On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, the minutes of August 14, 1979 were approved as
mailed with the following amendments:
Minute Order 79-1368 to reflect that the hearing on the Gridley-
Durham address area was continued to August 28, 1979 at 2:00 p.m.
Minute Ori3er 79-1341 to reflect that Article 1 of the bylaw
changes as adopted by the Community Action Board changed the name of''Butte
County Economic Opportunity, Inc, to Community Action Agency of Butte
County, Tnc.
1372 ADOPT RESOLUTION 79-170 HARING APPLICATION TO LAFCo TN ORDER TO CREATE
COUNTY SERVICE AREAS FROM THE EXTSTTNG ETGHT STREETLIGHTING MAINTENANCE

On motion of Supervisor Winston, seconded by Supervisor Moseley
unanimously carried, Resolution 79-170 making application to LAFCo
order to create county service areas from the existing eight streetlighting
ntenance districts was adopted and the Chairman authorized to sign.
On motion of Supervisor°Winston, seconded by Supervisor Dolan
unanimously carried, the following budget transfers were approved:
B-05 - Community Action Program - Rural Senior Service Project.
Transfers $1,800 from in-kind contributions and $3,365 from travel,
together with project income from the Rural Senior Service Project in
the amount of $9,312 increase the appropriation to the following accounts:
salaries and wages, $7,112; fringe benefits, $443; consumable supplies,
$5,122; and matching in-ksnd contribution, $1,800. This increase-represents
fees collected from senior citizens through July 15, 1979 and was approved
by the State Department of Aging on July 6, 1979.
B-06 - Community Action Program - HEW (Head Start). Transfers
163.87 from other medical and dental to equipment in order to cover the
urchase of a recorder/player which was approved by the Board of Supervisors
n August 7, 1979.
1374 APPROVE POSITION RECLASSIFICATIONS AS REQUESTED AND CREATE NEW POSITION OF
OMMUNTTY PROGRAM COORDINATOR - COMMUNITY ACTION AGENCY CAA
On motion of Supervisor Moseley, seconded by Supervisor Dolan
and unanimously carried, the reclassification of Program Manager, Community
Services Coordinator and Community Services Aide were approved and a', new
position of Community Program Coordinator was created.

,PPROVE GRIDLEY SENIOR CITIZENS RECREATION CONTRACT - COMMUNITY ACTION AGENCY
On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the Gridley Senior Citizens Recreation contract
with $10,000 in funding committed by the City of Gridley and a seniors
share of the program cost projected to be $6,987.98 for a total program
ost of $16,987.98 was approved and the Chairman authorized to sign<

and unanimously carried, submission of the Head Start supplemental grants
.o be funded in the following amounts: 1979 program expansion, $33,195;
:ost-of-living increase - 1979 program (including 5~ retroactive pay

special health project, $4,2818 and handicapped grant - 1979 cost-of-
Living and expansion, $3,019 in the amount of $65,766 was approved.
APPROVED PROPOSED CHANGES TO COMMUNITY ACTION AGENCY PERSONNEL POLICY

On motion of Supervisor Moseley, seconded by Supervisor Wheeler
and unanimously carried, the proposed changes to the Community Action
agency Personnel Policy Manual were approved.
APPROVE FAMILY SERVICE ASSOCIATION AGREEMENT - MENTAL_HEAIaTH
On motion of Supervisor Dolan, seconded by Supervisor Wheeler
and unanimously carried, the agreement with the Family Service Association
~f Butte-Glenn Counties for screening services to become effective
Lu1y 1, 1979 with the maximum amount of monies to be paid in 1979-80
at $185,820 was approved and the Chairman authorized to sign.
APPROVE VILLAGE SQUARE CONDOMINIUM FINAL SUBDIVISION MAP
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and unanimously carried, the Village Square condominium final subdivision
nap was approved; public utility easements, drainage easements and road
easements as shown on the subdivision map and offered for dedication were
accepted; and the Chairman was authorized to sign the subdivision agreement.
On motion of Supervisor Winston, seconded by Supervisor Moseley
and unanimously carried, the highway easement from Southern Pacific to
provide for access across the Southern Pacific Stirling City Branch'right-
~f-way (MP CH 195e5) to Pasatiempo Mobile Home Park near Russel Drive,

Justeson be approved and the Chairman authorized to sign.
Del Siemsen, deputy county counsel, set out the reason for
she amendments to the Land Conservation Act agreements. This allows the
assessor to determine the taxes at the fair price or the capitalization
rate. This provision is provided in the law. The option must be approved

Xuba County Water District. The district, pursuant to Water Code Section

Kenneth C. Klassen, et al, Chico. A letter containing 22 signatures has
been received forwarding information and requesting the closure

State Office of Emergency Services. The department forwards information
concerning the county's participation in the Emergency Services
program for the period ending June 30, 1978. Information,• no

Governor's Office. Pursuant to the provisions of Elections Code Section
2651 a copy of the Governor's proclamation has been received
requiring that a special state-wide election will be held !on

negative declaration and use permit to allow two duplexes 'on

DISCUSSION: LETTER FROM LOUISE AHART RE: HER CONCERN OF A ROAD THAT HAS
BEEN BUILT THROUGH HER PROPERTY ON COE LANE
Louise Ahart spoke to the Board regarding her letter concerning
the road that has been built through her property on Cox Lane. Mr. ',Brown
did not contact her when he improved the dirt road through her property
on county deeded right-of-way 60 feet in width. This right-of-way was
designated on the map and there was no reference to it in the survey.
After a fence was built on her property the people,. were traversing in
a different location where the surveyor made the map. The county came
out and surveyed the property later. The Public Works Department was
reluctant to show her any files regarding this matter. She was informed
by County Counsel that sh@ had a right to see the files. There was''no
permit in the files for the road work on the county right-of-way.
Clay Castleberry, public works director, set out where the
area is located. There is a 1896 subdivision known as the Old Magnolia
Colony. There must be 80 to 100 parcels, that are not developed, and there
was a 60-foot deeded rightrof-way that goes through Ms. Ahart's property.
Mr. Bradley has bought the old subdivision and has a legal right to'dispose
of it. There may have been a descrepency between the map and the deed.
The road was always there and the gentleman received permission to
improve the road.
Ms. Ahart stated that if there are going to be people living
back in the area, there will be a real strain on the road as it is improved.
There is heavy rain in the area and the four inches of gravel will sink
into the ground. He has made a public report on the property next eo
her property. He has about 500 acreso She could not find the parcel
numbers as they have been retired. They are not on the county books.
The piece of property next to her's is not included in the public report.
Del Siemsen, deputy county counsel, stated that as far as
encroachment on Ms. Ahart's property is concerned that would be a civil
matter. The county would be involved only with the road.
Chairman Lemke advised Ms. Ahart to meet with Del Siemsen,
deputy county counsel; Clay Castleberry, public works director; Mr.
Bradley and Mro Martin to see if this matter can be resolved.
LETTER OF APPRECTATION TO BE SENT TO U.S. FOREST SERVTCE FOR THEIR
SUPPORT IN THE CETA PROGRAM
Supervisor Wheeler reported on the CETA tour that was hello
The project is to be commended.
Jim Rackerby, personnel director, stated that as a result of
the tour he talked with the Assistant Forest Ranger for Quincy. Heihas
asked if the Board of Supervisors would set up a no host luncheon for
the District representatives of the Forest Service to discuss management
of public land and CETA.
Mr. Rackerby to set up the luncheon.

On motion of Supervisor Wheeler,. seconded by Supervisor Moseley
and unanimously carried, a letter of appreciation is to be sent to the
U.S. Forest Service for their support in the CETA program.
DISCUSSION: MEETING SCHEDULED WITH SENATOR JOHNSON RE: REQUEST THAT
HIGHWAY 99 FROM COUNTY LINE TO GRIDLEY BE INCLUDED IN FIVE-YEAR PLAN
Supervisor Moseley stated that the meeting with Senator Johnson
to discuss the Highway 99 situation was scheduled for August 29, 1979.
Feur of the Board members have expressed a desire to attend the meeting.
She wondered how this could be arranged.

Chairman Lemke stated that he had received a letter from the
Chico Greater Chamber of Commerce in support of Nowcasting.
Chairman Lemke advised that he had received a letter from the
White House regarding energy conservation. Copies of the letter are to
be made and given to the Board members.

ADOPT RESOLUTION 79-171: PUBLIC HEARING: RALPH D. DROWN - ABANDONMENT OF
A PORTION OF V-4 'ROAD
The public hearing on Ralph D. Drown abandonment of a portion
of V-4 Road was held as advertised.
Bettye Blair, planning director, set out the background of
the abandonment. Tt is in order with one exception. North Burbank
Utility District has requested that the public utility easement be
retainedo
Hearing .open to the public. Appearing: Ralph Drown. Mr.
Drown stated that he was surprised that this road had never been abandoned.
He was under the impression-that it had been abandoned. He requested
an abandonment for 222 feet of the northeast right-of~way which was,
approved. His neighbors requested that he continue the abandonment.
He did not object to the retaining of the public utility easement for
North Burbank Utility District.

Chico was held as advertised.
Del Siemsen, deputy county counsel, stated that the ETR was
prepared and certifiedo The Board can adopt the ETR as applicable at
this time.

the rezone. The Planning Commission recommended approval and found 'that
the rezone was in conformity with the General Plan.

1394 PUBLIC HEARING: JESS BRASIER - APPEAL OP ADVISORY AGENCY'S CONDITION 5
ON TRAVERSABLE ACCESS STANDARDS FORA TENTATIVE PARCEL MAP, AP 71-08-95,
96 AND 97, NINE PARCELS, 20 ACRES OR MORE EACH, LOCATED IN THE BIDWELL
BAR AREA.
The public hearing on Jess Brasier appeal of Advisory Agency's
condition 5 on traversable access standards for a tentative parcel map,
AP 71-08-95, 96 and 97, nine parcels, 20 acres or more each, located: in
the Bidwell Bar area was held at this time.
Clay Castleberry, public works director, set out the background
of the appeal. These are 20 acre parcels. There are nine parcels.!If
a parcel is 20 acres it can be under the tentative parcel map procedure
if there are more than five parcels. The Subdivision Committee put on
subdivision standards. The condition that is being appealed is the
requirement for a 20-foot road with 4 inches of gravel the full width.
He understood that the applicant wanted this to be one standard down to
be gravel where necessary 16 feet wide, The road is about one mile 'long.
This road will serve nine new parcels. There is no problem with the
zoning. He recommended that the Board stay with the requirement that
was placed on the map by the Subdivision Committee. If there were four
lots he would say the lower standard was more appropriate, but it is
nine lots.
Discussion of the road an the Thomas property held at this
time. Mr. Castleberry stated that the road is 16 to 18 feet wide and was
created by an illegal land division and a settlement was made with the
District Attorney.
Supervisor Winston stated that the road was built by the state.
Hearing open to the public. Appearing:
1. Jess Brasier. Mr. Brasier set out the background of what
has happened since he has owned the property. He made a point of having
the parcels over 20 acres so that he could obtain a parcel map and have
the requirements more lenient. The ground is fairly steep and would
restrict future divisions. He looked at the requirements for subdivisions
and came up with the RS-8 road standard. He spent about $15,000 for
the road work that has been done. This was for one and one-half miles
on his property and one mile on the early subdivision. He presented some
pictures to the Board showing the road work that has been done to date.
He received a letter from Public Works dated July 13, 1979 saying that
ondition ~~2 was two way traversable access RS-8 LD-1 road standards.;
This is a 16-foot road. When he attended the meeting the condition was
changed to 20 feet. wide. Some of the cuts in the road are 40 feet deep.
His brother wants to build a home on the same parcel that he will be
building a home on. He understood in the A-2 zoning that more than !one
dwelling could be built. The bridge is on the state right-of-way.
Due to the fact that some of the property is over 30% slope, they cannot
go to small on the parcels,
2. Mike Evans, Ron Graves and Associates. Mr. Evans stated
that the map is designed so that the slopes are given their prorata''share
of the ground. Some parcels could be split. There is a 60-foot right-of-
way. The road has some big cutbacks. In many places it is over 16ifeet wide.

There are turnouts on either side of the bridge as it is a one lanelbridge.
When the parcels are 20 acres or larger there is usually a lesser standard
involved,
Clay Castleberry, public works director, stated that a note
could be placed on the map that any further divisions will require a
higher road standard. This property is dividable.
Mr. Evans stated that the road has been there for years. 'Mr.
Braiser has upgraded the road, He is a road builder and can take care of
most of the problems. Some of the .parcels could be split and some could
not be split.
Bettye Blair, planning director, stated that the map was found
in conformity with the General Plan. Based on the large parcels and
dealing with the "A-2" zoning, to base a decision that is less than the
standard requirement is a little bit hazardous. The "A-2" zoning allows
more than one dwelling with no review. The Health Department works with
two standards when a lot is subdivided and one with just another house.
She did not believe they were just talking about 20 acre parcels. It could
have a greater density without seeing the map again. This should be limited
to one dwelling per parcel until zoning is accomplished. The "A-2"'zoning
is wide open and the concerns for access are valid.

Supervisor Winston stated that there is no doubt they would
not like to see 30, 40 or 50 parcels created. The road is a very well
constructed road at acceptable grade. If someone wanted to create a
lot split in the future they could come back in for zoning and then'. the
conditions would be imposed.
It was moved by Supervisor Winston, seconded by Supervisor Dolan
that the appeal be upheld providing that the parcel map be marked in
such a manner that there be no further division of parcels and dwelling
construction will be limited to one dwelling per parcel.
Mr. BYaiser stated that the one dwelling per parcel would'.
prevent him and his brother from building on the same parcel as they had
planned.

PUBLIC HEARING: CONSIDERATION OF CITIZENS PARTICIPATION PLAN FOR HCD
The public hearing on consideration of citizens participation
plan for HCD was held as advertised,
Pat McI,afferty, Connerly and Associates, set out the proposed
citizens participation plan. During the last several weeks they have had
a lot of citizen participation in the block grant program. There is no
question that citizens participation at its best is a lot of worko~
The plan that is being presented to the Board is designed to be more
open than the program the Board has previously had. The federal regulations

require that the block grant program have citizen participation piano After
hearing comments that have been made, they went back and attempted to
review the plan. They felt they could do better. There are some weaknesses
of the committee. .There are two problems that exist. He believed that the
committee structure was invented by the decision makers to take the
pressure out. Based on that and on the feeling that the committees
operate by crisis, the plan that is being presented is not only in !.the
spirit put in excess of the letter of the regulations.
Mr. McCafferty set out the plan at-this time. Page 1 sets
out general standards far participation. This is informational.
This is an opportunity for the public to be involved at all stages of
what they are doing. The people must be informed. The pre-application
stage is the most important stage of the process. This is where the
program is defined, They are setting public participation forums on
a countywide basis. These will be informational meetings. Connerly
and Associates as well as the Administrative Office will be at these
meetings. He suggested that the Supervisor representing the district
where the meeting. is held also attend, He suggested that the Board hold
two hearings on the pre-application and one hearing on~the application.
They felt that they should go into the communities to hold these public
forum meetings.
Mr. McCafferty stated that they have developed a registry for
anyone who is interested to receive information regarding the program.
They will receive information in the mail. The Administrative Office
will prepare a quarterly progress report on the program. How to handle

to respond to them. He felt that this was an innovative approach to
having citizen participation.
Hearing open to the publico Appearing: Gail Kehoe, Chapmantown
Improvement Association. Ms. Kehoe read a prepared statement regarding
the citizen participatian draft. The association came before the Board
last month because they were pulling out of Chapmantown for the next
application. She would like to see the Board switch their efforts every
other year to the two different areas. They have asked that the Advisory
Committee meet on a regular basis. They are glad that the county x'ecognizes
citizen interest in the plan. The draft would be workable between tthe
a.tizens and the county. She was pleased to see that information will be
made available. She asked where the meetings would be held. She would
like to see more public notice of the meetings and the names and phone
numbers of the people to contact if there are any questions included in
the notice. It is beneficial to the county and citizens to allow for
proposals prior to hearings on the pre-application. She was happy to
see the use of quarterly reports on the program. The plan states that
one committee meeting would be held semi-annually. She would like 'this
to be more specific. She wanted to know when and where the documents
would be made available. She would like to be notified regarding the
program.
C1if Nickelson, administrative officer, stated that they were
talking about having some documents in the library in the area.
Ns. Kehoe asked that the information be furnished in the
elementary school libraries also.

and unanimously carried, because the Board has reviewed the contents of
the draft environmental impact report, the comments received thereon, and
the responses to those comments, the Board certified that the final.
environmental impact report has been completed in compliance with the
California Environmental Quality Act, the State EIR Guidelines and the
Butte County Environmental Review Guidelines.
On motion of Supervisor Winston, seconded by Supervisor Wheeler
and carried, the use permit for a 231-unit mobile home park (Imhoff-
Blindbury) on property zoned "A-2" (general), located on the southwest
cornner of Sycamore Drive and Hicks Lane, identified as AP 44-49-11 (portion)
and AP 44-49-01 (portion), be approved, finding that based on our own
knowledge and reasearch, and on information presented to the Board concern-
ing this project, including the final environmental impact report which was
considered in arriving at a decision, the project may have a significant
traffic effect on the environment; that the significant effect of traffic
can be reduced but not eliminated by the adoption of the mitigation
measure set out below and by this reference made a part hereof; further
finding that although the alternative of no project, as set forth in the
environmental impact report, could avoid the significant effects to'the
environment identified with this project, the alternative is not feasible
in that the property could develop in some fashion given the "A-2" (general)
zoning which permits almost all land uses, many of which are more intensive
uses than the subject project and could result in greater environmental
impact; Alternative No. 2, as described in the environmental impact report,
providing for relocation of the intended use near to Chico, would not
avoid or mitigate the impacts identified, but would only cause the traffic
impacts in another location in areas that may be less suitable and where
the traffic volumes already are nearer capacity; finding also that the
other alternative uses of the site, as described in the environmental
impact report, will not avoid or substantially reduce the significant

traffic effects since similar magnitudes of traffic would be generated; and
,further finding that, although the mitigation measures incorporated into
the project will not completely mitigate the signficant effects to the
environment, there are social and economic factors which justify overriding

need for housing of the type provided by the mobile home park, a positive
trend in the immediate neighborhood away from-the agricultural uses and
the fact that isolated agricultural uses surrounded by noncompati.ble'land
uses finding that the proposed uses will not impair the integrity and
character of the zone in which the land lies and that the use would not
be unreasonably incompatible with or injurious to surrounding properties
or detrimental to the health and general welfare of the persons residing
or working in the neighborhood or to the general health, welfare and'
safety of the county subject to the following conditions:
