Referred to the Coanfiy Counsel. 75-652 CORRECTION OF I~NITl'ES OF APRIL_8, 1975 Dan 8lackstock, County Counsel, stated that there was a small problem with the action taken in Item 75-643. There seems Co be some misunderstanding of the action taken. The Board's moCian was to the effect that they had decided to deny the appeals requesting the County net to require the EIRs, but that because of the nature. o£ these areas, the Board wanted extensive EIRs and that the County would prepare the EIHs for the 3 lend divisions involved and that these EIRs would ba able to be used is similar areas wha a EIR's are required. Correction discussed. Supervisor Richter suggested that a fee be set on all divisions of property to finance the preparing of the EIRs. Anyone im~olved in the division of land should be assessed a small fee to finance the preparing of the EIR's. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the minutes of April 8, 1975, item 75-643, were corrected to scale that the EIR's in the troubled areas in the Swede Flat area and the Toaea Way area would be prepared by the County and that these EIR'e would be used in other land divisions of similar nature where BIHa are required. 75-6 3 ODRRECTION OF MINVPBS OF JANUARY 21 19 Daa Blackstock, County Counsel, requested that the Board consider a correction to the January 2i, 1975 minutes, Item 75-114. This concerns the Highland Park Subdivision. The Board did not find; in their motion, that the subdivision wen consistent with the General Plan. Supervisor Richter stated that following the reading of a letter from the Chico League of Women~s i-oters concerning this subdivision he had stated that the subdivision was in conformity with the County General Plan. Supervisor Madigan felt the Board should let the matter stand at this tide and wait for City of Chico Council to make their move in the matter. Matter referred to County Couaael, and he will report back to the Board is a week or two concerning the situation. T5-655 DISCOSSIONt REPORT BY BVYLDII4C COMMITTEE CONCERNING JU7ENILE HALL CONSTRUCTION PROJECT BIAS The Building Carmntttee concerning Juvenile Ha11 construction project bids presented their report for discuasinn. Supervisor Cameron requested that Chairman Ladd set out the details of the report. Chairman Ladd stated that the committee had met with the architect and he thinks that as a result of the committee aseeting, that it might be possible to eliminate $145,000 of the coats without jeopardizing the project or omitting teo meat' items that were needed. If this could be done. they would recommend the awarding o£ the bid. If they are unable to awsrd the bid, then they wouS recommend the zevising of the bid. Mr. Castleberry talked to the contractor today and they are making good progreae and the chances of being able to accomplish this is good. The committee will neat with the architect again on Friday to go over the matter and they will have a recommendation by next week for Board action. Supervisor Richter spoke concerning the site of the proposed juvenile hall. He said he hat spent some time lase week trying to gather information on this scatter. It has been vary difficult. Se said he has received very little help from those Working on this matter. Every one tells him not to quote them. He stated that he had gone to Merced County sad their average daily census is 12 juveniles. Thep were surprised that this County Was going to build such a Iarge facility. Supervisor Richter felt that the Board should go back and re-examine the plan. There is legislation to take the 16 and 17 year-olds out of juvenile Sall. They are also taking the 601s out of the halls. Chairman Ladd responded to the statements of Supervisor Richter. ~Ie stated he has done a lot of research oa this matter. He ezplained why some of the juveniles were held for k8 hours. These are usually run-sways from other areas and they have Co be detained. Every effort is made by our law enforcement people not to bring these juveniles in if they can get the parents to keep them at home or place them is other homes. Se explained host they had reached Che determination of the size for this facility. Supervisor Cameron set out his views concerning the site of this facility. Supervisor Richter read a telegram that he had zeceived from the State Capital from Lawrence Smith, Special Counsel. The telegram stated that run-sways and non-truants leave to be removed from juvenile halls. No action taken at thin time. 75-656 PUBLIC HEARING ON HOtEING AND COMMUNLTY DEVELOPMENT APPLICATIONS ADDPT RESOLUTION APPROYIN6 APPLICATION FOR GxANT Scott Tandy commented on tiir formation he presented to the Board Page 2kk. Mr. Tandy fisted that the EIR Committee has approved the report for the Boards' information. It is noted that the report has been filed. Representative from Shtehan and Associates commented on the application end the fact that it should be filed end approved as of this dace. Mr. Tandy sec out on the map the suggesttd areas fox the proposed housing unite. No specific site has been selected. Arses suggested discussed. Supervisor Cameron suggested that there were people in tht audience that do aoC knave what this application is abouC and requested that the background materiel be net out for their information. Mr. Tandy explained purpose of the application. He said that basically the thrust of this is to put back to the local level what is going to happen to hausiag in the area. He explained the County's application. The County would receive the grant and purchase the property. Bill Lawrence, County Auditor, asked what the advantage ie for the County to buy the property and what happens if they cannot get a developer to buy the property. Questions by Mr. Lawrence discussed. Hearing opened Co the public. Irene Parker asked the Board about the property to be purchased. Russ Charland, local realtor, asked abouC Che schedule of rents to be charged for this housing. Hearing closed to the public and confined Co the Board. Chairman Ladd asked what action would be necessary fox the Board to take. The application would have to be approved at this time. Consultant fees discusstd. The total application has been increased to $107,000. Under the presenC grant, $7,000 would go to Sheehan and Associates as their consultant fees. It was felt that the consultant fees sad administrative costs should be taken out of the grant. The survey that was made fox the need for housing explained by Mr. Melton. He has over 1800 on a list waiting for housing. Over the next few years, Hutte County will aced many more units for the eiderly and the love income people. Funds received from this application has to be used to purchase property for these unite. On motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, Resolution 75-61 approving the Housing and Community Development application was adopted, wiCh the administrative costa being reimbursable from the grant, and the Chairman was authoristd to sign. RECSSS: ia:50 RECON~-ENED: 11:00 75-657 DISCUSSION: FORMATION OF SOIL CONSERVATIO*7 DISTRICT Supervisor Richter stated that be had requested Chat this discussion be brought before the Board. Mr. Cisy Castleberry, Director of Public Works, wan requested to comment on the matter. It was stated that this discussion came about because of a drainage problem in Supervisor Richter's distrieC. They told Supervisor Richter that the County would be eligible for all types of services that would be paid for by this Agency. Services set out. The only stipulation to receiving these services would be that the County suet be is a Soil Conservation District. Supervisor Richter said that one o£ the services that could be received would be a soil survey for all " of Butte County. Palue of such a survey explained. Mir. Henderson of the Soil Conservation Agency spoke at this time. He stated he was the district conservationist. He explained the baci~grouad of this group. There ere about 160 districts in the State of California. The local community has to be interested and the community or county has to ask the foil conservation group to appear is the county sad help work with them. They are federal employees Hader the Farm Act. Mr. Henderson said a soil survey could ba done without cost to the local taxpayer. It is done by the Federal Coverament funds. He wee asked if the satire county could be delineated as a district sad he said it could be set out as one district. Tha Agency is the technicians and they do Ehe work up to a limit. Supervisor Richter said he wished that the Board would see fit to take the action that would form this district. Time spent discussing the formation of such a district and how it would be handled. Bernard Richter, Oroville, Chairman of the Butte County Development Commission, stated that the Commisaioa #elt it would be good for the County to form such a district. The soil mag would help is the planaiag of industry for the County. Dan Blackstock, County Counsel, stared that the district would have five directors, elected county-wide. A method of taxation would have to be provided. In securing groats, there is a certain amount of in-house work that would have to be done. The assessments would be leveed on the land only. Before could proceed with the steps of formation of such a district, a public hearing would have to be held. The district would have to be requested to be formed by one ox more taxpayer. It would then be referred to LAFCO. Mrs. Ernie Albrecht spoke concerning the formation of the district. Mr. J. Lgman spoke concerning the benefits of securing the soil survey. Ernie Hatch, as o trustee of Reclamation District 833, urged the Board to subJect this matter to a public hearing. Before embarking upon another maintenance area, the county should~hstfe~more public in-put. Jim Barrie stated that he had been at the meeting is Durham when Mr. Henderson bad been requested to speak before this Board. • The County is not bound by this discussion. Eidoa Cully, representing Butte County Farm Bureau, said the Farm Bureau would assist is every way they could in this matter. Chairman Ladd thanked Mr. Henderson for his preseatetioa. She explained her opposition to the extension, stating that the lights are on late at night now, and there is quite a bit of solos during the evening hours. She stated that the operators are not is compliance with their use permit. She want on record ea opposing the extension of time beyond the 10:00 p.m. deadline. 75-659 APPEARANCE: CARL LEVERENZ, SEERFSENTIHG JERAI.b Bra~+ton, PARCEL t~ILP Cori Leverenz, attorney at law, represeatiag Jerald Brayton, spoke concerning the parcel map and drain upon this property. Be does not believe this drain is seeded. He is present today to request the Board to take action deleting the drain so Mr. Brayton can use the property. The Board members are aware of this site and the problem. Mr. Castleberry reported on the problem and the possible abandoning of the Swale on this property. This has been discussed with the Board is the past. The ewale could be re-located. Request discussed. There is ao water on the land; the drain does not carry water. • Mr. Bsaytonshowed the plans for his property; there ie Daly going to be one house on the property; he plans to build half way back on the property. l;e is not going to block up the swale. Mfrs.Braytom requested that the swale be dele•tedi from the map. Mr. Blackstock stated that this is a recorded map; the engineer would have to be authorized to file an amended map. It was maned by Supervisor Cameron that the condition of the swale be removed from thn map. Motion died for lack of a second. It wen moved by Supervisor Richter. seconded by Supervisor Madigan and carried that the map be referred back to Public iJorks Mrector to go wt to the property end view the new site for the house sad bring back a new recommeadatioa to the Board, in view of the new location of the house. 75-660 dPPEARANCE: MRS. FRANCES ROMEEO. FICAETT LATE. PARADISE-DOG PROBLEMS Mrs. Frances Etomero, Fickett Lana, Paradise, spoke concerning the problem of dogs. She commented on the dog that had been picked up by the animal control officer and gassed. This dog's owner had been in violation of County ordinances regarding the dog. She spoko about the other dogs that run Loose in the County. She said she would like to see tine Board geC oa the ball and get all the dogs is the county licensed. Supervisor McKillop stated that Mrs. Romero had worked last year with the County committee on this type matter. He sugg~asted that she be consulted during budget sessions and get same of her idea concerning solutions to this problem. Mrs. Romero filed a letter and petition with the Cltrk regarding dog problems. 75-b61 APPEARANCE; ROYAL MANNIOT U S FOREST SERVICE Royal Mansion, District Ranger with the U.S, Forest Service, spoke concerning the proposed land exchange between the Diamond Iateraational and the U.S. For~s~te ice. No action taken. 75 Mr. William Laird, Fickett Lane, Paradise, complained eaouc cne problem of dogs running loose in the Paradise area. He also complained about the Sheriff's sub-station in Paradise being open only eight hours a day. fle urged the Board to pass a leash law in this county. 75-663 APPEARdNCE: MRS MARTHA 5COTT. PARADISE: REQUEST CONCERNING FEES Mrs. Martha Scott, Paradise, stated she had bees granted a time extension on her lead division. At the time she applied for the extension, she had an electrical and plumbing permit. She now finds that Chis permit has expired. She has been told that the permit would now cost her $54.00; the original permit was $21.00. She requested that the $21.00 that she hen paid be allow©d t~ g~ towards the $54.00 fee she vast now pay. Request discussed. It was moved by Supervisor McRillop sad seconded by Supervisor Cameron that the $21.00 fee paid to the County be applied to the $54.00 fee for the electrical and plumbing permit requested by Mrs. Scott. OROVILLE Mrs. Ernie Albrecht, Oroville, spoke on the dog problem and suggested that maybe the coat ehoul~,Ae brought is to the review of the animal control. There should be in-put from the people. Mrs. Albrecht also spoke oa the hausiag problem. She questioned the Board about the property that would be purchased to build housing units, and its effect on the tax rolls. 75-665 APPEARANCE: GENE MEAGER SECRETARY-FISH & GAME COP4QSSION Gene Mercer, secretary foz the Fish ~ Game Commission, stated the Commission had held a meeting last night. A resolution was presented to the Commiaeioa coaceraiag the exchange of land between the State and Mathews Aeadymix. He was told Co ask the Board to hold a public hearing before any land is exchanged. The resolution is from the Feather River Rod ~ Gus Club. Transfer of land discussed. Supervisor McEillop said he would be in favor of holding s hearing on the exchange of the land. Chairman Ladd felt the Board should know whets the land is located and that a hearing should be held. Supervisor McRillop said he would like to see this hearing held ae soon as possible. Mr. Mercer and Bob Lassen, Regional Manager, will be notified when the hearing is set. RECESS: 12:50 RECONVENED: 2:00 75-bd6 CLARR GOAD ASSESSMENT DISTRICT: ADOPT RESOLUTIONS 75-62 through 75.66 Bob Brunsell, bond counsel, stated that they were presenting the preliminary documents for the formation of the Clark Road Assessment District. They have prepared five resolutions for the Boards consideration. Page 248. April 15, 1975 sssssasas~,sssr~.raiilsli's~sli7i as4ssasssessaas ss Mr, Brunaeil explained the steps that would need to be taken in the process and explained the various resolutions. A hearing date wen suggested for May 27, 1975. The bonder will be issued under the ~-.ct of 1911 and the district will be formed under the 1913 cct. Supervisor BichCer questioned Mr. Bruasell regarding this choice. Hr. Brunsell explained the advantages of going under the 1913 Act, which requires only one hearing, whereas she 1911 Act calla for two hearings. Mr. Brunsell felt there was more competitive biddinga under the 1913 Act. Hr. 8runaell explained that if the people decide at the hearing that they do not want the project, the county will have to pay for the plans and specifications. Supervisor Cameros stated that he wants to know all the costa, boundaries, etc. so that the Board does not have another Skyway. Mr. Brunsell stated that this information would be available before the Hay 27 meeting. Dan Cook, Cook Associates, appeared to answer questf.oas of the Board regarding the proposed district. This will be from Pearson Rand to 500 ft. north of Elliott and is to compliment the road project of Clark Rosd. The cast will be $161,900 total. They will have the spread of the cost by the May 27 hearing. This does sot include curbs and gutters. The area to be covered is about 6300 ft. along Clark Road. The $161,900 is for curbs, gutters and drainage. Clay Castleberry explained the channeiication sad signals that will be iavol*ed. This particular mosey available oan only be spent in urban areas. Hr. Castleberry does not feel this can be done without the storm drains. Supervisor Cameron commented that he hoped the notices would be clearer Ehan those seat fox the Skyway project. On motion of Supervisor McKillop, Seconded by Supervisor Madigan and carried, the following resolutions were adopted and the Chairman was authorized to sign: Resolution 75-b2 Approving boundary map 75-63 of Preliminary determination to undertake special assessment proceedings for the construction of improvements and acquisitions to be made in Clark &oad Assessment District No. 1, County of Butte 75-b4 Appointing spaniel bond counsel and authorizing execution of agreement 75-65 Setting time and place of hearing far determining public convenience and necessity in Clark Road Assessment District No. 1, County of Butte 75-66 of Intention in the matter of the construction of improvements and acquisitions in Clark 8oad Assessment District No. 1 Hearing set for May 27. 1975 at 2:00 p.m. AXES; Supervisors I?cRi.llop, Richter and Hadigaa NOES: Supervisor Cameron and Chairman Ladd Hr. Brunsell stated that at the final hearing, the vote must be 4/5 of the Board members voting in favor of the action. He also suggested that perhaps the County would like to send out an informal letter to the people is addition to the official notice. The supervisors felt this waS an excellent ides. He is going to consider this carefully is the future. Mr. Castleberry suggested that he could be preparing alternates to this project. Discussed; ao action taken. 75-667 OONTINU£D HEARING: APPEAL OF SUBDIVISION COMI~IITTEE'S AETERMLNATION TO FILE NOTICES OF VIOLATION ON PROPERTIES IAENTIFIE9 AS AP 41-12 SODTfi OF DURI~AM-PENTZ ROAD ANA EAST OF CIAkK RAAD Bettye Blair, Planning Department, stated that they had received a report from the Subdivision Committee with suggested requirements for compliance. Howard Johnson, Magalia, has contacted the people in the area and explained the county's position. Mr. Hatch has prepared a tentative agreement using all the suggestions of the committee. Mr. Johnson read the agreement. There is also s road maintenance agreement. Brian stated that he had just received s copy of the agreement and had not had time to read the agreement and therefore was not ready to speak on it at this time. Mr. Biackstock asked i£ it would be convenient to put this over a week. Mr. Johnson stated that they would not object to this. Supervisor McRiilop moved and Supervisor Madigan seconded that the matter be continued one week. No vote ea this motion. Discussion. There ie a matter of getting a certification by an engineer and other information seeded. Mr. Johnson stated that they have to get funding for this and that it cannot be done until the agreement is signed. He suggested that County Counsel be directed to approve the agreement changing whatever is needed to satisfy the Board sad send him a copy. This way they can Set their funding. Discussion of ways tc continue the matter. Mr. Johnson would like to have Cauaty Counsel change the agreement to the County's satisfaction. Discussion of continuance times. On motion of Supervisor Meitillop, seconded by Supervisor Cameras and uneaiswualy carried, the Board approved the road maintenance agreement and the agreement regarding the improvements to be made, subject to County Counsel's approval and that this matter be continued until May 20, 1975, during which time Mr. Johnson is to be completing the signing of the agreement, end the other matters involved. 75-b68 THE HEALTH SERVICES ~(1CENCY DIRECTOR;PRSSEt1TATI0N OP REPORTS ON COUNTY SUPPORTID HEALTH PROGRAMS Dr. Enloe stated that this is their second annual report. He gave s review of some of the activities of the past year. He explained that there was a need for a system which could meet the needs of all the residents of Butte County. Dr. Enloe discussed the hiring of Dr. Erliagheuatir and the closing of the hospital. He also briefly mentioned new programs that have been instituted. All of this and the information to be presented by the other participants is contained in the Health Services Agency's "Report to the Board of Supervisors" dated April 15, 1975. He briefly discussed the accounts an8 money taken. in, which is discussed in the report. Introduction and Comparison of Expenditures. Dr. Gerald Maguire, Director of Mental Health Services, presented charts showing comparative costs of the present and also of ten years ago. He explained the rise in money elloted to Mentai Health Services which has gone from zero in 1965-66 to $1,000,000 in 1975=76 (projected). Chairman ladd questioned Dr. Maguire briefly regarding any indication oa the outcome of the services and haw we12 the program was helping people. Dr. Maguire stated that this was difficult to do and that it had not bees studied in depth. 24-hour Care. Ernest Ely, M. D., Deputy Director of the 24-hour Care Services, explained the patients this facility accepts, which are both voluntary and involuntary. Dr. EIy explained the length of stays of the patients, how they are admitted, and the process of the releasing the patients. Dr. Ely explained the staffing of the facility, which is 6~, people. Supervisor Richter questioned about the funding the ceunty received. Dr. Maguire explained the past end present funding, stating that the present way is not equitable. Dr. Ely showed the Board slides of the facility. Dr. Maguire stated thaC he is very pleased with the walk-away rate at the facility as there are no locks oa the facility. AfterodY~e Services. Richard Buehler, Chief of the Aftercare Services, explained that this program reaches the patients in their homes. They are decentralized and quite mobile. They also have a special 8-week training series in connection with the Work Training Center in Chico. They also have a program of providing some counseling to the operators of homes. There are 5 members on this staff. Outpatient. Screening and Crisis Intervention. Anita Mills, Deputy Director of the Outpatient Services, explained that this provides evaluations is helping other agencies in making plane. She explained the staffing and stated that 2/3 of the patients are serviced through the main office in Chico. Miss Mills explained the type of patients they have sad the type of problems they have. They also provide informatian for the courts and do emergency evaluations for hospitals in Chico. Miss Mille explained that they are not going to renew their agreement with the Bridge in Chico. They are going to try and use facilities such ae police stations and hospitals to try and cover high utilization areas. This will be a reallocation of funds. Discontinuing funding of the Bridge in the area discussed. They would contract out with other agencies in the various towns. Supervisor Richter questioned Miss Mills about the contracts with other agencies. They will have a parallel system during the high utilisation hours. This would cover people that would noC be likely to call the mental~heaith services office. Mi~3a Mills stated that the Bridge wen providing services that perhaps should be handled by other agencies. She explained the areas where they wfli try to have outposts. Alcoholism Program. Charles Westwater, Deputy Director of the Substance Abuse, easwered the Boards questions regarding his report on Page 251. He explained that there is ao hardfast rule on the treatment of drunks when they are picked up. This is responded to separately by each individual. However, ,fail is one of the last resources; more often they txy to call a family, call a taxi, etc. This program has a variety of referal services which inelud~ doctors, hospitals, friends and families. They also work with Alcs#iolic Anonymous and Al-Anon. Youth Crisis Services. Dr. William Lorack, Deputy Director of the Contract Services, explained that the obfect of the program is to divert the children from the Juvenile Hall into the Crisis Home. The home provides 2k-hour resgonse to children from Probation and Juvenile Hall. It was not posstbleto continue the 24-hoot release aspect of the program so it was discontinued. Supervisor Richter questioned Dr. Lorack as to whether the person provided at the hall during the day was xesching the ma3ority or if the 3uveniles were being made to waif until the next morning. Supervisor Richter stated that this ties in to his belief that the hall is overpopulated and this is not necessary. Dr. Lorack showed the Boerd slides of the home. He also explained that the schools are beginning to make referrals on the Crisis Alert Program, which is preventlt~ services to children who have problems such as loss of parent, brother, etc. or a ma}or problem. Dr. Erlingheuser, Director, stated that in the middle of last year, the staff spent time fa the study of the direction that they would like to go, to seek out and develop resources.fsr the well-being of the community and the individuals. He set out the background of the programs that were included is the department when ik was set up. Various programs handled by this department itemized and explained. The skills of the staff and their capabilities provide an efficient service to the county. There are more people looking for free medical services. Nureia¢. Medical Access. "2068" & DCRC. Sheila Brown, Director of Nursing Services, explained the program areas she covered. Services range from clinic services to helping a family with a newly discovered case of tuberculosis. Variety of nursing activities ezplained and the staff handing these activities itemized. Medical-dental access program explained, with the goals being set out. Staffing for this department explained. brag and referral program set out and work involved explained. Une of drugs sad how it is handled explained. Child health disability program sus~oaarised. Funding explained Screening includes selective lab care, gild screening clinics will begin late this spring; there are screening exams 'that are given to the pre-school children. Howard Toussaint, Director of the Environmental Health Service. explained that this is the regulatory arm of the Health Services. They are involved with water supplies, sewage systems, rabies control, housing, etc. They are involved with the land development part of the County; with the monitoring of the streams in the county. They are representatives of this department on the E.I.R. committee and on the Subdivision Committee. They presented the Board with a well ordinance about three months ago; they are studying it now and will bring it back to the Board in the near future. Laboratory Services. Crandon Kellogg, Director, summarized the d uties and services of this service. He presented slides to show the equipment used and the services provided. Diagnosing diaseasea in people and in animals is part of the service provided. He pointed out the figures on the work load volume and the increases. The lab has not added or changed their personnel since 1960. They have absorbed the volume of work. Business Services. Larry Stram, Administrative Services Officer, gave an outline of the business services. He set out the workings of this s erviee. items that cross his desk explained. Activities of this service suammarized. Their Crippled Children auditing system has been used as a model by the State. Current projects explained. Chronic Disease and Social Factors. Dr. Erlingheuser summarized his feelings concerning chronic a.~sease and social factors. Prevention medicine is advocated to avoid disease. Part of the services provided is help to the elderly. Various clinics that are provided explained. Educational Services. Nino Calarco, Coordinator of Educational Services, explained the services provided. Most of the charts and slides seen today were provided by this service. They have a selective target for the programs. They make an effort to reach everyone in Che County to inform them of the services provided by the Health Services Agency. Health education goes beyond the knowledge of knowing about the services; they help people by making them aware of the programs 1n the community. They-work with the staffs of the various services. Conclusion. Dr. Enloe gave the conclusion of this presentation. A typed memo was presented to the Board members. Changes set out by Dr. Enloe. Next year they will review the community needs and they will present them to the Board. He feels theirs is an unique service. There will be a marked increase in the services. He said that the Supervisors will become directly involved in private and; public health services. This is necessary if the Heaith Services are to take care of the needs of the County. He explained the workings of the Medi-Cal program. He stated that the malpractice problem is increasing the costs of health services. Dr. Enloe net out his recommendations for this department. He feels that this County's Health Department is one of the finest in the State. Overtime could be charged to the departmeat~s budget. Mr. Rackerby explained the requests for overtime. The Sheriff wants the bailiff hired under CBTA to work overtime and he stated that the overtime could be charged to his budget. Public Works CETA workers work overtime on the oiling program. This could be charged Co their overtime. It is a matter of policy. Discussed policy of overtime. Individual cases for overtime discussed; each request would be brought to the Board for authorization. Requests discussed. Supervisor Richter stated he felt that the Public Works request is justified. County Auditor, Sill Lawrence, stated that he would ~ftggest that the overtime be charged to CETA funds, and if the requests are in excess of the funds available, then the overtime could be used from the fadi~iidual departments. Mr. Rackerby said that the object of the CETA program was to get as many jobs for people as possible. If overtime is paid from this program's funds, then could be cutting someone out of work. Nelson, County Clerk, by Debra Clanton, Deputy. 75-691 JOINT PIANNING COMMISSION ASSESSOR AND BOARD OF SIIPERV130RS MEETING Jim Lawson, Planning Director, stated that one of the major items they would like to discuss is the question of taxation as a factor in zoning. There is legislation now, A$ 15, that deals with control of agricultural land and one provision is the restructuring of tax on these lands. This is a recurring problem locally. Assembly Bill 15 states that inequities exist and that this should be corrected but the bill does not give specifics on how this is to be accomplished. Discussion. Al Anderson, Assessor, stated that they will review the land after the zoning is changed as required by law. However, they have to wait for sales in the area before they can change the values. Supervisor Richter felt that the Assessor does not believe the Board when they zone property because it's changed so often. Dan 8lackstock, County Counsel, stated that the question relating to this matter is answered in Section 402.1. He read portions of the section to the Board. There is a presumption in favor of the zoning not being modified. Mr. Blacketock doesn't believe the Assessor can overcome that presumption. He stated that Rally Ridge ie the only one that he can recall where the Board modified the zoning. Mr. Blacketock continued reading portions of the section. Mr. Blacketock discussed the matter of zoning and taxes in connection with the Assessment Appeals Board. The Assessor must demonstrate Chat the zoning change has not effected the property. Chairman Ladd gave an example of changed values caused by a zoning change from A-2 to A-20. He stated that this land will not ee11 for nearly the same price as it won't be able to be split into smaller parcels as 'would be possible with the A-2 zone. He also mentioned that the water quality would be changed. Mr. Blacketock stated that there ie an amendment to 402.1 that will make the Assessor's fob mare 'difficult. One of the considerations he must take into mind is the restriction of environment in trying to find s comparable sale. Discussion of whether this zoning placed an the ag lend would atablize the values. Mr. Anderson felt it should. Discussion of using the income approach on these areas. Lawson presented a map of the county showing the Williamson Act agreements in the rice and orchard areas, stating that they are picking some of these up now. Supervisor McP3 llop questioned about what happens to the contracts if the Williamson Act is abolished. Mr. Blackstock stated that there is a clause in the contracts whereby they would be cancelled if there was a change in the law. Mr. Blackstock stated that there is legislation whereby there must be a state hearing before ag land use can be changed. Supervisor Richter asked what the effect of the General Plan is on the values the Assessor uses. Mr. Anderson stated that he will not look at the General Plan in determining a value but at the zoning. Discussion. Discussion of valuing property in the Weat Chico area. Mr. Anderson stated that they look to the size of the parcels: smaller parcels are valued at a higher rate. Supervisor Richter feels the people in the West Chico area are not being treated fairly. Chairman Ladd expressed his opinion that the zoning taking place in different areas is reducing the saie price far land. Mr. Anderson stated that there are areas that are far out that might change or might not. He stated that there are•all sorts of cixcumatancea effecting different properties and that Chair office has to look at all these items. Discussion of rezoning tawerda consistency with the General Plan. There has been a study session on revisions of the General Plan. Oae of the problems is that they are going in one direction and the Board has another philosophy in some areas, such as the foothills. Mr. Lawson stated ChaC there is a division of thinking in the Planning Department. He showed the Board the general area that is being considered. Bob Geiser, Planning Department, gave the Board a statue report on the committee's activities. He stated that they are having several prablema in being coasiatent with the General Plan. He explained Chat they are trying to develop areas in the foothills without sewer and water systems. One of the problems in allowing development in these gray areas is the coat of providing public services and much of the development is mobile homes, which many people do not believe pay their share of the services through taxes. There is also a problem of erosion, and that the higher areas have a problem of snow removal. There has been a lot of development but Mr. Geiser feels it should not be allowed to scatter too far where there are no public roads and where it conflicts with timber land. He explained the develmpment in these areas. Larry Stooks, Planning Department, questioned if there was a demand to develop parcels at a 2 to 30 acre size and the problem 1n getting services to these people. These areas could be broken down into parcels as small as two scree eventually. Mr. Lawson stated that what they are saying is that people gravitate toward the minimum sizes or specifications. He stated that Mr. Brooks would like to provide very iteteiled criteria far these various gray designations and develop toward these criteria rather than just having an arbitrary list of permanent uses. However, developing this criteria requires a lot of work. Gene Sylva, Planning Commissioner, spoke regarding the Bald Rock and Berry Creek areas' development. He felt there should be some consideration of denafty. Supervisor Richter asked how they would come up with the criteria. They have several surveys by the Soil Con~erva- tion District. For planning purposes these are sufficient. For the money they have, they think they can give the information needed without being unduly technical. Mrc. Velma Smith, Planning Commissioner, stated that the Planning Commission is hesitant to go dawn to a two-acre minimum. 5t-e feels that the population projection ie very important in determining Chess matters and it is very possible to get a laxge population in the area ni thout urban services. Supervisor Richter feels that there are contradictions in areas. He explained that the problem in Chico is re6tricting people from one area because it is prime ag land but on the other aide, percolation is not suitable for homes. Thin leaves no place to send these people to build: Recess: 10:50 a.m. Reconvene: 11:00 a.m. Mr. Lawson discussed the problem Supervisor Richter had mentioned regarding Chico. He discussed the proposed and approved subdivisions in the Butte Creek Canyon area. Mr. Sylva stated that they are having problems now with people that were allowed to develop in the outer areas who are now coming in requesting fire departments and similar services and the Commission can only tell them to form an assessment district, which is sometimes difficult to do. Mr. Lewsoa feels that the Board must adopt a policy of whether tc emphasize the current situation or to Zook further into the future. Mr. Lawson feels that the county is becoming an urban county and that now decisions are being made with the short-term effect in mind. Mr. 5ylva skated that there is a push toward regional boards because counties are not doing their work. Chairman Ladd thought that the Board, by some of the decisions they have made, are looking at the long-term effect and that you cannot look only to the future but also must consider the present. Supervisor Cameron thinks the Board looks at least 10 to 15 years to the future. He backs a policy of these grey areas being expanded from the already developed area but that the people should be aware of the situation as far as uses are concerned. Discussion. Mrs. Smith explained that the reason only three commissioners were present was because they work during the day and could not get time off. They request that the next joint meeting be held in the evening. No action taken. Mrs. Smith related Mr. Watson's views, at his request, regarding planning for the county. Discussion of outside developers come into the county. Disoussion re having an administrator handling the use permits and variances to lighten the workload of the Planning Commission. Mr. Sylva brought up the matter of having an administrator, in thin case Mr. Lawson, handle the use permits and variances instead of having them go to the Planning Commission for approval. The applicant would still have the option of appealing to the commission but Mr. Sylva felt that this type of situation would greatly reduce their workload and allow them more time for more important matters. Mr. Lawson explained the other areas using this procedure and their experience with it. It has been effective for the most part. Discussion of implementation of this system in Butte County. Page 262. Mr. Lawson pointed out that the commission has always had the problem of people knowing they could appeal to the Board of Supervisors so they hold back information until they come before the supervisors. Variances would be•very difficult to handle at the present time; use pezmits would be easier, but there would need to be some revisions to the ordinances. This would still have a public hearing provision to allow public input. Discussion of a sign ordinance for the County. Supervisor Richter feels that the county ordinance should not be superimposed over'the city ordinances. Discussion. Thin is an area that could be handled effectively by an administrative procedure. Discussion of status of the city general plans. Mr. Gainer gave a report of the general plans. Oroville, Chico and Gridley either have or will shortly have their general plane completed. Chairman Ladd doesn't think that the county general plan should be changed to meet the city plane. Supervisor Cameron felt the county should wait until the city finishes holding their hearings on the matter before making any decision. Mr. Lawson would Tike to go with the city general plane and ask them to make modifications if there are conflicts with the county general plan. Chairman Ladd suggested that the known areas of disagreement be discussed as soon as possible. 75-692 AUTHORIZE PLANNING DEPARTMENT AS PLA G AGENCY FOR BCAG Mr. Lawson stated that they need authorization to continue with their grants. Supervisor McKillop moved and it wan seconded by Supervisor Cameron that the Planning Department be made the planning agency for the Butte County Association of ilovernmenta. Discussion of the motion. Any member of the BCAG could authorize their staff to do the work. Supervisor McKillop feels that the county needs the map information for the zoning. Mr. Lawson stated the BCAG moat have a permanent planning staff. Louis'.Camenzind, Planning Co¢mrissioner, stated that he felt this would be a step toward regional planning. Motion amended as follows: On motion of Supervisor McKillop, seconded by Supervisor Cameron and carried, the Board made the Piaaning Department the planning agemcy for BCAG for the Lake Oroville Watershed Study and the Community Development Policies for Central Butte County grants, Vote on motion: Ayes: Supervisors McKillop, Cameron, Richter and Madigan. Noes: Chairman Ladd. 75-693 DISCUSSIGN OF ZONING VIOLATIONS Supervisor Cameron felt that there was some confusion regarding the violations and action that can be taken by the county. He would 11ke this matter looked into. Mr. Lawson stated that there ie a disagreement on this. The ordinance provides fox the injunction process and not for citations. Mr. Blackstock believes the county does have a citation process. Page 263. Recently, there have been several use permits expire because people have had difficulty getting financing. County Counsel and Planning are to work oa the extension of use permits and also an the matter of the zoning inspector being able to write citations and are to b;eiag pxoposels to the Board. Discussion of the matter of EIRs being prepared for the Swede's Flat and the Tones Way areas. Mr. Lawson reminded the Soard of the 30-day appeal perfod for EIRs. Chairman Ladd explained that it was the feeling of the Hoard that the maps in question did not have a significant effecC but that the area should be studied. Pat McAchren, DER committee, stated that the EiR's could be done in three to four weeks but when it comes to a study, the time would be nix months to a year. He suggested an interim zoning for the area. Supervisor McKillop stated that the action of the Board had been clarified in the correction of the April 8 minutes. Chairman Ladd stated that he had received a message from Richard Roseberry regarding the amount of timberland required to make a $20,000 income. Mr. Sylva suggested May 27 in the evening for the next joint meeting, as it would be the fifth Thursday and the Planning Commission would not be meeting that night.
