Blacklock, Chief Administrative Officer, as a follow-up to the Board's adoption on May 25, 1993 of rules and procedures concerning conduct of Board of Supervisore meetinqs, explained the procedure for the submission of written materials to the Board relative to items to be considered on the Agenda. The video "Enough is Enough", distributed by the California State Association of Counties and the League of California Cities, which speaks to the pliqht of local government generally was viewed. 93-201 Items removed from the Consent Agenda for Board consideration and action: 1. Tentative Memorandum of Understandinq (MOU) - Butte County and the Butte County Management, Confidential, and Supervisory (MCS) Unit - proposed is a MOU, ratified by the MCS Employees Association, covering the period of October 1, 1992 throuqh September 30, 1994. As part of the agreement, seven positions were agreed upon as to salary and title changes that were left unresolved from the Nash classification study - action requested - RATIFY CONTRACT AND AUTHORIZE THE CHAIR TO SIGN, AND WAIVE READING OF THE SALARY ORDINANCE IMPLEMENTING THESE CHANGES. Assessor - Board authorization is requested for the purchase of a cash reqister in the maximum amount of $500 from existinq fixed asset funds - action requested - APPROVE PURCHASE OF FIXED ASSET ITEM. 11. County Clerk-Recorder - Board authorization is requested for the purchase of Guardian software, installation and user traininq for the Superior Court Case Management computer system in the maximum amount of $1,502 including tax. Budqet transfer B-207 has been prepared for the necessary appropriation - action requested - AUTHORIZE SOLE SOURCE PURCHASE OF GUARDIAN SOFTWARE FROM AUTOMATED GOVERNMENT SYSTEMS. 12. District Attorney - Board authorization is requested to press into service items seized and forfeited (items described on May 5, 1993 memorandum from the District Attorney to the Board of Supervisors) pur suant to California Narcotics Forfeiture Statutes - action requested - ACCEPT ITEMS AND APPROVE PLACEMENT ON THE DISTRICT ATTORNEY'S INVENTORY OF COUNTY PROPERTY. 13. Fish and Game Commission - Board authorization is requested to purchase a dual hull aluminum boat (in lieu of a cartop boat), approximately 4,200 square feet specialized nylon netting (in lieu of a portion of fish purchases), and an electrofisher, generator and peripheral equipment (in lieu of an electrofisher and peripheral equipment oriqinally requested and not available) in the total amount of $4,800 includinq tax and shipping (restricted funds). Fire Department - Board authorization is requested to purchase a refriqerator in the maximum amount of $990 to replace the current 1967 model for Fire Station No. 73 - Biggs. Fire Department - Board authorization is requested to purchase a"Cutters Edge" ventilation saw with accessories ($1,325), 14" Partner K1200 rescue saw ($850) and accessory kit ($295), and a Ferno Model 71 basket stretcher ($350) for truck no. 74. Budget transfer B-204 has been prepared for the necessary appropriation - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. 16. Fire Department - Board authorization is requested to purchase a Stokes Type Litter Basket for use on Rescue 42 (North Chico) in the maximum amount of $558 - action requested - APPROVE PURCHASE OF FIXED ASSET ITEM AND DELETE APPROPRIATION FOR 5" IiOSE BRIDGES WHICH ARE NO LONGER AVAILABLE FROM VENDORS. 17. Fire Department - Board authorization is requested to purchase ten paqers for volunteer fire companies (Butte Meadows, 3; Maqalia, 3; and Butte Creek Canyon, 4) in the maximum amount of $1,600. The need for additional pagers is due to an increase in membership in the companies. Budget transfer B-209 has been prepared for the necessary appropriation - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. 18. Mental Health Department - Board authorization is requested to purchase one serial port card for a 386 ISA computer and two serial port cards for a 386 micro channel computer in lieu of an electric typewriter authorized in the 1992-93 budget - action requested - AUTHORIZE PURCHASE OF FIXED ASSET ITEMS AND DELETE 1992-93 APPROPRIATION FOR THE PURCHASE OF AN ELECTRIC TYPEWRITER. 19. Welfare Department - Board authorization is requested to purchase bi-fold doors in the estimated amount of $1,800 for the orientation room at GAIN in order to create a multiple function room currently limited to a single use. Budget transfer B-203 has been prepared for the necessary appropriation - action requested - APPROVE PURCHASE OF FIXED ASSET ITEM. Paqe 204 June 8, 1993 93-202 20. Proposition 4 Appropriations Limit Calculations for the County of Butte and for special districts under the control of the Board for fiscal year 1993-94 - action requested - ADOPT RESOLUTIONS 93-76 AND 93- 77 AND AUTHORIZE THE CHAIR TO SIGN. 21. Adoption of a salary ordinance amendment creating a three-quarters time (75~) position of Supervisor's Clerical Aide at salary range 39, with no additional annual increase to the total salary and benefits paid on an annualized basis - action requested - ADOPT ORDZNANCE 3072 AND AUTHORIZE THE CHAIR TO SIGN. 22. Adoption of a salary ordinance amendment establishing a new classification of Licensed Vocational Nurse (salary range 148) due to the inability to attract viable Registered Nurses to fill current vacancies at the higher level position of Clinic Nurse (salary range 188). This action does not add any new positions, but flexibly staffs the Licensed Vocational Nurse with the three existinq allocated positions of Clinic Nurse. The Personnel Department has met with the Butte County Employees Association (BCEA) on two separate occasions as per the General Unit Memorandum of Understandinq, Section 4.05, and has reached an impasse - action requested - ADOPT ORDINANCE 3073 AND AUTHORIZE THE CHAIR TO SIGN. 23. Adoption of an ordinance establishinq a speed limit of thirty-five (35 miles) per hour on Foothill Boulevard from Greenbank Avenue to 1,000 feet south of Oroville Bangor Highway (Road No. 25493) - action requested - ADOPT ORDINANCE 3074 AND AUTHORIZE THE CHAIR TO SIGN. 24. Introduction of a salary ordinance amendment establishinq the classification of Manager - Mental Health Community Services at salary range 257 due to the recent decision by the Butte County Office of Education to no longer provide contract services for drug and alcohol education/prevention. The 1992-93 contract was in the amount of $57,313, and the annualized cost of the position is $53,180 from within the department budget - action requested - WAIVE READING OF THE ORDINANCE. Introduction of a salary ordinance amendment allocatinq one additional position of Senior Health Nurse and one additional position of Public Health Nurse in the Public Health Department to provide selected nursing services for the Welfare Department Personal Care Service Proqram for the In-Home Support Service Proqram (IHSS). The Public Health Department will receive 100~ funding reimbursement from the Welfare Department - action requested - WAIVE READING OF THE ORDINANCE. 26. Resolution Recommending, Approving and Supportinq Changes in Pendinq Assembly Bill (AB 2207) Re: Changes in Butte County Municipal Court System - action requested - ADOPT RESOLUTION 93-78 AND AUTHORIZE THE CHAIR TO SIGN. 27. Resolution Against California Local Government 1993 Tax Shift - action requested - ADOPT RESOLUTION 93- 79 AND AUTHORIZE THE CHAIR TO SIGN. 28. 1993-94 State Department of Pesticide Regulation - proposed is a memorandum of understanding for pesticide use reporting by the County's Agricultural Commissioner commencing July 1, 1993 through June 30, 1994 in the maximum amount of $22,900 - action requested - APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE THE AGRICULTURAL COMMISSIONER TO SIGN. 29. 1993-94 State Department of Pesticide Requlation - proposed is contract no. 93-0063 commencing July 1, 1993 through June 30, 1994 which provides funding in the amount of $32,725 for the Agricultural Commissioner to perform enforcement of pesticide permit requlations - action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 30. 1993-94 State Department of Pesticide Regulation - proposed is contract no. 93-0236 which reimburses the County up to $17,000 for the data entry of all production agriculture pesticide use report applications for the period May 1, 1993 through April 30, 1994 - action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. Paqe 206 June 8, 1993 ~ ---~ 93-202 31. 1993-94 Annual Work Plan for Animal Damaqe Control {ADC) - the proposed aqreement with the State Department of Food and Aqriculture, the State Department of Health Services, and the Federal Animal Damage Control program in the amount of $36,270 provides trapper services for depredating wild animals and rabies cantrol, including trapping of skunks. The County share is approximately 59~ of the total cost per staff month. ADC will provide all proqram supervision, administration and equipment - action requested - APPROVE AGREEMENT AND AUTEIORIZE THE AGRICULTURAL COMMISSIONER TO SIGN. 32. 1993-94 Weights and Measures Petroleum agreement - proposed is agreement no. P-569004 to augment, improve and maintain a uniform and viable inspection proqram of establishments sellinq or distributinq petroleum products. The County will be reimbursed $72 per initial inspection conducted not to exceed $7,560 for fiscal year 1993-94 - action requested - APPROVE AGREEMENT AND AUTHORIZE TIiE DIRECTOR OF WEIGHTS AND MEASURES TO SIGN. 33. Michael Clayton & Associates - the consultants entered into a contract with the County on June 28, 1988 to prepare the Energy, Natural Resources and Recreation Element of the County General Plan. An amendment has been prepared to the contract finding that the consultant has fully complied with the intent of the contract and that no other action by the consultant is required - action requested - APPROVE AMENDMENT TO CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 34. Tehama Recovery Center (TRC) - the proposed amendment adds $7,710 (Perinatal Treatment Expansion Project [PTEP] monies) to the contract to serve perinatal clients in need of residential treatment as part of a five county regional Pilot Perinatal Project - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 35. Enloe Hospital contract no. 93-93/28A - the proposed amendment to the contract entered into on July 1, 1992 entitled Perinatal Day Treatment and Case Manaqement increases funding available from $226,387 (Federal) to $319,825 (Federal/PTEP) and expands Perinatal Treatment Expansion Project (PTEP) services to be provided - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. Nancy Agliolo, Toby Hale and Monica Schwartz - proposed are agreements for the provision of physical and occupational therapy services provided to children eliqible for the California Children's Services (CCS) Proqram. The aqreements, commencing June 1, 1993, are in the maximum amount of $20,000 (Agliolo), $28,500 (Hale), and $18,000 (Schwartz) (25~ realignment, 50$ State, $25$ County) - action requested - APPROVE AGREEMENTS AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 37. Delta Dental contract - the contract between the County and Delta Dental expired on October 31, 1992. The parties agreed to extend the contract from November 1, 1992 through October 31, 1993. Under the amendment to the agreement the contract term means the period commencing on the effective date hereof and terminatinq on October 31, 1993, and each yearly period thereafter durinq which this contract remains in effect - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 38. California State Association of Counties (CSAC)- Excess Insurance Authority (EIA) Workers' Compensation Program - a memorandum of understandinq has been prepared which restructures the CSAC-EIA Workers' Compensation Program and saves the County $33,000 in fiscal year 1993-94 - action requested - APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE THE CHAIR TO SIGN PENDING APPROVAL OF COUNTY COUNSEL AND THE AUDITOR- CONTROLLER. 39. Cannabis Eradication Program qrant - the Sheriff- Coroner is preparing an application for a one year grant funded under the Office of Criminal Justice Planninq (OCJP). This grant application is part two of an OCJP qrant process. Part one was approved by the Board on May 25, 1993 (Mari~uana Suppression Proqram qrant) - action requested - ADOPT RESOLUTION 93-80 APPROVING THE APPLICATION WITH NO COUNTY MATCH REQUIRED AND SUBJECT TO ADMINISTRATIVE OFFICE REVIEW AND APPROVAL OF THE PROPOSED ALIACATION OF FUNDS. Page 208 June 8, 1993 r-~ 93-202 40. 1993-94 State Department of Water Resources - proposed is an aqreement (no. 8-59213) for the continued fundinq which allows for reimbursement for boat and vehicular patrol of the Thermalito Afterbay from July 1, 1993 through June 30, 1994 in the maximum amount of $59,300 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 41. Bureau of Land Management (HLM) - proposed is agreement no. B950-A3-0013 for continued funding which allows for reimbursement for deputy sheriff's to patrol and enforce State and local laws on the public lands and roads administered by BLM. The maximum amount reimbursable under this agreement is $12,000 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 42. United States Forest Service - proposed is an agreement for the period beginninq May 1, 1993 and ending September 30, 1993 which allows for reimbursement to the County for deputy patrol wages to patrol the Plumas National Forest (Feather Falls Trailhead, Sly Creek Recreation area) and the Lassen National Forest (Butte Meadows and Cherry Hill campgrounds, West Branch campground trailhead and Soda Sprinqs campqround} - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 43. City of Chico - submits resolution no. 159 92-93 ordering territory desiqnated as West Chico Annexation District No. 1 annexed to the incorporated territory of the City of Chico subject to confirmation of such annexation by the voters within such district, and callinq a special election within the District on November 2, 1993 for the purpose of submitting the question of such annexation to such voters - action requested - CONDUCT THE ELECTION AS REQUESTED. 44. Mitch Delmaqe, Branch Manager, Planning and Assistance Branch, State Integrated Waste Manaqement Board (Board) - forwards a copy of the Model Ordinance relating to areas for collecting and loading recyclable materials in development projects. The California Solid Waste Reuse and Recycling Access Act of 1991 (ACT) requires the Board to develop a model ordinance for adoption by any local aqency relatinq to adequate areas for collecting and loading of recyclable materials in development projects. Any local agency that has not adopted such an ordinance of its own by September 1, 1993 will be qoverned by the Board's Model Ordinance. The District invites the Board into a partnership with OWID to prevent some of our local property tax revenue from being siphoned off to Sacramento. (REFER TO CHIEF ADMINISTRATIVE OFFICER) e. Steven J. Howell, Judge of the South Butte County Municipal Court - submits a rulinq in the case no. SC02614 (Marion Erl~nger v.
