Butte County Flexible Benefits Plan - proposed is a replacement resolution that coordinates elected and appointed officials retiring in good standing before age 65 with the County Flexible Benefits Plan - action requested - ADOPT RESOLUTION FIXING THE EMPLOYER'S CONTRIBUTION UNDER THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT AND AUTHORIZE THE CHAIR TO SIGN. (FROM 8-9-94) 2. Butte County Flexible Benefits Plan - upon implementation of the thirty-six hour work week, there was an agreement with the County's bargaining units to implement a flexible benefits plan. Proposed is a model addenda to the Memoranda of Understanding with the bargaining units and an agreement with Employee Benefit Specialists, Inc. to be the third party administrator for the flexible spending accounts. Kimshew Cemetery District - action requested - APPOINT MARCIA AVRAM TO FILL AN UNEXPIRED TERM ENDING JULY, 1998. 4. County Service Area No. 23 (Pleasant Valley Drainage District) - the Local Agency Formation Commission (LAFCo 94-36) has approved annexation to the county service area to provide drainage maintenance - action requested - ADOPT RESOLUTION 94-88 AND AUTHORIZE THE CHAIR TO SIGN. 5. Butte County libraries - Board authorization is requested to accept a Panafax 128M fax machine purchased through the North State Cooperative Library System in the total amount of $697.12 - action requested - ACCEPT FIXED ASSET ITEM AND APPROVE PLACEMENT ON THE LIBRARY'S INVENTORY OF COUNTY PROPERTY. 6. Adoption of tax rates - State law requires the Board to adopt various ad valorem tax rates not later than September 1 of each year - action requested - ADOPT RESOLUTION 94-89 FIXING TAX RATE IN THE COUNTY OF BUTTE FOR FISCAL YEAR 1994-95 AND AUTHORIZE THE CHAIR TO SIGN. 7. County service area service charges - in order to levy service charges in the various county service areas it is necessary to accomplish several prerequisite steps - action requested - DIRECT THAT A REPORT OF SERVICE CHARGES BE PREPARED IN ACCORDANCE WITH GOVERNMENT CODE SECTION 25210.77a AND THAT SAID REPORT BE FILED WITH THE CLERK OF THE HOARD OF SUPERVISORS; THAT A PUBLIC HEARING BE SET FOR SEPTEMBER 13, 1994 AT 10:30 A.M.; AND DIRECT PUBLICATION OF NOTICE OF HEARING IN ACCORDANCE WITH GOVERNMENT CODE SECTION 6066. Investments information report - the Treasurer-Tax Collector submits the July 29, 1994 report in accordance with the County's Statement of Investment Policy dated June 1, 1994 - action requested - ACCEPT FOR INFORMATION. 9. Adoption of an ordinance adding Section 2-26.2 to Chapter 2, Article V of the Butte County Code authorizing the north and south county judicial districts, from time to time within their respective districts for which each court is established, to designate locations within public and private educational institutions wherein their small claims divisions may conduct sessions - action requested - ADOPT ORDINANCE 3151 AND AUTHORIZE THE CHAIR TO SIGN. (FROM 8-9-94) 10. Resolution in honor of Sergeant Ronald E. Goates upon his retirement after 28 years on the California Highway Patrol - action requested - ADOPT RESOLUTION 94-90 AND AUTHORIZE THE CHAIR TO SIGN. 11. Bartkiewicz, Kronick and Shanahan, attorneys at law - proposed is a one year renewal of an agreement to retain attorney services to help on issues regarding the Green Rock Quarry. All work assignments are approved and monitored by County Counsel's Office - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 12. GC Services Limited Partnership - proposed is an agreement for a pilot program for a 24 month period to test the cost effectiveness of a private collection agency collecting unpaid fines and recoverable costs related to a defendant's failure to appear in criminal and non-parking traffic cases (to include civil assessments under Penal Code Section 1214.1). GC Services agrees to accept as full payment for services rendered a commission sum of thirty percent (30$) of the total amount collected for each account, not to exceed a maximum of one hundred and seventy five dollars ($175) for each account - action requested - CONCUR WITH THE MUNICIPAL COURTS' PARTICIPATION IN THE AGREEMENT, APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. General Plan Update Work Program - in March, 1994 the Board approved the Development Services Department's proposal to modify the existing General Plan Update Work Program. There is no fiscal impact stemming from this specific action. Accrued savings have been incorporated into available fund balances - action requested - APPROVE AMENDMENT NOS. 1 TO THE CONSULTING SERVICES AGREEMENTS WITH PSOMAS & ASSOCIATES, LCA ASSOCIATES, INC., OMNI-MEANS, LTD. AND ANGUS McDONALD & ASSOCIATES AND AUTHORIZE THE CHAZR TO SIGN. 14. Enloe Hospital - proposed is a contract for the provision of nursing services for the 1994-95 Options for Recovery Perinatal Program (fourth year of the program). The contract, in the maximum amount of $15,575 (STATE/COUNTY), provides a .30 full time Registered Nurse to work as a Nurse/Trainer for foster parents and natural parents of substance exposed infants and toddlers involved in the Perinatal Program in the Children's Services Division - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (FROM 8-9-94) 15. County of Siskiyou - under the terms of the proposed agreement, the Butte County Public Health Laboratory will perform laboratory examinations on selected specimens submitted by Siskiyou County, and reimburse Butte County for the cost of the testing in accordance with the current laboratory fee schedule - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 16. State Department of Health Services - under the terms of the family planning contract (no. 91- 12413), the Department of Public Health provides family planning clinical and educational services to County residents. Due to an extended staff vacancy, a portion of the available State funds will not be utilized. The proposed amendment (no. A05) reduces the amount of funding available to Butte County during 1993-94 to $124,304 (reduction of $12,500) - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. State Department of Health Services - immunization contract no. 92-15974 - under terms of the contract, the State reimbursed the County for the cost of providing selected immunization services to children in Butte County. The County has been reimbursed for all services provided - action requested - AUTHORIZE THE CHAIR TO SIGN CONTRACTOR'S RELEASE. 18. State Department of Health Services (no. 92- 16244) - proposed is an amendment to the agreement wherein the County's Health Department provides childhood lead poisoning case management activities under a contract with the State Department of Health Services. $17,613 in additional State funds are available that will be utilized to enhance the local efforts - action requested - APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO APPROVAL OF COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 19. 1994-95 Rural Health Services (RHS) application with the State Department of Health Services - the RHS Program makes available 100$ State funds of $285,428 (hospital allocation/$74,431; physician allocation/$21,682; other allocation/$23,767; and child treatment allocation/$165,548) that can be utilized by hospitals and physicians to partially offset the cost of providing uncompensated medical care to County residents. A portion of the funds is utilized to provide medical treatment services to children diagnosed with problems in the Child Health and Disability Prevention (CHDP) Program - action requested - APPROVE APPLICATION AND AUTHORIZE THE CHAIR TO SIGN. 20. State Department of Health Services - proposed are three declarations of intent with the State for administration of specific portions of the 1994-95 Rural Health Services (RHS) Program. The State will utilize a portion of the available RHS funds to cover its expenses at no cost to the County - action requested - APPROVE DECLARATIONS OF INTENT FOR ADMINISTRATION OF THE PHYSICIAN SERVICES ACCOUNT, CHILD HEALTH, DISABILITY AND TREATMENT PROGRAM AND ALL NONCOUNTY HOSPITAL FUNDS. Pacific Gas and Electric Company (PG&E)/County of Butte - proposed is an agreement for PG&E to install, at no County cost, a County owned and operated compressed natural gas (CNG) fueling station at the PG&E Corporation Yard, 11239 Midway, Chico. The agreement will also allow both County designated representatives and PG&E access to the facility, with PG&E to provide daily maintenance of the facility - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 22. State Department of Social Services - Child Abuse Prevention, Intervention and Treatment Program (CAPIT) (AB 1733) County grant renewal for July 1, 1994-June 30, 1997 in the maximum amount of $94,596 (1994/95), $94,596 (1995/96) and $94,596 (1996/97) - the AB 1733 Child Abuse Prevention Grant provides for a 100 State funded contract administered by the Department of Social Welfare and provided by a private non-profit organization for child abuse prevention services. Currently these services are provided by Parent Education Network in the form of parent education classes and in-home parenting services - action requested - APPROVE STATE GRANT FUNDING AND AUTHORIZE THE CHAIR TO SIGN THE COUNTY GRANT RENEWAL. 23. Statewide settlement for inter-county pipelines tax refund judgments and claims - owners of inter- county gas pipelines have obtained various judgments for tax refund claims - action requested - AUTHORIZE THE CHAIR TO APPROVE THE FORM OF SETTLEMENT AGREEMENT . 24. Amicus support - County of Butte's support in amicus brief filed on behalf of cities and counties in Rnott v. State of California. In Knott, the Court of Appeal ruled that a public entity was liable for the criminal act (murder) of its employee - action requested - BOARD SUPPORT OF THE AMICUS BRIEF FILED TO URGE REVERSAL OF THE COURT OF APPEAL'S HOLDING, AND AFFIRM THE TRIAL COURT'S HOLDING THAT PREMEDITATED MURDER IS BEYOND THE COURSE AND SCOPE OF EMPLOYMENT.
