Butte County Personnel Appeals Commission, Information, Durham Mosquito Abatement District, The District sends copy of its letter to Supervisor Gilman, with notification of resignation of David Kidd ~- ' from the Board of Trustees of the Durham Mosquito Abatement District. 6 ~ His term would have expired December 31, 1973. The Board recommends appointment of Robert Kidd to fill the unexpired term of his father. See motion following communications. Biggs Unified School District. The Trustees of the District request ,,,1 establishment of a 25 mile per hour speed zone from the Biggs city S V ' ~ limits on Ferris Road East to the bridge, Referred to. Public Works for handling, Local Agency Formation Commission, The Commission files resolution approving ~ 3 ~~~ d the establishment of County Service Area No, 49, County Counsel explained this item. No action taken at this time. County of Shasta, U, S, Department of Labor, Shasta County, will be prime sponsor for allocation of PEP funds for a part time summer employment Q 3 ,~ program for young people in an eight county area. The County has design- ated the current NYC staff to administer the program. Referred to Personnel. Mr, Rackerby explained the program, stating that there would, be about 47 jobs for youths this summer in this County. County of Nevada, The Nevada County Counsel forwards copy of letter to State Senator Berryhill regarding SB 544. By resolution they have 7 ~ Q ~ Z '~„ requested extension of time to bring zoning ordinances in conformity with the Ceneral Plan to December 31, 1974. No action taken at this time. Coordinating Council, Sacramento Valley Air Basin. Art Gilman, chairman,forwards copy of preliminary draft for establishment of an agreement for joint services among the districts in the Sacramento Valley Air Basin. Supervisor Gilman spoke about this agreement and suggested that Mr, Mackessey appear at the Board meeting to discuss the agreements at th~AmAe~t;n~y o,£ May 29, 1973. Brown, Chairman of Stirling City Sewer District, special Committee. $ y Request for appointment of advisory Board, See discussion and ~ 0 ~` motion of appointment following communications. 73-793 APPROVE EXCEPTION TO ORDINANCE N0, 1191, AS REQUESTED BY FRASER LOVETT, PARADISE The request of Mr, Fxasex Lovett, Paradise, for an exception to place a mobile home on his lot for use by his elderly mother discussed, Mr, Lovett explained the request. Planning Department stated that they were not~3nvolved in this matter, Mr. Lovett explained the groblem involved here, He stated that he did not know that there was not an approved access to the property when he purchased his property. Mr. Castleberry stated that he saw no problem in granting this request. On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, the exception to Ordinance No. 1191 to allow Mr, Fraser Lovett, Paradise, to place a mobile home on his lot for use by his elderly mother was approvedy for utility purposes only, 73-794 ACCEPT RESIGNATION OF TRUSTEE OF DURHAM MOSQUITO ABATEMENT DISTRICT: APPROVER THE APPOINTMENT OF A TRUSTEE OF SAID DISTRICT On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the resignation of David Kidd from the Board of Trustees of the Durham Mosquito Abatement District was accepted, with the direction that a letter of thanks be written to Mr. Kidd for his services to the County, and Robert Kidd was appointed to fill. the unexpired term of David Kidd, said term to expire December 31, 1973. Box 4, 502 Manzanita, Stirling City 73-796 MATTERS PRESENTED BY BOARD MEMBERS FOR INFORMATION Supervisor Gilman said he felt that in the interest of the people the matter of stock watering of dams should be referred to George Stamm for a report and to follow along on the matter. This concerns stock watering ponds and recreational ponds. Request set out and discussed, Referred to Mr. Stamm for follow up and to keep the Board evaluated nn its progress. Supervisor Cameron had a petition from people in the Paradise area requesting that the Dial-a-ride bus go back to its original route, Route set out and discussed, Petition referred to the Association of Governments for their consideration, 73-797 PUBLIC WORKS ITEMS APPROVED: ORDINANCE N0, 1348, ESTABLISHING SPEED LIMITS, BIGGS EAST HIGHWAY & CRANE AVENUE ADOPTED: RESOLUTION 73-79 DECLARING THROUGH HIGHWAY APPROVED AND APPROVAS. OF INCLUSION OF STREET LIGHTING IN_COUNTY SERVICE AREA N0. 47 On motion of Supervisor Ladd, seconded by Supervisor Gilman and carried, the following action was taken: 1. Adopted Ordinance No, 1348, establishing speed limits on Biggs East Highway and Crane Avenue and the Chairman was authorized to sign, ~~" 2, Adopted Resolution 73-79 declaring East Tenth Avenue a through- highway and the Chairman was authorized to sign. 3. Approved change order No. 3, Supplement 1, Paradise Pines Assessment District, 12, 13 and 14, for an extension of 15 days in working time due to the delay caused by this change order, and the Chairman was authorized to sign. 4. Approved agreement for sale, authorized Chairman to sign and authorized Auditor to issue warrant upon demand of County's escrow agent on the following: L. Sloan 0.589 acres $1,500 Impr, $515 Total $2,015, 5. Approved the proceedings to expand the functions of County Service Area No. 47, Guynn and East Avenues, Chico, a storm drain maintenance service area, to include street lighting and forwarded the matter to TAFC for action. 73-798 NO ACTION: RIGHT OF WAY ACQUISITION: ABANDONING PORTION OF ORO-BANGOR HWY, Delayed action in regard to abandoning a portion of Oro Bangor Highway and quitclaiming the property to William Robertson in lieu of all claims, now or in the future, against County of Butte arising out of the relocation or construction of the Oroville-Bangor Highway, at the request of Public Works Director. Supervisor Ladd had written a letter to Mr, Robinson with an agreement of exchange enclosed, Page 225. No action taken at this time. 73-799 ADOPT ORDINANCE NO 1349 AMENDING SALARY ORDINANCE On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, Ordinance No. 1349, amending salary ordinance to compensate the Gridley Justice Court Judge for increased services and which adds the Personnel Analyst funded under PEP was adopted and the Chairman was authorized to sign, 73-80fl APPROVE RECRUTTMENT PLAN FOR POSITION OF PUBLIC HEALTH DIRECTOR The Personnel Department has prepared a recruitment plan fox the position of Public Health Director. Mr. Nickelson explained the plan, Tt was suggested that Dr, Heindl be requested to sit in as one of the screening committee members. Plan and recruitment discussed. On motion of Supervisor Gilman, seconded by Supervisor Cameron and carried, the recruitment plan for the position of Public Health Director was approved, the Personnel Director was authorized to commence recruitment and with the request that Dr, :ieindl be made a member of the screening committee. 73-801 ACCEPT RESIGNATION OF DR= HETNDL WITH RELUC LANCE On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the resignation of Dr. Heindl, Public Health Director, was accepted with reluctance and with a letter appreciation to be sent to her thanking her for her services to the people of Butte County. 73-802 APPROVE LEAVES OF ABSENCE On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the following leaves of absence were approved: 1, A 30 day extension of the nonpaid medical leave of absence for Pauline Long to end May 30, 1973, as requested by the Hospital Administrator. 2, Authorized the non-compensated medical leave of absence for Mrs. Barbara Hood commending July 9, 1973 through September 11, 1973, as requested by the Health Officer, 73-803 DISCUSSION: ADVANCE STEP HIRING BY THE DIRECTOR OF MENTAL HEALTH A request has been made by the Director of Mental Health to hire the mental health technician at the C step of the salary range. This item was put over from last week. Supervisor Ladd stated he does not lake this business of hiring at a higher Step unless it is impossible to secure the help otherwise, Supervisor Gilman stated he would like to hear from Mr. Rackerby before action is taken. Action put over until Mr. Racherby is present. 73-804 GOLDEN FEATHER FAIR: AWARD OF BID FOR IMPROVEMENT OF FLOWER BUILDING On motion of Supervisor Gilman,s econded by Supervisor Ladd and carried,eward of bid for Golden Feather Fair Flower Building Project was granted to Donoho Refrigeration in the amount of $20,300. 73-805 APPROVE APPLICATION FOR DANCE LICENSE On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, the application of Whitney Hall for a license to hold a dance at the Odd Fellows Club on May T1, 1973 in Chico was approved. Supervisor Ladd said he did not think it was in the best interest of Page 226, May 15, 1973 r the County to waive fees on the use of the Memorial Halls, The fees merely cover the necessary things at the Memorial Halls. He feels that the £ees should be collected. Chairman McKillop suggested that the By-Laws be examined and revamped, The fees should be chec~Ced, It was suggested that comments be requested from the members of the Memorial Hall Committees, Mr, Mickelson will handle this matter o~ going through the By-laws and revamping them, 73-806 DENY RE VEST OF DIRECTOR OF MENTAL HEALTH FOR ADVANCE STEP HIRING Jim Rackerby, Personnel Director, explained the request of the Director of Mental Health for advance step hiring of a mental health technician at the C step of the Salary range, This would be the same salary that the man is receiving on the private sector of this operation. The man is trained and is qualified. It was set out that this man would be receiving Health Insurance and other fringe benefits if hired by the County. Request discussed. On motion ofSupervisox Ladd, seconded by Supervisor Gilman and ,carried, the request of Director of Mental Health to hire the mental health technician at the C step of the salary range was denied. 73-_807 APPROVE PAYMENT TO MR. ROWlnN, AS RECOMMENDE_D_ BY DATA PROCESSTNG COMt~CTTEE Mr, Rowan has submitted a request for payment for time spent on April 11 and April 23 in meeting with the Data Processing Committee, Recommendations from the Data Processing Cox~ittee wenepreviously presented to the Board at its continued meeting of April 18, 1973, however, no action was taken by the Board at that time, Dan Biackstock, County Counsel, explained the problem of this payment. He was not on contract, nor was he hired on as extxa help, He feels that it should be made known that only the Board can authaxize payment on these requests. Request discussed, On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, the payment to Mr. Rowan in the amount of $60 for services on April 11 and April 23 was authorized, 5TUDENTS FROM DURHAM HIGH SCHOOL & THEIR INSTRUCTOR, MR, SNELL, GOVT, CLASS, WELCOMED AT THIS TIME. STUDENTS OF LAS PLUMAS HIGH SCHOOL, GOVERNMENT CLASS, ALSO WELCOMED, RECESS: 10:15 RECONVENED: 10:30 73-808 REPORT BY STATE DEPARTMENT OF CONSERVAT20N: PLANS TO ESTABLISH A "CALTFORNIA ECOLOGY CORPS FACTLTTY" AT MAGALIA Mr, Drdean Monsen, local California Division of Forestry office, reported on the plans to establish a "California Ecology Corps facility" in Butte County. The. proposal is to change Magalia Conservation Corps to an Ecology Center. Mr, Jim Stanley, Ranger, Stated that the camp will be started on July I, Page 227. He expla~.ned the function of the camp, Previously this had been an inmate camp and they had been working on parks and fishing projects. They had also been working on the Magalia Nursery. The new camp will be doing the same type work. The big change will be the type of person housed at the camp, The new group of men will be made up from other type people. It is opened up for volunteers. It wall be one of Mr. Stanley's jobs to recruit and~keep the camp full. They will take people from the age goup of 17 to 31. Camp discussed; no action taken. Chairman McKillop thanked these men for their presentation to the Board. 73-809 ADOPT RESOLUTIONS 73-80 and 73-81 ABANDOMENT OF UTILITY EASEMENT, AND ABANDONMENT OF STORM DRAIN EASEMENT On motion of Supervisor Cameron, seconded by Supervisor Gilman and carried, the following resolutions were adopted and the Chairman was authorized to sign: Resolution 73-80 Giving notice of intention to abandon storm drain easement, ~ ?~- Lori Gardens Subdivision, Chico, with public hearing set for June 26, 1973 afi 1:30 p,m, ~..- Resolution 73-81 giving notice of intention to abandon public utility easement, lots 5 and 6, Lincoln Park Subdivision, Chico, with public hearing set for June 26, 1973 at 1:30 p,m. 73-810 APPROVE ELEVEN PARCEL MAPS AS RECOMMENDED FOR APPROVAL On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the following tentative parcel maps were approved as recommended, subject to the conditions of the Planning Commission: 1. Robert Stubblefield, AP 47-29-~4, 2 lots, off Garner Lane, near Hwy. 99E, Chico, Maps were set out by Mr. Lawson and conditions were discussed, Supervisor Gilman stated he would like to look at the two sites in Chico area before action is taken, Approval of maps put over one week, 73-812 PUBLIC HEARING ON GENERAL PLAN RESET TO JUNE 19th 1473 Discussed the request of Planning Commission for reconsideration of General Plan hearing date from June 26, 1973, to allow time for possibility of continued hearing, Hearing set for June 19th, 1973 at 1:30 p,m, 73-813 REPORT ON BUTTE COLLEGE VICINITY REZONING: REFERRED TO PLANNING COMMISSION MAY 8. 1973 Jim Lawson, Planning Director, reported on the Butte College vicinity rezoning that had been referred back to Planning Commission by the Board on May 8, 1973. He said that under the use permit requirements, the Commission chose to strike "commercial poultry, farms, duplex houses and multiple dwelling houses, The public hearing on this rezoning had been continued to May 22, 1973 for action. Rezoning discussed, Action will be taken at the continuation of the hearing on May 22, 73-814 APPEA_12ANCE:_ BILL TOMPSON. PARADISE Bill Tompson, Paradise, asked if the discussion of ordinance amending Chapter 19 of the County Code would be open to the public. The Board informed him that the discussion would be open. to the public, 73-815 APPEARANCE: HAROLD BRO_WN,_CREST VIEW DRIVE. PARADISE: PETITION FILED Mr, Harold Brown, Crest View Arive, Paradise stated that he represented Che protestors of the establishment of a home for the retarded in the Paradise ~~,~ area. Mr. Lawson explained the matter of these homes. It was suggested that I maybe the present ordinances should be amended; a conditional use permit should be required. Petition filed with the Clerk; no action taken at this time, Dan Blackstock, County Counsel, stated that State Legislature had bills that would amend the Welfare and Institution Code concerning these homes, Amendment read and discussed, He said he hoped to have a more detailed report to the Board in the next few weeks. He is going to attend a workshop where this will be discussed, Chairman McKillop suggested that the Board pass amendments Page 229, May 13, 1973 .. ., .. ~-----------Ma~+13, 1973---- ~---- --__ ,- - to the present ordinances that would require a use permit for these homes. Suggestion discussed, County Counsel will proceed with the wording for the amendment to the ordinances, Mr, Sterling Grigsby, Crestview Drive, Paradise, stated he had circulated the petition for this petition. Mrs, Katherine Best, Paradise, suggested that the people write to the State regarding this matter. The people will send a copy of the petition to the State, , 73-816 APPEARANCE: HELEN HILKE-REMOVAL OF TREES IN THE PARADISE AREA Mrs. Helen Hilke, Paradise, stated she was present to represent the people that are concerned about trees in Paradise, She presented pictures 1 ~ ~,~ of trees that had been cut down along Clark Road, The County had directed the developer to cut down the trees for the widening of the road in front of the development, She asked if the tree committee had been called in to consider the cutting down of these trees. She set out the matter of removal of trees for roadways and developments and- requested that the County take some positive action to restrict the taking out of these trees. Mrs. Hilke had a petition with 50 signatures, which supports the request to curb the taking down or cutting of trees, Mr, Castleberry spoke to this matter, He said that many of the roads in the Paradise area are too narrow for these developments. The road in question should be a ~S-lane road today, He said that perhaps it would be good to have the trees replaced, Removal of trees for widening of these roads discussed. Bertha Smith, Paradise, also spke on the matter, Supervisor Cameron said he would like to see a study made for the replacement of trees that are cut down, At this point the matter was taken under consideration and a plan will be prepared for consideration of trees in the Paradise area. 73-817 APPEARANCE: DEAN COFER, OROVILLE, ON BEHALF OF THERMALITO RESIDENTS: APPOINTMENT OF ERNEST REYNOLDS TO FILL VACANCY ON THERMALIT6 IRRIGATION DISTRICT Mr. Dean Cofer, Oroville, said he was present on behalf of a group of residents of the Thermalito area, They request that Mr. Ernest Reynolds be I ~ ~'~ appointed to fill the vacancy on the Thermalito Irrigation District. He presented petitions signed by the residents in that area; there are 623 registered voters names on these petitions. These people feel that Mr. Yarbrough should not sit on this Board as he is not a freeholder in the District. They have filed the charges with the Attorney General, Mr, Yarbrough is moving from the district, r Mr. Cofer called upon this Board to declare Mr. Yarbrough`s seat vacant as of today. Mr. Blackstock responded to this request, Mr. Blackstock stated that until the Attorney General's Office had taken action, this Board is not in a position to make a decision. Mr. Blackstock explained his views in this matter. No action taken at this time, 73-818 APPEARANCE: JAMES HANSEN OROVILLE Mr, James Hansen, Oroville, spoke about Iaws that are on the books before the State and Federal Government that try to do away with the ownership Page 230. May 15, 1973 May I5, 1973 of hand guns or shot guns, He Set out new legislation concerning registration of guns, He said he would like to see the Board question some of the new bills concerning guns, Matter discussed; no action taken. 73-819 APPEARANCE OF PHIL MACE, ATTORNEY AT LAW, PARADISE, REPRESENTING LYNN AND MARJORIE NOFF. PARADISE, Mr. Phil Mace, attorney at law, representing Mr. Lynn Noff and Marjorie Noff, Paradise, passed out a statement to the Board members concerning illegal parcelling of property without the filing of a parcel map. They are requesting the issuance of a septic tank permit fora trailer home that is to be placed on their 55 acres of land, It will have its own septic tank system, The County has requested that Mr, Noff sign certificates that he will not violate the county laws concerning the splitting of lots, in return for the septic tank permit. Mr, Mace explained the problem_ Mr, Blackstock explained tfie document that Mr. Noff is being requested to sign. Ile had prepared this document for people placing these homes on this type parcels of property. Mr. Mace said he did not see where the wording on the affidavit serves any purpose, Problem discussed, Howard Toussaint, County Sanitarian, stated that this statement does not relate to mobile homes, it relates to a second dwelling on one parcel of land, Chairman McKiliop felt that no action should be taken on this item until the Board has held the discussion of the ordinance amending Chapter 19 of the County Code, N 73-820 DISCUSSION: ORDINANCE AMENDING CHAPTER 19 OF THE COUNTY CODE Dan Blackstock, County Counsel, explained the proposed ordinance amending Chapter 19 of the County Code, The ordinance is limited to a rather vague field, He said he could not promise that this ordinance would be easy to regulate, This concerns two living units placed on one septic tank, Mr, Blackstock set out the areas that they would be permitted, Discussed whether one of the homes would have to be a conventional home or if both could be mobile homes, It was stated that they both could be mobile homes. The ordinance will be modified to state that the single family residence could be a mobile home or conventional type residence, Proposed ordinance discussed. Mr, Blackstock explained the purpose and meaning of the proposed ordinance. People appearing to speak regarding the ordinance: 1. Mrs. Bertha Smith, Paradise, She stated that she was against the placing of mobile homes in any area where there is a residence at this time. She set out her objections, She feels that the County will have a Lot of problems on their hands if this is pushed through, 2, Mrs, Gerda Holmes, Paradise, She opposes this proposed ordinance, 3. Mr. Bill Tompkins, Paradise, He questioned the Board about septic tanks and leach lines for the additional. dwelling, He was told that the County would not require a separate septic tank for the mobile home. He feels that there should be some limitation for only one trailer, Page 231. May 15, 1973 May-15,-1973 Proposed ordinance discussed. It Was felt that the ordinance should be re-worded, The Board members felt they could not vote for this ordinance at this time. Matter to be further discussed following the noon recess, RECESS: 12:35 RECONVENED; 2;00 p,m, County Counsel suggested establishing a variance procedure within County Code Chapter 19 itself which would have the same results as the proposed ordinance. One advantage of this would be that each case would be examined individually, but a disadvantage would be the additional required hearings, Variance to Chapter 19 discussed. Supervisor Gilman felt with the variance procedure, the Board could hear the objections to each case, and could evaluate each one individually. County Counsel stated that a variance would be doing two things: allow haoking on the same septic system, and granting a variance as to the square footage involved. Bertha Smith, Paradise, questioned whether neighbors would be notified if a variance is requested. County Counsel stated that a public hearing would be held, which requires publication, County Counsel was requested to prepare a variance to Chapter 19 and present it to the Board next week for their consideration, -" 73-821 ADOPT RESOLUTION 73-82, MAKING APPLICATION TO LOCAL AGENCY FORMATION COMMISSION FOR ANNEXATION OF TERRITORY TO COUNTY SERVICE AREA NO 18 C1if Mickelson, administrative officer, explained the proposed resolution, Service Area 18 is a lighting district off the Old Quincy Road. Public Works has recommended that this annexation to Service Area 18 be referred to LAFCO. Official action must be taken by the Board enabling LAFCO to act on this. On motion of Supervisor Gilman, seconded by Supervisor Cameron, and carried, Resolution No, 73-82, making application to Local Agency Formation Commission for annexation of territory to County Service Area No. 18 was adopted, and the Chairman was authorized to sign. 73-822 PHIL MACE REQUEST REFERRED TO COUNTY COUNSEL . Matter that was brought before the Board earlier by Phil Mace, was referred to County Counsel for research and a report to the Board, 73-823 APPROVE REVENUE SHARING PROPOSAL Clif Mickelson explained the Administrative report on revenue sharing, which outlined the actions that will be required regarding proposed use reports ~to be filed with the Treasury Department, and some of the budgetary problems Q ~,Z which will face the County. $1,033,000 of capital projects would be budgeted, Mr, Mickelson explained that any action taken by the Board at this date is only advisory, and can be changed at a later date. He set out the time line by which the Board is required to take action, Discussed. Dan Pellicotti felt that before any revenue sharing funds be spent, the Board should wait until the Hospital override and bond issue election and until then put the money into savings, where it can draw interest, Administrative report discussed, Clif Mickelson stated that the recommendation gives the Board flexibility. On motion of Supervisor Gilman, seconded by Supervisor Ladd and carried, the revenue sharing proposal as set forth by the Auditor and Administration was approved, the Chairman was authorized to sign the planned use report, The report will be published, designating the revenue will be used for public safety. 73-824 BUDGET TRANSFERS APPROVED Clif Mickelson set out the budget transfers before the Board, Transfers discussed, Budget transfers B-146 and B-147 were put over.and Administration will report back to the Board on these transfers, On motion of Supervisor Camernn, seconded by Supervisor Ladd and carried, the following budget transfers were approved: B-145 - County Buildings-Memorial Halls, transfers $1,350 from salaries and wages and $2500 from Reserve for Contingencies to Utilities and Overtime and $750 to ixansportation and travel 8-148, Paradise Justice Court - $100 from transportat'on to P ofession & 73-825 APP ROVE AMENDMENT TO MEDICAL DT RECTOR'S CONTRACT Special ~ervices County Counsel reported that the amendment to the Medical Director's contract to have his on-call and over-time spelled out in the same manner as for other doctors at the County Hospital had been prepared as requested. Mr, Mickelson reported that Planning had sent the fraternity a letter this morning, Chairman McKillop stated that the Committee of Supervisors Gilman and Ladd had investigated the possible purchase of the Safeway store building in Oroville, The committee was authorized to negotiate a price with Safeway and bring it back to the Board for consideration, Mr, Mickelson reported that the letter to Chico City Counsel relating the Board's concern regarding the contract with Duncan & Jones was ready for the Chairman's signature, Page 233.
