-1377 APPROVAL OF MINUTES
On motion of Supervisor Lemke, seconded by Supervisor h+bseley and
unanimously carried, the minutes of July 12, 1977 were approved as mailed,
following a discussion of the tow-away ordinance and hearings set out on Page 303.

Northam California Supervisors Assaciatian. Supervisor Madigan wmmented on letter
concerning meeting to be held in Susanville on August 12th. He suggested that
it might be nice if the county made up a pocke# of olives, almonds and rice
to present at that meeting. Supervisor Madigan will see about securing the almonds;
Supervisor Moseley will secure packets of rice and Supervisor Winston will secure
olives for the presentation.

77-1380 DISCUSSION: CASE OF BUTTE COUNTY HOUSING AUTHOR{TY_VS. KOLB
Supervisor Madigan requested that Dan ~Blackstock, County Counsel, check
out the status of the case of Butte County Housing Authoriay vs Dorine Kolb.
Mr. Blackstock will report back to the Board on the status of this case.
77-1381 WAIVE SECOND READING OF SALARY ORDINANCE AMENDMENT: ADOPT
ORDINANCE 1838
On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously
carried, second reading of salary ordinance amendment that provides a 5% salary increase
for appointed and elected department heads and implements several classifica+ion and
position changes was approved,
On motion of Supervisor Winston, seconded by Supervisor Madigan and carried,
Ordinance (838 adopting the salary ordinance amendment was adopted and the Chairman
authorized to sign.

On motion of Supervisor IMnston, seconded by Supervisor Lemke and
unanimously carried, a 5% salary increase was approved for Razia Kahn, E.O.C.

77-1382 APPROVE INTERNSHIP AGREEMENT: NON-PAID NURSING INTERNS
is agreement permits uti iza+ian o non-paid nursing interns to train in the
Health Department. The agreement is with the Cal€fomla State University at Long
Beach and €s similar to the existing agreement with CSUC.
On motion of Supervisor Winston, seconded by Supervisor Moseley and
unanimously carried, agreement with California State University at Long Beach for
v+ilization of non-paid nursing interns was approved and the Chairman was authorized
to sign.
77-1383 APPROVE HEALTH INSURANCE SATELLITE AGREEMENTS
The agreements etween t e county and the contracting public and non-public
agencies participating in the employees' health insurance plan are in order.
On motion of Supervisor Lemke, seconded by Supervisor Winston and unanimously
carried, the Chairman was authorized to sign the satellite health insurance agreements
with the following:

77-1384 WAIVE SECOND READING TOW-AWAY ORDINANCE; ADOPT ORDINANCE 1839
On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously

unauthorized vehicles by the Sheriff's Department from off street parking areas designated by
the Board of Supervisors was waived.

77-1385 APPROVE WELFARE FIRE CONTRACT EXTENSION

carried, a one month's extension was approved to complete insulation work as part of the
Welfare fire repair contract.
77-1386 APPROVE JAIL EXERCISE CONTRACT EXTENSION
n motion of Supervisor Winston, seconded y Supervisor Lemke and unanimously
carried, a 60-day extension was approved for completion of the exercise area at the Butte
County Jail.
77-1387 DISCUSSION: DEVELOPMENT TRUST LOAN
The Committee vn Pu lie Nbr and Deve opment Trust has reviewed and
recommended approval of the proposal for drainage extension of the Shasta Union
drainage system. Clay Castleberry, Director of Public Works, suggested that the out-fail
line would be on County property and the Board could consider approving a loan or
advance fa be repaid back aver a period of time of from three to five years. If it is
not paid back within 5 years, the Board could form an assessment district for the repayment
of the loan.
It was stated that the Board could not lend Revenue Sharing funds for this use.
Supervisor Winston suggested that County Counsel bring back recommendation
and procedures to follow next week. Chairman Richter recommended that a committee
meet with Mr. Blackstock to help prepare a policy. Chairman Richter will be on the
committee and will work with County Counsel; Supervisor Winston will also be on the
committee.
The committee wil I meet tomorrow at lunch time between 12:00 and 1:30 p.m.
77-1388 REPRESENTATIVE TO ATTEND GRAND JURY I'AAPANELING

77-1389 BUDGET TRANSFER APPROVED
On motion of Supervisor Mdse ey, seconded by Supervisor Winston and unanimously
carried, tf~e following budget transfer was approved:
B-192, Water services. Provides a $7,053.01 appropriation to cover the
1977 water entitlement payment ro the State based upon additional sales of water.

77-1390 APPROVE LOANS FOR REHABILITATION ASSISTANCE

77-1391 HEAD START MENTAL HEALTH GRANT: REFERRED TO MENTAL HEALTH DIRECTOR
A grant proposal has been prepared in the amount of $17,827 to provide mental
health needs to 134 Head Start children and their Families through the remainder of (977.
Chairman Richter felt it would be appropriate to submit the grant to the Mental Health
Department for their study.
On motion of Supervisor Winston, seconded by Supervisor Lemke and
unanimously carried, the Head Start mental health grant was referred to the Mental
Health Director.
77-1392 APPROVE AMENDMENTS TO LAND CONSERVATION AGREEMENTS
Amendments forte 969 and 76 and Conservation Act contracts with
Francis L. Carmichael have been prepared by County Counsel. Amendments are
required to correct mistakes of fact and clarify Intent of the parties.
On motion of Supervisor Winston, seconded by Supervisor Moseley and
unanimously carried, amendments to land conservation agreements for the (969 and
1976 contracts with 1=mncis L. Carmichael were approved and the Chairman authorized
to sign.
77-1393 APPROVE INDECENT BILLINGS
Bi ings in t amount of 5, 08J5 have been received with recommended payment
of $4,597.88.
It was moved by Supervisor Winston and seconded by Supervisor Moseley
that the biElings be paid with transfer from the reserve authorized.

carried, payment of indigent billEngs in the amounf of $4,597.68 was approved, and
transfer from the reserve authorized, providing that a continuous and constant effort
is made to obtain payment from the foreign government for payment of that portion
of the billing.

77-1394 APPROVE MATERNAL AND CHILD HEALTH AGREEMENT
On motion of Supervisor Winston, seconded by Supervisor Lemke and
unanimously carried, the maternal and child health agreement in the amount of
$2,871 was approved and the Chairman authorized to sign.
77-1395 AUTHORIZE REQUEST FOR PENALTY RELIEF
On motion of Supervisor mston, seconded y Supervisor Madigan and
unanimously carried, request for penalty relief for Gregory Stone for AP 66-21-18
was authorized.
77-1396 APPROVE PURCHASE AGREEMENT WITH GOLDEN FEATHERUNION SCHOOL DIST
unanimously carried, purchase agreement to seal tax deeded land to the Golden
Feather Union School District at a minimum purchase price of $50 was approved
and the Chairman authorized to sign.
77-1397 APPROVE PLACEMENT OF FUNDS IN MAINTENANCE FUND FOR SHASTA
UNION DRAINAGE ASSESSME NT DISTRICT
On motion of Supervisor digan, seconded by Supervisor Lemke and
unanimously carried, $1,908 was authorized to be placed in the maintenance fund for
Shasta Union Drainage Assessment District as a connection fee to the Lassen Avenue-
Shasta District formation.

helped prepore the comments and Chairman Richter stated he hoped the Board would
approve the comments.
Comments discussed. It was stated the County did not have the money to make
the survey; statement will be included in the comments that funds are not available
to conduct the survey. Second paragraph of the cover letter to 6e deleted.
On motion of Supervisor Lemke, seconded by Supervisor Madigan and
unanimously carried, cover letter and responses were approved with the recommended
changes.

Chairman Richter stated that before the hearing is opened to the public,
he suggested that he and Supervisor Madigan should sit down and go over the extension
with the Planning staff and limit the boundaries. They could then bring back a
recommendation to the Board. Anyone that is interested could attend this meeting

Consumer Protection Unit of,.the District Attorney's office. Mr. Leach
stated that he had been requested to attend the meeting today to discuss
the Consumer Protection Unit. Mr: Leach explained the background and
the position of the District Attorney regarding the Canaumer Protection
Unit. The unit Started in October 1, 1976, and about October 15, 1976
the personnel wen recruited and the unit was staffed. Mr. Leach stated
that he will cooperate with the Board as fully as he can. There has
been and ie some disagreement on the greaent Board and the past Board
regarding the unit. This is net the concerrt of the District Attorney.
The Board of Supervisors created the unit. .The unit now exists and it
is clear that the District Attorney has •a statutory and legal responsibility
to use those people.
Mr. Leach stated that he hoped that some of the problems that
seem to exist are simply one of communication. Appareatiy, there has
been a question of Supervisor Winston feeling there ie soma unfair tactics
being used. Mr. Leach stated that the first time he had any suggeatlon
of news that a party had done something to implement 5upervieor Winston
in some•i~legal activities was in .the newapeper. Certainly no one ever

thought Supervlsor Winston was involved. The District Attorney's office
has •a long time ago, because of the controversial nature and interest ~.n
part generated by the Board meetings, adopted a policy of not making
statements to the preen. There is either ao comment or the individual
is referred to a public document. 5upervieor Winston has a copy of the
letter that was sent regarding the implications concerning him. The
inquirer was referred to a public document. The District Attorney's
office has always taken investigative action to make a determination when
something ie reported. That continues to be the policy of the office.
Mr. Leach gave the background of the'1llegai aubdivisione in
Butte County. It started approximately August, 1972 with Ward Boulevard.
As a resulC of that, the District Attorney want to another County to
learn about the problem. There was no staff in Butte County et that
time who kaev anything about illegal lot splitting. The Department of
Real Estate and Che Attorney General became involved at this point.
In the Auttaan or Winter of 1973 the County was about to obtain an
agreement that the Department of Real Estate and the Attorney General
would provide certain personnel. The District Attorney's office
provided a part-time investigator and attorney. The Attorney General
provided two full-time peraoaael and the Department of Real Estate
provided 3 1/2 full-time personnel far investigations. This is a
report of what happened out of that agreement: Findings against
Williamson and Clark on September 3, 1975; People vs Byers etal on
Februeyy,1976; People vs Green oa June, 1976; and People va Culet and
Butte County Title oa December 16, 1976. These dates are important.
The Consumer Protection Unit did not come into being until October, 1976.
There was a part-time attorney before that who spent only about 15 percent
of his time on this. The District Attorney's office is not playing
favortism. The unit comprises less than one percent of the things that
the District Attorney's ,office does.
Mr. Leach stated that he was more concerned with the Department
of Benefit Payments trying to stop the District Attorney from prosecuting
welfare fraud. Mr. Leach set out the background of what is happening
with the legislation regarding this.
Mr. Leach stated that at the time the Meridian Munjar area
came up, there was no capability in the District Attorney's office to
da anything about it. The Board of}Supervisor held hearings on the
Meridian Munjar area and voted they were not is compliance. The Attorney
General took over and the Department of Real Estate filed an accusation.
This was done in en Administrative hearing and was not sustained.
Supervisor Winston stated that he did not think that Mr. Leach
knew of the things going on in his office or of the calls that are recorded
and translated. Supervisor Winston stated that the investigators should
advise the people they ere questioning that they do not have to answer
the questions without counsel.
Mr. Leach stated that unless a person is in custody there ie no
need to advise them of that. The investigator who would follow that process
would never get anything done. There is no way that anyone in the District
Attorney's office would •,•,r be permitted to do anything unlawful. There
has been developed a criteria as to how cases should be handled and disposed
of.

Supervisor Winston stated that the main reason for asking
Mr. beach to be present was to•insure the people of the County are treated
fairly and decently. People want law enforcement and they also want
integrity.
Supervisor Winatoa to meet with Mr. Leach and discuss some
of the problems.
Discussion of fundfng for the Consumer Protecticn Unit had
at this time. Because of savings it will continue through the first
of November rather•thaa October 1. It will probably be abandoned if
there are no people at the sad o£ that time.
Mr. Leach stated that he did not know the amount of money
the unit has been able to collect as a result of filings•aad suite
but that it was substantial, around $100,000 or $200,000.
Supervisor Madigan stated that he had received a call from
one of the parties involved is the Meridian Munjar division. The
Diatriet Attorney's office was given three documents that will be of
assistance as far as the Meridian Munjar area.
Mr. Leach stated that his office ie looking at activity in
the Meridian Munjar area, and they have all of the material from the
Attorney General. There will have to be a determination whether the
District Attorney's office can proceed, There are many cases that
could have been prosecuted if they could have been pursued in 1472,
1973 or 1974 but they~xre beyond the statue of limitation.

The public hearing on the request of Gary Roza for a variance to
allow a 320 square foot mobile Name on property zoned "A-5" (agricultural)
located approximately 900 feet north of Craig Avenue, approximately one
mile east of Palermo Honcut Highway, identified as AP 27-24-40, Palermo
was held as advertised.
Hearing open to the public. Appearing: Gary Roza. Mr. Roza
stated that he had bought the trailer and had applied for rezoning for
30 acres to allow an 8x40 trailer ion the property. The ordinance
required 5D0 square feet. The well and leach lines are in.
Hearing closed to the public and confined to the Board.
Supervisor Winston asked if this was for a temporary thing
to build a house. Bettye Blair, Planning Department, stated that it
was not requ~ated. If it were for a temporary permit he could get an
anministrative decision sad not have to go before the Board. He would
have to go to Planning and Public Works to apply for a building permit.
On motion of Supervisor Lemke, seconded by Supervisor Madigan
and unanimously carried, Che variance was disallowed.

negative declaration done on the it. Mr. Rogers is in agreement with
the negative declaration.

Mr. Rogers stated that the Board of Zoning Adjustment fou~td that the duplexes
would not fit into the surroundings. Mr. Rogers set out the background of
Che area. There is a conglomerate in the area.E Mr. Rogers stated that he
did not sea how the duplexes could be in conflict with the area.

There is an overlay zone of H-C on the property. Bettye Blair
stated that the amendment that is pending would give the Board more latitude
in this situation.

77- 1408 DISCUSSION: AGREEMENT TO LEASE A FACILITY TO "BUILD TO SUIT" FOR
THE MENTAL HEALTH OPERATIONS IN CHICO.
The discussion of the agreement Co lease a facility to "build to
suit" for the DSentai Health operations in Chico was held at this time.
Dan Blackstock, County Counsel, stated that there are two proposals to
be considered at this time. The staff has been reviewing the proposals
with regard to the Mental Health facilities for same time. the two proposals
are on Rio Lindo Avenue and era approximately 200 bards from each other.
The matters have bean reviewed by the Mental 'Health Advisory Board.
John McLaugilin and Joha Brunstoa will each present a proposal to the Board.
Both men will diacuse the price and the financiAl aspects of their proposal.
As of this time, we have not come to any recausnendatioa or any approval
ae to rental amount. This building will house the people who are being
held or under LPS procedure. It is s duel purpose building and there will
be treatment going on there.
Mr. John McLaughlin presented his proposal. The cost of the
building wbuid be $520,000 or $40 per square foot. The rental at the
present time would be $.60 per foot. This rental can be renegotiated
if the County is reimbursed for the additional reatrooms that are needed.
Mr. McLaughlin stated that he hoe a deposit receipt for the property
that is for a 30-day period. The purchase price of the property is
$71,900. The work will be covered by performance bonds. This will be
a partaersl6ip. There is a provision whereby if there is a decrease in
funding for LPS in the amount of 50~ over what we are getting, we would
be in a position to cancel the lease any time during the 20-year period.
Mr. McLaughlin set out the size of the parcel at this time. There is
an agreement with McCain and Associates for an easement to accomodate
the parking spaces. Time spent setting out the plea and proposed site.
Mr. McLaughlin statedtheyr have anthing in writing from the Fira Marshall.
This proposal presented sts a partnership. Dan Blackatock, County Counsel,
questioned Mr. McLaughlin relating to facts concerning the letter 14nd proposal.
Mr. bhn Brunston presented hts proposal. Site that is proposed set out.
lie had a letter from the Bank of America for financing this building. The State
Fire Marshal could see nothing wrong with their plans. Chairman lFichter
question Mr. Brunston about his proposal and the possible loon from the Bank of
America. The total cost of the building would be $610,000 and term of lease
would be far 10 years, with a rental charge to the County of .68 per foot per month.
County Counsel questioned Mr. Brunston at length about the proposal.
He felt that the amount of rental is a problem. Over the period of the lease,
the County would be payinfl over $2x000,000 rontal an this facility. Fie felt

It was felt that Supervisor Winston should be present to discuss this
proposal. Chairman Richter stated he would like to have some type agreement
that could be entered into by the County and the firm that there would be
sufficient protection to the county . Mr. Blackstock will prepare an agreement
that these people would obligate themself to a substantial penalty if they
could not perform on their proposal. These agreements could 6e signed by
Mr, McLaughlin and Mr. Brun3tan.
Matter put over one week. A recommendation will be given by the
committee next week at 11:45 a.m.

Mr. W1111s stated that there is a problem oa Schott Road.
The telephone company installed underground utilities. The road is
dangerous and narrow and will have to be widened at some time. The
mess left by the telephone company should be cleaned up. The contractor
should be required to make some repaira•on•back~iliing of excavation.
Clay Castleberry, Public Works Director, will work with
the telephone company and the contractor to take care of the situation.

Mr. McCalley stated that he had property on W. Lassen Avenue
that is caught up in the interim zone for the airport. Mr. McCalley
stated that he had started an eleven-unit pomplex and had only seven

and carried, the Public Works Director was instructed to issue a building

77-1412 APPEARANCE SHERRY GREENFEELD - APPROVE VARIANCE FOR MOBILE HOME
Ms. Greenfield stated that Howard Toussaint, Sanitarian, would
speak to the Board concerning her problem.
Mr. Toussaint stated that Me. Greenfield wished to place a mobile
home on 6 scree west of Midway and south of Antler Avenue. There is a
15 foot access. According to the Subdivision Ordinance is order to place
a single-family residence on the property an access greater than the
15 foot or execution of an affidavit would have to be done. Ms: Greenfield
hoe signed the affidavit. The problem ie that there is a residence on
the property at the present time. Ma. Greenfield wants to place the
mobile home an the property in order to care for her ill mother. This
is not an Aunt Minnie as there would be no abatement to this.

Mr. Manta stated that there are cars being hauled into the Holcomb
property on Clark Road again. Mr. Mants~asked when is the problem going
to be taken care of.
Dan Hlackstock, County Counsel, stated that the 60-day period
is almost up to have the work done.
Supervisor Lemke stated that he had a memo £rom Bob Ferguson,
Zoning Inspector, sMr. Ferguson forwarded pictures of the Holcomb property
that were taken on July 15, 1977. Mr. Ferguson has tried to contact Mr.
Holcomb's Erobation Officer but has been unsuccessful. Sugervisor Lemke
stated that he wasted the information given this date referred to the
Probation Officer and wanted to know why the Probation Officer is not
responding to the zoning Investigator.
Supervisor Lemke is to meet with the Probati~On Officer and
the neighbors of Mr. Holcomb.

to the curbs end gutters but thinks that the sidewalks are not necessary.

Mr. Toussaint explained haw the well shoe works and had one at the meeting

Discussion of running a pipe to the channel for drainage had
at this time. It was felt that the deposit would be the hest way to go.

77-1437 AUTHORIZE LSTTE$ TO R. L. ROgENBURN, CHIEF, DIVISION OF WATER RIGATS
Supervisor Madigan stated that sometime last year there van a
public hearing is Chico by the Water Resources Department regarding
ground water. Since that time the Department hae sent letters to the
riparian water owners asking for permission to go on their property to
make surveys to determine whether they are using the water properly.
On motion of Supervisor Madigan, seconded by Supervisor Lemke
and unanimouaiy carried, a letter is to be written to R. L. Rosenbura, Chief,
Division of Water Rights, Department of Water Resources asking that a
public hearing be held in Chico regarding riparian water rights sometime
after August 15, 1977.
77-436 ~I1DiTICNAL MATTERS PRESENTED
Supervisor Moseley stated that one of the cooks from the
Aging Project would like to have mileage to ••dttend a meeting is Redding.
Clif Nickelson stated that the Board approved mileage for the
Board members. She is an employee o£ the group and would have to check
with the people in Red•Bluff.
Supervisor Moseley stated that the Board had been invited to
attend an anniversgry function is Red Bluff.
Supervisor Lemke stated that Mike Teeter hae asked him if parking
spaces could be designated~by the new ramp so that people in wheelchairs
would be able to use the new ramp. Mika Pyeatt, Administrative Analyst,
is to follow through on this matter.
Supervisor Lemke asked why the agenda was not printed on two
sidesY Clif Nickelson, Administration Officer, stated that it was too
costly and it would be hard to Work fram.~. ~:.;~:~
Clif Nickelson, Administration Officer, stated that he had
called Senator Johnson regarding SB 689 that permits'bur~ing on a burn
day at over 1500 feet of altitude. This would allow some open burning
dumps in the mountains.
