APPROPRIATES $13,102 OF UNANTICIPATED REVENUE (PROBATION TRAINING GRANT - SB 924) TO THE TRANSPORTATION AND TRAVEL ACCOUNT The public hearing on Budget transfer B-189 - Probation. Approp- riates $13,102 of unanticipated revenue (Probation Training Grant - SB 924) to the transportation and travel account was held as advertised. THIS TRANSFER APPROPRIATES $50,000 UNANTICIPATED REVENUE FOR THE COM1'IUNITY ACTION AGENCY WEATHERIZATION PROGR'~M AND ESTABLISHES VARIOUS LINE ITEM APPROPRIATIONS FOR THE PROGRAM OPERATION. FUNDING IS FROM THE STATE OFFICE OF ECONOMIC OPPORTUNITY The public hearing on Budget Transfer B-195 - Community 1lction Agency - Weatherization. This transfer appropriates $50,000 unanticipated revenue for the Community Action Agency Weatherization Program and establishes various line item appropriations for the program operation. Chairman Wheeler would report on a trip to discuss CalTrans and legislation regarding ground water. Supervisor Saraceni stated he would discuss the subdivison revisions. 696 697 AUTHORIZE DESTRUCTION OF RECORDS - AUDITOR'S OFFICE On motion of Supervisor Fulton, seconded by Supervisor Moseley and unanimously carried, the destruction of records in the Auditor's Office pursuant to Government Code Section 26201 for the following records which have been microfilmed: 1976-77 summary budget statement, 1976-77 transfers and 3ournals, 1976-77 fixed assets register, 1976-77 detail revenue ledger, 1977 Public Works road maintenance time cards and 1977 payroll records was authorized. DIAIN, INC., DBA SECURITt TRANSPORT Mike Pyeatt, interim administrative officer, stated this was an amendment to the present contract. It comes through on an annual basis. ', It provides for a change from mileage fee to zone fee. The 100 miles increase is $4. There are some minor pay increases related to this contract. Supervisor Fulton questioned if the $1,081 which is 5 percent was Hough for the administrative costs. James McNaughton, executive director of Community Action Agency, Mated if the CAA did not have other resourses the grant amount would not be anough for the administrative costs. He did not want to dater the Board from requesting more for the costs, but he had not been successful in the past. They do not make money on it. APPROVE CONTRACT CHANGE ORDER NO. 9 -- TABLE MOUNTAIN BOULEVARD BRIDGE, PROJECT N0. 28491-76-I On motion of Supervisor Moseley, seconded by Supervisor Saraceni and unanimously carried, Contract Change Order No. 9 for the Table Mountain Boulevard Bridge, Project No. 28491-76-1 in the increasing amount of $1,445.72 to provide for placing additional reinforcing steel in abutment diaphragm corners and in stem walls around prestressing ducts was approved and the Chairman authorized to sign. April 20', 1982 8 2-, 708 709 710 711 71z April 20, 1982 23511-79-1, from District Center Drive to 350 feet west of Foothill Boulevard, in the amount of $84,727 from Robinson Construction Company, Inc. of Oroville, California was awarded; the low bid on Skyway pavement overlay, Project No. 51261-82-1, from 2.4 miles. east of Oakridge Drive to Paradise, in the amount of $145,530 from Butte Creek Construction Company of Chico, California was awarded. ADOPT RESOLUTION 82-65 - DRAINAGE FEES IN CHICO VECINO AREA Clay Castleberry, public works director, set out the background on the drainage fees in the Chico Vecino area .• A drainage plan has been approved and this is the drainage fee resolution being proposed. People have been notified for four parcel splits. The fees are expensive they are $6,000 and $8,000 per acre. This will not be used for any existing homes or parcels unless they are divided. The area is flat and some district from the drainage creek. On motion of Supervisor Dolan, seconded by Supervisor Fulton and unanimously carried, Resolution 82-65 adopting the drainage fees for the Chico Vecino area pursuant to Chapter 20 of the Butte County Code was adopted and the Chairman authorized to sign. PUBLIC WORKS DTRECTOR TO BRING BACK RESOLUTION ON ADOPTING DRAINAGE FEES IN THERMALITO AREA AFTER MAY 7, 1982 Clay Castleberry, public works director, stated he and Ron Graves had agreed to give further information on the proposed drainage fees in the Thermalito area. It is for capital out lay costs. The drainage plan was approved last year with no specific resolution. It does not apply to existing homes. It will apply to subdivisions. The cost would be from $2,000 to $450 per acre for new four parcel splits. He felt the plan was correct. The community asked for it. He did not want any misunderstandings. If more than three or people in the audience had questions, he would suggest continuing adopting the resolution and holding a community meeting. The Public Works Director to bring the matter back after the May 7, 1982 community hearing for adoption of the proposed resolution. DISCUSSTON: RESOURCE CONSERVATION WEEK Clay Castleberry, public works director, reported on Resource Conservation Week at this time. There will be assistance from Butte Environ- mental Council of Chico, Butte College students and Oroville Solid Waste Company. There were funds provided to the Oroville area for litter and cleanup. He will be submitting a signed contract with the State Solid Waste in a few days. PUBLIC WORKS DIRECTOR TO PLACE ON APRIL 27, 1982 AGENDA REVISION TO SUBDIVISION IMPROVEMENT STANDARDS Clay Castleberry, public works director, stated the Subdivision Review Committee would meet next week. The Revision to Subdivision Improvement Standards is scheduled for May 4, 1982. There were a few small changes submitted last week. Mr. Castleberry stated he would place the matter on the April 27, 1982 agenda for consideration. DISCUSSION: MEETING HELD WITH CALTRANS OFFICIALS Clay Castleberry, public works director, discussed the meeting held with CalTrans officials and the Commission. They will retain the county min- imums for not four years, but five years. They can do it without additional funds. The visit was a success because they felt the county minimums was a necessity. The 70 percent should stay within the county. They plan to attend the hearing in San Francisco on May 26, 1982 on specific projects. There is a Page 435. He would suggest there be representatives at the San Francisco hearing from the Board and Gridley. Mr. Castleberry stated they have letters to send to the Tran- sportation Commission. PUBLIC HEARING DATE SET A public hearing date was set for May Z1,-1982 at 10:00 a.m. £or consideration of the proposed negative declaration regarding environ- mental impact and rezone from "TM-40" (timber mountain 40 acre parcels) to "TM-10"and "TM-20" (timber mountain - 10 and 20 acre parcels), ,property located at the west side of Doe Mill Ridge Road, approximately five miles south of Highway 32 via Schott Road, identified as AP 63-02-70, northeast of Chico for Scott and Bridget Rutherford. PUBLIC HEARING DATE SET A public hearing date was set for May 11, 1982 at 10:15 a.m. for consideration of a rezone (item determined to be categorically exempt from environmental review) from "A-R" (agricultural-residential) to "AR-MH" (agricultural residential- mobile home), property located on the south side of Oroville Bangor Highway, approximately 1,800 feet east of Lower Wyandotte Road, identified as AP 36-113-054, two miles southeast of Oroville for Stanton Marsh. PUBLIC HEARING DATE SET A public hearing date was set fox May 11, 1982 at 1:30 p.m. for consideration of the Gridley-Biggs area rezone (item on which the environmental impact report has previously been certified) in order to bring the zoning into consistency with the adopted General Plan for that area as required by state law; the area under consideration contains approximately 42 square miles of publicly and privately owned unincorporated land bounded generally by Highway 162 on the north, the Feather River on the east, the Butte County line on the south, and a line extending south from the Richvale-South Highway on the west, and including the unincorporated areas surrounding Gridley and Biggs for the Butte County Planning Commission. APPROVE CONVEYANCE OF DEVELOPMENT RIGHTS AND OPEN AREA EASEMENT - EVELYN M. HOLLANDSWORTH ' On motion of Supervisor Saraceni, seconded by Supervisor Moseley and unanimously carried, the conveyance of development rights and open area easement for Evelyn M. Hollandsworth to comply with conditions of approval on a use permit was approved and the Chairman authorized to sign. CONSIDERATION OF AN INTERIM "AR-t4H" (AGRICULTURAL RESIDENTIAL - MOBILE HOME) ZONE TN THE THERMALITO AREA WAS WITHDR°~WN Bettye Kircher, planning director, stated the request for an interim "AR-MH" (agricultural residential - mobile home) zone in the Thermalito area has- been withdrawn. DISCUSSION: CONSIDERATION OF ROBERT SHEPHARD EXTENSION OF INTERIM C-2 WHICH EXPIRES MAY 22, 1982 AND ALL PERMITS ARE FINAL Bettye Kircher, planning director, stated there was no reason to extend the Robert Sheppard Interim C-2 which expires May 22, 1982 and all permits are final. The development has been completed as permits were issued. It will be a commercial area. No action was taken at this time. REPORT TO THE BOARD ON POPULATION - CONTINUE TO MAY 4, 1982 - PLANNING The report to the Board on population was continued to May 4, 1982 at the request of Planning'p~rector Bettye Kircher. REPORT ON THE RESOURCE CONSERVATION DISTRICT AND SOILS WORKSHOP HELD APRIL 13TH There was a report on the Resource Conservation District and Soils Workhop held April 13, 1982 at this time. Steve Streeter, planning department, stated the Board had a memo regarding the meeting. There was 50 to 60 people in attendance. There was discussion on updating the soils maps. It would be handled through a Resource Conservation District. They would not be real-active or collect taxes. The Tehema County district earns money through renting equipment to orchardists or farmers. The soils map for Chico and Oroville are from 1929 and are not accurate. There is work done through the Department of Forestry in taking soil tests and checking them through maps at University of California-Aavis. There are 3500 acres which need to be updated. He has a lot of data which includes cassette tapes on resource conservation districts. They will be forwarding information to the Board in the next two weeks. Supervisor Dolan stated there has been a lot of focus with the Planning Commission to update the soil maps and district. There are a variety of services that could be provided by local farmers. It is not limited to soils maps. Mr. Streeter stated they ware not asking the Board for funds. They are asking that it be put on the ballot in June or November. Most of the work was accomplished on his own time. ADDITIONAL MATTER BY PLANNING DIRECTOR Planning Director Bettye Kircher reminded the Board of the Special Study Session on specific planning to be held Thursday, April 22, 1982 at 7:30 p.m. in the Board Room. REPORT FROM COUNTY COUNSEL ON MANFRED SCHIDECK REQUEST TO CLEAR TITLE ON AP 28-17-64 A report from County Counsel relative to the request of Manfred Schideck to clear title on AP 28-17-64 was held as continued. Del Siemsen, county counsel, stated his proposal was presented to the Board last week. His proposal was to place a note one each map and increase the interest rate. On motion of Supervisor Saraceni, seconded by Supervisor Moseley and unanimously carried, that each parcel map that is existing on AP 28-17-64 owned by Manfred Schideck be segregated into four lots and to bear the interest rate of 9 percent was approved and the Chairman authorized to sign. APPOINTMENT TO AREA II DEVELOPMENT DISABILITIES BOARD On motion of Supervisor Nloseley, seconded 6y Supervisor Saraceni and unanimously carried, the appointment of Mrs. Linda Halbert to the Area II Developmental Disabilities Board was approved. IDERATION OF ANIMAL CONTROL AND HEALTH SERVICES LETTER REQUESTING USER INCREASES FOR ANIMAL CONTROL - CONTINUE TO APRIL 27, 1982 Continued to April 27, 1982 Consideration of Animal Control and th Services letter requesting user fee increases for animal control to w further study by the Board and the committee to meet. ANCES: HENRY MC CALL Henry McCall, Oroville, spoke regarding a newspaper article 3iving information Supervisor Saraceni had stated in a Board meeting regarding haying taxes within the city and county. He set out the^various budget amounts for a number of years and amount of taxes received. - Chairman wheeler suggested P1r. McCall and Supervisor Saraceni sit down and discuss the matter. APPEARANCES: BILL HOUSTON Bill Houston, Oroville, spoke regarding his feelings on County Counsel. He has the history of his medical. reports. He has not received any money from the county for his injuries. RECESS: 11:08 a.m. , RECONVENE: 11:1$ a.m. APPEARANCES: RUSSELL CRONINGER Russell Croninger, Ringel and Associates, representing Eastwood Oaks, stated they were ready to record the final map. 1n the SUDAD area the fees have been paid. They must go 300 feet to SUDAD. In the original plans some of the easements were picked up by the county and others were not. He has a problem with 3,600 foot easement. He knows the county has condemnation rights which can be used. He does not know which way to go. He has discussed the problem with County Counsel and Public Works. it is the Tom Polk and Lassen Avenues area. They have to get the easement across this property. He did not want the Board to go back to the party and say they had to do it. He does want to finalize the project. Chairman Wheeler suggested the matter be held one week in order for the Board to receive all of the information. ADOPT RESOLUTION 82-66 RECOMMENDING THE DEER HUNTING SEASON TO FISH AND GAME Vitto Quonterro, 898 West 8th Avenue, requested a letter or resolution be sent to the State Fish and Game for District 2 F recommending the deer season. The Fish and Game Commission was to forward a proposal to the Board. The meeting before the state is April 30, 1982. season. Chairman Wheeler stated there are those against the shortened Dan Heil stated he was in support of Mr. Quonterro. They represent the hunters from Chico and Paradise. On motion of Supervisor Saraceni, seconded by .Supervisor Fulton and unanimously carried, Resolution 82-66 recommending to the State Fish and Game that the deer season in D2F be held from September 25, 1982 through November 7, 1982 was adopted and the Chairman authorized to sign. APPEARANCES: RON GRAVES Ron Graves, Oroville, stated he was a resident of the Thermalito area. The drainage plan discussed earlier has been adopted by the Board. People on fixed incomes will not be effected.- Fees are not paid in both the city and county. He urged the Board to support the proposal by Public Works. APPROVE SUPPORTING WORK SHOP ON AGING PROBLEMS AND DELAYED SERVICES TO THE SENIORS Archie McDonald, Magalia, spoke regarding the Area Agency on Aging. There is a proposal under AB 2860 for long term care which would modify the existing organization of care. Supervisor Johnson had just attended the CSAC meeting. PURVIS ~ ', David L. Purvis, Kelly Ridge Volunteer Fire Department Chief, presented a letter to the Board with reference to proposed budget cuts in the fire department. Mr. Purvis read the letter into the record. SUPERVISOR MOSELEY ABSENT AT THIS TIME 732 APPEARANCE: ROBERT ADAMS Robert Adams, Plumas Avenue, spoke regarding dog problems in his ** area. The Animal Control officers will not come out at night. When calling regarding problems he was told to identify the dog, give them the owner and then they would contact the dog owner. SUPERVTSOR MOSELEY PRESENT AT THIS TIME 733 PRESENTATION TO THE BOARD OF SUPERVISORS CONCERNING THE -0PERATION OF THE BUTTE COUNTY HOUSING AUTHORITY ', Presentation to the Board of Supervisors concerning the operation of the Butte County Housing Authority held at this time. ', John Bowling, executive director, stated the purpose of the meeting was to tell them about the Housing Authority as many people do not know what they do. He would speak to the future of the Housing Authority. The Housing Authority is a public corporation. In 1946 the Board first formed the organization. There were five individuals appointed who became the ', Board of Commissioners. He had presented a chart to the Board. They have authority to operate within each city. Mr. Bowling set out the rights. They must abide by local planning unless they are exempt from State and Federal taxes. The amount of rent they receive is close to the taxes on the property. At present there are 131 units for farm labor housing; 170 units for low incoming; 627 units under Section 8 existing; 80 units ', under Section 6 modern rehab; and 19 units in after care program. ', Gary Sanner, Housing Authority, discussed the low income housing. They make sure the people will pay the rent and take care of the unit. When ', there are problems they take care of them in a timely manner. Some people have moved on to purchasing homes. Many are disabled or elderly. Most units are cement block. They presently do additional insulation in the attics. Mr. Bowling spoke regarding the underdeveloped area in Chico and Oroville. They have a operating budget of $10,600,000. The budgets cannot be intermingled. They have purchased property and are building a new office ', building. They will be able to place 50 units fox the elderly on the 7,000 square feet of property. They are really not sure where they are going. Chairman Wheeler stated Mr. Bowling had served well as the executive director. She felt there was going to be cuts in the future. It is time to have a coordinated effort. There are two other programs ', involved in rehabilitation programs. There is CHIP and self help program. To coordinate would cut at the administrative level. ', Mr. Bowling agreed the future will call for that type of effort ', and the public agencies must get together with those in private. They have 40 years of additional obligations to HUD. Page 439. ADOPT RESOLUTION 82-67 TN APPRECIATION TO GENE MERCER, SECRETARY OF FISH AND GAME COMMISSION Mike Pyeatt, interim administrative officer, stated Mr. Mercer is willing to continue serving as secretary to the Fish and Game Commission unil a replacement could be appointed. Mr. Mercer has served far 14 years. Mr. Mercer is not a member of the Commission, he did the leg work and provided support. Supervisor Saraceni felt the position should be posted and see who would apply. Mr. Pyeatt stated it was possible Mr. Mercer had become frustrated as he was a retired game warden. Some of his philosophys were different. He had put in a lot of noncompensated time in. Supervisor Saraceni stated copies of the last Fish and Game Commission meeting minutes would be distributed to the Board. On motion of Supervisor Moseley, seconded by Supervisor Saraceni and unanimously carried, Resolution 82-67 in appreciation of the 14 years of service as the secretary of the Fish and Game Commission for Gene Mercer was adopted and the Chairman authorized to sign. PUBLIC HEARING DATE SET FOR MAY 4, 1982 AT 7:36 P.M. FOR BOARD OF SUPERVISOR CONSIDERATION AND REVIEW OF SENATE BILL 1923 (GROUND WATER) Discussion was held regarding the communication from Superior California Water Association on Sentate Bill 1923. Chairman Wheeler stated they are going to review SB 1923. She will attend the meeting in Willows with County Counsel. Counties are to review Senator Johnson's bill and comment. Many feel there should be an amendment to speak more of needs and protection of the ground water management. The local Farm Bureau will address the issue April 29th. If they are to get the bill through legislation this session, it must be in by May 5, 1982. It has been suggested they hold a public hearing_ People are not comfortable with the language. She felt it would be"wise to send a notice of the public hearing to all water districts in Butte County. The meeting with the Farm Bureau will be April 29, 1982 at 7:30 a.m. at Lyons Restaurant in Chico. A public hearing date was set for May 4, 1982 at 7:30 p.m. for public input to Senate Bill 1923. REJECT CLAIM - LYDTA CHRISTINE VANDERLAAN On motion of Supervisor Moseley, seconded by Supervisor Saraceni and unanimously carried, the claim submitted by Lydia Christine Vanderlaan in the amount of 550,000 as a result of alleged damages sustained in an accident occurring February 15, 1982 as a result of a collision with a transit bus was rejected and referred to County Counsel and Risk Management Coord- inator. A lot of work was done by Michael Shover and Richard AeGarmo to get Amtrak through the west side. Supervisor Moseley stated she would like the telephones in her office at Administration Center removed. She does not use it. Chairman Wheeler announced that on April 22, 1982 at 7:00 p.m. in the Personnel Training Room the Air Pollution Task Force fee schedule meeting would be held. Supervisor Fulton stated he would like to see no smoking rule enforced in the Board Room. He did not want to make a motion. Chairman Wheeler announced Butte County OEDP has been contacting industrial people in Yuba, Placer and Sutter Counties. The meeting would be Thursday, May G, 1982 at 7:30 p.m. A letter was received from Dr. Raitt for review. Chairman Wheeler announced the new address for Supervisor Fulton which is Brawer QQ in Paradise. Chairman Wheeler announced Butte County Farm Bureau and State Office of Planning and Research were to hold a research planning convension at California State University, Chico on April 23. 1982 at 8:30 a.m. Supervisor Saraceni stated he received a communication item from Bi11 Sands on alternate work schedules.
