Drake, Chico, protesting the findings of the Environmental Review Committee requiring an E.LR. was referred to the Planning Commission. 76-511 EXPRESS INTENT TO EXPEDITE TRANSFER OF BIDWELL RIVER PARK TO STATE DEPARTMENT OF PARKS ~ REC REATIO N On motion of Supervisor Ric ter, seconded by Supervisor MclGillap and unanimously carried, the Board made it clear that it is their intent to expedite the transfer of Bidwell River Park to the State Department of Parks $, Recreation as quickly as possible, and will take whatever steps necessary to insure the transfer. 76-512 REJECT CLAIM OF PAMELA MAY RUSS On motion o Supervisor Ma igan, seconded by Supervisor Richter and unanimously carried, the claim of Pamela Moy 1L~ss by Patricia Ann McKinley -dn• the amount of $30,000 was rejected and referred to the County's Insurance Carrier. Time spent discussing the_group supervtsors positions at Juvenile hall. Mike Pyeatt explained the operation at juvenile hall. Use of the group supervisors set out; population at the hall is on the increase. Supervisor Ladd felt the Board would be able to make a more knowledgeable decision if they had a list of all the Manpower positions that were expected to be transitioned. Ms. Mickelson said a list could be prepared and sent to the Board members. Jim Rackerby, Personnel Director, stated there was going to be reduced funding in public funds and a decision was going to have to be made to lay-off some of the CETA employees. Sup: rvisor Richter felt the County should continue to fund the employees that are needed with CETA funds and then reduce the positions at a later date. Use of CETA employees discussed, It was felt that in the proposed ordinance, the six group supervisor positions could be eliminated for the present. On motion of Supervisor McKillop, seconded by Supervisor ]_add and unanimously carried, the first reading of the salary~• ordinance amendment was waived, with the elimination of the six group supervisors for Probation. 76-517 APPROVi: AGREEMENT WITH NORTHERN CALIFORNIA INSTITUTE OF LOCAL GOVERN The county has been requested to participate as a member of the institute of Local Government, A cooperative agreement has been prepared to permit the county to participate. This will provide training services for governmental agencies. Background set out by Mr. Rockerby. This will provide an opportunity to have someone from the County sit on the Boord of Directors. On motion of Supervisor Madigon,seconded by Supervisor Richter and unanimously carried, the cooperative agreement with Northern California Institute of Local Government was approved, Chairman authorized to sign, and with the stipulation that the Personnel Director be the County's representative on the Board of Directors. 76-518 AUTHORIZE OVERNIGHT TRAVEL, OFFICERS OF SHERIFFS DEPARTMENT On motion of Supervisor Richter, seconded by Supervisor Ladd and unanimously carried, request of Sheriff for authorization for W. R. Hopkins and Donald Pederson to attend a statewide School Resource Officers Association meeting in Fresno, April 8-9 at an estimated cost of $6I, was approved. Page 235. Apri 16, 1976 ~ ~~ 76-519 APPROVE LEASE AMENDMENT ON UPTRAP PROPERTY On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, the lease amendment on Liptrap property qt the corner of Ib~binson and Huntoon Streets, which stipulates amonth-to-month at~$IQ4 per month was approved and the Chairman was authorized to sign. 76-520 APPROVE FOUTS SPRINGS BOYS CAMP CONTRACT An increase rn t rate c rge to counties or placement at the camp becomes effective July f, 1976. The cost per ward per month increases from $625 to $680, with al[ provisions of the prior contract remaining the same. On motion of SupervisorRichter, seconded by Supervisor McKillop and unanimously carried, the contract with Counties of Solana, Yolo and Colusa for housing juvenile court words was approved and the Chairman was authorized to sign. 76-521 DISCUSSION: CITY OF CHICO/COUNN LIBRARY AGREEMENT A roug draft conso idation proposa s e en prepared y both the City and the County. Mr. Mickelson said the action requested was comments and instructions to go back into negotiations with Chico City Counsel. Disagreement cantered around liability for maintenance of structure and accrued benefits for employees that would be transferred to the new operation. Benefits discussed. Mr. Rackerby said he would be able to adjust the pay scale for the people being transferred. The employee would not take a cut financially. Dan Blackstock, County Counsel, stated he had received a telephone call from Jo Terry, County Librarian, and she wants the County to have a provision in the agreement to the effect that she can transfer books around. The Board felt this request was logical. One discussion that will have ro be held will be as~to the ownership of the books. That is the major modification to the agreement. It was felt that the County should go ahead with the agreement as set out. Clay Castleberry, Director of Public Works, will report on the bids la#er in the meeting. 76-524 AUTHORIZE PURCHASE OF NEW REFRIGERATOR: HEALTH SERVICES AGENCY On motion o Svperv sor a , sewn e y pemsor Ric ter an unanimously carried, purchase of a laboratory refrigerator~'reezer combination at a cost of $242 to be purchased from savings realized from other laboratory fixed assets accounts ($274) and laboratory supplies ($150) was authorized and the Auditor was directed to prepare a budget transfer. Purchase of an emergency portable oxygen unit for use in Paradise and outlying counties, at a cost of approximately $150 is requested. Sufficient funds exist within the equipment account as two otoscopes previously budgeted were removed from the stock of ald hospital equipment and kept for clin[c use. Supervisor Ladd questioned the purchase of this unit. Dr. Enloe said this unit would be for use in the clinics that move around,; he Felt the unit was needed. On motion of Supervisor McKillap, seconded by Supervisor Madigan and unanimously carried, purchase of portable oxygen unit was authorized. 76-525 APPLICATION FOR BOWLING ALLEY APPROVED App station as en ma e y C ay McGowan and W.D.Stile for a bowling alley at 2397 Esplanade. Application contains names of ten freeholders as required by ordinance. Dan Blackstock, County Counsel, stated this requirement is an ancient provision in the County Code. Application diswssed. On motion of Supervisor Richter, seconded by Supervisor Ladd and unanimously carried, application for bawling alley approved. Mr. 8lackstock said they were working on an ordinance to delete this provision from the Code. page 237. The employees kept the operation going until the insurance ran out. They were unable to provide the monies to take out a new insurance policy. An add is being run in the Chico paper asking for interested parties to wntoct the County for re-instdiement of the service. Mr. Castleberry wmmented on the letter from Mrs. Lucile Mundell, who requests that the service be continued. Certified letters have been sent to all known vendors and they have been given to April 13th in which to respond. Members of the review committee will screen the applicants. RECESS: The Board recessed at 10:20 for coffee break and to hold a short executive session. RECONVENED: The Board reconvened at 10:30 following coffee break and executive session, 7b-531 PUBLIC HEARING: DISCUSSION 8~ CLARIFICATION OF REOPENING STILSON CANYON REZONE HEARING T e pu is earmg for discussion and clarification of reopening Stilson Canyon rezone held at this time. Dan Blackstock, County Counsel, explained the rezoning procedure. The area was zoned A-2, if the Ordinance was invalid it would revert back to the A-2. Mr. Blackstock recommended that the Board refer it back to the Planning Commission for further study. The Board would then react to the zoning. Chairman Cameron suggested that the people return when the public hearing is held. Appearing: John Schooling, Stilson Canyon, who asked iFn*r clarificationof the proposed re-hearing of the Stilson Canyon rezone. Dan Blackstock responded, saying that the Planning Commission will hold a hearing as if it was a new proposal. Rezoning discussed. Mr. Schooling is in favor of an S-R zoning. Howard Toussaint commented on the wells and water wntrol aspects of the area in question, stating that some of it would not meet the requirements. Supervisor Ladd said that it was inconceivable that the Board would make a zoning that would be harmful to the health and welfare of the community. Irvine Schlaf stated that he did not plan to do anything before the new hearing is set. He explained that there were sixteen lots in the subdivision. He said that people were disturbed about something that was not going to happen. On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, the Board voted to implement the recommendation of County Counsel and refer the rezoning of Stilson Canyon back to the Planning Commission for rehearing. 76-532 DISCUSSION: CONDITION ~2, MUNJAR ACRES SUBDIVISION im awson, Panning p~rector, sal tat con ition o. was the one dealing with improvements. With this condition deleted, all that is left is a fifty foot building setback. The problem being that there were people coming in wanting certificates of compliance.
