Gregory Lee Bickmore, Stirling City -files a claim in the amount of $250,000 alleging actions of persons representing the County on or about March 10, 1994 relative to a citation filed in the North Butte County Municipal Court, Paradise Branch charging violations of the Butte County Code are causing headaches and stress - action requested - REJECT CLAIM AND REFER TO COUNTY COUNSEL AND RISK MANAGER. 11. Fire Department - on April 26, 1994 the Board approved $150,000 (AB 1519) for the construction of three water tenders as part of the County Cost Share Program. The volunteer companies in Gridley, Forest Ranch and Bangor will be purchasing the chassis and donating them to the County. The County will then pay up to $50,000 each to install the tank, pump and build up - action requested - APPROVE SPECIFICATIONS FOR THE CONSTRUCTION OF THREE FIRE APPARATUS/WATER TENDERS AND AUTHORIZE A CALL FOR BIDS. Contract change order no. 17 - jail construction project - the change order in the increasing amount of $33,404 provides for the construction of a looped fire hydrant system required by the Fire Marshal. Development Services, Planning Division - Board authorization is requested to purchase a memory upgrade for the Geographical Information System computer in the maximum amount of $1,500 and a color ink jet printer in the maximum amount of $1,500 for use in mapping work in support of the work program of the General Plan - action requested - APPROVE BUDGET TRANSFER B-187 AND PURCHASE OF FIXED ASSET ITEMS. 14. Public Health Department - Board authorization is requested to purchase a computer, printer and software in the maximum amount of $5,000 {100$ STATE) for use in the Child Health and Disability Prevention Program - action requested - APPROVE BUDGET TRANSFER B-182 AND PURCHASE OF FIXED ASSET ITEMS. 15. Public Works Department - Board authorization is requested to purchase a mobile, truck mounted, combination hydro-vacuum unit, designed to flush out and vacuum debris from underground drainage facilities. The department has located a serviceable 1980 Vactor 810 (rebuilt) unit (serial no. 80-12-1601) at a quoted price of $37,537.50 including tax (STATE MATCH/EXCHANGE FUNDS) (a similar, new unit costs approximately $160,000) - action requested - APPROVE BUDGET TRANSFER B-177 AND APPROVE THE SOLE SOURCE PURCHASE FROM G.C.S. INCORPORATED. 16. Public Works Department - the paging system in the Department's Oroville maintenance shop and yard is no longer functional and due to age cannot be repaired. The layout, purchase and installation of a new paging system by Central Communications is estimated at $2,000 (ROAD CONTINGENCY FUND) - action requested - APPROVE BUDGET TRANSFER B-179 (4/5 VOTE REQUIRED) AND PURCHASE OF FIXED ASSET ITEM. Annual financial and compliance audit - after reviewing proposals from four firms (in response to a request for proposals) for conducting the annual Grand Jury/Board of Supervisors audit, the Grand Jury Audit Committee and the Auditor-Controller recommend Macias & Company, Certified Public Accountants - action requested - AUTHORIZE THE AUDITOR-CONTROLLER TO DEVELOP A CONTRACT WITH MACIAS & COMPANY, TO BE PRESENTED TO THE BOARD FOR FINAL APPROVAL AT ITS JUNE 14, 1994 MEETING, FOR A THREE YEAR PERIOD COVERING FISCAL YEARS 1993-94, 1994-95 AND 1995-96 WITH ANNUAL MAXIMUM COSTS OF $43,000, $45,150 AND $47,400. 18. 1993-94 Proposition 99 Rural Health Services (RHS) funds - the State Department of Health Services has identified $5,036 in additional 1993-94 Proposition 99 Rural Health Services OTHER funds for Butte County. Approval of plans and specifications for widening culverts and shoulders on various Butte County roads, Hazard Elimination Project 03-BUT-O-CR, Federal No. STPLH-5912(007), County contract no. SP-92-5 - plans and specifications have been completed for the project - action requested - APPROVE PLANS AND SPECIFICATIONS, AUTHORIZE THE CHAIR AND DIRECTOR TO SIGN PLANS, ADOPT WAGE SCALE, AND SET BID OPENING ON JUNE 15, 1994 AT 11:00 A.M. Visual Graphix, Sacramento - proposed is the extension of a letter agreement for professional microfilming services to cover filming of additional Superior Court Juvenile files with a cost not to exceed $10,000 (DEPARTMENT BUDGET), and work to be completed no later than December 31, 1994 - action requested - APPROVE BUDGET TRANSFER B-191 AND AUTHORIZE THE COUNTY CLERK-RECORDER TO EXECUTE THE EXTENSION OF THE VISUAL GRAPHIX LETTER AGREEMENT SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER, Page 148 May 24, 1994 94-159 28. West Feather River Levee Reconstruction Agency - the County of Butte is one of six signatories to a Joint Powers Agreement (JPA) creating a public entity known as the West Feather River Levee Reconstruction Agency (WFRLRA), which was created to permit six signatories to participate as a single entity with the state and federal government in necessary renovation of levees on the west side of the Feather River. The Local Project Cooperation Agreement (LPCA) is a prerequisite to the release of state and federal funding for the renovation project. The proposed amendment modifies language in the JPA to make it congruent with the LPGA - action requested - APPROVE AMENDMENT TO THE JPA AND AUTHORIZE THE CHAIR TO SIGN. 29. Auctioneer agreement - surplus property - requests for proposal have been evaluated for professional auctioneer services of surplus and unclaimed found property. An agreement has been prepared with C. Popovitch Auctioneers, Inc. with a term from May 10, 1994 to May 9, 1996 and also containing provisions for two additional one year extensions. The amount of the contract is based upon a commission of gross sales as follows: vehicles, 7- 1/2$; general County surplus property 10$; and unclaimed found property, 9$ - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 30. Runaway and Homeless Youth Grant award - the County's Mental Health Department has received an award notification from the Department of Health and Human Services for assistance in financing the Runaway and Homeless Youth Program in a yearly amount of $90,842 for a total award amount of $298,722. The contract/grant period is October 1, 1993 to September 30, 1996 - action requested - AUTHORIZE ACCEPTANCE OF $90,842 FROM THE STATE DEPARTMENT OF HEALTH AND HUMAN SERVICES. 31. Occupational Health Services (OHS) - OHS provides the Employee Assistance Program (EAP) for County employees and their dependents, and provides for referrals from managers for employees experiencing performance problems. The renewal contract is for the period May 1, 1994 through April 30, 1995 at the rate of $3.80 per employee, per month (previous contract year rate $3.89 per employee, per month) - action requested - APPROVE CONTRACT RENEWAL WITH OHS, AND AUTHORIZE THE DIRECTOR-PERSONNEL TO SIGN THE RENEWAL SUBJECT TO APPROVAL BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. Brown, Chico - the Women, Infants and Children (WIC) Program, a 100$ Federally funded activity currently leases 1,300 square feet of office space at 1311 Mangrove Avenue, Suite E, Chico. The term of the proposed lease is June 1, 1994 through December 31, 1995 with monthly base payments of S680 ($0.523 per square foot) - action requested - APPROVE LEASE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 33. County of San Mateo/County of Butte - under the terms of this agreement, the County of San Mateo will continue to handle the general administrative responsibilities for the Medi-Cal Administrative Claiming Program (MACP). Participating jurisdictions pay a fee based upon the amount of anticipated revenue received from the program. Butte County's fee for 1994-95 is $4,474 (100$ Federal) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 34. Nancy Aqliolo, Toby Hale, Susan McManus, Monica Schwartz, Teresa Wood-Hansen - the County contracts with selected therapists for the provision of physical and occupational therapy services for children eligible for the California Children's service (CCS) Program. The proposed agreements adjust the maximum amount payable under the utilization of the services (Aqliolo/$26,000; Hale/$5,000; McManus/$31,000; Schwartz/ $28,000; Wood-Hansen/$34,000). This program is mandated by Health and Safety Code Section 252 and is funded from realignment funds (25$), State funds (50$), and County matching funds (25$). This is a budgeted item and no additional appropriation is necessary - action requested - APPROVE AGREEMENTS AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 35. 1994-95 Comprehensive Perinatal Outreach Application - the State has made available 100$ State funds that can be utilized to provide selected services to pregnant women. The maximum amount payable under this application fs $51,399 for the period July 1, 1994 through June 30, 1995. Additional funding for the program will be received from special tobacco education monies - action requested - APPROVE APPLICATION AND AUTHORIZE THE CHAIR TO SIGN. Page 150 May 24, 1994 94-159 36. State Department of Health Services - proposed is an amendment to the contract for Medi-Cal Administrative Claiming which increases the amount payable to the County from $381,000 to a maximum of $1,405,150 for the period July 1, 1992 through June 30, 1994. The actual amount billed will be calculated from claims prepared by participating County departments (Public Health, Mental Health, Welfare and Public Guardian). The claiming process is expected to result in a continuing increased inflow of State funds into the future with temporary increases related to claims from prior years. These funds will supplant County discretionary funds - action requested - APPROVE AMENDMENT TO CONTRACT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 37. Agreement for preparation of waste generation studies, non-disposal facility elements, Countywide siting element, and the Butte County Integrated Waste Management Plan - proposed is an agreement between the County, cities and town to share the cost to develop proportionally these studies. The County's Public Works Department will administer the contract for services and will maintain sufficient records for accounting the contract's costs. The County's share of these costs will be funded through the Neal Road Landfill Management Fund - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 38. 1993-94 Gridley Transportation Services agreement - proposed is amendment no. 18 to the agreement to allow the continued operation of the Gridley Golden Feather Flyer until June 30, 1994 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 39. California Used Oil Recycling Block Grant Application - proposed is an application to the California Integrated Waste Management Board (CIWMB) seeking $36,389 in grant funding to capitalize a waste oil recycling tank, oil filter collection container, household hazardous waste (HHW) storage container, and supporting materials, to establish a Waste Oil Recovery Program at the Neal Road Landfill. The County's contribution specified in the grant application is $2,931 (Neal Road Landfill Management Fund) - action requested - ADOPT RESOLUTION 94-60 APPROVING GRANT APPLICATION AND AUTHORIZE THE CHAIR TO SIGN. United States Forest Service - proposed is an agreement commencing May 1, 1994 to September 30, 1994 for continued funding ($7,500) which allows for reimbursement for deputy patrol wages to patrol the Lassen National Forest campground areas (Butte Meadows, Cheery Hill, West Branch, Philbrook Lake and Soda Springs) - action requested - AUTHORIZE THE CHAIR AND SHERIFF-CORONER TO SIGN THE LASSEN NATIONAL FOREST OPERATING AND FINANCIAL PLAN FOR PATROL SERVICES ON THE LASSEN NATIONAL FOREST SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 41. 1994-95 Office of Criminal Justice Planning (OCJP) grant application - the proposed grant provides the continued funding necessary for two full-time deputy sheriffs to investigate and eradicate marijuana cultivation sites as well as arresting suspects and the follow-up investigation necessary for successful prosecution. The amount requested under the grant is $140,250 (NO COUNTY MATCH REQUIRED) - action requested - ADOPT RESOLUTION 94- 61 APPROVING APPLICATION FOR "MARIJUANA SUPPRESSION PROGRAM" GRANT. 42. Highway 70 Marysville to Oroville By-Pass, Environmental Impact Report and Third River Bridge - action requested - APPROVE LETTER TO CONGRESSMAN HERGER INDICATING THE FOLLOWING: 1. THE BOARDS SUPPORT OF HIS EFFORTS TO INCLUDE A $3 MILLION LINE ITEM IN THE 1995 TRANSPORTATION APPROPRIATIONS BILL; AND 2. URGING HIS SUPPORT OF CONGRESSMAN FAZIO'S EFFORTS TO SECURE FUNDING TO HELP ADVANCE THE THIRD RIVER BRIDGE WHICH WILL IMPROVE ACCESS BETWEEN YUBA CITY AND ROUTE 70, AND AUTHORIZE THE CHAIR TO SIGN. 43. Mechoopda Indian Tribe of Chico Rancheria - requests the County provide partial financial support for a flag pole to be erected in honor of Native Americans who served in the armed forces, died in that service, and are now buried at the Mechoopda Indian Tribe of Chico Rancheria Cemetery. Total cost for the project is estimated at $1,600. The Veterans of Foreign Ware have donated a flag, the City of Chico is donating $500, and the tribe is requesting a $500 donation from the County - action requested - APPROVE APPROPRIATION OF $500 FROM COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM INCOME; AUTHORIZE PAYMENT TO THE CHICO RANCHERIA; AND AUTHORIZE THE APPROPRIATE BUDGET TRANSFER.
