Present: Supervisors Dolan, Moseley, Wheeler, Winston and Chairman Lemke. Invocation by Supervisor: Moseley APPROVAL OF MINUTES On motion of Supervisor Dolan, seconded by Supervison:and unanimously carried, the minutes of August 7, 1979 were approved as mailed. 1333 APPEARANCE: TOM STRUTHERS Tom Stru#hers, purchasing office, spoke in regardsko SB-374 the Holmdahl bill which would eliminate the :mandate.in'•.the:1aw for the+implementatian of 911 by 1984 which would benefit the county. It would also eliminate the 3/4.of .1% surcharge on telephane bills, if it passes it would end at the end of December. Having the 911 number is a desirable-; thing but it puts this county in dserinus funding positiono The initial cost of. the telephone system was $34,000 to'$40,000 to be ~colil•ea#ed through the surcharge:. It was noted that Shasta Caunty had expended a total of about $400,000 a year for dispatching services. 'The 911,. number is about the same cost as dispatching services. There was discussion on the great need for receiving help as rapidly as possible ~, On the inside cover of the telephone book there are 30 different individuals to. call and a person is not always sure ~ylrch~ .agency to call. 1334 SB 374 would allow the county on an individual basis to go to the voters and ask for a tax to subsidize 9l 1 with a 2/3 majority of the voters. The funds that have already been collected through the surcharge would go to existing 911 centers. $up.ervisor Winston felt they were better off without the State of California mandate . Chairman Lemke supports the removal of the mandate but hesitates to cut off any possibility of receiving the surcharge. He did not favor going back to the voters. He stated he favored Supervisor•_ Winston's stand on removing the' mandate position until we get the county street names worked out as"'f'it will cause more problems. A public hearing date of September 11, 1979 at 10:00 a.m, was set for County Service Area #59 (Park Vista streetlights - Chicol to reconsider the per parcel service charge as PG &E has advised that a need exists for an add- itional street light within the county service area in the amount of $74.36. ADOPT RESOLUTION 79-166 ESTABLISHMENT OF A REVOLVING FUND FOR TH E AGRICULTURAL COMMISSIONER On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, Resolution 79-ibb was adopted establishing a revolving fund for the Agricultural Commissioner in his Weights and Measures Division in the amount of $300 pursuant to Government Code Section 29320 et seq. and the Chairman authorized to sign. APPROVED AGREEMENT -BOND COUNSEL FOR SOUTH OROVILLE DRAINAGE DITCH PROJECT. (HCD) On motion of Supervisor Moseley, seconded by Supervisor Winston and unanimously carried approval of an agreement to retain bond counsel for the south Oroville drainage ditch project, costs for the service are contingent upon the levy of assessments and the sale and delivery of improvement bonds and the Chair- man is authorized to sign. APPROVE PROGRAM AMENDMENT OF 1979 HEAD-START AND POSITION RECLASSIFICATION. EOC On motion of Supervisor Winston, seconded by Supervisor Moseley and unanimously carried, approve the program amendment of 1979 Mead Start revising the personnel organization and accountability in order to strengthen services to low incpme fam,ilie the amendment represents no increase in the overall budget ;and authorize the ~1'iairman to sign. APPROVED PROJECT.PROGRESS-REVIEW REPORT IN ACCORDANCE WITH COMMUNITY SERVICES ,4DMINISTRATION. EOC On motion of Supervisor Moseley, seconded by Supervisor Dalan and carried, approved submission of the Project:. Progress Review Report for the second quarter in accordance with Community Services Administration guidelines and has been reviewed and approved by the Community Action Board and the Chairman was authorized to sign. ': Supervisor Moseley stated they were changing their meeting night so they would have time to prepare things before the Board of Supervisors meetings. APPROVED ACCEPTANCE.OF GRANT AWARD -.WEATHERIZATION SERVICES FROM STATE OFFICE OF ECONOMIC OPPORTUNITY FOR $45,429 On motion of Supervisor Mose ey, seconded by Supervisor Dolan and unanimously carried the acceptance of a grant award that has been received from the State Office of Economic Opportunity in the amount of $46,429 to provide weatherization services for an anticipated 120 homes (the granf mandates that a minimum of 58 homes will be served) and the Chairman is authorized to sign... Martha J. Davis -renewal of variance to sections 19-10 and/or 19-12 of the Butte County Code for placement of a mobi le home on AP 46-10-04-06, 1299 Humboldt Avenue, Chico area. The zoning is "A-2" and is approved for a period of one year. 2. William J. Parks -renewal of variance to sections 19-1D and/or 19-12 of the Butte County Code for placement of a mobi le home on AP 27-Ob-24, 6975 Citrus Avenue, Oroville area. The zoning is "A-5" and is approved for a period of one year. 134 APPROVED AGREEMENT FOR NURSING SERVICES BY THE PUBLIC HEALTH DEPART- MENT TO THE SUPERINTENDENT OF SCHOOLS n motion of Supervisor Winston,. seconded by Supervisor Moseley and unanimously carried the approval of an agreement for the provision of school nursing services by the Public Health Department to the Superintendent of Schools for $16,050 in revenue and authorized the Chairman to sign. APPROVED SUBMISSION OF MATERNAL AND CHILD HEALTH GRANT (79-000071 On motion of Supervisor Moseley, seconded by Supervisor Winston and unanimously carried the approval of submission of Maternal and Child Health Grant (79-00007) with the State Department of Health Services in the amount of $2,871 and will continue to cover a portion of the nutrition component of the program and authorized the Chairman to sign. Mike Pyeatt, assistant administrative officer, stated the funding was from Short-Doyle. Supervisors Winston and Wheeler stated they would like to look at the budget before voting on this matter. Mike Pyeatt was instructed to continue this item for one week. 1347 1348 1349 1350 APPROVED PUBLIC WORKS ITEMS On motion of Supervisor Winston, seconded by Supervisor Wheeler rind unanimously carried the following ;.Public Works items were approved: i . Quif claim deed -drainage easement. A quit claim deed for drain- age easement across Lot 26 of Stormes Subdivision No, 2, located off of Lower Wyandotfe Road, Oroville, to Virginia Wilmoth in exchange for a replacement easement was approved and the Chairman was authorized to sign the deed. 2. Final map for Almond Tree Estates Subdivision. Performance, labor and materials and maintenance bonds have been furnished to guarantee construction of required improvements to county standards'on the 52 lot subdivision, AP 44-38-01, located on the west side of Morseman Avenue, Chico were approved and the Chair- man authorized to sign the subdivision agreement. BOARD IS IN OPPOSITION TO ASSEIv16LY BILL:_2 {HERMAN) Dan Blackstock, county counsel, set out the background on Assembly Bil! 2 relating to ten percent public bail system. It is a bill that would put the county in the bail bond business in the sense- that it would reduce the present bond to 10% of what it is now. Such as in a drunk driving case::of $400;0 $500 the bail' is_•now:$50:dnd; with-£he 10% change it would only cost $5. The bill would be allowing people to just post this amount and sign something guaranteeing they wi 11 pay or_the county wi I I have to collect. On motion of Supervisor Winston, seconded by Supervisor Wheeler and unanimously carried the Board is in opposition to Assembly Bill 2 (Berman). REPORT ON SENATE BELL 894 Dan Blackstock, county counsel, stated that SB 894 appeared to be just an extension of time on the General Plan. He felt that Butte County was' not in that condition to worry about. COMMUNICATIONS A. Clemons, Chico. A letter was received concerning possible zoning and health violations by Darrel Parsley on AP 47-26-165, located on the east side of Highway 99E near Keefer Road, Chico. This item was referred to Planning and Environmental Health on August 7, -1979 meeting. Latimer & Kenkel, attorneys at law. The attorneys write commending the service of Deputy Marshall Joseph Romeo. ADDITIONAL MATTERS PRESENTED BY BOARD MEMBERS Chairman Lemke had received a letter from the State Division of Water Rights and was to reply within 10 days, yet it had not been mailed for four days. PUBLIC HEARING: RON IMHOFF APPEAL OF THE PLANNING COMMISSION'5 DENIAL OF A PROPOSED NEGATIVE DECLARATION AND USE PERMIT TO ALLOW 231 UNIT MOBILE HOME PARI< ON PROPERTY ZONED "A-2" LOCATED ON THE SOUTHWEST CORNER OF SYCAMORE DRIVE AND HICKS LAND, AP 44-49-11, CHICO The public hearing on the Ronald Imhoff appeal of the Planning Commission's denial of a proposed negative declaration and use permit to allow 231 unit mobile home park on property zoned "A-2" (general) located on the southwest corner of Sycamore Drive and Hicks Lane, AP 44-49-11, Chico was held .as advertised. Del Siemsen, deputy county counsel, stated that this is not a negative declaration the Planning Commission had required an impact report and the agenda was incorrect. Page 42. It is a proposed mobile home park of 231 baits on 39 acres. There will be a 40 foot buffer fronting on 99. The present use is agricultural. The present impact includes conforming from agriculture to_ low agriculture use. The soil is nofi prime, it is vino clay loam. The primary impact is traffic increase and noise. A letter from Caltran indicates they feel a traffic signal should be placed by the on and off ramps. It is low density use and conforms with the General Plan. The other impact factor would be the drainage increase as 40°!0 of the area would be covered. There aredrainage facilities in the area that could accomodate the increase. There is a mobile home park adjacent to the property and agriculture uses throughout the area. There will be a public service demand such as the fire department and schools. The park is to be an adult park so it is felt there will be no great demands on the public schools in the area. Supervisor Dolan questioned the traffic I fight expense, Mr. Molcar stated the contractor was to contribute towards the I fight. The park would be within the Shasta Union Drainage District. , Bettye Blair, planning director, set out the background and stated the Board had copies of Planning Commission's minutes, staff findings and all other correspondence regarding the proposed mobile home park. Ms. Blair stated the use permit had been before the Planning Commission and they had required a draft impact report when it came before them in September 1978. Supervisor Dolan questioned if i t was within the Keefer-Garner study area. Ms. Blair said no. There is a park to the south that at this time is in the process of being developed. Hearing open to the public. Appearing: 1 . Jon Anderson, Chico. The engineer for the park stated they studied the area and newspapers as to what was .available. They felt this site was not good agriculture land and the soil was not prime. Concerning schools there was Shasta Elementary Schoo! District and closeby was McManus School which was under capacity and since this was to be an adult park this was not a major concern. He felt the traffic would not be of great significance that the Imhoff park would cause an increase of abaut four times what is currently being used. He questioned the recommendafions of staff concerning Hicks Lane and Sycamore Drive. They felt Sycamore Drive was a cul de sac. He has discussed this matter with Mr. Castleberry. Supervisor Dolan questioned the Sycamore Drive and Hicks Lane entrances. Mr. Ainderson stated the Sycamore Drive exit would not be used and it was to 6e barnicaded. Mr. Anderson felt the Shasta Union Drainage District could handle the flow of drainage . The existing soil is aidobe clay ~Ioam and the property currently has good run-off, it is going to be increased but they feel~it:wi;ll~not be a big prob! em . 2. Ronald Imhoff, Chico. He felt the impact report speaks for itself. They have redrawn the plans to back off the street so that the park will be surrounded by frame houses. The back will. have a two way gate, it is of a type that people Page 43. August' 14, 1979 74- a August 14, 1979 would have to drive through the wrong way and he felt they would not have the same type of problem other parks have been having recently. He felt this property was the number one choice and possibly the only use for it. They had picked this site so there would not 6e a number of impacts. The park next to their. property was in the courts at the time they started plans and wasn't available to them. They plan to leave 175 prune trees and did not feel it would be reducing the value of the surrounding properties. Mr. Imhoff stated they invited the neighboring property owners to write up their own deed restrictions. No one responded but the offer is still open. 3. Charles Bird, Chico. He was objecting to the park. He felt it was a loss of vital prime orchard land. He would object to any.:mobile home park in the area. 4. Tom Mann, Chico. He felt they would be putting six homes to an acres at the park and felt this was more than it should be. The mobile home park is consistent with the General Plan. 5. Don Curtis, Todd Court-Chico, He felt they should add to the impact report the traffic and schools. 6. DeVeFe~Pace, Chico. He has been living in a home near the proposed park for i5-20 years. He has seen a lot of changes and the orchard has had a'useful life and he would approve this project. 7. Clark Imhoff, Chico. There are five relatives working on this park. He commented on the different families in the area and stated they had received no objections from the people. This piece of property had a use permit issued for it before they bought it to develop a subdivision. The permit had expired. 8. Steve Raley, Chico. He stated he had lived in a mobile home for eight years and lived adjacent to a mobile home park. He sells mobile homes. Insurance companies have stated they are 1 .37% better than stick houses as a fire risk. They are equiped with smoke alarms, fire proof carpeting and draperes. Top quality people buy mobile homes. The price of houses are so high that people. are looking for more economical housing. Supervisor Wheeler stated there is a bill in the state legislature to tax mobile homes as a unit. 9. Joe Castle, Chico. Mr. Castle was concerned about the high energy consumption, large traffic flow and storm drainage. He felt it was going to lower the value of the surrounding property. 10. Doug Meyers, Chico. He was opposed to the park and expressed concern regarding the schools in the area. He had no objections to single family developments. 11 . Jay Garner, Chico. He is not opposed to this development. Garner Lane was named after his great grandfather. He believes we should preserve our farm land but he felt an individual should make the best use nut of the land. He felt that increased densities should be in an orderly manner and he felt this park was in this manner. Page 44. August 14, 1979 79- d ___ ___ Au_gust14,19_79_____ __ 12. Sue-Blizman Chico. Ms. Bli~an. was opposed to the park' because of traffic. She felt this area should be !<ept in one acre parcels as it now exists. When asked by Supervisor Winston if she would object to a single family area she stated no. i 3. James Magner, Chico. Mr. Magner stated that in the past year he has been employed to research the availability of mobile homes and parks in fihis area. He felt there was a great need for additional parks. This area was. going to be developed soon and felt a park was a good use for the land. He felt the proposed park is an exceptionally quality park and there would be i75 foot buffer around it. 14. Dexter Blindberry, Chico. Mr. Blandberry felt the traffic would be the same even 'if they did',not develop the park.-.:'They have met several times with the property owners in the area. They have built three mobile home communities in •~hico.7_ike parks in southern California. He felt the density would be the same. RECESS: 11:15 a.m. RECONVENE: 11:25 a.m. Mr. Ronald Imhoff introduced Dave Kalbac~h.. He is in real estate and Mr. Imhoff requested him to study the matfier when the Planning Commission turned down their use permit. i5. Dave Kalbach, Chico. Mr. Kalbac:hpresented a map to each of the Board members with certain areas colored and numbered. There were nine different sites including the Imhoff site. One site was a slaughter house off of Highway 32. What they look for in locating possible sites is a minimum of 30 acres, 40 acres is ideal. Some of the sites were too close in or too expensive. Mr. KalbacJn discussed the prices of homes today average in the upper $80,000 to $90,000 and the majority of people can not afford those prices. He discussed the concerns: involved when attempting to locate a mobile home sitesurch as traffic, drainage problems and schools. Today the Butte County ordinance states ten units per.acre primarily single wides are used to achieve this. Double wides or T-units ma!<es the density fall off. He felt there was a definite need in this area for mobile homes. 16. Don Curtis, Chico. He is a member of the Eaton Home Owners Association and hasspoker~Fo most of the people in the Hicks Lane and Eaton Road area during the past 8-10 months. He felt there was the appeal of the orchard and they realized they could not stop progress. An individual buying their home is still the largest investment they make in their lifetime. 17. Frank Blizman, Chico. Mr. Blizman would like to see one acre parcels. The real estate agents state there is a demand for one acres. He was concerned about the increase of traffic on Hicks Lance and Sycamore Lane. 18. Tom MciCready,Chico. Mr. McCready stated that to develop you must go to the north and east. There is a shortage of mobile home sites. There are limited areas in the "A-2" zones where you can place a mobile home. It is possible it will be subdivided if the park is not approved. Clay Castleberry, public works director, stated it would depend on whether the channel was man made or natural. Supervisor Wheeler stated everyone recognizes that it takes 37 to 40 acre' `parcels for agriculture land. The people have no objections to single family or subdivision so it appears that the people are opposed to a mobile home park and not to taking prime agriculture land. Supervisor Dolan stated she had read al! of the information very carefully from the Planning Commission minutes and felt they should uphold the decision of the Planning Commission. She felt it was the density not the location of the mobile home park. Supervisor Winston stated that from Mrs. Lamberts motion she based it on the fact the site was an orchard and they should preserve the agriculture land. Mr. Winston felt it was determined .that agriculture land was not the major concern of those objecting to the park. Supervisor. Dolan made a motion that the .use permit be denied on the findings of the Planning Commission . Motion dies for lack of a second. Supervisor Moseley felt there was a lot of talk about the wise use of land but it takes very little land for a retired individual or widowed person to take care of. She has a lot of friends and family who live in mobile homes who otherwise could not afford to own or were capable of handling more than an acre of land. Supervisor Dolan stated she would like a list of findings and the mitigation measures of the Environmental Review's impact report and conditions that would have been submitted had the Planning Commission approved the use permit. Dick Molcar, a nviconmental review department, set out the background on this appeal. It is a rezone of 40 acres on "TM-20" and "TM-40" to "TM-5". It is part of a larger parcel of 220 acres. There is "TM-5" zoning in the area. This parcel is located on the left of Forest Ranch most of the property is general moderate terrain. There is developable area throughout the project site. There is large deer habitat in the- area. There is high fire danger. It is four miles from electrical service. The 'Environmental Review Department suggests that the steep terrain of the property be deleted or zone to a different district. The Board has copies of the Planning Commission's minutes and staff find:,ingso Ms. Blair had posted a large map of the area, Parts of the area have 30°Io slopes orgreater. There are 16`to40 acre parcels. He stated that the northwest portion is "TM-5", however, there is a portion of "TM-40" to the east and west. That meets the "TM-5" basis. This was discussed in much more detail in the environmental review report. He feels that they are just trying 'to correct this error. There was discussion on parcels 4, 5, 6 and 7. Mr. Guth felt 7 was mar;.gina] and it should be out. When questioned about 4 he stated it was getting steep but it was buildable. In response to Supervisor Wheeler's question as to how many acres were involved in 5, 6 and 7 he sta#ed 15 acres, They are 5 acre parcels. Chairman Lemke question if the suggestion of the Environmental Review Department on parcels 5, 6 and 7 concerning the steep terrain could 6e acted upon or would it have to go back to the Planning Commission. Mike Pyeatt, assistant administration officer, stated they had been working with the people in the Gridley area concerning their ambulance service, Supervisors Winston and Moseley had talked with approximately twenty people in Gridley and it was their suggestion that a service charge be initiated, Hearing open fo the public. Ms. Prebble presented #wo petitions to the Board, One petition had 86 signatures on it and Ms. Prebble read from the petition_conccerning the closing of EI Paso Way. The petition was from residents (100%} requesting the closing of White Avenue or the opening of EI Paso Way. The seconded petition had 1,288 signatures and gave six reasons that EI Paso Way should be opened. Supervisor Wheeler stated that a citizens committee had been formed and they were discussing not only EI Paso Way but other problem areas in the north Chico area. She stated they were forming proposals to bring back 'to the Board and to the state. Supervisor Dolan stated they had not ignored the people and their problem they had been working on it. She stated there i~ad been a motion to bring it back before the Board after 90 days and it has not been 90 days since the closure. The closure was until the area and problem could be looked into, it was not a permanent thing. Supervisor Winston stated this matter was brought before the Board in 1978 and he felt that closing it for a couple months was not going to solve the problem . On motion of Supervisor Winston, seconded by Supervisor Moseley to rescind the action of closing EI Paso Way and open it to traffic.
