Probation Department - Board authorization is requested to purchase a personal computer with peripherals and laser printer in the maximum amount of $4,300 {Department budget/salary savings} for the Chief Probation Officer - action requested -- APPROVE BUDGET TRANSFER B-170 AND PURCHASE OF FIXED ASSET ITEMS. Adoption of a salary ordinance amendment reallocating a Sheriff's Sergeant {receives overtime compensation) position as Sheriff's Lieutenant (overtime exempt) for a more effective management structure in the Operations Division (the salary differential between Sergeant to Lieutenant is approximately $8,903 annually). In fiscal year 1993-94, the Sheriff disclosed an expenditure of $13,661 in overtime, and by converting the position, an actual annual savings in overtime of $4,758 may be achieved. Also, as a rescult of a recent arbitration award, it is requested that the classification of Senior Correctional Officer be placed in the Management, Confidential and Supervisory Unit. The Personnel Department also reviewed the job titles for Senior Correctional Officer and Supervising Correctional Officer and recommends the appropriate jab titles be Correctional Sergeant (Senior Correctional Officer) and Corrections Lieutenant (Supervising Correctional Officer} which is consistent with industry standards - action requested - ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN. Superior and Municipal Courts - restoration of 40 hour per week work schedule - adoption of a salary ordinance amendment to effect the courts' restoration to a 40 hour work week schedule by exempting specific, essential court staff personnel classifications from the 36 hour work week - action requested - ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN. County Library donations - in accordance with Government Code Section 25355, donations of $5,000 from Friends of the Library-Paradise, and $1,160 from Friends of the Library-Chico have been received for the Butte County Trust Fund for the purchase of books - action requested - ACCEPT DONATIONS AND AUTHORIZE LETTERS OF APPRECIATION. 4. Notice of completion - Early Site Improvements/Butte County Courthouse (Bid No. 2- 95} - all work on the project has been completed in accordance with the plans and specifications - actfon requested - ACCEPT PROJECT AND AUTHORIZE FILING OF THE NOTICE OF COMPLETION. 5. surplus property - the Purchasing Division has prepared a list of County personal property that is broken, worn out or without further uae to County departments which is to be consigned to C. Popovitch Auctioneers, Inc., to be sold at their next auction per the agreement entered into by the Board of Supervisors on May 24, 1994 - action requested - DECLARE LISTED ITEMS AS SURPLUS AND AUTHORIZE DISPOSAL AT PUBLIC AUCTION. 6. General Services - safety testing equipment - Board authorization is requested to purchase two safety testing equipment items: carbon dioxide monitor, $3,100 and a noise dosimeter with software accessories, $2,450. Funding is available within the ISF fixed asset acquisition budget as a result of savings realized in the purchase of other items - action requested - APPROVE ACQUISITION OF FIXED ASSET ITEMS. 7. Public Works - two of the department's hand held radios used by its survey crews no longer provide adequate service and are too old (over 15 years) to be satisfactorily repaired or upgraded. Proposed is the purchase of two new hand held radios at an estimated total cost of $1,250. Funding will be provided by postponing until next fiscal year the acquisition of a docwment scanner ($1,300) - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. Public Works - in order to more productively and effectively apply pavement markings such as crosswalks, stop bars, and legends, the department desires to acquire a "Cat-A-Quick" striping machine from Cataphote, Inc., for heating and applying an instant drying reflectorized striping powder in lieu of paint. The striping machine has been used on a trial basis and found to be very satisfactory. The machine will be paid for by a $0.94/pound increased material cost for 3,000 pounds, totaling $2,820. Purchased outright, the machine is priced at $4,500. A search was made for vendors of similar equipment, but none could be found - action requested - APPROVE ACQUISITION OF STRIPING MACHINE FROM CATAPHOTE, INC. AT A COST OF $2,820. 9. Sheriff-COronQr - Government Code Sections 26720- 25750 authorize the Sheriff's Civil Division to collect fees for performing civil services. Government code Suction 26731 specifies the amount or percentage of the fees which revert back to the Civil Division, and also limits the use of these fees and the fees are considered "restricted". The Butte County Auditor-Controller has established three funds into which these fees are deposited. Board authorization is requested to purchase a police sedan, three mobile radios, and to equip all civil vehicles with radios, emergency lights, sirens and associated safQty equipment (Fund 1227 Equipment/Vehicles) in the maximum amount of $21,398 plus tax and shipping on radios; installation of vehicle equipment in the maximum amount of $1,000 (Fund 1226 Maintenance/Installation}; and five cellular phones ($907). a VT 420 for access into the Sheriff's main computer system ($1,000) and miscellaneous phone installation kits and antennas ($420) (Fund 1217 Office/Automation) - action requested - APPROVE BUDGET TRANSFER B-163 AND PURCHASE OF FIXED ASSET ITEMS. lo. District Attorney - Spousal Abuser Prosecution Program - on January 10, 1995 the Board passed Resolution No. 95-13 authorizing the District Attorney's office to receive funds from the California Department of Justice for a Spousal Abuser Prosecution Program. The Department of Justice has subsequently granted the County $70,000 for the Progras - action requested - APPROVE BUDGET TRANSFER B-153 APPROPRIATING $70,000 IN UNANTICIPATED REVENUE TO THE DISTRICT ATTORNEY'S SPOUSAL ABUSER PROSECUTION PROGRAM. Page 72 March 14, 1995 95-65 11. 1995-96 Tax and Revenue Anticipation Notes (TRANs) - Board authorization is requested to commence preliminary procedures to participate in the California Cash Flow Financing Prograa far the 1995-96 issuance of Tax and Revenue Anticipation Notes (TRANs). The issuance will be for a maximum feasible amount to be determined by the Treasurer and Auditor-Controller, not to exceed $15,000,000 - action requested - AUTHORIZE THE AUDITOR-CONTROLLER AND TREASURER-TAX COLLECTOR TO APPLY TO JOIN THE CALIFORNIA STATE ASSOCIATION OF COUNTIES (CSAC) TAX AND REVENUE ANTICIPATION NOTE PROGRAM AND TAKE OTHER RELATED ACTIONS. 12. Investments information report - the Treasurer-Tax Collector submits the February 28, 1995 report in accordance with the County's Statement of Investment Policy dated June 1, 1994 - action requested - ACCEPT FOR INFORMATION. 13. Adoption of a salary ordinance amendment - the Agricultural Commissioner requested a review of the job title and specification for the position of Agricultural Pest Control Worker. The specification was ravised to incorporate other duties associated with the weights and Keasures function of the Department. The new recommended title for this classification is Agricultural/Weights and Measures Inspector (no salary range change is recommended and no allocated position is being requested at this time) - action requested - ADOPT ORDINANCE 3182 AND AUTHORIZE THE CHAIR TO SIGN. (FROM 2-28-95) 14, Adoption of a salary ordinance amendment - approved as part of the 1994-95 Final Budget was review of the creation of a new classification entitled Superior Court Examiner {salary range 1168/$1,948--$2368 monthly). A study was conducted and the review substantiated the use of an already existing classification of Paralegal (salary range 1155) to perform the similar job duties of probate and family law. The County Clerk is also requesting that a vacant SupQrvicinq Superior Court Clerk position be reallocated as Court Clerk III, II or Office Assistant I {approximately a 10$ salary savings), and flexibly staffing one supervisory position in the Recorder's Office as Supervisor-Recordable Documents Examiner or Recordable Documents Examiner II to allow greater flexibility and utilization of existing staff - action requested - ADOPT ORDINANCE 3183 AND AUTHORIZE THE CHAIR TO SIGN. Adoption of a salary ordinance amendment - the Municipal Courts requested transfer of the Pre- Tria1 Release Program from the Sheriff-Coroner to the Courts, and review by the Personnel Department of the classification of Manager/Pre-Trial Release Program. Tho study recommends the position be titled Specialist/Pre-Trial Release Program at salary range 1172 ($1,986-$2,414 monthly), which is at parity with Probation Officer II, and adding one allocated position to a newly created budget unit in the Sheriff~a Department entitled "Consent Decree" (budget unit no. 361-001) - action requested - ADOPT ORDINANCE 3184 AND AUTHORIZE THE CHAIR TO SIGN. Introduction of a salary ordinance amendment - Superior and Municipal Courts - the Auditor- Controller received a letter from the Judicial Council of California dated January 3, 1995, which provided a schedule of the revised salaries for judges effective January 1, 1995. The proposed salary ordinance shall take effect retroactively to January 1, 1995 - action requested - WAIVE READING OF THE ORDINANCE. 17. Introduction of a salary ordinance amendment - the Director-Mental Health has requested the Personnel Department review the appropriate classification designation for one position of Principal Clerk (salary range 1110). in assessing the scope of supervisory responsibilities and the level of classifications supervised within the medical records unit, it is the recommendation of the Personnel Department that the incumbent should be reclassified to the existing classification entitled Supervisor-Medical Records (salary range 1147) - action requested - WAIVE READING OF THE ORDINANCE. 18. Resolution recognizing the Catholic Ladies Relief Society for 75 years of service - action requested - ADOPT RESOLUTION 95-37 AND AUTHORIZE THE CHAIR TO SIGN. 19. Resolution proclaiming the week of March 12-18, 1995, as "Employ tha Older Worker Week" in Butte County -- action requested - ADOPT RESOLUTION 95-38 AND AUTHORIZE THE CHAIR TO SIGN. California Department of Food and Agriculture (CDFA} - 1994-95 pest detection-trapping contract no. 94-0144 - proposed is an avendment {no. 1), which increases the dollar amount of the contract by $11,850 (from $26,640 to $38,490) to provide for direct payment to other vendors by CDFA on behalf of the county for the purchase of vehicle(s) and/or tool boxes - action requested - APPROVE AMENDMENT NO. 1 AND AUTHORIZE THE CHAIR TO SIGN. 21. Assignment of counsel - County counsel requests confirmation of the assignment of Green Rock Quarries, Inc. v. Butte County Board of Supervisors and appeal of Green Rock Quarries to the State Mining and Geology Board to the law firm of Bartkiewicz, Kronick and Shanahan - action requested - APPROVE ASSIGNMENT OF COUNSEL. 22. R. E. Harrington - unemployment insurance contract - Board approval is requested of a contract renewal with R. E. Harrington for unemployment compensation services. The term of the agreement is January 1, 1995 to December 31, 1997. The contractor's fee remains at $1.00 per employee with the continuing service fee not to exceed $.06 per full-time employee {no increase in the contract fee charged to the County) - action requested - APPROVE CONTRACT AND AUTHORIZE THE DIRECTOR-PERSONNEL TO SIGN. 23. Emergency repair contracts - Pine Creek Levee/Paiva Ranch - an indemnification agreement has been prepared with, and signed by, the Paiva Ranch and a sponsor agreement has been prepared with the U.S. Department of Agriculture, Natural Resource Conservation Service covering repair work to the Pine Creek Levee resulting from the winter storms of 1995. There is no cost to Butte County far the levee repair work. This is similar to other contracts the Board has approved - action requested: A. APPROVE THE INDEMNIFICATION CONTRACT WITH PAIVA RANCH AND AUTHORIZE THE CHAIR TO SIGN; AND B. APPROVE THE SPONSOR AGREEl~NT WITH THE NATURAL RESOURCE CONSERVATION SERVICE AND AUTHORIZE THE CHAIR TO SIGN. Page 75 March 14, 1995 95-65 24. 1994-95 Rural Health Services Program - County Contract Back Agreement - the Rural Health Services Prograa makes available $285,428 (100 State funds) that can be utilized by hospitals and physicians to partially offset the cost of providing uncompensated medical care to County residents. A portion of the funds are utilized to provide medical treataent services to children diagnosed with problems in the Child Health and Disability Prevention (CHOP) Program. Under the terms of this agreement, the State Department of Health Services will administer the Rural Health Services Programs (Physician Services Account; Child Health and Disability Prevention Treatment Mandate; and Hospital Services Account) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 25. State Department o! Health Services - proposed is an amendment to the agreement (No. 94-21014) to participate in the Hepatitis A Prevention Program for the period January 1, 1995 to December 31, 1995 in the maximum amount of $300,000 (100$ State) - action requested: A. APPROVE BUDGET TRANSFER B-175 APPROPRIATING UNANTICIPATED REVENUE; B. APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER; AND C. APPROVE PURCHASE OF PERSONAL COMPUTER IN THE ESTIMATED AMOUNT OF $2,460 (100 STATE FUNDING IS AVAILABLE WITHIN THIS AGREEMENT). Page 76 March 14, 1995 95-65 26. California Conservation Corps (CCC) - a major amount of debris is blocking affective water flow in a portion of Dead Horse Slough (Chico area) and in a portion of the South Branch of Wyman Ravine (Oroville}, which contributes significantly to flooding of adjacent properties during periods of heavy rainfall as recently experienced. Proposed is an agreement with the CCC to provide labor and equipment to remove the debris. Total cost of the work shall not exceed $22,150 (proposed funding by 100$ F.E.M.A. reimbursement as a future flooding mitigation measure) - action requested - AUTHORIZE DIRECTOR-PUBLIC WORKS TO EXECUTE AGREEMENT ON BEHALF OF THE COUNTY SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER AND APPROVE BUDGET TRANSFER B-173 APPROPRIATING UNANTICIPATED REVENUE ($24,000). 27. Chapman/Mulberry District Tree Planting Project - an November 8, 1994, the County entered into an agreement with the California Department of Forestry for grant funding to implement a tree planting program in the Chapman/Mulberry area - action requested - AUTHORIZE THE DIRECTOR-PUBLIC WORKS TO ISSUE A REQUEST FOR BIDS FOR THE CHAPMAN/MULBERRY AREA TREE PLANTING PROJECT, 28. Conflict of Interest Code - the Lake Madrone Water District has submitted to the Board of Supervisors, far approval by its code reviewing body pursuant to Government Code Section 87303, its Conflict of Interest Code as adopted by the Di$trfct's Board of Directors on July 30, 1994. County Counsel has reviewed and approved the amended code - action requested - APPROVE CONFLICT OF INTEREST CODE AS SUBMITTED. 29. In addition the National Weather Service has advised that the rain is expected to continue through Sunday, March 12, 1995. Also requested is flexible staffing of the allocated Appraiser classifications at the same levels to allow the department to sore effectively manage future vacancies.
