Mr. William R, Lawrence, Auditor, sworn and testified at phis time. Dan Biackstock, County Counsel, questioned Mr. Lawrence concerning his response of March 28, 1977 to the Interim Grand Jury Report. Mr. Lawrence answered questions regarding reconcilieCoa'~and the decision of his office to withdraw from data processing. On motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, the Auditor's answers to questions are authorized to be transmitted to the Grand Jury. Supervisor Madigan read a prepared statement concerning the Auditor-Data Processing problem. On motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, the Auditor ie ordered to immediately return his accounting to the computer; that the Auditor be directed to select profedsional help in correcting the existing programming, or prepare new ones; and that the Auditor eha11 within two weeks bring to the Board a proposed agreement with a firm he deems competent to modify or develop an appropriate fund and budgetary accaunting system for his office; that the contracts on the two NCR 299s be cancelled as soon as possible, 77-658 ADDITIONAL MATTER PRESENTED BY SIIPERVISOR MADIGAN Supervisor Madigan commented on a letter from the Department of the Interior concerning Chico Canal. The continued public hearing oa the Rodney Worthington appeal of Subdivision Committee's determination to file notices of violation on property located on west aide of Maxwell Drive, south of Greenwood Drive, Paradise, AP 59-03-40 & 42 was held at this time. Indicate a 50 foot leach field free set beck along the west property line on AP 53-03-41. 2. Construct full urban improvements, i.e. curbs, gutters and sidewalks along proporty frontage. 3. Deed to Covnty of Butte 30 foot right of way from centerline of Maxwell Drive. 4. Indicate 50 foot building setback from the centerline of Maxwell Drive. 5. Show all easements of record on final map. The public hearing an Meyers Street Assessment District determining public convenience and necessity for the improvements and acquisitions was held as advertised. Mr. Robert Brunseli, Attorney, set out the background of the proceedings. Mr. Everd McCain, Engineer for the project, set out the background of the establishment of the Assessment District. The district is being formed is order to apply for EDA funds and Revenue Sharing funds. The EIR process in not completed as yet. The Board will have to consider the EIR at a later date. If the funds are not approved, the property owners will have to take a second look at the project. If theta ie a problem in getting the funding then the only fees will be for engineering and legal expenses. Hearing open Co the public. Appearing: 1. Robert Slade, representing Mr. & Mrs. Glen Russell. Mr, Blade stated that Mr. and Mra. Russell wish to be excluded from the proposed Meyers Street Assessment District. Mr. Blade net out the background of the Russell property. Mr. and Mrs. Russell are willing to put in the improvements but do not want to be in the Assessment District. 2, Wayne Turner, representing Lasaea Foods, Inc. Mr. Turner stated that Lassen Foods is in favor of the Assessment District. 3. Ray Karrington, Rex Products. Mr. Barrington stated that he is in favor of Che Assessment Diattict. Mr. Barrington stated that if the District is approved he would like to nee sidewalks eliminated and rolled curbs regdred. 4. Cley McQovwan. Mr. McQuaasanetated that he was in favor of the District. Thin would upgrade the area. Hearing closed to the public end confined to the Board. Mr. McCain stated that the one property that has already been excluded might have to be included in the district. There era too many possibilities at this time. Mr. McCain stated that he recommended rolled curbs and the elimination of sidewalks ae this is an industrial area. Oa motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the Russell property is excluded from the Meyers Street Assessment District and that the Russell's enter into a satisfactory agreement with the City of Chico to install the necessary improvements; adopt Resolution 77-57 determining public convenience and necessity for the improvements and acquisitions of Meyers Street Assessment District and authorized Chairman to sign. 77-663 PUBLIC HEARING: ADOPT RESOLUTION 77-58; ABANDONMENT OF PUBLIC UTILITY EASEMENT ON LOTS 7 & 8 IN OAKMORE PARK SUBDIVISION PARAAISE WALTER HUTTON The public hearing on the Walter Hutton, Oakmore Park Subdivision abandonment of public utility easement on Lota 7 and 8 was held ae advertised. AND TRANSIENT BILLING: CONTACT IRANIAN Et~ASSY AND 2MHIGRATION DEPARTMENT CONCERNING PA7~tPI' FOR BUTTE COUNTY CASE NOS 62 & 63. Watt Abkin®, Health Services, set out the background of Case Nos. 62 and 63. The person has no way to pay the bill and is not eligible for Medi-cal. Oa motion of Supervisor Moseley, seconded by Supervisor Lemke and carried, Che Immigration DepartmenC and the Iranian Embassy are to be contacted regarding payment of butte County Case Nos. 62 and 63;payment in the amount of $601.68 for Butte County Case No. 56 was approved and the Auditor directed to prepare budgettrensfer w3th~funding coming from the reserve. Chairman Richter stated that possibly the~State man could coma up and talk to the Board concerning sealing of the dumgs etc. The matter is continued to Agrii 20, 1977 at 8:30 a.m. after BCAG, This is also to be oa the BCAG agenda far the same day. The refuse people 1n the County are to be notified. 776 6 APPEARANCE: MARVTN BENNETT REGARDING CARDROOM ORDINANCE Mr. Marvin Sennett stated that he was concerned with the Cardroom Ordinance that has just been passed. He presented the Board with a letter. Mr. Bennett is appealing hie denial of an operator's license. Ms. Katherine Scott read a statement regarding the water shortage. Ms. Scott ie very concerned about everyone conserving water. Ms. Scott is•also concerned about getting more programs for young people so that they will stay out of trouble. Supervisors Lemke and Moseley ware appointed ae a committee to study the feasibility of Taek Force to develop Drug Abuse Residential Treatment Facility. 77-672 .DISCUSSION: FIRE HYDRANT SERVICE CHARGES: DEL ORO WATER COMPANY Bill Turpin,.Adminiatrative Analyst, stated that the County has been negotiating with Del Ora Water Company to enter into a contract similar to some of the other agreements. There has been~ao committment to Del Oro to pay the bill. Mr. Turpin clarified some of the paints of the agreement. Mr. Bob Paulus, Fire Warden, stated that he has looked at the agreement with Del Oro Water Company. Del•Oro Water Company is pursuing a maintenance agreement and no money changes hands. Ia ,aigipgi~his, the County willbe responsible for the hydrants. The back billing should be ~a separate item. Mr. Paulus would like to nee a county wide maintained system. ~77-63$ AWARD FINAL APPROVAL FOR REHABILITATION ASSISTANCE FOR PROPERTY LOCATED AT 22 3 D STREET ORAVILLE. Ward Connerly, Connerly and Associates, Inc., set out the background of the Rehabilitation Assistance loan. On motion of Supervisor Madigan, seconded by Supervisor Moseley and unanimously carried, final approval for rehabilitation assistance loan for property located at 2273 D Street. Oroviile was awarded. 77-674 AUTHORIZE NEGOTIATIONS WITH STATE WIDE ORGANIZATION OF BANK OF AMERICA FOR FINANCING~irADflPT PROPiISLkS FOR SECTION 312 DIRECT LOAN COSTS •CD T:.~:: C:~:::~cr1...-.. Werd Cotaterly stated that the State wide organization of ;Bank of America has an insurance program that would help the Section X7.2 funding. Section 312 funding is a direct loan to the individual applicants within the County. Our request was approved but because of the overwhelming regveat in Region 9 there is not a set amount of money set aside. It is a first came first serve•basis. The program is restricted to South Oroville. Section 312 funds must be used for rehabilitating homes it can not be used to build a new home. The limit is $17,400 for 912 funds. Mr. Connerly is requeatiag that the Board authorize HCD block grant funds until the Section 312 funds axe available. Mr. Connery stated that he would like the Board to authorize the Administrative Officer to submit application based on Piggy Backing. He would also like approval to piggy back up to $5000. On oration of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, the Administrative Officer is authorized to sign end submit to the Department of Housing and Urban Development all Section 312 loan applications. 77-677 AUTHORIZE SUBMISSION OF COMMUNITY SERVICES ADMINISTRATION GRANT APPLICATION CR_URAZ HOME REPAIR ACTION PROGRAM) . Mr. Connerly stated that 4hapmantown has rece~nred $45,000 grant approval, This ie not enough money. The grant application to the Community Services Administration rural home repair action program in the amount of $100,000 would be for the Chapmantown area. On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, the submisaion•of great sgplicatioa is the amount of $100,000 to Community Services Administration was authorized. 77-678 AUTHORIZE REIMBURSEMENT CONNERLY AND ASSOCIATES, INC. Ili THE AMOUNT OF $5.000 (HCD BLOCK GRANT FUNDS) FOR TIME AND EAPENSES. On•motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, Connerly end Associates, inc. are to be reimbursed $5,000 from HCD black grant funds for time and expenses. 77-679 AUTHORIZE CHAIRMAN TO SIGN LETTER TO HOUSING AND URBAN DEVELOPMENT AND UPON FAVORABLE RESONSE, E3~END BUTTE COUNTY FUNDS ANTICIPATION OF CHAPMANTOWN COMh1UNITY DEVELOPMENT BLOCK GRANT REIMB~~'. Larry Hraaks, Administration, stated that Chapmantown will receive public works improvements and that theta will be na residential rehabilitation during the interim perbd. It is the public worke~improvements with the revenue•aharing and CETA personnel.
