On motion of Supervisor Wheeler, seconded by Supervisor Dolan
and unanimously carried, the minutes of May 6, 1980 were approved as
748 (AUTHORIZE BUDGET INCREASE TO BUTTE COLLEGE CETA CLERICAL TRAINING CONTRACT
On motion of Supervisor Dolan, seconded by Supervisor Moseley
and unanimously carried, a budget increase in the amount of $45,377 to the
Butte College CETA clerical training contract which wilhallow 90 PSE_workers
to receive training and clerical skills during the summer was authorized.
749 AUTHORIZE PURCHASE OF MAGNETIC'TAPE RECORDER - CHICO MUNICIPAL COURT
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the purchase of a magnetic tape recorder
gat a cost of $1,275 for the Chico Municipal Gourt was authorized.

Supervisor Winston stated that he had received an analysis
of savings by going with state contracts. This analysis included things
other than automobiles. He was interested in the automobile contract
purchase through the state. He wanted this viewed in light of the
economics in Butte County with the merchants. He expected to re"eeive
additional information regarding the automobile purchases.
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, The purchase of three additional patrol cars
at a total cost of $23,511.01 from Ed McConnell Ford of Gridley was
authorized.
APPROVE FEATHER RIVER SENIOR CITIZENS ASSOCIATION. INC. AGREEMENT
On motion of Supervisor Wheeler, seconded by Supervisor Moseley
and unanimously carried, the agreement with the Feather River Senior
Citizens Association, Inc. in the amount of $14,834 for use of previously
appropriated revenue sharing funds to the Oroville Meals on Wheels program
was approved and the Chairman authorized to sign.
7"52IAPPROVE BUDGET TRANSFERS
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
land unanimously carried, the following budget transfers were approved:
B-165 - Central Services. Within central duplicating, transfers
$500 from overtime to office expense in order to cover existing budgetar;n-
deficiencies and to provide an appropriation for the balance of the fiscal
year which has been caused by microfilming projects in the Auditor's Office
and Sheriff`s Department. Also transfers $130 from extra help within
central communications to extra help within central stores in order to
provide a budgetary appropriation to cover existing deficiencies for
extra help used for the surplus equipment inventory from the old Administra-
tion Building. Page 404.

B-168 - Agriculture. Establishes an additional appropriation
of $4,500 in poison for resale in order to cover the greater than anticipated
poison sales. Funding for the increase appropriation is from unanticipated
revenue.
B-169 - Chico Munici al Court. Transfers $120 from rents and
leases of equipment to maintenance of equipment in order to cover the
cost of maintenance for a magnetic tape recorder. Also transfers $1,275
from revenue sharing miscellaneous projects to fixed assets - equipment in
order to .provide an appropriation to cover the cost of purchasing the
magnetic tape recorder currently being leased at a higher annual cost.
B-170 - Sheriff-Coroner - Patrol. Transfers $23,512.01 from
revenue sharing miscellaneous expense to fixed assets.- equipment in order
to provide funding to cover the purchase of three patrol vehicles to
replace three other vehicles that have been demolished as a result of
vehicle accidents this fiscal year.
8-171 - Revenue Sharin Transfers $14,834 from the Oroville
Meals on Wheels project in order to establish a budgetary appropriation
for the Feather River Senior Citizens as directed by the Board.
ADOPT RESOLUTION 80-100 SETTING PUBLIC HEARING DATE FOR ABANDONMENT OF
ALLEYS, EL MEDIO TRACT - HCD
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, Resolution 80-100 setting a public hearing data
of June 24, 1980 at 10:15 a.m. to consider abandonment of all alleys on
block seven, E1 Medio tract, Subdivision No. 1 as indicated on Book 6
of Maps, page 17 (Burbank School site) for HCD was adopted and the
Chairman authorized to sign.
AGREEMENT FOR DISPOSITION OF THE BURBANK SCHOOL SITE HELD OVER TO
MAY 20 1980 - HCD
Consideration of the agreement for disposition of the Burbank
School site was coni4inued to May 20, 1980.
ADOPT RESOLUTION 80-101 ESTABLISHING FAIR MARKET VALUE FOR 777 VIRGINIA
STREET - HCD
On motion of Supervisor Wheeler, seconded by Supervisor Dolan
and unanimously carried, Resolution 80-101 establishing a fair market
value of $5,000 for 777 Virginia Street, Chico was adopted and the
Chairman authorized to sign; and the Administrative Office was authorized
to begin procedures to sell the property at the appraised value.
ADOPT RESOLUTION 80-102 ESTABLISHING FAIR MARKET VALUE FOR 2523 FT. WAYNE
STREET - HCD: PUBLIC HEARING DATE SET
On motion of Supervisor Moseley, .seconded by Supervisor Wheeler
and unanimously carried, Resolution 80-102 establishing a fair market
value of $15,000 for 2523 Ft. Wayne Street, Oroville was adopted; the
Chairman authorized to sign; the Administrative Officer authorized to
proceed with the acquisition; and a public hearing date of 3une 17, 1980
at:•10:00 a.m. was set to considertthe property acquisition.
AUTHORIZE NOTICE OF NON-RENEWAL -.FAMILY SERVICE ASSOCIATION CONTRACT -
MENTAL HEALTH
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, a notice of non-renewal of the crisis and
screening contract with Family Service Association of Butte and Glenn
Counties effective with the close of business June 30, 1980 was authorized.

On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried; the transfer of the letter of credit 100221 in
the amount of $66,960 to the Town of Paradise was approved; and the return
of letters of credit 100219 and 100220 in the total amount of $23,600
to Stoneson Corporation for Stoneson Subdivision (Stoneridge No. 1) was
approved.
APPROVE CHICO URBAN AREA TRANSIT SYSTEM AGREEMENT
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, the agreement with the City of Chico for the
Chico Urban Area Transit System which provides for sharing of capital and
operating costs with two-thirds city and one-third county with the City
of Chico acting as operator of the system was approved subject to
approval by Counsel and Auditor; and the Chairman authorized to sign.
AUTHORIZE PUBLIC WORKS DIRECTOR TO SIGN ANNUAL TRANSPOR~YTiON CLAIM AND
DECLARATION - TRANSIT, BIKEWAY ANA PLANNING PROTECTS
Clay Castleberry, public works director, set out the background
of the claim and declaration to be submitted to BCAG. There were concerns
about the Section 18 money from the federal government for the inter-city
system. There was concern that the county not use the federal money for
the county operated system because of labor agreements. Mr. Castleberry
asked that the claim be changed to reflectfi1.07,400 instead of $Oj~70 and
to change $0,000 to read $8,911. They had planned a bike project £or
the .town of Durham. He did not feel that there would be sufficient funds
to cover that project.
On motion of Supervisor Winston, seconded by Supervisor Dolan
and unanimously carried, Public Worka Director was authorized to sign the
annual transportation claim and declaration for transit bikeway and
planning projects for submission•.,to BCAG with the claim changed to reflect:
$107,400 instead of $10,470 and $58,9'11 instead of $50,000.

AUTHORIZE SENDING OF-LETTER TO U.S. ARMX CCIRPS OF ENGINEERS ASKING THEM
TO REPAIR SEVERAL SITES ON THE-SACRAMENTO BANK. PROTECTION PROJECT UNDER
PUBLIC LAW 99
Clay Castleberry, public works director, stated there were several
areas along the Sacramento River bank projection project that were in need
of repair. He asked that the Board authorize a letter to the Army Corps
of Engineers asking them to do the repairs under public law 99. If the
county were to be required to do the maintenance on these sites the cost
would be between $100,000 and $200,000.
On motion of Supervisor Nosel:ey, seconded by Supervisor Dolan
and unanimously carried, the Public Works Department was authorized to
send a letter ~o the U.S. Army Corps of Engineers asking them to make
repairs on several Sacramento River bank protection project sites under
Public Law 99.
DISCUSSION AND POLICY DIRECTION - CROUCH DITCH (CHICO AREA) AND DAYTON WEST
ROAD (DAYTON AREA) SUMMARY ABANDONMENT
Clay Castleberry, public works director, stated that he had
received several calla from people in the Park Avenue area of Chico asking
the county to do something about the drainage in the area. There is no
maintenance district. The key to the drainage in the area is the outfall
of the old Crouch ditch. He-felt it would be best to accept the deed for
the Crouch Ditch. About ten percent of this area is in the city limits.
Dan Blackstock, county counsel, stated that the people would
like to give the county the ditch. If he had a liability he would want to
given it away. The county would have to assume the liability of the ditch
and also to maintain the ditch. The City of Chico would have the county
pick the ditch up and maintain it for them. The city could pick up the
deed to the ditch. There is no advantage for the county to obtain
ownership of the ditch.
Clif Nickelson, administrative officer, stated that he was
concerned about the county acquisition of the ditch. The City of Chico
has made many public announcements about annexing much of that area.
Maybe the city could take over the property. As far as the outfall,
that could be a different issue. The trading of a liability for an
asset was his concern.
Supervisor Dolan stated there were serious drainage problems
in that area, Without public ownership of the ditch it could be blocked
off at any time. increasing the problem.
Supervisor Winston stated that if the property owners would
instigate the formation of a drainage district for maintenance of the
aria he would be willing to obtain the ditch for that district.
Policy direction was for the people to pursue the formation
of a drainage district.
Supervisor Wheeler stated she would like an opportunity to
take a look at the area before the Board made a decision on the ditch.
APPROVE HAGEN RIDGE PARK SUBDIVISION
On motion of Supervisor Wheeler, seconded by Supervisor Winston
and unanimously carried, the Hagen Ridge Park Subdivision final subdivision
map, 24 lots, south side of Keefer Road, approximately 4800 feet east of
Hicks Lane, north Chico area was approved; the public utilities easements
were accepted; the drainage easements and 60 foot wide non-exclusive easements
for Donald Drive, Jac-O-Lyn Way, and Kendal Court as dedicated on the
final map were accepted; the C1a~manRa~t~horized to sign subdivision
agreement subject to the pass books being directed to the Public Works

On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, the first reading of the ordinance repealing
Ordinance 1398 relating to the establishment of a use permit procedure
for the allowance of homes described under Welfare and Institutions Code
Section 5116 was waived.
CERTIFICATE OF APPRECIATION TO BE PREPARED FOR JAMES ALTENBURG: APPOINTMENT
TO THE FISH AND GAME COMMISSION
A certificate of appreciation is to be prepared for James
Altenburg to be presented to his wife.
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, Bill D'Amato was appointed as a member of the
Fish and Game Commission for a permanent term.
APPOINTMENT TO THE CHICO URBAN AREA TRANS TT SXSTEM ADVISORY COMMITTEE
Supervisors Dolan and Wheeler Were agpointed to the Chico Urban
Area Transit System Advisory Committee.
COMMUNICATIONS
Dallas Lewis, Chico. Mr. Lewis, agent for Malcolm D. Jayred and William S.
Towne, writes appealing the Advisory Agency's mitigation measure
relating to the installation of a crossing signal at Entler
Avenue and the Sacramento Northern Railroad tracks for Southgate
Acres Subdivision Unit No. 2, AP 40-04-36 and 38, 20 lots,
south side of Entler Avenue, east of Midway, Durham area.
Set for hearing June 3, 1980 at 10:45 a.m.
Maurice C. and Lucy M. Williams, Chico. Mr. ,and Mrs. Williams write
requesting a return of drainage deposits in the amount of

Criminal Justice Information System (CJIS Policy Board). The Policy Board

Senator Ray Johnson.. Senator Johnson forwards information concerning
proposed Public Utilities Commission regulations dealing with
utility line extensions and allowances. See motion following

State Department of Water Resources. The department forwards information
concerning costs incurred by the department in investigations
of the Eel River as a source of water supply for the state water
project and costs incurred from 1976 through 1979. Referred
to the Auditor.
County of Orange. The county forwards information concerning Proposition
11, the oil profits initiative, and asks that the Board join them
in support of the measure. The Board has taken the position not
to support or oppose the initiative.
U.S. Department of the Interior. The department writes in follow-up to
the Board's letter relating to construction of a chairlift at
the Lassen Volcanic National Park ski area. Information; no
action taken.
U.S. Aepartment of Labor. A telegram has been received concerning the
removal of CETA Title IIB/C and D participants from sectarian
elementary and secondary schools. Referred to Personnel
Director for report back to the Board.
Barbara Shaffer, Oroville. Ms. Shaffer submits her resignation from
the Orovilie Mosquito Abatement District due to health and

The public hearing on revenue sharing proposed use hearing was

5. Eda Stumg, Feather River Senior Citizens. Ms. Stump read
a letter at this time. The senior citizens will be $50,000 short for
the building of their senior citizens center. They were asking for any
consideration the Board might give them. She submitted a copy of the
letter at this time.
6. Lyle Bennett, Durham Volunteer Fire Department.' Mr. Bennett
stated they had submitted a letter to the Board on April 11, 1980. They
are asking that the Board give them funds fox the following equipment:

Mr. Bennett submitted a petition from the residents of

$3,150 in revenue sharing funds to make repairs to the building, He
submitted a proposal at this time.
8. Helen Lantis, Chico Friends of the Butte County Library.
Ms. Lantis stated she was present to Iet the Board know they had not
forgotten the needs for a new building for the Library in Chico.
9. Andrea Herr, Chico Community Day Care Center. Ms. Herr
set out what the center does at this time. They are requesting $13,000
in revenue sharing funds. She presented a letter setting out the
request at this time.

The public hearing on Joe Vielbig appeal of the Advisory Agency's
denial of the proposed conditional negative declaration and tentative parcel
map, AP 58-33-09, three lots, south side of Hoffman Road, approximately
one-half mile west of Concow Road, Concow area was held as advertised.
Clay Castleberry, public works director, set out the background
of the appeal. The denial was based on the Planning Director's report
that the project did not meet the General Plan requirements, specifically
the fire requirements.
Bettye Blair, planning director, stated that this was denied
because of the fire protection information. She had provided a map of
the Concow area delineating the subject property and the proximity to
the road. The volunteer fire company is located to the south of subject
progerty.

1. Joe Vielbig. Mr. Vielbig stated that when he purchased the
property in 1964 the only fire service was the Forest Service at- r=
Garbo Gap. He built a structure well aware of the fire capacities.

JThe environmental report was favorableWon the parcel split and covered the
subject matter of fire protection. He was satisfied with. the conditions
placed on the map. He was satisified with the fire protection in the area.'
2. Mike Evans, Ron Graves & Associates. Mr. Evans asked that
the Board give policy, direction regarding the fire protection issue. There
are not really any rules to work from. He felt that a gerson should be
allowed to live where they want to live. He felt that some kind of
clear action was needed so that people would know. This property is
very suitable for a parcel split.
3. Bill Geddis. Mr. Geddis stated that he would be appealing
another project because of the same reasons regarding fire protection.
Parcels have been created for many years without benefit of fire stations.
The requirement for the project he is going to appeal that is located
on Bald Rock Road is that for a four. parcel split the project must
either have a pressurized fire system or there must be a fire pumper
truck, which is an estimated cost of $35,000. There will have to be a
solution to this matter or the Board will have to say no development
in outlying areas. The Fire Department has said that the matter of
defining adequate rests with the Board. He would like to see a formal
definition of what adequate fire protection is. He felt that another
requirement would be better. The Board might want to possibly require
an impact mitigation fee for fire protection and when there are sufficient
fees available from parcel splits to purchase fire equipment. By drawing
lines on a map there is no fire hazard created. He wondered if the Board
could attach afire mitigation to the building permit.

Supervisor Wheeler stated that she had discussed this matter
with Counsel. It was felt that maybe representatives from the Board,
Planning and Counsel sit down and go over the definition of adequate
fire protection.
Chairman Lemke stated that the same situation applies to
sanitation. Maybe a good long look at the whole process should be
forthcoming. He felt that the discussions should include some of the
local people involved with the process.
Supervisor Winston stated that there was a debate by the Board
regarding the adequacy or inadequacy of fire protection with tine adoption
of the General Plan, There was a carefully phrased statement regarding
fire protection that was placed in the General Plan that was to be
interrupted by taking into consideration that there are remote areas
where people would choose to live. The different areas that decided
they deeded fire protection formed volunteer fire departments.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, finding that although the proposed project could
hatze a significant effect on the environment, there will not be a significant
effect in this case because the mitigation measure described below has
been added to the project and a negative declaration was recommended:
1. Grading and site development earthwork to be conducted during the
dry season only.

Clay Castleberry, public works director, stated the map was
denied on the basis of noncon€ormity with the General Plan.
Bettye Blair, planning director, set out the background of
the appeal. She had posted a map on the wall. This map delineates
the subject property in read. The green on the map is the existing
Land Conservation Act contracts. At the tsme the application was filed,
the proponents were provided with the information that this project was
in conformity with the General Plan. The Board changed the open and
grazing definitions in the General Plan after that time. It was changed
from one to five acres minimum to over forty acre minimum parcel sizes.
The General Plan line falls along the creek not along the swayle. South
of the line is agricultural designation which is being considered during
the airport environs study.
Earl Nelson, environmental review director, set out the
background of the negative declaration. There are two concerns set
out in the study: the potential flooding of Rock Creek and the two
archaeological sites. The archaeological survey shows that thec~one of
the sites- is a village site. ~7...,

sites cover about three acres. This property has been farmed for the last
fifty years over those sites. He ripped the land and leveled it on

sites if there was a time limit involved for the Society to do their
work. Mr. White stated that during the other hearing the line for the
General Plan was changed from the creek to the drainage swayle. He
checked on the zoning a year ago and was advised that this project would
be in conformity with the General Plan. He was not notified that the
project was not in conformity until two weeks before the Advisory Agency
hearing.
Supervisor Wheeler stated that Mr. White wanted to place his
home in the rocks and farm the good soil. She felt the open and grazing
designation was turned around.
2. Donna White. Ms. White stated that the Board's decision
was important to them. They want to farm this area.

requirements without going into the easement. He has applied for an
abandonment of this easement. The procedure for the abandonment will
take much longer than he has to complete the project. He asked that
the Board grant him the abandonment.

Dan Blackstock, Bounty counsel, stated that the procedure
for abandonment of a public utility easement is set by Government Code.
The Board could not abandon this easement without going through the
Planning Commission. The Board could grant an exception t,~" Chapter 19
of the Butte County Code relative to septic tank systems.
On motion of Supervisor Lemke, seconded by Supervisor Moseley
and carried, the Board grated an exception to Chapter 19 relative to the
septic tank systems and determined it would not be inappropriate to
allow a portion of the leachfield to be within the easement in that
it could do no harm to anyone and the abandonment of the public utility
easement is in process at this time.

Ms. Ahart spoke regarding the letter she had sent to the Board
relative to trespassing in the Dunstone/Cox Lane area. She requested
that in the budget process that law enforcement be provided in this

declaration for Sacramento Avenue Assessment District No. 1, west of

Bob Brunsell, bond counsel, spoke regarding the funding for
the Sacramento Avenue Assessment District No,.l. The Board initiated
proceedings fox this district in 1976. In the meantime the environmental
review and the agreement with the State of California has been done.
This is a storm drainage project. The groject has a provision for
an oil. and sediment trap before it reaches the creek. The reason for
the amendment to Resolution 76-18 is a change in the proceedings act.
Originallypthe improvement act of 1911 was used and he would like to
change this to the 1913 act proceedings.

Hearing open to the public. Appearing:
1. Bill Geddis. Mr. Geddis stated that under the subdivision
ordinance, 20 acre parcels are considered as parcel maps and are allowed
to be gratted on gravel roads. County Counsel's opinion is that due to
the fact there are more than four parcels it is in fact a subdivision.
Assuming this is correct, this has to be treated as a subdivision and
there must be minimum RS-3 road standards. He did not feel this was the
intent at the time the subdivision ordinance was written. These are
twenty acre parcels and the reason for this size parcel was due to the
Fish and Game comments and environmental facts that recommended pursuing
20 acre minimum parcel size zoning. He felt a paved surface was excessive.
He asked that the Board approve an RS-7 standard graveled roadway 20-feet
wide. Dunstone and Bangor Park "Roads are both county roads which are
paved in the area.
2. Louise Ahart. Ms. Ahart spoke regarding the road conditions
in the area during the rainy season. If the roads are not required to
be paved at this time, it would be the county's responsibility. Cox
Lane was impassable from the west side during the winter . It was necessary
to bring in several amounts of gravel for the road. Percolation tests
have required that the lots be larger. She did not feel that a gravel
road would be sufficient when there is clay soil and the ability to get
traction is impossible.
Clay Castleberry, public works director, stated that the
requirement would be to pave the county road at the frontage of the
parcels. Dunstone fronts on one of the parcels. The county road is also
gravel. Paving is a little out of place in this area. He would not
say that it was not needed.
3. Bill Geddis. Mr. Geddis stated that Cox Lane is a different
road from that which will be improved. The percolation testis are sufficient
for a 20 acre parcel and for a five acre parcel. Dunstone has year-around
traversable access. It is a county road.
4. Louise Ahart. Ms. Ahart felt that Mr. Geddis was mistaken
when he said that Dunstone was a yearly traversable road.

On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and carried, the appeal of Harold Thompson, et al was denied and conditions
1 through 5 were amended to reflect 18 months on the conditions.
COUNSEL TO BRING AGREEMENT WITH SACRAMENTO AIR POLLUTION CONTROL DISTRICT
BACK TO THE BOARD ON MAY 20, 1980
Supervisor Moseley stated that the ratification of the joint
powers agreement with the Sacramento Air Pollution Control District had
been discussed.
Counsel to bring back the agreement next week, May 20, 1980 with
the provisions that Butte County would want to be involved in the
administration and responsibility for the funds.
ADDITIONAL MATTERS PRESENTED BY BOARD MEMBERS
Chairman Lemke advised the Board had received a memo from
the Administrative Office relative to the standards and training of
probation officers. The county has five days to analyse the program
and make comments.
The Administrative Officer to respond to the letter and
let them know that the county would like to request that the county be
allowed to grandfather in those employees now on-board and that this
would apply only to new employees.
OPPOSE APPOINTMENT OF RUTH L. RUSSIAN TO DEPARTMENT OF .CORRECTIONS
On motion of Supervisor Wheeler, seconded by Sueervisor Moseley
and carried, the Board supported Stanislaus County and opposed the
appointment of Ruth L. Russian to the Department of Corrections. AYES:
Supervisors Moseley, Wheeler and Chairman Lemke. NOES: Supervisor Dolan.
RECOGNIZE MAY AS SENIOR CITIZENS MONTH
On motion of Supervisor Wheeler, seconded by Supervisor Moseley
and carried, May was recognized as Senior Citizens' Month.
