March 23, 1976 _________________ March 231976 =__________________ r Chairman Cameron stated that Dr. Cotner o~the State Department of Health, Advisory t~iealth Counsel, is going to paid a meeting in May. If Chairman Cameron or other Board members wish to participate in the hearing, they would be welcome to do so. This item will be on the agenda for the Supervisors Association meeting in April far discussion. Supervisor Madigan stated that there have been indications that there may not be any funding next year for the Emergency Health Agency. 76-432 DISCUSSION: CHICO CLIPPEROPERATION ' Jim Ruwe, ico, state a worked two years on the senior citizen's transportation problem. The people are pleased with the Chico Clipper operation that has bean started in Chico. It is his feeling that the operators are not living up to their contract. Background information of fhe operation in 1;Tiico and other areas set out and discussed. Mr. Rowe set out Instances that demonstrated that the operator was not doing the things he had contracted i+o do. Mr. f~we said he would be willing to work with the County and the City of Chico to help insure the proper operation of this transportation system. Clay Castleberry, Director of Public Works, suggested that the Board acknowledge the suggestions and offer to meet with the City of Chico to Further discuss the operation, It was stated that there is a meeting next Wednesday of 8:00 p.m.; this item could be discussed at that time. i.etter from City of Chico will be answered, suggesting that the City representatives meet with the County representatives at the meeting scheduled for March 31, 1976 at 5:00 p.m. 76-433 APPROVE HEAD START TRAINING & TECHNICAL ASSfSTANCE GRANT APPLICATION On motion of Supervisor McKi op, seconded y Supervisor Ric ter and unanimously carried, the head start training and technical assistance grant application in the amount of $1,552 was approved and the Chairman authorized to sign. 76-434 APPROVE PAYMENT OF BUTTE COUNTY TRANSIENT AND ILLEGAL ALIEN MEDICAL BILLINGS Payment of Butte County transient and illegal alien medical billings discussed. Supervisor Ladd said he could not see paying these billings. Supervisor McKillop agreed, stating that as long as the County continues to pay them there will be nothing done at State level. Billings set out and discussed. On motion of Supervisor Modigan, seconded by Supervisor Riehter and carried, Butte County transient and illegal alien medical billings were approved to be paid in the amount of $9,362.01. AYES: Supervisors Madigan, Richter and Chairman Cameron NOES: Supervisors Ladd and McKillop 76-435 APPROVE PRISONER BOARDING AGREEMENT WITH PLUMAS COUNTY On motion of Supervisor Cameron, seconded y Supervisor Richter and unanimously carried, the prisoner boarding agreement with Plumes County was approved and the Chairman authorized to sign. Transfers $80,000 from Midway Crossing Protection Account to Midway Grade Separation Account. This is en internal transfer to properly categorize expenditure. B-131 Oroville Justice Court. 1Yansfera $100 f mm extra help to overtime to cover clerical costs due to jury deliberation going after 5:00 in the evening. 8-132 District Attornev. Transfers $1,147.20 within the District Attorney's budget to cover costs of extra help employee replacing regular employee on maternity leave, and to odd $99 to the overtime account to cover certain family support division costs. ii-133 Sheriff - (incarc~ oration), Transfers $10,000 within the Sheriff's budget from enforcement to incarceratim . the budget, this year, was separated into ~ai1 functions end general functions." In doing so extra help and overtime costs were improperly applied. Transfers $400 within the department of office expense to cover increased postage and paper costs. Transfers $44,089 within the budget account to cover phase 1 adminlstration expenses covering various equipment and administrative expenses. Board. 76-437 ADOPT RESOLUTION 76-61 INTENTION TO SELL TAX DEEDED PROPERTY Un motion of Supervisor Richter seconded by Supervisor Madigan and unanimously carried, Resolution 76-61 of intention ro sell tax deeded property (lot 3, block Howe's Addition of Orovil le) was adopted and the Chairman was authorized to sign. 76-438 APPROVE FOOD STAMP ISSUANCE AGREEMENT WITH PO5T OFFICE A new agreement as en raven up increasing issuance cost from $.85 to $I.10 per transaction. Increase covers actual cost of issuance. Adequate funds are budgeted for this increase since there has been a decrease in the volume of issuances recently. Agreement discussed. On motion of Supervisor McKillap, seconded by Supervisor Madigan and carried, the food stamp issuance agreement with Post Office was approved and the Chairman authorized to signr subject to County Counsel's approval. Total project cost for year would be $I29,OB4; with local hard match cost of $46,I09. Hal Brooks, representing District Attorney's office, present to answer questions on the matter. Funding explained and discussed. On motion of Supervisor Richter, seconded by Supervisor Madigan and carried, Resolution 76-b2 authorizing Chairman to sign grant application for real estate fraud unit was adopted and the Chairman authorized to sign. AYES: Supervisors Madigan, McKillop and Richter ABSTAINING: Supervisor Ladd and Chairman Cameron 76-440 REPORT BY COUNTYCOUNSEL; AGREEMENT FOR E.I.R.'s Dan 6 ackstoc ,County Counse , stated t at ast week the Board had instruc#ed his office to come vp with a atandarized agreement for preparation of Environmental Impact Reports. They have encountered several problems. There would be a problem with bidding on such an item. He wondered if it would be possible or desirable to utilize the extra help provision which would have the affect that Planning Director would have a person on his staff so he wind see how many hours work it would require in the preparation of such reports. Reports and manner of reimbursement for the reports discussed. There is quite a bit of paper work in keeping track of the money that is deposited for such reports. Bidding process set out and discussed. Mr. Blackstock explained the theory of contracting for the work. It was felt that before a final decision was made, the Board would like a report From Mr. Lawson as to how ofher counties handle these reports. Supervisor Madigan said that Los Angeles County has sent out a feeler to do away with EIRs. Mr. Lawson will obtain al! the information possible in this matter and will report back to the Board. No action taken at this time. 76-441 HEARING: APPEAL, PLANNING COMMISSION'S FINDINGS REQUIRING AN ENVIRONMENTAL IMPACT REPORT FOR "MOUNTAIN PARK SUBDIVISION" T aring on t appea o P coning Commission s findings requiring an Environmental Impact Report for "Mountain Park Subdivision"was held at this time. Jim Lawson, Planning Director, set out the background and set up maps showing fibs location of the property involved. ~ ~ ~? . Q d , ~ Hearing opened to the public. Appearing; I. Phil Mace, attorney ct law, representing Mr. Kasza. Mr. Mace explained the purpose of the appeal. There will be quite a few problems if the BIR is required. Conditions that are being appealed discussed. The Paradise Fire Deportment has stated that there will 6e no fire problem due to this development. Letter from the Paradise Fire Department filed with the Clerk, Supervisor McKillop said he Felt this was one of the better planned subdivisions. Page Z03. Chairman Cameron spoke concerning the problems involved in this piece of property. There is nothing on the property at this time. This area has been a problem for a long time. This development will help ease the impact. On motion of Supervisor McKillop, seconded by Supervisor Ladd and unanimously carried, the Board concurred with the appeal and denied the requirements for an environmental Impact report for the "Mountain Park Subdivision ". 76-442 DISCUSSION CONCERNING THE REBUILDING OF PULGA-MAYARO ROAD: REQUESTED BY MARSH WASHINGTON $ MARSH T matter o t e re ilding of Pulga-Mayaro Road discussed at this time. It was stated that Mr. Marsh could not be present at this time. Appearing: Mr. Pat Murphy, Chico. He set out the history of the property. The road leading into the property was closed by a slide. They are using the long way through Concow to keep the school going. As of Saturday, they stated they could no conger keep the school open. As a result of this decision, the disturbed children will not be able to live at the school. This will end the application to get the road repaired. Board members questioned Mr. Murphy. One of P.G.B~ E.'s main power lines is in the area of the slide. Clay Castleberry, Aivector of Public Works, recommended that the County wait and see on the matter of the rebuilding of this road. P.G.& E. has mode some extensive studies, i~ad relocation is not the way to go. He felt chat it would take hundreds of thousands of dollars to gat the road back info service. Mr. Frank Cluny, operator of the school, stated that the school had a capacity of keeping t5 boys at the school . The school is now closed. Mr. Mannion, Division of Forestry, stated that the Forest Service has no immediate plans to open the road. Mr. Castleberry said he would suggest that the Board instruct him to keep in touch with P.G. 8 E. It is his guess that they will hove io relocate some of their towers. No action taken at this time. Wiw is authorized to remove these low;~ooks from the library. Mr. Blackstock stated that the Law Library is run by the Law Library Trustees and they take care of these matters. He suggested that Mr. Hanson discuss this matter with the Law t.ibrar-.3an. Mr. Flanson said he had discussed this with the law librarian; he would like to have these banks located. Supervisor Madigan said he would bring this up at the next Law Library Board of Trustees` meeting. 76-445 ADOPT RESOLUTION 76-63 re DRUG ABUSE Dr. En oe reporte t at t e rug program had received a 15°!o cut in the budget. They hove been working around the;cut. One of the Drug Counselors is leaving. Legislation is now being discussed in the State Legislature. lie would suggest that the Board adopt a resolution and make it available to the Legislature ro reinstate the f5°!o cur and to request a cost of living increase. Mrs. Jean Covell read a letter urging the Board ro send a letter to the suggested members of the State Legislature. Matter discussed. On motion of Supervisor Mckillop, seconded by Supervisor Madigan and unanimously carried, Resolution 76-63 re Drug Abuse program was adopted, to include the statements made by Dr. Enloe, and the Chairman was authorized to sign. 76-446 APPEARANCE: MR. GARDNER CHICO Mr. Gar ner state owns over 4 acres on Mariposa Avenue, Chico. Several months ago the property next to his property was sold and the new owner has rented the rooms of the home and has place two trailers on the property and has rented the trailers. He has voiced his objections ro the Health Department and ro the Planning Deportment. Fle was told that the trailers were not illegal but thafi the owner could rent the rooms in the house. Definition of what makes up a rooming house set out and discussed. The trailers will have ro be vacated. The zoning inspector will check this matter out. Mr. Gardner said that when he purchased the property he hod planned on placing a mobile home on the 4~cres. He was told he could place the mobile home on the property only during the period he was constructing his house. Placing of mobile homes on property discussed. His property is now zoned ro allow mobilehomes. Jim Lawson, Planning Director, set out the background of the hearing. He stated that one of the conditions state that all material shall be stored within an opaque fence. Anthony lelati. P.C. and Dominic lelati were the original applicants. Original use permit read by Mr. lelati. The pip~neferred to is outside the fence as it is not for sole. The opaque Fence was not mentioned at the hearing before the Planning Commission. It was Mr. lelati that a use permit was not needed; the use was grandfathered in with the zoning. Mr. Blackstock explained the matter of licensing of junk yards. Provisions of the law set out. M-2 zoning requires a use permit for a junk yard. Supervisor Ladd said he felt this was orte of the best maintained salvage yards in the county. 2. Mrs. Don lelati. She is the owner of the property. The tape recorder was not working at their hearing before the Planning Commission and she felt that this was a underhanded #rick. Ivbdifications to the use permit set out by Mrs. lelati. She also stated the pipe is not for sale. They do not want it within the fence because it has nothing to do with the yard. She does not feel that were violating the use permit. Hearing closed In the public and confined to the Board. Supervisor Ladd said he has inspected the yard. He does not feel the ielati's are in violation. It was moved by Supervisor Ladd that the Board uphold the appeal of the modi- fication of the use permit for auto wrecking yard located on Kusel Road. AMtion died for lack of a second. Mr. Ferguson, zoning inspector, spoke to the matter of the requirement for the fence. Pictures of the wrecking yard of the lelati's presented for Board inspection. There were cars parked out on the County right-of-way and a stack of stall outstide the fence. At the time he took the pictures he was threatened by Mr. lelati and was told that he could not take the pictures. Registered letters were sent addressed to the lelati's which were not accepted by the lelati. On motion of Supervisor Madigan, seconded by Supervisor Richter and carried, Planning Commission's recommendation was upheld and the Board denied the appeal of Anthony lelati of Planning Commission's modification of use permit for auto wrecking yard located on Kusel Road. Waived the second reading, adopted Ordinance 1698 establishing speed limit of 35 MPH on Stafford Lane and the Chairman was authorized to sign. 2. Authorized Public Works to return a $500 time certificate deposit to Don or Linda Weaver, a moving permit deposit, Jordan Hill Road, as work covered by this deposit was not required. 3. Adopted Resolution 76-65 of intention to rename county highways (Magalia Drive and Neal 13~ad), set April 20, 1976 at 2:00 p.m. as time of hearing, and authorized the Chairman to sign. 76-449 DISCUSSION: WATER LINE INSTALLATION-FROG BUILDING Pu is Wor s an consu tent engineer recommend award to low bidder, Seors Construction, for low bid of $20,686.60 for the water line installation at the new FROG building. It was suggested that this 6e put over at this time. Mr. Cdstleberry will obtain the cost of a pump and matter will be placed book on the agenda for consideration. 76-450 APPROVE PAYMENT OF JUVENILE HALL ARCHITECTURAL SERVICES-KITCHEN EQUIPMENT Original design by architect included kitchen equipment alternative, which was not awarded by Board. Later a grant application was made possible purchase of equipment designed by architect. Mr. Ward feels that since he designed it, he should be paid for if. Amounts of claim is $2,178.44. Claim discussed. Mr. Castleberry recommended that the claim be paid. On motion of Supervisor Ladd, seconded by Supervisor Cameron and carried, architect claim for Juvenile Hall architectural services for kitchen equipment was approved in the amount of $2,178.44. Parcel map processing. CETA and overtime use is neaessary to get maps out on time. 2. Road and bridge design section. In order to keep Public Works programs going, overtime will be necessary as well as probable contract of one or more bridge designs. 3. Secretarial and clerical staff. To keep operations and other work for construction program up to date, necessitates overtime use. Supervisor Richter questioned the logic of this move. He stated that this matter has been postponed three times. He stated that the $6.00 figure was a equitable price. It would take some of the pressure off the taxpayer. Chairman Cameron stated that the Cammercial haulers will raise the rate to get it back. Supervisor MclCillop suggested that they be given until, the 15th of April to come up with a determination. Mr. Maddox, representing one of the property owners in the area, Arley t'bwsden. He read a statement prepared by Mr. Howsden stating that he owns nine acres adjacent to the area proposed fox rezoning. He stated that the County Master Play calls for low _ _. density in that area. He stated that cooperative planning should be the rule. He stated that 50 percent of the property owners in the area were against the proposed rezoning. He also stated that the Drainage District was formed against the wishes of the property owners in the area. But that theq were having to pay for it. But that it is not possi- ble to farm this land, because of the declining return from the almond crops. Spoke ~. favor of the rezoning. Dennis Hampton; He supports the rezone as it will permit the owners to develop the land. Loin Hienze; Mrs. Hienze represents the League of Women Voters, She stated that they have studied land use and that they are•committed to preserve the agricultural land in this area. They are against the rezoning. -' ` Supervisor Richter asked Mra. Hienz how she responded to the fact that they were forced into a situation where they paid for the Drainage District, but were now not able to use it by developing the land. Mrs. Hienz responded that they should be compensated but that the League wanted to keep the land in agricultural zoning. Edward McCain; From the Assessment Drainage Districts Mr. McCain is also a land owner. He gave his point of view in an historical and moral fashion. He stated that he was the project engineer for the drainage district. He gave details of the formation of the drainage district, saying that the value of the district is only reflected if the land is developed. He requested an C~1 zoning, stating that this•.i.s"a._,logical-step down from the other zoning. He said that if the property owners were not allowed to develop they may be in a position to recover some of the money. Supervisor Richter asked County Counsel about whether or not the money could legality be recovered. Mr. Blackstock resgonded~eaying that with the A-2 zoning it is unrestrictedp the proposed zoning would be more restrictive.It.its s question of whether the public would be benifitted by the zoning. Wards were opp osed to this zoning saying that it would do damage to the esthetic atmosphere of the area. If this development ~s allowed to take place, the demand will be mag- nafied as we have seen it in the Lassen Avenue and Esplanade area. This zoning could not handle the sewage. Urges denial of the proposed rezoning. Melvin Herring; Mr. Herring said he was a property owner in favor of the rezoning. He is opposed to the rezoning he feels that the valuable Vina Loam should be preserved.Stated that there were better areas for development. The good soil in that area is very important. When asked by Supervisor Richter how he felt about the people in that area being assessed and not getting the benefit, he respon- ded that as they wore speculating they took their. chances. Land value had to take precedence. Jim Jessie; He lives on Hobart street ; he discussed the soil Island in Chico. Stating that it was the extent on the valuable Dina Loam. He said the Bertram pro- perty is on this island. High density is not in the general plan for the city of fhico . Mr. 3esaie stated that the agricultural land ie the heart of the valley. He said that we should plan our growth fiery carefully. If they. follow the recommendation of general plan, the Board will deny this rezone. He addressed himself to the County Counsel, saying that there were indeed grounds to bring suity c;uoted a case in Palo Alto. He said that the day is gone when the farmer could live off his crops.
