HomeMy WebLinkAboutM052973May 29, 1973 73_878 _ PUBLIC HEARING: FORMATION OF SKY'a1AY ASSESSMENT DISTRICT N0. 1 ~ a p,~, ~iEARING CONTINUED TO JUNE 26, 1973 FOR FINAL DETERMINATION The public hearing relative to hearing any and all protests regarding the Skyway Assessment District No. 1 reconvened at 8:00 p,m. at the Veteran's Memorial Ha11 in Paradise. Present: Supervisors: Cameron, Ladd, Gilman and Chairman McKillop; Mr. Clifton Nickelson, Administrative Officer; Mrs Dan Blackstock, County Counsel; Mrs. E11ie Witt, Board of Supervisors Clerk pro tem. Appearances: Mr. Everett McCain from McCain and Associates, Mr. Dan Cook from Cook and Associates, and Mr. Jim Raekerby. Mr. Dan Blackstock, County Counsel, set out the proposed outline and offered a brief explanation regarding the procedures of the meeting, what the purpose of the meeting was and also urged anyone that had something to say to first identify themself, state their address and whether or not they lived in the proposed assessment district. The hearing was opened to the public and the following were heard: 1. Mr. James Snow 85 Roe Road offered comments to the Board regarding their violation of proper assembly procedures wherein all the chairs are to be attached to one another-; 2. Mr. Lightonberg inquired of Nr. Blackstock whether or not a petition signed by many persons involved in the assessment district could be sent to the Board rather than just individual personal letters; 3. Mr. Ken Bowden (owner of some district property) also inquired of Mr. Blackstock who was allowed at this meeting; 4. Mr. Laurence Webb (5880 Skyway - inside district) requests a clarification of the deadline on which protests (written or oral) may be heard: There being no further e.omments at this time the meeting is turned over to Mr. Everett McCain for his explanation of the system, the need, cost and proposed design of the proposed drainage system. Mr. McCain also urged persons in the audience to express any problems that the construction of the drainage system might cause. At this time, Mr. McCain asks-.. for any comments or questions from those in attendance. 1. Mr. James Nea11 86 Roe Road inquires of Mr. McCain whether or not his system would work properly in the snow; 2. Mr. Lightonberg 570 Oakwood Lane inquires where the line will be laid, whether or not the sewer line will go down the Skyway; 3. Sharon Poleschook (owner of district property) doesn't approve the project if it allows more drainage onto her property (AP 51-25-73 and AP 51-25-72) and inere~sing the culvert thereon; 4. Mr. Laurence Webb 5580 Skyway inquires whether or not there will be an assessment regardless of whether or not water drains onto the Skyway from a persons property; 5. Mr. Jim Drake (district property owner} requests a future meeting with McCain and Associates relative to the set up of the stakes and the procedures. Mr. Drake offers no protest. Dan Cook from Cook and Associates for his explanation re3.a.tive to the se~~rer system, the color codes used on the maps and thc'proposed cost of.this portion of the system. Afro Cook also inquired if there v~ere any comments or ouestions and the following responded 1. Afr. Jim Drake inquires where the dispersing area for the sevaer system will be when the project is completed; 2. hlr. Ivan Haclter inquired whether or not the lateral lines could. be directed or cont:ected to each individual piece of property; 3< Charlas R. AfcHugh 5813 Crestview Drive offered a short.~lecture on vrhy this project is being done, wha as'.~ced for it and the cost to each person assessed. Chairman NIcY.illop expresses to the audience the flow of events leading up to the necessity oz this project, such as the widening of the Skywv,y. Supervisor Cameron offers his e;~planati.on on ~=rhy he feels it is imperative to put in tae laterals while the Sllyvray is still just a two- ' 1a.nd road rather than digging up 80 ditches through four lanes of road. 4. Afr. D. R, ifattais 5950 Del Afar Avenue offers his opinion that the sewers are necessary and, in his opinion, it is inevitable that someday there will be a need for them throughout Paradise. The hearing is recessed at 9:00 p.m. and reconvened at 9:05 p.m. The hearing is closed to the public and the audience is thanfred for. attending the meeting. Chairman hfcYi7.lop offers an explanation of the meeting procedures and reconvenes the public hearing portion of the meeting to allow any. furtk~ier oral protests which people may vrish to express. Laurence ~~ebb _ as property owners at 5880 Skyvray, Paradise, we hereby prote~i the formation of DrainaGe District -- Resolution 73-61 our reason for protest as follo~•rs: This is a major item which should • be decided by vote of persons r~ithin the district; the method of assessment for drainage is rot equitable, in that it bears no rela.ticn- ship. to benefits to be derived therefrom; the property owners have no voice in this matter, which is unfair. I~Ir. John Tolle 6537 Pentz Road (Fir Strut property o=~rner) I am not here to protest, I am here to protest the protesters and raise my hand as one o.f the people in Paradise who asked the Board of Supervisors to look into the problem at hand. He goes further to state that he is willing to pay his share of the taxes to do tae job. Mr, Blackstock reads into the record the names of the written protestors which protests have been filed and are as follows: Ralph B. Menunen, P, 0. Box b39, Paradise; Andrew R. Koller, 5542 Schmale Lane, Paradise; PSike Poleschack, AP 51-25-73 and a portion of AP SI-25-72, Paradise;.. Annie Stoltz, 3276 Olive, Paradise; Laurence Stubb and Genevieve M, Webb, 5880 Skyway, Paradise; Esther M, Glenn, 509 Inez Way and 7545 Skyway; Butte Enterprises, Inc. AP 52-121-4.5; and Robert E, Punteney 5691 Skyway, Paradise. Chairman McKillop inquires as to whether or not there are any further remarks, comments or protests, and closed the hearing, S"apervisor Gilman Makes a few remarks relative to the conception of this project, and expressed to the audience that it arose from requests coming from cikizens from Paradise and persons visiting Paradise; Supervisor Cameron thanked all the persons for attending the meeting and mentioned that he was one o£ the main instigators for having this meeting i_n Paradise and suggested that a more comfortable place might be reserved for the next meeting, Page 251, May 29, 1973 May 29, 1973 Chairman rlclCillop assured all the gersons attending tonight that all the protests, Taritten and oral, would be considered when the Board makes their decision on June 26, 1973, He again thanked the people for. attending this hearing, 73-879 ADOPT ORDINANCE IdO, 1358 AMER'DING OP.DINANCE N0, 1347, CALLING ANA PROVIDING FOR SPECIAL COUNTY CHAPTER ELEC~ TI~_CONSpI~IDATING S~AP_ATL PRECINCTS Dan Blackstock, County Comisel, briefly explains the Ordinance on which the Board is to vote wherein a separate precinct is being sought for the Centerville voting district', It :is moved by Supervisor Cilman, seconded by Supervisor Cameron and carried, that Ordinance h7o, 7.358, amending Ordinance No, ].347, calling and providin fora special county Charter Election, setting up a special. precinct for Centervill district, was adopted and th~~ Chairman was authorized to sign, A~3v5: Supervisors Cameron, Gilma.n., Ladd and Chairman McI:illop NOES: None ABSENT: Supervisor Madigan }iECESS: The Board recessed at 9:30 to go-into an executive session, RECONVENED: The Board reconvened at 10:20 p,m, following an executive session.
