trafficing shall be the determination of the Board: Page 427.
