Pledge of allegiance to the Flag of the United States of America Invocation by Supervisor Lemke 77-595 APPROVAL OF MTNUTES On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the minutes of March 22, 1977 were approved as mailed, with the correction on Page 73, Item 4, to state "Federal" Legislation rather than State; item 77-557, should show rezone from S-R to S-R (re-affirm 5-R) and on Page 82, show that Supervisors Madigan and Moseley voted "No" on Olive Highway rezone. 77-596 COMMUNICATIONS City of Chico. I / 3, o0 77-597 AUTHORIZE LETTER TO STATE REPRESENTATIVES OPPOSING SENATE BILL 600 Supervisor Madigan reported on Senate Sill 600, which provides that no peace officer could arrest aliens, etc., which he felt should be opposed, Page 85 . On motioa of Supervisor Madigan, seconded by Supervisor Moseley and uaanimousiy carried, a letter was authorized to be written to our Senator and to other county represeatatives in Sacramento expressing the Board's opposition to this bill. RECESS: 'The Board recessed at 9:15 for an executive session to discuss the charges made against department heads. RECONVENED: The Board reconvened at 9:33 following the executive session. 77-598 REPORT ON E]tECUTIVE SESSION: STATE AUDITOR GENERAL TO BE REQUESTED TO MARE STATUS STUDY OF BUDGETARY ACCOUNTS Chairman Richter reported that in regards to the accusations made by the Grand Jury against Mr. Sank Hiadery, Data Processing Director, this Board feels that e4-e suggestions have already been adopted by the Board aad that thep will press forward on the implementation of said suggestions. Regarding the accusations against Administrative Officer, the Board feels Mr. Nickelson operated as they feel he should. Mr. Nickelson is a creature of this Board and the Board felt that the accusations should have been against this Board sad the Board takes the responsibility for I3r. Mickelson'8 actioas. As to the accusatioas against the Auditor, the Board took the following action: It was moved by Supervisor Lead:e;> seconded by Supervisor Winston, and unanimously carried, that the State Auditor General come to Butte County to make s statue report a# budgetary aad•"fuad accountingg.dperations in the County Auditor's Office. = - ~"". 77-,~99 REPORT ON EMERGENCY MEDICAL OOMMITTEE Supervisor Winston reported on the Emergency Medical Committee relating to T9 advertising. The Emergency Medical Council has a small advertising budget but the T'V items were•presented £ree grates. Supervisor Winston said he would present as additional repore on the matter next week. Chairman Richter said he had a telephone conversation with Mr. LaPorte and he stated that Shasta County will take a vote next week and ghat there is a good likelihood thae they will vote to support the Emergency Medical program at a cost of $17,000 or $18,000 per pear. Supervisors Lemke and Moseley have another report. They went to the Butte-Glean Medical meeting last Friday night. There was a slide program and apparently this Emergency Medical program started from a group of volunteers of seven Counties. Butte County got in after all the work was done. Supervisor Winston will report back next week. 77-600 HEARING: JOHN T. AND CLARA M. FROM CENTERLINE OF POISON STREET, ON PROPERTY ZONED A-R (AGRICULTURAL-RESIDENTIAL) LOCATED ON THE SOUTHEAST SIDE OF FOISOiS 5TREET AT HAMILTON ROAD-CALIFORNIA STREET INTERSECTION, IDENTIFIED AS AP 47-1b-06 ORTION), NORD The public hearing en the Gary R. Curia requested variance to street setback to allow a building 40 ft, from the centerline of Folsom Street, on property zoned A-R (agricultural-residential) located on the southeast side of Folsom Street at Hamilton Road-California Street intersection, identified as AP 47-16-06 (portion) Nord was held es advertised. Mr. Curia was present at this time and Chairman Richter asked him abort his not appearing at the meeting held by fire Zoning Adjustment Board. Chairman Richter felt that the proper thing to do would be to refer it back to the Zoning Adjustment Board. Mr. Curia explained whp he had not attended these hearings. Bettye Blair read the letter written by the Zoning Adjustment Hoard. They requested thaC Mr. Curia attend the meeting to be held on March 3, 1977. Oa motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the Gary R. Curia requested variance was referred to the Board of Zoning Adjustment for hearing, 77-602 APPROVE SPEDY GRANT MODIFICATION The grant modification has been prepared and is recommended by the Manpower Planning Council to add $266,312 to the SPEDY grant°to permit employment of 300 youth under fire CETA program this summer. On motion of Supervisor Lemke, seconded by Supervisor Madigan sad unanimously carried, grant modification for SPEDY grant was approved and the Manpower Director authorized to alga. 77-603 APPROVE CETA TITLE i MODIFICATION '" A great modification has been prepared and is recommended by the Manpower Planning Council which will enable GETA to employ 30 non-disadvantaged youth this summer. The $25,000 for this program are unspent Title I --~.;+ administrative and program funds. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the grant modification for CETA Title I was approved and the Manpower Director authorized to sign. 77-604 ADOPT RESOLUTION 77-52 AMENDING SECTION 12.14 (J) OF THE BIITTE COUNTY PERSONNEL RULES Oa motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, Resolution 77-52 amending Section 12.i4(j) of the Butte County Personnel Rules was adopted and the Chairman authorized to sign. 77-605 AIITHORIZED FIFTH STEP ADVANCED STEP HIRING FOR CURRENT ELIGIBILITY LIST BUILDING INSPECTOR Because of recruitment difficulties on the current eligibility Page 87:• March 29, 1977 n ~ ~ a s a a a a a a a a a a ~rCahs29,a1977 a s a a s a s s a a s a a list it is requested that advanced step hiring of the fifth step be considered. It was felt the County needed a good stable trained staff and the County bas difficulty in attracting trained inspectors. Discussed. On motion of Supervisor Winatoa, seconded by Supervisor Madigan and unanimously carried, the Board authorized fifth step edvsaced step hiring for current eligibility List for buiidiag iaspeetor. 77-606 PERSONNEL TO PREPARE SALARY ORDINANCE AMENDMENT REDUCING ZONING INVESTIGATOR POSITION TO HALF TIME A study of the soniag investigator position revealed that approximately 50x of the time is required to spend on zoning im-estigations. 8eport discussed; this has the concurrence of the Planning Director. On motion o£ Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, Personnel was directed to prepare salary ordinance amendment reducing the zoning investigator poaitioa to half time. 77-fi07 DISCUSSION: BUTTE COUNTY COORDINATING COUNCIL FOR DEVELOPMENTAL DISABILITIES This organization has requested support from the Board in the amount of $500. Discussed. Administrative Officer to check to see if there is some State funding to cover some of these things. 77-608 ESTABLISH FE6 FOR BUTTE COUNTY CODE SUPPLEMENTS & FOR COUNTY CODE it is requested that a fee be established for the sale of the Butte County Code supplements that have recently been prepared. Administrative Officer felt the Board should set a charge per page for the supplement and increase the cost of the county code to $50. Oa motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, fee for reprinted pages of supplements to the County Code was established at .12 per page and the CountyCode charge vas set at $50.00 per book. Aa agreement has bees prepared with theCalifornia Highway Patrol for the lease of radio vault and antenna apace in the sew Butte County radio repeater vault on St. John Mountain. On motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, agreement with California Highway Patrol for lease of radio vault and antenna apace in the sew Butte County radio repeater vault on St. John Mountain was approved and the Purchasing Officer wea authorized to sign. 77-610 PUBLIC REARING: PAUL DAUGHE3'~-- REVERSION TO ACREAGE, 4 LOTS, NORTHWEST CORNER OF PALERMO RDAD AND OCCIDENTAL AVE. SWTH OF OROVILLE The public hearing on the Paul Daugherty reversion to acreage, 4 iota, northwest corner of Palermo Road and Occidental Ave., South of Oroville, AP 26-10-08 wea held at this time. The Board suggested that Clay Castleberrq, Director of Pubiic Works, bring in a resolution that would 'allow".the Subdivisioa'Committee to handle these requests for reversion to acreage. 77-611 APPROVE GRANT MODIT~ICATION-000J REGIONAL LAW ENFORCEMENT COMt~4JNICATIONS SYSTEM A grant modification has bees prepared which would enable the purchase of additional communications equipment in the amount of $80,561. Distribution of the walkie-talkies discussed. They are very valuable on search and rescue missions. Oa motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, additional equipment was approved and submission of the grant modification authorized. 77-612 APPROVE PURCE~ASE OF FLOOR SAFE FOR PUBLIC CUARDLAN Tae Pubiic Guardian requests d safe for hie new office Location. The safe is needed to secure money, checks, and other personal property belonging to wards or conservatees. Cost of the safe is approximately $200. Request discussed. da motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, purchase of safe for Public Guardian approved and transfer of funds in the amount of $200 from the reserve authorized. 77-613 APPROVE LEASE AGREEMENT FOR P_ARADI5E $EALTii BUILDING A lease agreement has been prepared with William R. Taylor, M.D. fox the leasing of office space at 5734 Olive Street, Paradise for the Health Department. Thin is a new agreement which calls for a monthly rate of $325 and $25 for Furniture and equipment. Effective date of the lease ie April 1 end will continue on a month to month basis. Taylor, M.D, for Paradise Health building was approved and the Chairman authorized to alga. 77-614 DESIGNATION OF SMOKING/NON-SMOKING AREAS-ADOPT RESOLUTION 77-5~ AB 2291 requires designation of no smoking areas is public meeting rooms by April 1. Area to be designated discussed. It was moved by Supervisor Winston, seconded by 6upervisor Richter sad carried that the entire Soard of Supervisors Room be designated as a "no smoking" area. AYES: Supervisors Madigan, Moseley, Winston and Chairman Richter NOES: Supervisor Lemke On motion of Supervisor Winston seconded by Supervisor Madigan and unanimously carried, Resolution 77-5~ designating smoking and non- smoking areas was adopted s~Rhe Chairman authorized to sign. It was Supervisor Lemke's understanding that this resolution would nullify previous motion as the resolution seta out certain areas in the Board room where smoking would be permitted. AYES: Supervisors Madigan, Moseley, Wiaston aad Chairman Richter NOES: Supervisor Lemke 77-615 APPROVE VOTER OUTREACH/ANIMAL LICENSING PROGRAM This program proposes to~distribute voter registration postcards to persons not registered to vote and to issue notices of violation to those failing to license their dogs. IC is recommended that the Board allow those issued notices o£ violatiaas to license dogs for the 1977-7$ fiscal year is advance of the July renewal of dog licenses. Darrell Kister, Oroviile, stated he felt this program was ea insult to the taxpayers and dog owners in the County. Putting a license tag on e dog does not change its character. Identification is the problem.; The sheep owners had asked the Board to do something about the doge that were killing their sheep. As a matter of record, he killed 183 dogs aad 3 of the dogs had a license. The owners did not claim them. As to the voter registration program, if the people are not interested enough to register to vote, then they should not vote. Unregistered dogs should be caught and if not claimed, then they should be destroged. He would agree to a registration of dogs on a one-time basis. Mr. Mickelsoa attempted to answer some of the questions raised by Mr. Kilter. The intent of the registration is to target the populated areas. He stated that the County Clerk has Co have an "out-reach" registration program for voters. Background of licensing of dogs set out by Mr. Nickelson. James Hanson asked if Butte County was the leading county regarding rabid animals. He was told that we were one of the leading counties but that not a lot of dogs were found rabid. Steve Musaelman explained the matter of Che questionaeire. On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, the voter outreach/animal licensing program was approved. 77-61b APPEARANCE; E. C. FULLERTON, DIRECTOR, STATE DEPT. OF DISH & GAME: DEER HERD MANAGEMENT GLANS, FUTURE FUNDING, AND POSSIBLE LEGISLATION: MOTION TO SUPPORT THEM IN REQUEST FOR MORE GENERAL FUND tdONIES TO ENFORCE LAWS E. C. Fullerton, director, State Department of Fiah sad Gmne was present to discuss deer herd management plans, future funding, and possible legislation. Mr. Fullerton explained some of the programs. He stated that they are now embarking on a sew management of deer herds. They are hoping to bring the deer herds up-'La'what they were is the peat. They are asking the State Legislature to tightened up the laws concerning the problem of night hunting of deer. They are in the midst of putting together a contingency plea to combat the drought program. They will be planting fish in the waters. They Page '~~. Legislature has broadened their'dutiea by hsadliag all animals in the state. The State has put new duties on them. Deer poachers are being caught but they need more night patrols. Chairman Richter asked if there was anything this County could do to help them. A resolution could be adopted supporting their request for funding from the General Fuad. On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, a~resolution supporting.-the,.State Depaztment of Fish and Game in their request for General Fund monies to help them eafarce the lawsa was requested to be prepared by County Counsel. 77-617 APPROVE BEQUEST FOR MORE FAMiLX SUPPORT DIVISION Mr. Y.en Leach preaeat to explain his request for staffing needs within the family support division and requests that a salary ordinance be prepared adding a typist clerk sad family support ittveatigatar, in addition to providing necessary office equipment. Se presented a written document to the Board outlining the reasons for the request. Re has talked to Family Support Division and they feel that with the reassigning of some of the duties, they could eliminate a typewriter. Staffing discussed. Mr. Leach explained the program of collecting the support payments for families. Supervisor Winston stated he was in sympathy with the program, say increase in staff should be handled at budget time. Chairman Richter said that in the whole welfare mess, this program is the one bright light. tie feels that this request chould be granted. Action to be taken discussed. RECESS: 11:10 RECONVENED: 11:15 77-618 APPEARANCE: DAN DRAKE, CHICO-ItECARDINC MINOR DEVIATION FOR YAC ZONING FOR DEVELOPMENT Mr. Dan Drake stated that~his development was in a PAC zone and there was no allowance for a fence. The fence is needed for privacy and security. The development is bounded by three streets; Lassen, Renshaw and Cussick Avenues. This would fail under tt-e category of a minor deviation. Dan Blackstock, County Counsel, stated that a fence is considered a structure. If the fence is allowed it would be within 35 feet of the centerline of the road. Would there be any problem of Bite visibility? Mr. Blackatock stated that possibly the Board would Iike to consider making an amendment to the PAC zone to provide a procedure by which this type of problem can be taken care of. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the Board finds that a fence would be a minor deviation of the PAC zone and the change is allowed. County Covasel ie instructed to prepare an amendment to the PAC zone that would prevent this type of thing from happening again. 77-bI9 APPEARANCE: JAMES HANSON. DROVILLE. Mr. Hanson stated that he was concerned with additional investigators being placed in the District Attorney's n£fice. This should be placed in the Sheriff's office. Mr. Hanson stated that he would Iike to discuss the mining ordinance. 77-620 APPEARANCE: ROBERT MILLER Mr. Miller stated that he was opposed to the proposed ordinance on mining. 77-b2I APPEARANCE; STEVEN HEADSELL Mr. Headsell stated that the biggest problem in mining ie the Forest Service and the Bureau eE Land Management. The Bureau is attempting to restrict all mining operations no matter how small. 77-622 APPEARANCE: ALFRED K. DOLAN. CLARK ROAD] PARADISE Mr. Dolan stated that he did a little mining. Mr. Doiaa stated that he was opposed to the mining ordinance. 77-623 APPEARANCE: CAL SMITH. PARADISE Mre. Smith stated that she sad her husband mined. It is very nice to go out into the woods and do a little mining. It is very peaceful. Mrs. Smith stated that the miners do not destroy the land. 77-624 APPEARANCH: PEGLEG SMITH. PARADISE Mr. Smith stated that he was opposed to restrictions on•mining. There is a great deal of mining going on in Butte County. 77-625 APPEARANCE: ROBERT F BROCK PRESIDENT'.MINING COUNCIL IN BUTTE COUNTY Mr. Brock stated that he was opposed to additional restrictions placed on the misers. 77-626 APPEARANCE: AL APPEEMAN. THERMALITO Mr. AppZemaa stated that the Supervisors had given the miners a lot of help. The State and Federal people are to blame. The Supervisors should be given more time. 77-627 AUTHORIZE SENDING OF CHAPTER 13 OF THE BUTTE COUNTY CODE TO STATE DIVISION OF MINES AND GEOLOGY Supervisor Lemke stated that the committee on surface mining procedure ordinance and reclamation plane was not readip~~to make a report. '(Lt, Cherry rezone) 77-629 ADOPT ORDINANCE 1814 ZONING A PORTION OF COUNTY A "TM-40" (TII~ER MOUNTAIN DISTRICT CHERRY REZONE-WITH THE DELETION OF THE 40-ACHE PARCEI On motion of Supervisor Wiastan, seconded by Supervisor Madigan unanimously carried, Ordinance 1814 zoning a portion of County as an "TM- (Timber Mountaia) District was adopted, with the finding that all this ordinance was doing was to correct the avereight of deleting AP 56-04-44, and the Chairman was authorized to sign. 77-630 APPROVE Bi1DGET TRANSFERS Mr. Miekelsoa stated that in addition to the budget transfers listed, the E.I.R. Director has requested a transfer within his budget for extra help in khe amount of $5,000 to clean up the backlog of E.I.R.s. Request discussed. On motion o£ Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the following budget transfers were approved: E.I.R. Department, transfer of $5,000 within budget to extra help Butte County Fair Board 1976 3, This 3~a a $2,598,72 transfer in order tc reconcile the Fair Boards 1976 statement of operations. Couatp Counsel stated that he had en ordinance that could be adopted today on an emergency basis .for the use of grey water. The ordinance could go fnto effect immediately and would aspire oa December 31, 1977. Request for ordinance discussed. Clif Nickelson, Administrative Officer, reported on liability insurance coverage. Jack Sweeney has been able to secure coverage for the County with Columbia Insurance Company and needs authorization to sign e binder for the $L76,000 premium. This would be a $L00,000 deductible insurance coverage. Insurance and premium discussed. Self-insurance should be considered it was felt. Discussed Bill AB 961, Knox, relating to insurance. A study should be made in the future for sal#-insurance. It was moved by Supervisor Winston, seconded by Supervisor Moseley and carried that Jack Sweeney be authorized to execute the binder with Columbia Insurance Co. for the liability insurance, with a $100,000 deductible clause, and that this Board authorized McVey txCompany to make a study of the insurance requirements and needs of the County of Butte, with the provision that the proposed insurance policy have a b0-day caaeellation clause, with the unearned premium to be pro-rated.
