Clif Nickelson, administrative officer, by Mike Pyeatt, assistant administrative officer; Del Siemsen, acting county counsel; and Clark A. Nelson, county clerk- recorder, by Nancy Wilson, deputy clerk. Absent: Supervisors Lemke and Saraceni Pledge of Allegiance to the Flag of the United States of America Invocation by Clsy Castleberry RECESS: The--Board recessedeat 9:06 a.m. to hold a closed session. RECONVENE: The Board reconvened at 9:14 a.m, after holding a closed session regarding litigation. There were no announcements at this time. The approval.-of the mnutes-of July 17'and 21, 1981 were continued to August 4, 1981, 2132 !APPROVAL OF ADDITIONAL AGRNDA TTEMS FROM BOARD MEMBERS TO BE ADDRESSED AT Supervisor Wheeler stated Mr. Lvelq has outlined a plan for Lure budget processes. She felt they should form a committee and have ch Board member and staff come back with a proposal after analyzing the terial. 2133APPROVE CBTA TITLE VI AND TITLE IV PHASEDOWN ANA APPROVE CETA ANNUAL PLAN On motion of Supervisor Dolan, seconded by Supervisor Wheeler and ed, the following actions were approved: 1, Authorized modification to CETA Title IV and Title VI programs s a result of .Congressional action, thus returning unspent funds in these itles to the federal government; there will be no impact to participants on he current program; and the Personnel Director authorized to sign. 2, Approved the CETA FY 81 annual plan modification permitting use Title IID and Title VI funds for.aervices to participants through private for placement agencies within the county; and the Personnel Director horized to sign and implement the program. 2134 PPROVE CETA ON-JOB-TRAINING PROGRAM Jim Rackerby, personnel director, set out the discussion regarding n-job-training program, Last year is was discussed having the program handle hrough the county rather than EDD, CETAC was unable to come up with a ecommendation to the Board which is outlined in his memo. It can be done n-house for less money and would not necessitate lay off of additional ounty employees and maintain the Chico office open, Rod Sandretto, manager, EDD, stated it was a tough decision, It as county vs, state employees. They have been doing the job for seven years. wring that period there have been no significant problems. They have not on.e to task for any breach of contract. They have developed the work and xpertise to provide the services. EDD has in the past .dealt with employees n a daily basis. They have contacted between 1,100 to 1,200 employees in utte County. If they do not handle the OJT contract, they will still be ontacting employees which will be duplicated by the county, d Page 77. July 28, 1981 81- b' July 28, 1981 T Rod Weyand, BCEA representative, stated he agreed with Mro Rackerby that the county should do the work and retain the five employees< James Hayes, Veteran representative on CETAC, stated he hated to see people laid off. EDD has done the _job for seven years with no complaintsa He strongly urged that OJT stay with EDD as it has in the-past. Supervisor Dolan stated she sat on the committee. She felt both the county staff and EDD staff had the expertise, ability and experience to handle it. County staff could do it less expensively, There would be no cast to the county to run the program as it is already funded, She felt it should be operated by the county. On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the on-job-training program through CETA to be operated by the County of Butte was approved, APPROVE PSYCHIATRIC TECHNICIAN INTERN?EitPiGRAM, RAPE CRISIS INTERVENTION AGREEMENT AND RELIEF FROM RESPONSIBILITY IN PROBATION DEPARTi+2ENT APPROVAL On motion of Supervisor Dolan; seconded by Supervisor Wheeler and carried, the following items were approved:. 2135 1, Approved the psychiatric technician intern program agreement with Yuba Callege to permit placement of interns in the Mental Health Depart- ment, interns will be non-paid but will receive 480 hours of clinic experience; and the Chairman authorized to sign, 2. Approved the Rape Crisis Intervention agreement in the amount of $7,000 to operate a program offering services to victims of sexual abuse within Butte County in 1981-82; and the Chairman authorized to sign. 3. Authorized relief from responsibility for fixed asset items in the Probation Department and Juvenile Hall as requested by Chief Probation Officer. ACCEPT INSPECTION SERVICES OFFER ON LIBRARX CONSTRUCTION PROJECTS Supervisor Wheeler stated there has been statements made by other departments that they have not seen the end of the funding for the librarieso That there are a great many hidden costso 213b Gerald Lively, deputy administrative afficer, stated they are not hidden. The financial plans show how it is set out in the budget, They are dealing with the limiting of the bonds. The funds for landscaping and permit fees were deferred from the bonds so there would be no out lay of funds for at Ieast 20 months. The inspection fees are not hiddeno They are immediate costs that will be for inspection which is the Boards insurance they will get a quality structure. The notice of procedure indicates there will be immedfate.construction. They need inspection from the beginning. There needs to be inspection at the site for compaction work beneath and above the ground. Their negotiations show they can provide professional inspection for only $3,000 per year which is cheaper than from Public Worlcs. This would include both libraries under one contract, After the Gridley library is completed, his fee per month would be reduced, There-was a motion by Supervisor Wheeler, seconded by Supervisor Dolan, to accept the offer of Fred Unfried for construction inspection services on the Chico and Griley library construction projects, appropriate the necessary funds with budget transfer coming forward next week; and the Administrative Officer authorized to execute the contract on behalf of the county subject to review by the Auditor and County Counsel,, Page 78. Mr,Livel~.., stated the inspector would be accountable to the Administrative Officer, They tell them immediately when problems are developing and they defer remedial action. If there are problems in the future it is handled in Superior Court. There are daily logs of tests performed. Vote on motion: AYES: Supervisors Dolan, Wheeler and, Chairman Moseley NOES: None ABSENT: Supervisors Lemke and Saraceni Mbtion carried. 21371 21381 21391 ', 21401 APPROVE DEPOSIT OF PAROUE ESTATES SUBDIVISION (CITY OF CHICO) On motion of Supervisor Wheeler, seconded by Supervisor Dolan and carried, the deposit of $1,277.40 by the developer for taxes or special assessments which are a lien, but not yet payable for the subdivision within the City of Chico was approved, CONTINUE TO AUGUST 4, 1981 - RULES OF NOTICE AND PROCEDURE, ASSESSMENT APPEALS BOARD The rules of notice and procedure of the Assessment Appeals Board was continued to August 4, 1981 in order for the Assessor to review them. APPROVE BYLAWS AND RULES AND REGULATIONS FOR BIGGS-WEST GRIDLEY WATER DISTRICT On motion of Supervisor Dolan, seconded by Supervisor Wheeler and carried, the bylaws and rules and regulations of the Biggs-West Gridley Water District pursuant to Water-Code Section 35305 were approved as updated, APPROVE AGREEMENT WITH EAITH A. LAUSTEN DBA ESPLANADE MANOR - MENTAL HEALTH There was a motion by Supervisor. Wheeler, seconded by Supervisor Dolan, that the agreement between the county, on behalf of the counties comprising the northeastern ten county mental health region, and Edith A, Lausten, dba Esplanade Manor, for operation of an enhanced 24-hour residential care facility in Chico in the amount of $91,000 for the period July 1, 1981 through June 30, 1982, funding is covered entirely by state revenues and additionally the state is providing $40,000 to the county to cover the local Mental Health Department's administrative costs in adtriinistering the.cok~tract, be approved; and the Chairman authorized to sign; and direct the Auditor to make necessary budgetary adjustments in Mental Health budget and revenue schedule, Mike Pyeatt, assistant administrative officer, stated Board members had received a copy of Mr. Musgrove memo. There is a question of litigation and liability costs. This involves patients from other countieso Jim Griffith, deputy county counsel, stated he had nothing to add to his memoo He had no recommendation to the Board, he simply gave a legal analysis and the ramifications. Mro Fyeatt stated every agreement that is brought to the Board has some liability. They try to cut that through hold harmless clauses. Dr. Ma,guise, Mental Health, stated if the contract was not approvedp individuals would be brought into the county without their approval, Once the patients are in the county they are stuck, This contract is not similar to the Creekside homed Page 79. LOGUE'S DEPOSIT ON DISPOSITION OF 2523 FORT WAYNE, 2510 FORT WAYNE AND 2567 ELGIN - HOUSING AND COMMUNITY EYEVELOPMENT Pat Osborn~~ Connerly & Associates, set out the background on the ', request to return Mr. Logue's deposit, The sale has not been executed to date. There-was delay in removing a mound of dirt from the sited fihey are ', requesting the $1,000 deposit be returned. T.tao sites are vacant and one has a structure which are within the 1978-79 target area. The original plan was to demolish themo They are requesting authority for the consultant to contact contractors for the one site and advertise to rent or sell that propertyo They would hold the other two sites until October 1982 as the grant has been revised, They want to-select a contractor to rehabilitate the structure. Supervisor Dolan stated that would be like the county becoming landlords as they would be retaining ownership of these parcels. Ms. Osborn stated it would be a temporary situation until they can find a prospects There is a considerable amount of pressure to spend the 1978-79 money and get it all completed, They would hold the two parcels until October and bring back a proposal for the Board, Page 80. July 28, 1981 81-2150 DISCUSSION: REQUEST OF 3u1y 28, 1981 ROBERT NEIL SCHLIESMAYER FOR INTERIM "AR-Mti" ON 3' PROPERTX IDENTIFIED AS AP 34-44-21 Discussion regarding the Robert Neil Schliesmayer request for an interim "AR-MK" on property identified as AP 34-44-21 was held at this time. ', Bettye Blair, planning director, stated the chief inspector from Public Works had submitted information regarding this request. The applicant applied in January 1980 and then withdrew the request for a building permit, Staff would be able to issue a temporary permito She was reluctant to give ', approval for an interim zone. A mobile could be placed on a foundation at this location pursuant to the requirements. There is no evidence of a permit issued for the septic installation. She felt the option was to apply-for the necessary permits to put a mobile on a foundation, if the mobile qualifies, There was a motion by Supervisor Wheeler to deny the request for interim "AR-MH" requested by Robert Neil 5chliesmayer. It was not necessary to make a motion. Ms. Blair stated they will be in contact with Mr. Schliesmayer and the Building Division will be contacting him on buildings that have been constructeda 2151 CONTINUE TO AUGUST 25 1981 - DEVELOPMENT AGREEMENT RESOLUTION - PLANNING Discussion regarding the development agreement resolution was held as continued. Bettye Blair, planning director, requested that the matter be continued as the Planning Commission might want to consider adoption of an ordinance or resolution. The Commission is looking at whether or not they want to review development agreements which are similar to "PA-C's". Continued the matter to August 25, 1981 for a report back from the Land Development Commission and Planning Commission. 2152 CONTINUE TO AUGUST 4, 1981 - CONSIDERAfiION OF OPPOSITION TO ASSEMBLY SILL 2074 (ROBINSON - CANCELLATION OF WILLIAMSON ACT CONTRACTS) Consideration of opposition to Assembly Bill 2074 (Robinson - cancellation of Williamson Act contracts} was held at this time. Bill Cottingham, Chico, spoke regarding what happened in the Williamson Act back in 19750 The contracts are much different from most ', contracts hat are signed, The Act was passed so agriculture lands could not be assessed at the whim of the Assessor or because of surrounding property selling fora high price, He owns land which is in the Act and some which is not in the Acto The better land is not within the Act. fihere is only $1 difference per acre. It is a low savings for such entrapment. Proposition 13 made the Williamson Act obsolete. There~is about one-fifth of total acreage in Butte County within the Williamson Act. Most of the area is araund Richvale in rice, row or orchard cropse Timber land was found to not. afford this and took action to be removed and are now within the TP zoneso Assembly Bi11 2074 z;has strong backing, He discussed property in Orange County that was under the Williamson Act. It is not th'e same act which was enacted in 1965. Supervisor Dolan stated she did not agree with some of his state- mentso The individual in Orange County is one of the largest developers in ', the county. In order to get out of the Act the Council must find consistency ', with the Chapter. Supervisor Wheeler stated they have directed staff to send the information to all local farm errti=ties and they have not received a report back. Page 83. He was not pro or con for the bill. Before they took action he hoped they would make sure they know what they are doing. ', He has copies of the other bills should the Board wish copies, The matter was continued to August 4, 1981 for consideration. 2153 CONTINUE TO AUGUST 11, 1981 - CONSIDERATION OF "CRITERIA LIST" TO DETERMINE THE COMPLETENESS OF APPLICATIONS IN ACCORDANCE WITH THE RECOMMENDATIONS OF __ Consideration of "Criteria List" to determine the completeness of applications in accordance with the recommendations of Government Code Section 15054e2 regarding CEQA time limits was continued to August 11, 1981. 2154 CONTINUE TO AUGUST 4, 1981 - PUBLIC HEARING: DAN HAYS, SR., APPEAL OF REQUIRE[~NT FOR AN ENVIRONMENTAL IMPACT REPORT ON A GENERAL PLAN CHANGE TO AN INDUSTRIAL DESIGNATION AND REZONE TO "M-1" {LIGHT INDUSTRIAL), AP 40-13-22, 23, AND 24 FOR PROPERTY LOCATED AT THE INTERSECTION OF PENTZ ROAD AND HIGHWAX The public hearing on Dan Hays, Sr. appeal of requirement for an environmental impact report on a General Plan change to an industrial desig- nation and rezone to "M-1" (light industrial),. AP 40-13-22, 23 and 24 for property located at the intersection of Pentz Road and Highway 99, south of Chico was held as continued, Earl Nelson, environmental review coordinator, set out the back- und on the project and the concerns brought up at last weeks meeting arding: traffic, aesthetic problems and fire protection. Prior to 1979 the area was zoned industrial, The matter was continued to August 4, 1981 at 11:45 aom. 2155 Bill Sands, Oroville, spoke regarding his letter listed under mmunications. He set out a few of his proposals for alternate budget is rather than cutting personnel, Mr. Sands set out several items ntained in his lettero He felt if he was running a private business, would try to plan ahead, He would know what type of income and what the tuation they would be faced with in terms of a budget, To .continue ving capable administration that would come forward with proposals that uld give the opportunity to make a choice other than people. That would the most cost saving. Supervisor Dolan stated the Board has said many times it was not soon. It is difficult to project Long range budgeting when you do not w what type of budget the State will be adopting. They try to acertain t inflation will be three years down the road. As a Board member she ws they do not look at cutting people first thing. They are providing Page 84. no action takeno Senator Ray Johnsono Senator Johnson forwards a copy of Assembly Bi11 75 relating to the continued use of studded tires and requests comment from the Baardo Referred to 1?ublic Workso RECESS: 12:02 p,ma RECONVENE: 1:36 pom, ~~l DISCUSSION: LONG RANGE DATA PROCESSING PLAN AND CONSIDERATION OF PROPOSAL TO AUTHORIZE THE ISSUANCE OF REQUESTS FOR INFORMATION (RFI) RELAfiIVE TO DATA PROCESSING SERVICES Discussion of the data processing long range plan and consideration of proposal to authorize the issuance of requests for information (RFI) relative to data processing services held at this timed Supervisor Wheeler stated after the presentatipn of Gillinger and Associates they were giving SCT a chance to respond to the long range report since they are directly effected, After the response,,there are points that need to be addressed, They need to sit down with Gillinger and the Data Processing Executive Subcommittee to discuss the mattero Representatives from SCT are also to be included, 2160 Joseph Staszak, General Manager, SCT, Mro Staszak appreciated the time to respond to the Gillinger report, Mro Parsons will speak on the costs and the impacto They entered into the contract with the county for a period of three years, They are bias because of maintaining their reputation as the largest grovider of facility management services to local government and higher educationo Mro Staszak set out the issues raised in his letter to the Board, Bili Parsons, SCT, Mro Parsons referred to Attachment A of Mro Staszak's letter, He discussed the attachment regarding cost to initial implementation of the Gillinger approacho From the requests of Gillinger it would cost an additional $300,000 or an increase of about 75 percent which is quite staggering considering the way Butte County finances are at present, Mxa Staszak stated the report indicated the county should alter. its method of acquiring serviceso They have heard this charge beforeo Their office conducted an analysis by!telephone callso It Cass found Butte County spent less per capita on data processing than other countieso He set out their recommendationse Supervisor Wheeler stated one of the problems with the Gillinger agreement was they wexe to discuss needs with legal counsel and the Executive Committeeo Maybe they were not fully aware of the new program that Mro Nelson discussed during budget sessions Mro Staszak stated he would be happy to work with the Subcommitteeo Ed Brown, assessor, stated he was to be a part of it, the Sub- committee did not work with Gillinger, They were given direction from Administration not to talk with the Subcommittees He felt that was unethical, Now they are trying to subvent that and they have SCT's reputation to deal witho This prablem will not be resolved by not following the direction set out at the Executive Committee meetingo Page $70 July 28, 1981 81- a. July 28, 1981 Carl Morton, treasurer-tax collector, statedTwhen the motion was made at the Executive Committee they recommended they hire Gillingero They were first honaring the point of the Granfl Jury Report, The second part of the motion was the Subcommittee would negotiate and direct the consultant in the process. That did not happeno Tt aborted the whole project from the start. In Section 2-6 of the Gillinger report he disclaims that point, When he questioned him about it fie was told Mr. Mickelson and Supervisor Wheeler told him not to-talk with Mr. Johansen or Mr, Brown; Supervisor Wheeler did not think they were going askew, The more information they can amass to make that decision for a long range plan is more valuable to Butte County. She was not trying to subvent that issue, They should tatEe all passible information through the structure of the Committee and people they hirer If it is a good structure she would like to think they can take the weight of this, They are department heads and computer users. They should be able to sit down with these people and arrive at a proposal plan that can be used rationally, It is a financial commitment they have to be very careful about makingo She stated .she never spent time with the consultant, She would never assume the authority of telling them to not talk to those department heads. ' Bi11 Houston, Oroville, stated they should do away with the computers and hire the bookkeepers that handled the work before computers, The problem with the county is they all have strings attached to us. He read from the Constitution of the United States. Back in 1976 the county started with a $31 million budget at the time of Proposition 13o Now it is $67 million which is more than i20 percent increase. He felt they should examine each item. He felt Mr. Castleberry spent too much money on equipment, Jim Johansen, auditor, stated his recommendation was to refer the information from the Gillinger study to-~ each of the study members,refer for examination of that and recommend coming back to the Board through the Executive Committee. Leave it open to the Committee's discretion, It is a provisional situation. Mr. Gillinger can respond to what they had in mind regarding hardware. Supervisor Wheeler stated she found a great deal of text book information in the report. She objected to the study and she made the statement she supported it not because it was politicalo She felt 'once and for all the situation would be solved. Supervisor Bolan stated she felt the Subcommittee should give them direction before they sit down with SCT and Gillinger. Mike Pyeatt, assistant administrative officer, stated a billing has been presented by Gillinger and Associates for payment of Phase I which included incidentals. What was the Board's decision on Phase TT? SUPERVISOR WHEELER ABSENT AT THIS TIME Jim Johansen stated he felt this was still a part of the consider- ation of Phase io 'The report raised some questions and they would like Gillinger to respond.
