COUNTY OF BUTTE ) The Board of Supervisors met at 9:00 a.m, pursuant to adjournment, Present: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke. C1if Mickelson, administrative officer; Dan Black stock, county counsel, by Jim Griffith, deputy county counsel; and Clark A. Nelson, county clerk, by Cathy Pitts, assistant clerk to the Boardo Pledge of Allegiance to the Flag of the United States of America. Invocation by Supervisor Moseley • 831 APPROVAL OF MINUTES 79• On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, the minutes of May 15, 1979 were approved as mailed with the addition to minute order 79-818 of the words was approved. 832 (DISCUSSION: REPORT ON PROBLEMS IN THE MENTAL HEALTH TRANSITIONAL LIVING Dr. Maguire, director of Mental Health, stated that during the last six weeks there have been a series of six meetings. Last Monday the subcommittee of the Mental Health Advisory Board met to see if there was any way to resolve the problem between the local operators and Mrs= Dematteis. It was not workable. The operators were asked to submit proposals and this would be done on a competitive bid basis. Dr. Maguire stated that there was a meeting held last night that involved five members of the Mental Health Advisory Board, two staff members and two members representing CARCH. There were six proposals considered including one from Mrs. Dematteis. The selection committee voted to recommended two proposals: Carleen Barksdale, a 13-bed and a 6-bed transitional home; Mrs. Josephine Hartje, a 6-bed transitional home. He was satisified with the process. At this point, staff has to sit down with the proposed contractors and develop contracts. There is $55,000 for next year for the transitional living program in the budget, Dro Maguire stated that Mrs. Barksdale's 13-bed facility-was a long term facility for the more difficult to manage who require more supervision, The proposed contractors have requested about $34,000 for a starter cost. Tom Boffman, director of Community Living Center, stated that he Butte County Mental Health Services is submitting an application on ehalf of Community Living Center. It was on the basis of this proposal :hat the funds were approved by the state. He felt that if the county sere not going to use the original proposal, they would run into a few problems. The intent of the law that was passed by the legislature was to o to the county agency or a non-profit organization. it was not the ntent of the legislation to assist in development of private homes. e wondered whether the state would allow for the remodeling of private owes at the taxpayers expense. This would be upgrading their homes and ncreasing the property values. The Board on Marah_2 7, 1979 expressed a esire to have this type of program. He wondered why the operators in utte County were not upset in December and January when this plan was ubmitted to the state. Chairman Lemke stated that he hoped that these matters had been nought up during the committee meetings that had been held. As far as he legal status of the proposal is concerned, this will be left up to ounty Counsel and Dro Maguire. Mr. Boffman stated that he will be contacting his attorney as e felt that a contract was made•and the funds were obtained because of their roposal. Page 345:> May 22, 1979 833 _ _ _ _ _ May_22, 1979 'PROVE 1979-80 MENTAL HEALTH PLAN AND BUDGET FOR SUBMISSION TO THE STATE Dr. Maguire set out the background of the budget at this time. There have been four revisions of the budget in the last six weeks. This has always been a problem because they are totally dependent on the level of state fund so The dependence is becoming more total. He hoped that at some point there will be a more confirmed and stable funding for the mental health services. Some time ago, the county developed almost a complete capacity of providing services. One gap-:-has been the reliance on the convalescent hospitals. He hoped that long term care facilities will fill that present gap in services. Many counties are dependent on outside resources. The phasing down of state hospitals will have an impact on how much money Butte County will receive. The administration has changed their position for the next three years and there will be no county money for. mental health, alcohol and drug programso There will not be state funds for the $170,000 of county match that was lost and those programs will not be able to be developed next yearn There will be $100,000 to $119,000 that will be for specific programs. It will not include Rape Crisis and child services. They may.- be able to improve the 6-bed adolescent facility to increase it by 13 bedso That is the only prAgram that the advisory board has recommended that would fit~the money the county might receive. The loss will be across the hoard. On motion of Supervisor Wheeler, seconded by Supervisor Winston and unanimously carried, the 1979-80 Mental Health plan and budget were approved and the Chairman authorized to sign the plan. 834 (AUTHORIZE CETA TO REIMBURSE RON GRAVES & ASSOCIATES FOR MONEY EXPENDED AS On motion of Supervisor Wheeler, seconded by Supervisor Moseley and unanimously carried, CETA was authorized to reimburse Ron Graves & Associates in the amount of $462.40 for money expended as a result of the eligibility error. 835 836 ACCEPT RECOMMENDATIONS OF CETAC TO INCORPORATE ADDITIONAL FUNDS INTO CURRENT YEAR GRANT TO BE SPENT ON A FIRST-IN, FIRST-OUT BASIS WITH SIMILAR AMOUNT TO BE CARRIED TO FY 80 On motion of Supervisor Moseley, seconded by Supervisor Wheeler and unanimously carried, the recommendation of CETAC to incorporate the additional $26,479 into the current year grant to be spent on a first-in, first-out basis with a similar amount to be carried to FY 80 and the Director authorized to sign. ' ACCEPT RECOMMENDATION OF CETAC TO INCORPORATE TRAINING BEYOND BASIC SKILL LEVELS AND PROCEED WITH SOLICITATION OF PROPOSALS FOR DEVELOPMENT AND OPERATION OF TRAINING PROGRAMS FOR PSE PARTICIPANTS. Jim Rackerby, personnel director, set out the background of the training programs. This would amount to spending of 10% for training. This would go up each year until 1981 when the amount would be 22%. The policies the Board has set in the past are that CETA should not duplicate existing services available. The request is to authorize a call for proposals from community colleges and possibly private schools to review the program and see if it is feasible to go out with. Chairman Lemke stated that a list of vendors were offered to CETAC. There are also a number of private organizations offering this same kind of training. CETAC will take great care in reviewing the vendors when the proposal is made. Staffrras instructed to come up with ,in the general concept of CETA ,to increase the training element throughout all of the titles and to the persons to train someone for a valid position=so they will be ready to go to work for someone. This is a requirement of the Department of Labor. Page 346. May 22, 1979 May 22,_1979 Mr. Rackerby stated that there are about 500 participants in public service in Title VI and 200 in Title VII. Title VI is a hard one to deal with. It is short-term projects, low pay and there is some form of training. Hopefully during their experience they will be able to use a contract to sharpen;. skills. What the Council was referring-to is taking Title IIB and utilizing that money in jobs_wE'~:ere'.aa is recognized that its is -more to the advantage of the participant to be trained than to be placed in a work site. On motion of Supervisor Wheeler, seconded by Supervisor Winston and unanimously carried, the recommendation of CETAC regarding the proposal for training elements of Butte County CETA Program in conjunction with Public, Service Employment was accepted and approved proceeding with solicitation of proposals for development and operation of training programs for PSE participants. RECESS: 9:57 a.m. RECONVENE: 10:08 a.m. 837 IMOTION TO ADOPT RESOLUTION OF ENDORSEMENT OF JUVENILE DEI,INQUENCX PREVENTION Discussion of endorsement of the Juvenile Delinquency Prevention Program grant application held at this time. Supervisor Winston stated that the problem is that the Superintendent of Schools has advised that the services are already being performed. The report talks about February to June the program coordinator will seek avenues to continue the program. Even though it is not an on-going program it is talking about on-going funds, John Foster,, Superintendent of Schools office, stated that the local support that is mentioned in the project budget was trying to state there is an office budget that is on-going. This is in the position of Truant Officer. This project will not be one person trying to accomplish these goals. It provides services that are very much needed that one person cannot provide. This project will provide support to the one position, They have letters of support from the school districts. The continuance of the program would be at the support of the local school districts. If the school districts are not able to support the program, the program will not continue. The results of the program will come back from the school districts. This program would use any of the programs that have been used in the past by other agencies that are found to be satisfactory for the individual involved. They would be working with the person and doing an assessment and trying to find the problem and giving help. It was moved by Supervisor Dolan that a resolution of endorsement for the Juvenile Delinquency Prevention Program be adopted and the Chairman be authorized to sign. Motion dies for lack of second.- 838 PUBLIC HEARING: EUGENE WELLS APPEAL OF DRAFT EIR AND DENIAL OF USE PERMIT TO ALLOW A MOBILE ROME, HEAVX EQUIPMENT AND STORAGE YARD ON PROPERTY ZONED "A-2 LIMITED," LOCATED ON THE SOUTH SIDE OF BUSCHMAN ROAD, BETWEEN The public hearing on the Eugene Wells appeal of draft environmental impact report and the denial of a use permit to allow a mobile home, heavy equipment and storage yard on property zoned "A-2 Limited," located on the south side of Buschman Road, between Paloma Drive and'Scottwood Road, identified as AP 54-09-36, Paradise was held as advertisedo Page 347. The request is for a use permit to allow heavy equipment. The EIR was prepared for this and it indicates potential environmental effects. The use has been on the property for a number of months and is already there. The effect of the 3enial would be that the use must be removed to comply with the zone requirements. The main environmental effect is the quest of compatibility with the neighborhood. It consists of mixed uses. Mr. Nelson set out the uses at this time. They include a church, single family units, multiple family units,. mobile homes and one similar use of Modern Garbage, Re felt that the compatibility question relates to the aesthetics. The appearance of the site is the question that should be addressed. There is also concern about the equipment being an attractive nuisance £or :hildren. .One mitigation measure is a site screening fenced Other concerns are noise and equipment coming and going. Bettye Blair, planning director, set out the background of the use permit. This item was heard by the Planning Commission and denied. It has been appealed to the Board. The Board has received copies of staff findings and the minutes and pieces of correspondence that the Planning Department received prior to and during the commission hearings. She showed the Board three photos that were submitted at the March 14, 1979 hearings. The use permit goes with the land and is on-going unless the use is abandoned. The application did state a mobile home but it is allowed in the "A-2" zoning and not subject to hearing. Hearing open to the publico Appearing: 1, Gary Zilaff, Lewis and Zilaff representing Mr. Wells. Mr. Zilaff stated that Mr. We11s has applied fora permit and has equipment stored to allow him to improve the land. Mr. Wells is trying to level the land off. He asked that even if the permit as applied for is not allowed that the Board allow for a year permit to complete the leveling. This would improve the surrounding area. He will be calling Mr. Wells and Robert Guth forward to present testimony on the use permit and the EIR. Ke will present testimony to show the surrounding property is really just as shockingo Next door to Mr. Wells is a dry cleaning business and a corraling operation. There axe pigeon coups. The general area will be shown to be not aesthetically pleasing. They are asking for a one year permit to allow Mr. Wells to improve his propertyo 2. Eugene Wells. Mro Wells stated that he was the owner of the property and had applied for a permit for heavy equipment storage, Ke intended to improve his propertyo Pictures of the property were shown to the Board at this time. This shows what has taken place. These pictures are not intended as evidence. He has a need of the equipment temporarily. He has started storm drains and has been stopped by the property owner on the west sided It has come as far as charges against him. He felt that he could get rid of the equipment in a year. Mr. Miser runs the corrals. There is a commercial dry cleaning business next to his property at the present time. He has trucks stored and the quipment is on his property. The pigeon coups cause odor, flies and werything else, He felt that he was arbitrarily discriminated against. Picture entered into evidence at this time. Mr. Wells stated that the only thing he had to add was that he did not think he had done the people an injustice. The real estate agent swore that this was legal and he filled out the application for his use permit. He was told that he could use the property for this purpose in the "A-2 limited" with no permit. He would like to clean up his property to make it presentable. He would like to go ahead. with the drainage ditch. Page 348. Mr. Guth stated that he prepared the environmental data submitted in the ETR. The main concern Cs the compatibility of the use.. He submitted a mitigation measure ghat if the applicatian is granted then one year later the equipment could have to be removed. The safety problem has been addressed, putting ~ Fence around the storage area. The physical impact of the property is rather slight. There is quite a variety of land use with Modern Garbage cot to di$imilar. Improvement of the property could not hurt the aesthetics ~f the area. With the removal of the equipment, he felt that the property could be improved. 4. Walter Heg®ndorn, Mr. Hagendorn stated that the equipment ras first placed on the property almost 18 months ago. Mr. Wells has said that he did not need a permit. He showed the Board pictures of Mr. Wells property. Aland clearing operation shouldn't take two years to clear one scre of land which still might be for sale, He is asking for a permit to store construction equipment. He has moved out but that does not mean ie cannot move back in. This type of operation does not go with the neighborhood. He felt that Public Works should take care of the drainage 3itch. The so called commercial operation, cleaning establishment, Mr. 3egendorn felt that at one time this was an in-home rug cleaning operation. 3e has never seen anything objectionable about it. Mr. Zilaff asked if it was the opinion that he would not be llowed to cross-examine the witnesses: Chairman Lemke stated that he would not be allowed to cross- °xamine, These people are not witnesses. Mr. Zilaff stated that there is a case that would indicate lue process is served by allowing cross-.examination of people who testify. Ael Siemsen, deputy county counsel, stated that the public learings do not provide for that type of cross-examination. The procedure Cs if there are questions, they are addressed to the Board and they can ask the other person. 5. Cedell Miser. Mr, Miser stated that the EI12 was pretty well stated. The county has allowed this area to be a quiet residential area. Cnto one lot comes heavy industrial equipment. He submitted pictures taken a couple of days ago. He asked if this type of equipment was needed to actually level property. He has not yet filed charges regarding the storm drainage. Mr. Wells put in a culvert, cut his fence and tore down trees and put other dirt in there. He went back and put up the fence and placed a sign that said no trespassing. He cut the fence down again, 3e has no alternative but to have the drainage pipe removed. He submitted two letters in opposition to the use permit. Imo. Miser stated that he Sid not ogerate a corral business. He has a stable and. one horse. 6. Althea Miser. Mrs, Miser stated that the neighborhood had been subjected to an industrial junk yard for nearly two years. Mr. Wells ias been able to use his property without benefit of a permit. She hoped that the Board would deny the permit. Mr. Wellst yard is full of pipe, old rubber tires and a huge crane. There is no way to put a fence high :nough to cover these. 7. Larry Joe. Mr. Jae stated that he had the same business as Mr. Wells. He has never had to have his equipment on his home lot in Paradise. 'He has been able to rent commercial areas. ~Mr, Wells has said that he needed the equipment to level, his Iot. He has enough equipment to level a mile of land. He asked. that the area remain residential. Page 3~9. He asked that any of the Board members who have talked to the Planning Commissioners abstain from voting on this matter. He asked that the Board grant a one year permit in order for Mr. Wells to complete the improvement to his property. PUBLIC HEARING: DANIEL W. YOUNG - APPEAL OF ADVISORY AGENCY`S CONDITIONS 8 AND 9 ON THE TENTATIVE SUBDIVISION .MAP FOR WOODLAND CREEK ESTATES, AP 55-261-61, 28 LOTS, BETWEEN STEARNS ROAD AND DE MILLE ROAD, PARAAISE The public hearing on Daniel W. Young appeal of Advisory Agency's conditions 8 and 9 on the tentative subdivision map for Woodland Creek Estates, AP 55-2&1-61, 28 lots, between Stearns and DeMille Road, Paradise was held at this time. Chairman Lemke abstained for taking part in tEiis hearing. Vice Chairman Winston chaired hearing, Clay Castleberry, public works director, set out the background of the appeal. This consists of a proposed two unit development between Stearns and DeMille Road of some 28 lots in the southeast area of Paradise. Mr. Castleberry recommended that the improvement of DeMille and Stearns be the same width as the existing pavemento Hearing open to the public.. Appearing: No one. Hearing closed to the public and confined to the Board. 840 Mr. Castleberry stated that conditions 8 and 9 were the pavement of Stearns and the extension of DeMille Roads. The condition would have been 36 or 38 feet. DeNEille Raad is 30 feet. In his judgment, it seems that between the two roads the pavement widths should be the same to serve the needse The proposed pavement would be extended along the frontage of the development, On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the appeal was upheld. and the extension of paving for Stearns and DeMille Road to be the same as the existing paving. RECESS: 11:15 a.m. RECONVENE: 11:20 a.m. ADOPT RESOLUTION 79-80: PUBLIC HEARING: BUTTE COUNTY PLANNING COMMISSION PROPOSED NEGATIVE DECLARATION AND GENERAL PLAN LAND USE MAP AMENDMENT TO CHANGE EXISTING "MEDIUM LOW DENSITY RESIDENTIAL" TO "COMMERCIAL" PROPERTY iENERALLY DESCRI-BED AS PROPERTY LOCATED ON BOTH SIDES OF CLARK ROAD FROM k~PROX. 500 FEET SOUTH OF BUSCHMANN ROAD, TO A DEPTH OF APPROX. 1,300 FEET, QARADISE The public hearing on the Butte County Planning Commission proposed negative declaration and General Plan Land Use Map Amendment to change existing "medium low density residential" to "Comiriercial" property generally described as that property located on both sides of Clark Road from approximately 500 feet south of Buschmann Road, to a depth of approximately 1,300 feet, Paradise was held as advertised. Earl Nelson, environmental review director, set out the background of the negative declaration. The environmental effects relate primarily Page 350. It is a mixture of uses. He recommended a negative declaration. This area does not appear to be environmental sensitive. The main concerns relate to traffic increases and drainage. It appears that the facilities can be constructed to take care of the drainage. The traffic will be handled if needed. There was a letter from CALTRANS stating they were not going to improve the road. Bettye Blair, planning director, set out the background of the General Plan amendment. This was generated by the Board of Supervisors as a result of a November, 1977 petition requesting commercial zoning. The Board ref0rred it to the Planning Commission and they initiated hearings for a General Plan amendment. She set out the areas involved in the amendment, She suggested that this matter be incorporated with the hearing that is being held on the Land Use Element and map. There are several requested General Plan amendments that could be incorporated if the Land Use Element hearing were to continue too long. Heinke's property is outside of the area. Hearing open to the public. Appearing: 1. Lou Mariotti. Mro Mariotti stated that he also ~-owned property in Graig Mooretown. That hearing has been going on for over six years. The people in the area have been trying since November, 1977 to get the Clark Road area rezoned. Tt has been an effort to get going and now there is a request for a delay. 2, Dorothy Hilmer. Mrs. Hilmer stated that she owns six acres on Clark Road. She was told to put in a road and a parcel map for the acreageo .She has now been waiting for two years for this rezoning to take place. She asked that this amendment be approved, 3o Clint Bennett. Mr. Bennett stated that the area is probably commercial through the application of use permits. Since there is no controversy for the property going commercial, it is hurting the people at this time to hold the rezoning up. Hearing closed to the public and confined to the Board, Chairman Lemke set out the reason that the request was made to include this proposed amendment with the other one being considered at this time. On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, finding the proposed project could not have a significant effect on the environment, a negative declaration was accepted. On motion of Supervisor Winston, seconded by Supervisor Moseley and carried, finding that through one-half of the calendar year the county has used none of the General Flan changes and noting that in 1978 the county used only two and noting several will be used in one change and finding that the proposed map change from "medium low density residential" to "commercial" is in keeping with the existing uses in the area and to the benefit of the public in general the General Plan Land Use Map amendment to change existing "medium low density residential" to "commercial" property generally described as that property located on both sides of Clark Road from apgroximately 500 feet south of Buschmann Road, to a depth of approximately 1,300 feet, Paradise was approved; with the finding that the change in the mag is keeping with the text of the existing change of the land use element as well as other elements; Resolution 79-80 was adopted and the Chairman authorized to sign. PRESIDENT OF THE_BCEA Ms. Panattoni presented the Board with a flag to be flown .over the courthouse. It was flown over the Capitol on Aprii 10, 1979 at the request of Senator Alan Cranston. REQUEST TO RESCIND ACCEPTANCE OF DEDICATION AND AUTHORIZATION FOR FILING AMENDED ROSEHILL ROAD SUBDTVTSION MAP HELD OVER TO JUNE 5 1979 Clay Castleberry, public works director, stated 'that Counsel has asked that the request to rescind the acceptance of the dedication and authorization for filing an amended Rosehill Road Subdivision map be held over. His department made an error. This map had been held through the land fraud process. A portion of the road was included for acceptance into the county system, It does not connect with a county road because of road maintenance agreementso Pat Jeffwell stated that he purehasa°property north of Rosehill Road. It deadends on his frontageo He was told that Rosehill was a county road and he purchased the property with the intent to split the property. The matter was continued to June 5, 19790 843 APPROVE AUTHORIZATION FOR SAFE ACCESS TO THE SKYWAX AT NORTH END OF PARADISE PINES UNIT dk4 AND ACCEPTANCE OF $1,828.53 TO BE DEPOSITED INTO THE CSA ~~4 TO ASSIST IN DRAINAGE MAINTENANCE WHICH WOULD_PROVIDE A_"FAIR SHARE" OF COST Clay Castleberry, public.-works director, set out the background of the safe access~o the Skyway at the north end of Paradise Pines Unit #4. This county service area was for money for construction of the relocation of the Skyway. A property owner has asked to be included in the assessment district. On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, authorization for safe access to the Skyway at the north end of Paradise Pines Unit ~k4 and acceptance of $1,828.53 to be deposited into the County Service Area No. 4 to assist in drainage maintenance which would provide a "fair share" of the cost earlier incurred. 844 DISPOSITION OF EHMAN HOUSE REFERRED TO COUNSEL FOR THE PREPARATION OF NECESSARY LEGAL DOCUMENTS TO AFFECT TRANSFER OF OWNERSHIP OF THE EHMLiN PROPERTY TO THE BUTTE COUNTY HTSTE3RICAL SOCIETY Lorna Barth, Butte County Historical Society, was present to discuss the disposition of the Ehman House. Chairman Lemke stated that the Board had received an appraisal from the assessor on the Ehman House at a total of $30,000 full cash value;. with land, $16,000 and improvements, $I4,000.~ The Board has received a letter from the Oroville Code Enforcement Officer regarding what would have to be done to bring the house up to standard. it is basically sound but needs extensive repairs. Supervisor Winston felt that the property should be held in trust for the benefit of all the people. He wondered if the preservation of the home and granting to the Butte County Historical Society would be more beneficial to the people than the $30,000. The Historical Society has done volunteer work and he felt that it wa"s a worthwhile gesture to see that they receive the Ehman House as a possible museum and headquarters. On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the matter was referred to Counsel to prepare the necessary legal documents to affect the transfer of ownership of the Ehman property to the Butte County Historical Society. ADOPT RESOLUTION 79-82 DESIGNATING THE WELFARE DIRECTOR AS PROJECT OFFICER AND GIVING ASSURANCES OF PROVIDING LOCAL FUNDING RE: CHILD SERUAL ABUSE TREATMENT PROGRAM AND APPROVE CONTRACT WITH FAMILY SERVICES ASSOCIATION On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, Resolution 79-82 designating the Welfare Director as the project officer and giving assurances of providing local funding for the Child Sexual Abuse Treatment Program for the period July 1, 1979 through August 31, 1980 with the total amount of the application being $31,111 (federal, $28,000; state, $1,555; and local, $1,556) was adopted; the Countract wiCh Family Services Association was approved and the Chairman authorized to sign contract and resolution. APPROVE BUDGET TRANSFERS ' On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, the following budget transfers were approved: B-145 - Auditor-Controller. Transfers $207 from the reserve to judgements in order to cover the cost of a judgment from the Oroville Justice Court against Butte County for damages to sheep by dogs. B-149 - Assessor. Transfers $300 from office expense to publications and legal notices in order to cover the cost of news- paper advertisement with regard to homeowners, veterans, and personal property exemptions. B-150 - Gridley Justice Court. Transfers $1,200 from jury and witness expense to office expense in order to cover higher than anticipated costs of forms, postage, maintenance of the library - all related to an increased workload. B3.51 -.Auditor-Controller. Transfers $400 from regular salaries and wages, $800 from professional and specialized services, with a total of $1,200 going to maintenance of equipment in order to cover unanticipated maintenance costs on the NCR 399 machine brought about by a misunderstanding of the warranty termination date. B-152 - Assessor. Transfers $125 from office expense to main- tenance of equipment in order to cover the cost of unexpected repairs to the map making machine, B-153 -Fire Department. This transfer is necessary in order to award the bid for Skyway at Lofty Lane to Robinson Construction Company in the amount of $71,7.41. DISCUSSION: E%CESS LIABILITY COVERAGE WITH CSAC Supervisor Winston stated he felt that it would be a good idea to go with the excess liability insurance coverage from CSAC with nominal fees. Matter to be discussed later in the meeting. 850 851 852 853 ADDITIONAL MATTER PRESENTED BY SUPERVISOR WINSTON Superivoor Winston stated that the Board had received a memo from the Administrative Officer dated May 15, 1979 regarding revenue sharing. The Board did net have a revenue sharing committee appointed this year. Clif Mickelson, administrative officer, stated that the committee was not required by law. It does not mean that a committee could not be appointed. There must be a public hearing for public input before the final decision is made regarding the revenue sharing fundso The proposals will show in the. Administrative Office proposed budgeto During the budget hearings, the Board will make the final decision regarding revenue sharing. ACCEPT RECOMMENDATION OF CETAC WITH REGARD TO APPROVAL/DENIAL OF CETA TITZE VI PROJECT PROPOSALS AND REQUESTS FOR MOBIFICATIONS Jim Rackerby, personnel director, set out the recommendation of CETA with regard to approval/denial of CETA Title VI project proposals. There are approximately 20 people involvedo This is the CSUC outreach program for older citizens to come back to the University that maybe feel they do not fit in. There is also use of CETA personnel to do a study on EOC employees to write the classifications for that office. On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the recommendation of CETAC with regard to approval/denial of CETA Title VI project proposals and requests for modifications were accepted, AYES: Supervisors Dolan, Moseley, Wheeler and Chairman Lemke. ACCEPT RECOMMENDATION OF CETAC WITH REGARD TO DEFINITIONS OF DISPLACED HOMEMAKER AND HANDICAP FOR USE IN__BUTTE COUNTY'S CETA PROGRAM On motion of Supervisor Wheeler, seconded by Supervisor Dolan and unanimously carried, the recommendation of CETAC with regard to definitions of displaced homemaker and handicap for use in Butte County's CETA program was accepted. AUTHORIZE SENDING OF LETTERS TO DEPARTMENT OF LABOR REGARDING INSURANCE AND OUTSTATIONTNG FOR CETA PROGRAMS Jim Rackerby, personnel director, stated that during the CETAC meeting Mr. Richard De1k from the Department of Labor was presento They discussed the problems the county is facing in implementing GETA. The Department of Labor is reluctant to give direction because they do not know what the proposals are. Mro De1k suggested in some of the areas the county is having operational problems to send a letter to the Department of Labor setting out the problem and proposed solution and ask for a response. There are two areas that should be handled this way: 1). property damage and personal liability for CETA workers; 2) proposals for outstationing. AUTHORIZE NOTIFICATION OF CSAC THAT BUTTE COUNTY IS INTERESTED TN PARTICIPATING TN THE DEVELOPMENTAL PHASE OF THE EXCESS LIABILITX TNSURAI3CE PROGRAM Steve Replogle, risk management coordinator, stated that he had attended a meeting on May 2, 1979 regarding the CSAC excess liability insurance program. They will need 20 counties to participate in the program to make it a viable group. They have received indications from about 12 of the counties that they will participate. CSAC wants a decision by June 1, 1979. Tt does not look like the county will receive any input regarding the proposals for companies until after June 4, 1979. The program offered by CSAC will be set up for different levels for different size counties. On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried, notification to CSAC that Butte County is interested in participating in the developmental phase of the excess liability insurance program was authorized, 855 PUBLIC HEARING: BUTTE COUNTY PLESNNING COMMISSION - DRAFT EIR AND GENERAL PLAN LAND USE ELEMENT - CONTINUED TO MAY 29,_1979 AT 2:00 P.M. The public hearing on the Butte County Planning Commission draft environmental impact report and General Plan Land Use Element was held as continued. Hearing open to the public. Appearing:. 1. Bernice Stanhope, Oroville Board of Realtors. Ms. Stanhope stated that after hearing all the pros and cons on the issue it is her opinion that one of the major differences of opinion is based on the fact that the Land Use Element text is based a great deal on environmental concerns and the map is more liberal in concepto The map had to be like it is to conform to the present zoning. There is merit to start from inside and build out with planning. It will not be difficult to keep the county from having leap frogging due to the fact there is limited water and sewage disposal. The area is basically rural. The rural residential will serve as a buffer between agriculture and urban and still allow people to live in a rural atmosphere. There are 25 rural counties facing the same problems. She did not feel that the plan should be for 20 years because planning is an~ever changing process. This should be updated every five years. Ms. Stanhope asked that the Board form a committee to study the proposed amendment and bring a report back to the Board. 2. Jack Bryson. Mr. Bryson stated that the Concow area has just recently Formed an association. Rural residential fits their needs. The committee is studying a small area for commercial. Mr. Garzia stated that under the proposed amendment, out of the 1712 acres he owns about 1,450 acres' fall into the rural residential. He felt that his entire property should have been in one classification. He felt that this was an appropriate classification-for his land. He raises cattle and it is very difficult not to have to feed them additionally during the winter. Supervisor Winston stated that on page 29 of the text where it is talking about policy under population growth there is a statement under policy B to designate adequate land for free market. On page 30 under orderly development they are talking about encouraging annexation and development around a community with facilities. There is a conflict with the two statements. Kyle Butterick, planning department, stated that the policy should be looked at and evaluated collectively. There will be some apparent conflicts. Dr. Frank Bennett, chairman Planning Commission, stated that he could not see what holding additional meetings by a committee could accomplish. There is a need to drake a decision. TABLE LETTER FROM COUNTY OF LOS ANGELES RE: GASOLINE SITUATION IN CALIFORNIA On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the letter from County of Los Angeles forwarding its resolution with regard to the gasoline situation in California was tabled. 87 DISCUSSION: PROPOSED STATEMENT RE: ARB CHARGES AGAINST JOE BANDY Discussion of the proposed statement regarding the ARB's charge against Joe Bandy, agricultural commissioner, held at this time. Supervisor Winston stated that the statement was particulaxly a Apropos particularly to the 2,000 acre fire burning in the canyon, the tole burning and the other areas they were burning. Yet, some way in the ARB's.ma$ic system they funneled the smoke through some filters and determined all of the smoke was coming from rice burning. Their refusal to talk with Mr. Bandy was despicable. He has received a letter from Dr. Rolland Hauser, meterologist CSUC, stated that for reasons cited in the preceding paragraphs-the report from ARB does not .present meterolcgical verification of wind patterns that caused smoke from rice burning to impact on the Sacramento and Say areas in his opinion. The information in the report is grossly insufficient to corrolate public complaints. Page 360. The matter to be discussed May 29, 1979. 883 ADOPT RESOLUTION 79-90 IN SUPPORT OF SB 390 TO KEEP CHP HELICOPTER ASSISTANGE IN OPERATION On motion of Supervisor Wheeler, seconded by Supervisor Moseley and unanimously carried, Resolution 79-90 in support of SB 390 to keep CHP helicopter assistance in operation was adopted and the Chairman a uthorized to sign.
