Aliver, in the amount of 77-457 REPORT BY COUNTY COUNSEL: CANCELTdTION OF LIABILITY INSURANCE POLICY Dan Blacketock, County Counsel, reported that lost week the Administrative Officer was advised that the liability insurance police was being cancelled, Mr. Blacketock stated he called the insurance carrier and they have stated that this information is correct; the insurance policy is being cancelled. Jack Sweeney went dawn to San Francisco to see i£ a replacement policy could be secured but sa far he has not been successful. So as of this date, the County can anticipate that it will no longer have liability insurance up to $500,000. Matter discussed; no action taken. Mr. slacketock reported on-the proposed contract for sale of water to Butte Water District. They have signed the contract and returned to Mr. Blacketock. He received a call yesterday from Department of Water Resources asking what the contract was about. Mr. Blacketock stated that the water would be sold in this snooty; he was informed that Butte Water District was going to transport the water across she county line to Sutter County. Butte Water District would take delivery of the water. Bette Water District approves this contract and desires an o`ptioa for next year. Supervisor Lemke stated he objected strenuously to this contract if Chia was a subtafuge to get this water to Sutter County. It was suggested that the ratification of this contract with Butte Water District be held up sad have a study to determine if the water could be pumped up to the Paradise reservoir. It was felt should utilise information Chat have in-house about the study of this water. Land Use Element: The proposed rezoning of the parcel would allow a minimum parce size of 8,125 sq. ft., and allow enly sinnle-family development. The Butte County General Plan Land Use Element delineates the area as low density residential, one to four dwelling units per acre. The project would not be in conflict with this element. Circulation Element: The subject property is located on the south s de of S asta Avenue w#th d'lrect ingress and egress to Shasta Avenue. _, There does not appear to be a conflict between the goals and the policy stated in the Circulation Element and the proposed rezoninc_s. Scianna abandonment of a public utility easement along the easterly 12 feet of Lot 18 of "Shadybrook Subdivision," Wagstaff Road, Paradise was held as advertised. Jim Lawson, Planning Director, set out the background of the abnndonmeat. The Planning Commiasioa vote was 5 to 1 and 3 absent for the abandonment. Hearing opened to the public. Appearing: No one. Mr. Lawson stated Chat the Planning Cosmeiiseioa had asked him to convey the fact that the abandonment of Che easement is the subdivision is being dose one lot at a time. Ms. Colby stated that he would like to have the requirement for 8 caches of rock sad 2 inches of asphalt decreased to 6 inches of rock and 2 inches of asphalt for streets within the anbdivision. Mr. Castleberry stated that Public Works would be wi3ling to look at reduction of the requirements for the 8 inches of rock based on as analysis of the soil. S. BUREAU OF RECIAMATION PRESENTATION CONCERNING WATfiR SUPPLIES IN THE NORTH VALL$Y. Mr. Dave Schu3terr, Bureau of Reclamation, was present to discuss the present drought situation. Mr. Schu3terr stated that the Imperial Valley gets their water from the Colorado River. Thexe is no impact to the Imperial Valley at this time. The San Joaquin Valley will have to go to ground water to be able to have water. The ground water basin will be drained down this year. Mr. Schu4terr stated that north system has Shasta, Trinity, Folsom, San Luis and Whiakeytawn dams to draw from. Il:har&ehn~sisva•abeds thetBd;i}3 apcHaringfweheyears and provides water to Shasta Dam. This is like having water-in storage, When there is a dry year and cuts have to be made they are done on•the following basis: 25% to water rights users; 50 % to municipal and industrial users; and 75% to ail ether agricultural users. Mr. Schuster eaplained the method of keeping the salt water intrusion out of the delta. One of the reasons for keeping the salinity rate down ia•the delta is because of the fiaheties. The sentiment of the meeting was that the people in the Chico area are intexeeted in the Vina Canal. Oa motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, a request to the Bureau of Reclamation asking them to make a feasibility study of looking at the Vina Canal and considering •other area that can be aexved was authorized. 77-47:0 APPEARANCE: JAMES HANSOM. The State requires that the County approve a Reclamation Plan before the County is in the position that they are required to give people itecdamation Plaa. It is a procedural program. Clif Nickelson, Administrative Officer, stated that Mr. Freedman had called him and stated that $80,000 was a good price for the CHP bufiding in Chico. On.motion of 6upervisor Winston, seconded by Supervisor Madigan and carried, the offer to purchase the CHP buildiagist 479 Perk Avenue, Chico at a price bf $75,000 is restated for the last time and Mr. Freedman is put on notice that the Board wbi~klinstigate condemnation process unless he accepts the offer within ten days.
