COURT: APPROVE BUDGET TRANSFER B-179 On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, relief from cash shortage in the amount of $1,176 as a result of a loss that occurred as a result of a burglary of the court safe during the weekend of February 17-18, 1979 at the Oroville Justice Court was authorized; budget transfer B-179 transferring $1,176 from the reserve to miscellaneous expense in the court's budget was approved. ADOPT RESOLUTION 79-114 DESIGNATING DOCUMENT AS PROPOSED 1979-80 BUDGET AND SETTING PUBLIC HEARING DATE: SET PRICE FOR BUDGET AT $3.10 On motion of Supervisor Moseley, seconded by Supervisor Wheeler and carried, Resolution 79-114 designating document as the proposed 1979-80 budget and setting a public hearing date of July 24, 1979 at 11:00 a.m. was adopted and the Chairman authorized to sign. The price of the budget was set at $3.10. 1066 Clif Mickelson, administrative officer, stated that the county would receive information from the state relative to bail-out funds about July 20, 1979. There is a delay in getting the assessment roll computed:. The budget has $1,600,000 that has been put in there as a club to balance that budget. The $1,bD0,OD0 would have to materialize to make the budget viable. There will be increased property tax revenue 'because of the 2% or repairs or new construction and state bail-out added. If there was $400,000 allocated for the Library like last year, that would be $400,000 off the $1,600,000. This budget has.no funds for any CETA transition that would be about $700,000 more> There is no money for a cost of living for the employees. AUTHORIZE ADMINISTRATIVE OFFICER TO SIGN LETTER OF INTENT COMMENCING SERVICE JULY 1, 1979 - WORKMEN'S COMPENSATION - GATES, MC DONALD OF OAKIAND: AUTHORIZE PURCHASE OF INSURANCE THROUGH RILEY & SWEENEY RE: ALTERNATIVE #l Steve Replogle, risk management coordinator, stated that he has received three quotes for workmen's compensation coverage. AlI three quotes were identical. CSAC will not be able to get joint powers agreements before September 1 with the counties. The Board is faced with the situation of whether to buy insurance from one of the three companies and cancel when the better rate is available through CSAC- or go bare until CSAC puts their rates into effect. There is a very good possibility that they will be dealing with the same insurance company. Tf that does happen there would be no short rate insurance cancellation fee. If they do not go with the same company the county would be faced with a short rate fee. The rates will cost about $2,847 for two months. CSAC rates will be 25 to 35% lower than the quotes that were received. The limits for the insurance would begin at $250,000 and go to $2 million. The county has never had a claim that has gotten up to $200,000, Everything up to $250,000 the county would pay for. On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, the Administrative Officer was authorized to sign a letter of intent with Gates, McDonald of Oakland in an amount not to exceed $30,510 for workmen's compensations self insurnace commencing the servie July 1 pending development of a formal contract. On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, the county will purchase insurance under alternative ~~1 from Riley and Sweeney for workmen's compensation and cancel policy when CSAC insurance program takes effecto . June 26, 1979 79'- v' June 26, 1979 On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, the Administrative Officer was authorized to prepare a contract with Gates, McDonald of Oakland in an amount not to exceed $30,510 for claims administration for workmen's compensation self insurance subject to Auditor and Counsel approval. APPROVE BUDGET TRANSFERS On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, the fol}:owing budget transfers were approved: 1067 B-178 - Public Works - Road Maintenance. Establishes an appropria- tion of $385,300 from federal aid - F.A.S. funds for the permanent marking program as approved May 23, 1979 by Resolution. 79-99. 8-180 - Chico Municipal Court. Transfers $10,000 from the reserve to professional and specialized services in order to cover additional court costs because of a first degree death penalty murder case in the process. B-I81 - Gridley 3ustice Court. Transfers $275 from the reserve to professional and specialized services in order to cover mandatory expenses for court interpreters and court reparters. B-182 - CoTunty Counsel, Transfers $2,000 from professional and specialized services to office expense in order to cover the cost of litigation and copy expenses incurred in the Fossil 1 and 2 case and the numerous parties that need to be served, B-183 - Welfare Administration, Transfers $1,600 from receiving homes and together with unanticipated federal revenue in the amount of $4,200, transfers $1,b00 to ATP redemptions and $4,200 to WIN child care. The WIN child care increase is brought about by increases in enrollment and the ATP increase because of participation due to new ruleso B-184 - Sheriff. Transfers $700 from clothing and personal supplies and $2,000 from rents and leases of equipment in the enforcement budget and $300 from clothing and personal supplies and $500 from special department expense in the incarceration budget; with $3,500 going towards transportation in the incarceration budget in order to cover current and anticipated deficiencies in the jail transportation account. 8-185 - Agriculture. Transfers $9,000 from the reserve with $3,000 going towards overtime and $6,000 to professional and specialized services in order to cover unanticipated costs in the grasshopper emergency as directed by the Board on May 29, 1979; minute order 79-927 and June 5, 1979; minute order 79-932. B-186 - Appropriation for contingencies. Establishes an additional appropriation of $299,416 in the general fund reserve as a result of SB 154 block grant revenue to be made available to Butte County i.n accordance with Goverment Code Section 29130.5. Information and confirmation of the county's eligibility has come from the State Controller's office after audit and redefinition of the county's "General Fund Reserve" balance as of July 1, 1978. B-187 - Probation. This is an $11,983 transfer within various AB 90 funded projects to cover current and projected deficits in accordance with a modification request approved by the Board om April 24, 1979. The purpose of this transfer is to establish an appropriation to fully fund the contract' award for Chapmantown improvements from the City of Chico ($16,000) and Housing and ConDnunity Development participation ($49,629) to cover the contract award to James E. Byrne in the amount of $291,329 for construction of Chapmantown improvements. B-189 - Purchasing. Transfers $25 from publications and legal notices to memberships. in order to return the Purchasing membership account to current status as a budget deficiency in 1977-78 caused 1978 dues to be paid from the 1978-79 funds. 8-190 Civil Disaster. Transfers $30 from transportation and travel to special department expense in order to cover necessary blood bank supplies in Oroville for the remainder of the fiscal year. B-191 - Central Services - Motor Pool. Transfers $600 from maintenance of equipment to rents and leases of equipment to cover the cost of rental vehicles for the balance of the fiscal year. 8-192 - Central Services - Stores. Transfers $50 from small tools and instruments and $90 from transportation and travel; with $140 going toward office expense in order to cover a deficiency caused by printing of new stores requisitions and to cover anticipated expenditures for the remainder of the-fiscal year. B-193 - Central Services - Communications. Transfers $2,000 from regular salaries to maintenance of equipment in order to provide an additional appropriation to maintain the. St. John Mountain repeater site for the balance of the fiscal year and also transfers $12 from professional and specialized services to rents and leases of equipment in order to` cover the deficiency caused by the rental rate increase for a postage meter. B-194 - Sheriff - Incarceration. Transfers $25 from special department expense to small tools and instruments in order to cover a budget deficiency brought about by the purchase of miscellaneous equipment br the Sheriff's garden preparation. B-195 - Mental Health General Services. Transfers $1,000 from regular salaries to maintenance of structures and grounds in order to cover the cost of needed revisions to the locking mechanism at the new mental health facility in Chico. B-196 - Juvenile Hall. Transfers $8,670 from regular salaries; with $2,850 going towards extra help, $1,320 to food, $100 to office expense and $4,400 to professional and specialized services in order to cover current and projected deficiencies for the remainder of the fiscal year in various accounts. B-197 - Street ii~htine maintenance districts. Transfers $2,926 from the unneeded Lake Madrone bailout funds; with $407.75 for Vista Del Cerro, $169.75 to Crestwood, $594.75 to Lindo Gardens No. 3, $93.75 to Joshua Tree, $650 to Shasta Estates, $320 .to Joshua Tree No. 2, $600 to Brentwood and $90 to Meadow Estates Subdivisions. This transfer provides an appropriation for utility charges for the various street lighting districts in accordance with action taken by the Board of Supervisors on December 5, 1978; minute order 78-249. B-199 - County Service Area ~k37 (Gridley Ambulance). Transfers $5,804 from the balance of bailout funds from Lake Madrone Water District to provide an increased appropriation for the Gridley-Biggs ambulance service. This is in follow-up to the Board's hearing on bailout funds of December '5, 1978. i7AIVE VARIANCE FEES - CHICO HOUSING IMPROVEMENT PROGRAM CHIP On motion of Supervisor Dolan, seconded by Supervisor Wheeler snd carried, variance fees for CHIP of $75 per parcel for three parcels in the Ei Medio Area: AP 35-OS-2-7, AP 35-09-3-6, and AP 35-12-1-6 were waived. 9PPROVE RURAL REHABILITATION PROGRAM AMENDMENT MODTFTCATTON - EOC On motion of Supervisor Moseley, seconded by Supervisor Dolan snd carried, the Rural Rehabilitation Program amendment modification to offer the program county-wide was approved and the Chairman authorized to sign. APPROVE HEAD START TRAINING AND TECHNICAL ASSISTANCE PROGRAM PROPOSAL FOR iUBMISSION TO HEW On motion of Supervisor Moseley, seconded by Supervisor Wheeler snd carried, the Head Start Training and Technical Assistance Program ~xoposal to provide training and technical assistance for Head Start's staff and parents in two parts totaling $3,970 with funding to be provided as follows: $1,361 for travel, $$02 for supplies, $1,657 for consultant and $150 for space costs for submission to HEW was approved and the chairman authorized to signo APPROVE RURAL SENIOR SERVICES PROJECT PROPOSAL SUBMISSION TO CALIFORNIA 3EPARTMENT ON AGING - EOC On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, the Rural Senior Services Project proposal to submit a funding -equest to the California Department on Aging for continuation of the Rural ienior Services Project in the amount of $86,909 (federal, $65,182 and ion-federal, $21,727) that is to operate from October 1, 1979 through tune 30, 1980 and provides for several changes in position classification and wages was approved and the Chairman authorized to sign; and the job acriptions and salary schedule were approved. APPROVE bEPARTMENT OF ENERGY CONTRACT AMENDMENT - EOC On motion of Supervisor Moseley, seconded by Supervisor Dolan and carried, the Department of Energy contract amendment that would allow `or up to 30% of funds originally allocated for weatherization materials to >e used for transportation, tools and equipment and on-sight supervision; with the contract to be extended from June 30 to August 14, 1979; with income ;uidelines raised from 100% to 125% of the poverty level; and the maximum allowable expenditure per house to be raised from $400 to $800 was approved and the Chairman authorized to sign. 1073 ~ DENY SUBMISSION _OF_ COMMUNI_TY FOOA AND NUTRITION_ PROGRl1M - EOC Supervisor Wheeler stated that she could not support the :ommunity Food and Nutrition Program proposal because there is_;aF:>good-deal ~f money lost in administrative costs. G R ~ ~ ~ R 3ames McNaughton, EOC director, stated that Mateo Munzo presented a different proposal to the executive committees Both components of the proposal be considered are being done in some fashion now. They have been using basic grant funds to do some of the program. This would be for expansion of the program. These funds are similar to CETA Title VT project funds. The Concilio is doing some of what is taked about now. Mr. McNaughton set out the costs for personnel at this time. The project director would receive $10,000 the specialist, $8,000, and a clercial worker at one-half time for $3,000 with a total in salaries including fringe benefits of $41,000 out of the $66,000 grant. The'Concilio is staffing a project at the present time. The remainder of the money would be used for equipment and operating costso The Concilio is talking about eveloping a consumer resources and training center and buyer cooperatives. Both of these da not involve a great deal of equipment cost. This addressed primarily the migrant type population. Chairman Lemke stated that he did not know why government has to be involved in this type of program. One-half of the funds are going to an agency that is funded by other projects. Mro McNaughton stated that this would be for one year. They would be establishing food buying groups and getting out of the program. This would help the .gleaner grogram self sufficient. They are not getting low income participation at the present time. The low income people are not aware of the grograms. He did not feel this was a duplication of programs already established but an expansion of the programs. Supervisor Dolan felt that it was appropriate that EOC attempt a ,one-year demonstration project to see if the programs can be expanded. On motion of Supervisor Wheeler, seconded by Supervisor Moseley and carried, submission of the Community Food and Nutrition Program submitted by EOC was denied, AYES: Supervisors Moseley, Wheeler and Chairman Lemke. APPROVE VARIANCE RENEWAL - EDWARD HARTSEL On motion of Supervisor Moseley, seconded by Supervisor Wheeler and carried, the renewal of variance to Sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobile home on AP 65-18-27, Woodward Avenue, Magalia for Edward Hartsel, zoning: RT-1A was approved for a period of one year. APPROVE PUBLIC WORKS ITEMS On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, the following Public Works items were approved; 1. Approved authorization to return fire hydrant development fees with interest i£ developer has subsequently installed the hydrant. 2. Authorized preliminary engineering for Lassen Avenue off-ramps. 3. Approved Amendment No. 4, Oro Express contract which will raise the City of Oroville's allocation from $40,000 to $55,000 and the Chairman authorized to sign. 4. Approve a one-year. contract extension for the Gridley Flyer in the amount of $13,093 (county - $3,093 and city - $10,000) and the Chairman authorized to sign. 5. Adopted Resolution 79-115 for maintenance of traffic. signals was adopted and the Chairman authorized to sign; the Auditor authorized to issue warrant in the amount of $3,000 to deposit with Caltrans. AUTHORIZE PUBLIC WORKS TO APPLY FOR FUNDING AND PERFORM NECESSARY ENGINEERING WORK - ELIMINATION OF BAGGETT - PALERMO ROAR CROSSING - WESTERN PACIFIC MAINLINE (WPRR 4-200.6) On motion of Supervisor Moseley, seconded by Supervisor Wheeler and carried, Public Works was authorized to apply for funding and to perform necessary engineering work for elimination of Baggett - Palermo Road crossing fox the Western Pacific mainline (WPRR 4-200,6), REPORT ON BID OPENING - CLARK ROAD ASSESSMENT DISTRICT N0. 2 Clay Castleberry, public works director, reported on the bid opening for Clark Road Assessment District No. 2e Hayward Construction, Inc. of Redding was the low bidder. The bid award was continued to July 10, 1979. 1078 DISCUSSION: UNMET TRANSIT NEEDS REPORT AND ALTERNATIVES Discussion of the unmet transit needs report and alternatives held at this time. The data in the study came from four different sources. The census data sets out certain age groups or income groups that would be more or less dependent on transit facilities. They also used the information from the 500 q,uestdonnaixressample that was sent out. There is a transit need in Butte Countyo In the Chico area the sample indicates that a high number of people are satisifed. The people who felt that part of the needs were met was about 5 to 10% of those who answered. There was about one-half percent of those that did not feel that the needs were met. There was a desire for a transit need and better bike paths. There was a greater desire for bike paths than transit needs. The other sources for the report were the public hearings held and the correspondence received. Mr. Castleberry stated that he has sketched an intercity system. There are five alternative systems to be considered. The cities of Gridley and Biggs have endorced the system. The City of Oroville have stated that they are satisfi~d_,with the continuance of the Clipper service. He hoped they would reconsider. At this point all of the cities want to continue the Clipper services. He felt that two other systems might be viable to start. This should be only on a trial basis to determine of they will work. He stated that he would be talking to BCAG tomorrow on the study. It was felt that there was no problem with the intercity system. 1079 Mr. Castleberry stated that the Legislature is considering~a new bill that will bring $133,000 of additional money to BCAG for public transportation only. ADDITIONAL MATTERS PRESENTED BY PUBLIC WORKS Clay Castleberry, public works director, stated that he had drafted a letter for discussion at MAC to answer their letter on drainage. Mr. Castleberry stated that he had discussed the mosquitos with PG&E. There is more water in the ditches than in all the transformer boxes in California. He did not think it was of major consequence.. Earl Nelson, environmental review director, set out the background of the negative declaration. The checklist indicates that there would be no significant effects as a result from the implementation of the drainage plan. This project consists of 375 acres in northwest Chico. It is.a basic collection system for storm drainage. The pipe goes from 21 inches to 84 inches totaling 16,730 lineal feet. The outfall is at the west end. It parallels the railroad right-of-way along the east side and goes into Lindo Channel. The main areas of impact relate to excavation of trenches and back filling, drainage instead of percolation in the soil and possible pollution will be put into the systemo It is recommended that if archaeolog- ical sites are discovered that an archaeologist be contacted. Of the 375 acres there is only 160 acres that remains to be developed. The balance is presently in urban use, primarily in single family use. He recommended a negative declaration. Clay Castleberry, public works director, set out the background of the drainage plan. He hoped that the Board would consider adopting the plan as a guide. It has a development fee schedule which would allow installation of facilities some time down the way. There are some 4,000 to 6,000 plus acres depending on the land use proposed. APPEARANCE: MARY FURDES Mrs. Furdes stated that she was opposed to the auto repair shop going in across the street from her home. This is on Larkin Road. She submitted a petition of property owners opposed to the auto repair shop. This business will be using acetylene tanks and torches. This will effect their property values. She requested that the Board interim zone the area. This will be an auto body fender and repair shop. Bettye Blair, planning director, stated that there would only be a use permit required if there will be painting done. Auto repair shops are not required to get a use permit. Mrs. Furdes stated that this gentlemen bought an old gas station and is putting it up five feet from the property line. This would. be unsightly in the neighborhood. PUBLIC HEARING - INTENTION TO RENAME ROADS TN THE GRTDLEY-DURHAM ADDRESS AREA The public hearing on the intention to rename roads in the Gridley-Durham address area was held as advertised. Clay Castleberry, public works director, stated that several years ago a petition was brought to the Board by the emergency medical and fire people saying the county should straighten out the street names and numbering system fox the county. The county hired a consultant to do a report on thiso This report would have required every street number in the county to be changed. The Board backed a different system. The county was divided up-into address areas. Highway 99 was the point of number to the west and to the east from that point. Mr. Castleberry stated that the community had given some of the proposed name changes. There are some that should be discussed separately. Supervisor Wheeler stated that there are several people who would like to speak regarding the proposed name changes. The Postmaster has concerns as some.of the changes cross postal zones.
