PubJ.a.c Works request authorization for a minor safety project on Glark
Road north of Bi17.e. Maps were available. Project...is a minor realignment of a
bad curve and--widening for a left-turn lane to be .paid fox' by an adjacent developer.
Should problems arise with the property owner on the Hupp=Coutolenc Road in the
future, the Department would-ask the Board to refund this project. It is proposed
to have all work done by renting private contractor's equipment in the Paradise area.
Mr. Castleberry stated that -there was a new mabil.e home development in that area,
the developer was been asked to assist in these costs. $2,000 will be contributed
by the developer for.: the left turn lanes. Project discussed.
On motion of Supervisor-Maxon, seconded by Supervisor Madigan and
unanimously carried, the safety pr-oject for Clarl~_$oad, north of Bille was
approved anal trar.~s£er of funds in the amount of $5,000 from the Hupp-Coutolenc
Road to this safety project on the Clark Raad was authorized.

contract for addi.Lional dirt removal was approved.
71-1351 DISCUSSION: MATTERS PRESENTED BY DIRECTOR OF YUBLiC WORKS
Clay Castleberry, Director of Public Works, stated that at the July
Highway Commission meeting discussion will be held on the Oroville Dam Highway.
The letter from Wm. Warren, District Manager, stated that consideration was being
given to the deletion of the Oro-Dam-Olive Highway from the State Highway system.
Mr. Castleberry explained this communication. Mr, Castleberry stated he takes
exception to this9 he would like to write a letter to the State stating that this
highway was, taken .into the system because it goes to a recreational area. Mr.
Castleberry was requested co convey the Board`s thoughts in this matter.
Mr. Castleberry. stated that the Board had received another communication
about Lake Madrone, This letter referred to County Counsel. Mr, Castleberry
said that they were trying to work out~some solution to this matter; hopefully
the matter will be resolved.
Mr. Castleberry said the second 60 floats at Lime Saddle are almost
full now. They are still working on the roof to the floats. Mr. Castleberry
is meetir~.g with the operators at Lime Saddle this week to discuss the operation
of the mar.'ina, Chairman Reynolds s"rated that Pentz Road, gaing to Lime Saddle,
is going to have to be considered by the State.
71-1352 LETTER 'TO SENT TO MISS BUTTE COUNTY': THIRD RUNNER'f3P IN-.STATE PAGEANT
Chairman Reynolds stated that he had received a memo from Dave Davis
requesting that the Board send a letter saluting Miss Butte County (Miss Dennis Jones)
.for placing third runner-up in the State Pageant last Saturday night. Mr. Nickelson
was requested to write the letter and the Board members will sign. and have the
letter' sen~ to Miss Jones.
71-1352 REPORT BY WELFARE DIRECTOR: HR-1, "FAMILY ASSISTANCE PLAN"
Ed Robinson, Welfare Director, reported to the board concerning HR-i;
this will supplement the written report on the "family assistance plan" submitted to
the Board under' his memo dated June 18,.1971. He stated that this involved the
meeting held in San Francisco. He stated that this would completely revise the
Welfare Plan. Mr. Robinson explained the plan; setting forth the two phases of the
plan.
Mr. Robinson said the meeting in San Francisco lasted ail day. The
Welfare Rights groups gave the most opposition. The plan would increase the
current costs of Welfare; the current expenditures are increasing daily.
Mr. Robinson explained how the costs would increase under this new plan.
Supervisor Maxon stated that a letter or telegram should be sent to the Senators
and to the President opposing this Nixon program. Mr. Robinson said they have
more or less tabled the Welfare plans in the State until the Nixon Welfare Reform
Package has been approved,

71-1353 APPEARANCESo SUPPORTING APPBAL OP S. A. PICIiBTT MOBILE HOME•
D 0 Letters were read from.Mr. & Mrs. C.-M. Allen, Sr., Mrs.- Louise G.
~~ 3• ~emecek and Mrs. Helynn M. Hilke concerning the mobile home placed by Mr. Pickett
on his property in the Thermalito area. This property is zoned an A-R District.
1. Mr. Al Appleman,Thermalito, said he wanted to speak about zoning and
Mr,.Pickett. He apologized and retracted his statements that. were published in
the Chico enterprise recently. Mr. Appleman gave his views on zoning in this County.
He read a prepared statement concerning the background of zoning in this county.
He said the first thing that should be done is to get this man out of jail (Mr.
Pickett). He said the County should then appoint a knowledgeable mobile home owners
committee to advise the County on mobile home problems.
Chairman Reynolds questioned, Mr. Appleman concerning the statements
made in the letter to the Editor. Chairman Reynolds asked him why he accepted
County jobs, feeling as he does about the County officials. Mr. Appleman said
he was in, the printing business and it is a competitive business.
Supervisor McRillop told,Mr. Appleman that any zoning that the County
has done has been at the request of the people and it has been done legitimately.
Public Hearings have been held in the democratic manner. Mr. Appleman said he
was not questioning the fact that the Board was-doing this zoning .legally.
Supervisor McKillop said that as long as the County has the ordinances on the book,
the County has to prosecute Mr..Pickett if he does not obey these laws.
Time spent discussing the violation of Mr. Pickett. Supervisor-Maxon
said there should be a hardship variance in these A-R zones where a variance could be
granted to place a mobile home on property.
2. Mr's. Mabel Pickett appeared at this time. -She presented some of the facts
concerning this case, -She had a petition.signed by her neighbors requesting
R-l: zoning. She had affa.davits signed by 14 people stating that this mobile home
was a pre-existing use. She stated that she had requested the Court to appeal
their decision, She said that there was no transcript made of the court
proceedings. County Couasel said there is never a court reporter at the Justice
Court trials unless requested by the defendant, There are tapes from the Planning
Commission meetings and.Mr. Pickett admitted he was out of conformity and knew
he was doing wrong. a
Jim hawson, Planning Director, explained how rezoning requests are handled,
He said that Mr. Pickett never completed his application.
Mrs. Pickett said she was requesting an interim zoning ,ordinance to be
adopted and they will then apply fox' permanent zoning. Supervisor Maxon suggested
that the Board .establish an,interim zoning today. Mr. Lawson-said the Board
could establish interim zoning but it would place the Planning Commission in a
very awkward position.
It was moved by Supervisor Maxon that Ordinance 1178, being an interim

The Planning Commission should handle these zoning matters, ,The adoption of this
ordinance would not alter the present vioiations< County Counsel stated that
he chid not believe the Board could legally adopt such a motion, He read the Code
regulating these matters. He said the, law stares that this ordinance could not
be legally adopted at this time. He said he did not see how it would be re~.evant
to Mr, Pickett to adopt this motion. He said the Court had suspended his
sen.tenoe to allow him to get into conformity. Mr.Plckett said 47No" he was not
going to.move his trailer. Sentence has not been imposed as yet on the septic
tank violation.. Mr, Blackstock said the proposed ordinance could not be legally
adopted under the provisions of the Government Code.
Motion. withdrawn at this time.
Supervisor McKillop said 1~¢rs. Pickett could file her application for
rezoning, but that the application should .include all the areas to be affected.
Mx. Blackstock said Mrs> Pickett could .file a notice of appeal in this matter.
Mr, Weltner had informed Mr. Pritchard, zoning inspector., that Mr. Pickett had
waived his right_ of appeal. Mr, Blackstock said he would look up the law in this
matter of appeal, Supervisor Maxon x'equested that Mr.-Blackstock check this matter
immediately.

71-1354 APPEe9RANCE OF`MR. DON~CARROLL
Mr. Don .Carroll asked :if the County was interested in bringing .more money
into this County, The Board said if he meant industry they were interested in bringing
it into the County. He asked if mobile homes were allowed .in the County. Supervisor
McKillop told him the Board wanted the mobile home industry. Mr. Carroll asked
if 'the Board would allow the industry to come in and waive the taxes. He was told
that it is illegal for industries to come in without. paying taxes.
Mr. Carroll said he felt that the whole county shnuld be studied and
that rezon%.ng should be done in many places,
No action taken.
71-1355 APPEARANCE OF MR.. DON.BROWN. BRERETl~N. WAY', OROVILLE
Mr. Don Brown, Brereton. Ways Oroville, read a statement that set forth
that the Picketts should be allowed to-live in their mobile home. He-said people
were concerned about the ruling that governs this type home. He said this was a
vi.olatf.on of the peoples rights. He had a petition requesting this Board to
review and repeal all rulings and/or ordinances that attempt to restrict personal
freedoms and rights of the citizenry. Petition filed with the Clerk.
71-1356 APPEARANCE OF LOUIS GAMEN2TND, CHICOo WELFARB RECIPIENTS
Louis Camenzind, Chico, said he would .like to.make a suggestion. He
said that a1:1 able bodied Welfare recipients should be made to work and that the
residency requirements should be put back into. effect.
71-1357 GRANT HEARI:NGa REQUEST BY MR, SPEGKERT TO BE REMOVED, FROM AGRICULTURE PRESERVE
AGREEM$NT
Aan Blackstock, County Counsel, explained the letter from attorneys for
Mr. Speckert in which they request that a hearing be held to enable him to ¢
cancel the land conservation agreement with the County. Mr. Blackstock stated his

office has reviewed the letter. He said the Board should now determine whether-they
will seta hearing on the request. He said the letter does not 'state any facts
to base a hearing upon.
Mr. henha.rd, attorney for Mr. Speckert, stated he was quite surprised by
Mr. Blackstock°s remarks. He feels that. he gave facts for the request for the
hearing. He said there are about 290 acres involved; the valuation wasabout $100
per acre prior to the time that it was-placed within the agricultural preserve.
Taxes have now gone up 70f~; He said it is impossible to hold this property under
the Agriculture Preserve at the current assessed value. No one had the vaguest
idea that the taxes-would double. He said they can prove that this land cannot
be held for agricultural purposes.
Mr, Blackstock explained how the cancellation could be handled. The
Board can can~_el the contract after they have found that the cancellation-is in
the public's interest. Chairman Reynolds explained his feelings in this matter.
Mr, Zenhard said this was to be a tax incen"rive program. everyone was suppose to benefit
under this program.

+On motion of Supervisor Maxon, seconded by Supervisor Gilman and
unanimously carried, a hearing was granted to Mr. Speckert for Tuesday, July 20th
1971-at 11:00 a.m. ore his request to be relieved of the Agreement under the
Agriculture-Preserve.
:~'he Clerk was requested to send out notices of said hearing; Planning
Department and County Counsel were requested to assist in the preparation of the
notices and in determining who should receive the notices.

Dr. 3ailey appeased to speak to the Board regarding the cost Lo the
county of use of non-formulary drugs at the County Hospital. Dr. Bailey explained
the problem of payment of these drugs; he said the Board should receive an answep
from County Counse"l. The charges have 'been seat to the County and presented to the
Auditor for• payment. Dr. Bailey explained how these charges are made. The
patient agrees to pav £or *h.ese non~formular_y drugs, signs a receipt stating he will
pay and then the patient does not pay, These bi17.s should be sent to the patient
and then if they do not pay the bills should be turned over to the credit bureau.
Dr. Bailey ,stated he would like to know the Board's feelings ih'this martere Some of
the dr'-igs are prescribed by outside doctors,
Time spent discussing how-this problem should be handled, Chairman
Reynolds said that Dr, Bailey should advise the outside doctors that the County will
not pay for these drugs and they should not prescribed theme Dr. Bailey said the
hospital should not allow these patients to charge these non-formulary~d rugs..
County Counsel was requested to get an answer in writing to Dr. Bailey
next week, Mr. Blackstock explained the problems involved in this matter.
Mr. Blackstock will review the matter and present his findings to the hospital and
to the Board members.

71-13'9 DISCTJSSIONa DIVISION OF FORESTRY°FIRE HAZARDS NOW:EXISTING
Jer.ry•Letson, Division of Fores"try, and Mr. Mackessy of the Agriculture
Department were present to discuss fire hazards now existing due to the heavy growth
of grasses and weeds caused by the wet spring. Mr. Letson said this was a weed
abatement program that was discussed last year. Mr. Letson explained the background
of this matter.' and the problems involved. Mr. Letson stated it would be quite
expensive for the county to go out and clean. up these lots and then bill the
owners. Supervisor Gilman said he did not see how the County could subsidize
any more services. He stated that in some instances, a simple letter co the
property owner might get action.
Mr. Mackessy explained how the property owners were contacted. .Last year
they did not have the man. power and the Board stated at that time that this was a
one shot operati.on.. $.500 was given to the Agriculture Department last year to handle
"this matter. Supervisor Gilman presented a letter to the Board members concerning
this matter. Supervisor Gilman asked who he should refer this letter to.
'lime. spent discussing the problem and how it should be handled. It was
stated that the work could be done by the county and chargedto the individual
property owner. The county could contract for this work. It was felt that the

Chairman Reynolds asked if there-was any legal action this Board could take
to check the formation of the proposed reclamation district being established by
G1enn.County. He stated that there was to be a meeting in Glenn County in July.
He said that there were people opposed to this formation. Chairman Reynolds said,
he hoped that this Board would a1`low a member of County Counsel's staff to attend
the hearing in July. Dan Blackstock, County-Counsel, said if he attended the meet~.ng,
he would want to be instructed as to the Board°s position .in the matter. Mr. Blackstock
asked if the Board was for the District or. opposed to the District. He asked what
area the Board would want him to cover, and what position would th~Board want him to
take. He was told to utilize all information that is available,
-Supervisor Gilman asked about the area outside the proposed district.
Chairman Reynolds requested that County Counsel research the matter. There are
many unanswered questions at this time. All avenues should be covered in this
matter, Chairman Reynolds said he wanted to be on record that he is not in favor
of the formation; he said he could not support this formation until it is clearer
and more defined.

Supervisor Gilman reported on the Sacramento Va11eg Air Pollution Coordinating
Council meeting held in Quincy last Friday. They discussed the money budgeted by
the counties for air pollution matters. No action necessary.

a motion had been made to reactivate the Fair revolving fund, Bi11 LaTarence,

funding said budget with an additioa.al. S2550 and the. micro-film machine was taken
from the County Clerk's Office and placed under Contra L Services, the proposed
money.in County Clerk°s Budget for extra help-was left as proposed.
Count~_Counsel's Budget
Dan Blackstock, County Counsel, said that there has been some concern
expressed for the placing of a fourth actor'ney_in the County Counsel's office.
Mr. Blackstock went over the past. his~ary of the staffing of this office and
explained the request for the additional attorney. Mr. Blackstock explained the
services that hi.s office supplies to the schools, to the TElection~Department,
Assessment AppeaYs Commission, and the many departments throughout the county.
He said the most tremendous growth was in the Butte County Junior College District;
they take a tremendous amount of time from County Couhsel3s office. Mr. Blackstock
said there were sa man.y distriWts and so many requests for opinions that his office
had a backlog of work that they just have not been able to handle. The work problems
in *_his office set o~;t and discussed, Mr. Blackstack stated that the total amount
of work is such that he feels that it is mandatary at this time *_hat they take on
another deguty.
Supervisor Gilman asked where this man would be housed if this request was
approved, Mr. Micke.lson said the proposal was to place this additional man out at the
Superintendea*_ of Schools Office. This would be a temporary thing until the other
offices are available.
Time spent discussing the request. Supervisor McKillop said he felt there
should be secretaz•ial he"bp placed in this budget.
Supervisor Madigan brought up the matter of the individual Board members
reques?~ing opinions Pram Cour;cy Counsel, The board member should be specific
about the requested opinian. 3t was suggested that County Counsel keep a table
of the opinions requested to see wha~ the opinions are related to and the type
opinion being requested. Mr. Blackstock said he would keep a list of opinions
requested and who requested the opinion, the Board will look at the list in several
months and then make a detez•mination in the matter. Supervisor McKillop felt
the request for opinion from County Co~:nsel should come before the Board first.
A list will be kept of all written opir!iora and the time spent preparing said
opinion. Mr. Blackstock said he would request that *_hese opinions be requested
in writing.

unanimously carried, an.additianal attorney was approved for County Counsel's office,
adding an attorney at an additianal coat of $900 Through $1200 per month, attorney

Building. Department
Discussed the matter of an additional building inspector. It was stated
that Mr, Harelson has been i11 for some time. He is building and subdivision
inspector. Mr. Nickelson explained the proposal in this matter. Time spent
discussing the services of an inspector. Mr. Nickelson explained the matter of
reclassification of Mr. Harelson. .Position of inspector discussed. The number
of building .inspection positions have not been filed. .Problem of building
inspectors set out and discussed. No action taken at this time.
Probation Budget
On motion of Supervisor Reynolds, seconded by Supervisor Gilman and
unanimously carried, the electric typewriter proposed for the probation department
was deleted, but approved the adding of dictating equipment, with no change in
the amount of funds proposed,

Appropriation for. Contingencies Budget
Budget discussed. It was stated that Mr. Nickelson and-Herb-Seely, County
Auditor, have had many discussions on this budget. Mr, Seely feels that there should
be a $600,000 contingency. Mr, Nickelson said that his basic worry was the tax rate
that would be imposed on the taxpayer. .Mr. Seely said that as of 2s00,p.m. today,
the projected tax rate would be 3.16. Mr. Nickelson said that with the $600,000
placed in contingenciesy would be talking about.a >42 increase in the tax rate.
Mr. Nickelson said he had been talking about x•$450,000 reserve. $150.,000
should also be put ira this budget for the hospital. They also placed $15,560 surplus
in-.Fish & Came in the Con.tingen.cies. These amounts are in addition to Road Fund Cont.
$600,000 was placed in this 'budget for reserve in the general fund.
This reserve will be reflected in the resolution that will be adopted by this Board
on Tuesday, July 13, 1971, N'o action taken at this-time,

Mr. Nickelson and Mr. Hockett brought the Board up to date, stating that
'last year the Board voted to contribute $2,000 to Comprehensive Health Planning and
that Comprehensive Health Planning was asking for $2,000 to $4,000 this year.
'This amount comes out of the Cour_ty Hospital-budget, but it has nct been included
in the Hospital budget this•year. Discussion followed regarding the merits of
comprehensive planning.
On motion of Supervisor Madigan, seconded by; Supervisor Maxon and
unanimously carried, the Board voted not to contribute to Comprehensive Health
Planning this year.
Salary Adiustments
On.motion of Supervisor Maxon, seconded by Supervisor Gilman, and carried,
the Superior Court•Secretary/Jury~Commissioner was reclassified from Range 14<5
($571m692) to Range I7.5 ($660~80I).

In regard to the Agricultural Commissioner/Air Pollution..Control Officer,
Supervisor Gilman stated that in the fueure we may not be able to have the same
individual perform both functions. Mr. Nickelson advised that the Board could .leave
the Agricultural Commissioner at the same step and range but pay the Air Pollution
Control Officer $100 per month mox•e. On the motion of Chairman Reynolds, seconded
by. Supervisor Maxon, and unanimously carried, the Air Pollution Control Officer
was given a $100~awmoath raise.

In. the area of the Personnel Officer, Supervisor Maxon asked what progress
was being made i.n up-dating testso Discussion followed x'egarding the workload in the
Personnel Department. Supervisor McK.illop made a moti.on.to raise the Personnel
Officer from R. 25.5 ($973-$1183) to R. 27.5 ($1074-$1805). Motion failed for lack
of a:second. On motion of Super'vi.scr Gilman., seconded by. Supervisor Maxon and
unanimously carried, the Personnel Officer was r.eclassi.fied to Personnel Director

thx'ee Welfare Service Aid positions were reclassified from R. 7.0 ($395-$480) to
Eligibility Worker I positions at R 11.0 ($480-5584),
On motion of Supervisox`Maxon, secen.ded by Supervisor Madigan, and
unanimously carried, a reclassi..ficatien of Accounting 'Technician, R 14.0 {$556-$676) to
Accounting Control Clerk, R 12.5 ($517-$628) i.n the Auditor's Office was approved.
On,moti.on of Supervisor Maxon, secanded by Supervisor Gilman, and
unanimously carried;. the Oro~rille Constable's salary of $6,874 was rescinded and
rep Laced with $1,200 per year, this situation. to be reversed when the Constable
returns full time to perform the services required of that officeo
On motion of Supervisor McKillop, seconded by Supervisor Maxon, and
unanimously carried, the auditor was authorized to a.ilocate $33,482 of Data
Processing increases throughout the several department budgets in order to cover
the increases in the Data Processing Budget,
At the present time there is a controversy between Public Works and
Planning departments about-where to place the posi.ti.on of Zoning Inspector. There
is a request for either a full-time or half-time zoning inspector.. On,motion of
Supervisor McRillop, seconded by Chairman Reynolds,-and unanimously carried, the
full-time position of Zoning Inspector at R, 18.5 ($692-5842) was p"laced in the
Planning Department°s budget,-and chi.s budget was increased $8520.
Public Defender Budget
Mr. Micke3.son recommended to the Board that they approve the funding.of
the public defender contract for $150,000 as stated in the contract and that next
year all interested attorneys and the Bar Association will be sent a letter
inviting them to quote costs for providing the service the following year,
Supervisor Maxon stated that there is still a great deal of information
that the-Board does not have, He again suggested conferring with the Court on
this matter.
Mr. Nickelson stated that under the present Court appointed attorney
system, the costs will run .$175;000 to $250,000 Herr*_ yeax'< He advised that next
_year, there would be a 40% increase over this year's figures.
Upon concern. from Supervisor Maxon regardiOg the performance of the
contractees, Mr. Mick.el.soa stated that the Superior ourt can invalidate this contract,
Mro Blackstock, County Counsel, stated that the contract.can be cancelled on a
ten-day notice if the Court withdraws the appointment.

Upon question from'-Supervisor Madigan. regarding the legality of. the contract,
Mro Blacks*_•ock stated that 9 or 10 other counties in the-State are operating under
this system and the Board has the power to enter into such an agreement if it so
wishes. He cited counties that have contracts similar to this contract.
On. motion of Chairman Reyno'lds., seconded by Supervisor Mc1Li11op and
carrYed, the funding of the public defender contract for 5150,000 was approved,
the 5150,000 to be taken out of the various court budgets within the county,
