The Board of Supervisors met at 9:00 a.m. pursuant to adjournmento
Present: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke.
Clif Mickelson, administrative officer; Dan Blackstock, county counsel; and
Clark A. Nelson, county clerk, by Cathy Pitts, assistant clerk to the Board.

APPROVAL OF MINUTES
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, the minutes of June 5, 1979 were approved as mailed.
On motion of Supervisor Down, seconded by Supervisor Moseley
and unanimously carried, the minutes of May 29, 1979,taminute order 79-907
subsection 1 was corrected to reflect 0.01 acre instead of 0101 acre.
ADOPT RESOLUTION 79-104 SETTING PUBLIC HEARING DATE FOR FORMATION OP
COUNTY SERVICE AREAS ~~60 THROUGH 66 ~S'fREET ]1,IQHIYS)
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, Resolution 79-104 setting a public hearing date
of July 17, 1979 at 10:00 a.m. for consideration of formation of Country
Service Areas ~~60 through bb (street lights) was adopted and the Chairman
authorized to sign.
ADOPT RESOLUTION 79-105: AML~TIDING RESOLUTION 79-13 INCREASING CASH DTFFERENCE
FUND IN REOORDER'S OFFICE FROM $25 TO $50 AND REIMBURSING THE FUND IN THE
AMOUNT OF $30.98
On motion of Supervisor Moseley, seconded by Supervisor Dolan
and unanimously carried, Resolution 79-105 amending. Resolution 79-13
increasing the cash dif€erence fund in the Recorder's Office from $25
to $50 and reimbursing the fund in the amount of $30,98 was adopted and
the Chairman authorized to sign.
APPROVE BUDGET TRANSFERS
On motion of Supervisor Wheeler, seconded by Supervisor Dolan
and unanimously carried, the following budget transfers were approved:
B-165 - Federal Revenue Sharinr~. Transfers $3,500 from fixed
assets - structures to maintenance of structures in order to progerly
account for maintenance work performed on the Sheriff's Chico
substation. Also transfers $4,100 from the Chico pgund expansion
project to maintenance of structures in order to cover an existing
deficiency in the maintenance account for the Sheriff's Chico substation.
B-166 - Environmental Review. Transfers $800 from extra help,
$372.74 from overtime, $650 from publications and legal notices, and
$250 from transportation and travel; with $47.74 going towards maintenance
of equipment, $1,525 to office expense, and $500 to professional and
specialized services. The purpose of this transfer4 is to cover actual
and anticipated operating expenses through the end of the current fiscal
year so that project processing can continue without avoidable delays.
B-168 - Probation. Establishes an appropriation of $25,500 in
contributions to other agencies in order to acknowledge receipt of additional
AB 90 funds from the state for the purpose of funding .the Female Abuse
Officer program through the City of Chico.

8-169 - Buildinc and Subdivision Inspection - Administration.
Establishes an additional appropriation of $1,500 in office expense in
order to cover additional costs due to an increased workload with
unanticipated revenue coming from construction permits.
B-170 - Public Works. Within engineering and administration
transfers $12,00 from professional and specialized services to transportation
and travel in order to cover unanticipated increase in equipment rates.
Within transportation systems transfers $65 from special department
expense to publications and legal notices in order to cover the cost of
legal notices for transportation needs hearings.
B-171 - General Insurance C_learin~. Transfers $350 from self
insurance to professional and specialized services in order to cover the
payment to the County Supervisors Assocfiation of California for Excess
Workers Compensation Program Development cost. This payment was authorized
by the Board of Supervisors on May 22, 1979; minute order 79-854.

CHIP (HCD) '
On motion of Supervisor Wheeler, seconded by Supervisor Dolan
nd unanimously carried, option agreements for seven parcels of property
between the county and the Chico Housing Improvement Program (CHIP) to be
developed. with Farmers Home Administration sponsored self-help housing in
the E1 Medio area were approved and the Chairman authorized to sign.
981 (APPROVE WEATHERTZATION PROJECT GRANT PROPOSAL SUBMISSION TO DEPARTMENT OF

On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the supplemental weatherization project proposal
grant in the amount of $46,149 federal funds to weatherize 120 low-income
occupied homes submission to the Aepartment o£ Energy was approved.
APPROVE BUDGET MODIFICATION AND AUTHORIZED EOC TO PURSUE WORK-STUDY CONTRACT
WITH CSUC - RURAL SENIOR SERVICE PROJECT
On motion of Supervisor Moseley, seconded by Supervisor Dolan
and unanimously carried, budget modification for the Rural Senior Service
project to be submitted to the Califo rnia Department of Aging modifying
variouslline items in the existing grant and reprogramming $9,312 project
income and $1,800 in-kind match with the total budget of $125,191 {grant,
$86,909; in-kind match, $28,970; and project income, $9,312) was approved
and EOC was authorized to pursue a work-study contract with California
State University - Chico (CSUC).
MOTION-FAILS: RE: AUTHORIZATION FOR PUBLIC HEALTH DIRECT TO SUBMIT GRANT
It~was moved by Supervisor D:31aii,~seconded by Supervisor Moseley
that the Director of Public Health be authorized to submit grant application
in the amount of $28,717 federal funds to the Department of Health Education
aid Welfare - U.S. Public Health Services for the purpose of conducting a
health education wellness project which will provide 60% of a health
education assistant, employee benefits, extra help and other expenses.
Clif Mickelson, administrative officer, stated that in order
to fund the remaining portion of the position (40%) there will have to
be a CETA position transitioned.
Supervisor Winston submitted that the county could not afford
to fund 40% of any position at this time.

Chairman Lemke stated that the problem arises in the additional
407 for a staff person that at this point in time, he did not see how the
Board could make the decision on that request prior to budget hearings
and knowing where the county stands with the CETA programs. There are
positions that will have to be transitioned.
Mr. Nickelson stated that the county is looking at $b00,000
to $700,000 for CETA transitions in this budget. The Board is going
to have to take a hard look at every one of the operations. He recommended
that the Board hold off until later in the year to consider this grant.
He was concerned with 1980-81 fiscal year.
Chairman Lemke stated that the request was for a grant application
azd it does not require a ceominitment for funds at this time.
Jim Rackerby, personnel director, set out what will have to
be done as £ar as transitioning of CETA personnel at this time.
There are close to 60 positions on board doing regular county jobs.
The funding will end as of the end of 1979. He did not know of anything
from the Department of Labor that would permit the county to continue
those positions under CETA, His office will have to issue termination
notices in the middle of September unless the Board feels the work is
critical and has to be continued with county funds. There is almost
one-half of the jail and some patrol officers on the CETA program.
Nino Calarco, Health Department, stated that they have one
full time regular position, one CETA position and a one-half time
pasition_at the present time. They had hoped to add the other one-half
portion of the grant that the one-half time position. It would be the
same number of employees. This is a request for a grant. He did not
know if the giant would be approved.
Supervisor Dolan felt that it makes sense to file the application
now and if the Board wants to fund the program they can do so later.
She did not feel that health education and wellness are a luxury.

APPROVE 1978-79 FAMILX PLANNING CONTRACT AMENDMENT
On motion of Supervisor Wheeler, seconded by Supervisor Dolan
and unanimously carried, the 1978-79 Family Planning contract amendment
reducing the maximum amount from $56,800 to $45,000 was approved and the
Chairman authorized to sign.
APPROVE 1979-80 FAMILY PLANNING CONTRACT-AND ACCEPT REVENUE
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
a nd unanimously carried, the 1979-80 Family Planning renewal contract with
the State Department o£ Health in the amount of $50,000 to provide for
family planning services to low-income individuals next fiscal year was
approved and the Chairman authorized to sign; and revenue was accepted.
RESCIND ACTION RE: MENTAL HEALTH RESIDENTIAL TREATMENT PROPOSALS AND DIRECT
LETTER BE WRITTEN TO STATE ADVISING THAT APPLICATION HAS BEEN WITHDRAWN
Dan Blackstock, county counsel, stated that he was concerned
about the possible litigation if the Board did not rescind their action
relative to the residential treatment application. He recommended

that a letter be written to the state and having the application withdrawn.
He recommended that Mental Health work with the local people in July,
August or September on a new program to be submitted for new funding.
He did not feel that if the application is withdrawn and later sufi~mitted
the Community L`ivrng Center could come back and collect damages.
There is no written contact at this time with Community Living Center.
It is an implied situation.

Dr. Maguire, mental health director, accepted Counsel's
recommendations. There have been a lot of changes in the last month
or so at the state level. This would be a delay of a few months.
His office could notify everyone of the intent.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the Board rescinded their previous actions
relative to Mental Health residential treatment proposals and a letter
is to be written to the state advising them that the application has
been withdrawn.
APPROVE PENALTY RELIEF REOUEST - RY RANCH '
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the request for penalty relief for Ry Ranch,
AP 47-18-29 was approved.
DENY PENALTY RELIEF REQUEST - DONNA NELSON
On motion of Supervisor Wheeler, seconded by Supervisor Moseley
and unanimously carried, the request for penalty relief for Donna Nelson,
AP 26-23-37 was denied.

Discussion of the request for penalty relief for taxes not paid
in full and a claim for refund for taxes paid by Mason-~McDuffie Company
for numerous parcels in the California Park area of Chico held at this
time.
Chairman Lemke stated that the company is paying full bore
taxes on the property that was assessed as a on-going operation requiring
services from the county and it never went through. They have never
opened. They are still paying taxes on the developed area when it should
have been left as grass land until something happened on the property.
If penalty relief is not forthcoming, he suggested that the project will
be shut down.
The matter was referred to Counsel for a report back to the
Board on June 19, 1979.
APPROVE PUBLIC WORKS ITEMS
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, the following Bublic Works items were approved:
1. Approved revision of cooperative agreement for State
Route 162 (Olive Highway) and Foothill Boulevard traffic signals to include
paragraph covering the maintenance and operation of the traffic signals
was approved and the Chairman authorized to _~n_t-ialri~ha~ehange.
2. Approve contract change order No. 1 for Bull Hi11 Road
Bridge at Butte Creek, FASOS Project No. 007{2) that provides for the
placing of conduits within the bridge for future telephone cables with
all costs to be borne by Pacific Telephone and .the Chairman authorized

On motion of Supervisor Winston, seconded by Supervisor Moseley
and carried, Ordinance 2026 amending Section 20-152 of the Butte County
Code relative to the installation of Street lighting systems was adopted
and the Chairman authorized to sign. Waiving of the second reading was
not done. AYES: Supervisors Moseley, Wheeler, Winston and Chairman
Lemke. NOES: Supervisor Dolan

APPOINTMENT TO THE CITIZENS ADVISORY COMMITTEE ON DRUG ABUSE/ALCOHOL
ADVISORY BOARD
On motion of Supervisor Moseley, seconded by Supervisor Winston
and unanimously carried, Ernest Hohman was appointed to the Citizens
Advisory Committee on Drug Abuse/Alcohol Advisory Board.
DISCUSSION OF LETTER FROM METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNL4
CONCERNING SB 200 (PERIPHERAL CANAL)
Discussion of the letter from Metropolitan Water District of
Southern California concerning SB 200 (Peripheral Canal) was held at this
time. The matter is mute as 5B 200 was defeated by the Legislature.
ADOPT ORDINANCE 2027 AMENDMENT TO PARAGRAPH (A) OF SECTION 24-125 OE THE
BUTTE COUNTY CODE TO ALLOW ONE SINGLE FAMILY DWELLING PER PARCEL INCLUDING
MOBILE HOMES
Discussion of the report to the Board regarding the Butte county
Planning Commission proposed negative declaration and amendment to paragraph
(a) of Section 24-125 of the Butte County Code to allow one single family
dwelling per parcel, not including tents, trailers or mobile homes was held
at this time.
Bettye Blair, planning director, stated that this was referred
back for the Planning Commission for consideration. The Commission's
report-aback to the Board was that they did not disagree and recommended
the ordinance be worded to include mobile homes.
Dan Blackstock, county counsel, advised that this ordinance
could not be an urgency ordinance as there were no grounds for such ordinance.
It would be a regular ordinance but the Board could instruct Public Works
to commence review and issuance of building permits so that they could
start when the ordinance goes into effect.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, Ordinance 2027 amendment paragraph (a) of Section
24-125 of the Butte County Code to allow one single family dwelling per
parcel, including mobile homes in the "N-C" zone was adopted and the
Chairman authorized to sign.

ADOPT RESOLUTION 79-107 PUBLIC HEARING: CONSIDERATION OF CLOSURE OF
EL PASO WAY BETWEEN EAST AND LA_SSEN_AVENUES. CHICO
The gublic hearing on consideration o£ closure of E1 Paso Way
between East and Lassen Avenues, Chico was held as advertised.

Clay Castleberry, public works director, set out the maps
showing E1 Paso .Way at this time. He set out the location of the possible
interchange at Lassen Avenue. His office has been asked for more information
for the Transportation Commission on the interchange.
Chairman Lemke set out the correspondence that had been
received by the Board regarding this matter: Elizabeth Langford, opposed
to the c3,osure; a petition opposed to the closure of E1 Paso Way; the
following communcations in favor of the closure of E1 Paso: Mrs. Geraldine
Young; Cardine Lewaik, Mr. and Mrs. Ed Gould, David West, Steve & Susan
Colvin, Laura Eshe, Carolyn Woolery, Mr. & Mrs. J. M. Jackson, Iren Crune,
Mr. & Mrs. Dale Kusie, A. L. Gates and Carolyn Curtis and a letter unsigned,
Hearing open to the public. Appearing:
1. Beth Langford. Mrs. Langford stated that White Avenue and
EI Paso Way servedthe same purpose and the same type of traffic, She lives
on White Avenue. She felt to close one street would burden the other
street with the total traffic problem. Both streets need to be closed
or there needs to be twa more streets opened. She opposed the closing
of El Paso Way>
2. Jerry Bowles. Mr. Bowles stated that he had circulated
a petition on White Avenue. Theepgople desire to have the White Avenue
exit on the Casa de Flores Mobile Home Park closed and have it as an
emergency exit only. The people living in the mobile home-park also
want the exit closed. Tt was originally an emergency exit. He left
the petition.
3. John .Otto. Mr. Otto stated that he lived on E1 Paso Way.
Mr. Otto stated that the people on E1 Paso-Way had no objections to the
people living on Tom Polk, White Avenue or Casa De Flores Mobile Home
Park using the street. E1 Paso can handle the local traffic. It cannot
handle the traffic between Eaton Road and Lassen Avenue, What is really
needed is another off ramp on Lassen Avenue. The real hazard is going to
be the traffic coming from the north.
4. Henry Curtis. Mr. Curtis stated that White Avenue could
handle more traffic than E1 Paso Way. El Pasa« Way has a lot of curves
and the visability is not good. White Avenue does not have the apartments
coming into it. E1 Paso Way cannot handle the new development. Mr.
Curtis set out the damage that has been done to the yards on E1 Paso Way.
5. E. G. Downing, E1 Cerrito. Mr. Downing stated that E1 Paso
Way was hazardous. White Avenue is a straight street. The county will
be held liable if there is an accident on E1 Paso Way as they have been
informed of the hazardous situation.

6. Muriel Nathan, White Avenue, .Mrs. Nathan s}~pported the
comments of Beth Langford, She was opposed to the dlosure of El Raso
Way unless White avenue was also closed, Lassen Avenue is a wide street
and the people should be required to use it. There are cars parked on
both sides of E1 Paso Way almost solid. The people on White Avenue
have problems being close to the railroad crossing.
7. 01eta Curtis,. E1 Paso Way. Mrs. Curtis stated that there
are no more than five or six cars parked on E1 Paso Way unless it is at
the apartments. She did not feel that Whit venue should take their
traffic. They have agreed to take the traf ~.c from the apartments.
White Avenue does not have the curves, they have dips that slow traffic
down.
8> Rebecca Probble, White Avenue. Mrs. Probble stated that
cars travel very fast on White. Avenue. The street is widened nice for
the raced rivers. The dips do slow people down to same extent. E1 Paso
does have a stop sign. She was opposed to the closure of E1 Paso Way.
9, Terry Paul. Mr. Paul supported the closure of E1 Paso
Way on the basis of safety. The street is very dangerous.
10. Art Leman, Panama. Mr. Leman stated that both streets
should be closed until the freeway offramp is taken care ofo The problem
is much larger than the immediate area. He felt that Tom Polk Avenue
should also be closed until there are offramps provided.
11. Bill Gates, E1 Paso Way. Mr. Gates stated that he was
concerned about the through traffico The people that live in the area
will not create a problem for the neighborhood.
12. Cheri Howard, White Avenueo Ms. Howard stated that the
traffic on bone streets has increasedo She suggested that maybe-the Board
could dose both streetsa
13o Carolyn Otto, E1 Paso Way. Mrso Otto stated that the concern
is the traffic north of Lassen Avenue. Both Esplanade and Cohasset are
four-lane roads.
14. Chuck Bain, El Cerritoe Mr. Bain stated that there are
a tremendous number of people both young and old that use El Paso-Way.
He was in favor of closing E1 Paso Way.
15, Marian Gates, E1 Paso Way. Mrs. Gates felt it was a shame
that their neighborhood had turned into a freeway. She was in favor of
the closure of El Paso Way.
Hearing closed to the public and confined to the Board.
Mr. Castleberry stated that the traffic volume on E1 Paso Way
was almost identical to the count taken last year. The traffic count-
on White Avenue which has somewhat less traffic than E1 Paso Way increased
a greater percentage. There are about 3,000 cars per day on E1 Paso and
about 2,200 per day on White Avenue. He had no comparison. There are
10,000 carshon the Skyway on a two-lane section. If the road is closed
the traffic on White Avenue and Burnap will increase. If bath streets
are closed, Burnap will be overloaded. He could not recommend closure
of E1 Paso Way.
Supervisor Winston stated that he lived on a street that has
about 8,000 cars on one street and 3,000 cars on the other that has a

the Planning Commission's approval of negative declaration and use permit

was held as advertised.
Earl Nelson, environmental review director, set out the
background of the negative declaration, The property is 2.5 acre in
the northwest portion of Palermo. The closest residence is about 300
feet from the proposed kennel, It is a proposed breeding kennel rather
than a boarding kennel. The Planning Commission limited the kennel to
ten females. The traffic would be minimal, The odor is potential
problem. The main concern relates to the noise from dogs ~axking.
There is a requirement that there be an inclosed building to keep the
noise levels to 65 dba at the property boundary. There are concerns
in view of the rural nature. He recommended a negative declaration.
Bettye Blair, planning director, set out the background of
the use permit. Tt was approved by the Planning Commission and there
was a timely appeal.
Hearing open to the public. Appearing:
1. Melvin Love. Mr. Love stated that he had circulated
a petition in the neighborhood. Noise carries in this area. You can
hear a barking dog a mile away. Smells carry in this area. There are
a lot of stray dogs and this would attract themo The value of the
property in the area will drop if there is a kennel.
2. Sohn Bible. Mr. Bible felt that a kennel would destroy
the value of property in the area, He felt there were other places more
suitable for a kennel.
3. Irene Whitmore. Ms. Whitmore stated that sound does carry
in the area. Property values would be jeopardized.
4. Linda Hayes< Ms. Hayes stated that she would hate to see
a kunnel go in on that property.
5. Ross Eddington< Mr. Eddington stated that the noise would
be minimal, He intends to keep the kennels in good shape and clean.
They have plenty of sewer lines and septic to handle the odor.` These

of the appeal of the condition at this time. This is a parcel map with

Department to accept a deposit in lieu of the drainage requirement.

of MIAC Investors Subdivision.

The public hearing on the acquisition of real property by eminent
amain for Meyers Street Assessment District (Harold V. Thomasson) was held
at this time.
Mark Rizzo, McCain and Associates, set out the background of
the eminent domain proceedings. The Meyers Street Assessment District
was formed to install curb, gutter, storm drainage and sidewalks.
There is a very serious problem in conjunction with the Meyers Street
Assessment District down to the future Ivy Street connections. Tn
conjunction with the assessment district a subdivision which has been
improved and has put in the Ivy Street portion. -Presently there is
an existing storm drainage system that services a portion of the area.
They are asking for the acquisition of the property so the pipe can reach
the actual ~.ough. There will be a manhole adjacent to the property.
He presented two photographs at this time. It is likely that the whole
district will be annexedd into the City of Chico.
Clay Castleberry, public works director, stated that the
assessment district is to finance the improvements on public rights-of-way.
The property would be under public ownership. It is necessary to acquire
two small drainage easements for underground pipes. The Assessment
District has applied for an EDA grant. There are no county property
axes involved. The maintenance would be insignificant.
Mr. Rizzo stated that they would leave the existing ground
the way it was when they started the project. There has been soma cattle
that have used the property.
Dan Blackstock, county counsel, asked the Board if they were
ready to assume liability and assume maintenance and how was the county
going to pay for the property?

of Mr. Thomasson. Mr. Cook stated that this is a piece of property between
the channel and a fence. The distance between the fences and the channel
is somewhat small. It has been used in the past for cattle. The concern
is that there is going to be a requirement for the placement of pipe and
mortar and concrete where the pipe runs out of the ground. The ground
is quite steep. The concern is when the easement is in the Bound it is
no longer an easement but is taken from the property owner without just
compensation. This piece of property is effectively land locked.

What is actually being done is not the placement of~an easement but the
taking of property. At this stage, there is nothing to justify placement
of the easement. The-money proposed is $100 per easement for a $200 totals
They had received offers on the property seven years ago for $17,000. The
appraisal done reflected a total price of $1,000,
Mr. Blackstock asked that the matter be continued for one week
so that he could sit down with counsel for Mr. Thomasson and talk about
the type of structure and see if they could work out something.
Mr. Rizzo stated that there is a need to have the resolution
adopted today because of the EDA grant.

effects. A11 of the impacts were not discussed. He did not feel that

Paulus, fire warden, as far as the fire danger.

there are land divisions in process at this time.
Ban Blackstock, county counsel, stated that an interim zone
puts the owner of the land that has a map in jeopardy as they would not
be able to have the final map approved and it would eliminate a particular
subdivisiono By the same token there is a provision of the Government
Code that states the final map is only what has been approved as a tentative
map. The general concept is that the Board has a zoning approval to change
what it has done with the subdivision on a tentative nature.
Supervisor Dolan felt that the entire area being studied by
the Planning Commission in the unclassified zone should be interim zoned.
Supervisor Winston stated that he was not against interim zoning
but would not vote to have the subdivision placed in the interim zone.

L975 for the purpose of setting forth a program for the storage, collection,
processing and disposal of all solid wastes ;g.enexa8 in the County. The

privately owned transfer stations and one central sanitary landfill site
which is owned by the County and leased to a private company for operation
end management. The use, storage and disposal of liquid waste is regulated

APPEARANCE: DAVE DAVEY
Mr. Davey was present to appeal conditions on a building permit.
He had been granted a use permit for his property Use Permit 77-1$ on the
east side of Clark Road, Paradise, He then applied for a building permit
and was-told that he could not be given a building permit as he had not
done the conditions on the use permit. There was nothing in the letter
he received from the county saying he had been granted a use permit that
indicated that he would have to furnish a right-of-way or apply for an
encroachment permit from Caltrans. The use permit was granted December 9,
1976.
Mr. Davey advised to get together with Counsel and the Planning
Director and they will report back to the Board.
EXECUTIVE SESSION: The Board recessed at 4:33 p.m, to hold an executive
session regarding litigation and meet and confer.
RECONVENE: The Board reconvened at 4:57 p.m. following an executive
session regarding litigation and-meet and confer. There is
nothing to report at this time,
