Laskey, Redwood City. Mr. Laskey's request for postponement d ~,$-Q of the hearing set for 2 p.m, on this date as he has not as yet received information requested from the Assessor's office. The City files Resolution No. 143 which sets forth the ,~ ~ D d ~ finding that there exists unmet public transportation needs which should be met through an expansion of existing system or establishment of a new system. The County files its Resolution No. 188-74 requesting the State Legislature to adopt legislation requiring ~ ~ p,p ~ the State Forester to utilize all personnel, buildings and equipment under his jurisdiction fully and completely throughout the year. The Chairman of the Board of Yuba County solicits information on possible needs by Butte County of a juvenile 4 ~ D~a ~ honor farm for juvenile court ward commitments, both boys and girls, and whether Butte County might be interested in participating in such a joint project. Referred to Administrative Officer and Don Nissen to study and report back to the Board. State Department of Parks and Recreation. To be placed in the file. 74-600 REJECT CLAIM OF BILL EPPERSON On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the claim of Bill Epperson in the amount of $10,000 was rejected and referred to County Counsel. 74-601 COMMUNITY ACTION AGENCY GOVERNING BOARD MATTERS Proposed Child Care Services. Mr. Berryman, Chairman of the Administering Board of the Community Action Agency, reported on the proposed child care services program. He said the Administering Board had approved this program, with a proposed budget of $50,014. Supervisor Gilman stated his concerning about the Board opting out of this program on June 30th. He feels that the Board should have some direction of the program so that it will be funded by a CAA outside this Board. Mr. Berryman told him that most of the proposals are being written with the understanding that the budgets may be cut to a two month period. Mro Berryman said that all they were requesting is for Board approval so that the proposal can be submitted to the San Francisco O.E.O. office. Discussed; no action taken, Page 438. April 23, 1974 _ _ _ _ _ ~ _ April 23,T1974 discussed. for a Community Gardens Proiect and Chico ty Gardens Project On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the proposal for a community Gardens Project was approved for submitting to the San Francisco, Ca13f., O.E.O. office, No action was taken on the Chico Area Legal Services proposal for a consumer advocate. Travel and miles a allowance. Travel and mileage allowance request explained by Mr. Berryman. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the request for travel and mileage allowance was authorized at the rate of 12~ per mile for authorized EOC personnel. Designation of an lnterim Director Mr. Berryman reported that the administering board of the Community Action Agency met last evening and they would like to ask that the Board approve the appointment of Nadeen• West as interim director on apart-time basis. Request explained. On motion of Supervisor Gilman, seconded by Supervisor Cameron and carried, the Board approved the appointment of Nadeen West as interim director, on a part~time basis. Housing proposal Mr. Berryman said he was not well enough informed on the proposal to speak on it; he introduced Mr. Nate White and requested that he explain the proposal. Mr. White explained the housing proposal, a proposal to upgrade the housing in the Oroville area. He said there was existing sub-standard housing in the Oroville area and explained how this proposal would help upgrade the area. He stated that the cost of the program for the two month period would be $3700. The money would be used for staff only. Mr. White explained the responsibility of the property owners to the tenants. Under this program, the staff would also assist the tenants in keeping the repairs up on the houses. He feels that this is a worth while project, He said there were people.•in the area that could be trained to work on the program. Positions for this program set out and discussed. Mr. Castleberry said his department would be happy to work with this program. Mr. Castleberry said that once his department has been put on notice of any violation, if the violation is not solved, then his department would have to condemn the house. On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the housing proposal was approved to send to O.E.O. for a two month program in the amount of $3700.00. Contract for auditing and financial counseling serviceso Mr. Berryman explained the contract for auditing and financial Page x+39. April 23, 1974 April 23, 1974 counseling services. They are merely asking authorization for the Chairman to sign this contract for the annual audit. On motion of Supervisor Cameron, seconded by Supervisor Ladd G L r~ O G and carried, the Chairman was authorized to sign the contract for r auditing and financial counseling services. Proposed Child Care Services pro~ram.^ Matt Jackson, Coordinator of Student Activities at Butte College, spoke on the request for revenue sharing funds for the proposed child care services program. He said he has been working on this matter with students of the college. They have requested that the EOC, inc. act as counsel for this~program, and are requesting the Board to give consideration of giving them revenue sharing funds to help operate the program. They would not be taking any money from EOC or Head Start to operate this service. No action needed at this time; request to be discussed after the deadline of April 30th, for the filing of requests for revenue sharing funds. RECESS: 10:15 RECONVENED: 10:25 74-602 CHAIRMAN AUTHORIZED TO SIGN APPLICATION FOR GRANT FOR FUNDING FROM CALIFORNIA REGIONAL MEDICAL PROGRAM Dr. Enloe spoke to thel~oard concerning application for grant for funding £rom the California Regional Medical Program and requested approval of an application for funding a local medical access project. He said the program could be ecarted on July Ist. He explained the program that is proposed. On motion of Supervisor Gilman, seconded by Supervisor Cameron and carried, the Chairman was authorized to sign the application for grant for funding from the California Regional Medical Program ltd the application for funding a local medical access pro~ecto 74-603 WATVE FIRST READING OF SALARY ORDINANCE AMENDMENT Salary ordinance amendment discussed. It was suggested that the reclassification of a physicia. position be held off at this time. Transition of PEP positions set out and discussed. Section 50 of Ordinance No. 1284, the salary ordinance, was atn~nded by adding thereto one sanitarian or sanitarian trainee position, changing the number of positions from 47 to 48. On motion of Supervisor Gilman, seconded by Supervisor Ladd and Harried, the first reading of the salary ordinance amendment was waived, with the changes as suggested. 74-604 FEDERAL WAGE AND HOUR LAW: AUTHORIZE MORATORIUM ON ALL COUNTY EMPLOYEES OVERTIME IN E%CESS OF 40"HOURS PER WEEK Jim Rackerby, Per sonnet Director, reported on the Federal wage and hour law. The new federal minimum wage law will apply to the County. This law establishes a $2.00 minimum wage and also requires time and one-half pay for non-exempt employees working over 40 hours per week. The details and the effective date of the law are not clear. The law is Page 440. April 23, 1974 ____ ___ ____Apri12311974_____________ currently being reviewed to determine the total impact on the County, Ns. Rackerby felt there was some concern in this mater and suggested that the County Board of Supervisors consider a moratorium on overtime until they- see the effect this will have on the County. They are looking at the exempt list of employees and trying to determine if it can be expanded. Recommendation of Mr. Rackerby discussed. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the Board authorized, effective;3~day 1, 1974, a moratorim on all County employees overtime in excess of 40 hours per week until the impact of the new law is determined and the County'°ruies can be amended; authorized overtime in excess of ~a0 hours per week only when a department head can justify a serious emergency exists and indicate the intent of the County to pay the applicable federal overtime rata in such instances; and authorized the Chairman to sign the modifications to the NYC contracts raising the salary hourly rate to $2.00 per hour. Mr. Nickelson stated that there would be a department head meeting held soon and they can discuss the pglicy of overtime. 74-605 AWARD OF BID ON STREET SWEEPER The only bidder for the street sweeper was the Nixon-Egli Equipment Company of Hayward at $22,609.80 including tax. There was a no-bid received from another supplier who could not bid competively for this equipment based on specifications. In checking with another purchasor of this equipment within the last year the price is competive. On motion of Supervi sor Gilman, seconded by SupervisorCameron and carried, the bid of Nixon-Egli Equipment Company in the amount of $22,609.80 was accepted for the street sweeper. 74-606 AWARD OF BTD-TIRES AND TUBES Nr. Nickelson reported that the only bids received for tires and tubes were from present suppliers in the two service areas of Oroville and Chico. Prices ~qre 12 to 15 per cent higher than last year, and several other vendors declined to bid because they did not feel that they could meet the bid commitments. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, bid for furnishing of tires, tubes and recapping service for the period May 1, 1974 to April 30, 1975 were awarded as follows: 1. Townsend Tire and Wheel in Oroville 2. C and L Tire Company in Chico 74-607 GOLDEN FEATHER FAIR ITEMS APPROVED ~ On motion of Supervisor Ladd, seconded by Supervisor Gilman -7 l3 ,a and carried, the following Feather Fair items were approved: 1. Approved billing for bid advertising in the amount of $97.50 for the Golden Feather Fair restroom project. 2. Approved Golden Feather-Fair Transfer 74-2 in the amount of $3,183.50 from the unbudgeted reserve to the capital expenditures account to cover the bid overage on the restroom project and other additional expenses for engineering and bid advertising. April 23, 1974 ---------====April 232 1974= = = = = =~==W =__ 3o Approved agreement with Deakins Construction Company for Golden Feather Fair restroom facilities project in the amount of $21,753.00 and authorized the Cha~.rman to sign. 74-608 APPROVE FISH AND GAME BUDGET REQUEST Gene Mercer, secretary of the Fish and Game Commission, forwards request from the Department of Fish and Game for an allocation of funds in the amount of $700 for trout tagging to study trout in Paradise, DeSabla and Philbrook area, and $500 for further tagging studies in Lake Oroville. The total $1,200 would come from the $3,000 budgeted for deer range improvement which will not be spent, Request discussed. On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, disbursement of $1,200 to Department of Fish and Game from Fish and Game budget, was authorized, with $700 to be used for tagging in the Paradise, DeSabla and Phillbrook area, and $500 to be used on Lake Oroville. 74-609 APPROVE TRANSFER OF HOSPITAL PERSONNEL PLANT OPERATORS AND GROUNDSMEN On motion of Supervisor Ladd, seconded by Supervisor Cameron and carried, transfer of hospital personnel (plant operators and groundsmen) under administrative control of Public Works-Building and Grounds Maintenance was approved. 74-610 REPORT: REMODELING ACTIVITIES Clif Nickelson, Administrative Officer, reported on the remodeling activities at the ald hospital. He said the Narcotics Intelligence Unit was about ready to move into the old Mental Health quarters at the hospital. The facilities for Farm and Home Advisor will take a little wore time in order to complete the rooms for them. With the transfer of the hospital maintenance people, the County will be able to do this work with their own personnel. Mr. Castleberry reported on the air conditioner and heating system for the hospital. He hoped that they would be able to bring back for Board consideration a consultant contract to properly heat and cool the hospital building. The plan that they are preparing will not need boiler tenders, as they did not think the boiler system was practical for an office building. Discussed; no action taken. ~;. Mr. Castleberry stated that the moves to the hospital building could be made by July 1st. Mr. Mitchell, Farm Advisor, could move on his July 1st schedule. 74-611 APPROVE TRANSFER OF RESPONSIBILITY FOR REMAINING HOSPITAL FUNCTIONS TO HEALTH AGENCY Mr. Nickelson said it is proposed that the administrative function of the final phase-out at the hospital be placed under Dr. Enloe, as it should properly be, as he is the person responsible for Health Care functions. Matter discussed. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, transfer of responsibility for remaining Hospital functions to Health Agency was approved. 74-612 BUDGET TRANSFERS APPROVED Proposed budget transfers discussed. On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the following budget transfers were approved: B-111 Biggs Justice Court - $100 from salaries and wages regular to transportation and travel B-112 Local Agency Formation Commission - $610 from the reserve, with $230 going to publications and legal notices and $380 to Board authorized trips. B-113 Animal Control - $2,700 from the reserve to professional and special services account. B-115 Superintendent of Schools - $500 from communications to office expense B-116 Assessor - $500 to Board authorized trips witty $300 coming from office expense and $250 from professional and specialized services B-117 Recorder - $42.94 £rom office expense to equipment maintenance B-118 Library-$70p from the reserve to maintenance of equipment B-119 Public Works - $1,200 to transportation and travel with $700 coming from communications, $100 from special departmental expense and $400 from Board authorized trips B-120 Building and Subdivision - $1,500 from the equipment account to transportation and travel account B-121 Oroville Justice Court - y1,930 from jury and witness expense with $i,b80 going to extra help and $250 to office expense B-122 Assessor - $5,000 from the reserve to Assessor's professional and specialized services account to cover counsel for Equalization Litigation 74-613 ACCEPT DEPE.RTMENT OF WATER RESOURCES EASEMENT DEED F~~R RE-ESTABLISHMENT OF RABE ROAD RIGHT OF WAY Clay Castleberry, Director of Public Works, reported that prior to construction of Thermalito Afterbay by Department of Water Resources, portion of Rabe Road was abandoned by County of Butte. The County now finds a parcel landlocked. Dept. of Water Resources has prepared a directors easement deed to County of Butte to re-establish Rabe Road right-of-way westerly from Wilbur Road to provide access to landlocked parcel. On motion of Supervisor Ladd, seconded by Supervisor Gilman and carried, Department of Water Resources director's easement deed to County of Butte was accepted and the Chairman was authorized to sign the certificate of acceptance. 74-bI4 AUTiiORIZE RELEASE OF DUPLICATE TNSPECTTON FEES (PARADISE PINES A.D. ~k12, I3, 14) AND-APPROVE AGREEMENTS FOR SALE SKYWAY & DOS RIOS LARKIN ROAD PRO. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the following action was taken: 1. Worth Bayles 2.570 ac. $2,570 " " $2,570 16391-69-1 of ux 74-615 WADE FIRST READING ORDINANCE AMENDMENT RE ARTICLE IR, SECTION 14-15 of BUTTE COUNTY CODE (COVERING MOTOR VEHICLES IN LINDO CHANNEL) Proposed ordinance amendment regarding Article IX, Section 14-15 of the Butte County Code, covering motor vehicles in Lindo Channel discussed, Clay Castleberry, Public Works Director, requested that the County vehicles be exempt, for maintenance use only. Request discussed. It was felt that the following should be inserted within the Ordinance: "any vehtaes not authorized by the County." On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, the first reading of the ordinance amendment regarding Article IX, Section 14-15 of theSutte County Code (covering motor vehicles in Lindo Channel) was waived, with the inclusion to be inserted within the ordinance: "any vehicles not authorized by the County." 74-616 AUTHORIZE POSTPONEMENT OF BID OPENING FOR PUBLIC WORKS/PLANNING JOB Gene McFarren, architect, has requested that the Public Works/ Planning job bid opening scheduled £or May 3 be postponed until May Z0. Request diacussed. On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, postponement of bid opening for Public Works/Planning job to May 10, 1974 was authorized. 74-6 i7 INFORMATION AND DISCUSSION ITEMS (a) One-foot strip crossing -Forest Ranch area (Nopel Avenue), taken off agenda at this time. (b) Hospital heating and air con~itioning report. Mr. Castleberry will have a report and a proposed agreement back to the Board at a Inter date. (c} Personnel request - Building and ,Subdivision inspection. Mr. Castleberry reported on this request, stating that they have one hundred building permits that they are in the process of working on. He has been authorizing overtime of two people to get this processing work out. He explained the matter of the great backlogs in this work. The permits are up 30-40% over last year. He requested Board authorization to have Personnel Department prepare an ordinance allowing additional personnel for this department. Mr. Rackerby explained .the matter of overtime for this work. He also stated that there are some vacancies in the PEP program. He said there were some junior engineer aides that he felt could be hired out of the Federal funds provided for these positions. He suggested that instead of clerks to do the office work, that Mr. Castleberry fill the positions with these aides that could do clerical work and who would be able to work in the field. He said that in this way the Page 444. April 23, 1974 County could train their own building inspectors. Suggestion of '4r. Rackerby discussed. Mr. Castleberry stated that the plan checker was the most critical of the needs at this time. Supervisor Cameron felt the Board should go along with the suggestion of using the PEP positions. Mr. Nickelson set forth another aspect of this operation. Financing of this Department is really financing two ogerations. One part is subdivision and one part is building. The Board has not been receiving any reports on which side is bringing in the money and which side is costing the County money. He feels that these two funds should be split and in that way the Board could determine which one is making money. 'Bill Lawrence, County Auditor, stated that they propose to separate the two operation accounts. In the new budget, there will be twn separate budgets for these operations. On motion of Supervisor Cameron, seconded by Supervisor Ladd and carried, Mr. Rackerby was requested to prepare an ordinance, amending the salary ordinance, to provide for a plan checker and funding for three PEP positions with the Building Department, and purchases requested were authorized, to be paid for out of the Building Trust Fund. (d) Ordinance relating to urban improvements for commercial and multi-family buildings in urban areas. Mr. Castleberry requested that this item be taken off the agenda for the time being. 74-618 AUTHORIZE LETTER TO BE WRITTEN 1NDICATING THAT CARPS OF ENGINEERS SHOULD RE-DO SOME OF WORK DONE LAST YEAR ,Z O ~ Mr. Castleberry requested authorization to have a letter written 1 '~ requesting that the Corp of Engineers come back to theCounty and do some work on the River Road, which had been done last year. Request discussed. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the Board authorized a letter to be written indicating to the Corp of Engineers that perhaps they should re-do some of the work that they had done last year. 74-619 APPROVE DEVELOPER'S :REQUEST TO DO EMBANKMENT WORK ALONG LINDO CHANNEL Mr. Castleberry stated that the developer of Longfellow Terrace No. 25 has asked if he could do some work within some of the County property along Lindo Channel. The State Reclamation Board and the City of Chico has approved this work being done. Mr. Castleberry felt that the embankment work along the Channel should be approved, and he hoped that the Board would concur. Request discussed, This man was going to take material from his property to widen out the embankment. On motion of Supervisor Ladd, seconded by Supervisor Gilman and carried, the Board approved the developer doing some embankment work on County property along the Lindo Channel, subject Co any requirements of the city of Chico, and Mr. Castleberry was authorized Co work with the City of Chico on any requirements that they might impose, 74-620 CHAIRMAN AUTHORIZED TO SIGN LETTER OF INTENT AND PAYMENT AUTHORIZATION FORM: p COUNTY SERVICE AREA-N0. 26 - ~ 3 O-D Bill Spruance, attorney fbr:Thermalito Irrigation District, spoke page 4[~.5~ April 23, 1974 April 23, I974 to the Board regarding the FHA Loan applications for County Service Area No. 26, and presented letter of intent Co meeC conditio ns as outlined in letter of conditions dated April I8, 1474. He also presented payment authorization form for signature by Chairman of the Board on behalf of County Service Area No. 26. Mr. Spruance said Che bonds would have to be sold at a public auction, He said they have now received the assurances from FHA; FHA has requested Chat Chese documents be handled this week. The District is requesting at this time that the Chairman be authorized to sign these documents at this date. Bi11 Lawrence, County Auditor, stated that this applicaCion is for only one-half the amount that has been authorized for the bond sale. He said that before the loan agreement is consumated, he would like to take a good hard look at the agreement. On motion of Supervisor Ladd, seconded by SupervisorCameron and carried, the Chairman was authorized to sign the letter of intent to meet conditions and the payment authorization for Butte County Service Area ~~26. 74-6.21 APPEARANCE: REPRESE IVES OF PARADISE COUNCIL ON AGING~INC. / Mr. Edwin Rounds,representing the Paradise Council on Aging, V 2 ~~ ~ Inc., appeared to present the request of the "Meals on Wheels" program and request for revenue sharing funds. He said that one of the biggest problems of the aging is that of nutrition. He said that there has been federal legislation that has been enacted to help handle this problem. This bill provides for a feeding program for people over 60. In Paradise alone, there are 6,000 people over 60 years of age. He said his Council proposed a program that will attack this problem. The estimated budget set out; they will deliver one hot meal a day to the people that are referred to them that are physically handicapped and cannot provide their own meals. Program explained. The Chico Building & Loan will Iease a van and will give it to them for one year free of cost. The van will have to be fitted to meet the uses that are required, They need funds to get the program started. Chairman Ma:igan thanked them for their presentation and said their request for funds will be considered along with the other requests. .john Bishop, vice-president of the Senior Citizens, spoke on the matter of the requests. He said they were only asking for these funds to get them going; he explained how they would receive contributions from other organizations. 74-622 APPEARANCE OF LINDA JOHNSON: HOME HEALTH AGENCY PROGRAM Linda Johnson, Director of Community Home Hea7.Eh Services of Redding and Chico, presented the program being instituted in Butte County and surrounding counties. She explaia~d the type services that will be provided. She said this is similar to the program that had been operated by the Health Department previously. SOLONi).N LEE GABBER Mr. Solomon Lee Garber, appeared and stated that he has been active as a business consultant in the Chico area. He functioned here as a land development consultant in the past. He was appearing today in relation to the Skyway Assessment District matter. No action needed, 74-625 APPEARANCE: NOEL HIGHFILL Noel Highfill, Chico, appeared concerning the public defender contract. He feels that the Bo ~ d should put this contract up to public bid. The contract should be looked at and maybe there is a possibility that it could be let at a lesser figure. Dan Blackstock, County Counsel, stated he had argued the matter of this contract in the Court of Agpeals last September. No decision has been received in the case. Mr. Blackstock set out the background of this contract. At the present time, this contract is operating on a month-to- month. basis. It was stated that this matter had been placed out for bids. An attorney cannot bid on work; he can submit a proposal but not a bid. Mr. Highfill said he was then satisfied that this maCCer was being watched. 74-626 APPEARANCE: MRS. DORIS GOODSON OROVILLE MYS. Page 447. April 23, 1974 -----__ __---April 23s 1974 Chairman Madigan outlined the things which were to be discussed at the hearing; bids, drainage, curbs and gutters. Discussion of letter receiv ed regarding appeal of this district was held. Fverd McCain explained the need for the district. It will provide storm drains and gutter facilities for the Paradise district along the Skyway. The low bid was 7% higher than the overall estimate. Low bid $377,174.60 (A-C Construction - S&H Engineering) Frontage Assessment $ 4.83 per ft. Drained area Assessment $ 1,831.00 " acre Mr. McCain explained the procedures regarding construction, bonding, a billing, etc, in these matters. He stated that the first bills will probably be senC out in February of 1975. These will be senC out after the construction is completed. There were no questinns from theBoard members. Hearing opened to the public, Chairman Madigan emphasized iC should pertain to: drainage, curbs and gutters. Appearing: Solomon Garber, Iand developer, Paradise. He does not own property in the area yet, but is inspecting property and will be buying property shortly. He has several concerns. He has discussed these matters with many of the staff and has received benefit from these discussions. He stated he has not been able to determine whether there has been an analysis of the monetary benefits versus the cost. Supervisor Ladd stated that all indications are that the ridge will be cut off from using sewer systems. Supervisor Ladd also explained that the accidents justify building this road, Clay Castleberry explained that they have made judgment decisions and would be happy to hear any ideas. This project has been in the making £or 9 years. They have lived with the problem and feel they know more about it. Mr. Garber was concerned about the removal of 50 large Ponderosa Pine trees for additional parking space. He explained that he has been in contact with other cities where trees have been left near the roadway and also in the roadway islandso He feels that the trees can remain. He is prepared to do what is necessary to keep the trees there. He also doesn't agree with the EIIi. He feels it should be updated. Some discussion about the charter and how it applys in this situation was held. Mr. Garber stated that he feels that there are alternate methods that would be a lot cheaper than this new construction. He gave an alternate method of using existing streets. He was also concerned about the fact that the right of way was purchased before the project was approved, Robert Lempky, president of the Paradise Chamber~of Commerce, explained that the proposal presented by Mre Garber has been looked at but would not work. He is in favor of the project. Page 448. He: has no problem with drainage as he lives on higher ground. Mr. McCain explained that this man was on high ground so that his water ran down onto someone else. The parcels that drain to the facilities are the ones that will be assessed. He explained that there will be a detailed analysis of each individual parcel. Each parcel has to be double checked. Mr. Gustafson wanted to know how this project would effect the owner of the property on the corner of Neal Road. AlI that will be done is that it will be widened only. The intersection will not be changed. Hearing closed to the public and confined to the Board. Supervisor Cameron explained that he was concerned about the trees in the Paradise area. He spent a lot of time trying to determine if it couldn't be shifted, which was done in m~y~•cases to save some trees. He feels that they have made the attempt to save the trees. On motion of Supervisor Camem-, seconded by Supervisor Gilman and carried, the Board approved the following resolutions and authorized the Chairman to sign: Resolution 74-62 Ordering work, Skyway Assessment District No. 1 74-63 Award Of bid, " " " " Mr. Blackstock explained that it would be preferable that they discuss the bids at this time. He explained that the Low bidder had filled out the wrong portion of the bid form. The form was signed and the bidder had been in touch and agreed to the bid by telegram and later ~Sy lettero Mr.Blackstock received a letter from Baldwam Construction which protested any consideration of the lower bid. However, there is a provision that provides for waiving any irregularities in the bids. He feels it is appropriate to waive the irregularities of the bid and proceed and avard the bid. On motion of Supervisor Ladd, seconded by Supervisor Cameron and carried, the Board waived the irregularity in the bid on the Skyway construction and accepted the low bid. Clay Castleberry brought up the proposal prepared by their department for funding the project. He presented their alternatives. Discussion of an amendment to the contract concerning funds was held. Mr. Castleberry will have a proposal for funding next week. In the meantime, the money set aside for the Magalia Dam could be used for this project. Mr. Castleberry will discuss this with Supervisors Cameron and McKillop as this project is within their districts. The transfer of funding is to enable the construction company to proceed with the project. 74-629 PUBLIC HEARING: LASKEY ASSESSMENT PROTEST Ban Blackstock, County Counsel, reported that this will be resolved before the Assessment Appeals Board and can be taken off the calendar at this time. 74-630 WAIVE FIRST READING: ORDINANCE AMENDING CODE RE JUNK DEALERS' LICENSE Mr. Blackstock explained the ordinance amending code re junk dealers' licenses. April 23, 1974 _______====Apr=il 231 ~974W =___=__=_===_ On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, the Board waived the first reading of the ordinance amending county code regarding junk dealers' licensee, being Article 2 of Chapter 11. 74-631 PUBLIC HEARING: PHILIP LYDEN, CHICO-APPEAL, ENVIRONMENTAL IMPACT REPORT FOR WILLIAM LEE SIMS REZONE FROM "S-2" INTERIM TO "S-1" FOR AN AREA SOUTH OF SYCAMORE CREEK, CHICO The public hearing on the Philip Lyden, Chico, appeal of the draft environmental impact report for the William Lea Sims rezone from "S-2" (minimum-density Suburban-residential) interim to "S-1" (medium- density suburban-residential) for an area described as south of Sycamore Creek, east of Cohasset Rd., north of Lupin Rd. and the easterly prolongation of Lupin Rd., containing approximately 526 acres, Chico, was held as advertised. Jim Lawson, Planning Director, gave the background of this matter. The EIR was certified by the Commission and subsequently appealed. It is under an interim zone that will expire in June. This area had been considered under a previous proposal but-now they are considering a portion of the larger pareelo It is now zoned A-2 and the proposal is for S-1. The appeal was timely filed, Hearing opened to the public. Appearing: Philip Lyden, Chico, the appellent. He does not feel the EIR has followed the procedures mandated by the Code. He gave a few details to support his appeal and asked that the Board reject the EIR as inadequate or delay action until the EIR complies with requirements of the law. Mr. Lyden gave the Board members a copy of his presentation. Time spent discussing the specific objections as to where the EIR is inadequate. Mr. Lawson rebutted Mr. Lyden's objections. Mr. Lyden was concerned with the so-called "Fish Project" that is supposedly going to go in in this area. Mr. Lawson explained that there is no official plan or application on file which would require a more detailed EIR. Mr. Lawson said the EIR was written for a subject zoning application and they are not able to consider other zoning except that requested. He stated that the Chico City staff, the County General Plan and the area planning general plan agree on this zoning. There was a discussion of a list of 15 specific points Mr. Lyden had drawn up where he believed the EIR was incorrect. Mr. Lawson rebutted everyone of these. Mr. Lawson stated they have considered alternatives. They have not considered this a Bart of the Fish project because there is no application that has been brought in for review. The Planning Department is not able to review unofficial proposals. Appearance: Vernon Fish. He stated that the so-called "Fish Plan" is not a plan but a feasibility study. They made this to see if the S-2 zone would fit the property. If developed, they must go to sewers due to ground conditions. Page 450 . April 23, 1974 April 23, 1974 Everd McCain, in favor.
