The re-routing of these logging T trucks has caused some concern. He explained how they might 6e re-routed. Lt. Cramer is working with the logging people on the re-routing of the logging trucks. Read and acknowledged. 76-434 APPROVE ADDENDUM TO JOINT POWERS AGREEMENT WITH THERMALITO IRRIGATION DISTRICT (COUNTY SERVICE AREA NO, 26) m. nuance, at#omey or rmalito Irrigation District, was present to explained the proposed addendum to the Joint Powers Agreement between the County (County Service Area No. 26) and the Thermalito Irrigation District. Dan Blackstock, County Counsel, stated he had discussed this addendum with the various departments involved. Background of the matter set out and discussed. On motion of Supervisor McKillop, seconded by Supervisor Ladd and unanimously carried, the addendum to Joint Powers Agreement to substitute semi-annual deposits for annual deposits of bond principal and interest for Farmers Home Administration Bonds was approved, and the Chairman was authorized to sign, 7b-435 APPEARANCE OF JUDGE HANCOCK, BIGGS JUDICIAL DISTRICT •RE: LETTER FROM COURT CLERK Judge Hancoc ,Judge of Biggs Judicial District, reported on the letter written by Mrs. L. G. Pilot. The letter was not a letter of criticism of the Court. She set forth some constructive suggestions. It was suggested that the office and the court space be closer tope#her for a more efficient operation. He set out the duties of Mrs. Pilot and how she handled the court offices. Mrs. Pilot suggested two things: (I) that the Iota#ian of the offices be changed and (2) the hours of the office be changed. Case load of the court set out by Judge Hancock. The judges in this county cover far each other; he sits as judge in the Oroville Justice Court on Monday and Tuesday. Clif Mickelson, Administrative Officer, stated he had been meeting with Judge Hancock and with Norris Goodwin, who will take over the office of Judge of the Biggs Judicial District on July I, to discuss the relocation of the court chambers and office space. At the present time, they are considering the use of resident space in the Biggs Fire Station. No action taken at this time. Page 421. June 22, 1976 ~'~ June 22L1976 __ _~~~,_____~=~=~T to-~~t 76-436 REPORT BY CHAERMAN CAMERON RE COUNTY SUPERVISORS ASSOCIATION MEETING: TREMENDOUS COST OF REFORM ACT C airman Cameron reporte tot at t e County Supervisors Associatian meeting held last Saturday in San Francisco, they brought up a subject that many of the counties are talking about the tremendous costs of administering the reform act. The reports and paper work to comply with the law is tremendous. It was felt that this County should determine the costs to this County for handling this act. Sample ordinance from San Luis Obispa; in which they are urging that a urgency tax measure be passed to cover these costs, discussed. That county feels that the costs will be at least $100,000 to administer this reform act. County Counsel set out the time that is used to handling this act by his office staff. He said that Coun#y Clerk will have to spend a great deal of time handling these codes; new filing cabinets will have to be purchased in which ro file the documents. Mr. Nickelson will send copies of the San !mils Obispo ordinance to the Board members. 76-437 bISCUSSION: CABlE T.V. IN PARADISE AREA Dan B ac stoc ,County Counse , stated t at his office has been contacted by the Chico and Oroville TJif Companies relative to the Paradise area franchise. His office has written to Televents asking them to do something about their franchise. tie has "put them on notice that they have not complied with the conditions of the franchise. ORCO is also entering into an agreement with Gridley for cable N services. Terms of this franchise are not complete at this time. Paradise Cable N discussed, It was felt that representatives from ORCO should be heard as to what they plan in the Paradise an:a. Mr. Nickelson osked if the Board could advertise their intent that they will cancel out Televents and then that they will take bids for the cable N service in Paradise. Douglas Foster, representative from ORCO, gave a copy of the Gridley application to County Counsel. He stated he was present today to assure the Board of their interest in building in Paradise. They have made a study of Paradise and it has only bean recently that they felt they could go ahead with Paradise. They have the pole attachment agreements with PG &E. The only thing that they need is a certificate of camp) lance. FCC rules exp] ained . Glen Hunsvec, general manager of ORCO explained how they intend to provide services in Paradise. Use of micro-waves explained. Channels that will be provided set out. Supervisor Richter said he Felt that the Administrative Officer's suggestion was a good one and That the County should go out and secure bids. Supervisor McKillop felt that ORCO has done a good job in Oroville and they are offering many channels for the Paradise area. Mr. Blackstock stated that before the Board takes any action, they Page 422. June 22, 197b ~"y !^'' should hear from Mr. Martin. He called and expressed interest in the Paradise area. Mr. bhn Martin, State N of Chico, stated that interest has been Sh64Vn IR the Paradise area. Franchise for the Paradise area explained. It was his feeling that the Paradise area should go b public bid. He had hoped that the Televent situr~ion would be cleared up before a statement needed to be made. State N could use micro-wave signals to Paradise, also. State N would be interested in making n bid based on the limited survey they have made . County Counsel said it would be in order to set a public hearing to consider the franchise for the Gridley area. August 3, 1976 at 2:00 p.m. set for hearing on the franchise. Televents will be advised that their franchise will be canceled as of August 3, (976. Will also request bids for a new non-exclusive franchise for Paradise. Both areas will be considered at the public hearing. Mr. Foster stated that They are requesting a certificate of compliance by FCC and plan on proceeding with the Paradise area. RECESS: 10;30 RECONVENED: 10:45 EXECUTIVE SESSION: ~'1:itigation:discussed ~ 76-438 REPORT ON LITIGATION WITH CITY OF CHICO RE BARTRAM REZONING Dan B ac stoc ,County Counse , reported t at during t e recess period a short executive session was held to discuss litigation wi#h the City of Chico conceming the Bertram rezoning. The attorney for the City of Chico met with Mr. Blackstock and stated he would like #o discuss the matter before bringing action. They intend to attack the County's General Plan, zoning being inconsistent with tare General Plan and matters conceming the environmental process fihat the County went through on this matter. They intend to secure a restraining order against the County issuing building permits in that area. The attorney stated that he hoped that he and Mr. Blackstock could discuss this again after the suit had been filed. Mr. Blackstock stated that the law suit had not been filed at this time. The attorney stated that if the County would do certain things, than the City would drop the law suit. Lawsuit discussed. Mr. Blackstock will keep the Board informed on this lawsuit. COMMUNITY ACTION AGENCY GOVERNING BOARD A ROVE CONTRA T F R AA P TO C D CT RKSHOPS A contract s en eve ape in t e amount o is calls for the NAACP to conduct workshops in ceramics and knitting in Oroville for senior citizens in Butte County. Work under the contract has already been performed. This was continued from the meeting of June 15, 1976. The Board received the report from Mr. Mickelson regarding the work performed under this contract. Supervisor Madigan stated he had received a call from Mr. White and ha stated that they had discussed This matter with the Auditor's office. They had wanted to get the work completed before the fair. AYES: Supervisors Madigan, McKillop, Richter and Chairman Cameron NOES: Supervisor Ladd 76-441 APPROVE SUB-CONTRACT FOR JUVENILE DELINQUENCY PROJECT & APPROVE HANDICAP GRANT REQUEST FOR HEAD START On motion o Supervisor Ki op, secande y Supervisor Madigan and carried, the following actipn was taken: •••l, Approved wb contract agreement Schools and Butte County E.O.C. for the 'Big Friend Youth Council "project for an amount nat to exceed $31,000 and authorized the Chairman to sign. 2. Approved the handicap grant request for Head Start which would provide diagnosis, treatment and services for 14 handicapped children and their families for the period September I, 1976 through August 31, 1977. Amount of Grant is $4,400. 76-442 APPROVE SUBMISSION OF FAMILY MENTAL HEALTH PROGRAM G and Welfare for a family mental health grant in the amount of $15,933 to help Head Start families unders#and mental health practices and provide individual children with professional counciling and psychological testing far the period September I, 1976 through May 24, 1977, in the amount of $15,933. Nadine West was presen# to answer questions concerning this grant. On motion of Supervisor Ladd, seconded by Supervisor Madigan and unanimously carried, the submission of Family Mental Health Program grant was approved for submission to the Department of Health, Education and Welfare. 7b-443 APPROVE SUBMISSION OF SUMMER YOUTH Ri:CREATION GRAN REQUEST AND JOB DESCRIPTIONS FOR E.O.C. STAFF Butte County E.O.C. is proposing su mission of a program request in the amount of $3,910 to supply on sight playground activities for low income youth. program calls for subcontracting with City of Gridley and Feather River Park and Recreation District to supply on sight playground activities. Smit , a t p ysicist, Lawrence Berkeley Laboratory was present to discuss the laboratory's technique for earthquake prediction. He stated that work was being done in the Oroville area and explained how they wish to proceed in the future. They are trying M learn how to predict earthquakes in the future. It is the Laboratory's feeling that this method they are using is good. It is pat one of the traditional methods. Experience on this technique has been obtained in China; they have used this method and saved a lot of lives because of the prediction of an earthquake. This technique requires a lot of volunteers on the part of the people living in the area. People in the Oroville area have been very helpful. There is a good volunhe~arganization existing here to work on this study. Next year is uncertain as to the financial aspect of the study. Mr. Smith feels that the study should continue in the Oroville area for another year. The data that they have collected looks promising. They are finding out why some of fhe weals respondand some do nat. Technique being used explained. Support for this work should be an a broad basis ; he believed that since mast of the work for the next year will be in the Oroville area, this County should help fund the work. Mr. Smith said at present the work is funded by a Federal Agency. Supervisor McKillop felt that maybe the County should take the leadership to determine if there is a possibil icy of predicting earthquakes. Clay Castleberry, Director of Public Works, stated that the State is installing some devices throughout the State for this work; they are working with the Federal Bureau of Geologists. The Chinese dato is not openly available ro the geologists in this country. Work on this study set out; funding explained by Mr. Smith. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, Administrative Officer was authorized to work with Mr. Smith in the vein expressed during this discussion. 76-446 PUBLIC HEARING: W. A. COVERT-REQUEST FOR BUILDING PERMIT' TO PLACE A MO$II_E HOME ON AP 53-13-84 LOCATED OFF COPLAND ROAD, Between NUNNELLEY $ ELLIOTT ROAD PARADISE e pu is eanng on W. A. One of the conditions of the map was the requirement to install a fire hydrant on the southeast wmer of the intersection of Shasta Ave. and the Esplanade, being Condition No. 9, Mr. Connelly feels that the cost for the fire hydrant should be pro-rated among the other property owners. Mr. Paulus, Fire Marshal, said the boundaries of the County Service Area could be changed to include this property. If the property was to be included in the service area, They would agree to the deletion of Condition No. 9. Deposits could be taken from all the people splitting the property. Property will be annexed ro the County Service Area. On motion of Supervisor Richter, seconded by Supervisor Ladd and unanimously carried, the following tentative parcel maps, recommended for approval, were approved, sub(ect io the conditions, with the deletion of Condition No. 9 from the R. HEINDL, SWINE FLU INOCULATION IN BUTTE COUNTY Dr. Heindl, Health-Director, state tat CSAC as presents a proposal regarding swine flu inoculations ,but they want to be sure the Gavemor will approve the, proposal before approving the State contract. The proposed contract would provide the County with $12,000 to cover some of the program casts. Dr. Heindl said this would not cover the costs of inoculating everyone in the County, as the costs for liability insurance has risen, along with the other costs. Dr. Heindl further stated that this would be a voluntary program and in the event that the contract was approved, the county would then hire a caordinotor to put together a publi c education progrom. Possibility of charging a fee for the inoculations discussed. They did not recommend any changes in the minimums. A comparison of the minimums were made of various counties. On motion of Supervisor Ladd, seconded by Supervisor McKillop and unanimously carried, the following action was taken: Fee for inclusion in the Land Conservation Act raised from $25.00 to $50.00; acreage requirements to be last as they ore ,at present; Board to study the possibility of smaller acreage requirements and change the requirements accordingly, if necessary; that an additional proviso be added for the applicant to submit a lot book report instead of a title report when applying for inclusion in the Land Conservation Act.
