On motion of Supervisor McRiilop, seconded by Supervisor Cameron and
unanimously carried, the minutes of August 12, 1975 were approved as mailed with
the change of the hearing time for the Subdivision Committee appeals from August
26, 1975 to September 17, 1975 at 10:00 a.m.

75-20 disapproving the formation of the progosed County Service Area

Citq of Biggs. City submits its Resolution No. 19 establishing their tax rate

City of Chico. Mayor Stewart writes regarding a report from their Intergovernmental
Relations Committee. The City Council concurred with the recom¢nendatian
r I C•~ O that the Butte County Planning Commission hold a public hearing on the
City's new preliminary General Plan and they request the Board to give
consideration to this recommendation. See discussion and motion following
communications.
County of Yuba. The Yuba County Superintendent of 9~iaals sends two communications
Gt0 certifying amounts to be raised on the Sutte County tax rolls in fiscal "
0 0• year 1976-76. These are Regional Occupational Program and Physically
Handicapped Minors Program. (Referred to Auditor) Discussion; no action
taken.
Department of Transportation. Department forwards copy of Revised Regional
Transportation PlaaniRg Guidelines. A workshop for our region is set
~p O.otj up for September 3, 1975 in Redding and written comments on the draft
are requested prior to this workshop. Discussed and referred to Director
of Public Works.
Meladee Force, Chico. Request is submitted for consideration of appointment to

Cameron will transmit this request to the Mental Health Advisory Board.
Senator John A. Nejedly. Senator Nejedly writes regarding Senate Bili 632 and
sends considerable informational material on this matter which deals
/ d ~. L L with jail architecture and the requirements for individual detention
rooms which must be provided for each inmate. Discussion; Supervisor
Madigan stated that some counties have already made preparations for
this one cell per man.
W.B. & C.R. Richey, Long Beach. Appeal is filed to the Subdivision Commti.ttee's

John S. Freeman, Oroville. Mr. Freeman submits e..peCition for a variance to

Keith S. Humpherys, Chico. Request a time on the agenda to present an interim
zoning proposal for an area on Beil Road in Chico. This is the area
Q that Gary Hart has a proposed multi-wait project. He has submitted
a an appeal to the requirement for an EIR which is set for August 26,
r! 3• 1975. Chairman Ladd felt that this zoning proposal could be discussed
at the same time. Mr. Humpherys is to be notified Chat this will be
discussed on August 26, 1975 at 1:30 plm. in conjunction with the
Gary Hart hearing.
Jon Morehead, Chico. Mr. Morehead appeals the Planning Commission's decision
to require an EIR for a lot split northeast of Honey Run Road,
113,a ~ adjacent to Little Butte Creek. Set for hearing on August 26, 1975
7 at 11:30 a.m.
Magalie County Water District, Magalia. The district encloses resolution
fixing tax rate and also resolution providing for fire protection
services within the district for Board information. Diacusaed;•not

75-1392 APPROVE EXTENSION OF TIME FOR ORVEL ROLF'E PARCEL MAP
Letter received from Thiel Lippincott on behalf of Mr. Rolfe discussed.
Mr. Lippincott explained in this letter that they have experienced difficulty in
obtaining the necessary roadway. For this reason, they request an extension of
time on the map.
On motion of Supervisor Cameron, seconded by Supervisor Madigan and
unanimously carried, the extension of time on the Orvel Rolfe parcel map, AP
55-12-03 was approved for a period of one year.
75-1393 ADOPT RESOLDTION 75-124 MAKING APPLICATION FORCANNE2[ATION TO CSA ~k4
A request has been received from Harold and Pauline Hanrion of Simi
Valley for annexation to County Service Area No. 4 (Sierra Del Oro Drainage)
for AP 64-14-23. They request the Board to take the necessary action to send
this matter to LAFCo.
On motion of Supervisor Cameron, seconded by Supervisor McKillop and
unanimously carried, 8"esoluttdn 75-124, Resolution making applieation to Local
Agency Formation Commission for annexation of territory to County Service Area
No. 4 was adopted and the Chairman authorized to sign.
75-134_4 APPROVE REQUEST OF CITY OF CHICO RE CITY GENERAL PLAN
The City of Chico has requested that the Butte County Planning Commission
be 8uthorized to hold public hearings on their preliminary General Plan. Supervisor
Richter felt it would be appropriate for the Planning Commission to handle the
matter. Supervisor Cameron stated that widespread changes have been made in the
General Plan and that the Planning Commission should be given an undated copy.
On motion of Supervisor Richter, seconded by Supervisor McKillop and
unanimously carried, the Planning Commieaioa was authorized to hold public
hearings on the Chico General Plaa „said hearings to be held in Chico.
75-1395 APPROVE COMMUNITY ACTION'AGENCY GOVERNING BOARD ITEMS
Regional HEW has increased Head Start funding by approximately $18,000
and this budget submission balances our present budget tol,t3iati6igi~r~arcAlso
some revisions are necessary on the EOC budget because of previous Board actions
on cost of living increases, health insurance sad committal of carry-over funds,
and also to accurately identify program support services previously charged to
Central Administration.

75-1396 DISCUSSION: EVALUATION OF DAMAGE DONS BY THS AUGUST 1 EARTH UAKE
Supervisor Richter stated that he would like to see a detailed inventory
of the damage done in the county. He believes Chat this is the only way the county
will receive funds for the damage. EIe has been told by the OES people that they
will help the county if they can get such a list. Chairman Ladd felt that some
volunteer unite could do the work.
Pat Barry, EOC Director, stated that his office has been concerned
about the damage, especially that damage done to the low income houses. Several
agencies have been working together with EOC to evaluate the damage. They have
received help from FHA, the Red Cross and the County Public Works Department.
However, they have found that much of the property is below code and was this way
before the quake. Mr. Barry stated that the Red Cross can make grants for
damage but only as long se the~~ party has been turned down by the SBA.
Mr. Barry hopes that the Housing Authority will try to concentrate
their efforts in the areas that have suffered the most damage. He also requested
that revenue sharing funds be considered for thin.
Chairman Ladd suggested that a foxro be drawn up to be sent to all the
property owners in the area. This form would have places that could be checked
for the type of damage done, how much the damage is, and any other pertinent
information needed, He feels the people should be able to estimate how much
damage waa done to their property and that thA:$ would be considerably leas
expensive than doing a door-to-door survey. Mr. Barry stated that a lot of
information has been gathered already but he also feels a professional should
inspect the property to give a more accurate eatimata.
Discussion of using Mr. Stamen's services in this matter. Also discussion
of methods of handling the meilout. It was suggested that Data Processing could
run labels to be used on the forma.
Mr. Nickelson, Mr. Barry and Public Works are to work on a form and
try to bring it back to the Board next week.
75-1397 CONTINUATION OF HEARING ON BUDGET; ADOPT RESOLUTION 75-125 ADOPTING
ElCPENDITURES FOR FINAL BUDGET FOR FISCAL YEAR 1975-76.
Supervisor McRYi1oF moved add it was sew nded by Supervisor Cameron
that Resolution 75-125,~.reaolption adapting expenditures for final budget for
fiscal year 1975-1976, batadopted, setting the tax rate at $2.226 per $100
assessed valuation.
Supervisor Richter explained that he will not support this motion
as he feels the board ie deficit financing. He questioned Mr. Lawrence about
this, who answered that it is not deficit financing. Mr. Nickelson explained
that the reserve is large to handle situations like this ao that the tax rate
can be held stable. It is a serious situation that needs to be looked at
carefully so that it won't happen again.
Vote oa above motion: Ayes: Supervisor McKtllop, Cameron, Madigan
and Chairman Ladd; Noes: Supervisor Richter; Absent: None.
75-1398 WAIVE FIRST READING OF SALARY ORDINANCE RE JUSTICE COURT JUDGES
A salary ordinance has been prepared implementing the Board's decision
to affect equalization of salaries for three justice court judges when sitting

during their free time at the Oroville Justice Court. Two salary ordinance
amendments were submitted. Discussion of which amendment to use. It was Che
consensus of the Board that the amendment should be used whereby the judge
would receive his regular salary and the additional amount of $42.67 while
temporarily on assignment in another justice court within the county.
On motion of Supervisor McKillop, seconded by Supervisor Cameron and
unanimously carried, the first reading of the salary ordinance amendment was
waived,
75-1399 ADOPT ORDINANCE 1598 AMENDMENT TO SALARY ORDINANCE AMENDMENT
This salary ordinance amendment is to dmplament the changes approved
in the 1975-76 budget and to adjust classifications of several vacant positions.
On motion of Supervisor Cameros, seconded by Supervisor Madigan
and unanimously carried, the second reading of the salary ordinance amendment
was waived and Ordinance 1598 was adopted and the Chairman authorized to sign.
75-1400 DECLARE TRUCK SURPLUS FROPERTY
Public Works requests the Hoard to declare a 1960 Cabovex Ladder Truck,
Ford, surplus as it is unsafe far use and it does not meet Division of Industrial
Safety standards. It is considered good only for a trade-in.
On motion of Supervisor Madigan, seconded by Supervisor Cameron and
unanimously carried, the Cabover Ladder Truck was declared surplus and the
Purchasing Officer was authorized to dispose of same.
75-1401 AWARD BID"FOR RARADISE LIBRARY TO HAROLD WELLBORN
Supervisor Cameron stated that at previous meeting, concern had been
expressed that there would not be enough money to cover the damage to the county
buildings and to build the library. however, he feels certain that there are
many ways to get aids and that there will be no problem. Supervisor Cameron
feels there would be a great increase in coat of building this if it is put off.
Supervisor Cameron moved to award the bid for the Paradise Library to
Harold Wellborn for the amount o€ $398,364.
Supervisor McKillop asked Chat the motion be amended to state that
Mr. Wellborn must pay the prevailing wages for all portions of the construction.
Mr. Blackstock explained that they must follow the federal revenue sharing
regulations on these matters.
Above motion emended to include that prevailing wages shall be paid
according to revenue sharing regulations. Motion seconded by Supervisor
McKillop.
Supervisor Richter felt that other buildings is the county should
have first consideration due to the damage received in the earthquake. Supervisor
McKillop pointed out~tthat the library will ease the office space crunch at the
county center in Paradise.
Vote on above motion as amended: Ayes: Supervisor McKillop, Cameron,
Madigan and Chairman Ladd; Noas: Supervisor Richter; Absent: None.

75-1402 DISCUSSION: COUNTY INSURANCE PROGRAM
Mike Pyeatt explained that the county's fire and extended cavarage
insurance has been changed from $i00 deductible to $1,000 deductible. Thin
difference would amount to a savings to the county of about $17,000 in premiums.
Mr. Pyeatt stated that unleea the Board instructed otherwise, they would they
would authorize the $1,000 deductible coverage.
The second item ie the malicious mischief and vandalism policy. The
coat before was bstimk6ed~et $4,000. However, the actual cost would be $891
per year for $1,000 deductible, per occurrence. The insurance Barrier has
indicated it can be deleted at no extra charge. This is a Board decision.
Supervisor McKillop felt this item should be deleted. The policy
states that it is $1,000 deductible per occurrence and he doesn't think the
county incurs that much damage from vandalism;; There has been some damage to
Public Works equipment but this is covered under the automotive policy.
Chairman Ladd asked that Mr. Nickelson check to see if the County
ie coming out ahead on the $1,000 deductible coverage. Mr. Nickelson will do
this and stated that he will give the Board periodic reports on the matter.
The Board concurred that the malicious mischief and vandalism
insurance should be deleted.
The sprinkler system at the county library discussed. The insurance
carrier indicated that there is no coverage for leakage. Jim Glanders, Public
Works, stated that it is almost a fail safe system and ao coverage is needed.
Mr. Pyeatt stated that there is a vacancy clause in the fire and
extended coverage policy. If a building is vacant for 60 days, it is taken
off the policy. He is concerned about the storage of items in the vacant
buildings. The insurance would cover the contents and people in the building
but not the actual building. The county can save some money by deleting these
buildings. The storage coverage cam be kept, deleting the building coverage.
Discussion of cost for thin coverage.
Mr. Pyeatt will bring back a cost estimate on the storage next week.
This will be on the $1,000 deductible.
75-1403 APPROVE PURCHASE OF EQUIPMENT FOR DETOX IINIT
Dr. Enloe stated that they request authorization to purchase the
following: 1 Cushman food delivery vehicle (used), $1600; 2 Thermo Vat food
carriers with steam table pans, $250; 1 sofa, $350; 2 matching lounge chairs,
$320; 1 Home Style clothes washer, $300; and 1 Home Style clothes dryer, $250;
total, $3,070. They request that this amount be transferred from salaries and
wages to equipment.
Supervisor Cameron moved aad it was seconded by Supervisor McKillop
that purchase of equipment listed be authorized with transfer as necessary.
Mr. Lawrence stated that there was no reason to have a transfer aS
these items had been included in the budget. Dr. Enloe stated that he had not
been aware of that.
Chairman Ladd questicned about the food delivery system. He feels
something less expensive could be used. Dr. Enloe explained that it takes a

fairly large vehicle to carry the necessary equipment. Aowever, this has been
checked thoroughly and this vehicle is the moat economic method to use.

unanimously carried, the purchase of equipment listed with total estimated cost
at $3,070 was authorized.
75-1404 AUTHORIZE F'L'0'IMMUNIZATIONS AND CHARGES TO BS MADE
AB b0 provides 6,000 doses of flu vaccine to Butte County for people
60 years of age or older or those with a high risk condition. The 1,150 doses
left over £xom last year would allow the age limit to be reduced in Butte County
to 55. It is permitted to charge $1 for administration. Dr. Enloe stated that
this was very successful last year.
Oa motion of Sup ervisor McRillop, seconded by Supervisor Madigan and
unanimously carried, flu immunizations were authorized for 1975 for people 55
years of age~or older and others of high risk and that $l administration charge
be made and that authorization is granted to waive the charge in instances in
inability to pay.
75-1405 AUTHORIZE MEN'T'AL HEALTH BUDGET ADNSTMENTS
The state advises that additional allocations of Short-Doyle Mental
Health Plan monies far the 1975-76 fiscal year in the amount of $32,800 is available.
Programs proposed to utilize these funds are as follows.
The first is a psychiatric technician to work with the county school
system at a salary and benefit coat of $11,500.
The second is an early identification program for those incarcerated
at the jail. Thera is a need for counseling including drug and alcohol abuse
with a careening procedure Utilizing a licensed vocational nurse. This person
would be employed on an extra help basis with an expected annual cost of $2,000.
Chairman Ladd asked if this could be handled by someone else other than an LVN.
Dr. Enloe stated that this_ia not a checklist filled out by the pereoa but by
the nurse. She sake questions and then uses her judgment in filling in the
answer.
The third program is to beef up the medical follow-up of stablized
aftercare mental health patieate utilizing the additional state monies available
and this will be done by local physicians in the patients' community, reimbursed
through professional and specialized services. This program totals $18,5D0 of
which it is expected that 100% reimbursement through Medi-Cal will be realized in
the amount of $17,500 and the balance of $1,000 shared at the 90-10 ratio through
Short-Doyle. Dr. Enloe stated that this is necessary as there are fewer doctors
to refer these patients back to after they are released.
The final program is to cover travel expenses for members of the Mental
Health Advisory Board to their regular meetings and other meetings which was not
included in the budget and is projected at $800 per year. This also is covered
by 90-10 funding through Short-Doyle Program.
These program changes would be budgeted at a total of $32,800 with state
reimbursement through Medi-Cal or Short-Doyle in the amount of $31,270 and county
funding of $1,530. As mentioned above, some of these items are already covered
by transfers within the departmental budget.

On motion of Supervisor McRillop, seconded by Supervisor Madigan and
carried, authorization was granted for budget adjustments totaling $32,800
and for the Auditor to bring a budget transfer to the Board in the following
week reflecting these changes. Ayes; Supervisors Cameron, Madigan, McRiliop,
and Richter; Noes: Chaix~an Ladd; Absent: None.
Supervisor 17a~eron questioned Ds. Enloe regarding the contract with
the Bridge in Chico. This will be discussed at the Mental Health Advisory
Board meeting this Thursday.

75-1406 PUBLIC HEARING: AIR POLLUTION RULES AND REGULATIONS PERTAINING To RICE
STRAW• ADOPT ORDINANCE 75-1
Mr. Blacketock remind~l the Board that they are sitting ae the Board of
Direcoore for the $mate County AirrPollution Control District is this matter.
Hearing opened to the public. Appearing:
Dave Stratton, Air Pollution Control Officer, appeared to explain
the changes #n the rules pertaining to the rice straw. One change is :..
concerning strip firing or backfiring. Thin should reduce emissions by 3U
percent. There is also a change in the drying Cime.
Jack Willson, Butte County Rice Growers Association, read a statement
regarding their position on the changes. They feel they are restrictive but
can be used. They feel the air pollution officers and engineers have been
sensitive to the needs of the farmers in drawing up these rules. Mr. Willson
filed hie statement with the clerk.
Hearing closed to the public and confined to the Board at this time.
Chairman Ladd felt that the new regulations will add expenses to the
industry but since they feel they can work with 1t, he feels it ie a good
compromise.
On motion of Supervisor McRillop, seconded by Supervisor Richter sad
unanimously carried, Ordinance 75-1, amending agriculture burning guidelines
grosYfaiona pertaining to the burning of rice straw was adopted and the
Chairman authorized to sign.
75-1407 APPEARANCE: WTLLTAM WARD AND JAMES ROWE RE TAXI SYSTEM; ADOPT MOTION
OF INTENT
Mr. Rowe stated that Mr. Ward, an attorney from Chico, has agreed to
donate his time for this matter and will make the presentation.
Mr. William A. Ward, attorney with Watt, Leverenz & Ward in Chico,
outlined the problems of the senior cltizena. There sre people: such as Mr.
Rowe, who provide transportation at their own expense but this cannot go on
indefinitely. The senior citizens have indicated that they would be willing
to pay fifty cents per ride. Presently it ie $2.50 per mile far a taxi, and
when moat of the people Live on a $200-$250 income per month, they do not have
the moneq to spare for taxis.

There has been some concern that the syaxem would be abused by aoa-
eligible people, such as college students. Mr. Ward doesn't feel Chat will
happen as it won't be that convenient for the average person. He aaked that
the Board adopt a resolution implementing a subsidized taxi system is the
Chico area. He suggested an area to be covered which would be bounded by
Eaton Road, Skyway, Manzanita, and Highway 32. Mr. Ward also suggested Chat
use of this system be restricted to the aged and infixra. He also feels that
the City of Chico would be willing to share this coat.
Supervisor Richter thanked Mr. Ward £or his presentation. He stated
that he was very unhappy that no money was put into the budget for this matter.
He would like the Board to take action on the matter.
Supervisor McKillop felt the Board had considered it but that there
are no companies in the Chico area that will handle this. Supervisor Madigan
stated that there are two companies is Chico that have been approved by the
highway patrol and who are willing to talcs this on. He feels the City of
Chico should be contacted on the matter.

subsidized taxi system where there is a need in the urban areas of the county
for the aged and handicapped, aged being defined as over 62 yearn of age.
Mr. Rowe stated that he had been in contact with one of the cab companies
and had beam told they would do short hauls for $1150. Supervisor Madigan has
been in Couch with the attorney of two companies who indicated they would be
willing to participate.
Discussion of areas to be covered. It was indicated thin would not
be in the rural areas and Supervisor Madigan suggested that it be considered
on a yearly basis.
75-1408 PUBLIC HEARING: INTENTION TO ESTABLISH COUNTY SERVICE AREA N0. 55,
BERRY CREEK/BRUSH CREEK; ADOPT RESOLUTEON 75-126
The public hearing on the intention to establish county service area
55 was held as advertised. Supervisor McE31Iop explained that the proposed
area 1s basically the Pioneer School District.
Hearing opened to the public. Appearing:
Royal Mannion, U.S. Forest Service, explained that the forest service
responds to structure fires as a good neighbor policy but the men aren't trained
for fighting those types of fires. Their primary responsibility is wild land
fire .control. Their station in the area is closed during the mig.ter months
so there is ao fire control whatsoever. They are in favor of the service area.
Supervisor MclCillap questioned Mr. Mannion regarding the tax rata.
Mr. Mansion stated that a 25 cent rate has been suggested. Supervisor Cameron
questioned about what would happen if a countywide service area should be
approved. Mr. Blacketock explained that the present fire service areas could
be dissolved and included in the countywide area.
Supervisor McKillop aaked if there was any egssipment that could be
borrowed from the forest service. Mr. Mas~aion didn't think the tanker could
be loaned but that en old tanker might be available to the district.

75-1410 APPROVE CLOSURE OF HONBY RUN ROAD FOR SEPT. 25, 1975
Mr. Castleberry explained that there has been a request from the
Aoraeless Carriage Club to close weatbouad traffic on Honey Run Road between
Paradise and the bridge from 10:30 to 11:30 e.m. on Thursday, September 25,
1975. The highway patrol will oversee this matter. The group will not be
camping at the bridge.
On motion of Supervisor Cameron, seconded by Supervisor Madigan and
unanimously carried, the closure of Honey Run Road was approved as requested.

Mr. Castleberry explained that he would like authorization to attend

75-1412 APPROVE PUBLIC WQRKS ITEMS RE EARTHQUAKE DAMAGE
Mr. Castleberry requested authorization to send a letter regarding
the question of whether the replacement value or a portion that the state gives
to the county could be applied toward building in another area. He has
also prepared a resolution authorizing the Director of Public Works to sign
documents concerning the earthquake damage. Mr. Castleberry also has an
application he would like to have authorized which would apply for OES funds.
He suggested that a letter be sent to the men who had worked with the county
and city after the earthquake.
Mr. Castleberry stated that he feels the old portion of the jail
should be removed itnuediately. He suggests calling for bide for the
demolition of the jail and the older portion of the county administration
building. He hopes this can be done for salvage. Supervisor Cameron requested
that county personnel remove and salvage ae much as they can before this is
turned over to an outside organization. Portions of the old courtrooms had
recently been remodeled and he feels the county should be able to salvage some
items to use in the remodeling of the recently moved offices.
On motion of Supervisor McKillop, seconded by Supervisor Madigan and
unanimously carried, Resolution 75-127 authorizing the Director of Public Works
to sign concerning the Natural Disaster Assistance program matters; authorized
a letter to be sent as outlined above and authorized the application for funds
from OES.
Discussion of demolishing the vacanxtbuildings. Supervisor McICiilop
feels the whole thing, except the print shop area, should be torn dawn.
Chairman Ladd felt it would be premature to tear down the portion o£ the county
administration building. Supervisor Cameron felt it would be more advantageous
to consider a bid for the whole thing. Discussion. Supervisor McKillop feels
that Dave Davis could run the specs and get this ready for bide. Chairman
Ladd feels this should be placed on the agenda next week. Supervisor Cameron
asked that Mr. Cestleberry's men look at the possibility of salvaging whatever
can be used.

75-1413 DISCUSSION: OB CRISIS
Dr. Enloe reviewed the aewa release the Board had received from Enloe
Hospital regarding the OB problem. Dr. Enloe stated that there are about 20
women in the Chico area that are being referred out of the Chico area due to
unavailability of doctors. A auggeation that has been offered ie to send
a petition to the state explain#ng the problem is the county. Dr. Enloe stated
that part of the problem ie the malpractice insurance and another cause ie the
low reimbursement from Medi-Cal. The doctors that are still in the OB area are
not acce~iting new patients because they moat coQtiaue with the pregnant patient
the full nine months.

A proposal has been received to form a group to handle these cases.
However, the doctors are afraid that if they do form a group to handle OB
patients, they might be involved in as expense that theq cannot handle. They
are interested in entering into a~contractural arraagemenY with the county,
and not on a subsidy basis.
Chairman Ladd questioned if there has been a study done to see if the
insurance companies can justify the high premiums. He would like to know if
the increase is to cover settlements made in the medical field or if iC is
to cover bad investments in other areas. Dr. Enloe stated that this has not
been opened for viewing as yet. Supervisor Richter doesn't feel this is the
case. Discussion. Supervisor McKillop stated that he has talked with some
compariiea and there has been a loss of reserves due to the stock market.
Biscuasion of different methods of insuring doctors.
.Tim Lynch, Vice President of the Chico Chamber of Commerce, stated he
first got involved when a group of concerned citizens contacted him about the
'matter. As of now, there are 2 doctors handling about b00 patients. They have
had people trying to get information from the insurance companies but have not
gotten any satiefacotry results. Mr. Lynch stated that if nothing happens, there
is going to be a crisis as of November 1 when the rates go up.
Mr. Lynch explained that there is a bill pending that might lower the
rates but nothing can result from this bill for at least 18 months. Mr. Lynch
will try to get more information for the board,
Dr. Enloe will bring the proposed contract with the doctors back next
week for the Board's consideration. He feels the county will benefit from the
contract.

REQUIREMENTS, FOREST RANCH; REQUEST DENIED
The public hearing on the Grover Jones request for a 15 ft. variance to
the 50 ft. setback requirements oa Forest Ranch Way, to allow a 500 gallon
propane tank to be located 35 ft. from the centerline of Forest Ranch Way,
on property zoned A-2 (General) located on the southwest corner of Forest Ranch
Way and Robert E, Lee Drive, identified as AP 63-15-23, Forest Ranch was held as
advertised.
Supervisor Richter questioned Mr. Lawson concerning the denial. This
was denied on a 5-3 vote, 1 commissioner absent. Mr. Lawson didn't see any
hazard from having this variance permitted, however he didn't nee any hardship
in setting it back acoording to the law either.
Hearing opened to the public. Apgearing:
Grover Jones, Forest Ranch. Mr. Jones exglained that this is a lot
he purchased with his mother-ia-law. Each uses one end of the lotr she runs
an ice cream parlor and he runs a gas station. This variance is requested to
allow a propane tank. which will service his office and he will also be selling
propane. If it were placed•in the area where the topography would allow,
it would infringe on the parking lot of the ice cream parlor. To place it
behind the station would require excavating of a six to seven foot bank. Mr.
Jones presented a list of people approving the variance to the clerk.

Earl Duna, representing Baldwin Coaetruction, spoke regarding the deed
restrictions on the ptoperty. They have informed Mr. Jones by certified mail
that he may be violating the deed restrictions. They request that the Soard
follow the Planning Commission's recommendation.
Chairman Ladd stated that it is not the job of any county agency to
get imrolved in the matter of the deed restrictions. Supervisor McRYllop
felt that when a variance is requested, the deed reatrictiana should be
respected. Biscusaion.
Mr. Dunn stated that if the teak were for Mr. Jones' personal use,
it would be a different matter. However, since it is for selling, they oppose
the variance.
Mr. Jonas reappeared to state that this ie not a permanent structure.
Supervisor Richter questioned Mr. Jones about leveling a portion of his lot
to allow room to install the tank. Mr. Jones stated that it could be done but
it would involve moving a great deal of lead. Mr. Jones requested that someone
take a look at his property. Supervisor Madigan stated that he had viewed the
property. Supervisor Richter suggested that Mr. Jones look into the possibility
of building a barrier between the tank and the building. Mr. Jones stated that
he had not checked into this possibility.

Mrs. Blair, Planning Department, gave the background of the~.backgrouad
of the matter. She explained that the Board must make s decision as to whether
this is a subdivision. If the Soard finds that there is a aubdiviaion, then
they can proceed with a coaditioaal certificate. If they find there is no
subdivision, there ie legally nothing the Board can do to enforce the conditions.
If the Board determines there is no subdivision, the work Mr. Johnson and the
others have gone to in preparing theceagreemeats will have been for nothing.

Howard Johnson, Magalie, explained that he hoe several agreements to
present to the Board for compliance so that the matter can be solved. He
explained his involvement is this matter and the work he has done in trying to
settle the matter. He has been under the impression this is considered a
subdivision and that they have been working to get it up to subdivieiaa
standards. He explained the agreements he has been able to get signed. Mr.
Johnson explained that one of their main concerns ie that the county might
require the property owners to do afore than has been indicated to this date.
Mr. Johnson feels thaC Chey are close to having everything done as wan requested
by the Board in earlier meetings. He explained these. He requested that this
be continued so that the whole matter can be settled.
Discussion of the committee appointed to look at the matter and make

Brian Rix, Aeputy County Counsel, stated that he is concerned that
evidence has net been received as yet. He doesn't feel the Board should make ~.
a decision until it has. He also stated that the Board should find one way
or another regarding the subdivision matter. If the Board finds there is no
subdivision, they may issue the certificate of compliance. Discussion.
Supervisor McRillop moved that the Board find there is a violation of
the map act. Motion died for lack of second.
Discussion of procedure to follow. Mr. Rix feels that the Board should
receive evidence in the matter.
Phil Mace stated that he represents four people who own lots in the
area. He stated that one of their problems ie not kaowiag what the county is
going to require for compliance. Mr. Mace discussed his clients problems,
one of which is their contention that the county knew of the mai#re of the
division ~n February of 1973. His clients bought the property because all
indications were that the lots were legal. Discussion of time lag.
Mr. Johnson explained haw he came to purchase the property. He had
been told by county personnel that this appeared to be a legal lot and
proceeded on that basis.
Bob Stanley, Beveritt Inc, original owner of the property. He
explained that they are not prepared to present evidence on the matter at this
time. He explained that they would like to find out what eoaditians will be
put on the land, do them and then go through the procedure of getting the
certificate. Mr. Stanley feels this will solve the problem. Discussion of
whether the Board could vote ae to a moftats of intent regarding the conditions
that would probably be placed oa the certificate of compIltaat~.
Mr. Rix stated that if the people withdrew their appeal, the notices of
violation would be recorded. Discussion of this being done. Mr. Stanley stated
that their biggest concern is that they will do a lot of work on the improvements
and then have the county come beck and have them do much more. Moat of the
people don't have or want to spend that much money. Discussion of possible
solutions. Mr. Rix questioned Mr. Stanley as to hie authority to appear on
behalf of the Beveritt Inc. Mr. Stanley is an attorney and the secretary of the
corporation. He is qualified to enter into a stipulation regarding the matter.
Supervisor Cameron questioned Supervisors Ladd and McKillop as to
whether they agree to the conditions as outlined by Mr. Johnson. They do.
Mr. Rix pointed out that it is possible that the Board could get locked rota
these conditians. He explained the matter. He stated that the conditions appear
to be as required oa a tentative map. ;
David Olsen, Palm Springs. He has 11 acres in the area. Mr. Olsen
outlined hie ab~ectiona and the problems he has had in this matter. He feels
the Board should let Mr. Johnson continue working on the^matter.
Mr. Rix stated that he talked with Mr. Stanley end they are going to
hold an informat meeting to try and prepare a package for the solution of
this problem.
On motion of Supervisor Richter, seconded by Supervisor McKillop
and unanimously carried, the Board took the position that if the Board found
that there is a violation, the Soard would require the conditions one through
four as listed on the memo of February 27, 1975 addressed to the Board of

Mr. Toussaint, Health Department, stated that this proposed subdivision
was sent to the Water Quality Control Board end has received their approval.
It was explained that the water quality question wsa concerned with algae
growth in the streams.
Del Geddis stated that he was associated with 1.arwin when the study
was done. He stated that the k0~ estimate was a projection using many
variables. It was a pilot study and has been used as as example for other
studies. There has been nothing to substantiate that report by experience as
yet.
Supervisor Richter stated that he feels there is something to the
study and he will not support approval of this subdivision,

Mr. Lawson explained that the public hearing on this matter had bean
held last week. The Board had sent this back to the Planning Commission with
a recommendation of an R-2 zone instead of the R-3 as requested. Mr. Lawson
stated that the Planning Commission discussed it and held with their first
recommendation which wes to deny the R-3.
On motion of Supervisor Richter, seconded by Supervisor Madigan
and carried, Ordinance 1b00 zoning a portion of the couatq of Butte an R-2
(Duplex Residential) district was adopted, with the finding that this is
consistent with the General Plan, and authorized the Chairman to sign.

75-1421 APPROVE ACTUAL USE REPORT FOR REVENUE SIiARING
Federal regulations require the filing of an actual use report prior
to September 1, 1975 covering the 1974-75 fiscal year. This report moat be
Board approved first and then published in local newspapers and disseminated
throughout the news media and a certification must appear oa the report that
this has been done prior to filing. In preparing the report, the Auditor has
made a small switch in funding on two items with which the Administrative
Office is entirely in agreement. This is to use ACO funds rather than
revenue sharing funds for the Planning addition to the Public Works Administration
Building and the remodeling of the old county library for Data Processing. It
is felt that there are certain questions regarding these expenditures which
might cause problems and that it would be better to use ACO funding rather than
take the chance with revenue sharing funds.

On motion of Supervisor Richter, seconded by Supervisor McRd,llop and
unanimously carried, the Actual Use Revenue Sharing Report was approved, the
Chairman was authorized to sign, and publication and distribution to the
news media was authorized.
75-1422 APPROVE RESPONSES TO GRAND JURY REPORT_
Responses were presented to the Board last week for consideration. In
order to comply with the provisions of the Penal Code, it is requested that
the Board approve or amend and approve the reapoasas by department heads and
by Administration on behalf of the Board ao that they may be transmitted to
the Superior Ceurt in a timely manner.
Chairman Ladd listed his responses to the report, outlining his
thoughts on several. Oae was a garage for some equipment. He suggested
having this at the old county hospital. Mr. Nickelson explained that it
hen been suggested for the Durham area as this is where the employees of the
Sealer/Weights & Measures live and their office is in Chico. It is a
convenient coincidence that the employees are is the area where it would be
suitable to build the garage. Other recoumeendatione discussed.
Supervisor Richter commented on item 39 and discussed a California
Youth Authority report. $e also commented on Salabee's report which
discourages any additional juvenile halls being built. He feels this is
interesting after this county had been encouraged to build a juvenile hall.
On motion of Supervisor Cameron, seconded by Supervisor Richter end
unanimously carried, the transmission of xespanses to the Butte County Grand
Jury Report to the Superior Court im compliance with cede requirements was
approved with comments made by the supervisors and noted by Mr. Nickelson.
75-423_ DISCUSSION REPORT AND REC03~NUATTONS ON SPACE REQUIRE[~fENTS
As directed by the Board last week, a report has been prepared outlining
what is considered to be the minimum requirements for new construction necessary
a~,thie time to adequately house the county departments. A copy of this report
was enclosed with the agenda.
By Bosworth explained that they heed apace for approximately 105
employees. He discussed the employees involved, stating that he had left
out the CETA VI people but had included CETA iY positions.
Chairman Ladd questioned Mr. Bosworth regarding the positions Chat
need apace. Mr. Bosworth explained that many of the employees were in the
Assessor's office, some of which are still housed in the Ehmann building.
Mr. Bosworth explained that, after discussion with the department
heads, it was felt that the offices of the County Clerk, Recorder, Assessor,
Auditor and Treasurer/Tax Collector should be grouped together. Most people
go to more than one of these offices when doing their business and because
of the interaction of the offices themselves, it was felt there would be
greaC deal of inconvenience created if they were not grouped together,
Mr. Bosworth also discussed the storage apace needed for records
that are still used by the different offices. He stated that he had not
had time to compile a separate storage analysis.

On mooion of Supervisor McKillop, seconded by Supervisor Madigan and
unanimously carried, the claim of the California Stets Automobile Association
for lose suffered by David A. McIntyre was rejected.
75-1427 APPROVE LEASE AGREEMBNT WITH OROViLLE UNION RIGA SCHQOL DISTRICT F'OR
USE OF,MEMORIAL HALL
Mr. Blackstock questioned the Board as to the amount of rent they
want to charge the school district. Supervisor McKillop:felt they should pay
for the utilities and Chaixasaa Ladd suggested that there should be a clause
stating that they will remove their equipment within 30 days aftez termination
of the agreement.
The veterans groups have been contacted on this matter and these-.1a
no conflict with their activities.
On motion of Supervisor McItillop, seconded by Supervisor Richter sad
unanimously carried, the lease agreement with Oroville Union High School
District for use of the Oroville Memorial Hall with rent rate o£ $1 and with
changes as suggested by supersisors.
75-1428 APPROVE REVISIONS OP RESOLUTION 75-121 RE STATE OF EMERGENCY
Mr. Blackstock explained that the Resolution 75-121, resolution
