Iedge of Allegiance to the Flag of the United States of America Invocation by Supervisor Moseley 866 PPROVAL OF MINUTES There was a motion by Supervisor Moseley, seconded by Supervisor olan, the minutes of May 27, 1980 be approved as mailed. Dan Blackstock, county counsel, stated he was requesting a mod- fication of minute order 80-855 whereby the Board requested the Clerk`of he Board to republish the drainage plans. There was an allegation made uring the hearings that the published notice was inadequate. He has eviewed and looked-into the matter and felt it was one of the best ublications they have ever had. In addition to the description there as a plat map. It was published on April 22, 1980 which was more than imely. To attempt to notify each individual property owner in the area ould be quite costly, as the area includes 200 square miles. He felt the ublication was sufficient. There is no legal requirement for it. 867 Supervisor Dolan stated the minutes they just accepted the comments. stated there was a question regarding the environmental impact determination being available at the library. Supervisor Dolan suggested republishing notice indicating the Chico Airport Environ was being used for this ect when they asked for it at the library. Vote on motion: AYES:. MENTAL HEALTH DIRECTOR TO OFFER ADVANCE STEP ERTRA-HELP APPOINTMENTS On motion of Supervisor Dolan, seconded by Supervisor Moseley and arried, the Mental Health Director was authorized to offer advance step xtra-help appointments for the Family Service Association Crisis service taffing as recommended by the Personnel Airector. 868 ~AUTHORI2E PERSONNEL DIRECTOR TO CONTRACT WITH PE RS FOR RETTREMENT CONTRACT On motion of Supervisor Moseley, seconded by Supervisor Dolan and arried, the Personnel Director was authorized to-contract with PERS for a . limited actuarial-study for retirement contract review. not to;exceed•,$1-,000. 869 PPROVE 1980 AFFIRMATIVE ACTION PLAN ANA GOALS On motion of Supervisor Moseley, seconded by Supervisor Dolan and arried, the Affirmative Action Plan and Goals for 1980 were approved. 870 On motion of Supervisor Dolan, seconded by Supervisor Moseley and 'arried, the.purchase of,.; two 1,000 gallon gasoline storage tanks with locking ;ravity flow meters at U.S. For~asge S~~ice Headquarters in Brush Creek at an June 3, 1980 June 3, 1980 80= estimated cost of $800 each was agproved for CETA. b - 871 PPROVE FIRE DEPARTMENT PURCHASE OF DICTAPHONE/TRANSCRIBER On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, the Fire Department purchase 'of a Lanier dictaphone/transcriber machine at a cost of approximately $200 with funding coming from within. the fixed asset budget was authorized. 872 APPROVE BAR-O-BOYS RANCH ANll. Approved Fouts Springs Boys Camp contract with Solano County to cover placement of juvenile court wards as necessary at a cost of $940 per month; and the Chairman authorized to sign. , 873 AUTHORIZE COMMUNITY ACTION AGENCY TO PURCHASE TYPEWRITER FOR USE IN SENIOR NUTRITION PROJECT On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, Community Action Agency purchase-of; an IBM typewriter at a cost of $915.84 for use in the Senior Nutrition Project was approved. 874 APPROVE SENIOR NUTRITION PROGRAM CONTRACT AMENDMENT On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, Senior Nutrition Program contract amendment with the California Department of Aging separating total budget into three components to include: congregate nutrition service, $210,853; home delivered nutrition services, $110,592; and U. S. Department of Agriculture funds, $55,OS5 with total amount of $37&,500 with grant period January 1 through December 31, 1980 was approved and the Chairman authorized to sign. 875 APPROVE TREASURER-TAX COLLECTOR ITEMS On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, the following Treasurer-Tax Collector items were approved: 1. Denied request for penalty relief - Ignacio Diaz, AP 012-11-1- 005-0. 2. Denied request for penalty relief - Veronica J. Foster, AP 72-11-1-019-0. 3. Denied request for penalty relief -Fred Hudson, AP 72-11-1-019.-0. 4. .Denied request for penalty relief - Wesley L. McManus, AP 031- .. 22-5-013-0. 5. Approved request for penalty relief - Joanne Van Nuys, AP 04&- 15-2-001-0, 876 APPROVE PUBLIC WORKS ITEMS On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, the following Public Works items were approved: 1. Approved contract change order, Lincoln Boulevard, Project No. 18491-78-1 for an increasing amount of $39,277.56 which provides for removal of extensive areas of unsuitable material with funding available in the current budgeted amount for the project; and the Chairman authorized to sign. 2. Accepted the work of Robinson Construction Company, Inc. for Lincoln Boulevard, Project No,;~84~1-78-1; authorized the Chairman to sign notice of completion; and directed the Clerk to file said notice of completion with the Recorder. Grady in the amount of $5,400 which was required as a condition of filing a parcel map for AP 40-15-20, property located on the east side of Lott Road, 2,750 feet north of Durham-Oroville Highway, east of Durham. CONTINUED FOR ONE WEEK - PUBLIC WORKS TO REPORT BACK ON DRAINAGE DEPOSIT REFUNDS Clay Castleberry, public works director, requested that the Board continue to next week the three drainage deposit refunds which were listed on todays agenda for Tom Moore, Susan Attinger and David Williams. Mr. Castleberry will make a report to the Board. Clay Castleberry, public works director, stated he -had been trying to amend the contract for subsidized taxis effective July 1, 1980 increasing the price of tickets. The price increase reflects requirement of state law which set minimum farebox or local support. Chairman Lemke stated Mr. Andy Mitchell in 1977 had paid a drain- age fee and requested a refund from the Board but had received no correspondence regarding the matter. It is an area within the Town of Paradise. He would like this taken care of before July 1. Clay `:Castleberry, public works director, stated he would lock into the matter and report back to the Board next week. There were more deposit fees paid in the Chico area; almost none in Oroville; and some in Earadise. SUPERVISOR WHEELER PRESENT AT THIS TIME 880 WAIVE FIRST READING OF ORDINANCE AMENDING CHAPTERS 19, 23B AND 31 OF BUTTE COUNTY CODE RELATIVE TO SEWAGE DISPOSAL, WATER WELLS AND GARBAGE AND REFUSE Chairman Lemke questioned.if thAprdinance would include the amendments Lynn Vanhart, environmental health director, had requested. Dan Blackstock, county counsel, stated they set all fees by resolution. To keep in mind Proposition 4 where they cannot charge too much. If it is done by resolution it can be changed. On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the first reading of an ordinance amending Chapters 19, 23B and 31 of the Butte County Code relative to sewage disposal, water wells and garbage and refuse collection was waived. 881 APPROVE AMENDMENT N0. 7 TO WATER CONTRACT WITH STATE OF CALIFORNIA On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, Amendment No. 7 to the water contract with the State of California was approved and the Chairman authorized to sign. 882 SET PUBLIC HEARING DATE - REPORT FROM COUNTY COUNSEL ON TIMELY APPEAL Dan Blackstock, county counsel, stated the letter from Mr. Topping and Foothill Farmers and Residents Association appealing the environmental impact report on Oakvale Terrace Subdivison was timely and to set a public hearing. The public hearing was.Set•for June 24, 1980 at 10:45 a.m. 883 REPORT FROM COUNSEL TO THE BOARD REGARDING OLSON VS. CORY Dan Blackstock, county counsel, stated he had submitted a report to the Board on a proposed agreement. Mr. Blackstock set out the background Page 453. June 3, 1980 80- 3'. 884 885 886 887 888 ______--=====June 321_980______________ _____ on the case of Olson vs. Cory. It was noted the Governor has requested a rehearing on the matter. There are differences in the step ranges of superior court judges and municipal court judges. Chairman Lemke stated they would wait to see the decision of the Superior Court. WAIVE FIRST READING OF ORDINANCE REGARDING SAILER POSITIONS Clif Mickelson, administrative officer, stated it would be necessary to extend $10,000 from the revenue sharing unallocated funds for the people they are putting on immediately to the Sheriff's budget. The money is needed for salaries and uniforms. Chairman Lemke noted the five that were added is one per shift and to cover when individuals are sick or on vacation. He has asked the Sheriff to come to the Board on June 17, 1980 in the afternoon to give the figures to the Board. On motion of Supervisor Moseley, seconded by Supervisor Wheeler and carried, the first reading of a salary ordinance.amer~dment creating five additional jailer positions to provide immediate upgrading of jail security was waived; and $10,000 be transferred from revenue sharing "~ ..,- unallocated funds to the Sheriff's budget to cover salaries and uniforms was approved. APPOINTMENT TO OROVILLE MOSQUTTO ABATEMENT DISTRICT On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, :the appointment of Frank Walburn-to the:Oroville`Mosquito Abatement District to replace Barbara Shaffer with the term to expire on December 31, 1981 was approved. APPOINTMENT TO EMERGENCY MEDICAL SERVICES COMMITTEE - EMERGENCY ROOM PHYSICIAN On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the appointment of Dr. Scott Kastner to the Emergency Medical Services Committee - emergency room physician to replace Dr. Bob Roberts was approved. APPOINTMENT TO AREA II DEVELOPMENTAL DISABILITIES PLANNING BOARD On motion of Supervisor Dolan, seconded by Supervisor Moseley and carried, the appointment of Lou Cleary to the Area II Developmental Disabilities Board to replace Judy Wagoner with the term to expire on December 31, 1980 was approved. CONTINUED TO JUNE 10, 1980 FINAL DECISION ON DEGREENTNG THE COMMUNITY ACTION AGEfICY Reconsideration of a request by the Community Action Agency Board to "degreen" the Community Action Agency was held at this time. Supervisor Wheeler presented a petition from Chico Head Start parents with thirteen signatures and had the clerk read it into the minutes. Chairman Lemke presented five identical letters from Oroville Head Start parettts in favor of "degreening". The Chairman read the letters into the record. The clerk had :an, additional letter from Fran Fletcher a parent of Oroville Head Start ...and a letter from City of Chico. Jim Johansen, auditor, was present at the request of Supervisor Wheeler to discuss the impact upon his office on whether to continue or withdraw. His office spends 30 to 407 accounting time and clerk time on Page 454. June 3, 1980 80- 889 June 3, 1980 _ _ _ community Action Agency business. He could cut down on his extra help as hey;8re on a fiscal year, When Community Action Agency had a large turn wer of staff there were problems with inconsistency. Since the present staff. has been handling matters there has been less difficulty. They would Lose the fiscal control of the program should it be "degreened". Supervisor Moseley stated she had received numerous calls from her constituents against the "degreening". Jim McNaughton, executive director of Community Action Agency, stated the Board had received a letter from Jackie xIulhol.land addressing the fiscal concerns. In applying for the grant they had requested a computer which would help with the program. He felt it was a one time cost. Mr. McNaughton stated he had not had difficulty with the Board. They have re- organized twice now. The first time was staff and second time he delegated more control to the department heads. Now the executive director does not have total control. He felt they had a governing Board to oversee them which would be. more effective than the previous board. They emphasize working with local government. In JackieT~Iulholland's letter she stated the quarterly reports could be forwarded to the Board of ,Supervisors. Chairman Lemke was concerned about them shirking their duties. No matter who is on the CAA board they are not responsible to an electorates. The matter is to be held over for one week for a vote and to give time for Supervisor Wheeler to discuss the matter further with Mr. McNaughton. RECESS: 9:57 a-m. R. Cookson abandonment of public utilities easement and recreational easement, Paradise Pines, Unit 8, Lot 32 and William Mathews abandonment of public utilities easement and recreational easement, Paradise Pines, Unit $, Lot 47 were held as advertised. Bettye Blair, planning director, stated both applications were in order. Ms. Blair had talked with Hal McDonald of Public Works and he will be coming forward with all of the abandonments at one time. This is a citizens advisory role. The El Medio area was notified, They held a meeting at the Wyandotte School in May. The comments made at that time will be reviewed. It is important to know the county needs in this area far the next three years. Bettye Blair, planning director, set out the background on the extension. They have used 120 days and this is-the first request for an extension. The Planning Commission recommends the extension. TOWNE APPEAL OF ADVISORY AGENCY'S MITIGATION MEASURE RELATING TO THE INSTALLATION OF A CROSSING SIGNAL AT ENTLER AVENUE AND THE SACRAMENTO NORTHERN' RAILROAD TRACKS FOR SOUTHGATE ACRES SUBDIVISION UNIT N0. 2, AP 40-04-36-AND 38, 20 LOTS, SOUTH SIDE OF ENTLER AVENUE, EAST OF MIDWAY, DURHAM AREA The public hearing on Malcolm D. Jayred and William S. Towne appeal of Advisory Agency's mitigation measure relating to the installation o£ a crossing signal at Enlter Avenue and the Sacramento Northern Railroad tracks fox Southgate Acres Subdivision Unit No. 2, AY 40-04-36 and 38, 20 lots, south side of Entler Avenue, east of Midway, Durham area was held as advertised. Clay Castleberry, public works director, set out the background on the appeal and location. He stated the frequency of trains is not great, however, PUC recommends crossing protection on the railroad crossing. The requirement would cost $50,000 for gates. Earl Nelson, environmental review director, stated his memo to the Board covered what their position was in regarding to the required mit- igation measure in Unit No. 1. It is a policy question on the off-site improvements. Mr. Castleberry stated the project had been previously approved, this is a related improvement. Hearing open to the public. Appearing: 1. Mr. Rallis Lewis, Nimshew Stage, Chico. Mr. Lewis stated he was appearing on behalf of the applicants. They are appealing the installation of the railroad signals. They feel it is not justified at this time. There are only two trains passing per day. He had hoped that Sacramento Northern would go on a 50/50 basis. Unit No. 2 consists of 40 one acre lots. There are twenty other people on Entler Avenue-that are one acre.: or larger. They object to paying the full $50,000. Hearing closed to the public and confined to the Board. There was a motion by Supervisor Moseley, seconded by Supervisor Wheeler, the appeal on Jayred and Towne be upheld relating to crossing signal and stipulate somewhere down the line that they be required to pay part of the expense be approved. June 3, 1980 i 80- 3 .__--___---___Ju_ne-3, 198_0- _____--__-~--_____- - Dan Blackstock, county counsel, stated if Supervisor Moseley was indicating a deposit, there is-no way effective the county two or three years down the line could requixe this once the subdivision is approved. Mr. Castleberry stated he felt possibly in two years they would need the signals but not lights and gates. He felt possibly a left hand turn pocket on the Midway would be more efficient and more critical than the lights and gates. He could address the traffic concern at the intersection. Supervisor.Wheeler stated at the crossing site it is very short. She was concerned about traffic backing up onto the Midway. She ~fe1:t it would be a better investment to require the left turn pocket. Supervisor Dolan stated the residents in the area were not in favor of paying for expenses to further develope the area. She felt the signals and crossing guard would be necessary once there are 40 homes there. Mr. Castleberry noted it is a spur line to Durham not a main line. Motion amended: The appeal of Jayred and Towne mitigation measure relating to installation of crossing signal at Enlter Avenue and Sacramento Northern Railroad tracks for Southgate Acres Subdivision Unit No. 2 be upheld; and Jayred and Towne stipulate that they make a left hand turn pocket on the Midway be approved. Mr. Brown stated in the past he and Mr. Blackstock had not always agreed. Recently Mr. Blackstock made a presentation to the,State Board of Equalization in regards to the Timber Preserve land. He wanted the Board of Supervisors to know what a good job Mr. Blackstock had done and he was pleased with the presentation. APPEARANCE: ED BROWN-,.ASSESSOR ENDORSED THE CHICO FIRST CAMPAIGN TO CONSERVE AFTERNOON ELECTRICITY Mr. John N. Sutthoff, Chico, spoke to the Board regarding his letter under communications dealing with a community campaign to conserve afternoon electricity. He was here to ask the Board and residents of Butte County to help conserve afternoon electricity. He presented the Board with several pamphlets. In the Chico area they hope to conserve 10% and be elgible for an allocation of $100,000 for a specific community project. The period to .conserve is from noon to 6:00 p.m. Dave Davis is a program director and will help the county conserve energy. On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, endorsement bf Chico First program and educating the county in-the program and in conserving energy to 10%; if they could conserve 20% we would not depend on foreign oil was approved. Dan Blackstock, county counsel, stated he had meet.: with OWID and TID. They have a different approach to the subject. They will be reviewing the agreement shortly where they will be transferring the fire hydrants. There was concern about modifying the Boards policy. It was felt a Iot of it would be using common sense as to the placement of fire hydrants. The locations could effect fire insurance. Mr. Blackstock stated regarding the Stringer appeal the con-. dition.. would cost X2,187. He felt that to require one fire hydrant would be quite adequate far three lots. Chairman Lemke stated a contribution could be a reasonable solution and the contribution would set until they get the water. Clay Castleberry, public works director, stated if the Soard upheld the appeal on the condition the applicants could put what ever pay necessary with the irrigation district and whenever it was appropriate it could be connected with OWID, then they have met their commitment;. On motion of Supervisor Moseley, seconded by Supervisor Wheelex and carried, the appeal of Annette Stringer of the Advisoxy Agency's condition on fire requirements wasupheld; applicant to stipulate they will go ahead and pay OWID for installation of one fire hydrant with OWID discretion. RESCIND PUBLIC HEARING DATE ON PARR/TERRILL APPEAL ON GENERAL PLAN CHANGE Dan Blackstock, county counsel, stated on May 27, 1980 the Soard set a public hearing date of June 17, 1980 at 10:45 a.m. to consider the appeal of James E. Parr and Robert Terrill of a denied General Plan change. Mr. Blackstock stated there is no appeal process for a denied General Plan change. They could consider a General Plan amendment. On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, the public hearing date for James E. Parr and Robert Texxill appeal of denied General Plan change was rescinded. No announcement at this time. APPEARANCE: HARVEY WEIDMAN Mr. Harvey Weidman, Cohasset Stage, Chico. Mr. Weidman was before the Board requesting 'their help on a decision of the Planning Department regarding 240 acre parcel in Feather Falls area. When they purchased the property it was in an "A-2" zone. Four families purchased the property after confirming the project with Planning. After escrow was closed and they were ready to proceed they were informed it had been rezoned and they could no longer divide it. It would be a hardship to meet the present guide- lines.
