Committee sends notification that the formation of County Service Area No. 55, for fire pro#ectian in the northeast area of Butte County will not have significant effect on the environment and a negative declare#ion was filed on June 23, 1975. Informotion. Local Agency Formation Commission. The Commission sends certificate of filing ~ ~ S~ ~ format on~ ~~sed Formation of County Service Area No. 55. Drainage District No. One of Butte County. District sends notice that the Board yts~ of trustees goes on record as opposing the formation of a county resources ~ d!~ conservation district, within its boundaries and requests to be excluded if such a district is formed. County Counsel stated he had received a call from Mr. Henderson and he would like to talk to districts. Board approved suggestion. Assemblyman Pauline L. ,Davis. Receipt of Board communication on apposition .~ to Senate Bill 423 is acknowledged and it is further stated that the measure ~ Q d ~ Z failed to get out of the Senate Commi#tee on Public Utilities, Transit and Energy on June l7th. Letters in Protest of street Home changes in Paradise. Numerous letters and petitions were received in opposi#ion to the change of street names in Paradise. To be placed in file for discussion at time the matter is seF far,hearing. Chairman Ladd requested that Scott Tandy study eacl~~ of the letters and report back in the Board on the matter. Telegram from William J. Haltigan, Asst. Regional Director for Manpower . He reports on the status of the PSl~ enrollment levels, and of the funds allocated to this County. Jim Rackerby summarized the lengthy telegram. This gives them authority to borrow from Title VI to meet payroll of Title I!. 1t else sets out the matter of the 20 PEP jobs that the State of Calif. has in their employment. As of today, these positions have been terminated, unless the County were to execute a contract with the State ~a fund the positions, Mr. Rackerby recommendesd that as long as the State has made the layoffs, #hat this be the first phase of the layoffs. Board approved the suggestion to follow the course of action recommended ly Mr. RQckerby. Suggested that Mr. Rackerby study the matter of the CCCJ summer plan. lV1r. Raclcerby wi I i report back to the Board an this matter. 75-1119 D1SCL#SSION: PROTESTS OF PDSSIBLI: ROAD NAME CHANG>"S Supervisor Cameron state e a receive many teie~hone-calls and letters protesting the possible road name changes. Letters and petitions were filed with the Clerk. He stated that the report of the study made concerning the road Homes will be presented to the Board on July Z9th, possibly. Supervisor McKillop felt that it would be impossible to answer all the letters received in this matter and requested that the Clerk make up a file of all these petitions and letters and hold said file ready for the hearing. C airman Ladd requested that Mr. Nickelson in the fu#ure inform: the Board of the facts of the claims, mat is the amount, what brought abou# the claim and why the claim is being filed. On motion of Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, the claim of Dennis M. Latimer, Chico, in the amount of $1D,ODD for general damages and $1200 for special damages, was rejected and reFerred to the County`s insurance carrier. 75-1122 F.R.O.C. TO EXERCISE COUNTY OPTION ON PROPERTY AND PURCHASE IN THEIR NAME On motion o Supervisor Madigan, seconded by Supervisor McKillop and unanimously carried, the Board granted permission to F. R.O.C. to exercise the Caunry's option far the additions! two acres adjacent to the parcel being purchased for their building, and for them to purchase the two acres in the name of F. Smith for an auctioneer's license to hold auctions quarterly at Village Square, Chita, was approved. 75-1124 DISCUSSION: SALE OF COURTHOUSE ANNEX: RESOLUTION 75-9$ ADOPTED iom 5truthers,t'urcnas~ng agent, reported an the sate at tt~e courtnouse annex. A resolution has been prepared to implement the sale of the property located at 14$0 Lincoln Street, Oroville, California known as the Ehmann House. It is necessary that the Board set a minimum bid price for the sale and also the amount of bid deposit required. Proposed sale discussed. The bid will call for two options. One~for the house alone; and two-for the house and lot. Mr. Struthers stated that the bid specifications have been prepared. Chairman Ladd felt that the Board members should have been given copies of the specifications for their study and consideration, Supervisor Richter said he would lilts to know what the property is vuarth. The Assessor has placed a $20,OOD value on the property. Supervisor McKillop felt the County should go to bid with the alternatives and then could consider the most economical way of handling the matter. Discussed whether the County should ask far bids for leases ar other proposals. Page 4(~. Mr. Lawrence fait this should be approved at this time. On motion of Supervisor McKillap, seconded by Supervisor Cameron and unanimously carried, the following budget transfers were approved; 8-365 SuQerior Court. This t;ansferb $2,600 ftam the reserve, $4,000 from offfce expense and $500 from extra help with the total of $7,100 going to juxy and witness expense. The increase in the number of criminai.trfals and types of criminal trials account far this excess expenditure. B_-366 Sheriff. $1,200 fs transferred from the ammunition account to the equipment account within the Sheriff's budget and is to provide for Che purchase of 12 Smith and Wesson 38 caliber revolvers. This action is necessary to canfox~n to Labor Cade Section 6401. B-367 Fire Protection. ,This transfers $389.72 from equipment - prfar year to special departmental expense - prior year to cover expendable items for tf~e newly purchased fire and rescue truck. 8-368 County Bui'~clings. This transfers $228.02 from structuxea and improvements to the equipment account within the County Buildings budget. $210.52 is to cover purchase a£ 24-foot ladder& needed by the painters snd $17.50 to cover deficiency in the purchase of the three vacuum cleaners previously authorized. B-374 Manta! Health. Reimbursement for services will be at a provisional rate per unit with a maximum of X43,000. Agreement explained by Dr. Enloe. He stated that there was to Ise a change in the concept of this program. There will be people located in high risk hours at police stations, emergency hospital roams, etc. This program was put ' out to bid. There were two groups that bid for this contract. Proposal explained by Dr. Enloe, It was the decision and recommendation of the Advisory Committee that the Bridge proposal be the one that should be accepted. Program discussed. Dr. Maguire explained the study and consideration given to this matter prior to their making their recommendation. This program will get their people out in the field and will have less reliance on the telephone. There will be a professional on dory at all times tha# wilt work with the trained lay-person. Supervisor Cameron stated he had sat in an these committee meetings. There were two meetings to discuss these bids. The big•item that the committee was concerned with relating to the Family Services proposal was that they would need two or three months to gear up before they could do the work. The committee had the feeling that Family Services was not ready b take on this work.. . Supervisor McKiilop stated that at this point the Court is referring many people for these services. He feels that this is an area that should be in the Mental Health Budget. As proposed, the monies will come out of Family Services. This is all one servicPpage hauld be in the Short Doyle Program. .luly I, 1975 July I, 1975 Chairman Ladd set out the matter of working with and getting a better understanding of the various agencies that make the first contact with these people. 1t has bean requested that 50°k of the time of these workers would be in the field and 50°/a of their time would be in the ofFice where the people could go and talk to them. The Bridge has agreed #o do this. Supervisor Richter said it would be difficult for him to support this contract at this time. Et was felt that the Mental Health Advisory Board could #ake a better look at this. Supervisor McKillop felt that the Bridge is Chico orientated and he feels that the County needs more service in the other areas of the County. Supervisor Madigan felt the contract should he referred back to the Mental Health Advisory Committee for another look at the contract. Supervisor McKillop felt that the duplication of these services should be looked at. On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, the proposed agreement was sent back to the Mental Health Advisory Committee for further consideration of the points set out at this morning's meeting. RECE55: The Board recessed at 10:26 to go in#o an executive session after their moming coffee break. RECONVENED: TheBoard reconvened at II:00 a.m. following the moming recess and the executive session. Supervisor McKillop stated that there were two people From the Mental Health Council present at this time. Chairman Ladd informed Mrs. Murphy, chairman of the Council, that the Board had referred the agreement back to them far further review. He stated that they would be given a copy of the transcript of this discussion, 75-1131 AUTHORIZE BACK PAY ADJUSTMENT FOR LARITA PENDAGRAFT On matron o Supervisor Ma igan, sewn e y Supervisor Cameron and unanimously carcied, back pay authorization for the period of June 4th through June 27, 1975 for Larita Pendagraft was authorized and the Auditor was instructed ro pay such back pay adjustment. 75-1132 DISCUSSION: GRAVES $ GEDDIS, INC., OROVILLE RE PROTEST OF CONDITION ~2 TO THE K ~ DRCC>MPANY'S USE PERMIT FOR AP 35-13-96 Jim Lawson, Panning pirectar, appeared canceming t e protest i ed by Graves & Geddis~ Inc., Oroville, concerning condition ~2 to the K and DR Company's use permit for AP 3~-13-9fs. This condition relates to the requirement of urban improvements in the urban area. The company does not want to install curbs and gutters at this time. Supervisor McKillop said this map is on the agenda later in the meeting and he felt this condition had been deleted from the conditions. Today the Board is being requested to adopt two resolutions. Dan Blackstock, County Counsel, stated that he has reviewed the resolutions; there should be an open hearing at this time. No action needed at this time. 75-1135 APPEARANCE: CI.AUDE POPE, DEAN ROAD, PARADISE: PROPOSED ROAD NAME CHANGES C aude Pope, Dean Road, Paradise, read a letter protesting the changes in road names in the Paradise area. He strongly opposes the change in name of Dean Road. Letter filed with the clerk. 75-iI36 APPEARANCE: MRS. EDITH KINGDON, REQUEST FOR INTERIM ZONING -Mrs. Edith Kingdom, Oroville, :fated she had a petition signed by the -- property owners an Foothill Blvd., between Oroville-Quincy Rr~ad and Olive Highway, requesting interim zoning. The reques# is a change from A-R to R-l. Petition filed with Board. Request discussed. Supervisor Richter said he questions the use of interim zoning for this type zoning. He feels that it is an improper use of the zoning processes. Chairman Ladd said he feltfhat where there are small lots, the health and welfare of the people should be considered so pigs and cattle would not be allowed. He said he would like to have Supervisor McK'sllop review this area and bring it back to the board later in the day. Supervisor McKillop said he would look at the site during the noon hour and would bring his recommendation back to the Board. The Board told Mrs. Kingdon she need not be present this afternoon; the'':r action would be relayed to her by telephone, 75-1137 APPEARANCE OF JOE MIGUEL: MANAGER OF HUMAN RESOURCES: MATTER OF STATE CETA EMPLOYEES Jae Migue , manager o -State Department of Human Resources, spoke Page ~vfi7, July 1, 1975 concerning the matter of the telegram read this rooming regarding the CETA employees. In March of this year, the State hired 22 people; they were local Butte County people. He set out the positions held by these people. They were used to help Bvtte County residents that were unemployed. Chairman Ladd agreed with Mr. Miguel. He said the squeeze is on; he explained how the County was utilizing the CETA funds. Priorities explained. He said if the County could get the Federal Government to fund these people, the County would ga along with retaining these employees. No action taken. 75-1138 APPEARANCE: MARGO YERMAN PROTESTING CHANGE OF NAMES OF ROADS Mrs. rgo erman presence er protest concernrng # e propose c ange o names of roads in the Paradise area. She hoped that the Board will give these protests consideration at the time the hearings are held. There are 31 homes an her street; they alI oppose changing the name of the street, She had a petition with 1,8Q0 names upon it; she will file the petition aF the time the hearings are held, She has talked to the Fire Chief in Paradise, with~the postmaster, with the Lt. of the Sheriff's Department and the owner of the ambulance Service in Paradise. They all assured her that they did not approve the proposed changing of names of the roads. Mrs. Yerrnan requested that when the Board receives the report of the study of road name changes that the board hold a hearing but not on the Paradise section. She belieaes she has found a part of the solution. When the emergency number is set up in the county, she fait it would lee a simple matter ro set up a trunk Line to tellthe origin of the call. There would be no need to duplicate road names after that. Chairman Ladd explained the matter of the hearing in this matter. Where there are sound-alike names or the same name, the people should make a suga,~stion for the change of name . No action taken. 75-1139 BILL LAWRENCE; STATEMENT CONCERNING AUDITOR'S ROLL 1N COUNTY i Lawrence, County u itar, state tat recent iscussions attrr ute to the Board indicates that there may be some misunderstanding an the parF of some Board members as to the role of the County Auditor in County Government. He agreed that legislative decisions are limped to the Board of Supervisors. He did na# agree that it is presumptions for the Auditor to attempt to intfluence the Board's legislative decisions that involve fiscal matters. Mr. Lawrence explained the stand he had taken regarding the matter of the issuance of a warrant to Leslie Scott for salary payments far the May Ist to 19th period. Mr. Lawrence filed his prepared statement with the Clerk. No action needed. 75-1140 LAVINA MILLER-PLANNING COMMISSION'S REPORT OF A DENIED REZONE Mr. Lawson reported on the Lavine Miller matter. He will continue to see what counties da have such an ordinance. Santa Clara's ordinance deo#s with grading, If the County were grading for agricultural purposes, the County would still need a grading or clearing ordinance. E.I.R. under building permits discussed, Supervisor i~chter felt that the county needs to stop erosion that is damaging to the people and is a fire hazard. Supervisor Madigan said he did not know haw this situation had gone on existing in the Forest Branch area. It. should not have been permitted, Mr. 131ackstock stated he would search throughout the other counties and see if they can come up with other ordinances. It was suggested that all members ga back to the County and urge them to write a latter to the Governor regarding health service areas in the State. Supervisor Richter said he has the impression that because the County has opted to ga to a rural area, that this could penalize the County in the area of the pragrarns. Rural areas are an a different fee basis that the urban areas. Supervisor Cameron disagreed with this. Appropriations are based on population. page 479. July I, 1975 July 1L1975 On motion of Supervisor Cameron, seconded by Supervisor McKillop and unanimously carried, a letter was authorized to be written to the Governor urging him to make a recommendation Fa HEW, setting forth approval of the recommendation of the Medical Council. 75-1155 MOTION REGARDING REQUESTED INTERIM ZONING FOR AREA ON FOOTHILL BLVD. OROVILLE Supervisor cKi op stated he had gone out and looked at the property requested by Mrs. Kingdon to be interim zoned. He felt the Board should approve .the request for said interim zoning, it is his feeling that ag uses are non-compatible to the residents in this area and that this is a logical request. It was moved by Supervisor McKillop and seconded by Supervisor Cameron that the interim zon'sng from A-R to R-I far that property on Foothill Blvd., between Quincy !load and Ol'rve Highway, as requested by Mrs. kingdon, be approved and that the appropriate ordinance be adopted. Supervisor Richter sta#ed he had looked at the property with Supervisor McKillop, He feels that this would be an abuse of the zoning processes. He said he was going to vale against this motion.
