Pledge of allegiance to the Flag of the United States of America Invocation by Supervisor Lemke 77-1065 APPROVAL OF MINUTES On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, the minutes of May 24, 1977 were approved with the following changes: Page 204, bottom of page, delete four lots, 16th and Grand Avenue in Thermalito, and add Gridley; Page 206,Item 77-1004, change pine needles to pine beatle; Page 207, change Earl Wilson, to Nelson, throughout the minutes; Page 210, middle of page change "could have. an effect" to "could not"; Page 221, Item 77-1055, show that Land Fraud Unit is using personnel from Planning one dap per week, 77-1067 COMMITNICATIONS Joseph F. Supervisor Moseley stated she apposes this amendment; she feels if approved, these positions would become permanent employees. Jim Rackerby, Personnel Director, explained the justification for the ordinance. On motion of Supervisor Winston, aecoaded by Supervisor Lemke and unanimously carried, second reading of the ealarq ordinance amendment was waived. On motion of Supervisor Winston, seconded by Supervisor Lemke and carried, Ordinance 1828 amending the salary ordinance wen adopted, adding two sanitarian trainees under CETA Public 6ervice EmploymenC Program and reclassifying one agricultural corm¢iasioner c~aseificakion and provide for flexible hiring of positions in Manpower Administration and Aeaessor's Office and Chairman authorized to sign. AYES; Supervisor Lemke, Madigan, Winston and Chairman Richter NOES: Supervisor Moseley 77=1073 SET HEARING FOR COUNTY SERVICE AREA N0. 13, TO LEVY DIRECT ASSESSMENT CHARGE TO EACH OF PARCEL INVOLVED FOR EIGHT STREET LIGHTS A public hearing was set for June 21, 1977 at 11:00 a.m. for County Service Area No. 13, to levy a direct aeaesament charge to each of the 70 parcels involved for eight atreeC lights. 77-1074 ADOPT RESDLUTION 77-90 DESIGNATING DIRECTOR OF LIBRARY, ~. R. TERRY, TO SIGN GRANT AGREEMENTS On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, Resolution 77-9A designating Director of Libraries, J. R. Terry, to sign grant agreements was adopted and the Chairman authorized to sign. 77;1075 AUTHORIZED ADDITION TO WARRANT LIST FOR WARRANT FOR WODDSON CONSTRUCTION CO. A rehabilitation progress payment in the amount of $5,514 to ~Woodaon Construction Company pursuant to-a rehabilitation contract agreement ((Housing and Community Development) was inadvertently not placed on the ~uditar's list of warrants for approval. Supervisor Moseley stated she opposes the adoption of this code. Supervisor Winston, Chairman Richter and Mr. Paulus to meet and study the Code and bring back a recommeadation to the Board. •1077 BUDGET TRANSFERS APPROVED On motion of supervisor Winston, aecoaded by Supervisor Madigan and unanimously carried, the following budget transfers were approved; H-1 Treasurer & Tax Collector. Transfer $25 from office expanse to ambership to provide an appropriation for a membership in the California aunties Revenue and Reimbursement Officers Association. Transfers $750 from the reserve to Commission ebera travel in order to provide an appropriation for three new Planning emission members to attend an educational program. Mr. Ringel has started work for the applicant. Mr. Smith is lust not appealing the amount but the fact that they do not know the amount that they are to deposit. Mr. Jefferson Brown, attorney at law, representing Mr. Smith. He stated that they do sot know what they have to do to satisfy the County, The assessment is not known, They are requesting that the condition be removed or if sot removed, to be made more certain as to the amount of the deposit, The coadition ie too vague. The problem is that to determine what the assessment would be would cost money. Mr. Rfngel had requested County funds to make a preliminary design, Mr. Brown stated that Mr. Smith does not oppose the formation of an assessment district. Chairman Richter set out hie views concerning this matter. The Board does not know whet the cost would be for Mr. Riagel to make asi estimate of costs relating to the coadition. Mr, Paulus, fire warden, requests some type water source ouC in that area. Tanks could be placed sad the area could be required to pay for the tanks. It was felt that more information was needed in this matter. On motion of Supervisor Moseley, seconded by Supervisor Madigan and carried, Public Works was instructed to bring back a figure of estimate of costs for this work and to report back to the Board, with the intent to advance the mosey if it ie an agreeable amount. Bill Turpia, Administrative Analyst, set out the background, The error included part of the City of Oroville and this hearing is being held to correct the error and detach Che property from the service district, Staff recommends that the Board approve the detachment. She checked with County Counsel's office and they informed her that they did not have a copy of the ordinance. It was her feeling that copies of all ordinances should be filed with County Counsel. She rand in the paper that when the new Administrative Building is built, the Supervisors would be placed oa a raised platform in theBoardroom. She objected to the idea o£ the Supervisors being raised above the people. The Board informed Mrs. Paradis that the arrangement would be similar to that in the present Boardroom, and that the Board would at111 be able to look the audience in the eye. The Board instructed County Counsel to have copies of ordinances for the public. Clerk of the Board will be given copies of all proposed ordinances and she will make copies of the ordinance for those requesting them, charging them for said cppy, 77-1093 APPEARANCE: MRS, CECILIA LONG BUTTE INTER-TRIBAL COUNCIL Mra, Cecilia Long, Butte Inter-Tribal Council, stated that they had requested funds from Revenue Sharing. They would like to know why they were turned down. She stated that under Public Law 92512 that as native Americans they have a right to a portion of these funds. Chairman Richter stated that there was only "%" number of dollars and their proposal did not come up to the criteria that was supported. Every project that was funded went to all the citizens of the County; they were county- wide programs. Administrative Officer will inform this council why their grant was not approved. Arthur DeWitt, acting director of the Butte Inter-Tribal Council. questioned the Hoard about the committee that had been set up to study the use of the Revenue Sharing funds. He set out his proposal, stating he would like to see the abandoned vehicle officer be apart-time officer. He has his afternoons free and would like to handle this program, Re has the endorsement of the Highway Patrol. The County could sign s contract with the Highway Patrol and sub-caatract the program to him. William Chaff, assistant Public Works Director, states that in this instance, the aigne are close to being on the County right-oE-way. Searing opened to the public. Appearing: 1. Mrs. Louie Statham set out the location of the property, stating that it is north of the North Valley Mall. The County ordinance required that they place the signs 55' from the centerline of the road; this would place the signs at their front door, They are requesting permission to place the signs 34' from the centerline of the street. Chairman Richter asked if she would accept the condition that the signs be placed 40' from the centerline of the road, Mrs. Louie stated she would accept a 36' setback. 2, Mr, Fred Hocketk, East Avenue, stated he has filed his written objections to this use. At this time he requested that the use permit be denied, stating he felt the signs would be a traffic hazard. Se feels that the signs should be placed on Che applicants building. Mrs. Statham spoke in rebuttal to Mr. Hocke~t's statements. Searing closed to the public and confined to the Board, Supervisor Winston stated that Mr. Appelman and Mr, Camenzind are two of the most conservative people in the County; they are on the Board of Zoning Adjustment. They have recommended denial of the use permit. On motion of Supervisor Winston, seconded bq Supervisor Moseley and unanimously carried, the appeal of Sob Raker & Stan Statham for a use permit to allow four (4) aigne 34 feet from the centerline of East Avenue, oa property zoned "A-2" located on the north side of East Ave., Chico was denied. ~109b APPROVE_REQUEST OF CHICO WORK TRAINING CENTER FOR FUNDS AT THIS TIME Mr. Joe Campbell, Chico Work Training Centex, thanked the Board for their favorable reaction to their regv~at for Revenue Sharing Funds. Se pointed out that the Wark Training Center has had offered to them for the first time, a permanent stable contract that could provide this organization the economic stability to do its planning, The contract is with Fenno Saw Works, Chico. To take on this contract the organization would have to incur an obligation of approximately $17,000 for equipment to do the work. The Board has decided to make available to the Chico Work Graining Center $83,780 from the revenue sharing funds. The Training Center could like to have some of the funds to secure the equipment so they could sign the contract within the first ten days of June, Mr. Campbell request that :he Board, if they could possibly do so, allow them the necessary funds to purchase the equipment to take on this wood contract in a sum slightly over 17,000. On motion of Supervisor Winston, seconded by Supervisor Madigan unanimously carried, request of Chico Work Training Center for funds in the nt of $17,000 was approved, subject to the approval of County Counsel and County Auditor. Dogs dodge the dog catcher; they can spot the man in uniform, The editorial suggested that the dog catchers work after 5 p.m. as the dogs seem to know when the dog catchers work, He does not think the County should allow the dogs to run loose. Discussed; no action taken, -1098 APPEARANCE: GENE MC FARREN ARCBTECT REPRESENTING REGIONAL CONSTRUCTION FORUM Gene McFarren, architect, representing Regional Construction Forum, stated that the Forum meets once a month to discuss their mutual problems, It has resolved many things. He set out the function of the County building department. The building codes are getting more technical. Jim Thorpe, member of the forum, spoke to qualifications of the building department inspectors. He is a contractor representative oe the forum. He works for the electrical union. Aa a contractor representative, he ie concerned about the ability of the inspector to inspect the fobs. There are cases where work that should be turned do~.~n and isn't, and this tllows a safety hazard to remain within the building. Problems involved set out. He stated that most of the inspectors have a little knowledge about a lot of crafts. Too often the inspector is not sure of what he is doing, This forum is anxious to see the Building Department become a strong organization and more knowledgeable. The recent problem of turn-over in the building department does sot make for a strong department. Regional Construction Forum recommended that the Board appoint representatives from this forum to meet with the building department to streamline the operations of the Building Department. Chairman Richter felt this was an excellent idea. Suggestions discussed. He explained what has transpired in the past two weeks, The Tower Chief at the airport was sympathetic and looked at Mr. Reyes plan for development. The main concern is with the noise. Mr, Reyes is going to file a noise easement; this is an instrument of record, Anyone purchasing a portion of the property would know that there is noise ouC there, They could waive anq rights to complain. Background of his plan for development set nut. This plan does to minimal density. He would like to take this portion of the property of the interim A-40 zoning. County Counsel stated that they needed to talk about the format the agreement. He is sympathetic to Mr. Hayes' request but there is a ~b1em and he felt the property should not be exempt until the noise study completed. No action Caken at this time. Page 232. It was suggested that they could meet with the people when Clay Cestleberrq, Director of Public Works, returns from hie vacation, Mr. Castleberrq had mentioned that a turn lane or widening would give easier access to the lot. It was suggested that the County provide this in the way of a condition rather than the 4-lane road, curbs, gutters and sidewalks. Supervisor Winston urged thaC this be put aver one week, Rearing opened to the public. Appearing: 1. Mr. Eat1 Brookes, spoke coaceraiag the delays and the matter of a turning lane. Re stated that right sow the area does not warrant curbs, gutters and sidewalks. Widening of the road might be needed, Another delay would create further hardships. 2. Mrs. Marjorie Cox, Magalia. She reminded the Board that Mr. Harkey had been turned down on a curb, gutter, sidewalk issue. She spoke in opposition to the use permiC. On motion of Supervisor Winston, seconded by Supervisor Lemke and unanimously carried, the Board upheld the appeal of Earl Brookes and Charles Montgomery of the Board of Zoning Adjustment's decision requiring installation of curbs, gutters, sidewalks, and widening of road to four lanes for a use permit on Clark Road, south of Buschmann Road, identified as AP 54-12-33, Paradise, subject to conditions of approval, being No, 1, 2, 3 and No. 4 being replaced by Mr, Brookes signing a covenant that he will not resist inclusion is an improvement district £or curbs, gutters and sidewalks, and that he will construct a turn-out lane in compliance with Pub11c Works recommendation: Ii. It was felt it could be approved subject to approval of County Counsel and Planning. Cost of the study $3600; agreement makes no reference to the City of Chico participation in payment fot the study. Tice agreement could be approved by this Board and then work out the city situation later, Chairman Richter felt the City of Chico will come through with their share of the expense for this study, On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, Chairman was authorized to execute the agreement for noise study at Chico Municipal Airport, with R. '-1104 ADOPT RESOLUTION 77-94 AUTHORIZING ACgUISITI[YN OF REAL PROPERTY BX EMINENT DOMAIN NECESSARY FOR CONSTRUCTION OF COUNTY HIGHWAY KNOWN AS BAGGETT-MARXSVILLE REALIG~NT # 21461-74-1, IN COUNTY OF BUTTE Bill Cheff, assistant Public Works Director, responded'to the matter of adoption of resolution authorizing acquisition of real property by emineat domain necessary for construction of Baggett-Marysville Road. A letter had been sent to Che property owner that there would be a public hearing today at 11:00 a.m. The property owner did not respond to the letter nor is he present today. On motion of Supervisor Wiastoa, seconded by Supervisor Madigan and unanimously carried, Resolution 7744 authorizing acquisition of real property by emiaent domain necessary far construction of County Highway known as Baggett Marysville Realignment, Project X21461-74 1 was adopted sad the Chairman authorized to sign. '-1105 MATTERS PRESENTED BY BOARD MEMBERS Supervisor Moseley asked about the earthquake money. The County was given $284,000 to be applied to the County building project. Earthquake repairs for lo_w income people discussed. Supervisor Moseley felt there should be aid available to these people. The E.O.C. administered the funds for the low income people, Supervisor Madigan stated that United Ways published the list of funds they are awarding. He asked if these people will still receive County funds. Administrative Officer requested to investigate this matter. 1106 AUTHORIZE LETTER IN OPPOSITION TO SB 382 Supervisor Madigan comtnented~vn the Shasta County resolution objecting to SB 382. He felt the Board should oppose this bill. On motion ofSupervisar Winston, seconded by Supervisor Madigan and unanimously carried, a letter was authorized to be written in opposition to SB 382, as set out by Bob Crisan, Welfare Director. 1107 LETTER AUTHORIZED IN OPPOSITION TO BINDING ARBITBATION., Binding arbitration for safety employees discussed. It was felt that the Board should voice objections to the legislation regarding this matter as it hinders negotiations. Page 234. He Cold them that the request had been turned down. This County is not going to purchase the Berry Creek Ranch.
