Pursuant to Government Code Section 54956 the Butte County Board
of Supervisors hereby called to order at 1:08 p.m. a Special
Meeting of the Board in the Board of Supervisors Room, County
Administration Building, 25 County Center Drive, Oroville.
Supervisors present: Houx, Josiassen (1:27 p.m.), Yamaguchi, and
Chair Beeler. Supervisors not present: Dolan. Also present: Paul
McIntosh, Chief Administrative Officer; Bruce Alpert, County
Counsel; and Marion Reeves, Assistant Clerk of the Board.

03-135 Public Hearing - Chris Carter - Tentative Subdivision Map -
Appeal - consideration of an appeal of a condition of approval of
a Tentative Subdivision Map to divide a 30-acre parcel into 30
residential lots ranging in size from 0.23 acres to 4.5 acres in
three development phases. Phase 1 consists of 10 lots with an
average size of 0.23 acres, Phase II consists of 16 lots with an
average size of 0.30 acres, and Phase III consists of 4 lots with
lot sizes of 4.5 acres each. This is a project on which notice of
intent to adopt a negative declaration with mitigation measures
regarding environmental impacts has been given. Lots within
Phases 1 and 2 would be serviced by the Oroville Wyandotte
Irrigation District (OwID) for domestic water and by the Lake
Oroville Area Public Utilities District (LOAPUD) for sewage
disposal. The 4.5 (+/-) acre lots within Phase III would utilize
on-site domestic wells for water supply. A looped subdivision
road connecting to Oakvale Avenue would provide access to the
subdivision at two locations. Street "C", which terminates in a
cul-de-sac, would provide access to three of the 4.5 acre lots and
is proposed to be a private road. Storm water drainage plans
would be required to be submitted for review and approval by the
Butte County Public works Department. Fire hydrants would be
installed for fire protection services with the Butte County Fire
Department/CDF approving the location of the hydrants. The OwID
water ditch crossing the project site would be piped underground.
The property is zone A-R (Agricultural-Residential, 6,500 square
foot minimum parcel size) and is located on the east side of
Oakvale Avenue, approximately 0.3 miles south of Hildale Avenue,
Oroville, and identified as APN 068-360-116 (DB [TSM 03-03]) -
action requested:

THE BOARD TAKE THE FOLLOWING ACTION:
A. DENY THE APPEAL AND TAKE NO FURTHER ACTION WITH RESPECT
TO CONDITION NO. 20.
2. SHOULD THE BOARD CHOOSE TO MODIFY CONDITION NO. 20 AS
REQUESTED BY THE APPLICANT, STAFF RECOMMENDS THE BOARD TAKE
THE FOLLOWING ACTION:
A. SUBJECT TO FINDINGS II (A AND B) AS DETAILED IN THE
STAFF REPORT DATED MAY 8, 2003, APPROVE AN EXCEPTION OF
THE SUBDIVISION DESIGN STANDARDS IN ACCORDANCE WITH
BUTTE COUNTY CODE SECTION 20-4 TO ALLOW A MODIFICATION
OF CONDITION NO. 20, DELETING THE REQUIREMENT FOR CURB,
GUTTER AND SIDEWALK IMPROVEMENTS. (35)
