Mrs. Gonzales writes in favor of zoning for single family mmbile home dwellings in the location of the proposed Sierra De! Oro rezone. Ta be discussed at time of the hearing. Les Adolf, Oroville. Mr, Adolf writes conceming a zoning notice violation in an A-R zone located on Ellis Lane in Oroville, AP 35-18-08. Referred to Jim Lawson for comment. Sierra Del Oro Nome Owners Association, The Association writes requesting that an interim zone of R-MH be approved pending final outcome of the rezoning proposal now underway. SMITH, CHICO DENIED On motion of Supervisor Richter, seconded by Supervisor Madigan and ', unanimously carried, the request of Norman A, Smith, Chico that a compromise drainage assessment which was agreed upon on February 14 be considered postponed was denied. 7$-1028 PUBLIC HEARING: REVENUE SHARING PLANNED USE The public hearing on Revenue sharing planned use was held as advertised. A memo from Clif Mickelson, Administrative Officer, stating that the revenue sharing funds are estimated to be $f,910,595 discussed. There was also a memo from the Revenue Sharing Committee; also a letter of resignation from Wayne Angel, chairman of the committee, Supervisor Richter asked if the Board had to make a decision today. He was told that the object of today 's hearing was to get in-put from the residents of the Countyo Hearing opened to the public. Appearing: I. Ms. Anita Perlmother, representing NorCal Center on Deafness. They request support of the Board for a segmant in the County that is little understood. Future plans call for the setting up of interpreter services for this area. They are requesting that funds in the amount of $b, 000 be set aside for this service. MARAN, APPEAL OF APPROVED ENVIRONMENTAL IMPACT REPORT & USE PERMIT- CONTINUED TO JUNE b, 1978 at 9:45 a.m. The public hearing on the John J. Moran appeal of approved environmental impact report and use permit to allow a ten unit mobile home park on property zoned "A-2 limited"located on the west side of Foster Road, approximately 150 feet south of Southern Pacific Railroad rightrof-way, identified as AP 52-25-69, Paradise,. was held at this time, Letter from Phil Mace requesting a continuance until certain items are resolved discussed. It was felt that the Planning Department and Mr. Nelson should be allowed time to formulate their answers. Hearing opened at this time and continued to June 6, 1978 at 9;45 a.m. to allow the Environmental Review Department to respond to the new questions. ', 78-1030 CONTINUED HEARING ON REVENUE SHARING PLANNED USE ', The hearing on revenue sharing planned use held as recessed. Mr. Amos Saunders, a deaf person, stated by way of his interpreter, that the deaf community should be considered and these people should be worked with to determine their needs. 2. Mr. Ted Coulter and wife Nancy, representing Chico's Mealsron-Wheels, set out their request for funds to aid them in their work of supplying meals for senior citizens and shut-ins. The Board of Supervisors allotted them $7, fast year. Many people would have to be placed in institutions if they were not served these meals daily. They requested that the Board take under advisement their request for $7,500 revenue sharing funds and requested the Board's favorable consideration . 3. Ms, Margaret Caldwell, Paradise Meaisron-Wheels, Ms. Caldwell requested Board consideration in granting this organization funds from revenue sharing. ', 4. Michael Pierce, Swede Flat Read, requested .Board consideration of their request for funds as set out in the information given #o the Revenue Sharing Committee . 5o Ms. Carol Steinrude, Do-it-Leisure Cooperation. She stated she supports the other agencies. This organization is working with the various recreational districts in the county It is their feeling that the disabled person should be intregrated back into the community. Q~lOT REQUIRED) & REZONE FROM "A-R" TO "AR-MH"'(AGRICULTURAL RESIDENTIAL-MOBILE HOME) PROPERTY LOCATED SOUTH OF V-6 RD., OROVILLE ADOPT ORDINANCE 1927 T e pu is hearing on the approved negative declaration and rezone from "A-R" agricultural-residential) to "AR-MH" (agricultural residential-mobile home) property located approximately 350 feet south of V-6 Road, approximately 400 feet west of Lower Vyandotte Road, identified as AP 37--73-8, 23 and 24, containing 2.5 acres, more or less; Oroville, held as advertised. Earl Nelson, Environmental Review Director, set out the background on the negative declaration. This change in the zoning merely allows mobile homes to be placed on the property. The density would remain the same. It is recommended that the Board approve the negative declaration. Hearing opened on the negative declaration. Appearing: Phillip Wilson. He asked what a negative declaration meant. Hearing closed to the public and confined to the Board. On motion of Supervisor Moseley, seconded by Supervisor Richter and unanimously carried, the Boord finds that the proposed project could not have a significant effect on the environsrent and a negative declaration is recommended. Hearing on the rezone held at this time. Background of the rezone set out by Jim Lawson, Planning Director. Approval of the rezone was recommended on a 4-I vote of the Planning Commission. It conforms to the elements of the General Plan, Hearing opened to the public. Appearing: I. Mr. Raymond Lumsden, applicant. He stated he wanted to place a new ', mobile home on the property. 2. Mr. Bamey Dolan, neighbor~,_.: _ , He showed pictures of the area to the Board members. These people do not have a sewage system. Most of the people favor this request of Mr. Lumsdeny an~ley do not feel fihat it will harm the area. 3. Mr, Phillip Wilson, Oro-Bangor Highway. Petition apposing the use and rezone presented to the Board. They do not want mobile homes in that area. Mr. Wilson had appeared at the Planning Commission hearing and set out his opposition at that time. ', Hearing closed to the public and confined to the Board. May 30, 1978 Page 473. -------------- Ma~301 1978 __-__-_-_________ 78-1032 APPEARANCE: RED MELTON, HOUSING AUTHORITY: APPROVE REQUEST FOR 150 UNITS IN SOUTH OROVILLE & f20 UNITS IN CHAPMANTOWN Mr. Melton, Housing Authority, set out the matter of the referendum for 150 units in South Oroville and the referendum requesting 150 units in Chapmantown, Chico. He feels that the units are needed. His purpose today is to request the Board to endorse these proposals. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the Board endorsed -the request of Mr. Meiton for the 150 units ', in South Oroville and 150 units for Chapmantown, as set out in the ballot proposition ', that brings the question to the vote of the people in the areas. On motion of Supervisor Richter, seconded by Supervisor Moseley and unanimously carried, the Board finds the proposed project could not have a significant effect on the environment, and a negative declaration is recommended. Hearing on the rezone held at this time. Mr. Lawson set out the background of the rezone request. Planning Commission voted 5-0 in favor of the zoning change. This conforms to the General Plan. On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, .proposed rezoning for "R-3"to "R-2"for property located on Northeast corner of Mosseman Avenue and Lassen Avenue, Chico was approved, Ordinance 1928 adopted and the Chairman authorized to sign,. with the finding that it is consistent with the General Plan and that there will be no adverse effect on the environment. Supervisor Richter asked why there could not be a categorical exemption for these type rezoning; Mr. Lawson will write a memo on the matter to the Board members. Page 474. May 30, 1978 --------------- May_30L1978 ------------------- 78-1034 ACCEPT CETAC RECOMMENDATION FOR CETA TITLE f j ~ TITLE VI MINOR MODIFICATIONS Minor modifications have been prepared for CETA Title II and Title VI grants. The reasons for the modifications are to adjust amounts available for Fiscal Year 1978 grants due to retroactive indirect cost allocations to be charged against Fiscal Year 1977 grants; and to adjust the mumber of participants carried over in each grant from Fiscal Year 1977 to Fiscal Year 1978. In the cast of Title II, the adjustment is $782; in the case of Title VI, the adjustment is $b,34b. CETAC recommends approval of the modifications. On motion of Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, recommendations of CETAC were approved of the modifications and Personnel Director was authorized to sign. 78-1035 ADOPT RESOLUTION 78-102 RE OFFICIALS BONDS BEING SET PRIOR TO ELECTION Pursuant to ovemment Code Section 2 5 a rasa ution as en prepare prescri ing the amounts of officials bonds prior to the primary election. On motion of Supervisor Richter, seconded by Supervisor Lemke and unanimously carried, Resolution 78-102 prescribing amounts of officials bonds prior to the primary election was adopted and the Chairman authorized to sign. 78-1036 FEATHER FALLS VOLUNTEERS (OFF AGENDA AT THIS TIME) ', The volunteers have requested that their District Allacation Program contract be amended to permit them to purchase walkie-talkies, No change in the appropriation is required. Taken off the agenda at this time, 78-1037 APPROVE CHANGE ORDER: NO RD FIRE STATION A change order as een prepared in the decreasing amount of $1,238 to change the design of the concrete slab. On motion of Supervisor Lemke, seconded by Supervisor Moseley and unanimously carried, change order No. I, in the decreasing amount of $1,238 to change the design of the concrete slab was approved and the Chairman authorized to sign. ', 78-1038 BUTTE COUNTY FAIR-PAINTING AGREEMENT APPROVED An agreement has been prepared with Bowers Pointing Service for the painting ', of the structural steel in the livestock barns on the grounds of the Butte County Fair. ', On motion of Supervisor Moseley, seconded by Supervisor Richter and unanimously carried, agreement with Bowers Painting Service was approved and the Chairman authorized to sign. 78-f 039 BUDGET TRANSFERS APPROVED Budget transfers discussed. mos from Sheriff Gillick and Bill Lawrence set out and discussed. Supervisor Madigan expressed his concern about the memos from the Auditor. B-209, Recorder, discussed. On motion of Supervisor Lemke, seconded by Supervisor Winston and unanimously carried, the following. budget transfers were approved: B-199 Sheriff/Coroner - Enfarcement. Transfers $2,012 from rents and leases of equipment, and together with $22,500 from the reserve, increases appropriations for equipmenf maintenance $22,500; office expense, $2,000; and medical and dental supplies, $12. The purpose of this transfer is to cover additional vehicle maintenance cost due to more use of vehicles and more repairs required to keep older vehicles in operation until new ones are received and also to cover increased office supply cost because of the changeover in reporting systems. B-201 Sheriff/Coroner-Incarceration, Transfers $1,500 from extra help and $29.20 from other transportation and travel, with $1,000 going toward overtime, $500 to cLvPlurm-g and personal supplies, and $29.20 to outrof-county travel. The purpose of this transfer is to cover overtime costs necessitated by changeover and new personnel requiring regular personnel to cover shi fts, as well as new uniforms havinc to be purchased for new personnel. The transfer for outrof-county travel is to cover the cost of a trip where no funds were budgeted. B-210 Supplemental Manpower Program -CETA Title VI. This is a $74,633 transfer in order to adjust appropriations within various CETA Title VI l3SE subgrantee allocations. B-211 Publ is Works -Transportation Services. This transfer increases appropriations for the City of Oroville and county-portion? of the Oroville Express taxi service based upon revenues from sales of tickets not included in revenue estimates and to provide an additional appropriation for the county subvention of the program from an equipment item not being purchased. It transcfers $10,000 from equipment, and together with $14,000 from ticket sales revenue, increases the county's share of the taxi service by $14,400 and the city's portion by $9,600. B-212 Contributions to Other Agencies -Juvenile Justice Delinquency Prevention Planning and Administration. Transfers $895 from the reserve to set up a budget for the local portion of the cash match for the Juvenile Justice Delinquency Prevention Planning and Administration grant which was approved by the Board of ', Supervisors on August 2,. 1977; Minute Order 77-1495. B-213 Audi-tor-Controller. Transfers $8,500. from salaries and wages to extra help to cover current and projected deficiencies caused by extra help coverage ', of extended vacancies in regular help positions. B-214 Civil Disastero Transfers $30 from outrof-county ovemight travel to special departmental expense to cover current and projected deficiencies caused by increased cost of blood bank supplies. B-215 Building and Grounds Maintenanceo Transfers $2,000 from household expense to major maintenance to cover deficiencies brought about by inflation and under budgeting maintenance projects. B-216 Chico Marshal. Transfers $1,800 from regular salaries and wages, $74.24 from outrof-county overnight travel) $56.41 from office expense, and $228.08 from equipment; thereby increasing the appropriation for extra help, Page 476. An accident of one of the vehicles resulted in the transfer for maintenance of equipment and night court and late adjournment of day court was not anticipated and has exhausted all overtime and extra help funds. B-217 Court Reporters. Transfers $9,250 from the reserve to professional and specialized services to cover current and projected deficiencies caused by an increased workload and an increase in the per diem allowance from $55 to $75 per day. B-218 Agriculture. Transfers $220 from maintenance of equipment to rents and leases of equipment to cover an increase in copying requirements and also transfers ', ,,$1,700 from professional and specialized services to other transportation and travel to cover current and projected deficiencies caused by an increase in mileage and full ', costs. B-219 Veterans Service Officer. Transfers $100 from maintenance of equipment to office expense to cover an anticipated deficit in the office expense account. 78-1040 EL MEDIO DITCH: PUT OVER ONE WEEK Discussion on Stptus of Farmers Home Administration grant/loan proposal to be presented by Ward Connerly of Connerly & Associates put over one week. '; 78-1041 APPROVE HARTSEL EDWARDS RENEWAL OF VARIANCE ', Howard Toussaint set out the background of the Hansel Edwards request for renewal of variance to Section 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home at AP 65-18-27, P.O, Box 581, Magalia. Mr. Toussaint L stated he had visited the property and the situation remains the same as last year. He recommended approval of the variance. On motion of Supervisor Lemke, seconded by Supervisor Moseley and unanimously carried, renewal of the Hansel Edwards variance to Section 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home at AP 65-I$-27, Magalia was approved for an additional year. 78-1042 APPROVE CONTRACT FOR FEASIBILITY STUDY WITH STATE DEPT. OF BENEFIT PAYMENTS A contract has been prepared with the State Department of Benefit Payments to develop a proposal for ~.feb~b`i~l~tXi study for pn automated welfare eligibility determination system funded by the state in the amount of $5(,000. On motion of Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, contract for feasibility study was approved and the Chairman authorized to sign. 78-1043 APPROVE EXTRA HELP BUILDING INSPECTOR Public Works requests authorization to hire an extra help building inspector for a period of 90 days at the fifth step of the salary range. The Personrx~l Director supports this proposal, On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, request for extra help building inspector for a period of 90 days at the fifth step of the salary range was approved. Page 477, May 30,. 1978 ________________May~4,=127,1==============__=__ 78-1044_AUTHORIZE ARPLICATION TO PUBLIC UT1l.LTIES COMMISSION FOR BIKE CROSSING AT SPRR NORTH OF BIG CHICO CREEK An application to the Public Utilities Commission for a bicl<tZCle crossing of the SPRR .for a connecting route between State Route 32 and Chico State College is needed for approval in-order to construct the crossing, Supervisor Richter felt that Public Works had done a yeoman's job on this and congrat€ulated them on their efforts, On motion of Supervisor Richter, seconded by Supervisor Lemke and unanimously carried, rmpp~~ation to Public Utilities Commission for a bike crossing was authorized and the ,Chairman authorized to sign. 78-1045 APPROVE REQUEST FOR SCHOOL BUS STOP ON BIGGS-WEST GRIDLEY ROAD The Board previously approved 500 for the District 4 revenue sharing program to construct a school bus stop on Biggs-West Gridley Read subject to necessary right-of-way easements being provided by the community, Public Works requests authorization to install the bus stop subject to the same conditions. Discussed, On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried,. request for school bus stop approved, subject to the same conditions. 78-]046 PUBLIC HEARING: ROBERT F, PASCH-APPROVED NEGATIVE DECLARATION (E.I,R. There are other mobile homes in this area. There is the need to provide off-street parking for this home, This requirement will have to be complied with. Del Siemsen, deputy county counsel, explained the matter of categorical exemption, .Class 5 of the State Guidelines is a categorical exemption and that excludes rezoning matters, Wearing opened on the negative declaration. ', On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, rezone from "A-R" to "AR-MH" {agricultural residential-mobile home) property located on the west side of Seventh Street approximately 400 feet south of Yuba Avenue, identified as AP 3l-237-6 and 2 and 31-242-6, containing ~a48 acres, more or less, Oroville, . was approved; Ordinance 1929 adopted and Chairman authorized to sign, with the finding that it is consistent with the General Plan and that there will be no adverse effect on the environment. 78-1047 APPROVE OROVILLE EXPRESS CONTRACT AMENDMENT EXTENSION TO JULY I, 1978 Orovil a Express contract amendment extension to Ju y 1978 discussed. Last week the Board approved the fund transfer for this action; they now have the contract amendment. Mr. Castleberry stated that if the Board approves this action, he will then take this amendment to the City r.r)f Oroville for their action. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, the Chairman was authorized to sign the Oroville Express contract amendment contingent upon the City of Oroville signing, 78-1048 DISCUSSION: CHICO TRANSIT DEVELOPMENT PROGRAM Public Works suggests that the Board meet with the Chico City Council to discuss development program, possible ways of proceeding (ballot or start-up now), joint powers agreement and who should operate if system is impleumented. Public Works also recommends that discussion be had regarding amendment-#o Chico Clipper contract expanding services. Chairman Winston appointed Supervisors Madigan and Richter to meet with City representatives to discuss this matter. ', Mr. Castleberry said there has been requests from the senior citizens; they would like to have their tickets refunded if they disa~~er the funds are needed for use elsewhere. The Auditor was instructed to work out a system for refunding of ticket purchases if the person needs the money for other purposes. 78-1049 DISCUSSION OF VACANCIES ON THE MENTAL HEALTH ADVISORY BOARD PUT OVER AT THIS TIME Discussion of vacancies on the Mental Health Advisory Board was put over at this time. 78-1050 APPEARANCE CLAYTON D'ARCY, EXTENSION OF SERVICE, OROVILLE EXPRESS Clayton D'Arcy, Orovi le City Council, thanked the Board for w at they have done concerning the senior citizen taxi operation. REPRESENTLNG-IIM-&-CLAUDIA MOLL OWNERS OF THE PHOTO SHOP ON BIRD STREET RECENTLY PURCHASED Bill Baber, local attorney at law, stated he was representing Jim pnd Claudia M~~;~P, who have recently purchased the photo shop acr~ass the street on Bird Street, They object to the matter of the unsecured property taxes becoming a lien an the property. They received a letter from the County Tax Collector stating these taxes have to be paid today. Chairman Winston welcomed Mr, Baber and requested that Carl Morton, county tax collector,. explain the matter. Mr. Morton commented on the letter in question, The seller should have paid these taxes. Mr, Baber wanted to know why the buyer was required to pay the taxes four months before other property owners. Mr, Norton stated that the claim is against the seller. There is a rental on the property at this time, He was fold they could place the mobile home on the property, The County changed their procedure for the placement of a second unit on property. If the Philbrooks cannot put the mobile home on the property, they can not purchase fhe property, Matter discussedo On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the request of J, Philbrook to place a mobile home on his property at Oro Dam West and 13th Street, Oroville, as a second unit on said property, was approved and the County was authorized to tell anyone that was in the process of applying for permits for this second unit at the time the policy was changed, that their requests would be honored and second unit would be allowed, 78-1053 APPEARANCE: EUBERT DOWNING, CHICO: TRAFFIC PROBLEM ON EL PASO WAY Mr. Eu ert Downing, C ico, stated a represented peop a residing on or near ', EI Paso Way, Chico. Letter regarding the problem received by the Board. He requested time on the agenda to discuss the reasons for closing EI Paso Way. Chairman Winston requested that Supervisors Richter and Madigan meet with Chico representatives and these people to discuss the matter and explore the aFtematives.
