The City writes concerning the proposed prohibition of parking on both sides of Nord Avenue from Big Chico Creek to north of Sacramento Avenue. Mr. Castleberry met with representatives of Division 4 S O . ~ of Highways and Chico." He explained what would be done. Department of Water Resources. The Department writes concerning khe increase in water deliveries for the current entitlement period, This confirms the allocation of water to the County. Referred to County Counsel. 77-741 MATTERS PRESENTED SY BOARD MEMBERS Supervisor Lemke presented greetings from Town of Paradise and invited Board members to attend the Gold Nugget Days activities starting Thursday, April 21, 1977. Supervisor Madigan commented on the letter from Paradise Irrigation District regarding the ordinance from E1 Dorado County where all development has been stopped due to the drought. He felt the letter should be responded to stating that the Districts should ask for the area within their boundary to have development activities stopped. Garrett Burt, resident of Paradise, asked Co have the letter read, Supervisor Madigan read said letter and presented a copy to Mr, Burt. Supervisor Winston reported on the CSAC Revenue and Taxation Committee meeting held Last Friday. Many tax reform items were considered. The Petris Bill was considered; it provides a sliding scale of tax relief for home owners. The committee went on record as endorsing the Petris Bill. Chairman Richter reported on the Emergency Medical Access meeting held in Redding last Saturday. Shasta County's proposal discussed, Stan Statham and Ray Johnson will be contacted to see if they can secure State moneys to make up the difference in the funding of Emergency Medical Council. Mr, Lindberg was told that he would have to operate within the budget, Supervisor Moseley commented on the letter from the Oroville Community Hospital, thanking theBoard for their efforts. Supervisor Moseley commented on the letter from Walter Johnson regarding "Grey water". Letter discussed. A report will be secured to see if an ordinance is needed county wide, 77-742 PUBLIC HEARING: MIKE ARVONEN, CHICO-PETITION FOR VARIANCB TO PROVISIONS OF SECTION 19-10 and/or 19-12 OF COUNTX CODE FOR PLACEMENT OF MOBILE HOME CHICO The public hearing on the Mike Arvonen, Chino, petition for variance to provisions of Section 19-10 and/or 19-12 of the Butte County Cade for placement of a mobile home on AP 39-25-02, Route 3, Box 98, Chico was held at this time, Howard Toussaint, Health Department-County Sanitarian, reported that the parcel had been approved by the Health Department and they have no objection to the placement of this mobile home on the parcel. NOFREY-REZONE FROM AR-MH (AGRICULTURAL- RESIDENTIAL MOBILE HOME} TO C-I (LIG$T INDUSTRIAL) PROPERTY IACATED ON THE SOUTHEAST CORNER OF KUSEL ROAD AND LINCOLN BLVD., IDENTIFIED AS AP 3b-292-01, OONTAINING 3.22 ACRES MORE OR LESS OROVILLE-CONTINUED TO JULY 12 1977 The public hearing on the Louis C. Nofrey rezone from AR-MH (agrfcultural-residential mobile Name) to C»1 (light industrial) property located on the southeast corner of Kusel Raad and Lincoln Blvd., identified as AP 3fi-292-01, containing 3.22 scree, more or less, Oroviile, was held as continued from March I6, 1977. Jim Lawson reported that a••negative declaration had been approved. Background of the matter set ouC. He had an amendment that was approved by the Planning Commission last night. The amendment would take care of this situation. Staff report read; the amendment if adopted would alleviate the problem. Hearing opened to the public, Appearing: 1. Mr. Louis Nofrey. Spoke in favor of the rezone. He feels this property fa the ideal spot for commercial-type businesses. It was suggested that the hearing be continued until hearings could be held on the amendment. It was moved by Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, hearing continued to July 12, 1977 at 9:30 a.m. and the Board gave their blessings to the amendment to the General Plan and authorized the Planning Director to proceed with the hearings. 77-744 HEARING: NOTICE OF INTENTION TO PURCHASE CHI CO HIGHWAY PATROL FACILITIES FOR SHERIFF Hearing on the notice of intention to purchase Chico Highway Patrol facilities for Sheriff held ae advertised. Dan Blackstock, County Counsel, sek out the background of this purchase. Hearing opened to the public. Appearing: no one. Hearing closed to the public and confined to the Board. On motion of Supervisor Madigan, seconded by Supervisor Lemke--and ~o-~~~ carried, County Administrative Officer was authorized to immediately file escrow iastnsetions, setting out the purchase price of $80,000,, Chairman of the Board authorized to sign the acceptance of the Deed, with the inclusion on the warrant registry a warrant in the amount of $80,000 made payable to escrow agent, upon demand of said escrow agent. On motion of Supervisor Madigan,seconded by Supervisor Lemke and unanimously carried, second reading of salary ordinance emettdment waived, Ordinance 1819 adopted and the Chairman authorized to sign. 77-746 WAIVE FIRST READING OF SALARY ORDINANCE AMENDMENT: CHANGE IN COUNTY INVESTIGATOR CLASSIFICATION SERIES TO PERMIT FLEXIBILITY AT ENTRY LEVEL POSITIONS This ordinance provides for a change in the county investigator classifi- cation series to permit flexibility at the entry level positions. The ordinance also reclassifies several other positions. Classification of Deputy Sheriff Z discussed; Jim Rackerby explained how this would be handled. Jailers and Bailiffs could advance out into the field under this new ordinance. They have the opportunity to compete for the other jobs. On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, first reading o£ the salary ordinance amendment was waived. 77-747 PROVE PARTIAL PAYMENT - ST. JOHN MOUNTAIN COrPUINICATZONS VAULT The manufacturer of the communication vau1C for 5t. John Mountain, Glasacom Manufacturing Company, ie requesting partial payment of work completed. Suggested payment is $6,678 or 75 percent of bid price. Tom Struthers, Purchasing Agent, staked they have explored several alternatives to the partial payment. They had hoped to get the site prepared for the vault, but snow kept them from doing the work. 51te preparation wilt be ready in about a month. Alternatives eat out by Mr. Struthers. The building could be ctore by manufacturer sad delivered to the County when site is ready. The manufacturer would go along with this alternative, but would like payment of the interest on their loan. The County had told them they would Like delivery of the vault by January 1, 1977; the manufacturer has kept his aide of the bargain and would sow like payment. Alternatives discussed. Oa motion of Supervisor Winston, seconded by Supervisor Lemke and carried, partial payment in the amount of $6,678 was approved for Glasecom Manufacturing Company, for St. John Mountain communications vault, repraseating 75x of the bid price, on the condition that theCountp receive something from the manufacturer that the building is the property of Butte County. AYES; Supervisors Lemke, Madigan sad Winston NOES: Supervisor Moseley and Chairman Richter 77-748 PUBLIC SEARING: SAM SMILEY, HYPE AL OF CONDITIONS 1 and 5 FOR PARCEL MAY LOCATED ON THE SOUTHWEST CORNER OF 20th_STREET AND PLUMAS AVENUE. OROVILLE The public hearing on the 8sm smiiey appeal of Conditions 1 and 5 for parcel map located on the aouthvest corner of 20th Street and Plumes Avenue, Oroville (AP 30-037-07) held at this time. Clay Castleberry, Director of Public Works, set out background of the parcel map. Appeal of the conditions explained. Mr. Smiley requests that the drainage and improvement requirements be waived. Appearing: 1. Sam Smiley. He stated they are appealing the conditions for drainage and for curbs,~guttetC:and s~dewalke. Mr. Castleberry suggested that theSoard re-affirm the conditions and authorize him to work with Mr. Smiley to po8tpone '.temporarily the putting in of the improvements, It was suggested that the hearing be put over and in the meantime have the matter resolved, On motion of Supervisor Madigan, seconded by Supervisor Izmke and unanimously carried, the hearing was continued to May 10, 1977 at 9:45 a.m. 77-749 AWARD OF BID: ROAD BROOM Bids have been received for the purchase of a pull type driven road broom for the Public Works Department with the iow bidder being Droscher Equipment Company of Redding submitting a bid of $4,642,80 including sales tax. On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, award of bid for road broom was awarded to the low bidder, Droscher Equipment Company of Redding, in the amount of $4,642,80 including sales tax. RECESS: 10:25 RECONVENED: 10:32 77-750 APPROVE ADDENDUM_TO ARCHITECTS AGREEMENT: NEW ADMINISTRATION BUILDTNG The Building Committee has recommended additional work on the new Administration Building to include paved parking, access, landscaping and drainage, Supervisor Moseley stated that she did sot want the County to get stuck with an expensive landscaping cost for this building, Discussed work to be done. Landscaping discussed, On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, Addetdum No. 3 to agreement with the architects w as approved and the Chairman authorized to sign. 77-751 AUTHORIZE ADMINISTRATIVE OFFICE TO AWARD BID FOR HOUSING AND COMMONITY DEP. The low bid received on rehabiiitation of the county house at 2435 "D" Street ie $18,620 by E. C, Feria Company. Bid discussed, On motion of Supervisor Moseley, seconded by Supervisor Madigan and carried, Administrative Office was authorized to award bid in the amount of $18,820. Discussed. Oa motion of Supervisor Madigan, seconded by Supervisor Winston and carried, Resolution 77-644eatablishing $50 cancellation fee for Land Conservation Act cancellations was adopted and theChairman authorized to sign. AXES: Supervisors Madigan, Moseley, Richter and Chairman Winston NOES: Supervisor Lemke 77-753 ADMLNiSTRATIVE COST OF INFESTING: HELD OVER AT THIS TIME At the request of Administrative Officer, administrative cost of investing was held over at this time. 77-754 ADOPT RESOLUTION 77-65 ADDING $1,006 TO PUBLIC ADd~fINISTRATOR'S REVOLVING FUND The District Attorney Sa requesting s $1,000 increase to the Public Administrator's revolving fund from $500. - On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried; Resolution 77-65 adding $1,000 to the Public Admiaistratox'8 revolving £und was adopted sad the Chairman authorized Co sign. 77-755 CANCEL FUTURE HEARINGS: IINIFORM FIRE CODE County Fire Warden recommends postponement of hearings on Fire Code until further study is made, Committee concurs with the recommendation. The Fire Warden will contact the people in industry and secure their views on the Code. Code to be brought back by the Committee at a later date. 77-756 DISCUSSION: SALARY ORDINANCE AMENDMENT CONCERNING SHERIFF'S DEPT, DEPUTIES Supervisor Lemke said he could like to consider the matter of the employees at the Sheriff's Department. He suggested that a committee of Supervisor Moseley, Clif Nickelson, Jim Rackerby, Sheriff Gilliek and himself meet and discuss this matter. He said there are a number of people on board that the county has a good chance of loosing. Chairman Richter appointed Supervisors Lemke and Moseley as a committee to meet and bring back a report oa the matter. 77-757 GENESAL LIABILITY INSURANCE DISCUSSED Several aceions have been carried over from last week. Chairman Richter said he feels that he is going to keep his vote the same as last week. He believes the County should begin a risk management program. Liability insurance discussed. Supervisor Winston stated he does not want to leave the people of this County exposed to a large settlement. He asked if the County could ask Columbia Casualty and get a six-month coverage until this thing gets resolved. Suggestion discussed. A Negative Declaration Regarding Environmental Impact was filed with the County Clerk on August lfi, 1976, finding the proposal is in conformance with the zoning covering the property and uses in the area. AlI reasonable efforts should be made to protect Agriculture, not only for its economic advantages to the County, but, as an important and desirable use of. the land which establishes many of the values for urban areas. Agricultural land should he preserved against piecemeal urbanization which would tend to adversely effect the economic potentials of this important segment of the fiou_nty's base. Page 129. There•ia a need to appoint as alternate in case a member can not be present. It was suggested that the Board appoint an Alternate No. 1 and Alternate No. 2. Earl Nelson, Environmental Review Director, set out the proposed modification to the environmental review guidelines as it relates to the steps taken in an appeal.
