and unanimously carried that the response to County's application for

be referred back to the Committee £or review and report back next week.
75-577 ACCEPT WORK OF CORPS OF ENGINEERS CONSISTING OF BANK SLOPING AND PLACEMENT
OF ABOUT 600 FEET OF SANK PROTECTION WORK NEAR Otb FERRY ROAD ON SACRAMENTO
RIVER LEFT BANK AT RIVER MILE 183,3
The work of the Corps o£ Engineers under the Assurance Agreement
eoasisting of beak sloping and placement of about 600 feet of bank protection
work near the Ord Ferry Road on the Sacramento River left bank at River
Mile 183.3, Butte County, California discussed. It was felt the work was
proper, except that the bank sloping should be extended further.
Work discussed.
On motion of Supervisor Madigan, seconded by Supervisor McKillop
and unanimously carried, the work of the Corps of Engineers under the
above agreement was accepted, with the request that the Corps of Engineers
extend the eloping of the bank protection work.
75-578 DISCUSSION: LETTER FROM•MERCED COUNTY IN RE JUVENILE HALL
Supervisor Richter presented the Board members with a copy of a
letter from Merced County. He explained the basis of this letter. He
said there is a strong possibility that there will be Statc legislation
concerning the E01's being retained at Juvenile Halls. He stated that
he had telephoned Mr. Murphy of Merced County and asked him where he had
obtained hie information. He talked Co Mr. Garfield and he stated that
Che proposed legialatioa would bar the incarceration of 601'e at juvenile
halls. No state would be eligible for any funds that are placing these
601's in Juvenile 1[alls. Proposed legialatioa discussed; no action taken.

75-580 CHAIRMAN AUTHORIZED TO SIGN REQUEST TO DECLARE CHINESE CEMETERY

Chairman Ladd stated he had a letter from the Historical Societe
and that have voted to declare the old Chinese Cemetery oa Marysville
Road a historical (ppnument. They need the Chairaen's signature on the
request.
On motion of Supervisor Cameron, seconded by Supervisor Madigan
and unanimously carried, the Chairman was authorized to alga the request
to declare the old Chinese Cemetery a historical monument.

75-581 DISCUSSION: REPORT 8Y SHERIFF CONCERNING CORRESPONDENCE RECEIVED FROM
CITY OF•GRIDLEY CONCERNING ADDITIONAL PATROL COVERAGE IN AREA SURROUNDING GRIDLEY
Sheriff Gillick reported to the Board concerning coxrespoadence
received last week from the City of Gridley concerning additional patrol
coverage in the area surrounding Gridley. He explained matter of the
mutual aide agreement. There is one County patrolman and one City of
Gridley patrolman on duty at night; they back each other up. ge has not
kept track of the number of times that they have assisted each other.
Everyone is askfng for more security. Sheriff Giliick said he would have
the deputy keep a lo~g.• on how often they easist each other,
Supervisor McKiilop said that when the budget is reviewed, this
whale problem could be soaked at. Maybe at that time the Sheriff could
present data on an over all basis.
Sheriff G1111ck will discuss this matter with the City of Gridley;
he will do everything he can to takt care of the situation. The implication
is that the County should provide more protection is that area. Sheriff
Gillick will answer the letter by writing to the Board of Supervisors and
sending a copy of the Citq of Gridley. He will also discuss this matter
with the Chief of Police of the City of Gridley.
75-582 DISCUSSION OF PROPOSED CON9TRIICTIDN ITEM INCLUDID IN 1975'76 MAINTENANCE
BUDGET FOR MAINTENANCE AREA N0. 5
George Stamm reported on the proposed construction item included in
1975-76 maintenance for Maintenance Area No. 5. He gnus the backgsound of
the situation. There are three maintenance districts in the County that
benefit from flood control projects in the County. Maintenance Area No. 13
is the district that raises funds for the maintenance of the Cherokee
project. Butte Creek levee maintenance is done by Maintenance Area No. 5.
It was requested that a discharge structure be Included in the Chico levee
project. Hamlon Slough project explained. They have had trouble with this
facility as Tong as it has been constructed. It does not discharge properly
into Butte Creek. This year they have included an item for the repair of
the Hamloh Slough structure. Mr. Stam@ stated that Mr. Middleton Was present
today to explain this project.
Mr. Bob Middleton, in charge of maintenance for Dept. of Water
Resources, spoke concerning the projects fncluded in the 2aintenance
Budget for Maintenance Area No. 5. Zones of benefit explained, He
stated that the Corps of Engineers may acquire additional control gates.
This would be an additional expense.
Supervisor Madigan suggested that it might be a good idea to look
at this location tomorrow duxiag the road tour. Matter to be placed
back on the agenda after the road tour.

75-583 PUBLIC HEARING: CURTIS E. R055ITER APPEAL OF PLANNING COMMISSION
REQUIRSi~NT FOR EIR ON LAND DIVISION IAP 28-17-51)
The public heeiCing on the Curtis E. Rosaiter appeal of Planning
Commission requirement for EIR on land division (AP 28-17-51) was held
at this time.
Boa Graves, of Graves & Geddis. present to discuss the reasons for
this appeal. His firm was emploged by the property owner to make the

survey of thin property and to prepare the parcel map. This property is ...
southeast of Oroviile in the Swede Flat area. The Environmental Review
Committee determined that an EIk would be necessary for this division because it
might have as affect on the environment.
Mr. Graves set out the background of this land division. ~ Mr. Rossiter'
pur hased a 40-acre pparcel and he now desires to fluids this into four parQp~s
eae~i consisting of 10-acres. He does not believe they can be divided any
smaller, The .area is zoned M-R (mountain-reereatlon),
Mr, Lawson read the Committee's findings into the record. They are
requesting more specific guidelines. Chairsnaa Ladd said he could not
see how these four ten-acre parcels would have nay a#fect on the County.
Hearing closed to the public and confined to the Eoard. Supervisor
Cameron said he would like to look at this area while oa the road tour
tomorrow.
Appeal discussed.
On motion of Supervisor Mclfillop, seconded by Supervisor Cameros and
unanimously carried, the hearing was continued to Tuesday, April 8, 1975
at 10:30 e.m.
75-584 APPROVE_CETA TITLE 0I, GRANT APPLICATION
Jim Rackerby statad that a grant~applicatioa has been prepared
increasing the County's CETA Title YI program by $55,2k1. These grant funds
will provida vor 6 additional temporary corkers to be assigned to the
County's Public Project Program. Mr. Rackerby stated he had sent a
memo to the Board members netting out where these positions would be
placed.
Chairman Ladd said that ia6tead of just the 3 positions being kept
for the Home Imgrvvement Program, ha would like to nee all 6 of them
being used for the Housing Psoject. Mr. Rackerby explained how the
positions would be used. Positions discussed.
On motion of Supervisor Richter, seconded by SupervisorMcKillop
sad unanimously carried, the great application for CETA Title VI was
approved and the Chairman was authorised to sign.
75-585 APPEARANCE: MRS. KATitY WEST. PARADISE in re PARADISE ASSESSMENT DISTRICT
Mrs. Kathy Weat, Paradise, stated that the people in Paradise are
concerned about the asseasmenta within the Paradise Assessment District.
They are now filing a petition requesting the re-opening of the hearlags.
The residents did nat realise that this was an important item; the people
did not know that they were being assessed for this district. She felt
they had a right to appeal on the grounds that the notices were misleading.
She filed a petition with the Clerk.
Supervisor Cameron stated that there was a great deal of confusion
over these assessments, He would like to suggest that the people be
allowed to speak at the 2:00 p,m. hearing,
Request discussed, Dan Blackstock, County Counsel, said he would
11ke to suggest that he report back to the Board When the Board reconvenes
at 2:00 p,m,; he will give a recommendation then as to whether the hearing

A resolution hsa been prepared endorsing the concept of elimination
of unnecessary red tape where federal and state monies are concerned.
On motion of Supervisor MclCillop, seconded by Supervisor Cameron
and anaaimousiy carried, Resolution 75-55 re elimination of unnecessary
red tape was adopted and the Chairman was authorized to a1gn.
75-591 REPORT ON MONEiMENTING P80JECT
Clay Castleberry, Director of Public Works, reported on the monumentiag
project. He said they have been making fine progress on this project.
Theq have located many markers. Nevada County would 11ke Che foremat of
this project sad would like to pattern the method. Mr. Castleberry explained
the area that they are working in at this time. Report given for information
only.
75-592 ADOPT FEE SCHEDIII.E FOR HANDLING LI UID WASTE AT HEAL ROAD LANDFILL
Fee schedule far handling liquid waste at Neal Road landfill
discussed. The local eannertos dump their waste material at this site.
There are ponds to dump the septic tank materi8ls. Mr. Castleberry
wa~1d like to have fees set for the dumping of Che waste matters. Fees
discussed. It was felt they could be approved, on a trial basis.
On motion of Supervisor Richter, seconded by Supervisor Madigan
and unanimously carried, fees £or handling liquid waste at the Neal
Road landfill were approved, oa atrial basis.
Supervisor Madigan questioned Mr. Castleberry about the garbage
rates. Mr. Castleberry said the garbage committee ie going to hold a
meeting in aboue twe weeks. They feel that there should be franchise
areas in Paradise and Chico. If thin is done, then the rates would be
set automatically.
Garbage rates discussed. No action taken,
75-593 APPROVE PROCIDURE FOR FAIR HEARINGS HY APPLICANTS OR RECIPIENTS UNDER
THE GENERAL ASSISTANCE PROGRAM
Bob Crieaa, Welfare Director, presented the proposed procedure
for fair hearings by applicants or reeipienta under the General Assisteace
Program. Procedures discussed. Applicants will have legal counsel
at the hearings, if they desire. It was suggested that there be an
appeal officer from County Counsel's office to hear these appeals sad
rhea make a recommendation to the Board. Chairman Ladd felt that as there
are not many of these appeals, the Board should handle them.
Chairman Ladd felt that these guidelines were quite veil
prepared sad they ale accessary. Supervisor 3ycKilloa felt ttie'gitideliaes
sb~uid be followed as prepared. Supervisor Cameron acid he would like to
suggest that the words be added to No. 1 of the procedures: "referral to
legal services within the county"

The Sheriff hen requested a 60•day extension of the temporary
assignment of Deputy Sheriff Al Imhoff to a sheriff's sergeant position
during the absence of the incumbent, Sergeant Jones.
On motion of SupervisorMcItillop, seconded by Supervisor Cameron
and unanimously carried, the 6D+day extension of a temporary assignsent
as requested Was approved.
75-595..nISCUSSION: MERIT ADPANCEMENT VESTED BY JUDGE SAVAGE
3udge Savage has requested authorisation to grant a 2 stag merit
advancement to the Orovilia Justice Court Clerk Jackie Mardon. Merit step
advancements beyond 1 step require Board approval under Section 6.14 of
the personnel Rules. Mr. Nickelson said they have viewed this with
reluatance~:.. The County has the study of positions going on.
Request discussed. idc, Nickelson will answer Judge Savage's
letter and explain the Board's thinking oa the ~ quest.

Oa motion of Supervisor Cameron, seconded by Supervisor McKiilop

Oo March 11th, this Board approved a grant application to fund e
c ammuaicatioas officer for OCJP Region C contingent upon the assurance
that the three other counties in the region wouid~participate in the -ars
match requirements. That assurance has been received end to complete the
grant application a resolution is necessary authorizing submission of
the application.
On emotion of Supervisor McKillop, seconded by Supervisor Cameron
sad unanimously carried. Resolution 75-56 antharising grant application by
the aoman:nicetions officer and authorizing him to execute the great
award contract and certifgiag that the applicant agrees to provide
matching funds required vas adopted and the Chaireum was authorised to sign,
75-59$ APPR09E SUBLEASE: CHICO AREA RECREATION AND PARR DISTRICT
The District forwards sublease agreement between the Recreation
District and Walter J. Scott, Scottq's Boat Landing, for period of one
year terminating December 5. 1975. The Recreation District Board shone
snot to extend the lease beyond because of the pending transfer of
Bidwell River Park to the State Department of Parks and Recreation.

and unanimously carried, the sublease between the Chico Area Recreation
and Park District and Walter J. Scott, Scotty's Boat Landiag~was approved
sad the Chairman was authorized to sign,
Hill Lawrence, County Auditor, explained Budget Transfer 8-207.
which represents the revised budget for County Service Area No. 26.
He felt there were things that the Board should be advised about.
Under the terms of the agreement, it calla foz a transfer of monies from the
proceeds of the bond sale, a trasfer to Thermalito Irrigation District.
Under the FsA loan, the funds have to be kept under the control of the
Hoard of Supervisors.
To accomplish what seeds to be done, they have deleted the original
budget in it; entixety and established a sew one. Re explained the
contributions of the HUD grant and the contribution from T.T.D, as advance/.
The advances from T.I,D, have been primarily for preliminary work for designs
sad orgaaisiag the protect, The budget w111 also include the establishment
of tvo reaetwea: 1-for opere.tion and maintenance of the district sad 2-
for the bond redemption reaeroe.
Mr. I.awreace explained the repayment of the funds to T.I.D. Be
also explained how the matter should be handled. The necessary reserve
f ands will be eatabliahed, He recommended that the Board adopt the
revised budget. If the Board adopts the budget as presented, they can proceed
with getting this thing oa the way.
On motion of Supezvisor McItillop, seconded by Supervisor Madigan
e nd unaninwuslq carried, the revised budget pas adopted in conformance
with the agreement.
Oa motion of Supervisor McKiilop, seconded by Supervisor Cameros
and unanisously carried, payment of election Hosts for County Service
Area Ro. 26 was authorized is the amount of $963.94.
Mr. Lawrence explained the bill from Miaeaian & Minasiea. B.e
has discussed this with Mr. Blackatock. This is for their services;
they feel their efforts lead to the final approval of the bond election.
Mr. Blackstock Raid he vould recommend that the Hoard approve the proposal
presented by Mr. Miaasian, in the amount of $2,710.05. said funds to be
taken from the County Service area Na. 26 funds. Request discussed.
Matter put aver to give the Hoard an opportunitq to study the request.
75-600 BUDGET TRANSFERS AYPROOED
On nation of Supervisor Cameron, eecoaded by Supervisor MCR111op
and unanimously carried, the following budget transfers were approved:
'$-~88 Central Service"s - Motor Pool. $1,150 is transferred from the
.reserve to maintenance-£uel and oil account in the Central Services - Motor
Pool budget. Increased cost of fuel and higher pool car usage by departments
has caused the shortage in this account. The increased charges because of the
higher usage will balance the increased cast.
B-199 Plannine. $107,58 is transferred from office expense to special
departmental expense within the Planning budget and $3S from transportation
and travel - coumissioners to board authorized travel within the Planning
budget. Special departmental expense deficiency vas caused by zoning slap
reductions for the urban areas. No;~mose of_ these are contemplated far the

balance of the year. The travel amount is to cover deficiency created by the
required attendance at the Northern California Supervisors Association of the
Planning Director while serving as committee cecretary:

B-201 Medical Care Services, This transfers $6,000 from the professional and
• sp'ezialized services account with $1,600 going to support and care of persons -
'Chico Ambulance, $2,400 to support and care - Oroville Ambulance, and $2,000 to
support end care -Paradise Ambulance. These amounts are estimated to be needed
to "cover the cost of maintaining ambulance services through the existing agreement
between the County and the three providers of ambulance services.
8-202 Superintendent o~ Schools. This transfers $500 from other transportation
and travel to equipment maintenance with in the Superintendent's budget. The
$upetintendent's budget as prepared made no provision for equipment maintenance
• through an oversight and quarterly payments on the NCR machine maintenance contract
at $105 quarterly plus some other equipment maintenance costs on office machines
must be paid. '
. B-203 Purchasing. $18.90 is transferred from other transportation and 'travel

Staff comments explained by Mr. Lawson. The original ordinance
had a 15 day appeal period; the State guideline asks for s 15 day period,
eo the County is in compliance. Chairman Ladd stated that as page 5,
the minimum actual cost is determined to be $100.00. &e feels that this
cost of $100 is excasaive. Mr. Lawrence said the $100 minimum was
established by the Board at Sn hourly rate of $10.00 per hoar. It Was
felt that it is difficult to tell what the E.T.&. will actually coat.
Supervisor Richter felt that this should be as hourly charge. Costs
discussed,
Guidelines discussed, Costa for copy of report discussed. The
Committee felt that the cost should be $1.00 for the first page and

The Board felt the fees for copies should be $1.00 for the first page

The continuation of the public hearing as the Skyway Asseasm~znt
District No. 1 was held at this time. Chairman Ladd questioned Dan
Blackstock about the legal question that had been posed this morning.
Mr. Blackstock suggested that theChairmaa open the proceedings at this
time.
Gale Peck, attorney for the district, said that he has reviewed
the notices that have gone out fa this matter. Mr. Blackstock recommended
that this matter be set for an additional hearing and that the assessments
be re-noticed. In this way, everyone will have an additional period to
file a protest, If a protest is alreadp filed, this person will not be
required to file soother protest. the Clerk has seat copies of all the
written protests to the Board members.
Notices discussed. Mr. Blackstock recommended that the new
notices contain all the proper iafarmation and that they be sent in
an ea9elope.
County Cognael recommended that this Board rescind the closing of
the hearing to the public, that the engineer of work notice aii property
owners, that a :FdatARs~ be set for another hearing.

Bruce Grinnell, attorney for A-C Contractors, appeared to discuss
the sew hearing date and payment to the contract. This project has been
completed for 5 months; hie cheat has already accrued costs because of
this deiaq. Mr. Peck stated that there was no waq that she contractor could
get paid until these hearings are through and the bonds have been sold.
There have been protests about the work that has been accampliehed.

the intended proceeding today Was to have Mr. McCain set out the changes
in the assessments. The audience Wea requested to file a written protest
today or before the neat hearing date of April 22, 1975.

1. Mr. Adoph Pearson. He would suggest that this new assessment
be considered very carefully.
2. Mr. Dwight Breed, representing Mrs. Collins. He asked
if those that Eiled s protest at the last hearing, would they have to
re-file another protest. He was told that the old protests would be
included in the next hearing.
3. Mr. 'William toward, Paradise. He was chorea as spokesman
for the property owners on Luther Drive. They wish to appeal the
recommendation of Mr. McCain concerning the assessments.
4. Lawrence Webb, 5880 Skyway. He protested hie asaessmeat~
of $5.821.00. He would like to know haw this figure was arrived at.
Mr. McCain set out the procedure used to arrive at the assesmmeat figures.
5. Mrs. Kathy Weat. She stated that she had filed a
petition this morning. She asked Hr. McCain if the drainage assessments
were based oa benefit. She said she had investigated this matter and she
has found that the downtown area was assessed Daly on frontage. She set
out her protests 1n this matter; the downtawn merchants were not assessed
for sewers. Mrs. West set out the problem of the assessments and the
benefits to be received; she feels the assessments are too high.
Mr. McCain answered the questions sat nut by Mrs. West. Mr. Slackstock
said he did not know that theq: were making a reliance on a proposed sewage
district that is now dead. Nr. McCain set nut the sanitary system that had
been progoaed. He showed the lateral system that hen been set up for
drainage. It Was stated that the laterals were put in for the convenience
of not tearing up the pavement in the future for placing in of the sewage
leterale. Laterals discussed. Basic benefit of the groject explained
by Mr. McCain.

if there were alternate ways to set these assessments. He also suggested

County Counsel requested that Mr. McCain comment on this. Mr. McCain
said they could prepare the maps sad posC them in various places is Paradise..
They could provide sprint out of the system used. !!r. McCain suggested
that the Board members go by his office and he will show them the maps and
plans and tell them how each assessment was arrived at.
Phil Mace, attorney at law, said that along the lines of
Mr. Minasian, he would like to state that the map that is being used
now is outddtedd. They would like s current map. They do not have s map
that shows the current parcel numbers. It is aecesssry that this map
be secured. Mr. McCain said he would secure this information for Mr. Mace.
Mr. Robert Wilson had questions that he asked of Mr. McCain and
the Board. Ha presented his written protest at this time.

Mr. McCain asked the Board 1f they would like him to place the display
at the Paradise Memorial Rsll.. Is the hall always opeap Request discussed.
It was felt it would be better to place the display in the Paradise
Recreation District Hall.
Mr. Blackstack again requested that each Board member read the
protests filed. These protests will have to be read by the Clerk at
the nett hearing unless each Board member reads them before the hearing.
Re will request confirmation from the Beard members that they have read
the protests.
Mr. Minasian asked if the Board could see their way clear to have
Mr. McCain run alternate reaps to place the assessments. The maps could have
some alternates on: curbs and gutters, drainage, sanitarq system sad oa
frontage. Mr. McCain said 1t would not be 8 small sum to rnn these
alternatives, It would cost approximately $4,000 if this were to be done.
Mr. Mace stated that the Board does have the power to offer a con-
tribution by the County for putting in the lateral across the Skyway. This
was put in at the request of the County. The people in Paradise feel
that this is a County coat. The laterals were put is as a road project.
Mr. Castleberry explained about the funds paid by the County.
Curbs and gutters were installed in front of the Memorial Hall. He
explained what the County had contributed to this project.
Time spent discussing the assessments and how they were spread
to cover each item. Discussed whether Mr. McCain should run up
alternate methods of placing sssessmente on these parcels. Hr. McCain
said he could go through the formula and other approaches during recess.
He said he would have the maps and charts placed in Paradise prior to

Ae had been requested by Supervisor Madigan to prepare a summary of the
appro:d.mate land loss if this river is made a wild river. He said Butte
County has about 40 miles of river frontage. There are about I60 acres
per mile. Value of the lead set out. This is the best land Co be had
in the County.
Supervisor Madigan felt that fn addition to the resolution adopted
by this Board, the Board should have additional information to present to
the Corps of Engineers at thpApril 15th meeting.
Report and affects discussed.
On motion of Supervisor McICillop, seconded by Supervisor Madigan and
unanimously carried, Mr. Mackessy and Mr. Nickelson were authorized to write
a letter setting out the figures and the loss of land if the Sacramento

the vacancy.
On motion of Supervisor Ladd, seconded by Supervisor McKiilop and
unanimously carried, the resignation of Helen McKuaeick as a member of
the Biggs Swimming Pool Committee was accepted, and John Steeves was
appointed to fill the vacancy.
75-614 NATTERS PRESENTED BY BOARD MEMBERS
'The site for the Feather Raver Opportunity Center discussed.
The Boards motion had been to direct Mr. Castleberry to bring back
a report oa the utilization of the land. This site would have to have
an assessment made of it. if the property ie worth $25,000, it was
felt that this amount should be deducted from the $200,000 authorized
to be given to the Center from revenue sharing funds. Mr. Castleberry
will he requested to meet with the Building Committee end bring back e
report on drawings and plans for the center.
Chairman Ladd commented oa the letter from Coagreesmaa Johnson
concerning the in lieu tax on timber. It was felt that this matter should
be brought up at the Niae Northern Counties Supervisors meeting sad that
they prepare a resolution oa the subject. A letter should also be
written to Congressman Johnson concerning the Board's thoughts on the subject.
3uperviaor Madigan commented on the study received from Senator '
Collier. He suggested that tazatioa of timber land be considered by the
Niae Northern Counties Supervisors Aasociatian. He felt they should take
some action on this matter. Supervisor Madigan will secure a copy of
the bill in question.
Supervisor 2+iadigaa commented on a letter from Ventura County.
The Public Administrator and Treasurer of that County are asking that the
monies of decedents, whose estates are being handled by the Public
Administrator, be given to the County that is providing the service,
rather than going to the State. Matter discussed; no action taken.
