77-837 DISCUSSION: MOUNTAIN REFUSE TRANSFER STATIONS, NEAL ROAD LANDFILL
OPERATIONS AND ORD RANCH AND ORO'VILLE TRANSFER STATIONS.
Mr. Clay Castleberry, Public Works Director, set out the
background of the discussion. Last year the Board authorized the mountain
trai~nfer stations to be open two days a week and to charge for dumping
of garbage. This~was done in an effort to take the mountain transfer
stations off the property tax. There have been many problems is this
area. The people are dumping garbage when no one is there to collect
the fees, the fences ere being torn down and the locks on the gates
have been lost. The four transfer stations being discussed are:
Lake Madrone, Concow, Sterling City and Butte Meadows. Melvin Morris
who is the contractor fox the transfer stations is 7tosiag money.
There are different options that the Board can consider.
One option would be to do nothing. Another option would be to go back
to paying Melvin Morrie for hauling the loads and subsidizing those
out of the property tax. The last option is that the Board could close
the transfer stations and request the people take garbage collection.
Possibly there could be t8$dt~g area where the people would vote on
the level of service and a tax be levied.
Hearing open to the public. Appearing:
1. William Houston, Barry Creek. Mr. Houston stated that
he would like to see the service in Harry Creek the same as it has been
for years. The transfer station should be open to the public at no
charge.
2. Arthur Johnson, Sterling City. Mr. Johnson stated that
it was a few people who spoil it for the rest of the people. Mr.
Jahasoa stated that he hoped that the trans#er station in Sterling
City could be left.
3. Linda Mann, OK Sanitation. Mrs. Mann stated that she
has a little truck going to Sterling City at the present time as there
are not enough customers. I£ there ere more customers, then there will
be a big truck that will go to Sterling City.
4. Erv Tarr. Mr. Tarr stated that Sterling City only requires
a little truck at the present Cime. He is sure that if the demand were
greater the co~pany would gut a larger truck in Sterling City.
5. Ed Chiappari, Oroville Transfer Station. Mr. Chiappari
stated Chat the collectors have no security. The County seeds to
contract the refuse collection.
Supervisor Winston stated that with the tremendous increase
is population, the disposal problems have been plac8d upon the public
entities. This is almost is the public utility area. There is a need
for franchising o£ some type.
6. Ed Johnson, HutCe Disposal. Mr. Johnson stated that he
had put a truck in tine Coacow area. At first there was very little
service and now the business in increasing. There is a potential for

7. Everett Johnson, C6icn. lfr. Johnson stated that he had
been on the committee. DSr. Johnson stated that the cooa-ittee proposed _
that the mountain statione•and the disposal site be placed on the
same type~of system ea Glenn County. There is a charge-of $1.00 per
month on the property taxes.
8. Jim Ladd, Oroville. kir. Ladd stated that the mountain
traaefer station situation was intolerable. There are •e few people
who ere dumping ~rhen they should not. This is a taw ~riolatioa. Mr.
Ladd is op owed to franchising. All of the trucYs is the County should

9. ~Zmer Johnson, Chico Butte Disposal. lir. Johnson stated
that he was representing the Chamber of Commerce. The mountain stations
effect the Chamber directly and indirectly. Mr. Johnson net up the
mountain transfer stations. The traaefer stations should be continued.
The people could form special districts in order to keep the stations.
Z0. Melvin Morrie. Mr. Morris stated that there is one problem
that has not been considered. That is the bulky trash that is at the
mountain transfer stations. If the County quite subsidizing Che mountain
transfer stations then there•is no way they can be left open. The County
will either have to close the transfer stations or subsidize them.
The mountain station at Butte Meadows should remain open.
Mr. Castleberry stated that the Neal Road Landfill will be
self supporting for the next few years until it has to be closed and
another one built.
The City of Oroville has a franchised collector system.
Discussion of the Oroville Transfer Station had at this time.
Mr. Castleberry stated that the Oroville Transfer Station went out to
bid. The contract calls for paying $3.10 per ton to haul the trash
to Neal Road. This is subsidized by the Ceunty. There is a cancellation
clause of 90 days. The contractor is a private collector also.

Discussion of franchising had at this time. Chairman Richter
stated that the Board had been told that there could be ao franchising
unless it was put out to bid.
Daa Hlackstock, County Counsel, set out the background of
franchising for garbage collection. Mr. Blaclcetock read the Health
and Safety Code and Che Attorney General's opinions concerning
franchising. In order to franchise there moat be competitive biddigg.
The franchise does not have to be exclusive. It can be non-exclusive.
This ie for the protection of the public.
Supervisor Lemke stated that he was in favor of the private
enterprise system. If the public does not like iChreprice for collection
of garbage then they have the option to haul it to the dump themaelvea.
Discussion of franchising peraus free enterprise $ad at this

Board felt that the user should pay and that the system should be taken
off the tax roll.
County Counsel is to research the question of franchising
and contact different counties as to how they handle this situation.
County Counsel to send out answers to the collectors as well as the
Board.
The hearing is continued to May 10, 1977 at 11:30 e.m.
