Appeal of decision of Buttel~ounry Subdivision Committee rendered on July 23, 1475 concerning Parcel Number b2-53-30. tube heard September 17, 1975 at 10:00 a.m. 75-1353 REJECT CLAIM OF WARREN DOUGLAS KNUTSON On mot ono perv~sor ~ op, sew a pervisor Madigan and unanimously carried, the claim of Warren Douglas Knutson was rejected as it was not timely filed and the claim was referred to County Counsel. 75-1354 APPROVE REQUEST OF OROVILLE UNION HIGH SCHOOL DISTRICT FOR U5 F VETERANS MEMORIAL BUILDING ON MONTGOMERY STREET, OROVILLir FOR CONTINUA ION HIGH SCHOOL PURPOSES e rt anger, Business Manager of Oroville Union High School District, set out the background of the request of the District for use of the Veterans' Memorial Building on Montgomery Street in Oroville as a temporary facility for their Continuation High School. He stated that the State people from O.E.S. were up last week and they recommend that the students not use the old building. They could not detect anything wrong with the outside of the building but the problem deals with the roof structure. It was felt that the owner of the building should correct the problem. Their new building should be completed the end of October or first of November. Request discussed. Supervisor McKillop recommended that this be approved for a three months period of time while the new building is being wmpleted. The Purchasing Agent shoo Id work out the details of liabilities with County Counsel. Page 105. August l2, 1975 f.., ~* On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the Board approved the request of the Oroville Union High School District for the renting of the basement of the Veterans' Memorial Building on Montgomery Street, Oroville, as ateinporary facility for their Continuation High Schaal, for a period of three months, subject to the Administrative Officer looking at the building and determining that there will be no conflict in the use of the building. 75-1355 ADOPT RESOLUTION 75-121 INFORMING GOVERNOR OF COUNTY'S PLIGHT CONCERNING DAMAGES CAUSED BY THE EARTHQUAKE Supervisor Cameron comments on t e matter o t earthquake damages to the taxpayers of the County. Chairman Latlcl;aid he had a cpl! this naming from the Small Business Administration and they have declared this earthquake an emergency and they will make loans available to borrowers and they believe the loans will ba at the ~ratQ of 5% interest. There are people that cannot even afford the loans. Supervisor Richter asked how the County would be able to obtain help far these people. He felt it was an outrage that the County could not get funds to help these people. Supervisor McKillop felt that positive action should be taken in this matter. He felt that a resolution should be adopted addressed to the Governor of this State, indicating the County's plight and requesting h;s help. It was felt that the Governor could help the County in this matter. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously ~earried, Resolution 75-121 requesting designation as a disaster area __, addressed to the Governor, with copies going to our State Assemblypersons and Senators, was adopted and the Chairman was authorized fio sign. It was suggested that a letter of thanks be sent to the EI Medic Fire District for their door to door survey of their area concerning the damages that occurred as a result of the earthquake. 75-1356 CHAIRMAN TO SIGN LETTER TO CONGRESSMAN JOHNSON RE PAPERWORK REGARDING PROGRAMS FUNDED UNDER THE CETA ACT OF 1973 im c e y, rsonne erector, reports on t e after rom the U.5. Department of Labor, Manpower Administration Region IX, regarding their review of programs funder under the CETA Act of 1473. Mr. Rackerby feels that they have just been nit-picking. He explained the problem of the termination of the youth program, due to the delay in receiving Federal funds; it applies also fo the adult programs. The Region feels the County should change their accounting method. He explained the program and method of accounting. Mr. Rackerby read a letter addressed to Congressman 'Sizz "Johnson that deals basically with this subject. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the Chpinnan was authorized to sign the letter addressed to Congressman Harold "Bizz "Johnson regarding the CETA Act of 1973. Mr. Rackerby said That getting back to the problem of accounting, they have worked out a plan to use the cash report prepared by the Auditor. August 12, 1975 ~'`. /`~. =-=°.aco.aooo o a oan ~~~~~tf97~~ c. c n = ~ ~ eenc ~.co.. 75-1357 DISCUSSION: FOOD 5TAMP PROGRAM-MOTION TO DECLINE TO PARTICIPATE IN THE OUT-REACH PROGRAM Supervisor Cameron stated he hod a letter from the Nina Northern Counties Supervisors Association regarding a marxlated food stamp requirement. Margaret Mittel, Supervisor for Welfare Department, present to explain this out-reach program. Mrs. Mittel explained what they were doing to comply with this requirement. Representatives from their department are available for speaking engagements to give organizations the full details of the food stamp program. They work with E.O.C. and with Chico State University. Applications for food stamps are available at the centers. She explained who was eligible far food stamps and who was not eligible. Supervisor Richter felt the Department had been too successful fn informing the people of the program. Supervisor Cameron said that the action that was taken at the Nine Northern Counties Supervisors meeting was that they felt a letter should be sent b the President stating the County feels they are doing a sufficient job in this matter and that we decline to participate in their out-reach program. On motion of Supervisor Cameron, seconded by Supervisor Richter and unanimously carried, a letter was authorized to be written to the President stating that the County declines to participate in the out-reach program and that our Welfare Department is doing a sufficient job regarding the Food Stamp Program. 75-1358 REPORT: ACCIDENT ON RIVER ROAD AND REQUEST FOR SPEED LIMIT ON ROB 5upervisar Ric ter stated t re ad een a tern a accident on River Road yeste He would like to ask Pu61ic Works Department to hwe a speed limit set on this road ~ he travels the road daily. A speed limit of 45 miles per hour should be established was his feeling. This could be for the time that the revetment work was being done on the river. Mr. Castleberry said he would work with Highway Patrol on the matter. 75-1359 MATTERS PRESENTED BY BOARD MEMBERS airman re a after rom ar ton, Gounty Tax Collector-Treasurer, commending the Board on their leadership during the time of the earthquakes. He appreeiated the actions taken at this time. Chairman Ladd said he was proud of the County employees and department heads during this time of emersency. Supervisor Cameron commented on the help given by the local radio atatfon in their presenting the true facts of the earthquake. It was moved by Supervisor Cameron, seconded by Supervisor McKiDop and unanimously carried fhat the focal radio stations, particularly IG't'~ 6e commended on their giving out the proper information regarding the earthquake and the after shbaks. 75-1360 .iO1N ORANGE COUNTY IN THEIR ACTION REGARDING DECISION BY SUPERIOR COURT ~.+wun[an e.wa srarea rte naa rECetVea a leITBr rrom Vrpnge Wunry t3oaro Ot Supervisors regarding a court decision. He fait this Board should take action on the matter as the Superior Court decision might affect the Boards of Supervisors. This action was brought on when the Orange County Board of Supervisors determined that twenty-two investigators should be removed from the District Attorney's office and transferred to the Sheriffs Department. The investigators that were transferred did not loose any of their County privileges. It was felt that the Court's decision removed the Boards wntrol over the County budget. The Court felt that the Boards of Supervisors have been operating outside their realm of control. Orange County Boarci of Supervisors Page 107. Letter read and discussed. It was felt that County Caunse! should call the County Counsel of Orange County and then join them in their action. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the Board of Supervisors joined Orange County in their action protesting the unrightful decision of the Court. 75-1361 APPROVE GRANT MODIFICATION FOR CETA TITLE VI grant app ication as een prepare to imp ement t e plan of continuing all of the 239 public service employment positions for the wunty and its subagents through the remainder of this fiscal year. The CETA Title Vl grant is in the amount of $I, 629,272. On motion of Supervisor MclGillop, seconded by Supervisor Madigan and unanimously carried, the grant modification was approved and the Manpower director was authorized to sign. REGESS: 10;25 RECONVENE: 10:4A 75-1362 _,DISCIISSION: PARADISE LIBRARY BID5; CONTIN[;TED ONE WEEK Supervisor Richter stated that he was concerned that the Board would consider building this library in light of the damage caused by the earthquake. He feels that i£ the Board were to award this bid, it would be an acC of irrespanaibility. FTe feels that the board might have to raise the tax rate to cover the damage and feels that the board should definitely not award the bid. Supervisor Cameron stated that he had not pressed the matter of the bid lest week to enable the supervisors to assess the damage caused b~rthe quake. He has looked at the damage. It doesn't appear to him that Chere is so much to be done that the ]ibrary can't go ahead and be built. Supervisor Cameron stated that he didn`t feel that the Board would ever get s bid below the estimated amount again and feels the Board should go ahead with the plane. Supervisor Cameron moved that the Board award the bid for the Paradise Library to Harold Wellborn. Supervisor McKillop stated that he concurs with Supervisor Cameron but would like to wait another week to study the damage further. He questioned• Mr. Castleberry about the time limit on awarding the bid. Thin was not in the contract but Mr. Castleberry feels he could get the contractor to give the Board some extra time on it. Supervisor Richter restated his objections to continuing thin matter. Supervisor McKillop doesn't feel the Board should start new pragrame sad abandon the old ones. Chairman Ladd ouClined the steps the Board has taken in this matter. He feels that the Board should either build new or wait at least four years. He feels to do it within two or three years would be short sighted and would cost the Board much more money. Supervisor Richter responded to Chairman Ladd's comments. I+Ir. Mr. Castleberry is to contact the contractor about an extension of time. 75-1363 WAIVE FIRST READING OF SALARY ORDINANCE AMENDMENT The salary ordinance amendment has been prepared to implement the changes approved in the 1975-76 budget and Yo adjust classification of several vacant positions. A copy and explanation of the amendment was forwarded with last week's agenda. Mr. Rackerby explained that this concerns 7 2~3 new positions. Five of these positions are ones currently vacant that are being classified downward. He also informed the Board that the entire salary ordinance has been renumbered to correspond with the budget. Chairmen Ladd questioned Mr. Rackerby regarding several positions is the amendment, including the pay for the pharmasiat. He has contacted a few on his own and they stated that this amount was high. Mr. Rackerby explained the survey their office had done. Same people contacted refused to give them the information. He will give Chairman Ladd hie information from the survey (not far public disclosure). Chairman Ladd also questioned about the positions for the building department. Mr. Rackerby stated that these were increased because the work could not be done on a partrtimetbasic. Chairman Ladd also questioned about the attorney rating and the animal control officer. Supervisor McKillop questioned 12r. Rackerby concerning the reclassification study. This is being studied by the departments. Oa motion of Supervisor McRillop, seconded by Supervisor Cameron and unanimously carried, the Board waived the first reading of the salary ordinance amendment. 75-1364 APPEARANCE: KARL HUNN, PARADISElAUTHORIZE LETTER CONFIRMING LEGAL LDT Mr. Huhn give the Board members information to follow as he read the letter he had sent to the Board earlier in the day. This concerned a problem regarding the access to his property and his ability Co obtain a building permit. He would like for the Board to give him a letter stating that this is a legal lot so that he will be able to get a building permit when the time comes. This problem also applies to Jim Carter, who bought an adjacent lot. Mr. Blackatock stated that the problem arose when a large parcel was split into three smaller parcels and some mixup evolved.from this split. This information was explained in Mr. Huttn's letter. Mr. Black stock stated that the Board could have the man proceed through the certificate of compliance procedure or could simply great his request for a building permit. Mr. Hunn stated that they do not need the permit now as they are just buying the property. However, they want to be sure that in a year or so when they are ready to build, they can get the permit. Supervisor Cameros didn`t feel the Board should have this man pay far the certificate of compliance procedure. Mr, Blackstock stated that this is necessary only if Mr. HiEnn would like to have something he cos record. Discussion. Mr. Lawson examined the material Mr. 'Nunn had and stated that it appeared to him that there was ao problem with the lot. Page 109. It was suggested that the Board should write a letter to this effect. On motion of Supervisor Cameron, seconded by Supervisor Madigan and unanimously carried, a letter was authorized confirming the legality of these. Iota and the Chairman was authorized to sign. 75-1365 APPEARANCE: MARGARET CALDWELL. MEALS ON WHEELS PROGRAM, PARADISE Margaret Caldwell, Meals on Wheels program, read a letter to the Board reporting on the program and thanking the Board for their help in establishing the program. Supervisor Cameron atated that he was happy that they thought to give the Board a report on their progress. He wishes more organizations would do this. He thanked Mrs. Caldwell for her report. 75-1366 PUBLIC HEARING: S.G. EVANS, JR. REZONE FROM A-2 TO R-3, PROPERTX ATED AT MORSEMAN AVE. CHICO• MATTER REFERRER BACK TO PLANNING COMMISSION The public hearing on the S.G. Evans, Jr. rezone from A-2 (General) to R-3 (Medium Density, Residential) for property Located on the east aide of Morseman Ave., approximately ~ mile north of Lassen Ave., containing 14.5 acres, Chico, was held as advertised. Hearing opened to the public; Appearing: San€ord Evans, Jr., Chico. Mr. Evans gave the Board members copies of the map showing the proposed area. They would like to establish a permanent R-3 zoning is order to build triplexes on the property as they have done on San Gabriel. Mr. Evans atated that they have received no public opposition to this rezoning. This rezoning would allow them to place nine unite per acre, which ie three triplexes per acre. The property would not be on city sewer or water. They are within the proposed drainage district, for which they have already granted an easement. Supervisor Richter atated that he was concerned with the report from Planning stating that this is not in Conformance with the general plan. He wants a definite line net on how fare-high deaeity dwellings are going to be allowed. He suggested an R-2 zoning. Mr. Lawson stated that the Planning Coum:ission has discussed this. Chairman Ladd atated that other counties have restricted the R-2 zone with an amount of footage attached, such as R-2, 5,000 ft. This has also been considered by the Planning Commission. Supervisor Richter suggested that this be sent back to the Planning Commission with a recommendation for R-2. S.G, Evans, Sr. explained what they plan to do with the property. They do not want to put up multilevel, high density structures on their. property. Mr. Evans explained the problems they will have developing their property if it is zoned R-2, such ae having to drill wells. Hearing closed to the public and confined to the Board. Supervisor Richter staked that the area is low density residential. The Board has no assurance that the land will be developed as represented by Mr. Evans and for this reason, he would prefer a R-2 zoning. Page i10. August 12, 1975 ~' A Supervisor Richter moved and it was seconded by Supervisor Cameron that this matter be returned to the Planning Commission for consideration of the R-2 zone instead of R-3. Chairman Ladd stated that he was concerned about the report from Planning. It implied something he doesn't believe to be totally correct. He hopes that they are not basing their decision on the fact that the Board upheld an appeal of an EIR requirement far this property. He agrees with Supervisor Richter that the R-3 ie the not the property zoning for this area. Vote oa above motion: Ayes: Supervisors Cameron, Richter, Madigan, McKiilop and Chairman Ladd; Noes: None; Absent: None. Supervisor Madigan asked that this be taken to the Planning Commission this week if possible to helg speed this along. Hearing opened to the public. Appearing: Robert Guth, McCain Aeaociatee, representing Mr. Sicklestee1.' Mr. Guth outlined their objections to the requirement of this EIR. They feel there has been inconsistency in determining the need for EIRe an the project. Mr. Guth explained that this is the last of the development of the Indian Meadows 5ubdivieion and there will be no more development. These parcels will have ' on mobile home unit on each. The land cutting and leveling will be minimal as it has been logged over and• there are several spuulines and landings left from that. Supervisor Cameron questioned Mr. Lawson concerning the negative declaration filed in 1974 on the original map. Mr. Lawson explained that this is fairly common as there is lase damage likely when big parcels are involved. The smaller the parcels in an axes, the more population allowed which results in a greater impact on the environment. Mr. Guth stated that they have submitted pare tests and other data to Mr. Toussaint, who indicated that there would be no problem. Mr. Lawson stated that this conflicts with a memo they received from the Health Department on the matter. Mr. Guth stated that Mr. Toussaint was at the Plannipg Commission hearing and acknowledged that what they had submitted was sufficient as far as the septic requirements. Hearing closed to the public and confined to the Board. Supervisor Cameron stated that he is familiar with the development and feels they have done a good job. He can see no reason for requiring the EIR at this time. He feels that having only ono mobile home unit per two scree (approximately) will create no problem. Supervisor Richter summarized his impression of this district. He asked the Board to let the voters decide whether the district should be formed and to exclude all those that do not wish to be in the district. Supervisor Cameron said he was going to go to a Steering Committee meeting on the 18th of August in Lake County. He will report back to the Board on the meeting. Bob Nicholson said he would like to know which of the Boarr! members are going to participate at the State Fair on August 29th, Butte County Day. Board members told Mr. Bosworth who would attend. Chairman Ladd said he had a letter that the writer requested b~ read. It is from James Rowe; he would like ro be on next weeks agenda. The letter is in regard to 'Your Bus" . Mr. Rr~w~ will be given time on next week`s agenda at II:00 a.m. Supervisor Madigan had suggested to Chairman Ladd that there be a better way of assessment of the damages caused by the earthquake. He feels that George Stamm could coordinate this. Suggested that maybe could get some of the civic organizations to participate in thts. Chairman Ladd said that the County should also prepare a plan to be used in the event of an emergency or disaster. George Stamm will be used for assessment of the earthquake damages. Supervisor Cameron asked Mr, Bosworth where the County was in the matter of the contract with Mr. Stamm. This will be discussed next week.
