Northern California AIDS Consortium (NCAC) - Butte County is one of the five local counties which comprise the NCAC delivering services to individuals affected and infected by HIV/AIDS. United Way of Butte and Glenn Counties has been reelected by NCAC to act as fiscal agent for the 1997-98 fiscal year - action requested - AUTHORIZE THE CHAIR TO SIGN A CERTIFICATION FOR THE ALLOCATION OF HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS (HOPWA) FUNDS (STATE) THROUGH THE LOCAL AIDS CONSORTIUM. 2. A. Urgency ordinance prohibiting parking on portions of Honey Run Road and Centerville Road - proposed is an urgency ordinance to address the dangerous conditions caused by the numerous vehicles parking along portions of Honey Run Road (between the Okie Dam area to a point 1/10 mile past Fire Station No. 26) and Centerville Road (between Honey Run Road and Helltown Road), adjacent to Butte Creek, during the summer months. The proposed ordinance, requested by residents of Butte Creek Canyon, would make it unlawful to stop, park or let stand any vehicle at any time, with any portion of the vehicle on or over the pavement within the designated zone, and would provide for the removal by any peace officer of any vehicle parked in violation of the ordinance - action requested - ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN. 4. Griffith, Masuda and Godwin, attorneys at law - proposed is the renewal of an agreement for the provision of attorney services. The agreement, commencing July 1, 1997 through June 30, 1998 is in the maximum amount of $30,000. The money to pay for this contract comes from a special fund generated by the State's payment to the County of two per cent of the money paid to local districts for the sale of water to the State Water Bank and from the Measure G budget - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. General Services - Chico Area Voice Mail System - Board approval is requested to purchase an Octel Overture voice mail system and associated licenses, software and implementation costs on a sole source basis to provide voice mail services to Chico area offices. Cost of the system is $28,100 and implementation and training, $7,050. Funding for the purchase is to come from monies previously authorized for telecommunication and fiber optic backbone purposes and transfers from departments set forth in budget transfer B-271. Alcohol, Drug and Mental Health Services (budget unit 541-001) - Board authorization is requested for the purchase of 13 desktop computers in the maximum amount of $32,500 to be funded by Department savings in fixed asset purchases during fiscal year 1996-97 - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. 9. Alcohol, Drug and Mental Health Services (budget unit 541-002) - Board authorization is requested for the purchase of seven desktop computers in the maximum amount of $17,500 and one HP Laserjet 5M printer with 16MB Ram upgrade in the maximum amount of $2,000 to be funded by Department savings in fixed asset purchases during fiscal year 1996-97 - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. 10. Approval of plans and specifications for drilling and development of monitoring well no. 7 at the Neal Road Landfill, County Project No. 757-97-1 - in accordance with the Corrective Action Program for the Neal Road Landfill, Public Works seeks a contractor to drill and install an additional ground water monitoring well at the Landfill. Plans and specifications have been completed for the project - action requested - APPROVE PLANS AND SPECIFICATIONS, ADOPT WAGE SCALE, AND AUTHORIZE PUBLIC WORKS TO ADVERTISE FOR BIDS. 11. District Attorney-Family Support Division - due to additional delays in the implementation of the S.A.C.S.S. System and the additional growth of the Family Support Division computer requirements, the department proposes to upgrade the current BULL Computer system. The $29,141 upgrade costs will be covered by the savings in State Investment Funds - action requested - APPROVE PURCHASE OF FIXED ASSETS. 12. General Services/Buildings and Grounds - at the June 10, 1997 Board of Supervisors meeting, the purchase of a carpet extractor(s) was approved at an estimated cost of $3,400 from savings within the contributions/other agencies (183) budget. Proposition 4 Appropriations Limit Calculation for the County of Butte and for all special districts under the control of the Board of Supervisors for fiscal year 1997-98 - action requested - ADOPT RESOLUTIONS 97-75 AND 97-76 AND AUTHORIZE THE CHAIR TO SIGN. 14. Investments Information Collector submits the Report for May, 1997 in County Statement of July 17,1996 - action INFORMATION. Report - the Treasurer-Tax Investments Information accordance with the Butte Investment Policy dated requested - ACCEPT FOR 15. Butte County Office of Education (BCOE) - BCOE is requesting Board authorization (pursuant to Government Code Section 53853) to issue a 1997-98 Tax and Revenue Anticipation Note (TRAN) to allow the various school districts to meet cash flow needs at low revenue points. This is a direct obligation of the BCOE, and the County has no fiscal requirement toward repayment - action requested - ADOPT RESOLUTION 97-77 AUTHORIZING ISSUANCE OF 1997-98 TRAM BY BUTTE COUNTY OFFICE OF EDUCATION AND AUTHORIZE THE CHAIR TO SIGN. 16. Connerly & Associates, Inc. - proposed is amendment no. 10 to the agreement (dated August 12, 1987) for the administration of Community Development Block Grant program income extending the term to June 30, 1998, and increasing the maximum compensation from $117,600 to $132,000, with the monthly fee of $1,200 remaining unchanged - action requested - APPROVE AMENDMENT N0. 10 AND AUTHORIZE THE CHAIR TO SIGN. Adoption of an ordinance amending Section 7-13 of Article II entitled "Speed Limits" of the Butte County Code establishing a five mile per hour speed limit in that area of the Thermalito Afterbay designated as a water-ski slalom course. The water-ski slalom course was so designated by the State Department of Water Resources as part of a plan of recreational development approved by the Federal Energy Regulatory Commission (FERC) - action requested - ADOPT ORDINANCE 3341 AND AUTHORIZE THE CHAIR TO SIGN. Adoption of a salary ordinance amendment adding one Social Work Supervisor II (range 1235) and six Social Worker IV/III (range 1195} positions to the Welfare-Services budget unit as part of the provision of school based child welfare social work services (Federal 50~/State 35$/Other 15~.) Resolution Amending Resolution 97-70 to Reset Public Hearing Regarding New/Incremental Service Charges in County Service Area 135, Zones 2 and 4 - action requested - ADOPT RESOLUTION 97-78 RESETTING THE PUBLIC HEARING FOR TUESDAY, AUGUST 12, 1997 AT 10:00 A.M. 20. Resolution concerning changes in maintained mileage within Butte County - in accordance with Section 2121 of the Streets and Highways Code, each year the County must certify to Caltrans by resolution the current maintained mileage of County roads, which this year is 1,368.62 miles - action requested - ADOPT RESOLUTION 97-79 AND AUTHORIZE THE CHAIR TO SIGN. 21. Approval of plans and specifications for construction of storm damage repair of French Creek Road at various locations (County Project No. 49665A-97-1) - plans and specifications have been completed for the project - action requested - APPROVE PLANS AND SPECIFICATIONS, AUTHORIZE CHAIR AND DIRECTOR TO SIGN PLANS, ADOPT WAGE SCALE, AND AUTHORIZE PUBLIC WORKS TO ADVERTISE FOR BIDS. 22. Conveyance of one foot no access strip on Eaton Road and The Esplanade to the City of Chico - to provide for traffic control and safety, the County required dedication of access rights to the public roads for the Philadelphia Square, Phase III Subdivision, located at the southeast corner of Eaton Road and The Esplanade, in North Chico. This subdivision and the adjacent streets were annexed to the City of Chico on September 4, 1996 - action requested - AUTHORIZE THE CHAIR TO SIGN GRANT DEED CONVEYING TO THE CITY OF CHICO THE ONE FOOT NO ACCESS STRIP, AND DIRECT STAFF TO RETURN THE SIGNED DEED TO ?HE CI?Y OF CHICO FOR ACCEPTANCE AND RECORDING. Page 243 June 24, 1997 June 24, 1997 97-208 23. 1997-98 Weights and Measures Petroleum Agreement No. P-56904 - proposed is an agreement with the State Department of Food and Agriculture to augment, improve and maintain a uniform and viable inspection program of establishments selling or distributing petroleum products. The agreement, commencing July 1, 1997 through June 30, 1998, reimburses the County $72 per initial inspection conducted not to exceed $5,616 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE DIRECTOR- WEIGHTS AND MEASURES TO SIGN SUBJECT TO APPROVAL OF THE AUDITOR-CONTROLLER AND COUNTY COUNSEL. 24. 1997-98 Weights and Measures Weighmaster Agreement No. W-56904 - proposed is an agreement with the State Department of Food and Agriculture to augment, improve and maintain a uniform and viable inspection program of establishments licensed as weigh masters. The agreement, commencing July 1, 1997 through June 30, 1998, reimburses the County $63 per initial inspection conducted not to exceed $1,260 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE DIRECTOR-WEIGHTS AND MEASURES TO SIGN SUBJECT TO APPROVAL OF THE AUDITOR-CONTROLLER AND COUNTY COUNSEL. 25. 1997-98 Pesticide Residue Agreement No. 97-0187 - proposed is an agreement with the State Department of Pesticide Regulation wherein the Agricultural Commissioner takes samples of specified commodities known to have been treated with a specific pesticide, which allows the State to monitor pesticides which cannot be detected by current multi-residue screening techniques, and gather needed data on high priority pesticides with possible adverse health affects. The agreement, commencing July 1, 1997 through June 30, 1998, reimburses the County $80 per sample taken not to exceed $1,600 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF THE AUDITOR-CONTROLLER AND COUNTY COUNSEL. 26. Assignment of counsel - County Counsel proposes the assignment of Penn v. Einhorn, Esq. - action requested - APPROVE ASSIGNMENT OF COUNSEL. 29. Assignment of counsel - County Counsel proposes the assignment of Edwards v. Butte County Sheriff to the law firm of Craig and Shephard - action requested - APPROVE ASSIGNMENT OF COUNSEL. 30. Assignment of counsel - County Counsel proposes the assignment of Deorle v. Barry Fretwell, Lessor - proposed is amendment no. 3 to a commercial lease covering property located at 2680 South Fifth Avenue, Suite E, Oroville currently utilized by the consolidated courts for storage of files. The current lease agreement expired June 15, 1997, and the Court wishes the lease extended for an additional six months, through December 15, 1997. The monthly rental fee remains at $480 per month during the term of the extension - action requested - APPROVE AMENDMENT N0. 3 TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10126) 32. Long Beach Genetics (LBG) - District Attorney/Family Support Division - proposed is an agreement for paternity testing services commencing July 1, 1997 through June 30, 1998 in the maximum amount of $50,000 (1997-98 Preliminary Budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL, OF COUNTY COUNSEL. X10388), using unexpended funds (approximately $41,000 from contract no. X10264), for the acquisition of file servers to finish the equipment needs for the county wide, fiber optic ~~backbone" and management of the Information Systems Department - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER, AND PURCHASE OF FIXED ASSET ITEMS. 34. Butte County Victim/Witness Program - proposed is a grant application to the State Board of Control (BOC) for 100 State funding (no County match) of joint powers money for verification of victim claims. The grant in the amount of $113,428 covers the period July 1, 1997 to June 30, 1998 - action requested - ADOPT RESOLUTION 97-80 ACCEPTING GRANT AND AUTHORIZING THE CHIEF PROBATION OFFICER TO SIGN THE BOC AGREEMENT INCLUDING ANY EXTENSIONS OR AMENDMENTS THEREOF AND AUTHORIZE THE CHAIR TO SIGN. 35. Butte County Office of Education (BCOE) - proposed is an agreement for the provision of probation officers' services in BCOE community schools. The agreement provides for two probation officers for which the County will be reimbursed, including mileage and personal safety equipment, to a maximum of $84,000 per year. The positions are part of the 1997-98 Preliminary Budget - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF THE AUDITOR-CONTROLLER AND COUNTY COUNSEL. 36. Global Health Systems - California Children's Services (CCS) Program - proposed is the renewal of an agreement for the provision of claims processing services for clients seen in the medical therapy program. The contractor will be reimbursed 15~ of the amount received by the County for Medi-Cal eligible clients. The term of the agreement is July 1, 1997 through June 30, 1998 in the maximum amount of $22,500 (State) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. Quincy Engineering, Inc. - on October 22, 1996 the Board approved an agreement with Quincy Engineering, Inc. to provide professional engineering services for the design of the Aguas Frias Road Bridge at Butte Creek. The design hydraulic study has revealed a much deeper potential scour depth than anticipated, which will require additional test borings and an expanded geotechnical investigation - action requested - APPROVE AMENDMENT TO AGREEMENT TO INCREASE THE CONSULTANT'S FEE BY $7,700 TO AN AMOUNT NOT TO EXCEED $179,080.53 (ROAD FUND.) (County No. X10382} 38. 1997-98 United States Forest Service, Lassen National Forest/Butte County Sheriff's Office- Special Enforcement Unit (Mountain/Campground Patrol) Operating and Financial Plan - proposed is an agreement wherein the Forest Service will reimburse the County $7,500 for vehicle patrol of Butte Meadows, Cherry Hill, West Branch, Philbrook Lake and Soda Springs campgrounds - action requested - APPROVE OPERATING AND FINANCIAL PLAN AND AUTHORIZE THE SHERIFF-CORONER TO SIGN AS AUTHORIZED REPRESENTATIVE. 39. California Department of Alcohol and Drug Programs - proposed is an amendment to the NNA and Drug Medi-Cal (D/MC) combined agreement (NNA 04-94 A4). The term of the agreement is being extended for one year from June 30, 1997 through June 30, 1998 in a total amount of $1,992,033 - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 40. Willow Glen Care Center - proposed is an amendment to the agreement to provide low cost, transitional and long term mental health, residential care to the elderly with dementia and other mental health conditions. Due to higher utilization of this facility it is necessary to increase the maximum amount not to exceed $15,000 (realignment). The term of the agreement remains December 1, 1996 through June 30, 1997 - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. Loumark Associates - Butte County Alcohol, Drug and Mental Health Services proposes a continuation of a lease agreement for property located at 564 Rio Lindo Avenue, Suite 103, Chico, which is used for Youth Services and Youth Services' HERE program. The term of the lease is July 1, 1997 through June 30, 1998. The monthly rental amount is $1,005 for a maximum of $12,060 (departmental 1997-98 proposed budget) - action requested - APPROVE EXTENSION TO LEASE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10568) 42. Loumark Associates - Butte County Alcohol, Drug and Mental Health Services proposes a continuation of a lease agreement for property located at 564 Rio Lindo Avenue, Suite 206, Chico, which is used for Youth Services' OCAP program and Chico Community Counseling Center. The term of the lease is July 1, 1997 through June 30, 1998. The monthly rental amount is $1, 965 for a maximum of $23, 580 (departmental 1997-98 proposed budget) - action requested - APPROVE EXTENSION TO LEASE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10569) 43. Loumark Associates - Butte County Alcohol, Drug and Mental Health Services proposes a continuation of a lease agreement for property located at 564 Rio Lindo Avenue, Suites 207/208, Chico, which is used for Youth Services' Administration and "3632" program. The term of the lease is July 1, 1997 through June 30, 1998. The monthly rental amount is $1,417.50 for a maximum of $17,010 (departmental 1997-98 proposed budget) - action requested - APPROVE EXTENSION TO LEASE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10570) 44. James R. Glover, M.D. - Butte County Alcohol, Drug and Mental Health Services proposed to renew the contract for the provision of psychiatric services and to oversee medical treatment of clients. The term of this contract is July 1, 1997 through June 30, 1998. The hourly rate is $65 ($50/8 hr. shift for on-call) for a maximum amount of $148,540 (realignment/departmental 1997-98 proposed budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. {Contract no. Lancaster, M.D. - Butte County Alcohol, Drug and Mental Health Services proposed to renew the contract for the provision of psychiatric services and to oversee medical treatment of clients. The term of this contract is July 1, 1997 through June 30, 1998. The hourly rate is $75 ($50/8 hr. shift for on-call) for a maximum amount of $157,375 (realignment/departmental 1997-98 proposed budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10572) 50. MichaelHitchko, Ph.D. - Butte County Alcohol, Drug and Mental Health Services proposed to renew the contract for the provision of psychological services to mental health clients including, but not limited to assessment, diagnosis and offering treatment. The term of this contract is July 1, 1997 through June 30, 1998. The hourly rate is $45 for a maximum amount of $38, 902 (realignment/departmental 1997-98 proposed budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10573) 51. Eileen Terran, Ph.D. - Butte County Alcohol, Drug and Mental Health Services proposed to renew the contract for the provision of psychological services to mental health clients. The term of this contract is July 1, 1997 through June 30, 1998. The hourly rate is $45 for a maximum amount of $54,000 (realignment/departmental 1997-98 proposed budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Contract no. X10574) 52. Employee Assistance Program (EAP), Inc., Fiscal Year 1996-97 - Butte County Alcohol, Drug and Mental Health Services proposes to enter into a contract with EAP, Inc., for the provision of Drug/Medi-Cal, outpatient counseling services to Butte County residents receiving SSI disability.
