WAIVED THE FIRST READING OF AN ORDINANCE AND ADOPTED RESOLUTION 80-85 TO AUTHORIZE THE AUDITOR TO APPROVE OR REJECT CLAIMS ON BEHALF OF THE BOARD On motion of Supervisor Moseley, seconded by Supervisor Wheeler and carried, waived the first reading of an ordinance and Resolution. 80-85 authorizing the Auditor to approve or reject claims as per the '.Government Code on behalf of the Board of Supervisors was adopted and the IChairman authorized to sign. ADOPTED RESOLUTION 80-8b DESIGNATING THE COUNTY ADMINISTRATIVE OFFICER TO ACT ON BEHALF OF THE BOARD IN APPROVING TRANSFERS AS PERMITTED IN GOVERNMENT CODE SECTION 29125 On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried,,Resolution 80-86 designating the County Administrative Officer to act on behalf of the Board, Government Code Section 29125, in approving transfers within objects of appropriation (salaries and benefits, services and supplies, other charges and expenditure transfers and reimbursements) was adopted and authorized the Chairman to sign. APPROVED BUDGET TRANSFERS On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, the following budget transfers were approvedo B-143 - Plannine Commission and Planning (Housing and Community Development). Within the Planning budget transfers $13 from special depart- ment expense to office expense and within the Planning (Housing and Comm- unity Development) budget transfers $13 from office expense to special department expense. This is a corrective transfer of B-118 that approved an appropriation transfer to cover the exceeded budget amount for the cost of a camera in Planning Administration which should have been requested for Housing and Community Development. B-144 - Libraries. Transfers $900 from .extra help to overtime to cover the expense of paying a half-time regular help staff person overtime rather than utilizing extra help personnel. B-145 - Personnel. Transfers $875 from professional and specialized services to communications to cover the deficit caused by the cost of trans- ferring telephones to the-new Administration Center. B-146 -Assessor. Transfers $450 from office expense to special department expense in order to provide an additional appropriation to cover the unanticipated increase in the cost of film. B-147 - Stirling City Sewer District and County Service Area_-21 (Oakridge Sewer). For the Stirling City Sewer District, transfers $700 .from equipment to structures and improvements - maintenance to correct budget transfer B-103 which was approved on March 11, 1980. For County Service Area 21 transfers $401 from structures and improvements - maintenance to equipment in order to provide for the purchase of a sewer cleaner within the Oakridge Sewer Bistrict, with rental charges to be made to Stirling City. B-148 - Environmental Review. Transfers $3,000 from regular .salaries, $2,000 from extra hel"p;,--and $250 from overtime; with $250 going Page 374. The purpose of this transfer is to cover current deficiencies and to provide an approp- riation for the balance of the year. B-149 - Animal Control. Transfers $29,000 from the reserve to professional and specialized services in-order 'to cover current deficiencies and to provide an appropriation for .tcie remainder of the year. Deficiencies in the account were caused by an over-realization of dog license fees which must be paid to-the contractor, no provisions were made for a Consumer Price Index increase to the contractor for the months of May and June 1980, and unanticipated increases in pound charges. B-150 - Chico Municipal Court. Transfers $500 from professional and specialized services to transportation and travel to cover existing budgetary deficiencies and to provide an appropriation for the balance of the year as a result, of increases in the number of visiting judges to -the court. B-151 - County Service Area #47 (East and Guynn Avenue Storm Drainage and StreetliQhting). Transfers $150 from utilities to structures - maintenance in order to cover existing budgetary deficiencies and to provide an appropriation for the remainder of the year brought about by unanticipated costs of pump repairs. B-152 - District Attorney (AB 90 and AB 3121 costs). Transfers $900 from regular salaries to office expense and $500 from employee benefits to transportation and travel in order to cover unanticipated expenses in office and transportation costs. B-153 - District Attorney. Transfers $282 from publications and legal notices, $525 from special department expense, $491 from fixed assets - equipment and together with a transfer of $2-,302 from the reserve, increases the appropriation for jury and witness expense in the amount of $3,600 in order to cover current and projected budgetary deficiencies as a result of the unanticipated number of major cases and non-local witnesses subpoenaed. B-154 - Subdivision Inspection. Transfers $2,600 from extra help to overtime in order to cover current and projected budgetary deficiencies in the checking of subdivision and parcel maps. B-155 - Public Works - General Services. Trnasfers $470 from office expense, with $142 going to overtime and $328 to professional and specialized services. The purpose of this transfer is to cover budgetary deficiencies brought about by the preparation of revised supervisoxial maps and-surveys of the proposed dump site. APPROVED LOAN POR COMMUNTTX DEVELOPMENT BLOCK GRANT FOR REHABILITATION ASSISTANCE - HOUSING AND COMMUNITY DEVELOPMENT On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, approved the loan for rehabilitation assistance, 1635 D Street, Chico, under the Community Development Block Grant in the amount of $2,511 at 57 interest for 30 years. 3aT PUBLIC HEARING DATES Public hearing dates were set for the following items: 1. APPROVED VARIANCE RENEWAL, LONNIE 0. TAYLOR. OROVILLE AREA On motion of Supervisor Moseley, seconded by Supervisor Dolan and unanimously carried, the Lonnie 0, Taylor renewal of variance to sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home on AP 24-23-16, Route 2, Box 2503, -0roville area; zoning: "A-5" was approved APPROVED._AMENDMENT TO WOMEN, INFANTS AND CHILDREN AGREEMENT On motion of Supervisor Wheeler, seconded by Supervisor Moseley and unanimously carried, _. .. the amendment to Women, Infants and Children Agreement to the 1979-80 contract (No, 79-75659 A-l) was approved -and the Chairman authorized to sign. APPROVED AMENDMENT TO FAMILY .PLANNING CONTRACT On motion of Supervisor Wheeler, seconded by Supervisor Dolan and unanimously carried, - the Amendment to Family Planning Contract to the 1979-80 Family Planning Contract (No, 79-75035 A-1) was-approved.. 'and-the Charman•.authorized to sign. ADDITIONAL MATTER FROM SUPERVISOR - PLANNING DIRECTOR TO REPORT BACK TO THE BOARD Supervisor Winston stated there was a situation where agriculture property must have a signed affidavit before they are allowed a mobile home for an agriculture worker. The present practice is for both parties to sign the affidavit. There is an individual in the Bangor area, Mr. Rominger, who would like to modify this agreement. He has discussed the matter with the Planning Director who was concerned that the dwelling would remain vacant. This matter :was referred to the Planning Director for a report back next week. PUBLIC WORKS ITEMS APPROVED On motion of Supervisor Wheeler, seconded by Supervisor Moseley and unanimously carried, the following Public-Works items were approved: 1. Approved the right-of-way acquisitian for East Avenue traffic signals at Pillsbury and El Paso Way; authorizedthe Chairman to sign and authorized~the Auditor to issue a warrant upon demand of the county's escrow agent; it being necessary to acquire an additional ten square feet of land in order to place traffic signal poles out of the sidewalk area. Resolution 80-90 supporting SB 348 (Alquist) regarding workmen's compensation insurance as a prerequisite to issuing permits to a contractor was adopted and the Ghairman authorized to sign. ADDITIONAL MATTER BY BOARD Supervisor Wheeler announced that the signal lights were to start blinking on Thursday. Clay Castleberry, public works director, stated he had been informed the contractor was unable to complete the signahs until next week. ADDITIONAL PUBLIC WORKS ITEMS On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the additional Public Works items were approved: 1. Approved authorization for Thermalito Irrigation District to do emergency protective work on right-of-way for its sewer by abandoning Sacramento Northern right-of-way, Thermalito area. 2. .Approved replacement of three ton load limited bridge as low water crossing is provided adjacent to Craig.Rscrea:tion Road. REPORT TO THE BOARD REGARDING THE REQUEST OF SOUTHERN PACIFIC LAND COMPANY RE UESTING EATENSION OF TIME TO COMPLY WITH RE UIRED REGULATIONS Bettye Blair, planning director, set out .the background on the report to the Board regarding the request of Southern Pacific Land Company's request for extension of time to comply with required regulations. The Planning Department has requested applicant apply for a General Plan Amend- ment and different zone. The matter has been referred to the Zoning Investigator, County Counsel, Administrative Officer and the District - Attorney for legal action. Dan Blackstock, county counsel,- stated if he was instructed to proceed with the zoning violation they would be ordered to cease and desist and it would be a preliminary injection. He did not recommend giving an extension. There was no action taken regarding an extension of time request. He felt the Board could stop the the cleaning of box cars other than cement cars. This ties into industrial and the area is agriculture. PUBLIC HEARING: ADOPTED AIR POLLUTION CONTROL RESOLUTION 80-1 AMENAING SECTION 4-9 ON THE BUTTE COUNTY AIR POLLUTION CONTROL DISTRICT RULES AND REGULATIONS - COIQTTNUED SECTIONS 4-3 AND 4-4 TO JUNE 24. 1980 at 10:00 a.m. The public hearing for consideration of proposed amendments to Sections 4-3 and 4-9 of the Butte County Air Pollution Control District rules and regulations was bald as advertised. Joe Bandy, air pollution control director, set out the background on the proposed amendments. Section 4-3 is in regards to fee schedules and use process. 'Section 4-9 brings us 'to state law requirement of AB 884. The fee schedule will increase the revenue by $16,000. The larger sources will have larger increases, smaller sources will have a decrease in fees. There is a cost of $45,000 per year for the engineering aspect, this will represent 1/3 of that. The non-attainment increased the engineering functions: ~ They annually review the sources. Mr. Bandy stated Section 4-1 of the permitting process was in compliance with the'state. Section 4-3 structure states they must have an accurate data system. Mr. Bandy stated there has been quite a bit of opposition due to the summarization of the public notice. Without the data system the state can decide the local government does not have the abilities to handle the program. Hearing open to the public. .Appearing: 1. Hugh Santos, Durham. Mr. Santos was representing the Butte County Farm Bureau. He felt if the issue had been handled through the Agricultural Advisory Commission with public hearings this could have eliminated some of the misunderstandings the publication had generated. The farmers are not kicking about the fees but the coop people feel they are being pitted against the individual farmers. Supervisor Wheeler noted on March 20, 1980 this was directed to the Agricultural Advisory Commission but Mr. Bandy advised against it. Dan Blackstock, county counsel, set out the background on the agriculture implimentation which went back 5 to 6 years ago. The Air Resources Board did not want the big rice dryers included so the Board of Supervisors backed off. That is dealing with Section 4-4 which is not before. them today. Mr. Santos advised that the Board use their Agricultural Advisory Commission more often. The people feel this information being gathered will be used against them. He noted the rice dryers, almond hullers and co-ops consider themselves farmers in agriculture. It, is a gray dividing line. 2. John Valpie, Butte County Rice Growers Assoc. Mr. Valpie stated his organization hasfcomplied with the regulations and have-been issued permits. He did not feel additional fees would be justified. He felt only if there was an addition to the facility, then increase the fees. They paid $850,000 to meet the requirements to clear the air. He felt they were being singled out. 3. Karen Vaccaro, Northern Sacramento Valley Women for Agriculture. Ms. Vaccaro stated their organization was in support of members of the co-op and members of the Farm Bureau. The rules and regulations are getting harder and harder on agriculture. 4. .Larry Rinehart, North State Huller, Chico. Mr. Rinehart. stated many have gone to the bag house operation, .these type operations must be funded and they did not feel they should fund it. He felt the restrictions in Kern County .were ridiculous and hoped they did not have such restrictions in Butte County. He knew they were appea§ing~khe'-:Air Resources Board, it is something they must live with. 5. Lovis Camenzind, Jr., Durham. Mr. Camenzind was a retired livestock farmer. He was concerned about the legal advertisement in the newspaper. He felt it was a device to keep the bureaucratic in operation. He felt it was discriminating against the basic right of the constitution. They should tell Sacramento they have a Charter and they are going to run the local government by the Charter. Mr. Bandy stated on numerous occasions they have requested that Sacramento Air Pollution personnel visit Butte County. There is no response. Mr. Bandy set out the 1977 Clean Air Act Amendment. The re .was no enough data from Butte County on the non attainment. It is a federal law. Mr. Bandy stated it must be the Boards decision to noi~comply with the regulations. There was discussion regarding the 30 day notice and the effect- iveness once an application is received. On motion of Supervisor Aolan, seconded by Sugervisor Moseley and unanimously carried, Air Pollution Control Resolution 80-1, amending Section 4-9 of the Butte County Air Pollution Control District rules and regulations was approved; and refer to the Agricultural Advisory Commission Sections 4-3 and 4-4. There is a steep slope and a fire hazard. They recommend a negative declaration with mitigation measures. Arlen Cartwright, fire warden, stated there is no'~ full time fire protection in this area. Hearing open to the public. Appearing: 1. Steven Dean, attorney, Redding. Mr. Dean noted the foothill farmers and individuals at Mt. Ida Road were in opposition. They had enlisted the help of James Cooksley to present expert testimoney. 2. James Cooksley, scientist. The property is located right on a fault line. With the magnitude of the 1975 Oroville quake he would be concerned about placing mobile homes at this ephieenter. Even 10 to 15 miles away there can be major damage. Mr. Cooksley display ed maps-.f.rom .the State Department of Water Resources. Mr. Cooksley set out areas on the maps. He would not recommend placing a mobile home park at this proposed location. He could not set a time period when another earthquake could occur. He is pia scientist. 3. Raymond A. Leonard. Mr. Leonard lives z mile from the proposed project. He was concerned about the roads and school in the area. He was concerned about the drainage into North Honcut Creek. Nir: Leonard read from the impact report. He was opposed to the proposed project. Mr. Poore noted the financial impacts of building homes vs buying mobile homes. Mr. Poore presented pamphlets to the Board on mobile homes. He felt if the homes were anchored there would be no damages should there be an earthquake. He favored approving the mobile home park. 6. Henry McCall, Oroville. Mr. McCall displayed pictures of artesian wells in the proposed area. He was concerned about what impact the artesian wells would have on the area. Mr. Cooksley stated the maps were from the Water Resources and it was not conjecture. It _is data they have compiled. 7. Leon E. Mayer. Mr. Mayer played a recording of an elderly lady w_ho was hoping to move to the proposed project. She was concerned about the park in which she'"lived being converted to high rise buildings. Mr. Mayer felt if Honcut Creek was cleared of the debris there would be a better flow. He felt the retired people must have a place to live where they could afford it and not be moved out. 8. Mr. Tyler, Canal Drive, Oroville. Mr. Tyler felt the access- ability from Olive Highway contibuted to a death trap. They had received a letter from Mr. Castleberry who had been notified by the State Water of Resources stating there will be no significant erosion. It has been approved by the Reclam- ation Board, the same plans which were submitted to this Board. They will be deleting the cable and substituting with a metals gate. 2. Mr. Nolan Engle, civil engineer. Mr. Engle stated he was representing Mr. Chand. They did not understand why Newhall Farms were objecting. They have been working on it for two years and have complied with everyones requests. 3. Robert Lockbalm, Chico. Mr. Lockbalm stated he was the manager of the property for Newhall Land Property. He was concerned about the irresponsible manner this project has been handled. This came up in 1976.. They were not sure where the county road was bounded. If the cable is strung across the river it will catch debris or fisherman. Their soil is Columbian loam which is some of the best soil. If there was erosion it would be on the G1eanlCounty side. Mr. Lockbalm set ou•t the oxbow on the map. They are not interested in buying the property. They lost use of one of the pumps during the flood of 1970. He was concerned about a 10 foot drop off. Mr. Millington stated they would be willing to put in a culvert. 4. Paul Minasian, attorney for Newhall. Mr. Minasian.. set out the background of Newhall acquiring the land. The county has agreed to provide maintenance for the road after the flood. He was concerned about the eddying debris and erosion in this area. The barge,' was to beihoored in front of Newhall land, now they are indicating, cutting into the bank. EIe questioned if they had the legal authority to approve the use of a barge. [~ewhall was not in favor of access across their land for Mr, Chand. Mr. Millington stated there had been approval from the Reclamation Board, Army Engineers,_State Land Commission and Fish and Game. They want to open up farm land. The environmental impact report was waived. There was discussion at the maps. Concerns-were voiced to the oundary lines. Mr. Castleberry stated that the public has right-of-way. This would take some modification to keep the property owner with access for their driveways. He did not know if the county should say another property owner has the right as well. Hearing closed to the public and confined .to the Board. Mr. Blackstock, county counsel, stated the Board has never attempted o issue a permit of this type. The county would have to review the sub- ivision. If in fact the county line runs along. there, there is a question s to what authority the county has to issue a permit to allow the capability or crossing another county line. He wondered if the county wanted to assume he liability to benefit Glenn County. The encroachment permit the Board ould grant would have to be specially drafted to set out all of the concerns nd protect the county from liabilityo He will submit a written opinion to he Board as to whether they can allow the cable to be placed there. Chairman Lemke stated that the Board wanted a written opinion on county line location; the Board's liability if both sides are in Butte ty; and the ability of the Board to issue such a permit. RICHARD REESE,.AP 63-04-13, TENTATIVE PARCEL MAP FOREST RANCH AREA Russ Croninger, Ringel and Associates, stated ,that Mr. and Mrs. Reese had a tentative parcel map approved. This map was not recorded with- in the 18 months allowable. There was no .letter asking for a continuance. He is taking this map through the process on a new application. The :Advisory Agency adapted a negative declaration at the time of the original hearing on this matter. He is now required to-pay $175 for environmental review fees when the existing negative declaration and checklist will be used. He asked that the Board waive the environmental review fees ozi this map. Earl Nelson, environmental review director, stated that his office did not have the authority to waive the fees. They will not be doing any- thing different for this project than what was originally done. The nega- tive declaration does not have a 18-month time limit. He felt the critieria was the same today as when the original study was done on this project. APPEARANCE: -LOUIS CAMENZIND JR. Mr. Camenzind spoke regarding the litter along Oroville-Chico Highway. He asked that something be done by the CHP to ticket the people who are speeding on this road and leaving garbage on the highway. The California Highway Patrol to be requested to look along the Oroville-Chico Highway on the weekends. Mr. Camenzind was concerned about the slight recession the country was having at this time. He felt the Environmental Review Department and Planning Department should be abolished. DAN HAYS PROJECT TO BE PLACED ON ADVISORY AGENCY AGENAA Bill Cook stated that he was representing Mr. Dan Hays with regard to a project on the eastern side of Cohasset Road. He understood that~Mr. Hays had been before the Board on the county standards at a previous meeting. At that time it was agreed that Supervisor Wheeler would work with Mr. Hays and meet with Lynn Vanhart, environmental health director, to try and solve the problems on the project. He recommended that this matter be placed on the next agenda for the Advisory Agency meeting a week from Monday. Mr. Hays stated that yesterday he and Supervisor Wheeler met with Mr. Vanhart and asked that this matter be placed on the Advisory Agency agenda. Mr. Vanhart told him that he would not place the matter on the agenda. Lynn Vanhaxt, environmental health director, stated that he had told Mr. Hays he would not set the matter on the agenda for hearing. He would have no alternative but to recommend that the project be denied at the hearing if it were to be held at this time. ADDITIONAL MATTERS PRESENTED BY BOARD MEMBERS Supervisor Moseley asked that the joint powers agreement with Sacramento Valley Air Basin be placed on the agenda for consideration. The letter from TID regarding deposits for ,fire hydrants on development referred to Counsel and Public-Works. APPOINTMENT TO COMMITTEE ON LAW ENFORCEMENT SERVICES On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, Brenda Kinslow, Butte Creek area was appointed to the committee on law enforcement services.
