Mrs. Jane McDonald and Mrs. Katherine LaBreacht sends letters of appreciation to the Board of Supervisors for 20 year J ~ ~''~ ~ service awards recently received by the two ladies from the County of Butte. No action taken at this time. 73-547 REJECT CLAIM OF TOM E, MAY On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, the claim of Tom E. May in the amount of $150,000 was rejected and referred to County Counsel. 73-548 CONCUR WITH REQUEST OF BUTTE COUNTY MENTAL HEALTH ADUTSORY BOARD On motion of Supervisor Gilman, seconded by Supervisor Cameron and unanimously carried, the Board concurred with the following recommendations of the Butte County Mental Health Advisory Board: 1, The transfer of two Psychiatric Technicians through an inter- agency transfer from Butte County Community Hospital to Butte County Mental Health Services, 2, The creation of three new positions designated as Mental Health Technicians (the two Psychiatric Technicians from BCCH and the one position to be filled by the Psychiatric Technician currently hired by the Stabilization Facility contractor,) 3. The modification of the budget for Day Treatment Center and Residential Care Center in order for Butte County Mental Health Services to collect Medi-Cal revenues on 24-hour care patients. (These revenues are made possible by the increased staffing of items 1 & 2,) 73-549 CONCUR WITH A TOTAL RE-EVALUATION. OF_DATA_PROCES_SING_EQUIPMENT PROPOSALS The Data Processing Committee reported on the meeting held Monday, April 2, 1973. Supervisor Madigan set out the feelings of the committee regarding the data processing equipment proposals. It was felt by the members of the committee that the payment to Mr. Rowan should be released Page 144. April 3, 1973 Aril 3~ 1973 by the Auditor, Dan Blackstock, County Counsel, stated he had a meeting with Henk Hindery, Data Processing Director, and Mr. Rowan and they went over the contract in detail. The term of Mr. Rowan's contract is from October, 1972 to 3une 30, 1973. Mr, Blackstock stated that his performance under the contract was not yet completed. Mr. Hindery had set out the duties of Mr. Rowan under the contract. Mr, Blackstock explained the contract and the matters that were to be covered under said contract. Mr. Blackstock presented the Board members a letter from Mr. Rowan. The Committee is going to re-evaluate the data processing equipment proposals again. Meetings will be held this Thursday and Friday to go over the proposals. Payment to Mr. Rowan discussed. It was felt that Mr. Rowan should participate in these new re-evaluation meetings. Minutes of the Data Processing Committee meetings discussed; Supervisor Gilman felt that the minutes of these meetings should reflect who attended the meetings. Ev Bosworth, assistant administrative officer, explained who was on the committee and who had been attending the meetings. Mr. Bosworth stated that the action of the committee has been recorded and were made by motions. Yesterday a motion was made to re-open the negotiations with the vendors, Mr. Nickelson stated that his office would firm up the documentation of the minutes of these minutes and will send copies to the Board members. Time spent discussing the data processing equipment and the action that should be taken at this time, Mr. Bob Horvath, Sacramento branch manager for Control Data spoke at this time. He objected to any consideration being given to any proposals that were submitted after the cutoff date of ,7anuary 31, 1973. He summarized the past negotiations concerning the proposed equipment, He asked what specifically the Board wanted his company to present at these new negotiations. His statements discussed; no action taken on them, On motion of Supervisor Madigan, seconded by Supervisor Ladd and unanimously carried, the Board concurred with the recommendation of the Data Processing Committee to~have a total re-evaluation of the data processing equipment proposals, with meetings to be held Thursday and Friday with the vendors, and that the services of Mr, Rowan be utilized in this rewevaluation. 73-550 APPROVE CHANGE ORDERS, PARADISE_PINES On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, the following change orders were approved as requested by Del Oro Water Company for changes in the type of concrete valve box construction and specifications and the Chairman was authorized to sign: 1, Paradise P3.nes Units l0, 11, 15 A,D, (CCO ~4- increasing amount of $526,50 2. Estates /+ A,D, (CCO #5 - increasing amount $1,089,72, 73-551 PUBLIC WORKS MATTERS PRESENTED FOR DISCUSSION a, Discussion of Forbestown disposal site relative to Yuba County landfill. Yuba County has opened the Brownsville Sanitary fill area and they have asked Butte County to participate in the land fill, Mr, Castleberry said Public Works would like to cooperate with Yuba County in this matter, and he feels the County should give it some consideration, Matter discussed; no action taken at this time, b, Report on Sacramento River bank protection, Clay Castleberry, Director of Public Works, said the work is almost completed and it is being done at a cost less than that estimated, Mr, Castleberry said the Corps of Engineers will Iook at the work after it has been completed, Public Works is still waiting to hear whether they will extend the rip-rap on the Sacramento River, c, Upcoming meeting of State Transportation Board on regional guidelines, Mr. Castleberry stated that he has been requested by the Supervisors Association staff to be at their Thursday afternoon meeting in Sacramento, The guidelines have been amended to consider the rural areas, Mr, Castleberry stated that with the Board's blessing, he will attend this meeting Thursday in Sacramento, Approval was granted, d, Upcoming meeting with Supervisors Association on junk car funding. Mr. Castleberry stated that each car owner this year had paid a $1,00 fee to be used to get rid of abandoned or junk cars, The situation has been studied, It has now been turned over to the Highway Patrol administrators and he has been asked to give them some in-put on this matter, It is Mr. Castleberry's feeling that the County's share of this money should be returned to the County, He is going to meet with the Highway Patrol to discuss this. matter, e, Immediate need for additional building inspector and automobile. Mr. Castleberry reported on the need for an additional building inspector, He said the building volumne in this County is fantastic, He said this could be provided out of the Building Trust Fund, He said he hoped the Board would authorize them to employ another inspector. Request discussed, 73-552 PERSONNEL DIRECTED TO RECRUIT FOR BUILDING INSPECTOR On motion of Supervisor Madigan, seconded by Supervisor Ladd and unanimously carried, the Personnel Director was directed to recruit for a building inspector, 73-553 PUBLIC WORKS AUTHORIZED TO PROCESS PARCEL MAP FOR CITY OF OROVILLE Clay Castleberry, Director of Public Works, reported that the City of Oroville has requested him to process a simple parcel map. RECESS: 10:20 RECONVENEl7: 10:40 73-554 PUBLIC HEARINGS SET: REZONING MATTERS Public hearings were set for April 24, 1973 at 1:30 p.m, on the following: 1. Butte County Planning Commission initiated - rezone for Butte Community College and surrounding area from A-2 (general) and S-H (scenic highway) to A-160 (agricultural), A-3 (agricultural), and P-Q (public quasi- public), 2, Louis C. Nofrey - rezone from "AR-MH" (agricultural residential- mobile home) district to "C-1" (light commercial) district for property located west of Lincoln Blvd,, east of Custer Lane, south of Kusel Road, identified as a portion of AP 36-29-28, containing~l5 acres, more or less, Oroville. /73-555 ADOPT RESOLUTION 73-57 GIVING NOTICE OF INTENTION TO ABANDON A PUBLIC HIGHWAY On motinn of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, Resolution 73-57 giving notice of intention to abandon a public highway, setting May 22, 1973 at 1:30 p.m. as the hearing date, was adopted and the Chairman was authorized to sign. /"73-556 ADOPT ORDINANCE 1339 & RESOLUTION 73-58, ADOPTING NEW FEES FOR PLANNING ITEMS Jim Lawson, Planning Director, gave the Board a study that had been made by Santa Cruz County concerning fees for handling use permits, variances, rezaning and parcel maps by the Planning Commission. Mr. Lawson set out recommended fees for these services. Fees discussed, On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, Ordinance No, 1339 and Resolution 73-5$, adopting the fees for processing use permits, variances, rezoning matters and parcel maps were adopted and the Chairman was authorized to sign. 73-557 DISCUSSION: HEARING SUBDIVIDED AREAS FOR CONSIDERATl'ON FOR INTERIM ZONING Jim Lawson, Planning Director, presented a map showing areas in the County that should be interim zoned. Areas discussed, Mr, Lawson recommended a 120-day interim zone to stop further activity in the specified .areas. During the interim zoning period, the Planning Department would make an indepth study on the proper zoning for the specified areas, Board members discussed areas in question and action that should be taken. Supervisor Gilman did not think the 120-day period would be long enough, zoning discussed, Action deferred one week. 73-558 APPROVE SEVEN TENTATIVE PARCEL MAPS RECOMMENDED FOR APPROVAL Jim Lawson, Planning Director, set out the seven tentative parcel maps that were recommended for approval, Supervisor Cameron questioned Mr. Castleberry about the Anthony R. Bennett and V, C, Rogers, both at the end of Maxwood Arive discussed, Mr. Lawson set out the divisions of parcels that have been made over the past few months. Mr, Castleberry April 3, 1973 ==ate==aaa=-== April=3s 1973==-- - _- said that if the road is built to County standards, then he would recommend that the split be approved, Map discussed, Mr. Smith, Paradise, stated that he owns 300' that back-up to this parcel. ~He feels that this is an illegal land split. He said he would like to recommend that the map be denied, Statements of Mr, Smith discussed, Matter put over one week to look over the legality of this division. 73-562 APPEARANCE OF JAMES HANSEN. OROVILLE CONCERNING PLANNING COMMISSION Mr, James Hansen, Oroville, stated that the Planning Commission was D ~ initiated primarily to review and to give the citizen the opportunity to tl7> challenge proposed zoning laws and regulations prior to their being 11 ~ presented for adoption by the Supervisors. He said a proposed new zoning law was challenged by many concerned citizens at a Planning Commission meeting. He set out facts about the Planning Commission and their action that he opposed, He said that as a representative.af the Butte County Mining Council and the Oroville Arm of the N.A,K,S.A,, he was requesting "that Mr. Lawson be replaced with someone who is honest, has integrity, and cannot be considered (by anybody) a pathological liar:" He said he also felt the Board of Supervisors' meetings should be changed to the evening so the public could attend, 73-563 APPEARANCE: FRANK HOLDER, OROVILLE, USE OF MEMORIAL HALL Frank Holder, Oroville, said he was present to request the use of the Oroville Memorial Hall for a Cancer Arive Dance. Chairman McKillop said this permission to use the Memorial Hall has already been granted, No action necessary, 73-564 APPEARANCE WILLIAM HAZELTINE. OROVILLE, CHANGES__MADE AT STATE WATER MEETING William Hazeltine, Manager of the Butte County Mosquito Abatement District, presented the Board membera copies of a transcript of the changes made at the State Water meeting last month. He said the State intended to adopt their guidelines tomorrow, He was told he could see the guidelines after they were adopted. Problems of the adoption of these guidelines explained, He felt the Board should take action on these problems. Chairman McKillop stated that the Board had sent representation down to talk on this subject, Chairman McKillop said that the County is on record stating that there should be additional conditions to be considered, Matter discussed; no action taken, 73-565 APPEARANCE: D,AN PELLICCOTTI:_.PRO.BLEMS AT THE COUNTY HOSPITAL Dan Pelliccotti, Oroville, said he would like to know when the Board members could go out to the hospital so he could show them how his suggestions could be handled. Monday morning at 8:00 a,m, was set as the time the Board will tour the hospital with Mr. Pelliccotti. RECESS: 12:00 RECONVENED; 1:30 73-566 PUBLIC HEARING: DONALD FARRAND - CONTINUATION OF HEARING ON REZONING FROM "A-2" TO "C-2" PROPERTY LOCATED ON THE WEST SIDE OF THE ESPLANADE The continuation of the pu is Baring on the Donald Farrand Page 149, April 3, 1973 _ A~ril_3~ 1973 rezoning from "A-2" to "C-2" property located on the west side of the Esplanade at Eatoa4Road was held, Hearing was closed to Board discussion only at last weeks hearing. Planning Commisaion had recommended approval of this rezoning project. Rezoning discussed, Supervisor Gilman said he had asked that this matter be continued last week; he still has some reservations in the matter, He said it is his understanding that if this Board is to grant this request, they cannot-tie the road on as a condition to the rezoning, Dan Blackstock, County Counsel, said the rezoning could be held in abeyance until the Board had assurances of what is going to be done about the road, Supervisor Gilman said he felt that this proposed rezoning would enhance the value of the land, Chairman McKillop said that is why he was in favor of the PA-C zoning because it would put a handle on the zoning, Mr, Castleberry felt the extension of Eaton Road would be needed before 10 years, He feels that there will be a lot of traffic generat~~~ at this intersection, It was moved by Supervisor Gilman that the rezoning be denied, Motion died for lack of a second, 73-567 ADOPT ORDINANCE 1340, AMENDING COUNTX ORDINANCE N0, 996, CONSOLIDATTNG "C-2" (GENERAL COMMERCIAL} PROPERTY LOCATED ON WEST SIDE OF ESPLANADE AT EATON ROAD; CHICO On motion of Supervisor Madigan, seconded by Supervisor Cameron and carried, Ordinance No, 1340 amending Ordinance No, 996, consolidating "C-2" (General Commercial) for the property located on west aide of the Esplanade at Eaton Road, Chico, was adopted and the Chairman was authorized to sign. AYES: Supervisors Cameron, Ladd, and Madigan NOES: Supervisor Gilman and Chairman McKillop 73-568 CONTINUATION OF HEARING ON PROPOSED GUIDELINES ON ENVIRONMENTAL IMPACT ,,~-/ The continuation of the hearing on the proposed guidelines on // ?~,(~ environmental impact was held at this-time, Neil McCabe, deputy county counsel, spoke to these guidelines, Mr. McCabe set out the changes that had been made in the guidelines. Revisions explained and discussed. The State guidelines have been incorporated by reference rota the County guidelines. They have inserted in Paragraph 4 that only one environmental impact report will be made when more than one governmental agency is involved, Under Negative Declaration and Protests, Paragraph F, time has been changed to 15 days for the written protest to be filed with the Planning Commission, from the date the Negative Declaration was filed with the County Clerk, Change discussed. On motion of Supervisor Cameron, seconded by Supervisor Madigan and carried, the number of days in which to file written protest with the Planning Commission from the date the Negative Declaration was filed with the County Clerk was changed from eight days to fifteen days. AXES: Supervisors Cameron, Gilman, Madigan and Chairman McKillop Noes: Supervisor Ladd It was stated that written notice of the filing of a protest must be mailed to the applicant. Discussed the number of days notice of hearing must be mailed to the applicant. It had originally been set at three days; Page 150. Discussed Paragraph L; this states the applicant shall be required to pay the actual cost to the County for preparation of the EIR, The minimum actual cost had been determined to be $25,00. Cost discussed. It was felt this cost should be increased, Paragraph P discussed, This paragraph to read as follows: The draft EIR will be made available for public review and any person may obtain a copy of it by paying a fee of $1.00 for the first page and fifty cents (.50) £or all others, This change discussed, It was moved by Supervisor Gilman, seconded by Supervisor Madigan snd carried that copies of the guidelines will be made available to the public, along with any of the appropriate information request, at a cost of $1,00 for the first page, plus the additional pages to be made at cost, AYES: Supervisors Gilman, Madigan and Chairman McKillop NOES: Supervisors Cameron and Ladd The Appendix to the guidelines discussed, Mr, McCabe said he had received a letter from Gene McFarren and another letter from the State Board of Realtors, delivered to him by Helen Hollenbeck. Letters read and discussed, Mr, McFarren suggested that the guidelines should not apply to applications that have already been submitted, Mr~_McCabe did not think this could be done, He felt the guidelines would regulate any project that any finai decision has net bean made, Certificates of compliance discussed, Hearing opened to the public for discussion, Appearing: 1. Denny Bumgarz, U,S, Forest Service, He said the Piumas Forest Service felt that they should be added into the governmental agency list, They have a planning team on this forest service, He suggested that Appendix E be expanded to include the Plumes National Forest , This additional name wilt be added to the Appendix E, 2, Mr. Bi11 Earl, Butte Community College, He questioned the Board about the rezoning for the Butte Community College site, Report for this rezoning discussed, Mr, McCabe said that if the guidelines are adopted, the County is going to have to have at least a negative declaration in this matter, Projects are not automatically exempt, Filing of preiiminary review discussed, The report should be ready soon and would relate to the zoning only. Planning Director requested to prepare the report, 3. Wiliiam Hazeltine, Oroville. He set out his feelings concerning the guidelines. He suggested proposed changes to the guidelines, which he presented to the Board in writing. He questioned his ownership or connection with Butte Construction Company, Supervisor Ladd stated that he was not connected with Butte Construction Compsnv in any way. Supervisor Ladd presented official documents and reports made to the corporation commissioner for last year which shows that he is not an officer. This organization is not too alive and he felt this matter might be a subject for discussion at the next BCAC meeting.
