Valley Indian :Health, Inc. Oroville. The Organization writes appealing the Board of Zoning Adjustments determination with regard to a use permit to consider the requirement for cdeletion of curb, gutter and sidewalk, AP 31-237-08, southside of Yuba Avenue, approximately i00 feet west of Seventh, Thermalito. Discussed. See motion following communicationso Dorothy Hartnett, Paradise. Ms. Hartnett writes conceming receiving a retroactive rote for placement of a developmentally disabled person in her home. Ms. Hartnett present and explained her request. Referred to Mr. Crison, Welfare Director, with request that he rec~pond to this request and the other two presented by Ms. Hartnett. Northam Cglifomia Health Systems Agency. The Agency writes advising of proposed changes to their bylaws pertaining to membership. Administrative Officer to study and report back to the Board on the proposed changes. Northern Cglifomia-Health Systems Agency. The Organization writes providing information on their current year's activities and requests a contribution of $3,459 in financial support. Discussed; Administrative Officer to obtain more information on this matter and report back to the Board, State TV Cable, Chico. The Firm forwards information conceming their request for adjusting service rates which is set for public hearing on June i20;. To be considered at the public hearing on June 20. County Supervisors Association of California. The Association writes requesting voluntary contribution for support of the National Association of Counties Western Interstate Region Public Lands Service Program related to CSAC activities at the federal level. The amounfi requests of $!47.23. Discussed; Administrative Officer to write to them setting out Board`s views on the matter. U. S. Department of Labor. Ray Marshpll, secretary of labor, writes concerning the program underway by the Department of Labor with regard to CETA program abuses. Information; no action taken. Cheryl W.-Judi, et al, Chico. Letters containing numerous signatures have been received appealing the ElRand Advisory Agency's approval of Walnut Woods Page 496. Chairman Winston felt the Board of Supervisors Room was the proper place to hold such a hearing, where action could be taken at the time. of the hearing, Metropolitan Water District of Southern California. The District sends a mailgram asking that water contractors and legal counsel attend a meeting June 14, 1978 in Sacramento to discuss the impact of Proposition 13 on the stdtte water contractors. No action taken, Butte County Farm Bureau. DeVere Pace, Chairman, Butte County Farm Bureau Political Action Committee. Writes commending the stand taken by this Board regarding Prop. 13. 78-1096 UPHOLD PUBLIC WORKS RECOMMENDATIONS AND DENY APPEAL OF NORTHERN VALLEY INDIAN HEALTH, INC.., QROVILLE FOR DELETION OF CURBS, GUTTERS & SIDEWALK Clgy Castleberry, Director of Public Works; .reported on the condition on the use permit issued to Northem Valley Indian FH~lth, Inc., Oroville for deletion of curb, gutter and sidewalk, AP 31-237-08, southside of Yuba Avenue, approximately !OO feet west of Seventh, Thermalito. He-said he had granted them a nine month extension and they would now like a pos~,nonement of the requirement to install the curbs, gutters dnd sidewalk. He would not recommend a further postponement of .the requirement. . On motion of Supervisor Ricfht r, seconded- by Supervisor Madigan and unanimously carried, the BoarcJ~u°pon~he position of Public Works and denied the untimely appeal of Northern Valley Indian Health, Inc,, Oroville. 78-1097 STATEMENT OF CHAIRMAN WINSTON REGARDING PROP. 13 IMPLEMENTATION PRE PA RATI O N T e fo lowing statement was presented by Chairman Winston regarding Proposition 13 lmplementation preparation: "As you know, Proposition 13 (Jarvis-Gann Amendment) was approved by the voters of the State of Califamia on June 6, 1978, Presently the Governor and State Legislature are formulating plans to provide some relief for units of local govemment. At this time we do now know how much Butte County .govemment will be assisted or in what specific areas, if any. Even with action. taken by the state, there is a very good chance that some local services may have to be reduced or curtailed. In order to plan for al! eventualities, the Board of Supervisor's are enlisting your support and your input. Initially, we have asked the Administrative Officer to work with each department to formulate a coordinated report of priorities in the services provided by each department. The report should identify priorities of service from the lowest to the highestsf It should show the ramifications of staff reductions, services and supplies reductions, equipment reductions, and resulting property tax savings. We realize a report of this nature is not generated overnight and requires a diligent effort on behalf of all of us. However, we would like you to give some thought to your department's priorities L~Fore receiving specific instructions from the Administrative Officer. Robert A. There wil! be a breathing sped, prior to any action being taken. Supervisor Madigan recommended that there be a hiring freeze; this will be given consideration at a later date. Butte County Employees Association have sent out a bulletin stating that they believed that the County has acted in the best interest of the employees and that all negotiations regarding salary adjustments will be held in abeyance. The Board felt that this gesture on the part of the Association was very commendable. 7$-1098 MATTERS PRESENTED BY BOARD MEMBERS Supervisor Madigan commented on the Health Bulletin received by the Board members. Supervisor Moseley commented on the fetter received l:rom EDAW; it was her feeling that they were pulling out on the.countis. Chairman Winston suggested that Supervisor Moseley meet with the staff and they could interpret the letter for her.. They are making an effort to clean up the Fontana operation. 78-1099 PUBLIC HEARING: CMR TAXPAYERS ASSOCIATION, INC. ENVIRONMENTAL IMPACT REPORT AND REZONE FROM "A-2" (GENERAL) TO 'C-I "-, "TM-5" 'TM-10, "TM-20 (timber mountain-5, 10 and 20 acre parcels), property located SOUTH OF MIDDLE FORK OF LAKE OROVILLE, NORTH OF SOUTH FORK OF LAKE O OROVILLE & WEST OF TOWNSITE OF FEATHER FALLS (Cont. from March 14, 1978) T e pu is eating on the CMR Taxpayers Association, Inc.-environment, impact report and rezone from "A-2" (general)#o "C-I"(fight commercial), "TM-5", "TM-10", 'TM-20" (timber mountain -5~, 10 and 20 acre parcels), "FH-RR-2"and "FH-RR-S" (foothill-rural residential, two and five acre parcels) property located south of the Middle Fork of Lake Oroville, north of the South Fork of Lake Oroville and west of the Townsite of Feather Falls, containing 12 square miles, more or less. This was continued from the- March 14, 1978 meeting. ' Chairman Winston stated that due to the lateness of the preparation of the Environmental Impact Report, and because the Board had been advised by County Counsel that this should. be referred back to Planning Commission for their consideration of the E.I.R., this hearing will have to be continued to August 8, 1978. Earl Nelson, environmental review. director, commented that a lot of useful date had been gathered that will be helpful in coming up with a decision for the zoning in this area. Hearing opened to the public an the E.I.R. only. Appearing:, 1. Mr. Bnjno Wojcik, Mooretown Road. They feel that this matter has been dragging on for the fast 4# years. He felt that the preparation of the E.I.R, was a waste:of the taxpayers money. The E.I.R.. was not clear as far as he was concerned, The group that Mr. Wojcik represents are requesting that the Board take action at this time: page 498. June 13, 1978 ', Supervisor Richter stated that the law requires that the Board send this matter back to Planning Commission . ', Mr. Wojcik felt the Board should find a way to speed up this matter. He stated that it has taken 3 months to prepare this E.I.R. The County now is referring this back to Planning Commission and continuing the hearing for ', another two months. He again requested that the Board take action at this time. Chairman Winston stated that whether the Boardiliked it or not, they were governed by strict guide lines. This E.I.R. has to go down to the Clearing House for review. The Board cannot take action at this time. He assured the people in the audience that this Board would take action on August 8, if the Board has to listen all day to statements made by the audience. Also appearing: 1. Mr. L'. P. Larson, EI Cerrito. He asked why the Board could not use other E.1. R.'s that have been approved for the area. Request that the Board take action at an early date. Z Mr. C,;.J, Buchanon. Spoke in opposition to the continuance of this matter. 3, Mrs. Doris Pate, Texas. She wondered how much authority and power these people in the area had; they have requested that action be taken but instead this is to be continued for another two months. 4. Mr. Conrad Springer, Danviller Cplifomia. Stated he had driven up here this m.oming in the hope that there would be a speedy resolving of the facts. He hoped that the August 8th, 1978, meeting would settled the matter. Stated he had read the E, 1. R. and the sd:bstance of it boils down to: I, New zoning should be done for the area" 2. If more people would move in to the area, there would be more development, there would be more litter that goes with people. More people means less ruralness. Mr. Springer stated that people are camping on other people's property; this is going on all over the area. He felt that there were no material facts to help the Board reach a conclusion. The County should not be dominated by the people that are transcient. He urged the Board to adopt some thought of what the people iri that area desire. Chairman Winston stated that he thought some logical zoning should be placed on the property in the above area. He apologized to those that-have traveled so far fot this hearing. The next step is to refer the E. I, R. back to Planning and he again assured the people that the Board would reach a decision ', of the meeting on August 8, 1978. Mr. John Luvaas, attorney at law, representing a large number of ', the residents m that area, stated that it-was unfortunate that people in favor of the CMR rezone were not informed of the continuance of the hearing. People do not understand the procedure of this. Process explained, He spoke concerning the EoI.R. and the rezoning. He stated that it would take time for the Clearing House to clear the E.I.R.. They will have to devote a couple of evening meetings to this rezone. Chairman Winston assured -him that there will be a decision made on August 8, 1978; Board members supported this statement. Mr. Ed Krause spoke concerning the E.I. R, He felt that it was very poorly presented. ;Hearing continued to August 8, 1978 at 9:30 a.m. RECESS: The Board recessed at 10:15 for an executive session to discuss a personnel matter. RECONVENED: -The Board reconvened at 10:30 a.m. following an executive session. 78-1100 CHILD CARE RESOURCE CENTER GRANT SUBMISSION DEMED EOC is requesting out orization to su mit an application to the State Department of Education in the amount of $82,743 for continuation and expansion of the EOC Child Care Resource Center. This is a one year program commencing September I, 1978. Mrs. Kd4amreported on this; she stated that this was not a give-away program, It,will help people. Supervisor Richter questioned Mrs. Khan about'fhe grant. ~ Mrs. Kdianstated that EOC has its own mission and one is to help people achieve self sufficiency and to help people. The budget is for staff and . material. Mrs. Linda Wells, representing the Day Care Mothers of Chico, spoke in opposition to the grant. They oppose .the methods that are used. The survey that was-done for this grant was done under false pretenses. She stated that there is a lot of mis-information in the report. Day Care Mothers of Chico have their owri training sessions. They-have helped others to become Day Care operators and to become licensed operators. They oppose this grant as they see flaws in it. Their Association requests that this program be ended. Mrs. Kean responded to the remarks made by Ms. Wel Is. The problem is the need for such centers. Chairman Wrnston summarized what has been stated up to this time. This grant will provide for continuation of a Child Care Center with a staff that will advise people that hope to open such homes, Ms. Deni Lopur, President of the Day .Care Association, stated-that if this grant was directed solely to the low income people, she would not be here. ', Theie organization are not baby sitters; they are highly qualified people. They do take care_of some low income children. This Association represented 30 homes. ', Mrs. Wells stated that there are people that gnafi lilcedsed that ta{~e care a6~cf;7iu~dr~d. This program under the grant would duplicate the services that the Association was offering at this timed ', On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, the Child Care Resource Center grant submission was denied. Laura Rosent au, C ico, addressed t e Board concerning the transportation need questionaite. She is deeply concerned with the survey that states that there - are nctmany`"people that have atransportation need. Questionaire set out and discussed, There-was not orie question that was asked os to the needs of the people. The questionaire did not ask if the car was able to be driven or operated. She felt that the type of question that should have been asked would be: "Do you need transportation and how often do you need transportation ". Ms. Rasenthau stated that she hoped that the survey would not Claud the '; discussion of the #ransportation needs. Ms. Ann Becker, Chico, stated she was a recipient of AFDC and is a director of Welfare Rights. She has read the survey on transportation needs; it has been found that transportation-has been a prevailing problem. .Most of the AFDC families are left without transportation. Mr. Dan Siegel, Butte. County Legal Services, asked what the household major transportation needs would be; a need was seen for roads and parking Ispaces. A need was seen for buses in this County. Supervisor Lemke asked that whydduring the time that the survey was being made-ciid-the, bus service fail in Chico and Paradise. Chairman Winston stated that this matter would be debated at the BCAG meeting next week, 78-1102 APPEARANCE:-DON BLAKE: WATER ENTITLEiA/,i~INT PROBLEMS Don Blake stated he was heee° to aske.a question that was prompted 6y Dan Blackstock, County Counsel, in Willows-last Thursday. He asked if the Board had given clearance to the legal department: to give away water. He commented upon the stipulation thatgave'F.G. & E. the County water. Mr. Blackstock had told him "Let the document speak for itself" Chairman Winston told Mr. Blake that Mr. Blackstock was orr vacation; the Board could not answer the question set, out by Mr. Blade. The question of the water relative to the PoG. & E. coal fire plant has not been answered. The Board does not have any information on this. This Board has not instructed Mr. Blackstock on the water. question. Mr. Blake felt the stipulation was illegal because Mr. Blackstock did not have authority to make the stipulation. Discussed; no action taken. 78-1103A?PEARANCE: MR. MICHAEL HARRIS, BALDWLN AVE., PALERMO Mr. Mickael Harris, 2586 Baldwin Avenue, Palermo- protest the flowing of sewage from Mr. Simpson's property, across his land. He has written IetYers to Mr: Simpson to correct this situation. The Health Department has been informed of this problem. Mr. Harris stated he had obtained a lawyer, but he did not seem to get any action. He asked if this Mr. Simpson was going to be allowed to violate the Code of Sanitation forever or is the Health Department going to bring pressure on this man. Mr. Mickelson will report to the Bogca~4'on the situation,following astudy of the complaint. '; 78-1104 APPEARANCE: MR.-HENRY GILBERT, CHICO Mr. Henry Gilbert, Chico, reported that he was one of the people that ran for the office of Marshal for the Chico Municipal Courts He resigred his position ', as deputy marshal; the present marshal had stated he would not seek re-election. He has been out of work a little over three months. He would like his job back with the Sheriff's Department. Mr. Rackerby stated he was on the eligibility list if a positior becomes available. This position had been abolished through Board action. Mr. Gilbert stated he would never had resigned his job if he had known the~iosition would be abolished. Chairman Winston requested that Mr. Gilbert sit down with ', Mr. Rackerby and pursue the mattero 78-1105 APPROVE SUMMER FOOD SERVICE .PROGRAM C~h app ication as en prepared in t e amount of $1,654 fora Summer Food Service Program far childrens' funds. The program is authorized under the National School Lunch Act of 1975. , On motion of Supervisor Moseley, seconded by Supervisor Madigan and unanimously carried, the Board authorized submission of the Summer Food Service Program application and authorized the Chairman to.sign. 78-11.06-F:I?DifY,I~JYEREQUEST FOR REVENUE SNARING FUNDS FOR SENIOR RECREATION PROGRAM IN GRiDLEY AREA 2,500 in revenue sharing funds to expand the Senior Recreatiom in Gridley area is requested. This would .provide 'for six senior citizen bus trips to points of interest in northern California and Nevada, as w~llao~s funds for arts and crafts activities and a film series program. Supervisor Moseley stated that all the Revenue Sharing funds for her district have been used and unless there are funds available from some other district, this request would have to be denied. On motion of Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, the request for Revenue Sharing Funds to expand the Senior RECreation Program'in the Gridley area was denied. 78-1107 AUTHORIZE SETTLEMENT OF SUIT: JOHN PHIPPINNEY, SHERIFF'S DEPT. Estimated cost is $3,800. On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, the.Board authorized the signing of a petition of application for annexation to the City of Chico and transfer of $3,800 from the reserve to cover project costs. 78-1109 AUTHORIZE PARADISE BUILDING ADDITION-CHANGE ORDER ~I A change order. has been prepared which would add six days to the construction contract .for delays due to rain and also to increase the project by ', $25.30 for the installation of attic vents at the north end of the building. On motion of Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried, change order #I, Paradise Building Addition, was approved, Chairman authorized to sign, and a transfer of $25.30 from the Community Development Loan Fund was authorized. 78-1110 APPROVE CHANGE ORDER #12, ADMINISTRATION BUILDING CONSTRUCTION A change order to t econstruction-contract as een prepared to provide capacity far additional telephone lines to the old hospital complex section of County Center, . ', On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, change order #12 in the increasing amount of $9,678, was approved, atransfer of revenue sharing funds from the Administrative Building Contingency Furid was authorized and a time extension for-four calendar days approved to the construction contract, and the Chairman was. authorized to sign. 78-1111 BUDGET TRANSFERS APPROVED On motion of Supervisor- Ric .ter, seconded by Supervisor Madigan and unanimously carried, the following budget transfers were- approved: 8-226 Housing and Community Development Grant. Transfers $7,000 from HCD Relocation to HCD Public Works to cover additional expenses for change order #I for public works improvements in the EI Medio project area. Transfer is within the HUD guidelines. B-228-Planning. Transfers $90.00 from regular transportation and travel to out-of-county travel~to cover the cost of attending the Planning Directors' Association annual meeting. B-229-Administration. Transfers $100000 from extra help, $571076 from equipment maintenance, $12,00 from memberships,. $391.24 from equipment, and $:525.00 from the reserve in order to increase the appropriations for office expense, $750.00; outrof-county travel, $200.00; and other. transportation and travel, $650.OOa ', The purpose of the transfer is to cover current deficiencies and to provide an appropriation for-the balance of the fiscal year. This transfer is to cover current deficiencies and an appropriation for ', the balance of the fiscal year. B-231-Chico Municipal Court. Transfers $1,550 from regular salaries and wages, $1,000 from jury and witness fees, $400 from out-of-county travel, $367 from equipment, and x$5;965 from the reserve in order to increase the appropriation for extra help, $1,300; ovettime, 5 ;equipment maintenance, $200; office expense, $4,000; professional and specialized services, $3,000; equipment rental, $532; and other transportation and #ravel, $200. REQUEST FOR REHABILITATION ASSISTANCE-DEAN & LOIS ELAM, 1534 Bouaher Street, Chico Proposed is a Community and Development Block Grant loan in the amount of $32,800 at 3% interest for 30 years. On motion of Supervisor Qtichter, seconded by Supervisor Moseley and unanimously .carried, loan in the amount of $32,800 at 3°lo interest for 30 years. was approved for Dean and Lois Elam, 1534 Boucher Street, Chico, under"a Community and Development I Block Grant loan. 78-1114 APPROVE RENEWAL OF VARIANCES FOR MARTHA .~. Also proposed is a zone map change and increase of County fare to $1.50 for Zone 2 and $2.00 for Zone 3. Estimated annupl cost is $500 from SB 325 funds and $125 from County genera! funds, Page 504. On motion of Supervisor Richter, seconded by Supervisor Moseley and unanimously carried, request to remove the concrete wall at the Butte Meadows mini transfer station was approved. 78-1119 APPROVE PARADISE PATHWAY PROJECT-ELLIOTT ROAD REQUEST Public Works requests authorization to complete the project by change order with the paving contractor. This would be to finish grading, pave additional. two-foot strip, replace asphalt dike and backfill behind dike for approximate additional .cost of $16,000.00. Department of Labor, pre;ent to present the Board with an outstanding performance .award for the GETApnugram. He stated that with the passage of Prop. !3 there will be a great impaaf to CETA. Butte County bus exceeded the task of hiring people into public service. As a momentum of appreciation the Department of Labor is presenting this award for Mr. Rackerby's outstanding efforts in this matter. Chairman, Winston accepted the plaque on behalf of Mro Rackerby and-the people of the County. Mr. Douglas explained the impact of Prop. 13. If a, regular county employee is layed off, then a CETA employee in like positiorrmust belayed off. Examples set out of how the plan would work.. The concern is with the CETA employees. Everyone would hate to see them become unemployed again, There cre other possibilities of transferring.#hein to other jobs where there are no layroffs. At the present time, most governmental agencies have a financial crisis. No one knows the implication to this County at this time. It i~ forcasted that there is a problem coming and Chairman Winston stated that the .County will approach it coolly and calmly. Supervisor Richter complimented Mr. Racherby on his running of this program. Mr. Rackerby has a very tough job and Supervisor Richter went on record as commending ,him. 78-1130 AUTHORIZE A REQUEST FOR STUDY OF CtiICO CREEK Supervisor Madigan stated he had a request from Mr. Wright for the Board to review the problem of Chico Creek. The water comes out of Chico Creek and floods his property. On motion of Supervisor Lemke, seconded by Supervisor Richter and unanimously carried, the interim zoning of Sierra Del Oro, Units I through 4, being Ordinancel93l '! was set for a period of i20 days. 78-1133 MATTERS PRESENTED BY SUPERVISOR LEMKE Supervisor Lem a as ed County Counsel a out the matter of movie ratings for movies showing at Ioca) theatres. Is there a local ordinance that states the theatres ', can turn away people that are not in the proper age range. County Counsel did not have the answer. No action taken . Supervisor Lemke reported that .Judge Rix had written to him stating that ', the Paradise Constable has a necessity to transport prisoners to court in his private vehicle and his van does not have a safety screen. He asked if there were funds to have such a screen installed in the constable's vehicle. Administrative Officer will report back to the Board on this matter, 78-1134 LETTER OF PROTEST TO BE WRITTEN RE WITCHCRAFT COURSE TO BE GIVEN ', AT CHICO UNIVERSITY Supervisor Iviose ey stated that the Saturday night paper had an article that stated that Chico University would be giving a course on witch craft. She requested that a letter of protest`be written o On motion of Supervisor Moseley, seconded by Supervisor Madigan and ', unanirrpously carried, a.letter of protest was authorized to be written concerning a course on witch craft that Chico University will be offering to the students. Chairman Winstan stated that he resents other political entities coming to .the Board and telling the Board how to conduct their business. He voted for the motion but did not believe it should be written.
