at collecting would apply for a license.
4. Ervin Tarr. Mr. Tarr stated that the collectoxa~had a
meeting end had drawn up the~additione to the ordinance. They did
this wbthout benefit of counsel. Counsel should take the draft
proposal and come up with something.
County Counsel to meet with Public Works, Sanitarian, and
representative from both factions of the•collectora and go over the
ordinance and come back to the Board next weitk, May 24, 1977 at
1:30 p.m. following revenue sharing hearing.
5. Bd Johnson, Butte County Disposal. Mr. Johnson stated
that he had seC down with the collectors during discussion of the
ardiaance. He could see nothing wrong with the original draft of
the ordinance.
6. Elmer Johnson, Chico Butts Disposal. Mr, Johnson
stated that rates for commercial business cannot be regulated as
it can be in residential. Mr. Penny should Iook around or negotiate
with his present vendor if the price ie too high.
Gene Penny invited the Board members to attend the Northers
California Counties Supervisors Association meeting in Tehama County
on June 9th and 10th.
7. Bd Johnson stated that he would like to make a proposal
to the Board, Ia view of the changing of Neai Road Disposal in the
near future and the cost. The Board should Iook at setting up a dump
fund. There could b3 an increased dumping rate placed on the collectors
and the excess money be used for the transfer to the new site.
8. Elmer Johnson stated that this should be done immediately.
The Neal Road site might be extended for a time if a study were made.
Hearing on the Ordinance closed at this time.
Discussion of mountain transfer stations had at this time.
Butch Pritchard stated that the ideal situation in the
mountain areas would be to have a free dump but this is not feasible.
The Daly other way the dump could be run titouldm~e to place a man
at the•dump and pay him. The dump would have to be closed if there
were no possible way to do this: Garbage collection could be collected
and drop boxes•placed at Butte Meadows. The Boreat Service at Butte
Meadows would be happy to bid for the services to the camp grounds.
Supervisor Lemke stated that Sterling City had baked that
decision concerning the dump be delayed eo that theyrcould work with
the Forest Service.
Malvin Morris stated that if the mountain transfer statioae
are closed down and for some reason the Board decides to open them
again he would Like to have first chance•at them.
On motion of Supervisor Winston, seconded by Supervisor Madigan
and carried, the mountain traiu3fer statioae are to be•closed delaying
the closure 60 days is accordance with the recommendation of Public
Works Director, that refuse coilectioa•be teztninated with the contractor

Discussion of the Droviile Transfer Station had at this time.
Clay Castleberry, Public Works Director, set out the background of the
contract for the Oroville traaafer station at this time. Thin was
bid on a competitive basis and there were three bidders. The contract
has •a •90-day termination clause in it. It waa set up on a tonage basis.
Hearing on the Oroville transfer station open to the public.
Appearing:
1. Elmer Johnson. Mr. Johnson stated that there are two
possiblitiea for Oroville transfer stations ~o close down and put
out to bid, The Board closed to mountain transfer stations.to get
them off the tax rolls and you are talking about closing the OroviIle
trans€er station to get it off the tax rolls. Mr. Johnson stated
that he was sure that Melvin Morris could run•the Oroviile transfer
station and get it off the tax rolls as he did with the Drd Ranch
trans£ex station.
2. Ed "Shiappari, Oroville traaafer station. Mr. Chiappari
stated that he had bid oa the ,fob of the traaafer station 3 1/2 years
ago and now the Board wants to change their minds. There has been a
great investment made in Che transfer station. Mr. Chiappari stated
that he operates the transfer station and is also a private collector.
There is no difference between him dumpingtreskii and anyone else. He
has to charge himself for dumping the trash.
Mr. Castleberry stated that the Board could sit down and
discuss raising the gate fees to help•6ffset the tax rates.
Discussion of subsidizing the Orovilie transfer station had
at this time.
Oa motion of Sugervisor Lemke, seconded by Supervisor Moseley
and carried, a motion of intent to terminate the Oroville transfer
station ccatract at the end of 90-day period was approved.• AYES:
Supervisors Lemke, Madigan, Moseley and Chairman Richter. NOES:
Supervisor Winston.

RECONVENED: The Soard reconvened ~Cllizl5a.m, folbotiTing an executive
session to discuss litigation. Discussed where the terms
of the Holcomb agreement and how to proceed concerning the
Louisiana Pacific 11Cigation.
77-999 DISCUSSION: USE OF OROVILLE RESERVIDR•WATER TD CONTINUE FISH
SPAWNING AND KEEPING THE DELTA SALZNITY DOWN IN VIEW OE THE DRAUGHT,
Dan Blackatock, County Counsel, stated that he had bees
approached by the Agriculture Commissioner and that the estimated
effects of the draught that are directly traceable are $20 to $40
million, The Water Contractors Association is asking far some
type•of direction. The Oroville Reservoor is on a down plane to
provide for fish spawning. The water used for this has ao purpose.
The water is being taken out of the reservbir to control the salinity
in the delta.
On motion of Supervisor Lemke, seconded by Supervisor Moseley
and carried, the Board will make•avery effort to curtail lose of Iocal
water by whatever means possible as far sa•release of Oroville Reservoir
for flushing out of the delta based upon needs of users dawaatream.
