APPROVAL OF MINUTES
On motion of Supervisor Wheeler, seconded by Supervisor Winston
and unanimously carried, the minutes of April 10, 1979 were approved as
mailed.

ADDITIONAL MATTER PRESENTED BY CHAIRMAN LEMKE
Chairman Lemke advised that Congressman Johnson would be
at the new Sheriff's Office in Chico presenting a flag that had flown
over the capitol tomorrow morning at 8:30 aom.

APPROVE FOUTS SPRINGS BOXS CAMP CONTRACT
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the Fouts Springs Boys Camp revised contract
for the placement of juvenile offenders which reflects an increase in
rates of $840 per month to $870 per month per juvenile to be effective
duly 1, 1979 was approved and the Chairman authorized to sign.

APPROVED BUDGET TRANSFERS
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, the following budget transfers were approved:

B-124 - AB 90 - CETA transitions. Within CETA - PSE transfers
$5,315 from salaries and wages and $2,835 from employee benefits with
funds being transferred as folllows: Juvenile Hall AB 90 - CETA transitions
increases overtime, $4,315 and employee benefits $1,235; within Probation
AB 90 - CETA transitions increases salaries and wages, $600; overtime,
$400; and employee benefits, $1,600. Within the Probation Department AB 90 -
AB 3121 costs transfers $2,700 from regular salaries and wages to employee
benefits. The purpose of the transfer is to cover adjusted projected
county costs for wages and benefits exceeding CETA limitations and to
cover anticipated deficits.
8-126 - Fire Protection. Transfers $3 from special department
expense to memberships in order to cover the deficiency brought about by
an increase in membership fees of the Cal-Rural Fireman's Association.
B-127 - Sheriff/Enforcemente Transfers $2,000 from special
department expense to office expense in order to provide an appropriation
to cover depletion of stock in the Chico Civil Office.
8-128 -Public Works - Road Maintenance. Transfers $70,000
from the Larkin Road project and $40,000 from the road reserve with a
total of $110,000 going towards the chip sealing of miscellaneous road
projects as approved by the Board of Supervisors on April 3, 1979;
minute order 79-567.

APPROVE EL MEDIO DITCH ENGINEERING AGREEMENT WITH RINGEL ASSOCIATES
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the engineering agreement with Ringel and Associates
for engineering and inspection services for the E1 Medio flitch project in
an amount not to exceed $38,540 subject to Farmers Home Administration
grant approval was approved and the Administrative Officer authorized to
sign.
APPROVE VARIANCE RENEWAL - GRACE I. NICHOLS
On motion of Supervisor Wheeler, seconded by Supervisor Dolan
and unanimously carried, the renewal of variance to Sections 19-10 and/or
19-12 of the Butte County Code for Grace I. Nichols for placement of a
mobile home on AP 26-12-4-008, Hewitt Avenue, Palermo, zoning: "A-2" was
pproved for a period of one year.
PUBLIC HEARING DATE SET
A public hearing date of May 8, 1979 at 10:45 a.m. was set .
for consideration of Trma B, Arthur petition for variance to Sections
19-10 and/or 19-12 of the Dutte County Code for placement of a mobile
home on AP 53-13-1-063, 5817 Copeland Road, Paradise. Zoning: "A-2 Ltd."
APPROVE WOMEN. INFANTS AND CHILDREN KWIC) AGREEMENT AMENDMENT
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the Women, Infants and Children (WIC) agreement
amendment with the-State Department of Health Services increasing the
:ounty's revenues from $26,411 to $28,172 brought about by increased
participation in the supplemental food program was approved; the Chairman
nithorized to sign said amendment; and the additional revenue was accepted.
APPROVE MEDICAL INDIGENT BILLINGS
On motion of Supervisor Winston, seconded'by Supervisor Wheeler
and unanimously carried, medical indigent billings representing total
charges of $29,636.40 with suggested payment of $19,396.40 were approved
and a transfer of funds coming from .the reserve was authorized.
ACCEPT CLARK ROAD CLEARII3G (PROJECT N0. 57452-74-3): AUTHORIZE FILII3G
OF NOTTCE OF COMPLETION
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the work of Kemen and Son was accepted for the
Clark Road Clearing (Project No. 57452-74-3) and the Clerk was authorized
to file said Notice of Completion with the Recorder.
APPROVE PUBLIC WORKS ITEMS
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
nd unanimously carried, the following Public Works items were approved:
1. Accepted the Marjama Subdivision improvements, authorized
the Treasurer to release the time certificate of deposit which the developer
posted in lieu of labor and material and performance bonds and commence
the one-year maintenance period.
2. .Approved the following agreements for sale, right-of-way
acquisition; authorized the Chairman to sign and authorized the Auditor
to issue warrants upon demand of the County's escrow agent:

This is a rebid of the project because the bids received last year were
too high. .The bridge is falling in. This project is funded about 30%
by the U.S. Forest Service through agreements.
On motion of Supervisor Wheeler, seconded by Supervisor Winston
a nd unanimously carried, the plans and specifications for the Humboldt
Road Bridge at Golby Creek, Project No. 91422-76-1 were approved; the
Chairman and Director of Public Works were authorized to sign the plans;
the wage scale was adopted; and the bid opening was set for 11:00 a.mo,
May 10, 1979, at the Public Works Office.
ADOPT RESOLUTION 79-64 APPROVE COOPERATIVE AGREEMENT WITH THE STATE
FOR SACRAMENTO AVENUE ASSESSMENT DISTRICT N0. 1
Clay Castleberry, public works director, set out the background
of the agreement. This is a cooperative agreement between the county
and the state with the state contibuting $120,000 to the Sacramento
Avenue Assessment District No. to This is for the storm drains. It
is ixt conjunction with the widening of Highway 32.
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, Resolution 79-64 approving the cooperative
drainage agreement, with the state for Sacramento Avenue Assessment District
No. 1 was adopted and the Chairman authorized to sign.
RECOMMENDATION TO CALTRANS RE: STATE TRANSPORTATION IMPROVEMENT PROGRAM
(STIP) SUPPLEMENT
Clay Castleberry, public works director, set out the proposed
amendment to the State Transportation Improvement Program (STIP) by
CALTRANS at this time. They propose the replacement of the Honcut Creek
Bridge, Hwy. 70 in the 1980-81 program. This is for about $600,000 to
$700,000. He did not feel that this project was as high on priority as
smme of the others that the Board chose. The Lassen Avenue approach
is the only one that would fail within that amount of money. He felt
that the Board should tell the state that they do not feel that the
Honcut Creek Bridge project is as critical as some others and tell the
state that the Board would prefer the Lassen Avenue project in treeing
with the county's needs.
Mr. Castleberry stated that the Northern Counties Supervisors
Association have backed three projects they support as critical. One
of them, Hwy 99 from Pentz to Chico, is in Butte County. The others
are in Shasta and Sskiyou Counties. They are petitioning that these
three projects beincluded in the state planning listC_for construction,
He asked the Board's authorization to attend the hearing in Eureka on
the county's behalf,
Mr. Castleberry felt that the section of Highway 99 from Gridley
to the Sutter County line should be constructed. The Board should emphasize
that the state should make studies of environmental review, right-of-way
acquisition should be obtained and plans should be designed. This would
take six to seven years. An expressway for that area was not shown as
an alternative.
Chairman Lemke felt that Mr. Trombatore should be invited to
speak to BCAG regarding the state plans.
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and carried, the Board will remain recommending the offramps for Lassen
Avenue instead of improving the Honcut Creek Bridge Hwy. 70 project.

3'': work on Hwy 99 from Gridley to the Sutter County line. He was. also
d irected to attend the meeting in Eureka with the committee from the
Northern California Supervisors' Association to support the Hwy. 99
project from Pentz to Chico at the-State Commission hearing.
627 REPORT TO BOARD - BID OPENING CHAPMANTOWN AREA IMPROVEMENT, PROJECT N0.
53235R-77-1
Glay Castleberry, public works director, rg}~orted to the Board
on the bid opening for the Chapmantown area improvement, Project No.
S3235R-77-1. The City of Chico has indicated that they would like to
participate in the project by enlarging a pipe to drain the city. The
bids were about $14,000 over the estimate of the money available.
He will be working with Larry Brooks to try to get about $15,000 of
block grant funds.
The report regarding the bid opening was continued to
April 24, 1979.

The annual road tour of Public Works projects was set for May 17,
1979 at 8:00 a.m.
629 REPORT FROM PUBLIC WORKS, COUNSEL AND SUPERVISOR WINSTON RE: CHARGES OF
AREA II DEVELOPMENTAL DISABLED CONCERNING COMPLIANCE WITH PUBLIC UTILITY
CODE AS FAR AS UNMET TRANSPORTATION NEEDS TO BE PRESENTED BOARD ON
APRIL 24. 1979
Chairman Lemke advised that the Board had received a letter
dated April 12, 1979 from the Area II Developmentally Disabilities Board
in which they find that Butte County is out of compliance with the Public
Utilities Code as far as unmet transportation needs are concerned.
He asked that a report be given to the Board on the other nine counties
in the Area IT area. He wanted to know the percentages of SB 325 funds
being expended for transportation of the elderly and handicapped.
In the event.-that they find that these other counties are not expending
the same percentages"as Butte County is, he is going to file suit against
that Board for discrimination against Butte County.
The report from Public Works, Counsel and Supervisor Winston
to be given to the Board on April 24, 1979.
630 REPORT TO BOARD CONCERNING PLANNING COMMISSION'S RECOMMENDATION OF THE
"CHICO MUNICIPAL AIRPORT - AIRPORT ENVIRONS PLAN"
Dan Blackstock, county counsel, reported on the Planning
Commission's recommendation of the "Chcco Municipal Airport - Airport
Environs Plan." The City of Chico has requested that the county use this
report as a guide For Future zoning. The Board cannot use this plan as
a guide and it would be interferring with the hearing process. The Board
could direct the Planning Department to commence the appropriate zoning
modifications through the hearing process or General Plan changes if
any.
631 CONSIDERATION OF AMENDMENT TO CHAPTER 20, SECTION 20.155 OF THE BUTTE
COUNTY CODE RELATIVE TO INSTALLATION OF UNDERGROUND CABLE TELEVISION LINES
Dan Blackstock, county counsel, set out the amendment to
Chapter 20, Section 20.155 of the Butte County Code relative to installation
of underground cable television lines. This amendment would be in keeping
with what the telephone company is doing as far as undergrounding costs
and would pertain to cable TV stations.

79= Supervisor Moseley stated that she had reconsidered her position.
d'. She would change her vote if this matter were being reconsidered. She
felt that the user should pay,
Supervisor Winston stated that most of the Board members have
been subjected to input by the people involved, including a letter he
received dated April 13, 1979 from NORCAL. He felt that it would be
very convenient for him to table this matter until next Tuesday,
He felt that to allow the ordinance to stand as it is is unfair.
He asked that•the matter be put over one weak so that the Board could
look at the ordinance from Red Bluff regarding this matter. The attitude
of some of the people he has talked to is that the cable television
companies are a business enterprise that devise income from this service.
This is a cable investment from which they are deriving income.
i Chairman Lemke stated that he just had cable television hooked
up to his house on a pole. If he wanted the service underground he would
have to pay for it. Those subscribers living in underground areas are
paying a price for that.
Consideration of the amendment to Chapter 20, Section 20.155 of
the Butte County Code relative to installation of underground cable
television lines was continued to April 24, 1979.

Tt was moved by Supervisor Winston, seconded by Supervisor
Dolan that Harold Burdick be appointed to the Butte County Housing
Authority Board (District 4) for a four year term expiring April 19,
• 1983.
Supervisor Moseley felt that the Board should give everyone
the courtesy of being interviewed that applied for the position.
Supervisor.Winston stated that Mr. Melton had talked to him
at least eight months during the controversy before he retired as the
Director. He felt that it would be an exercise in frutilityo He will
be happy to interview Mr. Melton if that is what Supervisor Moseley
wants.

PUBLIC HEARING: CHAPMANTOWN INNOVATIVE GRANT PROPOSAL APPLICATION (HCD)
The public hearing an the Chapmantown innovative grant proposal
application was held as advertised.
Larry Brooks, HCD director, stated that this was the second public
hearing that has been held on this matter. The grant proposed is in the
amount of $875,000. There is $550,000 in rehabilitation and new construction.
This is a very competitive program and they are cooperating with Chico
Housing Improvement Program (CHIP) in getting the rehabilitation work done
and using CHIP as their nonprofit organization.

Mr. Brooks stated that he would be bring back the resolution
and formal action that was required of the Board at a later date.
They are still developing the fine points to put the grant together.
Consideration of the formal action for the Chapmantown

The public hearing on the Skyway at Lofty Lane (Project No.
51261-78-1) proposed negative declaration and project decision for curve
realignment on. Skyway extending from 0.1 mile south to Ool mile north of
Lofty Lane,. Paradise was held as advertised.
Earl Nelson, environmental review director, set out the background
of the negative declaration. There will be some tree removal. There are
no significant environmental effects. He recommended a negative declaration.

On motion of Supervisor Moseley, seconded by Supervisor Winston
and unanimously carried, on the basis of this initial evaluation, finding
the proposed project could not have a significant effect on the environment,

DECLARATION AND REZONE FROM "R-3" (MEDIUM DENSITY RESIDENTIAL) TO "C-2"
(GENERAL COMMERCIAL) PROPERTY LOCATED ON THE NORTHWEST CORNER OF CLARK
ROAD AND SHADOWBROOK WAY,. IDENTIFIED AS AP 53-12-54, CONTAINING 0,56
ACRES. MORE OR LESS. PARADISE.
The gublic hearing on the Floyd V. Powell proposed negative
declaration and rezone from "R-3" (medium density residential) to "C-2"
(general comumercial) progeny located on the northwest corner of Clark
Road and Shadowbrook Way, identified as AP 53-12-54, containing 0.56
acres, more or less, Paradise was held as advertised.
Earl Nelson, environmental review director, set out the
background of the negative declaration. This property is just to the
south of an existing commercial area. It is presently zoned "R-3".
The environmental impacts are the same for both zones. He recommended
a negative declaration.
Bettye Blair, planning director, set out the background of
the rezone. The findings on the General Plan were on the section of
areas surrounded by and continguous to and was found in conformity with
the General Plan on that basis.

Powell stated that he had nothing to add.

On motion of Supervisor Wheeler, seconded by Supervisor Moseley
and unanimously carried, finding the proposed project could not have a
significant effect on the environment, a negative declaration was recommended.
On motion of Supervisor Wheeler, seconded by Supervisor Winston
and unanimously carried, noting the negative declaration has been considered
and finding the project is in conformity with the General Plan and does
not change the zoning integrity of the area the rezone from "R-3" (medium
chnsity residential) to "C-2" (general commercial) ,property located on the
northwest corner of Clark Road and Shadowbrook Way, identified as AP 53-12-54~,
containing 0.5b acres, more or less, Paradise-was approved; Ordinance 2018
was adopted and the Chairman authorized to sign.
COMMUNICATIONS
Teal Nichols, Chico. Mr. Nichols writes appealing the Planning Commission's
denial of the negative declaration and rezone from "TM-20" (timber
mountain - 20 acre parcels) to "TM-5" (timber mountain - 5 acre
parcels) property located approximately one mile west of Schott
Road, approximately 2-1/2 miles south of Doe Mill Road,
identified as AP 63-01-118, containing 20.07 acres, more or
less, Forest Ranch. Set for hearing May 8, 1979 at 11:15 a.m.
Gridley - Biggs Gemetery District. The District sends notification of
the resignation of W. W. Johnson as a member of the cemetery
district board of directors. Vacancy to be posted by Adminis-
trative Office.
Ray Storz, Esparto. Mr. Storz writes concerning the need to continue
recreation in the Butte Meadows area. Referred to hearing
later in the meeting.
Donald V.-and Audrey Sorenson, Chico. The Sorensons write requesting that
their 260 acre parcel of land be removed from timber preserve
zoning. Referred to Planning Department.

Bob Meyers, Morro Bay. Mr. Meyers writes regarding the maintenance of
"Union Bar Road", east of Oroville. Referred to Public Works
for answering.
City of Chico. The city writes concerning Federal Aid Safer Off-System
Road funds and requests that representatives of the Board meet
with the Council's Intergovernmental Relations Committee. Public
Works Director to confer with Supervisors Dolan and Wheeler.
Rape Crisis Intervention. The organization writes concerning their
request for funding and forwards information concerning their
third-quarter activities under the CCCJ grant. .See discussion
following communications.
DISCUSSION: RAPE CRISIS INTERVENTION REQUEST FOR FUNDING
Discussion of the Rape Crisis Intervention request for funding
in the amount of $800 for matching funds for the CCCJ grant ,held at this
time.
Supervisor Dolan stated that it was not clear whether the
action requested is approval of money or verification that it is built
into the budget.
Supervisor Winston stated that he found it difficult to budget
any monies at the present time out of the 1979-80 budget. There are going
to be some problems in 1979-80. The $800 is going to be meaningful.
This request should be considered in light of other budgetary requirements.
Supervisor Winston set out the data that had been sent to the Board on
the activities of Rape Crisis. There are 21 incoming letters and 43
outgoing letters, awareness meetings and messages and a request to
volunteers., This is a very sensitive area. It seemed that some of
the areas covered could be covered adequately by-other law enforcement
agencies with the proper guidance.
Chairman Lemke stated that if they are to meet their deadline
it would be a request to fund from the reserve from the 1978-79 budget
and set aside for the 1979-80 budget. He assumed that the Board did
not what to do that at this time.
Supervisor Moseley stated that this matter came up before the
County Justice System Board and for the lack of one vote they did not get
the money. This money could come out of that budget.
Chairman Lemke felt that the only alternative would be to
come out of the reserve for the 1978-79 budget and placed in an account
marked for the grant proposal. If they filed for the grant it would be
pretty bad if the Board were to withdraw the money at budget time.
Supervisor Dolan stated that she was willing to consider the
matter but was not willing to vote for it today. Possibly this matter
could be considered next week.
The matter was continued to April 24, 1979.

to "C-2" (general commercial) for property located north of Chico along
Hwy. 99E just south of Eaton Road exit, AP 44-47-43, containing 6.3
acres, more or less, north of Chico was held as advertised.
Earl Nelson, environmental review director, set out the
background of the appeal. Tn determining that an EIR was required he
had to look beyond the proposed use. The proposal could go in there
without causing the kind of problems that could happen once the "C-2"
zoning was established. Once the zoning was completed, there could be
any of the uses allowed within the zoning district. He was worried about
access in view of the fact that the access would be off Hackamore Street,
which is a residential street. Even though there is a tentative map
in process that could possibly give additional access there is no way
of knowing that this will happen. He was concerned that there were
residential areas immediately to the south and across the drainage ditch.
The potential of the "C-2" zoning could be incompatible to the residential
uses. .He encouraged. Mr, Sandrowski to consider alternatives so that he
could use a negative declaration. He felt that the EIR requirement was
a proper determination in this case. There is still a problem with the
General Plan, It does not appear to conform to the density designation
of the General Plan for that area, This cannot go before the Planning
Commission until the environmental documents have been completed.
Supervisor Wheeler stated that the Myack Company is the property
in question next to Mr. Sandrowski's property. This is a proposed
subdivision map. The roadway that is propose@ will come to Mr. Sandrowski's
property, The water and electricity will be coming across his property.
Hearing open to the public. Appearing:
1. Ted Sandrowski. Mr. Sandrowski stated that he had applied
to put a nursery on his property. He is a landscape contractor. Most
of the nursery business is related to residential areas. Residential
areas are not uncommon areas for .nurseries. Mr. Sandrowski set out what
is in the area at the present time. He understood that he would have
to apply for "C-2" zoning in order to have the nursery on his property.
The only other alternative would be to maybe come up with zoning for
nurseries. Mr. Sandrowski set out where other nurseries in the area
are located. They axe adjacent to residential property. The only thing
on the checklist that was negative was the question on tYaffic. Mr.
Sandrowski asked if they were really serious about bringing the road
through his property. He would have to know this information before
he would know where the nursery should be located on his property.
2. DeVere Paceo Mr. Pace stated that he would much rather
see a nursery on that location than something else. There will be
ommercial areas in that location sooner or later because of the freeway.

Bettye Blair, planning director, stated that under the"A*SR"
zoning there could be a greenhouse and raising of nursery items but
there could not be retail sales in the "A-SR'" zoning. The "A-SR"
zoning could be changed through the hearing process to allow nurseries.
The initial environmental study would take the longest period of time.
The hearing process from the Planning Commission to the Board could be
done in b0 days. Tf Mr. Sandrowski wanted to amend his application,
he might want to ask for an amendment of the "A-SR" zoning to allow
a nursery with a use permit where the county would have input through
how the property is developed.,

Road, Paradise, identified as AP 54-08-66 was held as advertised.
Earl Nelson, environmental review director, set out the
background"of the negative declarationo There were some potential problems.
He felt that the mitigation measures could be overcome. The concerns
relate to overcovering of soil and increase in drainage and the possibility
of an upset if explosive materials are stored in the building. There is
concern about the asthetics. A negative declaration is appropriate with
the mitigation measures.
Bettye Biair, planning director, set out the background of
the use permit. The Planning Commission approved the use permit subject
to conditions. There axe instances where CALTRANS does not require a
left -turn lane but the county does require the lane.
Hal McDonald, assistant public works director, stated that
Mr. Mariotti would like to put up a covenant to .put the left turn lane
in at such time as the property across Clark Road is developed.
Hearing open to the public. Appearing: Lou Mariotti. Mr.
Mariotti stated that he objected to the requirement for the left
turn lane. There are other and greater developments that will come
into the area. He hoped that the area will be zoned "C-2" zoning.
There is a proposed mobile home park across the street. He did not
mind entering into a covenant.
Hearing closed to the gublic and confined to the Board.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, on the basis of this initial evaluation and
finding that although the proposed project could stave a significant
effect on the environment, there will not be a significant effect in this
case because the mitigation measures described below have been added to
the project and a negative declaration was adopted:
1. A drainage plan shall be submitted to the Butte County Public. Works
Department and the required facilities shall be constructed.
2. An encroachment permit shall be obtained from Caltrans. (Note:
The applicant has an existing encroachment permit from Caltrans.
Review of the existing driveway and public road approach by Cal-

Mrs. Barr, president of the Butte County Historical Society,
stated that it has come to the attention of the Society that there is a
possibility they might be able to make some arrangements to acquire the.
Eft;: House. This would be used as a walk in and museum.
Chairman Lemke stated that the county is in the process of
moving out of the building. The Board has the alternative instead of
paying to have the building demolished to save it and sell it to the
Historical Society for $1 and let them relocate the building.
Supervisor Winston stated that he would like to make a statement
regarding the value of the property. Is it going to be valued by use
of the property or value as to historical value. He would have no
problem if the determination was made that the public would be served
with the building being an office and exhibit area and letting them have
the building and the property for $lo
Mrs. Barr stated that they would not move the museum from
Butte College for security reasonso It would be used as a revolving
museum.
The matter was referred to the Administrative Office to
meet with Mrs. Barr regarding acquisition of the property,::and _ report
back to the Board on May 1, 1979.

Mr. Blake spoke regarding the Peripheral Canal. He referred
to SB 200 and the amendments that have been made to the bill. He asked
what action the Board had taken regarding the Peripheral Canal.
Supervisor Winston advised Mr. Blake that the Board had not
specifically endorsed the resolution that the Metropolitan Water
District had asked for but approved in principle the Canal if proper
safeguards were added to the bill.
64 APPEARANCE: HAROLD WILSON
Mr. Wilson stated that he was trying to build an addition on
a house on Hwy 70. He would like a variance to Section 19-11 of the
Code> This is the location of a structure in relationship to the septic
facility. The addition would come within the five foot limit. He had
gone to the Building Department and was informed that there were ways
around the requirement. He drew up the plans and now there is a problem
with the Health Department. The Health Department does not want to
grant the variance.
Lynn Vanhart, environmental health director, stated that this
department did not recommend the variance. The ordinance says five feet
from a foundation. He could find no authority to grant the variance.
Dan Blackstock, county counsel, advised that the Board does
not have the authority to grant a variance. The Board has the authority
to change the ordinance.
Mr. Wilson was advised that he should contact Counsel to see
if there is some way to convince him that this can be done.

the work that he did with Caltrans. He said that when he first started

Association. Butte County was given so much money for their use with.

ran out of money this year. Statewide the counties used up about 1/2

Butte County, out of $49,000 Mr. Castleberry only left $25,000 on the
table. Butte County first set out the procedures to use safer off-road
systems. Mr. Estep stated that it has been a pleasure working with
Mr. Castleberry.

two parcels on the south. side of Humboldt Road, approximately 3/4 mile
east of BuII Hill Road, and the other approximately one mile east of
Bull Hill Road, identified as AP 60-07-2 and 18, Butte Meadows was held
as advertised.
Earl Nelson, environmental review director, set out the
background of the negative declaration. This project involves a 32
space campground in the Butte Meadows area. The total parcel is over
100 acres. The camping areas are two portions of that property and
consist of about 40 acres. Tn the developed area there is about one
camping space per one acre. There is only one item that has a maybe
and that is potential contamination of groundwater. The Health Department
is concerned with the pit privies. Some of the outhouses are located
close to the existing stream. He recommended that the privies be sealed
vault construction and set back 100 feet from the stream. If assurance
could be made that there would not be any leaking then the setback would
be different. He recommended a conditional negative declaration.

the use permit. This was heard before the Planning Commission and
approved subject to conditions.
Chairman Lemke stated that the Board had received a letter
from Ray Storz regarding the use permit.
Hearing open to the public. Appearing: Neil McCabe, representing
Mr. Smothers. Mr. McCabe stated that the appeal is not on condition #1
but on conditions ~k5, 7 and 8o Mr. McCabe stated that there is no problem
with condition ~~5 as far as the requirement for sealed vaul£. He would
prefer to keep them at the present location. Some of them are within
100 feet of the stream, The State Water Resources Control Board says
that if the replacement is sealed, it is unclear why there must be a
setback from the stream. Mr, McCabe presented exhibits as this time:

Mr. McCabe stated that one of the main points is that the
recreation park is there. It has been is existence for many=years. The
campground has been used for over 40 years. It is a potential that the
use permit is net a requirement. The driveways are adequate and rather
than going to the standards to improve the existing driveways he would
like to use the ones there or pave the entrance way. There is a big
oak tree in the first picture that would have to be removed. Mr. McCabe
set out the pictures at this time. They show the driveway and the
location of the cedar tree. There would also be a possible problem with
the conduit if the road were widened. Mr. McCabe spoke regarding the
requirement for the road widening. There is about five miles of road
from Humboldt to Hwy 32 to these properties. The width of the pavement
section is 16 to 21 feet. To require widening through the first parcel
between 660 to 670 feet and then go back to the narrower width to cross
Biamond International property and then to widen the second parcel of
about 1/4 mile would create a bottle neck in between. It is not related
to the proposed use. There is no new proposed use, There are 32 spaces.
There are ten spaces occupied year round. The other 22 spaces are filled
in the spring and vacant in the fall. There are other trailers using
Humboldt Road for areas past this property. The space change in the
Forest Service campground is about every three days. Mr. McOabe would
like to see condition ~k5 modified to only require the seal vault construction
so that the privies do not have to be moved; condition ~k7 modified so
that the existing driveways are adequate; and condition ~k$ deleted
completely.
Hearing closed to the public and confined to the Boardo
Hal McDonald, assistant public works director, set out the
requirement for the road standards. Mr. McDonald set out the road in
the area of the proposed campground at this time. It is a typical
mountain road that is used for logging. He felt that it would be bad
to widen the road out in one spot and then go back to the narrower road.
If the driveways were widened a little bit, that should be appropriate,

REPORTS FOR PARADISE AREA: SET APRIL 24, 1979 AT 11:30 A.M. AS TIME FOR
PRESENTATION OF PARADISE WATER QUALITY MANAGEMENT PLAN
Lynn Vanhart, environmental health director, stated that the
recommendations from Paradise Municipal Advisory Council came about
after hearings on the study in Paradise, The Paradise-Water Quality
Management Plan study said that the county has a choice of remaining
on septic and. limited growth and plan for a sewer system for the entire
Paradise area. Part of the area on Skyway should be sewered now. In
any event, whichever way the Board decides to go there is a need for
a pollution study- in order to qualify for funding. There is $2,500
available that was budgeted for sampling in the 208 grant that was not
used. It would be available for use.
On motion of Supervisor Moseley, secanded by Supervisor Dolan
and unanimously carried, the Environmental Health Department was directed
to apply for a grant to complete the pollution study for the Paradise area.
The presentation of the Paradise Water Quality Management Plan
done by Montgomery Engineers will be presented on April 24, 1979 at
11:30 a.m.

FUNDING FOR TITLE XX FEDERAL SOCIAL SERVICES FUNDS AND IN-HOME SUPPORTIVE
SERVICES FUNDS
Discussion of the State Department of Social Services letter
regarding the Board's request for additional funding for Title XX Federal
Social Services funds and In-Home Supportive Services funds was held at
this time.
Bob Crisan, welfare director, stated that he had sent a memo
to the Board regarding the problems of fundinge The state has authorized

79= the funds for In-Home Supportive services. In Title XX funds the letter
a,; denies such increased funds. In his memo he indicated that $118 million
which was allocated for other social services amounts to $124,000 but
some games were played with the State where $6 million that went to the
general fund were licensing fundso The state has said they were allocating
state licensing fees to Title XX and are-now saying it is not Title XXe
There are four alternatives. One is fairly well eliminated and that is
the discontinuance of total services by May 11, 1979. It would take a
longer period than that for the layoff notices to be sent. The state
is indicating there are less funds than in 1975-76. They received only
$123 million but basically the state has increase in service funds of
$l03 million or 1.08%. Had that been applied it would be about $655,000
which is more than Butte County is requesting in this letter. There is
no way that the state can be approached to increase the allocation by
correspondence. The state took the largest amount in the two columns
for this year for 5B 154 allocations and allocated 96% of that, Those
counties that overspent. and at the end of the year had a reallocation of
funds came out quite well. Butte County stayed pretty closed to the
iaitial amount. There are eleven counties that were hurt, There axe
four counties that have a higher amount.
Dan Blackstock, county counsel, stated that they could request
a meeting with Mr. Woods in Sacramento with the Legislators and review
with them and see what if any relief the administration would be willing
to give the county.
Counsel to coordinate meeting with Mr. Crisan and Supervisors
Lemke and Wheeler to meet with the Legislators and try to work out the
problem.
653 ADOPT RESOLUTION 79-65 OF APPRECIATION OF ENERGY CONSERVATION CONFERENCE
HELD IN CHICO FOR APPROPRIATE TECHNOLOGY ASSOCIATION
Bill Ferguson was present to make a report by the Appropriate
Technology Association on the energy conservation conference recently
held in Chicoo They are interested in looking further into building
homes under the code for energy conservation and hoped that county
government will garticipate also. Energy is money. They are not working
on energy conservation far fun because the citizens are paying for the
energy. He also thanked the Board for holding the transportation meetings.
On motion of Supervisor Wheeler, seconded by Supervisor Moseley
and unanimously carried, Resolution 79-65 in appreciation for Appropriate
Technology Association for holding the Energy Conservation Conference
in Chico was adopted and the Chairman authorized to sign.

Supervisor Winston advised that Mr. Schlaf operates the fish
farm between Oroville and Chico. He has two people who work on the farm.
Due to the circumstances that he wants someone there to watch the farm,
he wants to move one house from one place to another and this led to
the legal question of whether he could do this. Counsel's memo states
that so long as there is no leasehold agreement between the owner and
tenant it is practical to place two residences on one parcel,

and unanimously carried, the Planning Department was instructed to inform
Mr. Schlaf as-per the memo of April 6, 1979 and subject to conditions

Supervisor Dolan stated that she now understood that the trans-
portation hearings would be held on April 24, 1979 at 7:30 p.m. in Chico;
May 1, 1979 at 7:30 pom. in Oroville; and May S, 1979 at 7:30 p.m. in
Paradise.
Supervisor Moseley asked that the Board set a time to talk
with the operators of mental health. facilities. There is a need for
some clarification of AB 3052.
The matter was set for April 24, 1979 at 2:00 p.m.

Chairman Lemke advised that the Soard•had received a memo
dated April 12, 1979 regarding covered loads with specified penalties
being allowed to enter the dump and having one person funded by litter
funds. It will take some time to get the thing working< The program
has worked elsewhere and Monty East has helped to put the same type of
program together for other counties.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the matter of possibly having a requirement
that covered loads be admitted into the dump site only and having a
specified penalty if loads are not covered was referred to the Public
Works Department with. the Board's blessings.
ADDITIONAL MATTER PRESENTED BY CHAIRMAN LEMKE
Chairman Lemke announced that he would have to attend a
meeting in Marysville at 1:30 p.m. on Tuesday, April 24, 1979 with
the state regarding rail planning in Californian He will have to
leave the Board meeting before it is over.
65 AUTHORIZE URGING ASSEMBLYMAN STATHAM TO DELETE INCREASED AMOUNT FROM ARB
BUDGET AND MOVE THE FUNDS OVER TO LOCAL DISTRICT SUBVENTION FUNDS RE:
AIR RESOURCES BOARD SUBVENTION FUNDS
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, the Board authorized urging Assemblyman Statham
to delete the increased amount from the ARB budget and to move the funds
over to the local .districts subvention funds.

REFER EMPLOYMENT APPLICATION FROM MR. DOUTHIT TO PERSONNEL
The employment application from Mr. Douthit was referred to
Personnel.
EXECUTIVE SESSION: The Board recessed at 1:20 p.m. to hold an executive
session regarding litigation and personnel matter.
