76-874 COMMUNICATIONS
Mars ,Washington $ Marsh, attorneys at law. The Attorneys, representing Milan Vein,

Palermo Community Center Advisory Committee. The Committee forwards suggested

Committee. Supervisor Ladd said he had no objections to the suggested names
for appointment. Appointments put over one week.
NORCOA-Superior Health Systems Agency. The Board of Directors submits nominees
3 g O ' 0 O for Phase II appointments to the HSA Board. Names submitted are Dennis Hefner,
representing Allied Health Professions, and Betty Wright and Doris Goodson,
at-large consumers. Supervisor Richter felt there should be at feast two names

Northern California Emergency Medical Core Council. The Council requests the Board
a.0 a to selects its member and alternate member to the Board of Directors of the

selected as member, with Chairman Cameron to serve as alternate.

unanimously carried, the claim of Kathleen Savage, Paradise, in the amount of

rejected and referred to County's insurance carrier.

On motion o Supervisor Ladd, seconded y Supervisor Madigan and
unanimously carried, the claim of Robert Paul Kinney and Linda Ellisy.in the
amount of $210,000.00 for personal injuries sustained in the vicinity of where the
Midway crosses Southern Pacific Railroad, was rejected and referred to County
insurance carrier and to County Counsel.

unanimously carried, the resignation of Charles W. Hancock as Judge of the Biggs
Judicial District was accepted, effective July I, (976, with the request that a
letter of appreciation, be sent to Judge Hancock for his services to the County.

unanimously carried, the resignation of Eugene F. Sylva, Jr., Oroville as a member
of the Butte County Planning Commission was accepted, effective June 30, (976,
with the request that a letter of appreciation be sent to Mr. Sylva for his services

76-885 DISCUSSION: COMPLAINT CONCERNING DOG ON LAS PLUMAS WAY
Supervisor Ladd stated a ad received comp aims concerning a og
out on Las Plumes Way. This is a big Shepard dog that attacks people. It is
felt that something should be done about this dog, At (east one person has been
bitten by the dog. Supervisor Ladd asked Undersheriff Stenberg if there was
something that could be done.
Undersheriff Stenberg stated that the dog could be quarantined if he
h~mat;lfi3~tetn anyone, tie felt that along-hard look should be given to these problems.
Similar complaints have been received in other areas of the County. The County
needs a better dog confrol program.
Time spent discussing ways the problem could be handled. It was suggested
that this item be placed on a futun: Board agenda for complete discussion of the
problem and ways that it could be handled. Glenn County Dog Control Ordinance
discussed.
No action taken at this time; to be placed on Future Board agenda
for discussion.
76-886 MATTERS PRESENTED FOR BOARD CONSIDERATION

AB 2~6. This bill would impose $87,000,000 on tax payers. It was stated that
when this goes ro the Senate Education Committee, it was indicated that the bill
would not be well received. Discussion to be placed on next week's agenda.

76-887 SERVICE ON S. D. EVANS, SR. 8 OTHER PARCELS IN RE LASSEN AVENUE
ASSESSMENT DISTRICT
Dan Blackstock, CountyCounsel, stated that the County has been served
in the matter of S. D. Evans, 15r, and other property owners relating to the
Lassen Avenue Assessment District. He would like this on the agenda for next week's
Board meeting in order that Bond Council could be present to discuss the matter.
Thera are a number of possibilities For solving the problem. Possible solutions
set out by Mr. Blackstock.
Discussion of this matter placed on the agenda for Tuesday, June I5,
1976 at f0:00 a.m.
Mr. Blackstock reported that the County had also been served in the
matter of McAmis vs County of Butte, also relating to the LOSS~R Avenue
Assessment District. •
76-888 APPROVE GRANT: HEAD START INCREASE
A grant request as en prepared tot Department of Health, Education
and Welfare. This grant submission covers a I°!o cost-of-I iving supplement of
$1,906 and, if approved, would become a permanent increase in the annual Head
Start base grant. In the 1476 program year the additional funds r~wuld be expended
on consumable supplies,
On motion of Supervisor McKillop, seconded by Supervisor Richter and
unanimously carried, grant request opproved and the Chairmen was authorized to
sign.
76-889 APPROVE APPOINTMENT OF DR, HEfNDL AS INTERIM HEALTH AGENCY DIRECTOR
On motion o Supervisor MoKi op, secon ed y Supervisor La an
unanimously carried, Dr. Irene Heindl was•appointed as Interim Health Agency Director,
County Drug Abuse Coordinator, and Chairman of County Emergency Medical Services
Committee to become effective June 12, 1976; and as County Health Officer to
become effective June 21, 1976. Dr. Heindl was given the Board's personal thanks
for acceptance of this interim appointment.
76-890 DISCUSSION: EMERGENCY MEDICAL/RESCUE SERVICE: DESIGNATE COUNTY
FIRE DEPARTMENT AS AGENCY TO PROVIDE THESE SERVICES & AUTHORIZE
PURCHASE OF EQUIPMENT FOR EXISTING FIRE ENGINE(S)
T e Emergency ice Services Committee recommends the following actions
relative to the provision of medical aid and rescue service in southern Butte Coun#y:
(I) designate County Fire Department as agency to provide these services; (2) authorize
purchase of equipment for existing fire engine(s) in order to provide interim service
(cost breakdown presented to Board); and (3) implement the full EMS recommendation
proposed in the FY 1976-77 budget.
Bob Paulus, Fire Marshal, explained the recommendations. He stated that
in relation to reca~mendation No. 1, the Board sometime ago, by resolution, authorized
the County F.i're Department to provide the emergency medical •services. On Condition
No. 2, his department had planned to hold off on this until budget time.
Bill Sanders, Area Commander of the Highway Patrol, spoke in support
of this request for equipment. A prepared sta#ement was read by Mr, Sanders,
in which he strongly urged the Board to purchase the extraeation equipment, a

list of which was presented to the Board members. He offered to help the Board , r,J~
all he could in advise them on the purchase of the equipment. '
Rescue Kits (jaws-of-life) discussed. Other necessary emergency., ,
equipment set out.
Chairman Cameron said that while the County was authorizing the
purchase of this equipment, consideration should be given for purchase of a
ports-power unit For the DeSabla area.
On motion of Supervisor Richter, seconded by Supervisor McKillop and
unanimously carried, the following action was taken:
I. Designated the County Fire Department as agency to provide
these emergency medical/rescue services
2. authortzed the purchase of equipment for existing fire engine(s) in
order to provide interim service, in the total amount of $6540 as listed by Rpbert
Paulus on the memo to the Board, with the additional expense to include the
extrication equipment (ports-power unit) for the Upper Ridge Fire Department,
as requested by Chairman Cameron'.
76-891 ADOPT RESOLUTiO N 7b-99 OF INTENT TO CONTRACT WITH DEPARTMENT OF
CONSERVATION FOR FIRE PROTECTION SERVICES

for fire protection has been prepared in draft form. The contract total under
Schedule "A" is proposed at $998,210.
On motion of Supervisor McKillop, seconded by Supervisor Madigan and
unanimously carried, Resolution 76-99 of intent to wntract with Department of
Conservation for fire protection services in the amount of $998,210 was adopted
and the Chairman authortzed to sign.
76-892 HEARING: HOUSING AND COdr~ilt~lEJNETY DEVELOPMENT: APPROVE
APPLICATION FOR GRANT
e pu is eartng for the Housing and Community Development far activities
to be considered for south Oroville in the final application for HCD block grant
funds held at this time. Funds to be considered are: (I) residential rehabilitation,
$175,000; (2) public works, $200,000; and (3) demolition, clearance and relocation,
$b0,000. Scot Tandy presented this matter for discussion and explained the
application for the grant, He stated that the figures are correct.

76-893 APPROVE FEDERAL WORK STUDY: CONTRACT WITH MC GEORGE SCHOOL OF LAW

student for the months of ,tune, ,July and August through the.Federal Work Study Program.
One contract covers the period June 7 through June 30, 197b with McGeorge paying
$0 per cent of the cost and the County, 20 per cent. The second contract covers the
period July i through August 27, 1976 with a 60 per cent to 40 per cent cost sharing
ratio.
On motion of Supervisor McKillop, seconded by Supervisor Richter and
unanimously carried, the two contracts with McGeorge Law School were approved
and the District Attorney was authorize d to sign on behalf of the County.
76-894 APPROVE SCHEMATIC DRAWINGS FOR NEW ADMINISTRATION BUILDING

plans on June ,~. The site is across from the Superior Court Building, Plans
discussed. Tom Tarmin stated that they are going to make the building comply
with the new energy conservation law.
On motion of Supervisor Richter, seconded by Supervisor Madigan and
unanimously carried, the schematic design phase for the new Administration Building
was approved and the architects were authorized to begin preliminary design phase.

76-896 APPROVE SU65TANCE ABUSE CONTRACT
A program has en deve aped wit the State Office of Narcotics and
Drug Abuse to provide a counselor position in DC RC to handle the influx of
heavy addition problems to study the problems in Butte County far determining
future action, provide training to DCRC and other local professionals iri the area
of heavy oddition, and to purchase portable dictation equipment. Contract has been
prepared in the amount of $15,735 which the State will pay 100% of the cost of the
above program fnr the period June 30, 1976 through Juna 29, 1977. Contract has
been approved by the Auditor.
• Dr. Enloe explained the contract. Supervisor Richter asked if the
program was necessary; Dr. Enloe felt that it was.
On motion of Supervisor Madigan, seconded by Supervisor McKitlop and
unanimously carcied, the substance abuse contract program was approved, the Chairman
authorized to sign the wntract, subject to approval by Counsel and the Personnel
Direc,~or was directed to prepare .salary ordinance amendment adding a counselor.
76-897 APPROVE PURCHASE OF NEW EQUIPMENT l=OR 24-HCtUR ACUTE CARE UNIT '
An inspection of t e 24-hour Acute Care Unit operated y the Mento
Health Division by the licensing bureau, cited the poor corid'+fion of a refrigerator
. and visafa in the office. The equipment is not part of'the rental agreement with ~
Kenmar: The inspector demanded immediate replacement of these two items. Cost
to replace the refrigerator is estimated at $210 and to purchase twn side chairs to replace th
sofa is estimated at $250, Supervisor Ladd questioned Dr. Enloe about the purchase
-'" of the refrigerator. Mr. Mickelson stated that the refrigerator has had to be
repaired several times and it is unreliable. Purchase of equi nt discussed.

76-898 APPROVE FAMILY PLANNING AGREEMENT'
A contract wit t State Department o Health has been prepared to
provide family planning services for the period of time from July !, 1976 through
June 30, 1977. Contract covers the payment to the County of Butte for services
provided to eligible :recipients by the Butte County Health Department in their
Family planning program and has a limit of $30,000. Contract has been reviewed
by the Auditor. Contract explained by Dr~Enloe. _ _~~~_,.
On motion of Supervisor Richter, seconded by Supervisor Madigan and
unanimously carried, the Family Plannine Agreement was approved and the
Chairman authorized to sign.

Jan Laug lin appeared to speak on the denial of a use permit €or
a rest home in Paradise. Dan Blackstock, County Counsel, explained the
reason for the denial. An application for a home for the physically handicapped
had been filed by Mr. McLaughlin. Planning Commission felt that the home
did not qualify. The Board of Supervisors denied the appeal because the
applicant had nat been present at their public hearing,
It was suggested that Mr. McLaughlin fife a new application with the
Planning Commission. Procedure to follow set out by Mr. Blackstock.
Mr. McLaughlin stated that the people were handicapped. He said
he would re-apply for the use permit. Planning Com'm~ssion will hold additional
hearings based on new circumstances.

unanimously carried, the Board waived the one-year requirement for the
re-application for a use permit by Mr. McLaughlin.

This parcel map consists of 4 lots, south side of Monte Vista Ave., east of lower
Wyandotte I3d., Oroville. Area and condition of the property set out by
Mr. Colby. He stated that because of a heavy out-cropping of rocks, the Monte Vista
Avenue could not be extended. Background of area set out. The area is zoned
for mobile homes. Mr. Colby requested that the Board approve the map, with the
deletion of Conditions No. 2 through 7, of the recommendations of the Planning
Commission .
Mr. Colby said there could be a traversable gravel road for these people.
The straight extension of Monte Vista Avenue could be a private road at this point.
It was stated that this property could have been a part of the original
subdivision. Mr. Colby said there has been no violation of the subdivision act.
Mr. Blackstock said he did not know the exact situation given to Brian Rix,
deputy County Counsel, when he wry the opinion. He said he would like to
look over the opinion and study the matter. Mr. Colbey said he would like the

CITIZENS SERVICES INC.
C airman Cameron stated that the Superior California Senior Citizens
Inc. had requested the loan of a food mixer (Hospital surplus). If was felt this
would be a good use for this particular item and the Board was agreeable to the loan.
Supervisor McKillop suggested that County Counsel, Dan Blackstock, prepare a simple loan
agreement and the loan be made.
On motion of Supervisor McKillop, seconded by Supervisor Madigan and
unanimously carried, loan of the food mixer to the Superior California Senior Citizens
Services, Inc. was approved and instructed County Counsel to prepare an agreement
for the loan of said food mixer.
76-917 CITY OF CHICO-COUNTY LIBRARY CONSOLIDATION AGREEMENT: PUT OVER
ONE WEEK
City of Chico-County library consolidation agreement discussed.
Mr. Blackstock stated that the Chico City Council had authorized the City Manager
to sign the agreement. Clif Mickelson, Administrative Officer, stated that the Boarct
should investigate the possibilities of stopping this action.
Bob Jones, Manager of BCEA, said he was suppose to have••~_sreet and
confer session with the City Manager, Fred Davis. He felt this action should not
be taken until often the meeting his held. Mr. Jones further stated that the BCEA
would seek an injunction if the agreement is followed through at this time.
Supervisor Ladd said it was his feeling that the county should not have to
take on this employee.
Supervisor McKillop suggested that the matter be put over one week.
On motion of Supervisor Richter, seconded by Supervisor Madigan and
unanimously carried, the City-County I ibrary agreement was put over one week.

On motion o Supervisor Ric ter, seconded y Supervisor McKil lop and
unanimously carried, the fallowing action was taken:
I. Approved filing of notice of completion effective June I, 1976;
2. Approved final cleanup change order including justified time extensions
3. Authori~d final payment minus the standard withholding
4. Approved Cook Associates professional services inspection and administration
contract to completion of the final project bookkeeping and cleanup
5. Authorized payment for services through Moy 31, 1976, over the previous
budge# amount of X3,279.43; and approved payment up to $3,000
additionally to cover administrative costs through the completion of
the Final project accounting completion.

Robert E. Simpson sfiated that there existed a necessity for him to move his
mobile home on his property (AP 36-022-341, located on the •,~ast side of V-C Road,
approximately 650 feet south of V-7 Road, Oroville. He requested thot the Board grant
him an interim zone to take care of the problem while the permanet zoning is being
considered.
On motion of $upervisor Ladd, seconded by Supervisor Richter and
unanimously carried, Ordinance 1723, interim wing AP 36-022-41, east side of
V-C Read, approx. b50 feet south of V-7 Road, Orovil le, Chairman authorized to
sign, and July b, 1976 at 2:00 p.rn. was set as time for public hearing on the

76-935 DISCUSSION: IMPROVEMENTS TO EAST LINDO AND FIFTH AVENUE. CHICO
Clay Castleberf,-Director of Public Works, advised the Board that there
were drainage problems in the East Lindo and Fifth Avenue areas in Chico.
Mr. Castleberry suggested that they be advised that the County will help them to
form an assessment district. Discussed; no attic, taken.

Clif Mickelson, administrative Officer, stated that the County's is
paying more in insurance premiums that they are generating in claims and that the
County is having trouble securing liability insurance on automobiles. Supervisor
Ladd stated that he had received a letter from Jim Farris and that RC RC was working

District Attomey's office. The District Attorney's office feels that the action
should be civil. Supervisor Richter felt that this was a blatant violation of the
zoning laws and that criminal action should be taken.
On motion of Supervisor Madigan, seconded by Supervisor Richter and
unanimously carried, the District Attomey's office was directed tb proceed with action on a
criminal basis, and if he is reluctant to do so, then the District Attorney can proceed
on a civil basis, in the matter of Ely Stern in violation of zoning laws.
