August 24, 1976 _---_____==---J9u~ustl4 127====_-____ __ ___-__ 76-1432 ADOPT RESOLUTION 76-142 CONSOLIDATING BUTTE COUNTY HOUSING AUTHORIT` SPECIAL ELECTION WITH GENERALEL'BCT10N On mofiion of Supervisor McKi op, seconded by Supervisor Ladd and unanimously carried, Resolution 76-142 consolidating Butte County Housing Authority special election for purpose of submitting to the qualified electors of City of Oroville a proposition regarding the construction development and acquisition of low income housing was adopted and the Chairman was authorized to sign. 76-1433 APPEARANCE OF SUPERINTENDENT OF SCHOOLS TO O15CU55 OPERA~'ING BUDGET FOR SCHOOLS Duane owers, perintendrnt of Schools, was present to discuss the operating budget far Superintendent of Schools Department, Supervisor Richter stated he would like the letter clarified. Senate Bill 90 explained and discussed. Mr. Powers stated he did not think this department was irresponsible, as stated by the County Auditor. Services of County Counsel to the school districts explained and discussed. Tax rate discussed. Charges to this department set out and discussed. Dan Blockstock, County Counsei, explained the utilization of the services of County Counsel's office by the Superintendent of Schools. Budget discussed; no action taken. 76-1434 DISCUSSION: REGIONAL NARCOTICS TASK FORCE 8 REQUESTS OF SHERIFF Supervisors concerning the dissolvement of Narcotics Task Force. Fb. stated there was a Users Council meeting last week; the dissolvement of this task force left the other areas in limbo. The Committee is concerned about the fact that they have had no communications from the Board about the extension of the narcotics task force or the employment of the people working for the task force. It was stated that the task force could continue to operate within the Sheriff's Department. If it were to be placed within the Sheriff's Department it would be a county of Butte operation. Work of the narcotic force discussed. Sheriff Gillick stated he had one position open at the Sheriff's Department. Several sergeants have taken the test for this position; there has not been a review board session on the position. Supervisor Ladd said he would not see the County justifying the deletion of this force; it would be opening the Covnty up to drugs. Sheriff Gillick set out the need For a watch commander at the Butte County Jail. At the present time, there is a night captain to over see the operations of the jail at night. He is one of the people that has the keys to the record bureau. Sheriff Gillick asked the Board if they could see their way clear to make one of the sergeants a lieutenant to relieve the night captain and to relieve the sargaant when they are aff duty, he vwuld appreciate thts. Cost for the reclassification within hts department would be $1,600, approximately. This would assist him in cutting down on problems within the jail. This would be an upgrading of a present sergeant. Request discussed. 1+Ar. Rackerby will bring back a report on this request. Page 114. August 24, 1976 ~ ~ -- ti Sheriff Gillick stated he could shift one of the men in the Narcotic Task Force to head the narcotic task force within his department if the Board requests them to have such a force. Sheriff Gillick also set out the need for a deputy in the Paradise-Magalia area. Chairman Cameron stated he would support more police protection that is requested by the residents of the County. Suggested that maybe service areas should be formed to give more police protection. Personnel at Sheriff's Department discussed. No act[on taken. 76-1435 APPEARANCES: REQUESTS FOR PERSONNEL FOR SHERIFF'S DEPARTMENT TO BE PLACED WITHIN PROPOSED BUDGET p arpenter, Para use Pines, requested additional police protection for the Paradise-Mngalia area. 2. Don Streissand, Paradise Pines, requested additional police protection for the Paradise Pines area. Supervisor Richter said there was a problem with the request for the additional police protection; the farmers will be taxed to pay for these services to people in the rural areas. Requests discussed; no action taken. 76-Id36 APPROVE OFFICE OF ECONOMIC OPPORTUNETY PROGRAM PROGRESS REVIEW REPORT 8 GRANT APPLICATION FOR SOCIAL ELEMENT PLANNING An eva nation o t program year actrvit es as en prepared in compliance with the Community Services Administration instructions and has been reviewed by the Program Committee and Administering Board at its meeting August 12, 1976, An application for $32,397 has been prepared for Office of Economic Opportunity discretionary grant funds in order to prepare a social element to the Butte GountyGeneral Plan. The application has been approved by the Program Committee and Admin istering Board of E.O.C. Supervisor Ladd questioned the benefits that would be derived from this application. Jerry Lively explained the application stating that the staff feels that this may be the time for the County to have a social element. Possible benefits would be to provide an in-depth report for special needs. Social Service Planning would be provided. Advantages of the social element explained. On motion of Supervisor McKillop, seconded by Supervisor Madigan and carried, the following action was taken: I. Approved the OFfice of Economic Opportunity Program progress review report; and authorized the Chairman to sign said report. 2. McCusker was approved, for a period of one year. 7b-1438 ADOPTION OF RESOLUTIONS 76-t43 and 76-144 itlU:fHORIZING TREASURER/ TAX COLLECTOR TO SELL PROPERTY AT PUBLIC AUCTION & SEALED BID AUCTION AS INDICATED Pursuant to venue and Taxation Cade Section 3b94 the Treasurer/Tax Collector requests approval to sell 53 items of property at public auction and eight items of property at sealed bid auction at not less than the .minimum price listing as these properties have been deeded to the State for non-payment of delinquent taxes. Carl Morton, County Treasurer, present to answer any questions the Board might have on this matter. On motion of Supervisor Ladd, seconded by Supervisor Madigan and unanimously carried, Resolutions 76-I43 and 76-144 authorizing Treasurer/Tax Collector to sell property at public auction and at seated bid auction as indicated were adopted and the Chairman authorized to sign. 7b-1439 APPROVE REVENUE SHARING ACTUAL USE REPORT AND AUTHORIZED PUBLICATION Actua and obligated expenditures for the period 7/1/75 through 6/30/76 consists of $883,139 for capital outlay and $414,871 for maintenance and operation. Report discussed. On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimousiy carried, the Actual Use Report, Revenue Sharing, was approved and publication authorized. 76-1440 ADOPT RESOLUTION 76-145 RETIREMENT CONTRACT AMENDMENT A resolution has been prepared to imp ement t first step in amending the county retirement contract to provide a 15% cost of living increase for employ retired prior to July I, 1971. page lib. Fred Hackett, President of the Retired Employees Association, commented an $upervi~r Ladd's statement. Resolution discussed. NOES: Supervisor Ladd 76-1441 APPROVED PERSONNEL SERVICES CONTRACT RENEWAL e services contract tween Butte County an t e State Cooperative Personnel Services will expire September 30, 197b. This contract permits the county to lease examinations from the state. A three year renewal contract is in order. On motion of Supervisor Madigan, seconded by Supervisor Richter and carried, the Personnel Services contract renewal was approved, commencing October I, I97b and Personnel Director was authorized to sign. AYES: Supervisors Madigan, McKillop, Richter and Chairman Cameron NOES: Supervisor Ladd 76-1442 DISCUSSION: MILEAGE REIMBURSEMENT FOR VOLUNTEER LABOR Mi cage ream ursement as en requeste ram o vo unteer war ing under the Butte College work-study program while working for the Probation Department. Current rules do nofi authorize mileage reimbursements for volunteer workers. Mike Pyeatt explained this item. There are some work-experience people that are driving their own automobile. Personnel has prepared an amendment that would provide mileage payment for these people. These people do not receive reimbursement Far their time. The department heads will be encouraged to utilize the County vehicles for these people. Supervisor Richter said he would have to vote "No' as this could establish a precedent. Time spent discussing the mileage reimbursement for volunteer tabor. It was suggested that the board could review specific requests of department heads. Mr. Rr~ckerby will notify the department heads about mileage payments. Request discussed. On motion of Supervisor Ladd, seconded by Supervisor Madigan and unanimously carried, rate increase from $7 to $10 for receiving homes used by the Welfare Department was approved. 76-1446 DISCUSSION: INFORMATION RE: UNEMPLOYED PARENT CASE LOAD INCREASE C airman Cameron commence on t a in ormation sent to t e Boa rom the Director of Welfare about the unemployed parent case load increase, stating that he hoped the Board members would have a chance to look over this information. It was felt that this was an item that should be discussed with the County's Legislators. Hero d We rn, contractor fort Paradise Library Building, stated he had problems that he would like to discuss with the Board. Full payment for the building has been approved. The department in Redding has requested that the Boord withhold $4,500 for penalties. Clne problem that concerned him was an error of the sub-contractor. He read a letter he had written to Cook and Associates relating to payment of hourly rates by sub-contractors. This error in payment of hourly rotes amounts to $429.39. Chairman Cameron said he had called Mr. Hughes in Redding, tt was suggested that a meeting be set up to discuss the withholding of the penalties. Dan Blackstock, County Counsel, recommended that the Board not take action at this time. The County has been directed to withhold this money. The Auditor would not release the money* and the Board is not in a position to release the money. The County has rto recourse but to honor the demands of the State. The Board could, if they desire to, write a letter to them setting out their views on the matter. Mr. Blackstock again recommended that the Board take no action until they receive a report from him. Chairman Cameron suggested that a meeting be held on September 2, 1976 following LAFCO meeting. A full hearing could be held with the public and press present. Mr. Welborn requested that there be a time on the agenda ro discuss the change order. Mr. Blackstock suggested thot both items be discussed on September 2nd.- Page 118. Don Tungate, Associated General Contractors of America, Sacramento, spoke concerning the Tom Hafl Masonry wage rate problem. Bill Brown of the Tom Hall Masonry felt that the appropriate wage had been paid to his employees. Prevailing wage rate for brick layers discussed. Cloy Castleberry, Director of Public Works, reported on the agreement, stating it could be app-oved subject to approval of the Budget. Butte County will have ro contribute $21,600 for this operation. On motion of Supervisor McKillap, seconded by Supervisor Madigan and unanimously carried, the bid for the Pentz-Magalia Highway project was awarded to Robinson Construction Company, the low bidder, in the amount of $36,765.30, transfer of fund authorized to be prepared, within the Public Works Budget, subject to the adoption of the budget. A memo was prepared for the Board regarding this parcel map•as it relates to the General Plan. On motion of Supervisor Ladd, the tentative parcel map, Dixon Hard Chrome Map, based on the Findings of the Commission that it is in conformity with the General Plan. Current rules do not authorize mileage reimbursements for volunteer workers. Mike Pyeatt explained this item. There ore some work-experience people that are driving their own automobile. Personnel has prepared an amendment that would provide mileage payment for these people. These people do not receive reimbursement for their time. The department heads will be encouraged to utilize the County vehicles for these people. Supervisor Richter said he would have to vote "No' as this could establish a precedent. Time spent discussing the mileage reimbursement for volunteer labor. It wos suggested that the Board could review specific requests of department heeds. Mr. Rnckerby will notify the department heads about mileage payments. This error in payment of hourly rates amounts to $429,39, Chairman Cameron said he had tailed Mr. Hughes in Redding. It was suggested that a meeting be set up to discuss the wi#hholdfng of the penalties. Dan Blackstock, County Counsel, recommended that the Board not take action at this time. The County has been directed to withhold this money. The Auditor would not release the money* and the Board is not in a position to release the money. The County has no recourse but to honor the demands of the State. The Board could, if they desire to, write a letter to them setting out their views on the matter, Mr. Blackstock again recommended that the Board take no action until they receive a report from him. Chairman Cameron suggested that a meeting be held on September 2, 1976 following LAFCO meeting. A full hearing could be held with the public and press present.
