Hancock, Biggs. Mr. Hancock states that he is fully qualified Q p as of May 14, 1974~for the position of judge in the Biggs Justice 11~' Court and requests the Board to consider his appointment to the vacancy. Discussed. Mr. Hancock will be interviewed during executive session. James E. Hill, Magalia. Mr. Hill requests immediate improvement of the Skyway ~ O d,0o from the end of the new portion built by Larwin to the Magalia Heights vicinity. The Chapter writes regarding Senate Bill 1113 which provides a 5% increase for ~ g S those retiring between January 1 and June 30, 1971. This bill O / corrects an error in SB 135, which inadvertently paid the cut-off date December 30, 1970 instead of June 30, 1971. They request amendment of our contract with PERS which is necessary to provide this benefit to the few employees who retired during this period, Referred to Administrative Officer, County of Siskiyou. They support the concept and method of distribution and suggest that we indicate support to our legislators and authors of the bill. Discussed; copies of this bill to go to Board members. State Department of Water Resources. The Department forwards copies 0 ~ ~ of recent amendments to water supply contract between the State ~"~~ ' and other contracting agencies as required under our contract. Referred to George Stamm. Governor Reagan. The Governor forwards copy of Special Election Proclamation D 9.Q Q declaring that a special statewide election be held on June 4 ~ be consolidated with the primary election held on that date. No action taken. Office of Economic Opportunity, Region IX. He states they are arranging a conference on National Resource Lands in Butte, Glenn, and Tehama Counties forFriday, May 17, 1974, They ask if the Board would be willing to name one of the Board members to serve on a panel at this conference. Supervisor Gilman was requested to attend. James M. Crane. He writes a letter of complaint against the current ~1 3+~ C northeastpofcChico. This7is bei0ngocheckednbyuthe Planning Commission. Eva Borchers, Secty. Chico Grange ~k486. She states that the Grange ~ ~ p,0 4 concurred with the resolution of the Berry Creek Grange ~k694 asking that deer hunting season be deferred. Referred to Fish & Game. Joyce Dorsey, Durham. She sets out the potential dangerous traffic condition on Durham-Oroville Highway. She requests that the Board consider lowering the speed limit on this road. The Board requested that Mr. Castleberry have the Highway Patrol look at the road to get prompt action on the matter. Mr. Castleberry said he would answer the letter and will have the matter back to the Board next Tuesday. Mr. Castleberry said there is a trip scheduled tomorrow with Highway Patrol. Filed. 74-638 ENDORSE STATE PROPOSITION 3, AS REQUESTED BY CITIZENS FOR CAL-VET PROP. 3 On motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, the Board endorsed State Proposition 3, the $350 million Cal-Vet bond measure to be on the June ballot, as requested by the Citizens for Cal-Vet Proposition 3. 74-639 APPLICATIONS FOR ADDITIONAL HOSPITAL BEDS SENT 70 BUTTE COUNTY COMPREHENSIVE HEALTH CARE COUNCIL FOR THETR RECOMMENDATION On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, the requests of CrestwoodConvalescent Hospital, Chico, and Feather River Hospital, Paradise, for additional beds for their existing facilities were sen.G to the Butte County Comprehensive Health Plan- ning Council„ with the request that they make a recommendation for the additional beds as requested. 74-640 APPROVE REQUEST OF HONEY RUN COVERED BRIDGE ASSOCIATION, INC. TO HOLD THEIR ANNUAL FUND RAISING PANCAKE BREAKFAST AT BRIDGE On motion of Supervisor Cameron, seconded by Supervisor McKillop and unanimously carried, the request of the Honey Run Covered Bridge Association, Inc. to hold their annual fund raising pancake breakfast at the bridge on June 2, 1974 from 8 a.m. to 1 p.m, was approved. 74-b41 ACCEPT THE GRAND JURY INTERIM REPORT On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried,. the Grand Jury interim report was accepted, 74-642 WAIVE SECOND READING-SALARY ORDINANCE AMENDMENT AND ADOPT ORDINANCE N0. 1447, AMENDING THE SALARY ORDINANCE On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the second reading of the salary ordinance amendment was waived, Ordinance No. 1447, amending the salary ordinance was adopted and the Chairmanpw~ae ~~tthorized to sign. 7 April 30, 1974 AEril_30,_1974 _ _ _ _ _ _ _ _ _ _ _ _ _ W 74-643 FARM ADVISOR ITEMS DECIARED SURPLUS PROPERTY On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, the following Farm Advisor items were declared surplus progerty and the Purchasing Officer was authorized to dispose of the same: 1. Flat top wooden desk X03938, which has been replaced with a new desk and is not in condition for transfer 2. 1967 Ford four door sedan ~~236 which has been replaced 3. Be11 & Howell movie projector ~~16432, inoperative and not worth repairing. 74-644 APPROVE TRANSFERS OF HOSPITAL SURPLUS AS REQUESTED The Administrative Officer stated that Board approval is requested for transfer of items as follows: steel kitchen table to Biggs Memorial Ha11; five tablet arm chairs to Welfare; one desk lamp to Assessor; one metal cabinet to Auditor; two file cabinets to Treasurer; and two bath scales to Health. Also per the Board's instructions, the Oroville Rescue Mission has chosen a list of items for which they have use. The Paradise Fire Department also has requested a number of items. Requests discussed, It was suggested that the Board re-check to see if the Memorial Hall requests have been handled. Purchasing needs some positive direction on what the County is going to do now that the "in-house" departments have been satisfied. On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, the transfers of hospital surplus werg approved as listed above. Time spent discussing the disposal of the balance of the hospital items not reserved by Dr: Enloe. Mr. Nickelson felt the County would be better off if they let everyone bid equally on the items. It was felt that the items that are available should be tsroken down into reasonable size lots. Supervisor NcKillop felt that disposal of these items should be delayed until the two county men go down to Santa Cruz and report back to the Board. He felt that only one person should go down to Santa Cruz. Mr. Nickelson explained why the two men were going down to Santa Cruz. 74-645 TRAVEL AUTHORIZATION FOR TOM STRUTHERS & WALTER ATKIN APPROVED ___ On motion of Supervisor McKillop, seconded by Supervisor La and unanimously carried, authorization was granted to send Tom Struthers and Walter Atkin to Santa Cruz to observe the auctioning off of the Santa Cruz County Hospital's equipment. One night's lodging; estimated cost of trip $50. Transportation by county car; cost to be charged to Hospital travel account:- 74-646 ADVANCE STEP HIRING FOR 3UVEN~LE`Ifii1L~ SUP~~`a<, AUTHORIZED T The Personnel Director recommends theBoard authorize the Chief Probation Officer authority to appoint a new .juvenile Hall Superintendent at Range 23.0, Step D, $1,094 per month. The recommendation is based on the difficulty in recruiting well-qualified candidates for. the position and the availability of the number one candidate on the eligibility list at the advance step. Nr. Rackerby explained how the recruiting was handled., they ended up with four men on the list. The man being proposed is an experienced man with Juvenile Hall. On motion of Supervisor Cameron, seconded by Supervisor Gilman and unanimously carried, hiring of the Juvenile Hall Superintendent at range 23.0, Step D, $1,094 per month, was authorized. 74-647 MANPOWER PLANNING COUNCIL DISCUSSED Mr. Rackerby reported that several names have been submitted fox consideration for appointment to the Manpower Planning Council. He stated he had sent this list of names to the Board members for their consideration. There would be one appointment for each of the seven categories. Categories set out and discussed. It was suggested that the resolution setting up the council be amended to add one additional member, a member of the Board of Supervisors. No action taken at this time. The Board members will study the list of names submitted. Mr. Rackerby will have the resolution prepared to amend the original resolution and will bring it back to the Board next week for consideration and action. 74-648 APPROVE BUTTE COUNTY FAIR AFFIDAVIT FOR PAYMENT On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the Butte County Fair affidavit for payment to Donald R. Long and Associates, consulting engineers, in the amount of $1,200 for services rendered on the restroom facilities project at the Fair was approved as requested. 74-649 APPROVE AGREEMENT WITH DEL NORTE COUNTY FOR BAR-O-BOYS RANCH On motion of Supervisor McKillop, seconded by Supervisor Cataeron and unanimously carried, the agreement with Del Norte County for use of the Bar-O-Boy's Ranch was approved, effective July 1, 1974, and the Chairman was authorized to sign. 74-650 AUTHORIZE DIRECTOR OF BUTTE COUNTY MENTAL HEALTH SERVICES TO MAKE APPLICATION TO STATE DEPT. OF HEALTH FOR BEDS UNDER RENMAR CONTRACT On motion of Supervisor Cameron, seconded by Supervisor Gilman and unanimously carried, the Director of the Butte County Mental Health Services was authorized to make application to the State Department of Health licensing for licensure-for the 14 contracted beds under the Kenmar contract. ,. 74-651 BUDGET TRANSFERS APPROVED On motion of Supervisor McKillop, seconded by Supervisor Gilman and unanimously carried, the following budget transfers were authorized: B-123 Assessment Appeals Board - $814 from the Reserve to professional and special services B-124 Public Works Yards and Stores - $825 from maintenance structures, improve- ments and grounds to communications B-125 Public Works Xards and Stores - $400 from maintenance structures, improvements and grounds to small tools B-i26 Public Works Engineering and Administration - $100 from special departmental expense to maintenance of equipment B-127 Public Works Road and Bridge Construction - transfers various amounts between completed road projects to cover deficiencies as follows: $2,074.63 to Dos Rios and Larkin Road, $84.44 to Hosler Avenue, $271.97 to Smith Avenue, with $2,074063 coming from Richvale West Road and $35b.41 from ,Power House Hill Road projects Page 4.59. B-137 Probation - $370 from the reserve to professional and special services B-138 Treasurer-$4,172 from salaries and wages regular and $453 from extra help, $100 from equipment maintenance and $300 from publications, with $400 going to communications, $4,450 to office expense and $175 to professional and special services B-139 Building and Grounds Maintenance - $3,000 from the reserve to hospital major maintenance account in Building and Grounds Maintenance RECESS: 10;15 RECONVENED: 10:30 74-652 APPROVE 1974 STATE FAIR EXHIBIT & CONTRACT WITH KEITH SKIBMORE Bob Nicholson, Director of Butte County Bevelopment Commission, presented the design of the 1974 Fair exhibit for approval and a request for authorization for Chairman to sign a contract with the Skidmore Displays. $3,600 has been budgeted for the exhibit. This will include the showing at the National Orange Show at Los Angeles County Fair in 1975 also. A new agriculture product will be features in this exhibit. The Kiwi Growers of California will be displaying their product. Exhibit discussed, On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the design for the 1974 Fair exhibit was approved and preparation of contract with Skidmore Displays was authorized. 74-653 AUCTIONEER'S LICENSE FOR MILTON J. WERSAOL APPROVED On motion of Supervisor Ladd, seconded by SupervisorMcKillop and unanimously carried, the auctioneer's license and bond of Milton J. Wershow Co. were approved to hold auctions at C. H. Miller Transportation, State Box Road off 5. 5th Ave., Oroville, said auction to be held on May 2, 1974. 74-654 PURCHASING AGENT AUTHORIZED TO CALL FOR BIDS FOR NEW CHASSIS AND BUILD UP FOR NEW TYPE VEHICLE FOR MOBILE LIBRARY SERVICE Mrs. Terry, County Librarian, spoke to the Board concerning a new type vehicle for mobile library service presently budgeted with revenue sharing funds. She stated that she has had consultations with Tom Struthers and Public Works and they are all in favor of this box-car type vehicle. The box car- is a standard type vehicle and has all. he safety features; it is considered safe by~the Highway Department. She stated that Mr. Struthers is recommending that the County buy a diesel chassis for this~vehiel2°; One of the things that will Page-460. April 30, 1974 April 34, 1974 bring the cost up on this vehicle is the new national standard that demands a new non-skid brake. Cost of the proposed vehicle set out. It is estimated that the vehicle will cost about $39,000.00; the County had budgeted $30,000 Iast year for the bookmobile. Delivery would take from six to nine months. The oid bookmobile would be traded in on this new vehicle. Nr. Nickelson stated that Mrs. Terry would like to get the Boards thoughts on this vehicle. She is requesting that the specs be approved and that it go out to bid. Request discussed. Supervisor Gilman felt there should be alternates set out in the bid. Automatic transmissions are not always the best for this type vehicle. An alternate will be placed in the bid for the manual-type transmission. An alternate will also be placed in the bid for a conventional gasoline engine. On motion of Supervisor McKillop, seconded by Supervisor Cameron and unanimously carried, the Purchasing Agent was authorized to call for bids for the new type bookmobile for the chassis and build-up, with funds to be taken out of the Revenue Sharing funds, justifying that this is a people program, and with the proper alternates in the bid form. 74»655 AppROVE AGREEMENT WITH APPLIED SCIENCE AND RESOURCE PLANNING Howard Toussaint, County Sanitarian, reported that an agreement has been prepared for Paradise Pines water quality monitoring for a six months sampling analysis and reporting at a fixed fee of $1,600. Funding to be through County Service Area No. 4. Agreement discussed. Mr. Toussaint said this should be included in County Service Area No. 4 budget, to be discussed at budget time. He said there were nine different areas that will be sampled. On motion of Supervisor Cameron, seconded by Supervisor Gilman and unanimously carried, the agreement with Applied Science and Resource Planning, Inco for Paradise Pines water quality monitoring was approved for the pexiod of April, May, June, July, August and September, subject to approval by County Counsel. 74-656 WAIVE FIRST-REARING OF WELL STANDARDS ORDINANCE Mr, Toussaint presented the amended well standards ordinance, which has been prepared by Health Department as per Board instruction. He stated that copies of amended ordinance had been sent to all the well drillers in theCounty. Casing requirements discussed. Mr. Toussaint said he would not see any reason to change the requirements for the casings. Fees were removed from the abandonment of wells. Amendment features set out and discussed. Supervisor Gilman said he wants one thing to be perfectly clear. If a man has an irrigation well and when he pushes the button the pump does not work, he wants the work to be able to be done without securing a permit for the work. Mx. Toussaint stated that no permit would be required for this work unless the pump has to be physically removed from the well, Supervisor Gilman felt Mr. Toussaint should pursue the part of the ordinance that speaks to quality construction of wells. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the first reading of the we 11 standards ordinance was waived, with the request that any reference to repairing of pumps be deleted, but that the section that refers to the construction of wells only be retained. 74-657 PARADISE FIRE DEPT. REQUEST TO APPEAR 'itEGARD.7NG REQUEST FOR FUNDS TAI'.EN OFF AGENDA Ev Bosworth, Assistant Administrative Officer, reported that the Paradise Fire Department would not appear at this meeting. The situation will be resolved by the Auditor, 74-658 APPEARANCES: DISCUSSION OF UPPER RIDGE FIRE STATION Mro W. Shinners of Magalia, presented copies of a backup sheet ~ ~ ~ and petition to the Board members. He said he was representing people ~,,,~~~ from the Upper Ridge, and he stated that a large delegation was in the audience from the Upper Ridge above Paradiseo Mro Spinner stated that the Upper Ridge was a large area; there are about 4,000 people living 3n that area. They dc.not feel that the DeSabla Fire Station is enough protection for these people. Matter of fire protection for the Upper Ridge discussed. The petition requests that the Board take such action as necessary to equip, Build and operate a station on the Upper Ridge. There are about 675 signatures on the petition, Mr. Jim Simmons, representing the Division of Forestry, spoke concerning the request for the fire station. 1Te identified a need for fire protection in the Paradise Pines. This is one of the fastest growing areas in the county. It was stated that the bids for this station could be tied to the bids for the Manzanita station. Supervisor Ladd stated that a joint agreement between the County of Butte and Gridley was prepared and sent to the Counsel for the City of Gridley. It would be a joint- operated facility. It ~~•<.s stated that Larwin had deeded to the County prnperty for a fire station. The County still has this property for use of afire station. Ralph Beemer, Magalia, spoke concerning the need for fire protection in the Upper Ridge area. He said the Forest Service had been authorized to make the survey to determine if a station was needed in that area. This has been a concern of the people in that area for at least two yearso He hoped that the Board would take action at an early date on this matter. Chairman Madigan said the Board would have to wait until they conclude with the plans for the Manzanita station. Funds for a fire station on the upper ridge would have to be discussed at budget timed An answer will be given to these people after the budget sessions are held this year. Su,~ervisor Cameron stated that he would let these people kno~~* when the Board will discuss this matter during budget sessions. Pat Patterson, Magalia, spoke concerning the roads in the Magalia area. The people there feel that the roads are inadequate. They would like to request that the Board consider the continuation of Ponderosa Way. Completion of this road has been put off for over two years, he stated. He said that Larwin had put up money with the County and these funds could be used to complete Ponderosa Way. Representatives of the area spoke on the need for the fire station and for the access road to the area. Clay Castleberryq, Director of Public Works, stated that Larwin had put up $38,OOOin cash; the rest was put up in letters of credit. He said he would recommend that the County spend Larwin's money on the access road. Stanley Golding, Magalia, stated that the road was already there; all it needs is to be leveled, some of the bank taken off and the road paved. He also requested that a solid line be placed on the road, with a "no passing" sign installed. Mr. Castleberry will check on this request. Chairman Madigan closed the discussion of these matters at this t..me, 74-b59 APPEARANCE: NOEL HZGHFIELD CHICO Noel Highfield, Chico, again spoke on thel~attter of the public defenders contract. He suggested that the Board look into the possibility of establishing the office of Public Defender. This would give the County better control over the salaries and the costa for running the office. 74-660 APPEARANCES 1. Les~a Allison, Magalia, presented a letter to Mr. Castleberry ~ concerning has request for a road from Paradise Pines to Magalia. He 0 Q•~ requested that Mr. Castleberry give copies of this letter to the Board members. 2. Fred Wolfslager. He stated that the people of the Craig- Moore Town area had a meeting Last night about zoning for that area. About 100 people attended that meeting. They were disappointed because Mr. Lawson and members of the Planning Commission did not attend the meeting. RECONVENED: The Board reconvened at 2:00 p.m, following the executive session and noon break. 74-661 CONTINUATION OF HEARING-PHILIP LYDEN, CHICO, APPEAL OF EIR FOR WILLIAM SIMS RE20NE SOUTH OF SYCAMORE CREEK CHICO Jim Lawson, Planning Director, summarized the background of the hearing on the appeal of Philip Lyden, Chico of the EIR for William Sims rezoning, south of Sycamore Creek, Chico. This hearing is a closed hearing and confined to the Board members. Mr. Lawson presented the Board members the comments made at last weeks hearing, and also the comments of the Planning Commission. Also included is a letter from Mr. Lyden: T.iie comments were read and studied by theBoard members. The additional comments were brought about because of Mr. Lydens letter. County Counsel read the comments presented by the Planning Commission. From the environmental standpoint, S-2 zoning is not as desirable as S-1 zoning. Mro Blackstock stated that it should be understood that the proposed zoning results from a study made by the Planning Commission. He explained the matter of the "landing pattern" of planes landing at the airport. He said the Board is going to have to study and discuss this matter in the future. He asked for discussion concerning the matter of including residential driveway permits as apart o£ building permits and (b) the removal of'those that are put in incorrectly or incompletely. Mr. Castleberry said he needs Board's guidance in this matter. They allegedly deeded portions of their acreages in violation of the agreement. It was moved by Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried that the necessary legal action on the Speckert violation of the Williamson Act Agreement be filed by County Counsei. 74-671 COUNTY COUNSEL TO TAKE LEGAL AGTION REGARDING HELIERMAN ZONING VIOLATION County Counsel reported on the Hellerman matter in Paradise. Mr. Hellerman continues to retain horses on his property in violation of the zoning for the area. It was moved by Supervisor Cameron, seconded by Supervisor Ladd and unanimously carried that County Counsel take legal action to resolve the Hellerman violation case. 74-672 APPEARANCE: ROYAL MANDIION U. S. FOREST SERVICE Royal Mannion, U. S. Forest Service, appeared to discuss the land exchange between Lassen forest and Diamond National. He outlined the areas that are in negotiation, as follows: 120 acre garcel in Tehama County 244 acres near Dead Horse falls 40 acre parcel near Butte Meadows. Page 472. He explained the distribution of the land in Butte County being offered by the forest service. Mr. Mannion explained tb.e progosal that is being negotiated. Mr. Mannion also mentioned that the deed is going to be recorded this Thursday on the acquisition from Southern Pacific in the middle fork of the Feather River in the wild area. Mr. Mannion expressed a wish to take the Board members on afield trip to view the forest. He will contact them later regarding this field trip. No action taken on this proposal. 74-673 ADOPT RESOLUTION 74-65 REGARDING EXPLORATION OF RE-AMORTIZING SHASTA BAM TO EXTEND PAYOUT PERIOD FOR PURPOSE OF 7ROVIDING ADDITIONAL FUNDS FOR BANK MAINTENANCE ON TEIE SACRAMEPITO RIVER Chairman Madigan presented a copy of a proposed resolution which describes the problems of erosion on the Sacramento River. It is to give consideration to the concept to re-amortisation of the balance due on Shasta Dam for a cost of water and power. The flood control factor has been taken care of. Chairman Madigan said he.would'Iike to have the Board adopt this resolution and he will present it to the Flood Control people in Sacramento tomorrow. Assemblyman Ray Johnson will introduce a similar resolution to the Assembly. If this balance due on Shasta Dam was re-amortized, it would continue for 50 years. On motion of Supervisor Gilman, seconded by Supervisor McKillop and unanimously carried, Resolution 74-65 endorsing the concept of possible re-amortizing Shasta Dam was adopted and the Chairman was authorized to sign, with the funds that would be available to be used for bank protection. 74-674 ITEMS PRESENTED FOR INFORMATION Supervisor Cameron mentioned the letter theBoard members hzd each received from the Lt. Governor. Time spent discussing the printing of the letter and the paper used. No action taken. Chairman Madigan stated that he had received a call from the California Taxpayers Association. There is to be a meeting May 2nd at which Senator Marler will be the speaker. The Board members were urged to attend this meeting.
