Everd McCain, Engineer, spoke concerning this request. Action of the Board explained to Mr. MoCain. 76-1219 APPROVE APPOINTMENT OF A GENERAL PLAN ADVISORY COMMITTEE t was move y Supervisor Rie ter, sewn e y Supervisor an carried, that a General Plan Advisory Committee be created ,composed of 5 persons, 1 nominated by each Board member and confirmed by the Board of Supervisors. This Committee should be charged with the responsibility of examining the Butte County General plan and making recommendations to the Planning Commission and the Butte County Board of Supervisors as to the degree of alteration, iF any, the method and an estimate of the cost end the time necessary to accomplish fihis task. This Committee should report back to the Butte County Planning Commission and Board of Supervisors within 60 days from the date of its establishment. Expenses to be paid for performance of these duties. 76-1220 AUTHORIZE NEGOTIATIONS FOR f URCHASE OF BETE FOR CHICO LIBRARY AND FOR PUBLIC WORKS TO COME UP WITH PLANS FOR GRIDLEY LIBRA RY Supervisor Richter reported that there had been a meetmg yester ay o t e Building Committee. There is a possibility that the Public Works Bill will be passed over the Governor's veto. Butte County would be eligible for a great deal of money under this 6111. It could 6e very likely that there would be 100% funding of the County Administration Building. There is also the possibility that there could be funds for other buildings in the County. Supervisor Richter suggested that a committee of Supervisor Madigan and himself be authorized to negotiate for a Chico Page 2. Discussed including the public Works yard in Gridley and the Upper Ridge fire station, using the Gridley fire station plans. It was moved by Supervisor Richter, seconded by Supervisor Ladd and carried, that negotiations be authorized for the purchase of a site for the library in Chico and for Public Works to come up with some plans for the Gridley library building. AYES: Supervisors Ladd, Madigan and Richter NOES: Chairman Cameron ABSE NT: Supervisor McKlllop 76-1221 INFORMATION AND DISCUSSION ITEMS Supervisor Ric ter questions t County Auditor and the Administrative Officer about the audit of the Narcotic Task Force. He wanted to know who had made the miscalculations. Audit discussed. Bill Lawrence, County Auditor, said he had advised the Board some time ago that L.E.A.A. had changed the game; the project was organized on o line item cost sharing. There ore errors in the accounting of the program. piscussed; no action taken . Supervisor Richter commented on the memo written by Don Nissen, Chief probation Officer, to the Board. Letter from Jim Glander regarding Building Codes discussed. It was felt that the County would be going backwards an building standards. Building Codes discussed. 76-€222 PUBLIC HEARING: BUDGET HEARING Fisca Year - u get aring opened at this time. Schedule of how hearing would be conducted discussed. Hearing opened to the public at this time. Appearing: I. Orrin Stratton, president of the Butte County Taxpayers Association gave a short general statement. It was his feeling that it was self evident that the people of the County cannot cope with a tax increase. The people are not willing to pay a higher tax rate. Hearing opened ro the public. Appearing: I. Art Thompson, Chico. He stated that the lines of the parcels were not properly drawn, as pointed out by Dan Blacksrock, County Counsel. He has now had a new set of plans prepared sefting out four parcels, rather than five as set out on the other set of plans. The plans will be filed with the Planning Department today. Plans discussed. It was felt that the plans should be referred back ro the Environmental lieview Committee to determine if they still will require an Environmental Impact Report. On motion of Supervisor Riehter, seconded by Supervisor Madigan and carried, the pions of Art Thompson were referred bock to the Environmental Review Committee for their study and recommendation. RECE55: 10;15 RECONVENED: 10;25 76-1225 DISCUSSION OF ADDRESSING STUDY Clay Castleberry, Director of Public Works, introduced Mr. Howard, postmaster of Chico Posroffice. Mr. Howard reported on the meeting just held to discuss this matter. He hoped the Board would agree that a complete change of numbering in the County would not be practical at this time. He commented on she action taken by BCAG approving Option 6of the pfoposal. The emergency people and the postal people are willing to compromise and they will embrace Option 6. Changes should be confined to each area separately. An ordinance should be adopted ro give the controlling oFFice the control as to what numbers will be given out in each area. Public Works should be given this authority. RAY: APPEAL OF PLANNING COMMISSION'S DENIAL OF USE PERMIT TO ALLOW TWO RESIDENCES ON ONE PARCEL: WEST SIDE OF COUTOLENC ROAD NORTH OF TOADTOWN e pu is acing on t Kent F. Ray appeal of Planning Commission's denial of a use permit to allow two residences on one parcel located on the west side of Coutolenc Road, approximately 3/4 mite south of Toadtown, approximately 5 miles north of Magalia, identified as AP 65-03-04 was heldat this time as advertised. Jim Lawson, Planning Director, set out the background of the appeal, stating that the Planning Commission's vote had been 5-4 to deny the TM zoning of the area. Planning Commission felt the two homes on this property would not be appropriate for the area. This is in the P.I.D. water shed water quality study area. Hearing opened to the public. Appearing; (. Kent Ray, setting out his justification for the two homes on the property in question. 2. Mrs. Hazel Ray, mother, and corowner of the property in question. The property was zoned A-2 when it was purchased 4 years ago. It was purchased as a place to retire to and she felt it would be grossly unfair if they are not allowed to build two houses on the 25 acres. All their earnings are Pied up in this property. 3. Mr. Earl Hogan, owns property to the east of the Ray property, Spoke in favor of the placing of the two homes on the property. 4. Gory Roy, brother of Kent Ray.' He requested approval of the use permit. Hearing closed to the public and confined fo the Board. Chairman Cameron felt that The use permit should be allowed. Sulervisor Richter set out his feelings in this matter. When there is a potential of pollution, the Board should not allow theae requests, he felt. On motion of Supervisor Madigan, seconded by Supervisor Ladd and corned, the appeal of Kent F, Roy was approved, and the use permit for the two residents on one parcel located on the west side of Coutolenc Read, approxinately 3/4 mile south of Toadtawn, approximately 5 miles north of Magalia, identified as AP 65-03-04 was approved, and the decision of the Planning Commission for denial was over ruled. A feed warehouse would be established on the property; their son desires to have a dismantling business, also. Hearing opened to the public. Appearing: I. Mrs. Doris F. Miller, setting out the justification for the rezoning of the property. Zoning for the area set out and discussed. The building has been established as a Feed store. Mr. Lawson read the uses allowed for the area as zoned. 2. Doug Colburn, Greenbank Avenue. filed a petition in opposition to the request of the Millers. Opposition explained. 3. Bob Wallace, Circle Drive, spoke in opposition. 4. Mr. R. A. David, Foothill Blvd, spoke in opposition. 5. Harold Miller, explained the comments relating to the dismantling business operated by his son. Hearing closed to the public and confined to the Board. It was suggested that the request be referred back to the Planning Commission for (heir shrdy of a C-2 zoning for the property. Rezoning discussed. On motion of Supervisor Ladd, seconded by Supervisor Richter and carried, the appeal of Mr, and Mrs. Harold Miller was referred back to the Planning Commission for study of C-2 zoning for this parcel only. 7b-1230 APPEARANCE: MRS. MID MOORE, SKYWAY, PARADISE, CLARIFICATION OF REQUEST FOR CURBS, GUTTERS AND SIDEWALKS FOR PROPERTY ON 51CYWAY s. She would like to have the requirement for curbs, gutters and sidewalks waived at this time. She stated she would pay her fair share when the Skyway is continued above Bille Road for the curbs, gu#ters and sidewalks. Dan Blackstock, County Counsel, said this matter has been discussed "in-house ". The way the code reads, it refers to buildings. A building permit is not needed for mobile home occupancy, Requirement for curbs, gutters and sidewalks explained, Mr. Blackstock asked the Boord if they would like to consider modifying Section 26-12. Mr. Blackstock felt there should be a policy decision made in the matter. Matter of driveway discussed. Discussed the passage of an urgency ordinance to requirement the improvements for mobile homes. It was the feeling of the Board that the improvements should be required at the site indicated by Mrs. Moore. County Counsel was directed to prepare a ordinance and bring back later in the afternoon as an emergency ordinance. Motion discussed and withdrawn. County Counsel to present the urgency ordinance for Board consideration this afternoon. 76-1231 APPEARANCE: BOB JONES, MANAGER OF BUTTE CO. EMPLOYEES ASSOCIATION Bo Jones, Manager of Butte County Emp oyees Association, said t y would be happy to work with the Chico Chamber of Commerce. Mr. Jones commented on the proposed "No Strike"Ordinance. There is an impasse situation in the meet and confer sessions. The Employees Association is requesting that the 2~% be placed back For the employees. impasse procedures are being considered. Mr. Jones pointed out that the State Attorney General's Office has filed action against the City of San Francisco regarding the firemen aid policeman provisions. Discussed; no action taken. 7b-1232 DISCUSSION: DISPOSAL OF SURPLUS PROPERTY T Pro ation Officer requests t e dispose of numerous items of Juvenile Hall equipment that were either donated to the Hall, collected over a period of years, not needed, or simply worn out. Board requested that Mr. Nickelson secure a list of the items. Action held off until later date. 76-1233 APPROVE DATA PROCESSING AGREEMENTS Data processing agreements eve en prepared for Tehama County Welfare Department ($6,000)and Mariposa County for secured taxes ($5,000) and voter registration ($1,500). Discussed. On motion of SupervisorRichter, seconded by Supervisor Madigan and carried, data processing agreement with Tehama County Welfare Department and Mariposa County for secured taxes and voter registration were approved and the Chairman authorized to sign. 76-1234 APPROVE CLAIM OF FOX, MC FARREN 8. TARMAN FOR PRELIMINARY DESIGN WORK C aim No. 5 for services in progress on preliminary design work has been received in the amount of $6,250 which constitutes 25% completion of the preliminary phase. Discussed. On motion of Supervisor Richter, seconded by Supervisor Madigan and carried, ciaim of Fox, McFarren and Turman for preliminary design work was approved and payment by Auditor authorized. 76-1235 APPROVE CLAIM OF CONNERLY AND ASSOCIATES T e irm o Conner y an Associates as su muted a claim for services rendered under contract for implementing the block grant awarded by Housing and Urban Development this year. The total claim for Fhe period June I through June 30, 1976 is $1,472.92. Poge 7. A slightly used desk has been located at leased cost of $20.58 per month. Request discussed. It was stated that there are two desks at the Supervisor's office in Chico and that one of them could be used by the attorney. Discussed; no action taken at this time. 237 DISCUSSION: CCCJ GRANT APPLICATION-COURT WORK REFERRAL PROGRAM e nicipa and Justice Courts have developed a pilot program whereby defendants would do public service work in Iteu of spending time in jail. Total cost of project $16,,667, county share $633. The Administrative Officer had been asked to have someone from his off%ce go out and look at the program. Memo from Jerry Lively, Administrative Analyst, read and discussed. The fines exceed the amount of the grant. Program discussed. Judge Savage, Judge of Oroville Justice Court, has a program and he sendsthe defendants out ro Public Works ro work out their fines. Chairman Cameron said he would like to follow through and see how the Oroville Justice Court is handling this problem. No action taken at this time. Jim Lawson explained the previous zoning and haw the property came to be zoned "PA-C". The Planning Commission voted for the rezone. Bearing open to the public: Appearing: 1. Andy Wippler -Property Owner. 7>!r. Wippler stated that he supported the rezone. 2. Kenneth Omer, Paradise -Property owner in Eden Roc Estates. Mr. Omer was opposed to the rezoning of the property. Mr. Jarrell, Paradise - Property owner in Eden Roc Estates. ' j Mr. Jarrell stated that he thought that this would be an improvement to the corner, tie was in favor of the rezoning. i 5. Aarry Stroud, Paradise -Property owner in Eden Roc Estates. Mr. Stroud stated that he was opposed to the rezoning. 6. Aarrq Anderson, Paradise. Mr. Anderson is planning oa buying the property if it is rezoned sad ie planning on putting a Short Stop store on the property. He is in favor df the reaontng:= i 7. Miss Wippler, Paradise. Mies Wippler read a letter by Mr. i John Wippler in favor of the rezoning. Hearing closed to the public and confined to the Soard. Chairman Cameros stated that he would have to concur with the Planning Commission. The property has been commercial and it should be rezoned back to coasnerciel zoning. '240 PUBLIC HEARING: DIAMOND INTERNATIONAL CORPORATION-ENVIRONMENTAL IMPACT REPORT 8. REZONING FROM "A-2" (GENERAL) AND "TM-20" (TIMBER-MOUNTAIN) 70 'C-F" (COMMERCIAL FOREST) PROPERTY LOCATED THROUGHOUT NORTHEASTERN BUTTE COUNTY CONTAINING APPROXIMATELY 5,300 ACRES, ADOPT ORDINANCE NO. 1737 The public hearing on Diamond International Corporation-environments act report and rezoning from "A-2" (general) and TM-20" (timber-mountain) to '"C-F" (Commerc iai forest) property located throughout north-eastern Butte County, containing approximately 5,300 acres was held at this time. Planning Commission voted unanimously for this rezone. Jim Lawson, Planning Director, stated that this was scattered property of Diamond International Corportion; background of the rezoning set out. Supervisor Cameron commented on cooperation that the County has had with Diamond International Corporation over the problem of the logging roads. Hearing opened to the public. Appearing: Page 9. July 20, 1976 ~^ n 1. Mr. Graff, Property owner Tiger Creek. ~Mr. Graff was concerned about niemond International Corporation owning the logging sights on his property. He set out the problems involved. I 2. Bob Barrett, Diamond International Corporation. Mr. Barrett stated that Diamond International Corporation was asking for the rezoning to clarify all property acquired from Southern Pacific Land Company last year. All of the property is contiguous. Mr. Gary Buzzini, County Fire Department, stated they would support any taxes for county-wide fire protection. There is a sizeable area of the County that does not receive fire protection from the County fire department. The volunteer fire companies have been doing an outstanding job. 4. Mr. Jim Lynch, Chico. He asked when the Economic Development Budget would be discussed. It is essential that this department be maintained, he felt. Matter of obtaining grants explained. Funds received under the grants can be used for site development. if the Board is going to consider the development of the County, then this department should be maintained. Industrial development explained. He explained how industrial development is secured. 5. Mr, Ib,rss Charland, member of the County Committee on Economic Development. They have mat with Mr. Mickelson and have prepared a proposal for the coming yea"r. Projects that have been handled through this committee and by the Economic Development Commission set out. 6. Fred Hockett, President of the Retired County Employees. IVIr. Hockett set out two requests that they need help on. The first request is for the people that retired prior to Jufy 1971; second request is for those that retired after 1971. A cost of living increase was also requested. These are provided for under State law. The State retired employees have received their increase but the County employees have not been granted this increase. Request sat out and explained by Mr. Hockett. These retired employees are having a problem making ends meet. Supervisor McKillop asked how many employees were included under those retired prior to July 197f. Mr. Hockett said he did not know the amount but there would not be a great deal of money involved in: this increase. Mr. Rockerby will get the figures for the Board, Cost of I iving increase explained. Mr. Hockett said they are merely requesting a small increase for the small group involved. Mr. Mickelson will obtain the figures from Mr. Rackerby about the number of employees retired prior to 1971 and the costs involved for the 6% cost of living increase requested. Mr, itackerby will report back on these at the next budget hearing. 7. Gene Mercer, Chico, spoke in support of Fred Hookett's request. He stated that in looking into the future, instead of having this group come before the Board, should include something in the budget for the retired County employees. Mr. Mercer is a retired State employee and will receive a 7°lo increase in his pension . 8. Hollis Jeffery, Chico, a former County employee. She hoped the Board will put their priarities in the right place and consider the request of the retired county employees for an increase in their payments. Board informed the public that their requests will be taken under consideration. Mr. Mickelson said that since the time the Budget was put together, there are some changes that should be incorporated into the budget. Mr. Nickelson said he had sent the Board a list of the areas that was thought reductions could be made to hold the current fax rate. The amount of the proposed reductions totaled about $2,402,000, which is more than needed. Reductions to the Auditor and Treasurer-Tax Collectors budget for data processing services discussed. Bill Lawrence, County Auditor, explained his thinking regarding its to the Budget. He said he would take the proposal of Mr. Nickelson and will try to tie if in to the tax dollars. Art Gilman, Durham, present to discuss the budget at this time. 1•le is present as representative of the Northern California Health Services Agency. They would like to request more money from the County. Butte County is the largest County in this Agency; purpose of the request set out. They are requesting .05 per capita for counties involved. He felt the .05 was a small amount for what wi I I be received . Mr. Gilman stated that Butte County is well represented on this Agency. Justification for the request set out and discussed. He stated that the bum unit at Chico Memorial Hospital would not be there without the Agency. Offices are rented to Durham now at about one-third the cost as the office in Chico. He so id it was his understanding that Humboldt County has already approved the donation to the Agency. AM. Nickelson stated that $4,000 has been ploeed in the budget; this request would be in addition to fine amount in the budget at this time. Mr. Gilman introduced the three hospital adminfstrators~ .. Mr. Norden Ernest, Chico Community Hospital, set out the example of ho.w the hospital had benefited from this Health Services Agency. He explained the additions that have been made to the Chico Community Hospital. Additional bed units have been built and the Agency worked hard in their efforts in obtaining these bed units. Explained the burn unit that they have at the hospital. Administrator Paul Hoff, Medical Center Hospital, Oroville, stated he hoped the Board would support their request for additional funds. Administrator Leonard Coy, Feather River Hospital, commented on the medical study. With the new program, the medical field will have guidance in all areas of health care planning. Page 23.
