though this is a continued downparceling of the County's rural areas.
The General Plan indicates two categories of open space in non-urban
areas: 1) multiple use open space and 2f permanent open space.

76-791 APPROVAL OF TENTATIVE 8UBDIVISION MAP: EDEN PINES SUBDIVISION
Discussion was held oa the Eden Pines Subdivision, 24 lots, vest side
of Peata-Magalia Highway, south of intersection of Skyway, Paradise.
John W. Hamby, Surveyor,,protested Condition No. 6, requiring
36 ft, of paving. He stated that this is in ezceas of the normal requirements.
Mr. Hamby also protested Condition~No: 8 requiring street lights, and Condition
No. 19 to provide for es:ergei-cy 'circulation to Pentz•Magalia or Clark Road.
Clay Castleberry, Public Works Director, stated that the department
could live with a 38 ft. paved road but that the 36 feet would be better as it
wonid provide room to park on the ptreet. Supervisor McKillop stated that
the 28 ft. width was within the ordinance. 3upervisox Richter felt that the
street should be the proper width. Mr. Castleberry felt that the developer
should put up a barrier.
Mz. Castleberry stated that on the natter of the street lights, `
Mr. Hamby and/or the developer'couid post the coat of putting the lights
in when the people want them. ,However, Supervisor McKillop felt that the
condition should stand. as it ie now written. Mr. Hamby stated that
Condition No. 19 could be dale#e$ because in an emergenc7 a fence could be cut
to provide an escape route. Supervisor Richter's feeling was that the County
should not create subdivisions thaE will put people in danger.
On motion of Supervisor McKillop, seconded by Supervisor Ladd and
carried, the following tentative subdivision map was approved with the
following changes to the conditions: ;Condition No. 6 be amended to a 28
foot road instead of the 36 foot,ae it now states; that Condition No. 2 be
amended to requite a barricade, and that condition No. 19 be deleted and
all other conditions standing as 'they are listed, with the finding that they
have been found to be consistent with~the Butte County General 81an and that
a negative declaration has been filed with tha.County Clerk:

The public hearing on the Philip A. LaGrow and Jaha G, Schlieper appeal of
Planning Commission's determination to require an Environmental Impact Report
for resoning from "A-2" (general) to "R-3" (medium density residential) for
1.8 acres, more or less, approximately 330 feet west of Horseman Ave., approzimate-
ly 660 feet north of Lassen Ave., identified as AP 44-38-99, Chico, was held
as advertised. Jim Lawson, P1Inning Director, net out the background of the
requirements and stated that the Planning Commission had voted S-3 in favor oP
requiring an EIR,
Hearing opened to the public.
Appearing:
Sohn Schlieper and Philip R, LaGrnw, appeared to explain their
reasons for the appeal. They feel that because in the immediate area there have
been similar projects that have not required an EIR, it would not be equitable
for the County to require them to provide an EIR. Mr. Schlieper and Mr. LaGrow
showed the Board members a map that set nut their property and those properties
that had not beed+ required to file an EIR.
On motion of Supervisor Richter, seconded by Supervisor Ladd and
carried, the appeal of John Schlieper and Philip R. LaGraw xas upheld sad
an Environmental Impact Report on the resone from "A-2" (general) to "R-3"

Everd McCain appeared before the Board and explained that hie client had ^
not received the notice of hearing and. therefore, did sot attend the public
hearing last week. Mr. McCain asked that it be put back oa for a new hearing as
they would like the oppartuniky to "let the Hoard know about a few things".
Daniel Blackatock, county couaael, stated that if he did not receive
the entice of public hearing, be would have to have a new hearing.

76-795 APPEARANCE: lUY JOHNSON FROM BOBS DISPOSAL
Mrs. Jahason spoke to the Board regarding Bob's Disposal contract
with the Chico State University at Chico. The contract does not expire until
1977; the problem being that the post of the service for the university does not
correspond with the cost of providing the service. t'Jrs. Johnson explained that they
had bid the fob and had been awarded the contract two years ago sad at that time
did sot contemplate an fncreaae is coat. She had explained to the University
officials that an increase of $1.D0 a load would allow them to service them
oa a break-even level, but that Sob's Disposal could not service them oa a
money-losing basis. Mrs. Johnson explained that the contract does not allow
for an increase. Mrs. Johnson requested that the Board consider granting Bob's
Disposal permission to empty the boxes for $3.00 per load, on a Cemporary basis.
76-796 APpEA_RANCE: FHIL STARK, p[)RCHASING OBBICER-CHICO STATE UNIVERSITY
Phii Starr stated that he was st the meeting to verify the terms
of the contract with Sob's Disposal Service. The Seatc allows the University
to enter into a contract such as this for as long as three years, and only
the State could cancel the contract. He stated that were they to allow an
increase in the rate it would cost the taxpagera more mosey in the long run,
and would not be sound business. The contract between Sob's Disposal Service
and the California State University at Chico is solid and sound.
Supervisor Richter stated that Che burden was being shifted to the
taxpayer; Supervisor MclCillop agreed and said that the cost would be shifted
to the Butte County property owners. Supervisor Ladd stated that this is
private industry and is private industry there is a chance that prices could
go up or down; he could not see how the County of Sutte could give relief in
this matter. Supervisor Ladd said that the University was using good fiscal
sense and should sat be critised for this.
Mr. Starr said the Board's mews were much the views of the
university and they would be happy to meet with the Board and discuss this
matter.

James Hasson, s Butte County taxpayer and s California taxpeger,
suggested that the Board visit or study the Burt County, Illinois policy
on revenue sharing. Be said that the appointed officials of Butte County should
be elected instead of appointed so that the people could have a voice in
eheir being or not being in a policy making position.

UTILITY ALLOCATION THROUGH 1977
On motion of Supervisor Ladd, secomded by Supervisor Richter and
carried, Resolution 76-91 concurring with Oro Dam Boulevard Underground
Assessmene District and reconfirming Oroviile'a use of the County's underground
utilikp allocatiom through 1977 was adopted amd the Chairman was authorized
to sign.
76-800 QUESTION FOR SENIOR CITIZENS IN PARADISE, AITTHORiZED
Questionnaire i9 to obtain information on senior citizens needs
and preferences for a public transportation system. Questionnaire to be
distributed through the Recreation DeparemenC and senior citizen's organisations.
Public Works is proposing s Iarge'posteard with return postage paid.
Clay Castleberry, Director of Public Works. explained the proposal.
Proposal discussed. Supervisor Ladd felt that this would be as unjustified
expenditure. Supervisor McKiliop felt it would be a good proposal. Chairman
Cameron felt that it would be helpful in forming a public transportation system.
On motion of Supervisor Richter, seconded by Supervisor McKillop and
carried, questionnaire was authorized to be distributed,swith•return postage
paid, as proposed by Public Works. -
76-801 PUBLIC WORKS TO SUBMIT GRANT PRE-APPLICATION FOR RURAL PUBLIC TRANSPORTATION
PROJECTS PROGRAM
Two grant pre-applications have been prepared to assist the City of
Oroville and citizens of Paradise in securing transportation for senior citizens
and the handicapped. The Oroville program (subsidized taxi system) is in the
amount of $24,012, with $9,288 county participatiom. The Paradise program
(subscription and reservation system) ie for a total of $64,475 with $27,000
Lncal participation. Grants discussed.
On motion of Supervisor Richter, seconded by Supervisor McKillop and
carried, Public Works was authorized to submit grant pre-applications.
76-802 GRANT OF LICENSE FROM CITY OF CHICO-IASSEN_AVENiJE_ ASSE5SMENT DISTRICT
In order to bore a storm drain wader the Sacramento Northern Railroad,
which is on City of Chico property, a grant of license has bees prepared by the
city; County Counsel, Auditor gad Public Works have reviewed document and find
it satisfactory.
On motion of Superviror Ladd, seconded by Supervisor Richter sad
carried, grant of 1lcenae from City of Chico was approved and the Chairman
authorized to sign.

CCO #3 is the increasing amount of $400 provides for reimbursing the
contractor at the rateof $0.80 per hour for one kraiaee'a participation in
the Equal Employment Opportunity training program. This is a federal

76-804 APPROVE RIGHT OF WAY ACQUISITION, ORO QUINCY HIGHWAY 6 RELEASE OF DEPOSIT
FOR LORNA HEIGHTS SUBDIVISION
On motion of Supervisor 13cRillop, seconded by Supervisor Richter and
carried, the following action ass taken:

1. Approved agreement for sale. authorised Chairman to sign and
authorized Auditor to issue warrant upon demand of County's escrow agent
on the following:

2. Authorised Public Works to release deposit furnished by developer
to guarantee completion of the work oa Lorna Heights Subdivision 12 195s enst of

76-805 LAEE MADRONE WATER DISTRICT 7 500 LOAN: DISCUSSED
Dan Blackstock, County Counsel, gave the Board details of the
legality of the Lake Madrone Water District proposed loan of $7,500. 8e
stated that for the long term effect the Soard should favorably consider the
loan. Supervisor Ladd questioned the security of the loan. Mr. 8lackatock
said they have not yet formed or established a tax rate, and when the rate
is set it could be set to take care of the loan. Mr. Blackstock thought
that it would be good busincas to make the loan to the Lake Madrone Water
District. County Counsel to report back on the matter.
76-8D6 ROSEBEN AVENUE CURB ~ GUTTER BIDS REPORT: BiD AWARDED
Public Works reported oa the bid opening for IIoaeben Avenue
curb and gutters, Project 25505P•76-1. Bid of Silva & Richter Co. was
the lowest bid.
On motion of Supervisor Richter, seconded by Supervisor McKillop
and carried, the bid for the Roseben Avenue curb and gutter project was
awarded to Silva and Richter Co., in the amount of $27,227, as recommended
by Director of Public Works, and the Chairman was authorised to sign the
contract.
76-807 COUNTY COUNSEL TO ACCEPT CHECR IN TSE AMOUNT OF $500 IN MATTER OF
COUNTY OF BUTTE VS. STANSBIIRY
On motion of Supervisor Ladd, seconded by Supervisor Richter and carried,
County Counsel, Daa Blackstock, Couatq Counsel, was instructed to accept the check is
in the amount of $S00 for damages to a stop light in Butts County.
76-808 DISCUSSION OF HIGHLANDS PARK SUBDIVISION LITIGATION
Dan Blackstock, County Counscl, stated that the Highlands Park
Subdivision law suit had been continued to Juae I1, 1976. Supervisor Richter
said he would like to nee as end to these delays; he is anzioua for a decision
is this case. Case discussed; ao action seeded.

76-809 DISCUSSION: GRAND JURY DECISION ON THE NAROOTICS TASK FORCE INVESTIGATION
Chairman Cameron stated that the Board had asked the Grand Jury to
give the Board a report on the Narcotics Task Force. It was stated that
a report should be received by budget time.
76-810 BICENTENNIAL DISPLAY-STATE FAIR: PUT OVER ONE WEEK
The discussion oa the Bicentennial display at the State Fair was
put over ko Tuesday, May 25, 1976.

76-812 ANNOUNCEMENT: UNTFOBM HOUSING CODE
For the benefit of the people in the audience, Chairman Cemeran
announced that the Board had taken action this morning in relation to the
Uniform Housing Code. They rescinded their previous action, waiving the
first reading of the ordinance. At this time,t-o hearing is required,
76-813 HEARING: NEW SUBDIVISION ORDINANCE (Continued from 4/21/76
Hearing on Che new subdivision ordinance vas opened and County
Counsel commented on the meeting held yesterday afternoon by the committee.
The committee vent through the ardinanee and made some recommendations
about the proposed ordinance. Suggested change^ set out and discussed.
Creation of uoususl parcels to be included in the ordinance. Clay Castleberry,
Director of Public Works, said he was not ready to recommend approval of all
the changes as set out by the committee. Purpose of the provisions within
the ordinance e~:plained by County Counsel.
The paragraph to eliminate the statute of limitation discussed.
Mr. Castleberry suggested chat the Board not take action on this at this
time. He will find nut what other counties ass doing in this matter.
The fifth recosm~endation relating to cul-de-sacs discussed.
Mr. Castleberry felt this needed further review.
Recommendations for changes to she proposed ordinance set out
and discussed.
No action taken on proposed changes at this tine.
76-814 DISCUSSION OF UNIFORM HOUSING CODE
Discussion of Uniform Housing Code opened at this time. The
Chairman again stated that the Board had taken action this morning by
rescinding their previous action, The Board will not adopt the ordinance
at this time.
County Counsel spoke to the natter of the mandate within the
Uniform Housing Code. In 1970 the State passed a statute that stated that
the respective Boards of Superrrisors would adopt a Uniform Housing Cade.
As a matter of law. the Uniform Housing Code has been in effect since
1971. Background of the Code set out by Mr. Blackstock. He did not
think a new ordinance vas nectssary of this tine.
Hearing opened to the public at this tine. Appearing:
1. James Hanson. He stated that he understood that this was
derived from a State mandate program. Opposition to the proposed ordinance
sat out by Mr. Banana.

2. DeYere Pace, Ck~ico, representing Butte County Farm Bureau.
He thanked the Board for their quick action taken this morning; this
indicates to him that the Board is responsive to the wishes of tine people.
3. Guy Hart, Oroville.- Expreeaed his feelings regarding the action
taken by the Soard this morning. He stated that he has bees concerned with
the Uniform Housing Code since 1970. By ignoring this code, he has learned
to live with it. He felt that any changes might switeb the power of
enforcement to the local level. He requedted that the Board continue to work in the
way they have been working.
4. Mr. Moxie Shirlep; his wife read the argument against the
Uniform Housing Code. Statement filed with the Clerk.
5. John Rowlias, speaking in opposition to the proposed ordinance.
6. Al Appleman, spoke in opposition.
7. Glenn Douthit, Oroville, speaking in opposition to the ordinance.
He suggested that the Boatd_~lace oa the ballot thiq Navember.Charter
amendments which would give the taupayers a legal staff to defenfl and
represent. them and another amendment to provide for maximum protection for
the protection of life and liberty for the property owners. Statement
setting out his suggestions read and discussed.
$. Donald Doersehlager, who presented the Chairman with a
affidavit sad asked the Chairman if he wan upholding Che California
Constitution. Supervisor &ichter objected to Mr. Doerachlager's remarks.
Mr. Doerschlager set out bis objections to the IIniform Housing Code
proposal.
9. Mr. Frank Wilkey. He said that the Palermo School employees
are in favor of the Butte County Farm Bureau's statements.
10. Mr. Roy Carne. 8is concern was that ao one knew about thin
hearing until yesterday. He suggested that every newspaper be notified
whey the Board holds these meetings oa matters that affect everyone in
the County.
Supervisor Richter informed the people chat there would be
discussion next week on a proposed charter amendment.

76-815 PUBLIC HEARING: BODNET WORTBIDIGTON-APPEAL OF SUBDIVISION COMMITTEE'S
DETERMINATION TO FILE NOTICES OF VIOIATION ON PROPESTY LOCATED ON WEST SIDE
OF MAXWELL DRIVE, SOUTH OF GREENWOOD DRIVE. PARADISE
The public hearing oa the Rodney Worthington appeal of Subdivieioa
Committee's determination to file Notices of Violation on property located
oa the west side of l:axwell Drive, south of Greenwood Drive, Paradise
(identified as AP 53-03-40, 41, 6 42) was head as advertised.
Mr. Rodney Worthington appeared and requested that the hearing
be continued two months. Purpose of the request net out.
Aa no one appeared in opposition, the hearing was continued
to Tuesday, July 13, 1976 at i:30 p.m.

76-816 AWARD OF BID: MONITOR SYSTEM
Sids have been received for the purchase of a monitor system for the
CCC,J Communications Grant, with the low bidder being Singer, Inc. in the
amount of $7,802.66. Charles Olson, Communication Systems Engineer, reported
on the bide.
On motion of Supervisor McKillop, seconded by Supervisor Ladd and
carried, the bid for the monitor system for the CCCJ Ce~unications GranC
was awarded to 9iager, Inc. is the amount of $7,802.fi6.
76-817 FURTHER DISCUSSION; NEW SUBDIVISION ORDINANCE
Supervisor McKillop suggested that the Board members be allowed
further time to study the ardinaace and recommended changes thoroughly
before they are further discussed. The comments had been received only
this date by the Board members and they have not had a thence to study them.
Supervisor Ladd said he would like to see the ordinance prepared
with the proposed changes set out to show the changes.
Time spent discussing how the proposed ordinance should be
prepared for the Board's consideration.
Hearing continued to June 16, 1976 at 10:00 8.m., fallowing the
BCAG meeting.
Gary Lippincott said the surveyors had only received s copy of
the ordinance about a week ago sad they would like an opportunity to
study the ordinance sad theq offered their services Co help the County in
this matter,
76-818 INFORMATION ITEMS
Chairman Cameron announced that he bed received a memo stating
that the Senate Bill 1500 had been defeated in the Senate today.
Chairman Cameron said that this morning it had been stated that
a meeting would be held in Torrence this Friday oa Emergency Medical
Services. He asked if the Board wanted to have any in-put into this
meeting. Dr. Enloe will be requested to sead.the Board's in-put to the
meeting. Mr. Nickelson will inform Dr. Enloe a# the Board's viahes in this
matter.
