At its May 15, 1972 meeting the City Council of Gridley ~ appointed Councilman J, E. Hughes to the County Airport Committee replacing I (~d,`~ former Mayor Shifflet and Police Chief Howard Geyer to the Civil Disaster Gommittee. Discussed. It was stated that Police Chief Geyer was not eligible. Referred back to the AdministrativE Officer to write a letter of explanation. Region C. CCCJ. (a} L. Supervisor Reynolds stated he had questions about the letter, Rules / U Q~~~ concerning challenging of Board members discussed, Dan B3ackstock, County Counsel, stated he had checked with~~TMr. Horton; he is not Finance Chairman for Ward Cameron. There is no conflict of interest in the matter. Supervisor Maxon withdrew his objection to Mr. Horton. It was suggested that another person be appointed as an alternate; he should be another Sawyer. Mr. Blackstock was requested to canvass the matter and bring back a recommendation to the Board so that it can be taken under consideration. 72-886 REN!-"~;E CONDITION FOR WATER INTERCONNECTION REQUESTED B'Y PARADISE FIRE PROTECTION DISTRICT: LAND DIVISION OF CARL ARENIUS PROPERTY Following the reading of the letter from Paradise Fire Protection District in which they rescind their requirement for the interconnection of the water main for the Carl Arenius property, upon the advise of Paradise Irrigation District that adequate water is available without an interconnection, it was moved by Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, that the water interconnection for the Carl Arenius property - parcel ~~53-17-34 & 44, was removed. 72-887 MATTERS PRESENTED BY SUPE RVISORS Supervisor Reynolds stated he had two Setters from Charles H, Bohrmann. Letters read. The first letter sets out that the area of the Feather River, from powerhouses down to the Thermalito Diversion Dam, about 52 miles, was closed to boating, Request that the area be opened to boating so that it can be used for fishing. Explained how matter cou3d be handled, Letter read and referred to Public Works and to the local Fish & Game Commission. The second Setter from Mr. Bohxmann states that roads in the Recreational area administered by Dept, of Fish & Game are dangerous, Roads set out. Letter read and discussed. Referred to Mr, Castleberry and Recreational Committee. It was felt there should be a joint meeting in this matter. Supervisor McKi3lop felt that both Setters should be referred to Recreational Committee, attention: _ _ _ _ _ .,,. ... _. _ _ _ _ _ _ _May_23,_1972 _ Chairman Gilman presented a 1et~er from Uni-Vac, He requested that it be referred to Hank Hindery, Director of Data Processing. Chairman Gilman said that as a matter of information, Supervisor McKillop, County Counsel and himself had gone to Sacramento yesterday and met with Senator Marler and Assemblyman Johnson. Everyone is in agreement that Butte County had overpaid their share of Medi-Cal payments. Legislation will be introduced in this matter. This will amount to quite a lot of tax dollars; as this overpayment could have gone on for years. Chairman Gilman felt that the Board owes the credit or much of it to 5upervisox McKillop in pushing for the audit so the County could receive the funds. STUDENTS OF LA5 PLUMAS HIGH SCHOOL & GRIDLEY HIGH SCHOOL WELCOMED fi0 THE MEETING. 72-888 MAYOR WINSTON OF OROVILLE: PARKING AROUND THE COURTHOUSE Mayor Winston of Oroville spoke to the Board regarding parking around the Courthouse, He thanked the Administrative Office for the memo they had sent to the County employees about the parking around the courthouse, He said that a city committee has been meeting on this matter and they will report back to the City Council at the first meeting in June, There are many violators of the two hour parking',' He said there will be a more rigid enforcement of the on-street parking ordinance. The committee is making s survey of the number of spaces that are available during the day, Parking problem discussed; no action taken at this time. 72-889 APPOINTMENT OF COMMITTEE TO REVIEW PROBLEMS TNCTDENT TO CITY OF OROVILLE SEWER CHARGES Discussed the appointment of a committee to review problems incident to City of Oroville sewer charges, It was suggested that the Chairman make appointment today of the county's members to the committee. The City Council could appoint their two members and then set up a meeting to discuss the matter. Mayor Winston was requested to inform the County if the City's appointments. On motion of Supervisor Maxon, seconded by Supervisor Madigan and unanimously carried, Supervisors McKillop and Reynolds were appointed to the Committee to review problems incident to City of Oroville sewer charges. 72-890 AUTHORIZE FLORAL AVENUE PROJECT On motion of Supervisor Reynolds, seconded by Supervisor Madigan and unanimously carried, the Floral Avenue project (a budgeted project) was authorized; Public Works authorized to negotiate to buy materials and rent equipment from contractors in the Chico axes to complete the project. 72-891 AUDITOR AUTHORTZED TO DISBURSE FUNDS: THIRD AVENUE PROJECT BETWEEN PALM AVENUE & MANGROVE AVENUE Clay Castleberry, Director of Public Works, reported that last year the Board appxaved a project and about $3,400 in funding toward a three-way pavement effort at Palm and Third Avenues, This project is a cooperative one with the County of Butte, city of Chico and a developer. The City of Chico opened bids and the bids were almost exactly as estimated, Mr. Castleberry recommended that the Auditor be authorized to disburse funds to the City of Chico for its contract award. On motion of Supervisor Madigan, seconded by Supervisor McKillop and unanimously carried, the Auditor was authorized to disburse funds to the City of Chico for its contract award for the Third Avenue Project between Palm Avenue and Mangrove Avenue, not to exceed tine $3,400 budgeted. May 23, 1972 72-892 PUBLIC WORKS ITEMS APP ROVED On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, the fallowing action was taken: 1, Approved Contract Change Order No. 3, Forbestown Road FAS Project 759{4), in the increasing amount of $2,000 to provide far payment for dust control, and the Chairman was authorized to sign. 2. Approved following agreement for sale, right of way acquisition, authorized Chairman to sign and authorized Auditor to issue warrant upon demand of County's escrow agent: Skyway FA5 75;(4) J. C, Waddell et ux 0.003 ac $63 No impr, Total $63, 3,a)Accepted following deeds for right of way acquisition, authorized Chairman to sign certificate of acceptance: East Ave. 57191-70-1 Parcel 27 G. (c} Authorize Chairman to accept quit claim deed from the State of California far parcels of land (Ridge Road and Canyon Road} adjacent to Kelley Ridge Estates Subdivision. 72-893 APP ROVE CHANGE ZN FEES: REFUSE DISPOSAL NEAL ROAD Mr, Castleberry stated that certain fee changes at the Neal Road Disposal Area are recommended. He feels that the new rates are in order. The rates would not apply to any of the commercial operators in the County, This is an addendum to the special haulers. Matter discussed. On motion of Supervisor Reynolds, seconded by Supervisox~Iadigan and carried, the following new rates were adopted .f or the Neal Road Disposal Site: Cara, station Wagons $ ,25 Pickups, Panel trucks, 2-wheel trailers ,50 1-ton Trucks, 4-wheel trailers 1.00 12ton trucks or larger 1,50 Semi-trailers 2,00 THE FOLLOWING IS NEW SCHEDULE 10-wheel dump trucks hauling demolition and tree stumps $ 5,00 per load Semi-trucks hauling demolition and tree stumps $10.00 per load Single-axle and over trucks hauling tires $ 5,00 per load Semi-trucks hauling tires $10,00 per load AYES: Supervisors Madigan, McKillop, Reynolds and Chairman Gilman NOES: Supervisor Maxon Supervisor Maxon stated there was a problem in Paradise concerning this matter. Mr. Castleberry stated that if he would set a time, Mr. Castleberry would get the operators together and meet with Supervisor Maxon to discuss the matter. 72-894 DISCUSSION: PROPOSED SKYG~AY' UNDERGROUND UTILITY DISTRICT Mr. Castleberry stated that Public Works would like Board's concurrence - - - - - - - - - - - - - - - -May-23 ,-1972 - - - - - - - Mr. Castleberry explained the matter. The merchants should be notified of the matter, Supervisor McKillop felt that Public Works should proceed with the preparation of the papers and that a public hearing should be set. Mr. Castleberry said he would bring back the district formation papers at an early date, No action taken at this time, 72-$95 INFORMATION ITEM Mr. Castleberry briefed the Board, as requested, on Regional Water Quality Control standards for Paradise Pines County Service Area No. ~-, He explained the conditions of the matter. Larwin feels that they can work it out. Mr, Castleberry said he would give the Board members copies of the standards. No action taken at this time, 72-896 PALERMO FIRE STATION OPEN HOUSE ANNOUNCEMENT Mr, Castleberry said that open house would be held on June 3, 1972 at the Palermo Fire Station. Division of Forestry is handling the matter. 72--897 STUDENTS GIVEN AN OPPORTUNITY TO ASK UESTIONS AT THIS TIME Chairman Gilman said the students could take this time to ask questions of the Board members, Mr. Jones, instructor from Biggs, requested that the Supervisors explain to the students how they spend their time. Chairman Gilman gave a rundown on his week and the work he is doing. He said that most of his time was spent handling problems, The other Board mc.~mbers gave their schedules of meetings and county work they were handling. They stated that a great deal of their time was spent on the telephone, handling co~~nty problems, Another student questioned the Board concerning the $1&8,000 over payment to Medi-Gal. Supervisor McKillop explained how the payment had been made, and that the County will be reimbursed for. the overpayment. RECESS: 10:00 RECONVENED: IO:I5 72-598 BUTTE COUNTY BAR ASSOCIATION PRESENTATION OF RECOMMENDED PUBLIC DEFENDER CONTRACT Lloyd Mulky, President of the Butte County Bar Association, explained the cover letter to the Board. He stated their study and recommendation had been made as a courtesy and a help to the Board. Dan Blackstock, County Counsel, stated that copies of the proposed contract had been placed on_ the Board members desks, Mr, Blackstock said he has read the contract; he said there were a number of policy matters that the Board should consider, Length of the contract should be considered, Paragraph 12 would prohibit private practice of any of the attorneys that signs the contract. If the Board desires to only consider a short term contract, Paragraph 12 should be struck from the contract, Mr, Blackstock said he would recommend that the Board have a conference with the Court in regards to .the contract. The contract should be referred tv the Superior Court Judges for their study and consideration. Reginald Watts, of the Bar Association, stated that the Judges saw the contract this morning. Mr. Blackstock questioned Mr. Watt considering the liability insurance paragraph, Mr, Watt felt there should be a consultation in that field, It was suggested that the Judges go through the contract this week and that the Board discuss the matter with them next Tuesday, The time for discussion of the matter should be set at the convenience of the Judges, Proposed contract to be placed back on the agenda for Tuesday, May 3O, 1972. No action taken at this time, May_23,_1972 adjacent to forest service road, The policy has changed to request that the Board's of Supervisors consider puting the roads into the County maintained systems trhere the roads connect to subdivisions. Mr. Blackstock said he could not see how the County could apply anything retro-active; the maps are recorded so cannot do anything about them. Clay Castleberry, Director of Public Works, explained how the matter could be handled, He said the County could form small road maintenance districts, A map setting out the roads and forest lands presented and discussed, This deals with Plumas and Lassen National Forests. It was stated that the roads were maintained for the protection of the lands in the summer. Millsap Bar access road is one that should be considered for a district, it was stated. Slides were shown at this time of the access roads in question. Mr, Letson said that maybe the Board should consider restricting developing in some of the areas. Mr,Castleberry said he would not propose restricting development. Mr, Castleberry said he would like for the U, 5. Forest Service, California Division of Forestry and Public Works to give thought about development in these areas. There are no guidelines at the present time. Mr. Castleberry said that whatever is done should have a lot of in-put by people who are familiar with use around the forest area. He said a study should be made and then guidelines should be developed, Matter will be pursued with the people involved in this matter. No Board action at this time. 72-900 ADOPT RESOLUTION 72-101, APP ROVING SECOND AMENDMENT TO COOPERATIVE AGREEMENT FOR THE FORMATION OF BUTTE COUNTY ASSOCIATION OF GOVERNMENTS At the last meeting of the BCAG a proposed amendment to the BCAG agreement was presented by County Counsel. This came from a request by the City of Chico to amend the BCAG Bylaws. Counsel feels that an amendment to the agreement to accomplish the objectives asked by the City of Chico is necessary, The concept as proposed in the amendment was agreed to unanimously at the BCAG meeting. On motion of Supervisor Maxon, seconded by Supervisor McKillop and unanimously carried, Resolution 72-101, approving second amendment to Cooperative Agreement for the formation of Butte County Association of Governments was adopted and the Chairman wars authorized to sign. 72-901 ADOPT RESOLUTION 72-102, APPROVING CONTRACT BETWEEN BUTT. COUNTX AND HRD SUPPLEMENT PROGRAM FOR WELFARE RECIPIENTS Ed Robinson, Welfare Director, explained the supplement work program for people on Welfare. This is part of the Welfare Reform Act. Tt requires that persons receiving Welfare, if they are able-bodied adults, must work for part of their grant. The administering program is done with HRD, They supply the activities with 5 persons to supply the social welfare services, He said they were not talking about an increase in staff. Program explained, They are talking about 472 positions. This would be set up on a priority basis. The families would be evaluated to determine if it would be detrimental to the children involved for the parents to work. Time spent discussing the program, Jim Rackerby, Personnel Director, stated he had the managers of the Oroville and Chico HRD offices in for discussion yesterday, He said there were cost items involved; costs explained. HRD has started the search of ----------------May_23,_1972 ---- Contract discussed. The contract has to be approved to get the program rolling. Welfare is already in the process of getting employees transferred to handle the program. Date of the contract would be June 1, 1972, On motion of Supervisor Maxon, secozxded by Supervisor Reynolds and unanimously carried, Resolution 72-102 approving the supplement work program between the County of Butte of HRD was adopted and the Chairman was authorized to sign, 72-902 APPEARANCE OF RICHARD BJORK: RE UESTS,REPLY TO LETTER (Rev,) Richard Bjork stated he was here to receive a reply to his letter sent to the Board concerning Welfare recipients. He said he was not in agreement with the letter written by County Counsel in this matter, Mr. Blackstock stated he had reviewed the matter with Ed Robinson, Welfare Director. He said they knew of no situations where there were harassments by the Welfare Department. Mr, Bjork feels that the Welfare Department could only deal with him; that can not be done, Mr. Bjork said his position was that the Welfare Department should recognize his position, They should not go behind his back; they should contact him whenever it is anything to be said to the applicants for a "Fair Hearing", Mr. Robinson asked Mr, Bjork what he was suppose to be doing wrong. He said there were regulations that have to be followed. He said the Welfare Department recognized Mr. Bjork for everyone he represents. They send him copies of all letters to the recipients in question. The regulations request that the Welfare Department make contact with the person who is appealing the matter. Matter discussed; no action taken. 72-903 APPEARANCE OF MRS. KAREN HENSLEY, WARD BLVD., REQUEST THAT PUBLIC WORKS NOT ISSUE BUILDING PERMITS TO CERTAIN PROPERTY OWNERS TN FOOTHILL AREA Mrs. Karen Hensley, Ward Blvd,, Oroville, said she was representing people in the foothill area north of Olive Highway. They request that Public Works not issue building permits to any of th e 30 people who filed deeds in a certain area that was set out on a map presented by Mrs, Hensley, She stated that these people would be building on a undeveloped road; she explained the problems of the septic tanks in the area, She requested that Public Works, Planning Commission and Health Department investigate this matter and determine whether the Subdivision Map Act has been subverted, Mr. Castleberry said he has not received any maps in this area, It is a nice area east of Oroville, He was not aware of this matter, Matter referred to Public Works for study and with request that he report back on the matter. 72-904 APPEARANCE: JOHN STUTZ, CHTCO: COURT TEST_OF RANCHO ESTATES SUBDIVISION Mr, John Stutz, Chico, said he was certain the Board was aware of the court test of the Rancho Estates Subdivision Map, He asked if the Board had turned down maps in the past.. Mr. Blackstock stated that this case could rat be discussed in open session, Mr, Stutz said that in looking aver a couple of letters that Vistic had sent to the City of Chico, the Board urges sewer connections, with or without annexation, He said he wanted to clarify the motion urging the City of Chico to annex the property to the City, The City interprets the motion to mean something else. Chairman Gilman said that the determination would have to be up to the City of Chico, Matter discussed; no action taken. 72-905 DISCUSSION APPEAL OF MAX_ TAYLOR PARADISE: APPEAL TOO LATE ----------------MaX 231 ].972-__ 72-90b AG COMMISSIONER AUTHORIZED TO APPEAR AT MEETING TO PRESENT BOARD'S POSITION On April 2S the Board instructed ~Ir, Black to write to the Air Resources Boaxd xegarding their proposed regulations on animal matter reduction operations. Mr, Black complied with this and now states that he has received notice of an Air Resources Board special meeting on May 30, 1972 in Sacramento on this matter and requests Board authorization to appeax at this hearing and present the Board's position. Matter discussed, On motion of Supervisor Maxon, seconded by Supervisor Reynolds and unanimously carried, Don Black, Agricultural Commissioner, was authorized to appear at the May 30, 1972 hearing by Air Resources Board in Sacramento and present the Board's position to them, 72-907 ADOPT RESOLUTION 72-103 RE CONSTRUCTION OF SAFETY FENCING ON THE BUTTE COUNTY FAIR GROUNDS GRIDLEY. " $2b,000 has been allocated by the Director of Agriculture for the construction of safety fencing on the Butte County Fair Grounds, Gridley, by Executive Order F-71-50, The resolution authorized the retaining of Donald R, Long and Associates as designers and engineers for the project and that upon receipt of an acceptable bid the Board of Supervisors will transact contracts for the completion of the project, On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, Resolution 72-103 re construction. of safety fencing on the Butte County Fair Grounds, Gridley was adapted and the Chairman was authorized to sign. 72-908 DISCUSSION: RE UEST FOR OPA UE PROJECTOR FOR USE IN BOARD OF SUPERVISORS' ROOM Jim Lawson, Planning Director, read a lettex from the Chairman of the ~r 3 ~~} Planning Commission requesting the purchase of a opaque projector for use in the Board of Supervisors' room. Request explained, It is felt this would cut down on a lot of map work, The costs for this projector were not known at this time, Purchase discussed, The Board felt that it was worth their consideration. Action could be taken at budget time on the matter. No action taken at this time. 72-909 AUTHORIZE CHARGE FOR PRINTED COPIES OF COUNTY'S GENERAL PLAN Jim Lawson explained the request for a charge for purchase of printed copies of the County's general plan. He said that there are 50 copies that could be sold. Purpose of the request explained, On motion of Supervisor Reynolds, seconded by Supervisox Madigan and unanimously carried, a charge of $6.00 was set for the printed copies of the County's General Plan, 72-910 APPROVAL OF TENTATIVE MAPS Tentative maps presented by Planning Commission discussed. Hearing continued to Tuesday, May 30, 1972. 72-91b REPORT ON MILK INSPECTION SERVICES BY DR. HEINDL Dr. Heindl, Health Director, reported on milk inspection services. She stated she had received more information. She reported that Sutter-Yuba Counties do their own inspecting. They have a registered sanitarian and milk inspector. As far as their lab was concerned, they would be unable to do lab work for Butte County. Colusa County does not have their own program. The State is doing their ~oork. Samples are sent to Sacramento and the producers pay the State fees, Dr, Heindl said Butte County Health Department could carry on with the lab testing work. It could be done hexes this is a possibility, 'The State could do the field inspection, Dr. Heindl explained the present work load, The Health Department has been giving the dairy business a good service. She would like to b ok into the matter of getting the field work done by the State inspector and doing the lab work here. Appearing to discuss the matter: Charles McLaughlin, a producer in Durham. He asked if the County does the lab work, will the County be compensated by the State. Dr, Heindl said she did not know exactly, She said the State inspectors would charge the producer for his services, Mrs. Haymes, Chico. She said she does not see why the County cannot May 23, 1972 carried on, The Health Department inspects the dairies once a month. There are only two processors in the County; There are 11 producers. Dr, Heindl requested that action be taken opt this matter. She has a budget session scheduled and will need to know how to handle the matter. The Board felt that costs to the producers should be firmed up and what the reduction would be if the County would do the lab work. Dr, Heindl will secure these answers and report back next week, No action taken at this tame. 72-917 AUTHORIZE DISCHARGE OF ACCOUNTABILITY This item has been carried forward for two weeks. The Board had requested more information on feasibility of transferring some of these accounts to an outside collection agency, The Collection Supervisor was not present to speak to the Board on this matter. Ev Bosworth, assistant County Administrative Officer, explained the matter, There was a question of the feasibility of turning over same of the accounts to an outside agency. Neither of the two agencies are agreeable to handling these accounts, A copy of the listing and letter of rejection set out. Mrs, Rowell feels that there is no chance of referring these old accounts to an outside agency, Matter discussed, A lot of these accounts are now aut-Jawed. On motion of Supervisor Reynolds, seconded by Supervisor Maxon and unanimously carried, the Board authorized the discharge of accountability of accounts owed to the County, 72-918 DISCUSSION: DIRECTORY SERVICES FOR THE POOR The information has been compiled by the Administrative Office as requested by Mr, Elmore, and was presented at this time with request for direction as to Board's wishes on publication, Dan Moellenberndt reported he had met with Mr, Fred Frost. The proposed directory should be referred to E.O.C, and finalize the development~of the directory. It could then be returned to the Board for fz.nal approval, Mr. Moellenberndt set out the reproduction costs, The costs should run about $14,00 per 100 copies. The poor sector have requested 10,000 copies, This would be for their distribution. Chairman Gilman said theBoard should consider how many of the directorys should be printed.
